George B. Brennan, Secretary-Treasurer, Imperial. Coal Company, Denver, Colorado, opened the third session of. the Sixtieth Regular Meeting of the Rocky Mountain Coal Mining Institute at 8:30 a.m., and introduced the first speaker of the morning with the following remarks: It is a pleasure to welcome you here this morning. We are indeed fortunate to have such excellent speakers this morning, some of the outstanding people in the mining industry. I know I express the feelings of the entire RMCMI when I say thanks to these excellent speakers for all of the time and trouble they have taken to prepare such talks and come here to give these presentations of some of the more modern developments with which we in the coal mining industry are concerned. The first speaker this morning is going to give a paper on a subject which has only recently caused one or two of unfortunate accidents. It hadn't, prior to this, been considered such a serious problem. However, the. Bureau of Mines is hot on the trail to insure there will be answers to this previously somewhat unrecognized difficulty.

PRESIDENT LITTLEJOHN: Before we open the discussion on the Utah mining laws, I want to bring out what I consider a slight misunderstanding on some of the things that I said this forenoon relative to our comparison of accidents. I did not mean to infer that we, as mine officials, are satisfied we have done the best we can to eliminate the accidents, when I was talking about a four-to- one comparison. I do not want any- one to get the idea in their heads that I do not think we are doing all we can. There is not any of us who can state that, even if we better these figures. It is the general understanding that these figures are based upon ratios per thousand man shifts and not upon the tonnage basis that we use. If it were based upon a tonnage basis, I think the figures would be pretty nearly reversed, for we are producing from two to four tons more per man than they do in Great Britain. The discussion will now be continued as I said this morning. There is a gentleman in the audience here that is as guilty of making these laws as I was, and I am quite sure when speaking he will confine himself to the subject of Utah Mining Laws and the prospective results. Before Mr. Monay starts with his paper, I want it understood that this discussion must be finished by 2:30 for the reason that we have still quite a lot of business before us this afternoon.

President Robert Wilson opened the meeting at 9:00 a.m. He introduced William A. Bear, General Manager Bear Coal Company, Inc., Somerset, Colorado, who presided over the session. George Nugent, Peter Kiewit Sons' Company, Sheridan, Wyoming, presented a most interesting film "Montana Mine Reclamation." His biography follows: George Nugent first entered the coal business in 1943 when he developed Peter Kiewit Sons' Co.'s first coal mine-Big Horn Coal Company at Sheridan, Wyoming. Since that time he managed an expansion program for P.K.S. in mining that resulted in the development of two other producing mines - Rosebud Coal Sales Company at Hanna, Wyoming and Decker Coal Company at Decker, Montana, in which Pacific Power and Light is a partner. Applications are now pending for a third mine. Black Butte, a joint venture of P.K.S. and Rocky Mountain Energy Company, near Point of Rocks, Wyoming. Nugent is a Past President of the Wyoming Chapter, Association of General Con- tractors, Wyoming Mining Association and Rocky Mountain Coal Mining Institute. He was President of Big Horn Coal Company and Rosebud Coal Sales Company as well as Manager of the Mining Division of Peter Kiewit Sons' Co. and Decker Coal Company when he retired Jan. 1, 1975.

Dear Mr. Pryde: In accordance with suggestion in your letter to me of June 21, 1923, Mr. Roberts, Mr. Dalrymple and I had a meeting and attached find our contribution to the proposed August report of the Committee on Safety. You will note that we have confined ourselves to matters in connection with explosions and prevention of explosions, in coal mines. If the committee is to report on general safety in coal mines, including accidents from haulage, timbering, rock falls, electricity, etc., we would like to suggest that you ask other members of the committee to specialize on one or more of these subjects. Especially we believe it would be advisable to specialize as to precautions against electrical accidents with giving of data as to maximum voltage, precautions to be taken as to gas ignitions by mining machines at faces, best methods of placing power wires underground, etc.; also give information as to up-to-date safety installations, such as whistle devices notifying of disarrangement of ventilation or devices for quick cutting off of electrical power from mines under certain conditions; also give data as to efficient safety man cars on various pitches, etc. Yours truly, D. Our next speaker this afternoon is a good friend of mine of some years. I must introduce him by way of a little story. Now Harris Sherman, many of you know because he was really in charge of everything to do with the mining industry in the State of Colorado for a good many years. Some of you may know that before he became part of Governor, Lamm's first cabinet as Director of Department of Natural Resources, he was an attorney for the Environmental Defense Fund and that caused me considerable panic as I think it might have caused some of you. I have observed Hams from the time he stepped into that office until he retired from that office to go into private practice as the senior partner of Arnold & Porter's Denver office, one of the , nation's most prestigious law firms. Hams is a Colorado native. He's lived here all of his life. He's a graduate of Columbia Law School for his law degree and a graduate of Colorado College down at the Springs for his BA. He has served in state government, but I thought it might be appropriate, since he is no longer in state government, if we used Harris, today, to tell us from a former state official's perspective what the image is of the coal industry from the seat he held in Governor Lamm's cabinet for a good many years. MR. MARGOLF: Thank you very, very much Harris. There's sure a lot there to think about in terms, of our image, particularly. I think we should keep' in mind what Harris said about our history not being monolithic. Therefore our image can only be that, which is reflecting the weakest link in our industry and I think that's a burden on all of us. Perhaps to do some policing amongst ourselves to try to improve whatever might be our weakest link and thereby elevate our entire industry. Our third speaker this afternoon is another good friend of mine of long standing and I am very pleased to be able to introduce to the Rocky Mountain Coal Mining Institute Bob Golten. Bob is a graduate of the University of Michigan with a degree in Economics and Harvard Law School. His professional experience encompasses private practice in Chicago where he was born and in the federal government as a public defender in Washington, D.C. and in the Department of Justice as a tax , attorney. Some of us have come to know Bob more in his present role as the senior counsel for the I National Wildlife Federation. He's also Adjoint Professor of Law and Director of the National Wildlife Federation Resource Clinic, University of Colorado. Boulder campus. In addition, Bob has served with the Rocky Mountain Center on Environment as one of its directors for a number of years. He's very active in a number of areas that are not only civic but he does reflect what I would present by way of introduction as a perspective

MR. DICKINSON: There is an increase of dust in machine loading, especially with the McKinlay loading and cutting machine which was extremely dusty. MR. FORRESTER: Declared more dust must be expected because when loading by machinery, the coal is shot harder in order to make it easier for the machine to pick it up. He believes however, that there was less hazard because of the closer supervision possible by reason of the concentration of operation. MR. McAULIFFE: Machine loading more dusty than hand loading. D. HARRINGTON: The hazard is greatly increased by modern methods of loading. Not only do the methods increase the quantity of dust, but they also increase the rapidity of mining and the increased quantity of coal broken down causes large quantities of gas to be released. The number of motors on loading machines and conveyors add to the hazard. No more dangerous places can be found for such motors than at the working face where there is excessive quantities of pure coal dust and where there is more gas than along any other point. Regarding Mr. Herres remarks that the machine loading was safer on account of the concentration and possibility of close supervision, Mr. Harrington said he believed concentration likely to prove a source of danger rather than its preventive. At Dolomite, Alabama, a number of men had assembled, and as a result what was a relatively small explosion killed a large number of men. Concentration is not without its dangers to mine operations. MR. McAULIFFE: These arguments do not appeal to me. Few places are better sprinkled than the working places in a machine loading mine. There is. more effective supervision, and there can be more ventilation. I believe machine loading will increase safety by that very concentration that Mr. Harrington deplores.

Shubart: George Delamater of Fort, Lauderdale, Florida scads greetings to his friends here at the meeting. O. F. Lewis: Thank yon, Stan. This morning we will start our meeting by turning it over to a very distinguished gentleman. I'm sure all of you know him. He started his work career many, many years ago, but lie doesn't look nearly this old, and his energy belies this. From 1.910 to 1916 he was a chemist with the American Smelting & Refining Co. at. Garfield, Utah. From 16 to '17 he was a broker with J. A. Hogle Company at Salt Lake. From 1917 to 1948 he was a metallurgist, ore buyer, assistant manager and later general manager of the Utah department. ASRC at Salt Lake City; and also president of the Garfield Chemical Co. Since 1951 to the present. time he has been President and General Manager of the Independent Coal & Coke Co. and Vice President of the Western Rock Bit Co. He has held many, many honorary positions; former Chairman of the Board of Regents of the University of Utah, former President of the Salt Lake Winter Sports Association, Past President. of the Community Chest there, and is presently a Director of National Coal Association, a Director of the First Security Bank of Salt Lake City, Utah, and also a Director of the Hotel Utah.

Twentymile Coal Company?s first longwall face in the late 1980?s was oriented approximately 45 degrees to the major coal cleats and 45 degrees to the primary horizontal stresses. This combination of stress and coal cleating resulted in frequent violent bursts of coal along the longwall face. The bursts created particles of sufficient size and force with the potential of causing injury to employees and occasional damage to shield components. Partial web cutting was subsequently developed in an attempt to relieve the stress on the coal face and required the shearing machine to travel to the tailgate and back for a full 36 inch web. The partial web cutting pattern is focused on first cutting the lower 90% of the seam to relieve the stress as the shearer travels from the headgate to the tailgate. The web depth during the headgate to tailgate pass is typically in the range of 70% to 80% and varies with conditions to maximize production rates. The top and bottom of the seam in the remaining 20 to 30% of the web are then cut out to allow the shields and face conveyor to advance. 100% of the web is cut at each gate end for a distance of approximately 19 shields. This paper addresses some general mine geology and the procedures and benefits of partial web cutting with respect to safety, production and maintenance on a high production longwall face.

Dear Mr. Shubart: At your request, am submitting to you several suggestions for the amendment of our safety code which you felt should be kept up to date. As before, am advising you that these suggestions do not have the approval of the entire Safety Committee, but rather are the individual opinions of several members who have expressed their wishes in the form of letters to me. I am particularly indebted to Mr. Dan Harrington and Mr. Wm. Littlejohn for their assistance. Would recommend the following amendment a to the various sections. Section 1. Wherever possible trolley wires should be securely hung to roof or timbers at a distance of not less than five feet and not more than six and one-half feet above rail and six inches to one side. Spacing of hangers should be from 20 to 25 feet apart. Section 2. 500 volts D. C. should not be allowed in any installations. Trolley wires should not carry a voltage of more than 250 D. C. Pumps, mining machines and other small machinery units where A. C. power is used should not carry a voltage of more than 220. Large units, such as pumps, motor genera- tor set and hoists, may use a voltage of 2,200. When power cables to operate same are of armored construction, cables should be securely buried at all crossings. Section 4. Where power lines pass through door frames or stoppings they should be properly insulated with porcelain or rubber tubing. Whenever men get on or off man-trips in vicinity of trolley wires same

Gentlemen : It is a pleasure to come to Glen- wood Springs to participate in this meeting of the Rocky Mountain Coal Mining Institute an organization created to handle chiefly the economic questions dealing with the coal industry of the Rocky Mountain District. I am not unmindful of the many and varied problems confronting the mining industry of this country which is so general at the present time throughout the United States. By reason of the difficulties experienced in marketing the product of your mines, there is all the more reason for greater economy and efficiency in production. No industry can be efficiently operated without giving due consideration to the safety of the employees. Safety and efficiency are inseparable for the success of any industrial enterprise. While the Bituminous coal companies of the United States are doing splendid work in the promotion of safety, yet our fatality rate is exceedingly higher compared with that of foreign countries, and with greater cooperative organized effort on the part of mine owners, mine officials, mine workers, and state and federal governmental agencies having jurisdiction, much more substantial progress can be made in the future and a greater economic saving .to the industry effected, not taking into consideration the greatest and most important phase of safety, which is the conservation of life and health of all those who are engaged in the occupation of mining. You are concerned with freight rates, marketing of coal and similar operating problems. "We have ourselves to blame in the steel industry for our condition." These words were addressed twelve days ago by James A. Farrell, President of the United States Steel Corporation, to his "comrades" at a meeting of the American Iron and Steel Institute. They carry a note of challenge to all industry, and particularly to the coal industry, where they point the way to the pressing need for operators everywhere to get their feet under one table. It is that note which I would stress to all producers. You have yourselves to blame for your condition. True, there are inter-district competition and competition of substitute fuels, but they'll always be with us, more or less, and the only sensible, sane course is to remove the evils within our respective districts, which can be done only by constructive effort along cooperative lines. It's the same story in Alabama, the same in Illinois and elsewhere. The larger number of the men gathered here are at the front, as it were, in the business of mining coal. They are the men who are doing a remarkable operating job. And naturally, the sessions of this annual meeting treat of news from the front, of technical problems. But, as in actual warfare, those at the front are often uninformed of developments in the rear. They keep on fighting without fully sensing the significance of a disaster at headquarters. You've played your eighteen holes today and evidenced the efficiency of your technique in the, production of coal. It is not amiss to take advantage of this moment, the nineteenth hole, to ponder over what it's all about. After all, what do improvements in the art of mining mean if business policies engulf you in red ink? To the extent that mechanization is a factor in increased overhead, which in turn increases the pressure to produce regardless of market demand, it only aggravates our troubles unless there is the controlling influence of coordinated effort.

The question of disposition of the slack and dust so troublesome to coal mine operators of the West has been divided by your committee chairman into three heads, viz: The preparation and transportation of fine and powdered coal. The developments along the line of low heat carbonization. The uses to which fine and pulverized coal have been put. The development of low heat carbonization has been assigned to me. This is really not a part of the subject but as it has a most important bearing on the future use of coal, I presume the chairman thought best to include it. An English committee on smoke abatement makes the statement that the burning of raw coal is "dirty, wasteful and unscientific". I will go a step further and characterize it as an "economic crime." It has been predicted by eminent scientific men that eventually no raw coal will be burned for heat or power purposes. All this will take time, experimentation and large expenditure, but it will surely come. The question of disposition of slack and dust so troublesome to coal and utilization of its by-products has been retarded by the abundance and cheapness of the raw coal, and by the abundance of suitable coking coals for metallurgical purposes. But necessity is surely, if slowly, demanding that the enormous waste ensuing from the burning of raw coal for heat and power must cease. For instance, smoke abatement investigations in Manchester, England, showed that the increased cost of household washing was about $1,250,000 per year due to smoke and soot. It is estimated that in London 200 tons of soot and smoke particles are suspended in the atmosphere over that city during dense fogs and that much more than this is emitted from the chimneys each winter day during the forenoon. As an example of what benefits a smokeless fuel gives, it is cited that in the mill town of Shaw, England, the burning of smokeless fuels in the factories has reduced the so-called fogs by about 80%. At the time of mine accidents one frequently hears the expression "there will be accidents as long as there are mines", or it may be varied to state that the accident in question was unavoidable, or something similar indicating inability to prevent accidents. However, it is the opinion of the writer, after over twenty-one years experience in both coal and metal mining, seven years being spent wholly in safety work, that by far the greater number of all accidents is due to carelessness or negligence. This carelessness or negligence may be on part of the victim of the accident or of one of his companions, or on part of his employer or possibly even of the inspector or safety man, and in some cases all of these agencies are involved. It manifests itself in various guises, one of the most serious being violation of state mining laws or regulations or of mine rules, and frequently the rules of ordinary common-sense. The cause very frequently is that trait in human nature to "take a chance" and it has been the writer's observation that the worst offender is the old-time miner who has come safely through many years experience, who was mining when the "safety man was a baby", and who clings to old-time ideas and practices and has "no use" for "newfangled" present-day "notions". Unquestionably, there are accidents, wholly unavoidable and many are caused by ignorance and by the new-comer in mining, yet as previously indicated, the writer's observation is that the old-timer is by far the worst offender, bringing grief to himself, companions and employer. Of the numerous manifestations of carelessness and negligence in connection with mine accidents, which have come to the notice of the writer, only one will be treated in this paper, viz: Violation of State Mining Law, and mention will be made only of explosions and major accidents in coal' mines with which the writer came in personal contact as investigator. In most cases, in addition to mine inspection after the accident, the writer heard the evidence given at Coroner's inquest and thus was enabled to for¬mulate fairly definite impressions as to events and conditions leading up to the occurrence.

The labor turn-over at coal mines has long been a fertile subject for parade by complaining coal operators, the question invariably occupying a place of prominence in the list of disabilities that tend to increase the cost of producing coal, adding likewise to the now startling number of accidents that occur in coal mines. This disability, however, is like the weather question, which some humorist once remarked of by saying, "The weather is something we all talk about, but nobody does anything to improve it." Endless compilations covering the shift of employment by coal mine labor have been made and published, and while the actual loss expressed in cents per ton in cost of coal produced has never been determined, the fact remains that such represents a substantial item, taking the mines of the country as a whole. Efficiency engineers who have made studies covering the cost of breaking in and training each new man employed in certain manufacturing industries, fix same as averaging not less than $100.00 per man, and when the character of mine employment is given due consideration, including its ever-present hazards, the difficulty of close personal super- vision of individual employes, and the, at times, almost impossible ability to transmit to men of many diverse nationalities understandable instructions, it is quite safe to say that the cost of securing and breaking in new men for underground mine work will fully equal that suffered by the factory managements. When we speak of mine labor turnover we must necessarily exclude the enforced shifting about of men who are laid off by the closure of mines due to accident or lack of market, con- fining ourselves to the turn-over occasioned by- (a) the dismissal of individual men or groups of men; (b) the voluntary resignation of the individual workman. It is these two methods of severance that the employer and employe alike suffer from; the item "Unclaimed Wages" carried in the accounts of every large coal company illustrative of the "quit this job, get another one" attitude of many workmen, who frequently, when leaving, fail to claim small sums due them, while others, in turn, leave a train of debts, large and small, behind.
