Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,

PRESIDENT SHOTT: Gentlemen, the meeting will now come to order, please. Members of the Institute: It is with great pleasure and honor that we welcome you to the thirty-ninth regular meeting of the Rocky Mountain Coal Mining Institute. I assure you that Mr. Krippner, the General Chairman, and his associates have an outstanding program in store for you, and trust it will be of much interest to the industry. I note by the program they have me slated for an opening address, but I am going to defer that, proceed with the remainder of the program, and endeavor to go on schedule and keep matters on schedule as outlined on our program. The first item on the program is the reading of the minutes of the thirty-eighth regular meeting by the Secretary. I might say that it has been customary in the past that we omit the reading of the minutes. If that is not agreeable, we will read them; otherwise, I would like for someone to make a motion that we dispense with the reading of the minutes, inasmuch as they are published in our annual report each year. Reef, of Denver, containing proposed amendments to the Constitution and By.-Laws, was read, and, upon motion,, was referred to the Executive Board, with .instructions to report upon the matter at the next, regular meeting. The proposed amendments follow: Article I1 (regarding who may become members and how) to be amended to read as follows: "Membership in this Institute shall be of three classes-corporate, individual, and honorary. Any company, firm, or individual operator actually engaged in the mining of coal within the territory of this Institute may become a corporate member on application, and by consent of a majority of the members present at any stated meeting. Any person, who is directly engaged or interested: in some branch of coal-mining may become an individual member upon application, and by consent of a majority of the members present at any stated meeting. Honorary members may be elected at the discretion of the Institute."

The eightieth regular meeting and convention was called to order by the President, John T. Atkins, at 9:15 a.m. Monday, June 25, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. President Atkins welcomed the members and their guests to the convention and noted that the annual business meeting would be held Tuesday afternoon at 2:00 p.m. in the same room. A convention update was made by the Conven¬tion Liaison Officer, Loren V. Linville. This was followed with a program report by the Program Chairman, Doug Ingram. The chair then called on Clifford Barrett, Upper Colorado Regional Director of the Bureau of Rec¬lamation of the United States Department of the Interior. He presented the Bureau's Citizen Award to RMCMI former president Ira E. McKeever for his outstanding contributions to the joint private/ Federal effort and the open planning process for AQUATRAIN. According to Barrett, "from 1981 to early 1984, McKeever led private industry work in the AQUATRAIN project, a proposal for a 1,400 mile long pipeline system. AQUATRAIN was conceived as a possible alternative to solve the government's problem of rising salinity levels in the Colorado river, as well as the private sector's need for a more economical coal transport method. The Citizen Award cites McKeever's efforts in developing a model for future cooperative ventures between government and industry that can benefit the nation." Following this presentation, the formal program of the 80th meeting and convention began with the president, John Atkins, introducing the convention kickoff speaker, Andrew Franklin, President of Nerco Mining Co., Inc., followed by the convention keynote speaker, Dr. Margaret N. Maxey of the University of Texas. These speeches are printed in this Proceedings together with those of all other convention speakers. I'm Andrew Franklin, President of Nerco Min¬ing Company, and I'm delighted to be here to kick off the annual convention of the Rocky Mountain Coal Mining Institute. This has always been a very special convention in my eyes and I'm sure this year's will be no exception. I am also here to share my thoughts on the western coal industry and how we're all affected - for good and bad - by public policy decisions. Although the title of my talk is "Western Coal: An Industry Under Siege," I believe a more accurate title might be "Western Coal: The Pit and The Pendulum," because of the wide swings in public policy and coal development in the past 15 years which have cut a zigzag path for growth over this period. As one of the nation's largest coal producers, Nerco is well aware of the problems facing western coal production. Nerco Mining Company is the western coal mining subsidiary of Nerco Inc. We have been "in coal" for more than 25 years through our parent company, Pacific Power & Light. To state my conclusion at the outset, I feel it's extremely important that consistency and common sense should guide our national policy for the development of valuable energy resources. In particu¬lar, we must reduce the wide swings in government policy and activities which have affected energy development. In short, we must decide what kind of game we're playing so that the "players" and the "referees" can keep their eyes on the "ball." Business today faces two main types of uncertainty market uncertainty and public policy uncertainty. As businessmen, we expect and are used to facing the familiar challenges and uncertainties of the market in which we operate. Over the past 10 years, the market has appeared to be bullish on coal. E. H. DENNY (United States Bureau of Mines, Denver, Colorado) In the absence of Mr. Harrington it is my privilege to read his paper, which is in his usual, forcible and sincere style, and it is within the province of this Institute, certainly, to go into it as it concerns safety and efficiency in mining. He brings out some points in his paper that, I think, are well worth the consideration of the Institute. The figures he uses were compiled by Mr. Adams, of the Bureau, and cover a five-year period. However, examination of similar Bureau figures for a ten-year period, or any other long period on other bases brings out similar results. The figures in this paper have been based on the million hours of exposure of accidents, and the figures based on three hundred working-man-day basis, or on tonnage, brings out similar results. This paper is entitled "Accident Record in Western Mines," and it is, in a way, an amplification of Mr. Harrington's letter which was read at the Glenwood Springs Meeting.

Gentlemen: I'm glad to see the crowd that's here this morning, glad to renew acquaintances with many old friends, and if you'll look at the program you'll see a heading there which states that as President I have the honor and pleasure to be here to address the membership of this meeting of the Rocky Mountain Coal Mining Institute, this being the 49th regular meeting. The tentative schedule of this gathering lists on the program the "President's Address," and I want to assure you that this will not be an address or a lengthy speech. It's said that a good speaker is one who arises to the occasion and then promptly sits clown, so please be at ease for I intend to sit clown very soon. There are other men here who have spent time writing and preparing papers on subjects that are to come up for discussion at this meeting, which will be, I'm sure, more interesting than what I have to say this morning; so again I'll say, we'll get this part of the program under way promptly.
