SALE AND CONVEYANCE. DEED BY INDIAN ALLOTTEE OF UNSOUND MIND-BONA FIDE PURCHASER. The deed of an Indian allottee whose mind was unsound, but who was not entirely without understanding, is voidable if made before the grantor's incapacity has been judicially determined; and a purchaser of the original grantee who interposes the defense of a bona fide purchaser has the burden of showing a purchase for value and on failure to do so can not claim the benefit of a bona fide purchaser. The purchaser of a mine equipped with an electric hoist, placed in the mine under a rental contract with the owner of the hoist and under an agreement to return it to the owner at the expiration of the term of hiring, can not claim and hold the hoist as against the owner where the agent of the seller explained to the purchaser that the hoist was not owned by the owner of the claim. A deed conveying lands subject to an oil and gas lease under which the lessee had the right to drill or pay money in lieu of drilling at his option, and reserving to the grantor a share of the royalties under such lease, and expressly authorizing the grantee to lease the land for oil and gas purposes and to take the rentals, authorizes the grantee to extend the existing lease before the expiration thereof in consideration of the annual payment of money in lieu of drilling, as contemplated by the lease.

After the discovery of the rare-earth mineral deposit in the Clark Mountain area near Mountain Pass, San Bernardino County, Calif., two samples wore obtained through the Mining Division of the Bureau of Mines for investigation of possible method of concentration. Three other samples were received later from different locations in the same area. The rare-earth mineral in this ore had been identified by E. T. Schonk as bastnaesite, a fluocarbonate of the rare-earth metals containing cerium, lanthanum, praseodymium, thorium, uranium, etc. Associated with the bastnaesite were barite, silica, and some calcite. The bastnaesite contained a small amount of iron as a coloration and some manganese. Twenty to fifty percent of the weight of the samples studied was bastnaesite, or ten to twenty-five percent total rare-earth oxides; about half was cerium oxide. Apparently, none of this mineral occurred in pure form. Even the highest-grade particles 'wore contaminated by fine, interlocked grains of barite, calcite, and silica; barite contamination predominated, and the barite was interlocked with varying amounts of bastnaesite. While the specific gravities of pure bastnaesite and barite (approximately 5.0 and 4.50 respectively) differ enough to allow separation by gravity, the interlocking of the minerals nullified this difference. Consequently, only a partial separation could be made by gravity concentration. The extremely fine grained texture of most of the ore prevented grinding to a size that would make concentration by flotation practicable; a partial separation of barite by this means was effected.

The Coeur d'Alene minim, district of Shoshone County, Idaho, has been one of the largest and most active lead-silver producing districts in the United States for the last 40 years. The mines of the district enjoy exceptional natural advantages with respect to ventilation in that the veins apex high on mountain sides and are most often developed to considerable depths, up to 2,000 feet, by adit and crosscut tunnels under conditions that develop large natural draft pressures; the increase of temperature of the rock with increase of depth from surface in at a low rate; and the average surface temperatures are low. These natural conditions have, in the main, resulted in well-ventilated mines with low temperature conditions throughout. However, where the development has been carried to considerable depths below the lowest level of surface entry, natural-draft ventilation has proved inadequate, and mechanical ventilation systems have been installed on the three largest mines of the district. Local conditions, more particularly those in dead-ended working places, have also required auxiliary ventilation by will fan-pipe units in these and other mines. A particular feature of the district is the number of exceptionally long crosscut tunnels that have been driven to provide entry to vein systems from low points adjacent to milling and transporta¬tion facilities. Three of these tunnels are approximately 2 miles long, and lengths of 3,000 to 8,000 feet are quite common.

"INTRODUCTION North Carolina has been the leading producer of mica in the United States, accounting for roughly 50 percent of the Nation's output. The producing area is a belt some 100 miles in width lying in the Mountain and Piedmont sections in the western part of the State. Ashe, Watauga, Avery, Mitchell, Yancey, Buncombe, Haywood, Jackson, Macon, Transylvania, Rutherford, Cleveland, and Lincoln Counties supply the bulk of production, while small amounts have been produced in Gaston, Catawba, Burke, Wilkes, Yadkin, Stokes, and Person Counties.To assist the operators and expedite the production of mica during the recent emergency, the Bureau of Mines drilled four of the more promising mica properties in this State. The results of this exploratory program are recorded in this report.ACKNOWLEDGMENTSIn its program of investigation of mineral deposits, the Bureau of Mines has as its primary objective the more effective utilization of our mineral resources to the end that they make the greatest possible contribution to national security and economy. This is the first report published by the Bureau of Mines on washability characteristics of coal from beds in Tennessee. It is based principally upon screen-sizing and float-and-sink tests of raw coal from a bed on the Cumberland Plateau. Stripping operations were undertaken recently on this bed by the Cumberland Collieries, Inc., near Chalybeate,Van Buren County, Tenn. The bed has not been definitely correlated, but it may be an extension of the Sewanee bed, which has been mined extensively in the Tracy City district to the south-vest and at points near Dunlap and Pikeville to the southeast and east. It was spoken of by officials of the Cumberland Collieries as the Sewanee bed at the time of sampling for this study. In a letter dated October 16, 1948, W. D. Hardeman, geologist of the Department of Conservation, Nashville, Tenn., states: "The stripping operations of the Cumberland Collieries near the old postoffice at Chalybeate are, I am fairly certain, in the upper part of the Whitwell shale, which carries the Sewanee coal. This coal may be a stray seam, but it probably can be correlated with the Sewanee coal, which is mined farther east. "There are no detailed geologic maps or reports covering the area, and this opinion is based on what was observed in visiting the strip mines in that general vicinity." The laboratory work upon which this report is based was done at the Southern Experiment Station of the Bureau of Mines, United States Department of the Interior, in cooperation with the University of Alabama and the Cumberland Collieries, Inc.

A complaint in an action to quiet title to minerals and to the min- eral rights in certain land is insufficient in the absence of a direct allegation of possession, although it avers that the plaintiff from the time of receiving the conveyance assessed the mineral interest for taxes each year and paid the taxes thereon and exercised various acts of ownership of such mineral interests, in that he caused test pits to be dug on the land for the purpose of exploring the minerals and ascertaining their quality and extent, in going upon the land and looking after them from time to time, and that he accompanied or caused his agents to accompany prospective purchasers of such mineral interests and exhibited the same to such prospective pur- chasers in efforts to sell them. This report describes results of laboratory-scale experimental treatment of nine ores containing gold and silver, including samples of products of previous plant treatment, from ore deposits in California and Nevada. The samples treated were taken by engineers of the Bureau of Mines during investigations of these ore deposits. The information reported is of interest for development of the mining districts represented or in future Investigations of similar ores from other sources. The treatment methods were as simple as possible. More complicated treatments were tried when required, The applicability of the methods and their limitations in treating the ores are shown by the data in this report. The following treatment methods were employed in the experiments described: Screen analyses were made to determine distribution of values in various screened-sized portions of crushed ore, or to determine optimum size to which a particular ore should be crushed or ground to liberate values, and some-times to determine residual values in various-sized portions of treated material.

This Bureau of Mines manual is intended to provide a better understanding of ground movement and the technology available for measuring it, The manual deals with convergence, strata separation, lateral roof movement, stress, and support load in underground mines. The instruments that measure these ground control parameters are described in detail. Step-by-step procedures for selecting the appropriate instrument are presented, which consider such factors as approximate cost, installation procedures, data collection, and data interpretation; and an instrument selection worksheet is provided to facilitate the instrument selection process. Actual instrument case studies and a list of instrument suppliers are presented in the appendixes.

"In a previous paper the Bureau of Mines. 3/ presented in condensed tabular form all analyses of Texas crude oils made by the Bureau up to March 193K. This previous report states;The first Al well in Texas was drilled near Oil Springs, Nacogdoches County, in 1863-67. However, the first oil field of major importance in the State was discovered at Corsicana,Navarro County, in 1895. Since that time the petroleum industry try in the State has spread and grown until today petroleum from Texas is an important commodity in world petroleum markets.Since March 1939 samples of Texas crude oils from many new fields, and some older fields not covered in the previous report, nave been analyzed. Those analyses arc reported in the present paper. The annual production by years from 1896 to 1940, inclusive, taken from the figures in the Bureau of Mines Minerals Yearbook, are given in table 1. Production for 1896-1940, inclusive, totals 6,579,715,000 barrels.Various authors reported upon developments and production in the Texas fields in the Transactions of the American Institute of Mining and Metallurgical Engineers, Petroleum Division, for 1941. 4/"

Tests were conducted in commercial foundries to determine the suitability of calcined anthracite as a cupola fuel. The calcined anthracite performed satisfactorily at two of the three foundries where iron-melting tests were conducted. Performance at the third installation was unsatisfactory because metal temperatures deviated widely and, in general, were lower than is desirable for the type of castings being made.

This U.S. Bureau of Mines (USBM) research simplified an earlier hydrogen chloride (HCI) leach-sparge process developed by the USBM to recover reduction-grade alumina from domestic kaolin clay. Improvements were made by decreasing the initial leaching acid concentration from 25 to 20 pet, decreasing the leaching time from 1 to 2 h to 15 to 30 min, eliminating the solvent extraction step for Fe removal, and eliminating the step to recover the AI content of the bleedstream circuit. A 10-cycle bench-scale experiment of the simplified process showed that the ferric chloride (FeC13) concentration built up to 9.3 g/L in the recycle stream. This did not interfere with any of the unit operations or final alumina product purity because Fe forms stable soluble chloride complexes when sparged with HCI and is easily washed from the large aluminum chloride hexahydrate (ACH) crystals. The reduced leaching time and acid concentration did not decrease Al extraction.

The Bureau of dines present, an economic evaluation of its process for the ferric chloride leaching of chalcopyrite concentrate. In this process, chalcopyrite concentrate is leached with ferric chloride solution to extract copper, which is precipitated from the solution by electrolysis while leaving sulfur in the residue. Spent liquor from electrolysis is treated with oxygen to regenerate the ferric chloride leach solution and the sulfur-laden residue is processed to recover the sulfur. A cost estimate was prepared for a plant capable of processing 600 tons of chalcopyrite concentrate per day, 330 days per year. The fixed capital cost, on an early 1.975 basis is $27,831,600 and the estimated operating cost is 9.9 cents, per pound of copper product. In comparison, the estimated operating cost of a smelter equipped with a citrate process plant to recover sulfur is about 13.6 cents per pound of copper product. No charge for chalcopyrite concentrate or credit for recovered byproducts has been included in either operating cost. The ferric chloride leach process, therefore, appears to be economically attractive.

Roof-rock instability in advancing sections of underground coal mines is a major contributing factor to accidents resulting in fatalities and injuries. Such roof-rock conditions can also result in loss of production due to additional cleanup time and increased amounts of reject material. The Bureau of Mines is investigating fundamental geologic factors affecting coal mine roof-rock instability in order to develop techniques to predict zones of potential unstable roof-rock. Two distinct directional trends of unstable shale roof-rock in a mine working the Upper Kittanning Coalbed are delineated: one trend is associated with the sandstone-shale transition zone, the other with a fault system. The unstable shale roof-rock associated with the transition zone, a consequence of differential compaction, is comprised of slickensided roof-rock. Whereas, the unstable shale roof-rock associated with the fault system, a consequence of structural deformation of the strata, is comprised of fault planes. These faults, small in comparison to the sandstone-shale transition zone, are difficult to delineate with a standard drilling program. Trends of the transition zone associated with the sedimentary facies change are projected into unmined portions of the coalbed with the aid of exploration core data.

This paper describes a method and a computer program for calculating shape factors and areas of channels that turn more than 90° and conduct fluids into the backs of wells. The program represents an improvement over a previous Bureau of Mines investigation by using a 4-point Lagrange interpolation equation instead of a 3-point and by summing areas of trapezoids with either x altitudes or y altitudes. Some of the techniques reported in this paper can also be used to compute the areas between contours and the lengths of lines that turn more than 90°.

This work is a codification and annotation of the Congressional enactments relating to minerals, mineral lands, and mining. It covers every enactment of Congress from the original ordinance of 1785 to the present time, as well as all sections of the Revised Statutes of the United States relating to these subjects. These laws are grouped according to their general subject matter, and are arranged thereunder in numerical or chronological order. Many of the mining statutes include matter not pertinent to the subject, and only those parts of such acts are quoted as will properly show their relation to minerals and mineral lands and indicate how they should be construed. Some mining acts have been repealed or have become obsolete, and others have become incorporated substantially in sections of the Re- vised Statutes; but these are retained in order to show the changes made, and the constructions placed thereon by the courts are given as aids in construing the new or repealing acts. The annotations consist of legal propositions abstracted from the decisions of the various courts and executive officers of the Govern- ment that have interpreted the sections and statutes so codified. These legal propositions are arranged under the different sections and acts with appropriate headings, titles, and subtitles, in logical order, exhibiting the present status of each particular section or act and its application to the subject of mines and mineral lands. The annotations do not purport to be abstracts of decisions on the sub- stantive law of mines and mining generally, but are limited strictly to the interpretation placed on a given section or act definitely re- ferred to by a court or executive officer by the number of the section of the Revised Statutes or the volume and page of the Statutes at Large in which the Congressional enactment is found. It may be observed that the legal propositions stated are not always pertinent to the particular section or act under which they are classed and of which they purport to give a construction. The arrangement, however, is not an arbitrary one, but is so made for the reason that the courts or officers in the construction of a particular section or act definitely referred to by number or volume and page incorporated in the decision matter not strictly pertinent to the par- ticular section or act so designated. This statement applies especially to the interpretations placed on the sections of the Revised Statutes. The explosion hazard of methane-air mixtures has become an increasingly serious mine planning problem, and an advance assessment of methane gas potential can therefore be essential for a safe and economic mine development program. As part of its coal mine health and safety program, the Bureau of Mines has developed a simple, inexpensive test to measure the methane content of coal samples obtained from exploration cores. The gas content of coal per unit weight as determined by the direct method test can be used as a basis for a preliminary estimate of mine ventilation requirements, and to determine if degasification of the coalbed in advance of mining should be considered. Since the Bureau began measuring the gas content of coal samples in 1972, experience has led to equipment and procedural changes, the most significant of which has been the development of a ball mill for crushing the coal sample to release the residual gas at the end of the desorption test period. This revised procedure replaces the crushing box and graphical methods described in earlier Bureau publications. The results of 583 direct method tests are summarized in tabular form. These results include data on the gas content of 125 coalbeds in 15 States.

Shales and clays from Illinois were sampled, tested, and evaluated to determine feasibility of producing lightweight aggregate by rotary-kiln methods. Sampling procedures and the 1 ,,,y of the Pennsylvanian shale units are discussed. Chemical, X-ray spectrographic and X-ray petrographic analyses were run on the samples to determine if a correlation existed between chemical mineralogic composition and expansion. Preliminary expansion testing was conducted in a muffle furnace. Rotary-kiln tests were conducted in a 16- inch by 14-foot rotary kiln. The weight of the aggregate ranged from 27 to 59 pounds per cubic foot. Concrete cubes employing the aggregate were tested to determine the qualities of the concrete. Compressive strength of the concrete using the 7-bag of cement cement per cubic yard mix, after autoclave curing for 6 hours, ranged from 2,950 to 6,750 psi. No correlation was found between the chemical, X-ray spectrographic, and X-ray and petrographic analyses and expansion, Sixteen samples made suitable lightweight aggregates in the laboratory rotary kiln. The expansion temperature range of eight of the samples was extremely narrow, and difficulties would probably be encountered in processing these materials commercially.

This Bureau of Mines study estimates capital investment, operating costs, and selling prices for three underground bituminous mines producing coal with annual production ranging from 1.03 to 3.09 million tons. It is assumed that the mines have a 20-year life. Wages and union welfare payments are considered as of December 6, 1974, under the Bituminous Wage Agreement of 1974, and costs for material and equipment are based on 1975 indexes Initial capital investment ranges from $26,498,500 for the 1.03- million-ton-per-year (MM tpy) mine to $67,173,300 for the 3.09-MM-tpy mine. Total capital investment ranges from $37,437,500 to $92,984,300 for the same mines. Corresponding selling prices for the coal range from $14.83 to $13.26 per ton, assuming a 15-percent discounted cash flow rate of return after Federal income taxes.
