RIGHT OF LIFE TENAN1' TO OPEN MINES. The common-law rule that a life tenant was not permitted to open or share in mines does not prevail in Michigan; but a life tenant by dower right is permitted to share in the royalties, as the strict common- law rule is not in harmony with the spirit of our institutions and the policy of our law and would often result in defeating the purposes of dower statutes. Poole v. Union Trust Co. (Michigan), 157 Northwestern 430, p. 432, March, 1916. SALE AND CONVEYANCE. PURCHASE OF ENTIRE ESTATE--FRAUD. A purchase of land where no exceptions or reservations of minerals were made and the land was bought as property, when nothing is excepted and no qualifications or reservations are embodied in the agreement, was presumptively and by common understanding a purchase of the property in its entirety; and the insertion in the deed of a reservation of mineral rights in violation of the contract of purchase and without the grantee's knowledge or consent was fraudulent. RESERVATION OF MINERALS--EXTENT AND EFFECL A reservation in a conveyance of land excepting and reserving to the grantor all coals and mines beneath the surface with the sole right and privilege to remove the same, is not as broad as the grant itself. A contract for the purchase of a mine recited that a deed had been executed by the owner and placed in escrow to so remain until the sum of $30,000 should be paid. The contract provided that $1,200 of the purchase price was to be paid in cash, $800 in 60 days, and the remainder out of 20 per cent of the gross output of the mine, such per cent to be paid in five years unless the vein and value of ore should not continue in depth, in which event the purchaser was to have two years longer to complete the payment of the purchase price. The contract contained other covenants to the effect that the purchasing corporation would fit up a certain specified mill and would continue development work at such rate as to keep the mill in operation if ores sufficiently valuable should be found and in the absence of unavoidable accident. The contract also provided 1/ that abandonment of work for a period of six months at anyone time, except as above, on said property," should operate as a forfeiture of the purchaser's right. In an action by the vendor to quiet the title to the land and to have the contract declared void, the court found that the purchaser failed to perform the work on the property and failed to place thereon the improvements as required by the contract and permitted debts to accumulate against the property, taxes to be levied thereon, and that for more than a year the purchaser had not done any work or labor of any sort upon the mine or premises, and that the contract contemplated development work from the time the purchaser took possession of the property, or at least promptly thereafter, and the fact that no machinery was in place for a year or more after the execution of the contract was a breach of the covenant of continued development, and that the clause in the contract" except as above" does not contemplate a delay in the development resulting from a failure to install machinery, but it means that unless prevented by unavoidable accidents the purchaser shouLdhave no valid excuses for neglecting the work for a period of six months or more.

"CONCLUSIONSThe investigation shows that there are 5 coal beds of major importance in Wyoming County from the standpoint of present production - Pocahontas No. 3, No. 2 Gas, Sewell, Beckley, and Eagle - and 5 beds of minor importance - Pocahontas No. 6, Cedar Grove, Winifrede, Douglas, and Chilton. The Pocahontas No. 3 bed contains the largest remaining known reserves.Known measured and indicated reserves in all beds, based on a minimum thick¬ness of 14 inches and on 1,800 tons per acre-foot of coal in place, are estimated at 2,665 million short tons as of January 1, 1951. Of this total, 2,121 million short tons is in beds 28 inches and more thick. Areas in each bed were omitted from the estimate because available data relative to the bed characteristics are too meager to make an estimate that conforms with the definitions of measured and indicated coal adopted for this study. Should future drilling or development prove reserves in these areas, such reserves should be added to the total estimated reserves.Recoverable reserves of coal have been estimated in beds 28 inches and more thick. This thickness is about the minimum now being mined by hand loading onto conveyors in the Appalachian region. The weighted average recovery for all beds in Wyoming County, as determined by this investigation, is 55.0 percent. This percent¬age is based on the total thickness of coal (less partings 3/8 inch or more thick) in the bed rather than on the thickness of the coal mined. The known recoverable reserves are estimated to be 1,167 million tons as of January 1, 1951.4. Since most of the Wyoming coals are medium- and low-volatile bituminous in rank and expand during carbonization in modern ovens, they are blended with high-volatile contracting coals."

This paper is the first putt of a report giving the results of the Bureau of Mines' twenty-third semiannual survey of motor gasoline marketed in the United States. A companion report, Part II, is in preparation and will give a more detailed discussion of the whole survey. Results of the determination of copper-strip corrosion, color, sulphur content, copper-dish evaporation residue, and gum content as given by the Bureau of Mines steam-oven method will be presented in the second paper, which will also include the prevailing retail price and the tax at the time the sample was taken. This paper deals specifically with data relative to gravity, Reid vapor pressure,' and distillation (method 100.13).6 The samples tested were divided into "competitive-price gasolines" and "premium-price motor fuels," a method of presentation that was begun with the twenty-second semiannual survey. A total of 312 samples were collected from service station pumps in 20 cities throughout the United States. Of this number of samples, 207 were "com-petitive-price gasolines" and 106 were "premium-price motor fuels." All of the samples were collected in March, 1931, and analyzed at the Petroleum Experiment Station of the United States Bureau of Mines at Bartlesville, Okla. "Competitive-price gasoline" includes those fuels that are sold at the generally recognized local base price and all fuels that are sold below that price. All fuels that are sold at an advance over the generally recognized base price are placed in the class of "premium-price motor fuels." These fuels include Ethyl gasolines, benzol blends, "high-test" fuels, and those fuels that owe their "anti-knock" rating to the process of manufacture rather than to the addition of other material such as Ethyl fluid or benzol. The term "high-test" is generally applied to motor fuels that are more volatile than the regular competitive-price gasolines. "High-test" fuels may also have a high anti-knock rating.

The use of explosives to fragment rock generates ground vibrations which may have a detrimental effect on contiguous underground coal mine openings. Increased surface blasting by a burgeoning number of surface coal mines and quarries has caused considerable concern among underground mine operators. Ground vibration effects generated from surface mine blasting are also causing public concern. In response to this concern, the U.S. Bureau of Mines (Stagg and Engler, 1980) has measured and analyzed ground vibrations and their effects on underground and surface structures. Some of the complaints registered against the mining industry are claims of substantial material damage from vibrations generated by the blasting; others are nuisance complaints of minor damage or annoyance. In general, allegations of damage from surface blasting have been sufficiently numerous to constitute a major problem for mine operators engaged in blasting operations. They have recognized the need for more technological data to evaluate the vibration problems associated with blasting. Both the operators and the general public need adequate safeguards based upon factual data to protect their specific interests. The coal mine industry needs reliable information from which to change blasting operations to reduce the number and severity of major damage claims and eliminate the growing number of nuisance complaints. The problem is of major concern not only to coal mine operators and nearby property owners, but also to federal, state and local governments. At the same time, environmental control agencies responsible for blasting and explosives use require reasonable and appropriate guidelines to protect the miners' lives.

The Federal Bureau of Mines made pilot plant investigations of the process requirements necessary to produce heavy fuel oil by the liquid-phase hydrogenation of bituminous coal. The investigation was carried out in three separate series of experiments. The first series studied the effect of temperature and contact time on product distribution at 3,500 p.s.i.g. and 420° to 480° C. in the presence of 0.1 wt.-pct../ stannous sulfide plus 0.05 wt.-pct. iodoform based on gross coal. As a result of increased contact times and temperatures, the conversion-6/ and yield of hydrocarbon gas increased, the viscosity of product oil decreased, and elimination of oxygen, nitrogen, and sulfur from coal increased. The yield of oil did not indicate any definite trend with changes in temperature and contact time. The yield of oil ranged from 76 to 85 pct. for Pittsburgh coal and from 60 to 85 pct. for Rock Springs coal. Asphaltenes in the product oil ranged from 17 to 38 pct. of the total oil for Pittsburgh coal and from 12 to 22 pct. for Rock Springs coal. Fuel oils meeting Bunker C or American Society for Testing Materials (ASTM) Grade 6 specifications were produced with Rock Springs coal at 0.2- to 1.0-hr. contact time and 440° to 480° C. and with Pittsburgh coal at 0.3- to 1.0-hr. contact time and 420° to 460° C. In the second series of experiments tin, nickel, iron, and zinc were evaluated as catalysts for the hydrogenation of Rock Springs coal to heavy fuel oil at 3,500 p.s.i.g. and 460° C. Using the apparent conversion of coal as criterion of catalyst activity, at a contact time of 0.45 hr. tin was the most effective catalyst; nickel and iron were nearly as effective, but the use of zinc resulted in much lower conversion. When the contact time was increased to 0.80 hr., the apparent conversion of coal was essentially the same for each of the catalysts. When the yield of oil boiling below 3550 C. was used as criterion of catalyst activity, at 0.45 hr. the order of activity was tin, iron, nickel, and zinc; at 0.80 hr. tin was far superior and the others were essentially equal. The product oils contained from 8 to 20 pct. asphaltenes.

This report addresses remote monitoring of coal waste impoundments for stability. Existing automated geotechnical monitoring systems are described and reviewed along with details of instruments suitable for such systems. An impoundment in West Virginia which was in the construction stage was instrumented and monitored between July 1979 and may 1981. Sensors which measure surface and subsurface parameters including settlement, horizontal deflection, surface tilt, pore water pressure, seepage, pond level, and meteorological parameters were installed. Data from the 37 sensors were collected by on-site logger and transmitted by telephone to a central processing station in Seattle for recording and interpretation. Difficulties were encountered with telephone and powerline outages and malfunction of electronic units. Detailed descriptions of the design and performance of the system are provided along with evaluation and comparison with other systems. Recommendations for improving and expanding the capabilities of the monitoring system are given.

This paper is one of a series of digests of foreign mining legislation and court decisions that is being prepared in advance of a general report relative to the right of American citizens to explore for minerals and to own and operate mines in various foreign countries. This interpretation of the mining laws of British Honduras has been prepared from the best available information in Washington and is released subject to amplification or correction, if necessary, by United States foreign-service officers. INTRODUCTION The mining law governing all mineral substances other than oil is ordinance No. 7 of 1927 (Minerals Ordinance, 1927), passed by the Legislative Council on March 25, 1927. The accompanying regulations, No. 3 of 1932 (General Minerals Regulations, 1932), made under the authority of section 66 of the minerals ordinance, were made by the Governor in Council on December 23, 1931.

Researchers at the National Institute for Occupational Safety and Health partnered with the water well industry to develop engi­neering control technologies and training products to address noise exposure at the job site. Noise­induced hearing loss continues to be a problem in the well drilling industry. Research con­ducted by NIOSH found that air rotary drill rigs produce sound levels more than 90 dB(A) over the course of an eight­hour workday. Sounds levels above 90 dB(A), identified during hammer drilling and the hammering of casing, exposes workers to levels that can damage hearing. A typical air rotary drill rig provides no barrier, for noise and dust pro­tection, between the drill’s control panel and the drill stem. The development of a partial cab is the clearest example of NIOSH’s research partnership with the water well industry. NIOSH researchers determined that an engineering noise control to protect the oper­ator at the rig’s control panel would be effective, based on typical work site conditions. Many surface rigs do not have full cabs as a result of the original equipment manufacturer design or the high cost of aftermarket products. Developed as a partial cab, the NIOSH engineer­ing noise control design addressed stakeholders’ needs associated with cost, transport, and worker usage (Figure 1). Field tests found the partial cab effective in reducing sound levels at the rig’s control panel, a typical location for a drill rig operator. Sound levels at the control panel were reduced from 104 to 96 dB(A) (Figure 2). Coupled with continued use of personal protective equipment, such as hear­ing protection devices, the partial cab can help to reduce noise exposure. NIOSH researchers created a CD with informa­tion about noise exposure and the partial cab. Most important to well drilling companies is information on how to construct and attach the partial cab to drill rigs. The CD can be viewed on a standard computer and includes a video of the partial cab in use on a work site. Computer­aided design drawings are included on the CD and provide detail of the cab design as well as information on construction mate­rials and design details. Additionally, the CD provides background infor­mation on noise­induced hearing loss and hearing protection devices to increase knowledge about this occupational health concern. This information can be viewed by all company employees to help promote the partial cab’s importance to workers using the cab. More information on the partial cab noise control technology can be downloaded from www.cdc.gov/ niosh/mining NIOSH researchers also examined the health and safety training needs of workers in the ground water industry. It was quickly realized that most workers learn health and safety on the job and do not attend any sort of formal training. In addition, there is not a lot of time for daily “tailgate talks” or “shop talks” on health and safety issues. As a small business industry, the owner is often operating a drill rig along with his other employees. In general, new employees learn the job in an apprentice style sys­tem. As a result, workers and owners have few opportunities to access uniform health and safety information based upon the job — an outdoor work environment with daily change in work sites. With this information, NIOSH researchers devel­oped two products that deliver health and safety information to fit into the daily work of well drillers. "Silicosis is a fibrotic pulmonary disease produced by inhalation of silica-containing dusts (Peters, 1986). Chronic silicosis may develop 20-40 years after initial exposure to crystalline silica, and the disease may progress from a simple to a complicated form. Few symptoms are evident in simple silicosis with pulmonary function being relatively normal. However, chest radiographs reveal small rounded ·opacities in the upper lobes of the lungs. These silicotic nodules consist of collagen arranged in a distinctive circular pattern. As fibrotic changes become more severe, the disease progresses to complicated silicosis (progressive massive fibrosis). Complicated silicosis is associated with shortness of breath and decreases in pulmonary function characteristic ofrestrictive lung disease. Chest x rays reveal numerous large silicotic nodules which may be associated with scar emphysema. Several mechanisms have been proposed to explain the cellular events which result in silica-induced lung damage and fibrosis (Lapp and Castranova, 1993). They include: ( l) direct cytotoxicity of silica, (2) activation of oxidant and enzyme release from alveolar macrophages, (3) recruitment and activation of polymorphonuclear leukocytes, and (4) stimulation of fibroblast proliferation and collagen synthesis.Tetrandrine is a bisbenzylisoquinoline alkaloid derived from the Chinese herb Radix Stephania tetrandra. It has a molecular weight of 622.73 and an empirical formula of C38H420 6N2. The chemical structure of tetrandrine has been published previously by our laboratory (Castranova et al., 1991 a). Its structure is characterized by methoxy groups at C7 and C12 , uncharged nitrogens at N2 and N’2 and two 17-carbon ring members connected by a double oxygen bridge between Ca-C7 and C11-C12. Tetrandrine has been shown to reduce both silica-induced fibrosis and the elevation of lung collagen content in rats (Huang et al .. 1981; Yu et al., 1983; ldel, 1987). Furthermore, tetrandrine has been used as an antifibrotic agent in Chinese clinical trials (Li et al.. 1981 ). Preliminary results suggest that administration of tetrandrine to patients with silicosis results in substantial improvement of symptoms, increases in diffusion capacity, and decreases in the size of shadows on lung x rays."

As a part of its overall program of coal carbonization, the Bureau of Mines is studying the coking properties of coals that may be used for metallurgical purposes. The objectives of this study were given in detail in a previous report The inherent suitability of coal for metallurgical purposes depends primarily on (1) chemical composition, (2) preparation characteristics, and (3) carbonization behavior. The first two factors, Be well as the amount of available reserves, are considered in selecting coals for carbonization tests. The selection of coal beds in Harlan County, Ky., for coking tests was based, in part, on recent studies of coal reserves by Wallace,3/ who estimated the recoverable reserves in beds 28 inches or more thick, in tons, as follows:

"IntroductionThe combined library facilities of the five universities in the Generic Technology Center for Respirable Dust, The Pennsylvania State University, West Virginia University, University of Minnesota, Massachusetts Institute of Technology, and Michigan Technological University, represent one of the most extensive and comprehensive collections of information on respirable dust research which is available in the United States. The Center encompasses two major medical schools, the Milton S. Hershey Medical Center at The Pennsylvania State University and .West Virginia University Hospital at West Virginia University, and includes national and international experts from such diverse disciplines as geology, geomechanics, mining engineering, mineral processing, electrical engineering, industrial engineering, mechanical engineering, material science, physics and several areas of medicine. In order to maximize achievements in research and facilitate early results application in the private industry, university, government and public sectors, a geographically dispersed Reference Center on Respirable Dust has been established at each of the affiliated universities. This network serves to encourage unity between the universities in the Center and coordination and communication with other entities who benefit from their research.Description of the Reference CenterIn this light, the goal of the Reference Center network is to identify at what location Information is available and to provide a means for others to access this information. It is especially necessary to have both ease of input and maximum retrieval capabilities available to all the research personnel in the Reference Center. At the same time, the service provided to the inquiring public must be complete and cost-effective. The Center's approach to realizing this goal incorporates advances in computerized and electronic searching of individual library holdings and the networking of major library and commercial search systems.The Reference Center uses the following means to achieve this goal. At each participating university, a hard copy collection ls maintained of the current respirable dust research in progress by that institution's personnel. Also, available. at each university ls a review of their past and present research on respirable dust. At each participating university a hard copy collection of annual status reports and of all publications produced by Center personnel for symposiums, national and international conferences ls maintained. A key word computer search capability ls available to participating universities. This computer search, by title, author and location, allows researchers to determine at which facility information is available, thus avoiding the tremendous expense and effort of housing all the information on respirable dust research under one roof. The Reference Center has access, through The Pennsylvania State University Libraries system and the libraries of other institutions, to a large number of data bases such as MEDLINE at the National Library of Medicine,"

THE HELIUM ACT (50 Stat. 885; 50 U. S. C. 161,163-166), as amended, places the responsibility for conserving, producing, and selling helium upon the Secretary of the Interior, acting through the Bureau of Mines-the only producer of helium in quantity in the world. It operates 4 plants-I each at Amarillo and Exell, Tex.; Otis, Kans.; and Navajo (Shiprock), N. Mex. The demand for helium has increased steadily since the decline immediately after World War II and is expected to exceed the capacity of the present plants in the near future. The Congress has appropriated $6,000,000 far constructing a new plant. In addition to providing additional capacity to meet increased demands for helium, the new plant will enable the Bureau of Mines to better conserve the helium in, the Government-owned reserves at Amarillo and Navajo.

The design and field testing of a seismic miner detection and location system arc described. This work was carried out over a period of three years. The first two and one-half years were sponsored by Continental Oil Company, while the last period of tests were done as the first part of a one-year contract with the U.S. Bureau of Mines. Laboratory and field experimentation in three different nines under simulated emergency conditions have led to three important results: (1) Taps on roof bolts with normally available objects can usually be detected up to horizontal distances of 1,000 ft. (2) The origin of the tans can be located by on-site processing with a small computer. (3) Some predetermination of the approximate location is necessary for a quick and successful rescue. This report also includes preliminary specifications an,d cost guidelines for construction of a transportable field system capable of matching the performance characteristics of the one used during the field tests.

The effect of load rate on the load-carrying capabilities of wood cribs is investigated in this Bureau of Mines study. The modulus of deformation (stiffness) of wood crib blocks has been shown to increase with increases in rates of load application, causing larger load reactions for increases in convergence rates. Since wood cribs are tested in the laboratory at convergence rates that are orders of magnitude faster than typically would occur underground, wood cribs tested in the laboratory will react larger loads than the same cribs would react underground for the same displacement. Tests conducted in the Bureau's mine roof simulator on green wood crib blocks indicate that the increase in stiffness for increasing load rates diminishes at displacement rates beyond 0.1 in/min, making crib load nearly independent of load rate for rates faster than 0.1 in/min. Seasoned wood specimens were not as con-sistent in load-rate dependency. Some possible explanations of observed load-rate behavior on wood crib specimens are also postulated in this paper.

Pressure-drop measurements through beds of granular iron, lathe turnings, steel wool, and parallel-plate assemblies were made at linear velocity and gas-density ranges expected in the Fischer-Tropsch hot gas recycle process.4/ Equations relating pressure drop, linear velocity, gas density, and bed porosity were derived. The results indicate that the exothermic heat of reaction can be removed at a lower cost by using catalyst beds with high porosity. INTRODUCTION The Fischer-Tropsch hot-gas-recycle process requires a catalyst offering low resistance to gas flow as one condition to economic feasibility. Conventional granular or spherical catalysts used during early development of the process in Germany did not meet this requirement. Large pressure drops across these beds made the cost of recirculating the gas excessive. The Federal Bureau of Mines is investigating the process by using novel and unusual catalysts that offer little resistance to gas flow. Pressure-drop measurements across these types of catalyst beds are discussed in this report.

In the first paper of this series (R. 1. 4333) on the cooperative work with the Eagle-Pitcher Mining & Smelting Co., changes in the nature of the sinter feed were measured by corresponding changes in the retorting temperatures necessary to distill zinc at the best rates; the firing schedules summarized such changes. In this paper, third of the series, are noted same of the changes in practice that were brought about by the need to treat more fused, glassy, and "hard" sinter, as the operators qualify it. Losses of uncondensed zinc were increased by adding zinc-bearing materials from which? the zinc was readily distillable to hard sinter requiring higher-temperatures for zinc distillation. The rates of zinc distillation were increased by grinding the fuel finer; there were few benefits and loss of dust on grinding the sinter finer, unless the fine ?coal and fine sinter were brought into contact by pelletizing, and the pellets made but little dust.

We present an analysis of the propagation in a uniform tunnel of semi -circular cross section that contains two axial conductors. In particular, we show that, even if one of these conductors has high ohmic loss, one of the two propagating modes has relatively low attenuation. This corresponds to the situation where an unloaded dedicated wire is used to improve radio frequency communication in a mine tunnel that contains a heavily loaded trolley wire.

Nine rock properties were determined for rocks coming from 49 locations and having a wide range of compressive strengths. Plots of the nine rock properties versus each other were prepared. A stepwise multiple linear regression analysis was performed to obtain several equations for predicting compressive strength. Both linear and curvilinear relationships were assumed between compressive strength and the other rock properties. The prediction equations had multiple correlation coefficients ranging from 0.947 for an equation with 1 variable (point load tensile strength) to 0.986 for an equation with 25 variables. Of the properties tested only point load tensile strength could be used alone to estimate compressive strength with fair accuracy.
