I. INTRODUCTION Lawyers are a cautious breed; and it might be expected that a paper concerning a broad and complex area of legal regulation, prepared by lawyers for presentation to a predominantly non-legal audience, would commence with several caveats. Ours are the following: First, we have written a broad (and, in some instances, simplified) overview of the regulatory system and of some of the more important requirements generally applicable to uranium mine and mill wastes in the United States. Our paper is not a legal opinion setting forth all of the governmental requirements that would have to be met by any particular mine or mill. Similarly, we do not imply that the requirements we mention are necessarily applicable to each and every mine and mill in the country; depending on the facts, some of the requirements may be inapplicable or avoidable through exemption or variance proceedings. Compliance decisions and strategies for particular facilities must be considered on a site-specific basis. Second, we have undertaken merely to describe the regulatory framework and some of the generally "applicable" requirements which have been promulgated and proposed by administrative agencies. We express no opinion on whether, under the U.S. Constitution and statutes, the existing and proposed agency regulations are valid in general or as applied to any particular mining or milling operation. There are, of course, procedures for judicial review of agency action; and newly promulgated environmental regulations have frequently been challenged, with varying degrees of success, before the courts. For us even to begin to consider such issues would expand an already forbiddingly long paper to totally unmanageable proportions. Third, in light of the subject of this Conference we have limited our paper to the legal framework and requirements applicable to uranium mine and mill "wastes" -- primarily mine overburden and waste rock and mill tailings (including waste tailings solution). We treat operating discharges (e.g., emissions from yellowcake drying) only peripherally. Fourth and finally, it is important to note that this paper, at least in so far as it concerns the specific requirements of particular regulations, will likely soon be out of date in some important respects. Safety and health at work is about people. It is about people who plan for work, organise work and perform work. It is about those who come in contact with the workplace and those who are responsible for the workplace. There are wider ranging safety and health obligations that are imposed on the industry stakeholders that span all phases of the production process. In all cases, those responsible for discharging the obligations must ask the questions: Is what we propose safe?, can it be done safer? and are we sure? What we learn from recent legal cases before the courts is that it is essential that all stakeholders work together in a collaborative way when discharging these obligations. Safety and health at work cannot become an issue that is viewed only through the eyes of a single stakeholder group. The reason for this is quite simple. The interrelatedness of the responsibilities that are imposed on each of the stakeholder groups, means that the performance based legislation simply wont work, where an active model of communication and consultation is not in place.

"One of the major issues that the Rare Earth Elements Mining Industry has to deal with is the legislation vacuum that exists in many countries around the world. Among these, are countries which have long history and tradition in mining. In many cases the lack of direct legislation for REE mine management as well as for other potentially polluting industries can be a barrier to sustainable development. Moreover, the case of lax legislation in China has led to environmental pollution problems and extended smuggling of rare earth elements. This paper looks into the current regulatory status on the mining of REEs, identifies the loopholes and suggests some elements for a new global legislation framework for sustainable development in the REE mining industry. The setting of this regulatory framework will be in line with the present and future challenges of the rare earths market as well as with the policy strategies that are defined internationally. The aim of such a legislative framework will be to strengthen the global rare earth elements supply chain, appease social concerns and ensure the preservation and conservation of the environment. INTRODUCTION The general public received their first introduction to rare earth elements (REEs) in 2010, when the previously inconspicuous commodities became the subjects of front-page headlines. It was when China created a furore in global high-tech markets after imposing an embargo on Japan following a minor marine dispute (Barakos et al. 2015b). Soon enough the Chinese embargo was extended on REE export restrictions all over the world and thus aroused concerns to many countries over potential supply disruptions. The world had suddenly realized that these wonder materials underpin products that they care about. Governmental and industry executives, policymakers and material scientists voiced concerns and conducted numerous reports stating the situation and the risks of a supply crisis. The price spike of 2011 intensified the crisis and the public turmoil, yet the drama did not last for long as the prices declined significantly in 2012. Nevertheless, the world was nonplussed by the fact that China has the total control of the market with more or less the 90% of the global production. More potential entrants became interested, thus initiating an exploration boom during the recent years that has resulted in a significant increase in known global REE reserves that could have potentials for exploitation."

The mining industry has waited a long time for the resurgence in commodity prices and demand for its products that it is now experiencing. Base and precious metals prices have reached levels not seen before. Coal prices have also shot up. And there are encouraging signs in the uranium market. China’s nearly out-of-control economic growth is said to be the leading driver for much of this resurgence. But demand for energy, metals and building materials in the United States and elsewhere are also major factors. The result is that expansions and new mines for nearly every commodity are in the works.

Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Addressing nutrient deficiency, among other factors, is vital to the growth and establishment of plants in mine spoils and tailings ponds. Although several organic amendments are available for this purpose, it is important to determine the appropriate ameliorant for the selected plant species. This research examined the effect of different amendments on the growth and ground cover of Centrosema molle, Calopogonium mucunoides and Sorghum spp. in copper/gold tailings. Plant growth and ground cover drastically increased with the application of organic ameliorants, especially manure. Among the three plants, Calopogonium exhibited the best growth and has shown its capability to establish a dense ground cover even in unamended tailings. Results suggest that the plant species and the ameliorants used in this study could be effective in a low-input approach to mine rehabilitation.CITATION:Domingo, J P T and David, C P C, 2014. THE Lehigh Valley Section is planning with a num-ber of other organizations a three-day conference, April 25, 26 and 27, with field visits to cement, slate and steel plants in the vicinity of Easton, Pa. W. B. Plank is chairman and D. Knickerbocker Boyd is sec-retary. Headquarters will be at Hotel Easton. Wednesday' will be cement day. In the forenoon A. S. T. M. Committee D-16 will meet and after luncheon the delegates will visit the Martin Creek plants of the Alpha Portland Cement Co. An evening dinner and general session on cement is being arranged. Thursday morning will be devoted to a technical ses-sion on slate, and the breaking of ground for the new John Markel mining building at Lafayette College. After luncheon various slate quarries will be inspected, the visitors being guests of the companies. In the eve-ning there will be a conference dinner at Hotel Easton with a number of distinguished visitors. Friday will be given over to steel and will include a visit to Lehigh University, an inspection of the plant of the Bethlehem Steel Corp., and a luncheon as guests of the latter.

February 2, 1999 marks a milestone in earth-moving technology at the San Miguel Lignite Mine. It was on that date that The North American Coal Corporation (NAC) took delivery of three Leica Dozer 2000 GPS grade control systems for use on its bulldozers. The primary reason for the purchase of these grade control systems was to prove that GPS technology could safely and economically be utilized on heavy equipment to assist operators in defining grades. If these properties were successfully demonstrated, the ultimate vision of the project was to expand the system to a point were GPS would become the primary means of providing grade control information to the mine’s heavy equipment operators. Twenty nine months and more than $500,000 later this vision was realized when the final bulldozer operating at the San Miguel Lignite Mine was equipped with Dozer 2000. Presently North American Coal has a total of nine Dozer 2000 GPS grade control systems at San Miguel providing cut and fill information to operators 24 hours a day. These grade control systems have allowed the San Miguel operation to increase safety, reduce costs, improve operator attitude, and better ensure environmental compliance. This article discusses both the nature of these benefits and some of the issues that had to be dealt with along the way.

"The Leitch mine, in the Beardmore area, Thunder Bay district, Ontario, is a part of the Leitch estate. It includes a group of patented claims, staked by P. A. Leitch of Port Arthur early in the century, along bands of jasper, hematite, iron-bearing slates, carbonatized schists, and greywacke, commonly known as 'iron formation'. The folding and shearing in these variably interstratified beds is a striking structural feature. The vein pattern is very definitely related to these structures.ROCKSThe rocks in the area are typical Keewatin lavas-greenstone-overlain by a series of Timiskaming sediments consisting of arkosic greywacke, iron formation, slate, greywacke, conglomerate, and greywacke, in this order from the contact. The sedimentary beds are generally conformable with the older rock contact except on local folds.Small intrusions of diorite occur as nearly vertical dykes and are believed to be of Algoman age. To the northwest of the mine there are larger intrusions of granodiorite belonging to the same period.Several dykes of quartz diabase up to 100 feet in width, striking generally north and south, with a vertical dip, cross the property. These have been classified by W. C. Laird as pre-Keweenawan in age. One of these dykes in particular is of importance for it cuts through the No. 2 vein and serves as a pillar when stoping. It is approximately 6 feet wide.The youngest rock type represented is a sheet of olivine diabase that extends over an area of thousands of square miles in and around lake Nipigon. It underlies most of this area and its outcrops form some of the most interesting topographical features, with fault scarps rising hundreds of feet. In the vicinity of the mine shaft the sheet is about 600 feet thick and extends from a depth of 1,871 feet to approximately 2,470 feet. It has a dense, hard, chilled margin and a sharp, tight contact. It intruded the sediments with very little lateral disturbance. The chief effect was baking, which darkened and hardened the greywacke near the contact. The sheet dips flatly to the cast."

In regard to the paper by J.B. Gwiazda, it makes a highly technical approach to show that the .u factor used by designers of lemniscate-guided roof supports has never really been confirmed as a maximum and assumes that convergence is vertical. Also, the paper does not appear to take into account deflection of structures, which occurs when the lemniscate and base members are fully loaded to their maximum stress level, nor the front to back line of the support in relation to differential roof to floor movements caused by strata movements under pressure. It is not unusual for differential movements to be slightly diagonal to the line of the support, particularly in faulted areas and on gradient faces. The paper also does not take into account consolidation of fines immediately above and below the support. Generally speaking, any differential movement is from face to waste and under these conditions the .u of 0.3, which appears to be an international standard, has worked in practice. However, if the face end of the support is lower than the waste end, then the µ of 0.3 can be considerably increased, giving rise to the damage mentioned in the paper. The ideal design should aim for a slightly forward bias in the lemniscate guide so that the last increment of setting is toward the face, tending to close any fissures that may have developed during the support advance cycle. The support should also be fitted with positive set valves to ensure that a high setting load density is attained to minimize bed separation. As far as powered supports are concerned, convergence is irresistible and all powered supports converge at their rated yield load. A similar principle can be applied to the differential roof to floor movements to drastically reduce the very high forces that would otherwise be applied to the lemniscate structures and pins and that, in turn, are transferred to the base arrangement and floor loading. Any differential movements are usually catered for by the 0.3 µ factor or deflection of structures in the lemniscate guide arrangement and consolidation of the floor. The floor loading, due to differential movement, is in addition to the support convergence load and requires additional bearing area to avoid possible floor penetration. Some seven years ago, Fletcher Sutcliffe Wild Ltd. (FSW) introduced a lemniscate-guided shield support where the lemniscate linkage is connected to the roof bar through two horizontally converging rams to allow differential movement to take place above a given rated figure. This is a known force and can be guarded against, whereas with rigid connections the forces, as yet, are unconfirmed. By careful design, a horizontal force in excess of 6 MN (60 tons) opposes differential movements for a total ram loading of only 2.5 MN (25 tons), or 1.25 MN (12% tons) each. This principle can considerably reduce the length and weight of the support in comparison with a rigid pin-type structure; also, the yield load rating can be increased without affecting the lemniscate forces. The graph shows the tensile and compressive forces in a lemniscate linkage of a support with and without hydrostore. These forces react into both the roof beam and base members and, as can be seen from the support height to linkage load graph, a considerable reduction in these reactions is gained by the use of the FSW patented hydrostore system. Floor loading is considerably reduced under maximum µ conditions, and by allowing the roof bar to move with the strata, some degree of improvement to strata control is achieved in line with the assumptions in the paper. In practice, these movements have only been in the region of a few millimeters, which, in turn, reflects on the improvements to strata control by the addition of positive set valves.

For the first time, the influence of stearyl trimethyl ammonium chloride (STAC) as a collector, on the flotation behavior of lepidolite (Uljin, South Korea) was systematically examined in Denver Sub-A cells. Flotation tests were carried out by varying amount of STAC (50?200 g/ton), feed size (-65, -100, -150, and -200 mesh), and solution pH. The impeller speed of 1000 rpm, flotation time of 10 min and AF-65 (a frother) of 250 mL/ton were invariably applied. In order to complement flotation experiments, zeta potential measurements and XRD analysis were conducted. XRD results showed that the ores were mainly composed of lepidolite, muscovite, quartz, calcite and albite. In addition, zeta potential results showed that isoelectric points were about 2.5, 2.3, and 9.7 for quartz, albite, and calcite, respectively, and lepidolite was determined to be less than 2. Overall, the results of 3-stage flotation showed that Li2O grade and recovery tended to increase with increasing STAC dosage and decreasing feed size. In addition, Li2O grade increased with decreasing pH. The results were explained by the extent of the interaction between STAC and each mineral.

In the Chibougamau area, a large portion of the glacially tranported boulders which were deposited at the surface were later partly remobilized by the waters of Glacial Lake Ojibway. In the dispersal studies of these boulders, it is sometimes difficult to discern the effect of this reworking process. In addition, depositional processes in the lake contributed material to the original block deposits through the formation of boulder lag by littoral wave action and through direct sedimentation in the form of deltaic deposits. In spite of these complicating factors, dispersal studies at carefully selected sites which were unaffected by the above processes make it possible to unravel the general patern of glacial dispersion. In this study, indicator lithologies of the Albanel and Chibougamau formations were used. They give a coherent image of dispersal throughout the area showing transport toward the southwest. Considering the particular geological context of the region, and in view of the extensive mineral exploration studies which are being carried out, the results of this study are encouraging for the tracing of source areas of glacially transported mineralized boulders.

"Les mineralisation d'or des gîtes de la SOQUEM - Silver Stack dans is canton Bousquet se situent dans une bands de roches pyroclastiques asides du groupe de Blake River, d'âge archéen, dans le même horizon géologique que lee gites aurifères de Thompson Bousquet et Dumagarni situés plus a rest. La propriété a été explores anterieurement a maintes reprises depuis les années 1930, parfois jusqu'aux travaux souterrains, notamment par les groupes Mooshla, Warrenmac et Westwood Cadillac ainsi que par Silver Stack Mines.Ces zones auriferes se situent a l'intérieur de larges halos (jusqu'à 1,000 m x 400 in) de pyrite disséminée (2-5%) dans des tufs a lapilli et des agglomerate acides montrant des concentrations locales de pyrite. La zone 1, découverte en vérifiant par sondage une anomalie E.M., coincide avec une de ces concentrations de pyrite et la teneur en or est ici proportionnelle a la pyrite. Ce secteur se distingue par l'intensité de l'altération en séricite. La zone 2, qui s'étend sur près de 600 m, se situe dans un agglomérat acids, avec une faible teneur en pyrite, et montre de fines veinules de quartz-carbonate.Du point de vue géophysique, aucune methods ne donne des résultats probants: la polarisation provoquée montre de tree grandee anomalies correspondant aux halos de pyrite, tandis que lee concentrations de pyrite détectées par les méthodes E.M. (VLF ou EMH) sont loin d'être toutes aurifères. Les relevés magnétiques aident a établir la structure la où un certain contraste de susceptibilité magnétique est present. Les essais minéralurgiques préliminaires indiquent que la concentration de Bette mineralisation aurifère ne présentera pas de problems majeur."

"RESUMELa stratigraphie du camp minier de Matagami se résume a la présence de deux groupes volcaniques: le Groupe du Lac Watson et le Groupe de Wabassee qui le surmonte. Les gisements de sulfures massifs volcanogènes sont situés au sommet du Groupe du Lac Watson. Ces roches sont déformées par l'anticlinal de Galinée dont l'axe, orienté E-W, plonge vers l'ouest. Le cœur de cette structure est occupé par le Complexe de la Rivière Bell.Les roches volcaniques du flanc sud de l'anticlinal sont peu déformées et pendent à 45° vers le sud. Les gites qui s'y trouvent présentent la morphologie typique des gisements de sulfures massifs volcanogènes. Ceux-ci se situent le long d'un horizon repère cherteux et sulfure, appelé ""Tuffite Clef', et leurs cheminées d'altération rejoignent, en profondeur, une zone d'altération stratiforme d'étendue régionale.Les roches du flanc nord ont été transposées tectoniquement en écailles chevauchantes, de dimension kilométrique, a l'intérieur d'un couloir de failles anastomosées d'orientation est-ouest. A l'intérieur: le ce couloir, les gites de sulfures sont déformes et sépares de leur héminée d'altération sous-jacente par des failles.Les gites de sulfures situes sur les deux flancs de l'anticlinal de 'Galinée se seraient mis en place dans un mime environnement volcanique. Leur position stratigraphique est identique puisqu' ils se 'rouvent au sommet de la rhyolite porphyrique du Groupe du Lac Watson. lis se seraient constitués au cours d'une pose volcanique recédant 1'éruption du basalte du Groupe de Wabassee. Le Complexe de la Rivière Bell est perçu comme la source de chaleur responsable de la circulation des fluides hydrothermaux qui sont à ""origine des gisements de sulfures massifs volcanogènes."

"Un trait marquant du cadre tectorwstratigraphique de la Sous-province de l'Abitibi est la présence de nombreux couloirs de déformation d’extension régionale et sub-concordants au grain stratigraphique. La présence de grandes masses granitoïdes qui perturbent l'allure du grain tectonique est typique de la partie nord de la Sous-province de l'Abitibi. Des rides E-W constituées de complexes plutoniques précoces forment des reliefs structuraux agissant comme des moles résistants qui interfèrent avec la déformation régionale.Deux types de couloirs de déformation sont distingués, les couloirs de bordure et les discontinuités structurales. Les couloirs de bordure représentent des auréoles de déformation élevée qui s’accompagnent généralement d’un métamorphisme au faciès amphibolite. lls suivent /'interface entre les roches granitoïdes et les assemblages supracrustaux. Ces couloirs sont de puissance kilométrique et sont confines, surtout au sein des roches vertes, a l’interface des complexes granitoïdes d’importance. La limite entre la Sous-province de l'Opatica et les roches supra crustales de l'Abitibi est caractérisée par un important couloir de bordure issu possiblement d'un chargement tectonique irrégulier et concentre lors du raccourcissement horizontal.Les discontinuités structurales sont des failles ductiles qui se propagent surtout en direction E-W mais avec des variantes de directions SE et NE. Les discontinuités E-W se caractérisent par la présence d'une linéation d'étirement à fort angle de chute. Les discontinuités SE sont caractérisées par des linéations d'étirement horizontales et directionnelles et les mouvements observes sont system attiquement dextres. Les discontinuités NE sont des failles à comportement beaucoup plus fragile et se distinguent par des composantes de mouvement senestre. Elles sont tar dives par rapport aux discontinuités E-W et SE et ne représentent pas la symétrique du système SE.La combinaison des systèmes E-W et SE décrit un motif anastomose a l' échelle régionale. Les failles ductiles se rejoignent defaçon asymptotique, isolant des blocs peu ou pas affectes par la déformation. L'anastomose est un phénomène qui se produit a toute échelle et est reliée principalement aux Mt érogénéités et aux anisotropies 1) des forces agissantes (champs de contraintes régionale et locale) et 2) de la réponse del' empilement supra crustal (compositions différentes, fabrique initiate, propriétés mécaniques variées, niveaux d'altération).Dans le but de respecter un raccourcissement horizontal N-S, différents modelés sont proposés; ils mettent en cause soit une transpression dextre, soit des failles inverses réactivées en failles décrochèrent dextres soit des failles de chevauchement redressées."

Les autres substances, parmi lesquelles ressortent nettement la tourbe, la silice et la magnesite, representent une valeur totale de 61.5 millions $.

"Located in the northwestern portion of the Abitibi greenstone belt, Les Mines Selbaie is a copper-zinc (silver and gold) producer. Felsic tuffs host three are zones. Composed of sulphide veins and breccias, they are not exhalative massive sulphide deposits, except, probably, for the massive pyrite (fragments and lenses) localized close to the top of the volcanic sequence.The total of all (mineable and mined) ore in the three zones presently outlined on the property, is of the order of 29.9 x 106 tonnes with average grade of 0.63 g/t Au, 37.02 g/t Ag, 1.21% Cu, 1.91% Zn.The ore reserve calculations and the daily production procedures are computerized to various degrees. The data handling process is highly computerized.Various geophysical methods are, and have in the past, been successfully used on the property. The ""mise-à-la-masse"" surveys were used to perform the geological interpretation of an underground deposit (A-2 zone). Presently the PULSE-EM surveys are performed in all surface and underground exploration drill holes."

"Selbaie is located northwest of Joutel, in what is known as the fourth east-west volcanic sediment group in northwestern Quebec. The main metals produced are copper and zinc, with important contents of both silver and gold. Production comes from an open pit mine on the A-I zone and from two underground mines on the B zone and the A-2 zone. Each mine gave rise to important capital investment programs for construction and mine development, all of which were managed and staffed with company-hired, non-union personnel. Production from all sources now exceeds 7000 tonnes per day, with a workforce of540 regular employees. Of particular interest technically is the high recovery of B zone reserves underneath 40 m of overburden cover, the low-cost capital development of the A-2 zone, the computerized control of open pit mining, and the successful copper-zinc separation of the A-1 zone ore. Due to the low grades of the mineral deposits, efficiency in all aspects of the production process, is essential to the success of the operation.LocationThe Selbaie Mine is located 82 km northwest of the locality of Joutel in northwestern Quebec (Fig. 1). Access to the mine is by an all-weather road, 32 km of which is paved. A second road access to the site is via La Sarre, 134km to the southwest. Employee access, materials transport and haulage of copper and zinc concentrates take place over both of these roads."
