Just prior to the close of the century, the Federal Mine Safety and Health Review Commission issued its long-awaited decision in Berwind Natural Resources, et al v. Secretary of Labor, to usher in the new millennium. The case arose as a result of a mine explosion in Eastern Kentucky resulting in MSHA’s issuance of 225 citations, not only to the contractor, but to four affiliated entities of Berwind Corporation. While an Administrative Law Judge dismissed those citations as to three of the Berwind entities, both MSHA and the remaining Berwind entity appealed the case to the Commission. Although the Commission effectively left intact the Administrative Law Judge’s decision, it announced a new theory of liability that would apparently be applied in the future, namely the Unitary Operator Theory. This presentation will provide an in-depth look into the Berwind decision and explore the means under which MSHA might impose liability for contractor violations upon other entities in the future.

The choice of ventilation schemes in the Northern Mujsky railway tunnel and definition of the nec-essary quantities of air ensuring regulated radiation conditions in the tunnel system has been accomplished. The influence of natural draught on the stability of tunnel ventilation has been estimated. The design of a portal venti-lation gate allowing minimal influence from natural factors is described. The dependence of pressure loss in the sliding ventilation gates on their spanning value of the vehicle tunnel section has been determined. The selection of parameters for an atmospheric air heating system in winter has been carried out. The operation regimes of air heaters, dependent on the temperature of atmospheric air, have been established.

A study has been conducted to control iron in copper electrolyte streams using Eichrom Industries’s new Monophosphonic /sulphonic acid resin. The resin strongly and selectively extracts ferric ion over copper and cobalt from highly acidic copper electrolytes. The resin has a loading capacity of 27 g/L of iron and can be readily regenerated. In addition, the new resin can be easily synthesized using commercially available starting materials. This paper presents the experimental results for iron control in copper electrolyte streams using the new resin and discusses its potential applications to other hydro-metallurgical streams.

There are many different machine setup parameters and variables that affect the production of cone crushers in a mineral processing plant. One of these variables is the eccentric speed at which the cone gyrates. In June 2012, pilot tests were conducted on a 200 hp high speed cone crusher to determine the production and operating conditions over a wide spectrum of eccentric speed. Every plant will have variations in the ore characteristics and feed rates throughout the life of the mine, and at times throughout a single shift of operation, which result in non-optimal use of the crushing energy and inconsistent process control. For high speed cone crushers, the crusher will exhibit a different capacity, power required, and discharge size distribution as the speed ranges over the design limits of the machine. This study documents the measured variation in production and energy efficiency both when the crusher was ran at full capacity as well as when the feed to the crusher was not sufficient to run at full capacity. Overall, the results match theory and the capacity and power fluctuated by 25% and 17%, respectively, over the speed range when operated full while there was an overall trend of slightly coarser discharge size distribution as the speed decreased. The results with the fixed feed rate were more telling, as the crushers had 4-14% higher production when making a theoretical minus 12.5 mm product when operating at the optimal speed as compared to the worst speed in the ?typical? speed range for this application. Secondary analysis of the fixed tonnage testing also showed that the power draw was more consistent with lower magnitude spikes at the higher speeds (higher cavity level), as on average the standard deviation of the power draw increased from 7% to 18% and the peak power spikes from 20% to 48% over the speed range tested. The findings lay groundwork for more efficient plant design. Varying the speed of the crusher can be used to tune the crusher speed during commissioning, adapt to changing ore conditions over long periods of time, or be used as a dynamic input into an advanced control system. Each action above would serve to make the crusher(s) more productive and more energy efficient, and would also have mechanical benefits for the machine. Mining and processing activities which are proposed on private land, state leases, or unpatented mining claims are governed by numerous local, state, and federal laws which identify the procedures and conditions which must be met before resources can be developed. The respective government agencies responsible for the administration and enforcement of these laws have promulgated supporting regulations and guidelines, and have implemented certain permit and approval processes to ensure compliance. Each exploration project has a unique environ- mental setting and location which further dictates the types of air, water, hazardous waste, and wildlife laws and regulations which must be complied with before development commences. The environmental planning process should be the first step in the evaluation of existing company properties and the potential acquisition of other mineral properties. However. many company don't consider the environmental requirements for a project until the decision is made to develop the property for mining and processing. If a mining company wants to expedite the environmental planning process, it must first develop an in-house process for evaluating the project and determining the environmental approval procedures in the state where the project is located. The first stage of environmental planning involves general information which can set the overall company philosophy for development of projects.

The ability of computers to create synthetic representations of the real world in virtual reality offers a number of opportunities to enhance training methods used in the mining industry. Unfortunately, the training effectiveness of virtual reality systems currently used in the mining industry has received only limited testing. Miner Simulation (MinerSIM), an augmented reality system with integrated hypermedia suitable for training underground miners in the basics of using a jackleg drill to install rock bolts in a virtual mine environment is in its evaluation process at the University of Missouri-Rolla Experimental Mine. This paper discusses evaluation methodologies of the MinerSIM system, which consists of experimental and control groups with control students learning via traditional lecture and text formats. Preliminary results from usability tests of the first part of MinerSim, which is an online tutorial on underground rock bolting, are presented.

This paper presents tunnel design considerations for the SR75/282 Transportation Corridor Project in Coronado, California. The project is managed by the City of Coronado in cooperation with Caltrans and the US Navy and may include a one-mile long twin-tunnel section with two options: a 36.5 foot diameter twin-bored tunnel or a twin cut-and-cover box. The alignment crosses the Coronado Fault, and design provisions were needed at the fault crossing to maintain life safety and prevent rapid inundation of the tunnel in the event of fault rupture. These provisions are discussed along with considerations related to liquefaction and ground shaking. The project is currently in the planning stage with construction to start around 2012.

Combustion processes, comminution and materials handling can generate airborne particulates. Regulation of these particulates by the U.S. Environmental Protection Agency (U.S. EPA) is becoming progressively more stringent, and regulations will soon include ?nanoparticulates,? which are particles finer than 100 nanometers (0.1 mm). Nanoparticulates are believed to have significant negative health effects due to their high surface area and reactivity. Although it was argued that nanoparticulate concerns were only important for combustion, studies at Michigan Technological University have shown that materials handling and comminution release significant quantities of nanoparticles into the air. Laboratory studies have shown that the use of sodium metasilicate reduced airborne particles finer than 10 mm (PM10) by 86% and particles finer than 2.5 mm (PM2.5) by 80% for iron ore. Additional studies were conducted that revealed that nanoparticulate emissions were present in the types of operations conducted at pyrometallurgical facilities.

Environmental Impact Assessment (EIA) is the accepted method for evaluating proposed mining and other industrial projects to obtain regulatory approval and to help companies plan for responsible development. Another evaluation system becoming increasingly more common for proposed projects is the Environmental, Social and Health Impact Assessment (ESHIA). An ESHIA differs from an EIA for its more comprehensive and inclusive approach to evaluate potential impacts on public health, and its ecosystem services approach to assessing biodiversity impacts. An ESHIA may also be required by certain lenders for financing major projects. Conducting an ESHIA for a proposed mining development is not without its challenges, with costs, scheduling, regulatory concordance and other constraints to be considered. This paper examines some benefits and challenges of ESHIAs and summarizes lessons learned using a case study approach.

Anecdotal evidence suggests that re-entering a sealed heating poses a significant hazard, whereby the original heating is rejuvenated at an accelerated rate forcing withdrawal and re-sealing of the area. Bulk-scale laboratory experiments using a two-metre column confirm these mine site observations. A high volatile bituminous coal from New South Wales, Australia was allowed to develop a significant hot spot before being inerted with nitrogen and allowed to cool. Air was then allowed back into the coal after the nitrogen was turned off and a hot spot developed almost immediately at the same location as the original hot spot before it quickly migrated towards the air source within a day. Two more re-entries were simulated. Each successive re-entry developed a broader hot spot and took longer to reach thermal runaway. These results clearly show the behaviour that can be expected when trying to recover a section of an underground coal mine that has been sealed due to a spontaneous combustion event.

Thee Brightwater water treatment facilities, currently scheduled to be completed in 2010 and begin operating in 2011, will serve the northern part of King County, WA. The facility includes a new treatment plant and extensive conveyance system consisting of more than 21 km (13 miles) of influent and effluent conveyance tunnels and five portals. The majority of the conveyance system tunnels are mined by tunnel boring machines (TBM) and microtunnel boring machines (MTBM). Tunnel and portal construction is divided into three main contracts. The Ballinger Way receiving portal, constructed under the central tunnel contract, is the terminus for the BT-3 leg of the central contract and the BT-4 terminus of the west contract. The shaft has a 7.3-m (24-ft) finished inside diameter (ID) to accommodate removal of the central project TBM and the west contract TBM and extends to a depth of 66 m (216 ft) below grade through a complex and challenging soil profile characterized by multiple ground water tables. Vinci Grand Projects/Parsons/Frontier-Kemper Constructors (VCFK) was the joint venture team for the Ballinger Way portal. Frontier-Kemper was responsible for the shaft sinking. VCFK evaluated either slurry wall techniques or ground freezing for earth support during excavation of the portal and liner installation. The selection process took into account the vertical depth, cost, past practice, geology, water tables and a 9-m- (30-ft-) thick zone of contaminated soil at the top of the shaft. Ground freezing, which would also act as a hydraulic barrier, was deemed the better option for this project. The contract was awarded to New Jersey-based geotechnical contractor Moretrench. Typically, frozen walls, by design, key into an underlying cutoff. At the Ballinger Way portal, however, the [ ] freeze bottomed out in a substantially thick stratum consisting of predominantly clay, but with some inclusions of permeable soil that indicated significant ground water pressures. To ensure stable conditions at the bottom of the shaft, Moretrench, which also specializes in dewatering, designed and installed a perimeter array of deep wells to temporarily depressurize the permeable soils. Washington?s King County is constructing a new regional wastewater treatment facility, called Brightwater, in response to growth in the greater Seattle region. Planning conducted in the late 1950s identified the need for two regional treatment facilities. Constructed in the 1960s, these plants have served the region well. However, an eventual need for a third facility was also recognized. The Brightwater project implements the final phases of the long-term plan. The project includes a new treatment plant and an extensive conveyance system. When completed in 2010, the Brightwater facilities will treat sanitary sewer flows from growing populations living in northern King County and southern Snohomish County. The new system will fulfill commitments to provide wastewater services to local jurisdictions and sewer service providers in the King County Service Area. It will also provide more flexibility in the operation of the King County regional wastewater system. The Brightwater wastewater treatment plant will provide secondary treatment capacity using membrane bioractor technology in 2010 for 36 million gallons per day (mgd), with anticipated expansion in 2040 to 54 mgd, using membrane bioreactor technology. These capacities are for average wet-weather flows. The plant will also accommodate peak hourly flows of 130 mgd by 2010 and 170 mgd by 2040. A 1/20 scale experimental dozer push test rig was designed and constructed to quantify the expected production rates (loose cubic metres per hour) for dozers operating in hard rock bulk push applications. The particle size distribution of the material employed in the test rig was modelled on a fragmented muckpile representative of that for a typical surface copper/gold mine overburden. A commercially available road base material was found to be highly representative of site conditions. Buckingham Pi theory was applied to mathematically develop factors for scaling up dozer productivity parameters, including blade loads and push times. Dozer production rates were investigated for various dozing distances and slope angles. A series of instantaneous productivity curves were produced which are applicable for use in hard rock dozer push operations. Currently, it is difficult to estimate dozer push productivity in hard rock environments due to dozer productivity correction factors that are empirical in nature and provide only discrete, end-point values for a range of operating conditions. The productivity curves produced demonstrate that dozer productivity declines rapidly over the range of 10 m to 40 m. As such, it is recommended that efficient bulk dozing operations in hard rock mining blocks should not exceed 40 m dozing distance. Further testing of muckpile conditions with increased clay and moisture content would be beneficial in order to better understand and quantify the effects of cohesion on hard rock dozer push productivity.

Testing was conducted on a Minnesota Iron Ore concentrate with Cook Clay as a binder using compressive sheer mixing to enhance the performance of the agglomeration mechanism. The testing was conducted on a bench scale at the Midland Research Center the summer of 2004. Results of the test program will be presented that shows the impact of compressive sheer mixing had on the strength achieve in a green ball.

The Stormwater Management and Road Tunnel (SMART) Tunnel is a world first in the use of tunnel space transmitting both road and water through the same spatial envelope. The unique aspect of the SMART project is that the highway decks are used periodically for the conveyance of water. This aspect of the project has posed its own technical challenges that have been overcome in the design stage of the work allowing the project to be taken forward to construction with confidence in the systems to be Installed in the tunnel.

In 2006, the Mine Improvement and New Emergency Response Act (?2006 MINER Act?), Pub. L. No. 109-236, 120 Stat. 493 (2006) was enacted in a bi-partisan move to strengthen the 1977 Mine Safety and Health Act. This action followed several underground coal mining accidents at the Sago and Aracoma Mines in West Virginia and the Darby Mine in Kentucky. The focus of that legislation was, in part, to force technological development and implementation. It involved the recomposition and training of rescue teams. Requirements for sealing worked out areas of mines were changed when MSHA invoked its Emergency Temporary Standard (?ETS?) authority for the first time in many years. Increased penalty amounts were established for certain types of violations for all types of mining, and minimums were set for unwarrantable failure violations issued under Section 104 (d)(1) and (d)(2); 30 U.S.C. Section 814 (d)(1),(2). The entire 30 C.F.R. Part 100 penalty criteria was revamped in a rulemaking, effective in April 2007. The visions were ambitious and noteworthy and those in industry and government have spent the last four years working through the aftermath of intended and unintended consequences of these changes. The penalty structure arrived at in 2007 has proven unwieldy and has contributed to the increase in contested caseload now before the Federal Mine Safety and Health Review Commission. In essence, litigation under the Mine Act ground to a virtual halt when the number of cases increased but the budget for Administrative Law Judges, who hear the cases, and the Solicitor?s office who represents MSHA, was not increased. Addressing the backlog effectively was one of the major challenges when Joe Main was confirmed as Assistant Secretary in early 2010.

"GENERAL PROJECT DATAThe Sparvo Tunnel is part of the “Variante di Valico” project, a new 65km (40mi) highway link between Bologna and Florence, designed to renew the existing A1 route which connects Bologna and Florence. It is composed of 2 x 2,5km (1,55mi) twin tunnels excavated inside a complex geological context, characterized by the presence of a series of surface landslides and methane gas.The inclination is 2,6 % and the minimum radius is 1.400m (4.600ft). The two tunnel tubes were excavated by a 15,6m (51ft) diameter EPB-TBM from summer 2011 to summer 2013. The internal diameter of the concrete lining is 13,6m (44,5ft), made up of precast concrete segments 2m (6,5ft) long and 70cm (28”) thick, being the largest and heaviest segments ever produced. Excavation went smooth apart from initial problems concerning clogging problems and a main bearing damage of the TBM, which are discussed in a further paper during the congress. No structural damage was observed until the end of the TBM drives.SITE OBSERVATIONS DURING THE POST-EXCAVATION PHASEThe first evidence of the stress state of the segmental lining appeared on November 20, 2013 inside the northern tube (1st drive). Ring No. 884 showed obvious signs of overstress, resulting in spalling and crushing of the concrete, and the subsequent bending of the reinforcement, as visible in figure 1.At this time the tunnel invert was already partially backfilled, and construction traffic was running through the tunnel. First safety measures included closing of the tunnel, and initial measurements of the displacements."

"In Europe, and therefore in Hungary opening a new mine is harder and harder. Depletion of mines, unfavourable legal and economic changes, and growing public concerns are the main reasons. Social and economic interests require total utilization of mineral raw materials of the operating mines, and furthermore utilization of waste heaps of the former mines. There are 5-6000 waste heaps of the operating and the closed mines in Hungary. 2000 of these waste heaps have already been estimated, and researches show that total amount of waste heaps can be calculated to 1 billion tones. These researches left out of consideration waste heaps exploited and placed in deep lignite mining. In several projects and researches we analysed processing of waste heap and possibilities to use its components. A processing technology for utilizing waste heaps has been developed based on laboratory and pilot plant tests. Great amount of useful materials of quarrying waste heaps can be utilized with this technology. Tests were also done for processing waste heap of a former ferrous metals mining. The developed processing technology contributes to use these waste heaps as aggregate for cement industry, as dielectric and aggregate for construction. The essay presents in details main characteristics of waste heaps, technologies already used for processing waste heaps of quarrying and ferrous metals mining, mass balances and qualitative parameters of the end products."

Outcrop barrier pillars serve to keep mine personnel and the public safe from sudden uncontrolled flows of water accumulated in active and abandoned underground mine workings. When an outcrop barrier fails, the result is an outbreak of water to the surface and is termed as blowout. Mine blowouts are associated with above-drainage mines and can occur through the coal outcrop and sealed portals. A blowout is often catastrophic, a threat to the people on the surface living or working in the path of a potentially large flood. In addition, blowouts can destroy homes, cause landslides and severe erosion and release pollution and acid mine drainage. This paper provides guidance on the planning, design, evaluation and inspection of barriers to address the problem of mine blowouts associated with above-drainage coal mines.
