Our next speaker this afternoon is a good friend of mine of some years. I must introduce him by way of a little story. Now Harris Sherman, many of you know because he was really in charge of everything to do with the mining industry in the State of Colorado for a good many years. Some of you may know that before he became part of Governor, Lamm's first cabinet as Director of Department of Natural Resources, he was an attorney for the Environmental Defense Fund and that caused me considerable panic as I think it might have caused some of you. I have observed Hams from the time he stepped into that office until he retired from that office to go into private practice as the senior partner of Arnold & Porter's Denver office, one of the , nation's most prestigious law firms. Hams is a Colorado native. He's lived here all of his life. He's a graduate of Columbia Law School for his law degree and a graduate of Colorado College down at the Springs for his BA. He has served in state government, but I thought it might be appropriate, since he is no longer in state government, if we used Harris, today, to tell us from a former state official's perspective what the image is of the coal industry from the seat he held in Governor Lamm's cabinet for a good many years. President Robert Wilson opened the meeting at 9:00 a.m. He introduced William A. Bear, General Manager Bear Coal Company, Inc., Somerset, Colorado, who presided over the session. George Nugent, Peter Kiewit Sons' Company, Sheridan, Wyoming, presented a most interesting film "Montana Mine Reclamation." His biography follows: George Nugent first entered the coal business in 1943 when he developed Peter Kiewit Sons' Co.'s first coal mine-Big Horn Coal Company at Sheridan, Wyoming. Since that time he managed an expansion program for P.K.S. in mining that resulted in the development of two other producing mines - Rosebud Coal Sales Company at Hanna, Wyoming and Decker Coal Company at Decker, Montana, in which Pacific Power and Light is a partner. Applications are now pending for a third mine. Black Butte, a joint venture of P.K.S. and Rocky Mountain Energy Company, near Point of Rocks, Wyoming. Nugent is a Past President of the Wyoming Chapter, Association of General Con- tractors, Wyoming Mining Association and Rocky Mountain Coal Mining Institute. He was President of Big Horn Coal Company and Rosebud Coal Sales Company as well as Manager of the Mining Division of Peter Kiewit Sons' Co. and Decker Coal Company when he retired Jan. 1, 1975.

The Rouse Mine, belonging to the Colorado Fuel & Iron Company, earlier known as the Santa Clara Mine, is located at Rouse, Huerfano County, Colorado. Operations at this property started about the year 1899, after the old Rouse mine had been drowned out by a large flow of water coming from the strata underlying the Cameron seam. The present new Rouse mine was opened by a slope on what is familiarly known as the Walsen seam in the Walsenburg district. This slope has an average grade of 12 per cent bearing approximately, south 45 degrees west, and having at the present time a total length of 6300 feet. This seam has an average thickness at that property of five and one-half feet; however, there are sections of the mine where the thickness is from seven to eight feet. The mine has been developed. since the time it was opened on what is known as the Room and Pillar system ; water level entries have been driven right and left off the slope, and in some cases the rooms are driven directly up the pitch; and in other cases entries have been driven with rooms turned on water level courses. The first flow of water of which we have ally record was encountered in 1901 in what was called the "Second West Entry." This flow, however, was small, and did not require the installation of any large pump unit. From 1901 up until 1909 the flow increased normally as the field was developed. In January, 1909, the first large inflow occurred, coming from a break in the seventh west entry, making a total flow at that time of about 500 gallons per minute. This necessitated putting in larger pumps, and the first pump to be installed of the centrifugal type was a 600 gallon Worthington. By the year 1911 the water had increased, due to additional development, until it was found necessary to install an additional 600 gallon Worthington centrifugal type pump. In December, 1912, a break occurred in the eighth west entry, between the fourth and sixth cross entries, making 2000 gallons per minute. This flow decreased after a period of three weeks some 500 gallons, but on account of the quantity of water then being handled at the mine, and in view of the fact that we needed some reserve pumping equipment to take care of these flows, and additional 600-gallon Worthington centrifugal type pump was installed in June, 1913. An the latter part of 1914 a 250 gallon Reese roturbo was installed to take care of the water, which was being made in the lower workings of the slope. We found after the installation of the centrifugal pumps that the water decreased to a certain degree in the uppermost workings. This led us to believe that the field was being drained, more or less, and the head reduced ; however, our ideas in regard to this were again upset in December, 1915, when we encountered a flow in room 6 off the first cross entry on the ninth east entry. This flow was not as large as previous flows had been, but made 200 gallons per minute.

Gentlemen : It is a pleasure to come to Glen- wood Springs to participate in this meeting of the Rocky Mountain Coal Mining Institute an organization created to handle chiefly the economic questions dealing with the coal industry of the Rocky Mountain District. I am not unmindful of the many and varied problems confronting the mining industry of this country which is so general at the present time throughout the United States. By reason of the difficulties experienced in marketing the product of your mines, there is all the more reason for greater economy and efficiency in production. No industry can be efficiently operated without giving due consideration to the safety of the employees. Safety and efficiency are inseparable for the success of any industrial enterprise. While the Bituminous coal companies of the United States are doing splendid work in the promotion of safety, yet our fatality rate is exceedingly higher compared with that of foreign countries, and with greater cooperative organized effort on the part of mine owners, mine officials, mine workers, and state and federal governmental agencies having jurisdiction, much more substantial progress can be made in the future and a greater economic saving .to the industry effected, not taking into consideration the greatest and most important phase of safety, which is the conservation of life and health of all those who are engaged in the occupation of mining. You are concerned with freight rates, marketing of coal and similar operating problems. The subject of my few remarks addressed to the Rocky Mountain Coal Mining Institute, "Guessing or Knowing! Which," may perhaps suggest but little to you here today. However, I am sure you will all agree with me when I say that in the conduct of a coal mining operation there should be no choice between guessing and knowing. The value of, and the results to be obtained from this Institute, its meetings and printed transactions, as well as those of other similar educational organizations, depend very largely on the mental attitude of those who constitute, through their pronouncements, the more active portion of the membership. Perhaps the most apt criticism that is now being made of the coal industry is that, to an extent possibly exceeding any other industry of similar magnitude and importance, it depends for its conduct altogether too much on "rule of thumb" and "tradition," rather than on proven practice and actual fact. The records of our coal mining association meetings bear expression of many conflicting opinions, the majority of which are sincerely put forth by those expressing same as representing the facts; the extremes expressed, however, frequently fix the question raised as one yet located in "no man's land." There are yet too many chances taken we are still "weighing pounds on railroad track scales" and measuring yards with the proverbial "bit of string." The actual expense of conducting any one of the several operations incident to the production of coal is rarely determined, and in many instances the general cost figures, prepared some weeks after the work is complete, are of that sweeping character that very little can be abstracted therefrom. Many coal companies are now making a daily cost sheet, showing the cost of labor and material in detail, as used in the several related operations,, and such is decidedly helpful, particularly to the mine superintendent and his foreman, who, without such, sail an uncharted sea; the auditor's belated monthly summary rarely ever seen by these men who are held responsible for the labor and material used. I have made reference to this situation as an accentuation of the fact that the coal industry contains more "serious minded, conscientious guessers" than does any other similar industry, although the annual cost of our product runs up well beyond the billion dollar mark, and what is more important, our industry is one that still continues to exact a heavy toll of human life. Now this brings me to the question of safety, the one question that should be, and which is, I know, uppermost in your minds. The coal mining world, engineering and operating, is now well sold on at least two things the theory of using permissible explosives and the elimination of the open light. Furthermore, the industry, particularly that portion which is located in Great Britain and the United States and Canada, are now planning vast extensions of the use of "rock" or "shale dust," both in the form of "dust barriers" and in "direct application" to entries and cross-cuts. This is well; however,, my study of past mine explosions has convinced me that the great majority of such had their very beginning in gas accumulations; frequently originating in restricted areas at the working face, in abandoned worked-out areas, or in some other certain place where ventilation is not, maintained as it should be; and that again leads me to the point where it can again be well said, that there is too much "rule of thumb," too much guessing now being done in regard to the volume of air required, and continuously furnished, in a given entry,, panel, room or area. Just to emphasize this situation, is it not a fact that the majority of mine inspectors express the ventilation conditions as measured by them, in terms of cubic feet per man employed, in each certain split, and does not the mining laws of many states yet demand a minimum of "100 or 150 cubic feet

When the writers were asked to prepare a paper on this subject for this meeting of the Institute there was some question in our minds as to what to say that would be of interest to the members. You all know that Utah has some wonderful seams of good coal, on which have been opened some of the most modern mines in the United States, and that her coal operators have been putting forth many efforts to reduce losses due to accidents as well as disease. While I believe that the physical condition of Utah's mines is as good as in any other state we are not unaware of the fact that a great deal can still be done and we are always willing to frankly discuss the accident situation in the state. Dr. Murray has assembled some interesting figures showing the monetary loss due to accidents and disease which I will will proceed to give you to show the necessity of continued efforts in welfare work regardless of humane considerations.

Preceding the regular meeting, "Harvest from the Sky" was shown, an action-packed movie demonstrating how man and machines provide Denver with water. This vividly colored picture illustrated the magnitude of the job, highlighting the construction scenes at the 23-mile Harold D. Roberts tunnel, many scenes of which were taken underground at the face. Presiding was Mr. John Peperakis, Alanager, Sunnyside Operations, Kaiser Steel Corporation, Sunnyside, Utah, who called the regular meeting to order at 9:30. Mr. Peperakis introduced Mr. Otto A. Wiesley, Chairman, Industrial Commission and Utah Labor Relations Board, Salt Lake City, Utah, who spoke on "Functions and Policies of the Industrial Commission of the State of Utah." It was with obvious pride that he discussed the Medical Panel in use and the successful operation of the Indus- trial Commission in Utah, stressing the fact that the most important word in their vocabulary was "cooperation." His speech of welcome to the Institute follows: The President's Remarks Guests and Members of the Rocky Mountain Coal Mining Institute: It is my privilege and pleasure to welcome you to the 56th regular meeting of the Institute. A look at the program will show that the various chairmen and their committees, headed by General Chairman A. Z. Dimitroff, have been hard at work to prepare a program which I am sure you will find to be informative as well as entertaining. I think that a special vote of thanks and appreciation is due Glenn Sorensen, who stepped in to head the Program Committee when Clint Cornelius moved from this area.

Modern civilization is centered around a small group of essential occupations, the three principal ones which are agriculture, mining and manufacturing. Agriculture might be called the most important of the three, as it has to do directly with the supply of food for the human race. Mining, however, is certainly next in importance, as it furnishes the supply of fuel and many of the raw materials used in manufacturing. Without mining, modern machinery and many industrial operations would be impossible. Mining takes advantage of the, natural resources in fuel and minerals that lie underneath the surface of mother earth, and while at times some of these metals are hard to find and mines come and go, mining must continue to increase. Mining is no longer a haphazard proposition but one calling for careful study and complete plans of operation for years to come. The shafts, power houses, rock dump crusher, concentrator, and other machinery must be located advantageously in order to enable owners to make a profit. Many tons of rock or mineral must be mined frequently to get one ton of concentrated metallic ore or metal itself. Economy in mining is just as essential as it is in manufacturing. The mining engineer of today is called upon to utilize every branch of engineering, and not only, is a wide: range of knowledge required, but ingenuity to meet the unusual conditions which are constantly arising from week to week. On account of the wide variety of information required by the mining engineer, some things with which he is in almost daily contact may be passed over with only a small amount of attention, provided everything is going well, in order that time and attention may be focused on what might be termed the more important features of mining operations. Because competition has become keener than ever, owing to overproduction at times of certain minerals, it becomes a matter of first, importance to understand as far as possible the factors which enter into the cost of production of any mineral which may be mined. In such times of overproduction, the high cost mine is forced to close down while the low cost mine may, if desired, be kept running constantly. In keeping a cost record, wire rope on account of its high first cost 19 coming into the lime light, and a comparison of records of one mine with another is now frequently made in order to see whether the rope service is satisfactory or not. Every rope maker, on the other hand, is interested in seeing that the rope which he produces gives the maximum possible return for the money invested. Modern mining owes much of its success to the use of wire rope for hoisting materials from beneath the surface of the ground. Deep mining would be impossible without the use of wire rope as a means of hoisting. A study, therefore, of rope problems in mining work and a discussion of the points which are beneficial to maximum life will enable the mining engineer, manager, or superintendent to keep his costs down to the minimum while at the same time he provides a suitable and sufficient safety factor for operations at all times. Mining might be defined as the extraction of coal, metallic ores, or minerals from below the surface of the ground. The morning session opened at 9:00 a.m. and was presided over by Mr. Don Ross, Manager of Mines, Kaiser Steel Corporation,- Sunnyside, Utah. The first speaker was Mr. S. W. Zanolli, Partner in Law Firm of Webster and Kilcullen, Washington, D.C. Mr. Zanolli was born and raised in a coal mining community of Fredericktown, Washington County, Pennsylvania. He was educated at Washington and Jefferson College and graduate schools of the University of Pittsburgh. He served as an infantry officer in the European Theatre of operations during World War 11. He worked as' a handloader at Vesta No. 5 Mine of Jones & Laughlin during summers while attending Washington and Jefferson College. He worked at a variety of production jobs at No. 7 Mine. of Island Creek Coal Co. of Holden, West Virginia. Assigned to a variety of industrial relations assignments at Island Creek Coal' Company during 1949-51, attaining position of Supervisor of Personnel and Labor Relations. Served in many industrial relations assignments at U.S. Steel Corp. headquarters during 1953.-1967, attaining a position of Personnel Director-Heavy Products Operations. In January, 1968" he became a member of the Bituminous Coal Operators Association-as Executive Vice President. This past year he went back to practicing law and is a member of the Law Firm of Webster and Kilcullen, Washington, D.C. He is married and has five children.
