Two recent antitrust cases, coming from widely separated areas, different industries and involving wholly different facts were decided by the Supreme Court on June 7, 1965. The decisions in these two cases may well prove to be the most important and far-reaching decisions in the field of labor law that have been handed down in the last 24 years. These cases, although quite dissimilar factually, had one common element. In both, the gravamen of the antitrust violation was bottomed on the terms of labor agreements negotiated by a multiemployer group. These cases are usually referred to as Pennington1 and Jewel Teat. Since a number.-of references will be made to the antitrust laws, it may be well to state briefly the applicable portions. Section I of the Sherman Antitrust Act makes "every contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce among the several states, or with foreign nations, is declared to be illegal...". Section 2 imposes criminal sanctions against "Every person who shall monopolize, or attempt to monopolize, or combine or conspire with any other person or persons, to monopolize any part of the trade or commerce among the several states...". Under Section 4 of the Clayton Act a person who sustains damages as a result of a violation of the antitrust laws is entitled to recover treble damages plus costs.

Pumped storage power plants are one of the options to store the fluctuating production of electric energy from renewable sources in a sustainable manner and is able to provide Europe with the opportunity to overcome the effects of climate change. However, due to the extensive land use required when planning the water reservoirs, several projects have been declined after social conflicts raised, even in Germany. Nonetheless, after the flooding and drought periods in northern Germany, the catastrophic floods of July 2021 in south west Germany, the country’s need to decrease its dependency on import of gas and energy supply, and the energy transition goals set for 2030 and 2050, it has become clear that the implementation for water reservoirs must increase in the coming years, whether above ground or underground. Furthermore, not only Germany is interested in the use of underground cavities for water and energy storage, other European countries as Sweden are currently developing studies and solutions to bring this concept soon to reality in Europe. This article introduces the systematic approach for planning and designing large underground cavities for water reservoirs as a sustainable energy transition approach and a climate change response by showcasing the process of selection and results of the “Energy and Water Storage Harz” (EWAZ) research project. Additionally, the results of the evaluation of the effect of implementing the selected underground and surface infrastructure into the current water management system in the region is presented. Finally, the different possibilities evaluated for the underground cavities within the project and the technical challenges involved are be discussed.

[This paper summarizes the more popular mineral valuation techniques being used by the dining industry, and attempts to demonstrate how they are Interrelated and where some are in error when compared to modern methods of financial analysis. The academic community and the larger and more sophisticated raining companies, have largely rejected the older valuation methods such as the, Hoskold and Morkill concepts and replaced them with "discounted cash flow" (DCF) techniques. The relevancy and usefulness of the older methods have been questioned primarily on the basis of their underlying assumptions that mining companies do not have numerous alternative investments and must use sinking funds deposited at market or ?safe" rates of return to recover the purchase price of mineral reserves. The ability to reinvest In numerous (often non-mining} alternative business ventures, the changing purchasing power of the dollar, corporate income and other taxes, depreciation and depletion allowances, and modern financial management practice, all mitigate against the continued use of the older valuation methods, especially for the larger mining companies. Snail mining companies and Individuals still use these methods largely out of habit and familiarity. Federal and state regulations, in an effort to reduce acid rain, are becoming increasing more stringent regarding sulfur content of fossil fuels. Whereas coal from Illinois and Ohio contains between 1.5 and 37. sulfur, Wyoming has billions of tons of coal reserves containing less than O.5/% sulfur. However, much of Wyoming's coal is high in moisture, 25-30%, and low in energy, 8,200 to 8,900 BTU, vs. 10,500+ BTU for Illinois and Ohio Basin coals. Wyoming currently ships in excess of 130 million tons of coal to utilities as distant as Michigan, Wisconsin, Minnesota, Iowa, Nebraska, Louisiana, Oklahoma, and Texas. With freight charges ranging from $12.00-$20.00/ton, more than $1.5 billion a year is spent to transport water. A test shipment of more than 50,000 tons of Wyoming coal has recently been made from Mobil's Cabello Rojo Mine, south of Gillette, by Burlington Northern to the Robert's Bank British Columbia coal terminal for transloading and shipment to Taiwan Power Company. This coal assayed approximately 8,400 BTU/lb. and 277. moisture. Carbontec Energy Corporation feels the future availability of dried coal containing 11,000+ BTU could substantially enhance the potential export as well as the domestic market for Wyoming coal. Large and small utilities, along with industrial furnaces require tens of millions of tons of Wyoming, West Virginia, and other Eastern The federal government is encouraging the expenditure of hundreds of million of dollars by utilities to retrofit their boilers to allow them to burn higher sulfur coal. This program, if carried to completion, would cost many tens of billions of dollars, with the net result being high power costs sustained by the utilities. These costs will be passed on and paid for by the American consumer. A sensible alternative would be the burning of low sulfur coal by the utilities, without costly capital and operating expenditures. Carbontec Energy feels the successful operation of a Carbondry Coal Drying Plant in Wyoming will be the forerunner to other similar and larger operations in the State. CARBONTEC RESEARCH The activities of Carbontec's personnel to develop a viable process to dry sub-bituminous and lignite coal goes back some 14 years; in fact, for some of us it goes back to 1962 when we were involved in a program under which lignite coal from Truax Trayer's Velva mine was placed in low sulfur coal, which are burned alone or blended with high sulfur, Midwestern coal. Carbontec believes that a high BTU. reasonably priced, shippable coal fuel produced in Wyoming and delivered at costs competitive with Eastern low sulfur coal, could offer substantial benefits to Wyoming coal producers, utility customers, and to the State of Wyoming.

For many years, the combined efforts of machinery manufacturers and mine operators have endeavored to achieve greater productivity from the men involved and the machinery and capital invested, by developing methods to drill blast holes more effectively. Obviously, this means much more than simply developing a drill that will drill a single hole faster. Considerable attention over these years has also been given to methods of carrying and positioning the drilling machine on versatile jumbos, whereby the man's time can he better utilized by the faster drilling machines. Likewise, the art of blasting to utilize the holes that were drilled to achieve the maximum amount of fragmented ore and the methods of moving the broken ore have also progressed. But each phase of the production cycle just described must be made to balance with the other phases of the work. Obviously, major breakthroughs in only one phase don't always generate more "rock in the box" per manshift. Yet, through the persistent effort of the machinery developers and the researchers, the progressive attitudes of mine managers, backed by corporate capital investments, and battle after battle at the operating level, progress is made. Then, if the innovated system is good enough to "stick", in a few years it becomes the system that the newer method must replace, after the same repeated struggle. This is the situation that many mine operators find themselves in today, Looking at their production cycle, which is assumed to be efficient and balanced between drilling, blasting and materials moving capabilities, they tend to guard any visable disruption of the balance of that day's production, and many would prefer to maintain the status quo indefinitely. This Bureau of Mines report describes methane liberation trends from all U.S. coal mines liberating over 100 Mcfd (100,000 cfd) (2.8 Mm3/d). Detailed are results from the latest Bureau survey performed in 1985 and shown are mine and company name, location, coalbed and methane liberation quantity. The report shows that in 1985, there were 180 mines producing more than 100 Mcfd (2.8 Mm3/d) and the total quantity of methane liberated by these mines was 303,900 Mcfd (8,605 Mm3/d). This data is compared with previous studies performed in 1971 , 1973, 1975, and 1980. From 1971 to 1985, there was a 10% decrease in the number of mines liberating at least 100 Mcfd (2.8 Mm3/d) but there was a dramatic 34% increase of liberations from these mines. The increase seems to be caused by new mines being developed in deeper, gassier coalbeds, particularly in Alabama. Likewise, in comparing the ten highest liberating mines in 1975, 1980, and 1985, an increase in methane liberations each year was experienced. The report classifies mines by three levels of liberations: greater than 100 Mcfd but less than 500 Mcfd (2.8 to 14 Mm3/d); 500 Mcfd to 1 ,000 Mcfd (1 4 to 28 Mm3/d); and greater than 1,000 Mcfd (>28 Mm3/d). It was found that 87% of liberations were from mines producing over 1,000 Mcfd but these accounted for only 38% of all the mines in the study.

Optimization of a process is achieved by selecting, 'from all the known options, the most beneficial method of obtaining a product. It is rare that the optimum process is arrived at by conventional methods, because of the great amount of time required for developing and comparing all the options. On the other hand, it is now possible, by means of an optimization program based on special mathematical formulas involving an algorithm and implemented by a computer, to plot the optimum process realizing considerable savings and in a reasonably short time. The flow sheet arrived at in accordance with the optimization program described in this paper investigates and develops all the possible options and, with the aid of the computer, makes it possible to select the most economical ore beneficiation process. The options in an ore beneficiation process are all the possible trajectories that can be traced through the particle sizes to which the ore is reducible in the extraction of its valuable minerals. Although an ore can have a wide range of composition and several valuable minerals that can be extracted, this paper is concerned with the special case in which only one mineral is extracted from the ore and in which the maximum allowable percentage of impurities in the end product is defined.

Cyanide is highly toxic to humans and other organisms. Concentrations of RCN as low as 0.05 ppm can be lethal to fish (Scott and Ingle', 1981). In wet climates and in colder climates where natural degradation is slow, it is becoming mandatory to destroy cyanides in effluents before they can be discharged. The disposal of spent gold ore as tailings from cyanide heap leach processing facilities is a matter of concern to the public, the mining industry, and regulatory agencies. South Dakota mining laws and regulations require that spent ore be neutralized to a suitable level with respect to cyanide before disposal (Durkin, 1990). To safeguard the environment and protect ground-water and surface-water supplies adequately, a reliable test is needed to determine the amount of cyanide in the solid spent ore.

In June 1997, Mount Polley Mining Corp., a division of Imperial Metals Corp., completed an 18-kt/d (20,000 stpd) gold-copper mine in central British Columbia. Fast-track construction and extensive off-site construction were combined with an aggressive project schedule to build the mine in one year. This was three months ahead of schedule and 7% below the original budgeted cost of C$123.5 million (US$86 million). The Mount Polley Mine was the first of a crop of new open-pit mines in British Columbia. The Mount Polley deposit has been explored since the mid-1960s when it was known as the Cariboo Bell property. From 1988, Imperial Metals completed drilling and metallurgical testing on the deposit. This led to a positive feasibility study and the issuing of a Mine Development Certificate in 1991. The project was later shelved due to falling metals prices and the strength of the Canadian dollar. In late 1994, Imperial merged with Bethlehem Resources Corp., bringing a strong project team to the company. The deposit was then re-evaluated, ore reserves revised and additional metallurgical testing was performed. The result was a revised project plan. It indi¬cated that a financially feasible gold-copper mining op¬eration could be constructed at Mount Polley operat¬ing at 18 kt/d (20,000 stpd). In May 1996, an agreement was reached with Sumitomo to jointly fund and develop the project. By early 1996, final plans and permits were being prepared for construction, scheduled to begin in June 1.996. On-site work commenced on May 28th, 1996 following lifting of the road restrictions. Mount Polley Mining acted as its own project manager. Construction was completed in June 1997. Plant runup took place in July and full production began in August. Through the use of off-site construction and the careful selection of contractors who cooperated to complete some 12 major contracts, it was possible to reduce the mine and mill construction time from 16 to 13 months. Off-site construction for all possible aspects of the work and the use of used milling equipment allowed significant savings in overall capital costs of construction. Total costs for the mine, mill and tailings dam equated to C$6,100/t/d of throughput. The mill design incorporates several innovative features that will aid maintenance and allow flexibility of operation. The operation is designed as a closed system and meets the latest environmental standards. Concentrate is shipped by truck to the port of Vancouver. Revenues for the mine come from the mine's production of about 3.1 t/a (100,000 oz/year) of gold and 10.8 kt/a (24 million lbs/year) of copper during the first four years of the 12-year mine life.

Refractory sulfide flotation or gravity gold concentrates are coated onto a sized support matrix and placed in a heap configuration for biooxidation. The surface coating is typically less than 0.05 in. thick and the support matrix is preferably composed of 0.375 to 0.75 in. diameter material. The exposed thin coating of sulfides reduces biooxidation rate limitations due to oxygen mass transfer. The large spaces between matrix particles reduce resistance to fluid percolation and aeration in the heap. The capital and operating costs for this biooxidation configuration are significantly less than for concentrate biooxidation in stirred tanks. After 30 to 90 days of biooxidation, sub- sequent gold recoveries exceed those seen in whole ore heap biooxidation and are comparable to recoveries obtained from stirred tank biooxidation processes. Results from laboratory and pilot testing indicate that this technology is a viable alternative for pretreating sulfide refractory gold ores.

1his paper presents a modified ordinary kriging technique referred to as the "Nearest Neighbor Kriging" (NNK). The method is a simple and practical tool to use when the ordinary kriging (OK) results are unreasonably smooth, especially when estimating recoverable ore reserves for deposits with skewed grade distributions. NNK is robust and globally unbiased like OK. However, it is more advantageous over OK because it can control some of the smoothing and conditional bias which have been the major pitfalls of OK in many grade estimation cases. The paper details the methodology of NNK and its application to a gold deposit.

Pocahontas Land Corporation, a wholly-owned subsidiary of Norfolk and western Railway Company, owns a 100,000-acre block of coal lands in Martin, Johnson, Pike, Floyd and Lawrence Counties, Kentucky. These holdings were largely acquired in three major purchases between the years 1942 and 1959. The area is undeveloped and constitutes a part of the coal reserve for future mining. This block, which is principally in Martin County, lies in a triangle formed by the Levisa and Tug Forks of Big Sandy River on the sides with Dewey Dam at its base and the Town of Louisa at the apex. The topography'is typical of eastern Kentucky and consists of steep hills rising from 500 to 800 feet above creek level. There is little level ground in the area. As a matter of fact, some roads are on the creek bottoms with what little bottom land is available in the hollows being utilized for small-scale farming. The steep hills are marked by three separate massive sandstone formations which form cliffs ranging from 40 to 100 feet in height.

Successful longwall gate entry design requires control of both vertical and horizontal stresses. Vertical, or overburden, stresses are most severe in the tailgate where they are concentrated by longwall panel extraction. Horizontal stresses, which are generally tectonic in origin, can be highly destructive during the development and headgate phases of longwall mining. The goal of this paper is to present the current state-of-the-art in detecting and controlling horizontal stresses. The information presented was collected through site investigations at 45 U.S. longwalls and an international literature review. The paper begins with a discussion of the present knowledge of regional in situ stress fields in the U.S. A review of available underground stress measurements from coal mines is presented, along with data collected by structural and petroleum geologists. The combined evidence indicates that a persistent ENE-EW trending stressfield is present throughout the eastern coalfields. Experience with horizontal stress in longwall mines is addressed next. The paper focuses on the northern Appalachian region, where the effects of horizontal stress have been most evident. Three case histories are discussed in detail, and the solutions each developed are highlighted. Observations made in the Southern Appalachian, Alabama, and Illinois coalfields are also described.

A 0.5 m (20 in) diameter high pressure natural gas pipeline crosses over a coal mine located in Central Utah. Ground movement induced by the mining operation could possibly place excessive strain on the pipeline causing it to rupture. The mining operation extracts coal from two seams using the room and pillar method. The seams are situated one on top of the other and both lie directly under the pipeline. At present, only the upper seam is being mined beneath the pipeline. However, in the future, the mining operation of the lower seam will also affect the pipeline. As would be expected, mining of both coal seams causes surface subsidence. This is especially true when the pillars are extracted during retreat.

Utilizing the technology developed for oil well stimulation by hydrofracing, a disposal system which permanently fixes the waste has been proven. Large quantities of radioactive waste can be processed by a single well system making this method an attractive method for permanent radioactive waste disposal. The system depends on locating a relatively thick formation of impermeable, but easily fracturable rock such as a shale, creating a horizontal fracture, pumping the waste into the fracture in a form which will subsequently solidify and seal the fracture from the well system. The paper presents the theoretical considerations from creating and extending horizontal fractures and how these considerations were used in designing a waste disposal system which is now operating.

I can recall a time 10 or 12 years ago when I spent a pleasant Sunday afternoon driving to Jim Thorpe, Pennsylvania to see a carnotite deposit that had recently been discovered. The announcement of the discovery stated that it was in the Pottsville conglomerate in a road cut along the highway. To my surprise, the highway was lined with cars and every weekend prospector for 100 miles had come to see the ?big uranium deposit of the east?. I literally had to stand in line to make a measurement with the scintillation counter I had with me. The thought at first occurred to me that this is evidence of how thoroughly the surface of the United States must have been prospected, more likely, perhaps it points out quite the opposite. A lot of time and energy was being spent in tracing the footsteps of others and a lot of time was spent looking for the obvious occurrences. The point is, that in the early days a tremendous amount of uranium exploration was carried out but few systematic surveys were made. Thorium anomalies were usually discounted after cursory surface field checks. Conversely, in airborne surveys - anomalies due to elevation changes or thin over- burden on hilltops were often investigated more thoroughly than smaller indications on hillsides and valleys. An adequate supply of uranium was nevertheless found due to the ingenuity and persistence of the geological profession and the public in general. This ?adequate? supply, like so many estimates for raw materials turned out to be far too low.

A comprehensive flotation study has been carried out on a Chinese fluorspar ore using the packed flotation column developed at Michigan Technological University. The results are compared with that of a conventional mechanical flotation method on the same feedstocks. Key factors controlling flotation performance of both methods are evaluated based upon a simple statistic design. The flotation concentrate produced in one stage of the packed column has 4-S% higher recovery and much lower silica impurity content than that produced by up to six stages when a conventional mechanical cell is used. The results also show that the packed column flotation process is particularly suitable for recovery of finer fluorspar particles.

Over-exposure to noise remains a widespread, serious health hazard in the U.S. mining industries. Most other categories of illnesses and injuries associated with mining have improved, with the exception of hearing loss. Mine Safety and Health Administration (MSHA) coal noise data from 2000-2004 show that the continuous mining machine is first among all equipment with 35% of the noise overexposures. Joy Mining Machinery, in collaboration with the National Institute for Occupational Safety and Health (NIOSH), is conducting research to reduce noise generated by continuous mining machines. This paper describes a ?JOY Designed for Noise Reduction? (JOY-DNR; Patent Pending) tail section as a noise control for reducing the noise overexposures of continuous mining machine operators. Underground results show a 45% and 65% noise exposure reduction for the operator when compared to a standard machine. Utilizing this newly developed noise control, along with previously proven controls, will provide continuous mining machine operators an opportunity to be within the MSHA-Permissible Exposure Limit (MSHA-PEL).
