MR. MARGOLF: Thank you very, very much Harris. There's sure a lot there to think about in terms, of our image, particularly. I think we should keep' in mind what Harris said about our history not being monolithic. Therefore our image can only be that, which is reflecting the weakest link in our industry and I think that's a burden on all of us. Perhaps to do some policing amongst ourselves to try to improve whatever might be our weakest link and thereby elevate our entire industry. Our third speaker this afternoon is another good friend of mine of long standing and I am very pleased to be able to introduce to the Rocky Mountain Coal Mining Institute Bob Golten. Bob is a graduate of the University of Michigan with a degree in Economics and Harvard Law School. His professional experience encompasses private practice in Chicago where he was born and in the federal government as a public defender in Washington, D.C. and in the Department of Justice as a tax , attorney. Some of us have come to know Bob more in his present role as the senior counsel for the I National Wildlife Federation. He's also Adjoint Professor of Law and Director of the National Wildlife Federation Resource Clinic, University of Colorado. Boulder campus. In addition, Bob has served with the Rocky Mountain Center on Environment as one of its directors for a number of years. He's very active in a number of areas that are not only civic but he does reflect what I would present by way of introduction as a perspective

R. DAWSON HALL (The Coal Age, New York City) : Mr. Chairman and gentlemen: I do not feel that I have anything in particular to say. I have not prepared anything for an occasion such as this. I just came from New York City, and as one man said to me today, "That is not any recommendation in particular." (Laughter.) In answer to your request for a few remarks of a timely character I would say: One of the possibilities in the Rocky Mountain Region coal mines is the use of steel arches, posts and straps. The timber of the region seems unusually subject to dry rot and does not last long, especially in those places as in southern Wyoming, where the mine atmosphere is likely to contain a large quantity of carbon dioxide. It is true that, in many mines, much care is taken to drive out this gas and to arrange that the timber will have the fresh air that will prolong its life, but despite such provision much timber is subjected to speedy rot. Steel has made rapid progress in England, Germany and France and is recognized as an economy, not an extravagance. Frequent replacement of rotting wood and removal of broken rock are a source of great waste, risk and inconvenience in operation that together spell great cost. The very dryness of the mines and the lack' of acid water are favorable to the use of steel where support of roof or sides is necessary.

In a meeting of this kind where everyone present is connected with or engaged in coal mining, and where each one is present with the set purpose of learning new thoughts or ideas, the subject of the saving of life by any method in the industry is a vitally interesting and important one. On the cost per ton basis, it mounts to a formidable figure especially so during these days of depression and stagnant, or no business. But entirely outside of the human side of the question, to lose lives would cost more than saving them. Your insurance under haphazard safety measures would mount, loss of time due to accidents would impair efficiency among employees and the breaking of the morale of the staff, due to criticism of lax methods would cost more than an efficient safety program. Taking it for granted that most of you are looking at the question from the viewpoint of a yearly or five-year cost sheet, and that at this time you are doing all that can be done without bringing a ruinous cost upon your companies, I can offer only one suggestion: Raise the quality of your safety, or lower the cost. In this meeting, there should be no question of standing still or retreating in the quality of safety, so I will amend the suggestion with "Raise the quality and lower the cost." We have learned that when the coal beds were forming, nature sealed them in with a strata of mud that the ages have turned to shale, sealing them effectively against the deteriorating influences of the air. Mudite is carrying out nature's plan of coal preservation to the inside of the coal mine. Text books teach us that a large proportion of the vegetation that forms our present coal beds grow on what might be termed mud, later falling and being buried practically where it grew by mud, then on being subjected to heat, pressure and time, was changed to coal. The mud being subjected to the same three forces forms our present shale stratas. Now if nature saw fit to use this solidified mud as a preservative through countless centuries, isn't it reasonable to expect that occasional coatings on the ribs and roofs of entries and rooms will aid materially in preserving our coal and coal dust? Nature took mud and formed it into shale; mudite takes the shale, reduces it into dust, adds water and makes a mud, applies it to the ribs, roofs and floors of the mine in a thin coating

One of the most dreaded things which mining men sometimes have to contend with is underground mine fires, which are both dangerous and expensive. In the Reliance mines we have had considerable trouble with mine fires. We have at the present time five different fire zones, three of these zones give us considerable trouble and the other two have not given any trouble since they have been walled off. Fire Zone No. 1 comprises No. 2, 3 and 4 South Entries, about 50 acres are enclosed in this zone. Fire Zone No. 2 comprises the main drift entry from the mouth to the Old Boundary Plane and extends to the crop line, about 10 acres are enclosed in this zone. Fire Zone No. 3 comprises 1 and 2 North Entries from the main slope to the Old Boundary Plane, a distance of about 1,200 feet, about 15 acres are enclosed in this zone. Fire Zone No. 4 comprises 11/2 and 2 North Entries, a distance of 1,100 feet between New Slope and Old Boundary Plane, about 15 acres are enclosed in this zone. Fire Zone No. 5 comprises the inside end of No. 11/2 and 2 North Entries and 3 North Entry from the New Slope to 30 room, a distance of about 2,600 feet along No. 3 North Entry, about 20 acres are enclosed in this zone. The first mine fire started in No. 2 South Entry in No. 1 zone in 1914. Inside of No. 7 room on the high side of the entry, there was a soft piece of coal. There were no rooms driven in this coal and one day a fire was discovered in the solid pillar on the high side of the entry, work was started at once to load out this fire. and several places was driven into the pillar and cribs built where the coal was taken out, but this method proved a failure and a sand pack was put up along the entry between the track and the high rib. This consisted of timber set about 3 feet from the rib and 2-inch boards put behind the timber and sand or adobe put in between the boards and the ribs, and this method gave very good results except that it required close watching as the sand would settle and let the smoke out between the roof and the sand. Fire broke out in No. 3 South Entry in No. 1 zone in the summer of 1919. We sealed this fire off by building 36 fire stoppings, which also enclosed the fire in No. 2 South Entry and we have never had any trouble with fires in this zone since it was walled off. The fire started in No. 2 -zone in 1919 and has been very active ever since. When this fire was first discovered we built new stoppings in front of the old one in the room necks; we also opened up some of the room necks and loaded out part of the burning coal and rock but this did not help any, the fire, would burn out around the stoppings also burn along the roof between the top coal and the roof sometimes nearly across the entry. Several holes were drilled from the surface to the fire area and flushing the fire was tried but this was also a:\, failure, the rock above the coal was so hot that the mud would dry in the hole and fill it. In 1921 we started to take down the top coal along this entry, timber the entry and put 2-inch boards behind the timber and fill in between the coal and the boards with sand or adobe. We have at present over 1,000 feet of this work done and it has given us better results than any other method that we have tried. As the coal burns out behind the timber the weight breaks the timber and it is necessary to renew some of it. Fire broke out in No. 1 North Entry in No. 3 zone in 1922. There was a stopping in this entry that had been put in when the entry was finished some few years before. The fire burned around the stopping on the low rib of the entry, we built another stopping in front of the old one taking down the top coal and extending it up to the roof also digging in both ribs and setting the stoppings into the coal about 18 inches. This fire did not cause any trouble until June, 1924, when we discovered this fire was very active on the inside

MR. DICKINSON: There is an increase of dust in machine loading, especially with the McKinlay loading and cutting machine which was extremely dusty. MR. FORRESTER: Declared more dust must be expected because when loading by machinery, the coal is shot harder in order to make it easier for the machine to pick it up. He believes however, that there was less hazard because of the closer supervision possible by reason of the concentration of operation. MR. McAULIFFE: Machine loading more dusty than hand loading. D. HARRINGTON: The hazard is greatly increased by modern methods of loading. Not only do the methods increase the quantity of dust, but they also increase the rapidity of mining and the increased quantity of coal broken down causes large quantities of gas to be released. The number of motors on loading machines and conveyors add to the hazard. No more dangerous places can be found for such motors than at the working face where there is excessive quantities of pure coal dust and where there is more gas than along any other point. Regarding Mr. Herres remarks that the machine loading was safer on account of the concentration and possibility of close supervision, Mr. Harrington said he believed concentration likely to prove a source of danger rather than its preventive. At Dolomite, Alabama, a number of men had assembled, and as a result what was a relatively small explosion killed a large number of men. Concentration is not without its dangers to mine operations. MR. McAULIFFE: These arguments do not appeal to me. Few places are better sprinkled than the working places in a machine loading mine. There is. more effective supervision, and there can be more ventilation. I believe machine loading will increase safety by that very concentration that Mr. Harrington deplores.

At the time of mine accidents one frequently hears the expression "there will be accidents as long as there are mines", or it may be varied to state that the accident in question was unavoidable, or something similar indicating inability to prevent accidents. However, it is the opinion of the writer, after over twenty-one years experience in both coal and metal mining, seven years being spent wholly in safety work, that by far the greater number of all accidents is due to carelessness or negligence. This carelessness or negligence may be on part of the victim of the accident or of one of his companions, or on part of his employer or possibly even of the inspector or safety man, and in some cases all of these agencies are involved. It manifests itself in various guises, one of the most serious being violation of state mining laws or regulations or of mine rules, and frequently the rules of ordinary common-sense. The cause very frequently is that trait in human nature to "take a chance" and it has been the writer's observation that the worst offender is the old-time miner who has come safely through many years experience, who was mining when the "safety man was a baby", and who clings to old-time ideas and practices and has "no use" for "newfangled" present-day "notions". Unquestionably, there are accidents, wholly unavoidable and many are caused by ignorance and by the new-comer in mining, yet as previously indicated, the writer's observation is that the old-timer is by far the worst offender, bringing grief to himself, companions and employer. Of the numerous manifestations of carelessness and negligence in connection with mine accidents, which have come to the notice of the writer, only one will be treated in this paper, viz: Violation of State Mining Law, and mention will be made only of explosions and major accidents in coal' mines with which the writer came in personal contact as investigator. In most cases, in addition to mine inspection after the accident, the writer heard the evidence given at Coroner's inquest and thus was enabled to for¬mulate fairly definite impressions as to events and conditions leading up to the occurrence.

The meeting was called to order in the Albany hotel, with the President, John B. Marks, in the chair. At the request of the Secretary, the chairman brought before the Institute the question of a reorganization of the finances and system of conducting the Institute, explaining that, although the Institute is in good financial shape and the meetings are of great interest and are attended by a large and serious minded membership, the Institute is getting so large and of such value to the operators that it should be taken over by the operators, conducted by some man elected by and from the operators, and its financing put on a definite basis. At present, it was explained, the Secretary, not a coal operator nor interested in operating, arranges and conducts all meetings and finances the Institute from three sources: the very low dues, the advertisements published in the Proceedings, and by direct solicitation of contributions among the supply and machinery houses. Mr. James Dalrymple spoke vigorously on the need of having the Institute entirely free from any taint of commercialism. Upon motion by W. D. Brennan, seconded, a committee of four, one to represent each State, was voted. Appointment of this Committee was deferred temporarily. The reading of the minutes of the previous meeting was then called for, but upon statement of the Secretary, that the minutes were published in Volume 2 of the 1925 Proceedings, they were dispensed with. The Secretary-Treasurer's report was made informally inasmuch as the last report had not yet been audited. In brief, the Secretary reported on a cost of approximately $1,600.00 a year to publish and send out the Proceedings, an expense of approximately $1,800.00 to care for the Denver meeting, and an expense of approximately $1,200.00 to care for the summer meeting. The Secretary's salary of $25.00 a month has not been collected, but a certain portion of this has been used for stenographic expense. The Secretary asked for expression from the floor regarding the advisability of continuing the publication on the present elaborate plan. Mr. Gibson, Mr. Marks, Mr. Whiteside, Mr. Littlejohn, Mr. Dick and others spoke positively on the value of the present form of the Proceedings, and urged that no changes be attempted in this. Upon motion of Holbrook Mahn, it was moved, seconded and carried that E. H. Weitzel and W. F. Murray be made life members of the Institute in recognition of their services in the organization of the Institute, placing them with Floyd W. Parsons as the original organizers of the Institute. Mr. Murray spoke briefly in acknowledgment of the courtesy. Mr. Weitzel's words are included in the discussion A letter was read from George B. Pryde relative to the present emblem of the Institute. The Primero mine, operated by the Colorado Fuel & Iron Company, is located 17 miles west of Trinidad, Colorado, in Las Animas County. Unusually bad roof conditions, along with heavy side pressure and other conditions causing rapid decay of timbers, all combine to create a very serious timbering problem. The height of the coal averages six feet six inches. It is a heavy coking coal and has a tendency to become easily crushed and broken down in the seam. The seam lies about 35 feet below the sandstone and the intervening formation is composed of loose shaly rock, and as the coal is extracted, the air slackens this rock to such an extent that within 24 hours, roof falls varying from five to fifteen feet in height are likely to occur. Under these conditions it is necessary to use cross bar sets in both rooms and entries, and they must be spaced no further apart than three and one-half foot centers, and be maintained within a distance of three feet of the face. Rooms are spaced on fifty footcenters, and cannot with safety be driven to exceed 14 feet in width, and 200 feet in length. The large pillar must be maintained to protect from side pressure, and the rooms must be driven up and retreated with as quickly as possible to avoid the squeeze caused by the intense side and roof pressure. Best results in extraction have been obtained by driving rooms for only a distance of 150 feet. Under these circumstances, it is readily seen that timbers of small diameters cannot be utilized in timbering any development work of a permanent nature. Entries are driven nine feet wide, and special peeled piling with an average diameter of 12 inches are most commonly used. It, is necessary to use lagging between each set of crossbars . Conditions such as these necessitated an immense expenditure for mine timber. In addition to ordinary seven and eight foot props, we used a yearly average of 65,000 feet of heavy peeled piling, averaging in diameter from 10 inches to 12 inches. Annual expenditures for timber of all classes was in excess of $60,000.00. Timber costs per ton averaged around 29 cents. In view of these exceptionally severe timber conditions at Primero, the company, in 1920, had a survey made with a view of providing some remedy to this problem. A comparison of the life of main entry timber at other bituminous mines was made, and an average life of four years was established. The actual data collected at Primero indicated an average of less than two years in the manway or "return" airways, and up to five years on the haulageways or "intake" airways. While some of this timber will stand up for a much longer period than this, a close inspection will reveal in most cases that its period of usefulness is spent. It is very essential when discussing the life of timber, especially that used on, main haulageways and aircourses, that a distinction be made between the point of service, that is, the point where it is sound, serviceable and able to carry weight, and the point of breakdown or failure, where it is no longer sound and able to carry weight. In figuring the life of timber, the point of service only should be considered as timber will frequently stand for a considerable length of time when it is entirely decayed and unserviceable. The larger part of the timber used for our permanent work was Alpine Fir, or what is locally termed Red Spruce, and the supply of this I is gradually becoming depleted and has to be obtained at a point so distant
