This work is a codification and annotation of the Congressional enactments relating to minerals, mineral lands, and mining. It covers every enactment of Congress from the original ordinance of 1785 to the present time, as well as all sections of the Revised Statutes of the United States relating to these subjects. These laws are grouped according to their general subject matter, and are arranged thereunder in numerical or chronological order. Many of the mining statutes include matter not pertinent to the subject, and only those parts of such acts are quoted as will properly show their relation to minerals and mineral lands and indicate how they should be construed. Some mining acts have been repealed or have become obsolete, and others have become incorporated substantially in sections of the Re- vised Statutes; but these are retained in order to show the changes made, and the constructions placed thereon by the courts are given as aids in construing the new or repealing acts. The annotations consist of legal propositions abstracted from the decisions of the various courts and executive officers of the Govern- ment that have interpreted the sections and statutes so codified. These legal propositions are arranged under the different sections and acts with appropriate headings, titles, and subtitles, in logical order, exhibiting the present status of each particular section or act and its application to the subject of mines and mineral lands. The annotations do not purport to be abstracts of decisions on the sub- stantive law of mines and mining generally, but are limited strictly to the interpretation placed on a given section or act definitely re- ferred to by a court or executive officer by the number of the section of the Revised Statutes or the volume and page of the Statutes at Large in which the Congressional enactment is found. It may be observed that the legal propositions stated are not always pertinent to the particular section or act under which they are classed and of which they purport to give a construction. The arrangement, however, is not an arbitrary one, but is so made for the reason that the courts or officers in the construction of a particular section or act definitely referred to by number or volume and page incorporated in the decision matter not strictly pertinent to the par- ticular section or act so designated. This statement applies especially to the interpretations placed on the sections of the Revised Statutes. "INTRODUCTION North Carolina has been the leading producer of mica in the United States, accounting for roughly 50 percent of the Nation's output. The producing area is a belt some 100 miles in width lying in the Mountain and Piedmont sections in the western part of the State. Ashe, Watauga, Avery, Mitchell, Yancey, Buncombe, Haywood, Jackson, Macon, Transylvania, Rutherford, Cleveland, and Lincoln Counties supply the bulk of production, while small amounts have been produced in Gaston, Catawba, Burke, Wilkes, Yadkin, Stokes, and Person Counties.To assist the operators and expedite the production of mica during the recent emergency, the Bureau of Mines drilled four of the more promising mica properties in this State. The results of this exploratory program are recorded in this report.ACKNOWLEDGMENTSIn its program of investigation of mineral deposits, the Bureau of Mines has as its primary objective the more effective utilization of our mineral resources to the end that they make the greatest possible contribution to national security and economy. The Coeur d'Alene minim, district of Shoshone County, Idaho, has been one of the largest and most active lead-silver producing districts in the United States for the last 40 years. The mines of the district enjoy exceptional natural advantages with respect to ventilation in that the veins apex high on mountain sides and are most often developed to considerable depths, up to 2,000 feet, by adit and crosscut tunnels under conditions that develop large natural draft pressures; the increase of temperature of the rock with increase of depth from surface in at a low rate; and the average surface temperatures are low. These natural conditions have, in the main, resulted in well-ventilated mines with low temperature conditions throughout. However, where the development has been carried to considerable depths below the lowest level of surface entry, natural-draft ventilation has proved inadequate, and mechanical ventilation systems have been installed on the three largest mines of the district. Local conditions, more particularly those in dead-ended working places, have also required auxiliary ventilation by will fan-pipe units in these and other mines. A particular feature of the district is the number of exceptionally long crosscut tunnels that have been driven to provide entry to vein systems from low points adjacent to milling and transporta¬tion facilities. Three of these tunnels are approximately 2 miles long, and lengths of 3,000 to 8,000 feet are quite common.

Tests were conducted in commercial foundries to determine the suitability of calcined anthracite as a cupola fuel. The calcined anthracite performed satisfactorily at two of the three foundries where iron-melting tests were conducted. Performance at the third installation was unsatisfactory because metal temperatures deviated widely and, in general, were lower than is desirable for the type of castings being made.

This U.S. Bureau of Mines (USBM) research simplified an earlier hydrogen chloride (HCI) leach-sparge process developed by the USBM to recover reduction-grade alumina from domestic kaolin clay. Improvements were made by decreasing the initial leaching acid concentration from 25 to 20 pet, decreasing the leaching time from 1 to 2 h to 15 to 30 min, eliminating the solvent extraction step for Fe removal, and eliminating the step to recover the AI content of the bleedstream circuit. A 10-cycle bench-scale experiment of the simplified process showed that the ferric chloride (FeC13) concentration built up to 9.3 g/L in the recycle stream. This did not interfere with any of the unit operations or final alumina product purity because Fe forms stable soluble chloride complexes when sparged with HCI and is easily washed from the large aluminum chloride hexahydrate (ACH) crystals. The reduced leaching time and acid concentration did not decrease Al extraction.

The value of mineral production in-creased 13% in 1977. Nearly all commodities registered an increase in production and value, continuing a trend that started in 1976. In addition, practically all commodities registered an increase in unit value. Alabama led the Nation in the production of crushed marble, was second in bauxite and scrap mica third in kaolin and oyster shell, and fourth in bentonite, dimension marble, and fire clay.

The explosion hazard of methane-air mixtures has become an increasingly serious mine planning problem, and an advance assessment of methane gas potential can therefore be essential for a safe and economic mine development program. As part of its coal mine health and safety program, the Bureau of Mines has developed a simple, inexpensive test to measure the methane content of coal samples obtained from exploration cores. The gas content of coal per unit weight as determined by the direct method test can be used as a basis for a preliminary estimate of mine ventilation requirements, and to determine if degasification of the coalbed in advance of mining should be considered. Since the Bureau began measuring the gas content of coal samples in 1972, experience has led to equipment and procedural changes, the most significant of which has been the development of a ball mill for crushing the coal sample to release the residual gas at the end of the desorption test period. This revised procedure replaces the crushing box and graphical methods described in earlier Bureau publications. The results of 583 direct method tests are summarized in tabular form. These results include data on the gas content of 125 coalbeds in 15 States.

This is the first report published by the Bureau of Mines on washability characteristics of coal from beds in Tennessee. It is based principally upon screen-sizing and float-and-sink tests of raw coal from a bed on the Cumberland Plateau. Stripping operations were undertaken recently on this bed by the Cumberland Collieries, Inc., near Chalybeate,Van Buren County, Tenn. The bed has not been definitely correlated, but it may be an extension of the Sewanee bed, which has been mined extensively in the Tracy City district to the south-vest and at points near Dunlap and Pikeville to the southeast and east. It was spoken of by officials of the Cumberland Collieries as the Sewanee bed at the time of sampling for this study. In a letter dated October 16, 1948, W. D. Hardeman, geologist of the Department of Conservation, Nashville, Tenn., states: "The stripping operations of the Cumberland Collieries near the old postoffice at Chalybeate are, I am fairly certain, in the upper part of the Whitwell shale, which carries the Sewanee coal. This coal may be a stray seam, but it probably can be correlated with the Sewanee coal, which is mined farther east. "There are no detailed geologic maps or reports covering the area, and this opinion is based on what was observed in visiting the strip mines in that general vicinity." The laboratory work upon which this report is based was done at the Southern Experiment Station of the Bureau of Mines, United States Department of the Interior, in cooperation with the University of Alabama and the Cumberland Collieries, Inc.

This Bureau of Mines manual is intended to provide a better understanding of ground movement and the technology available for measuring it, The manual deals with convergence, strata separation, lateral roof movement, stress, and support load in underground mines. The instruments that measure these ground control parameters are described in detail. Step-by-step procedures for selecting the appropriate instrument are presented, which consider such factors as approximate cost, installation procedures, data collection, and data interpretation; and an instrument selection worksheet is provided to facilitate the instrument selection process. Actual instrument case studies and a list of instrument suppliers are presented in the appendixes.

This report describes results of laboratory-scale experimental treatment of nine ores containing gold and silver, including samples of products of previous plant treatment, from ore deposits in California and Nevada. The samples treated were taken by engineers of the Bureau of Mines during investigations of these ore deposits. The information reported is of interest for development of the mining districts represented or in future Investigations of similar ores from other sources. The treatment methods were as simple as possible. More complicated treatments were tried when required, The applicability of the methods and their limitations in treating the ores are shown by the data in this report. The following treatment methods were employed in the experiments described: Screen analyses were made to determine distribution of values in various screened-sized portions of crushed ore, or to determine optimum size to which a particular ore should be crushed or ground to liberate values, and some-times to determine residual values in various-sized portions of treated material.

This study was done to evaluate the economic and technical considerations of using pozzolanic materials in order to guide cement manufacturers, pozzolan producers, contractors, Government organizations, and others interested in concrete construction work. Five hundred and thirty-eight samples of pozzolanic raw materials were taken from 27 central and western States. These samples were evaluated by petrographic procedures, and about 200 of the most promising ones were given a complete series of physical tests (American Society for Testing and Materials) to evaluate further their suitability as a pozzolan. This investigation showed that deposits of natural pozzolan materials were widely dispersed in the central and western parts of the United States but that exploiting these deposits would depend on whether they could compete economically with an increasingly abundant industrial waste product--fly ash.

Shales and clays from Illinois were sampled, tested, and evaluated to determine feasibility of producing lightweight aggregate by rotary-kiln methods. Sampling procedures and the 1 ,,,y of the Pennsylvanian shale units are discussed. Chemical, X-ray spectrographic and X-ray petrographic analyses were run on the samples to determine if a correlation existed between chemical mineralogic composition and expansion. Preliminary expansion testing was conducted in a muffle furnace. Rotary-kiln tests were conducted in a 16- inch by 14-foot rotary kiln. The weight of the aggregate ranged from 27 to 59 pounds per cubic foot. Concrete cubes employing the aggregate were tested to determine the qualities of the concrete. Compressive strength of the concrete using the 7-bag of cement cement per cubic yard mix, after autoclave curing for 6 hours, ranged from 2,950 to 6,750 psi. No correlation was found between the chemical, X-ray spectrographic, and X-ray and petrographic analyses and expansion, Sixteen samples made suitable lightweight aggregates in the laboratory rotary kiln. The expansion temperature range of eight of the samples was extremely narrow, and difficulties would probably be encountered in processing these materials commercially.

This paper describes the location, features, qualities, extent, and potential of iron occurrences and some associative resources - limestone and dolomite, coal, petroleum and natural gas, power, and water - in New Mexico. Reconnaissance investigations were made of 118 iron occurrences to determine their extent, attitude, and potential; character samples were analyzed to determine their quality and impurities; and pioneer metallurgical investigations were made on character samples to present their metallurgical problems. Some factors influencing past and potential iron markets are discussed. The most abundant iron minerals are magnetite and hematite, The higher grade deposits are extensive contact-metamorphic and pyrometasomatic replacements in calcareous Paleozoic rocks associated with intrusives. Low-grade deposits of considerable potential are the extensive Cambrian oolitic hematites of sedimentary origin and the Precambrian magnetite-hematite taconite iron formation. Iron occurs also as extensive colluvial and alluvial concentrations. A wide variety of accessory elements are indicated and these pose metallurgical and economic problems.

A complaint in an action to quiet title to minerals and to the min- eral rights in certain land is insufficient in the absence of a direct allegation of possession, although it avers that the plaintiff from the time of receiving the conveyance assessed the mineral interest for taxes each year and paid the taxes thereon and exercised various acts of ownership of such mineral interests, in that he caused test pits to be dug on the land for the purpose of exploring the minerals and ascertaining their quality and extent, in going upon the land and looking after them from time to time, and that he accompanied or caused his agents to accompany prospective purchasers of such mineral interests and exhibited the same to such prospective pur- chasers in efforts to sell them. "In a previous paper the Bureau of Mines. 3/ presented in condensed tabular form all analyses of Texas crude oils made by the Bureau up to March 193K. This previous report states;The first Al well in Texas was drilled near Oil Springs, Nacogdoches County, in 1863-67. However, the first oil field of major importance in the State was discovered at Corsicana,Navarro County, in 1895. Since that time the petroleum industry try in the State has spread and grown until today petroleum from Texas is an important commodity in world petroleum markets.Since March 1939 samples of Texas crude oils from many new fields, and some older fields not covered in the previous report, nave been analyzed. Those analyses arc reported in the present paper. The annual production by years from 1896 to 1940, inclusive, taken from the figures in the Bureau of Mines Minerals Yearbook, are given in table 1. This survey report, the first for this type of fuel, is issued to provide information on the characteristics of the burner-fuel oils now manufactured for sale. Reports of surveys of diesel fuel, conducted under a cooperative agreement between the American Petroleum Institute and the Bureau of Mines, United States Deportment of the Interior, have been published annually since 1950.2/ This survey of burner-fuel oils is similar to the diesel-fuel surveys In pattern and has been conducted under an extension of the same agreement at the request of the Oil-Heat Institute of America and the petroleum industry. It is not intended to conflict with the diesel-fuel survey but rather to supplement it. Burner-fuel oils, also specifically referred to as heating oil, range oil, furnace oil, "Bunker C," and fuel oil, are sold in increasing volumes for use in this country and for export. Sales of all grades of fuel oil in the United States have increased from 340 million barrels in 1926Y to over a billion barrels per year. 4/ Distillate fuel oil sales, in proportion to total fuel-oil volume sold, increased from 42 percent in 1950 to 50 percent in 1954. Sales of distillate and the heavier residual oils during recent years are shown: [ ] It must be realized that the data given are not accurate indications of the use of these materials as burner fuels. Some burner fuel, used as range oil, is kerosine, which is not included above. The Bureau of dines present, an economic evaluation of its process for the ferric chloride leaching of chalcopyrite concentrate. In this process, chalcopyrite concentrate is leached with ferric chloride solution to extract copper, which is precipitated from the solution by electrolysis while leaving sulfur in the residue. Spent liquor from electrolysis is treated with oxygen to regenerate the ferric chloride leach solution and the sulfur-laden residue is processed to recover the sulfur. A cost estimate was prepared for a plant capable of processing 600 tons of chalcopyrite concentrate per day, 330 days per year. The fixed capital cost, on an early 1.975 basis is $27,831,600 and the estimated operating cost is 9.9 cents, per pound of copper product. In comparison, the estimated operating cost of a smelter equipped with a citrate process plant to recover sulfur is about 13.6 cents per pound of copper product. No charge for chalcopyrite concentrate or credit for recovered byproducts has been included in either operating cost. The ferric chloride leach process, therefore, appears to be economically attractive.
