With mining development on hold and other underground works in a slowdown, the develop- ment of nuclear waste repositories takes center stage on the American rock engineering scene. Three repositories for commercial spent fuel -- in salt, tuff, and basalt -- are in the phase of site characterization and conceptual design, and one pilot project for defense high-level waste in salt is under construction. A repository design for crystal line rock has recently been postponed. Because of strict quality assurance requirements throughout design and construc- tion, and because of the need to predict and ascertain in advance the satisfactory perfor- mance of the underground openings, much intellectual energy has been expended to analyze underground openings in the unusual circumstances of the repository environment. In the long term, these efforts will lead to an improved understanding of rock behavior and improved methods of underground analysis and design. For the shorter term, a formalized ground control plan was developed, the princi- ples of which may be applied to other types of projects. This paper summarizes the status of underground design and construction for nuclear waste repositories and presents some details of the ground control plan and its individual elements.

On the 5 September 2014 a road train (tractor-trailer) with two trailers carrying ammonium nitrate was involved in a single vehicle accident on the Mitchell Highway, 30 kilometers (18 miles) south of Charleville in Central Queensland, Australia. The ammonium nitrate was being transported to a mine site for use as a blasting explosive. The truck came to rest in the creek bed adjacent to a road bridge and caught fire. The vehicle burnt for over one hour before the load of ammonium nitrate exploded. Miraculously there were no fatalities; however eight people nearby sustained injuries, some seriously. The road and rail bridge over Angellala Creek were destroyed and vehicles in the nearby vicinity were seriously damaged. The truck carrying the ammonium nitrate was completely destroyed with over 2500 pieces of debris scattered up to one thousand yards (one kilometer) from the blast site.

Near misses recorded and reported by workers can provide awarenessto the potential causes of injury and prompt safety management initiatives. Although most companies require near-miss reporting, it is unclear what the value of these reports are, if any, and how they influence subsequent actions or controls to reduce on-the-job risks. Researchers at the National Institute for Occupational Safety and Health (NIOSH) conducted a case study with an aggregates company in which near-miss reports were analyzed at each of their locations over an entire quarter during the summer of 2018. Within that quarter, workers recorded 249 near misses. Of those, 167 were valid near misses that occurred at work. Researchers coded the reports using a qualitative 5 × 5 risk matrix. Of the 167 near misses, 19% were deemed low risk, 25% moderate risk, 30% high risk, and 26% critical risk. Several patterns in the near-miss incidents were documented, including classification of incidents and common corrective actions referenced (i.e., elimination/substitution, engineering control or redesign, work process/procedures, and personal protective equipment). The analysis provides insight into ways that risk communication and management programs can be improved to reengage workers and their situational awareness on the job.

The world?s ever-expanding demand for energy and coking coals has resulted in the underground mining industry looking at taking on increasingly marginal and geotechnically challenging deposits. The drivers for this change include a reduced availability of open cut reserves and a lack of remaining ?good coal leases?. The lack of plum deposits is forcing some companies wanting to enter the coal supply market to purchase and operate in higher risk, lower margin areas. As geotechnical professionals, we are expected to develop strategies to facilitate safe and productive mining in ground that once would have been avoided. To be successful in these reserves, we are required to use every tool available, from exploration data to longwall automation, and invent or reinvent some new tools along the way. This paper presents geotechnical case studies of challenges in longwall mining and some of the methods developed and used to allow longwall mining to succeed where others said we would fail.

The Sherritt Fort Site nickel refinery and fertilizer plant has been operating continuously since 1954. The ammonia leach process uses ammonia and sulphuric acid, producing nickel and cobalt and an ammonium sulphate byproduct. One of the features of an ammonium sulphate based process is the aggressive nature of ammonium sulphate to concrete and structural steel. After six decades of operation, portions of the structural steel and concrete at the Sherritt facility have become degraded. Infrastructure replacement programs started in earnest more than a decade ago with pipe racks and electrical infrastructure, and have now progressed into building steel. Replacing and repairing this infrastructure within the tight constraints of an operating plant poses several difficult challenges. This paper will outline the approach taken to accomplish this difficult work, and discuss key learnings from the ongoing program.

Throughout the 2016/2017 financial year, the NSW Resources Regulator conducted an assessment of each underground metalliferous operation across the state to assess how each operation managed the principal mining hazard of ground and strata control. The assessment considered all aspects of the mining process, including all aspects of managing geotechnical risk within drawpoints. This assessment is ongoing and, therefore, this paper is limited to the first six mines assessed in the program.In 2015 there were three fatalities in and around underground drawpoints in Australian metalliferous mines. Whilst many of the systems of work around underground development are consistent across the industry, there are large discrepancies around how each underground mining operation manage the risks associated with drawpoints.For drawpoints to be effectively managed, their management needs to be considered at the earliest stages of the mine planning process. By using downholes and adopting remote systems of work – systems that are continuing to improve with technology – the risks drawpoints posed can be greatly reduced.The assessment by the NSW Resources Regulator revealed a number of common failings across the state in the management of the risks that drawpoints pose. The assessment also observed a number of innovative practices that particular operations have adopted in the wake of serious incidents occurring within drawpoints at their operation; however, these practices have not been communicated to other operations.It is hoped the learnings from the assessment can be considered by industry and reduce the risks drawpoints pose in underground metalliferous mines.CITATION:Hill, X, 2017. Capricorn Copper Pty Ltd (CCPL) are operating the Capricorn Copper Mine located at Gunpowder, Queensland. As current holder of the environmental authority for the site, CCPL have obligations to rehabilitate areas of the mine that are no longer operational and have the potential to cause/contribute to environmental harm. CCPL sought a voluntary Transitional Environmental Program (TEP) to provide an agreed program of works to cap and rehabilitate the former Mammoth Tailings Storage Facility. The voluntary TEP contained conditions that were required to be met, to reduce the potential for environmental harm from the facility. The former Mammoth Tailings Storage Facility commenced use in the early 1970’s, and is an unlined valley in-fill structure, contemporary in design compared with other such approved structures of the era. The decommissioned Mammoth Tailings Storage Facility, now known as the Old Tailings Storage Facility (Old TSF), has been a legacy source of contamination due to the existing capping not meeting modern cover criterion, and allowing oxidisation and infiltration to the underlying acid forming tailings resulting in Acid and Metalliferous Drainage (AMD) from the facility. A cover design for the Old TSF, and other mine waste storages onsite that required clay capping, had been proposed by previous operators. Under the TEP cover design phase, it was identified that a key constraint was the lack of significant quantities of low permeability clay onsite. The lack of available clay prompted the consideration of alternate lining materials for the Old TSF, with a Bituminous Geomembrane Liner (BGM) being adopted as the preferred alternative. The BGM compared favourably with clay-based materials on seepage analysis, and led to other benefits by eliminating the need for borrowing clay off site, reducing the site’s environmental footprint, and reducing construction time. The BGM cover system on the Old TSF is being monitored with the intent to use this as a case study to confirm expected performance, enabling the cover design to potentially be adopted on the remainder of the site’s mine waste storages that require capping.

Legacy tailings storage facilities exist within operating mine sites across Australia. These tailings storage facilities are often viewed as rehabilitation liabilities but with considered assessment may prove to be a resource. Extraction of such a resource might add value to operations by providing cash flow during the development of new mines; providing supplementary mill feed for existing mines undergoing step changes in operations; and supporting mine closure activities. Hellyer Gold Mines is successfully extracting and reprocessing sub-aqueous material from legacy tailings storage facilities at their Hellyer operation in north-west Tasmania. The Hellyer tailings storage facilities contain poly-metallic material from the Hellyer and Fossey underground deposits dating back to the 1980s as well as material from tailings reprocessing activities by other operators of the Hellyer site. Hellyer Gold Mines is reclaiming sub-aqueous material using cutter-suction dredgers and reprocessing on-site. Hellyer is the only operation of its type in Australia and few such operations exist worldwide. Key learnings around the estimation of a resource for legacy tailings storage facilities have been acquired at Hellyer that can be applied to the assessment of other tailings storage facilities. The application of dredging as a mining method at Hellyer is delivered through collaboration with experts from outside the mining industry under the direction of a mining engineer. Key elements required for the planning and delivery of safe and efficient dredging inside tailings storage facilities have been identified at Hellyer and are presented to provide a road map to the development of other dredging operations.

In recent years rehabilitation of mine sites has become a principal focus of mining legislation in Victoria. In previous eras, managed rehabilitation commenced, if at all, towards the end of mining operations. Planning for rehabilitation works now commences before an exploration licence is granted.The paper gives a brief overview of the requirements for rehabilitation under the Mineral Resources Development Act 1990, Extractive Industries Act 1966, and related environmental planning legislation including rehabilitation bonds and enforcement provisions.A brief review of the current taxation provisions is also included.

Most mining companies today perform site assessments and operational or compliance audits regularly. The purpose of these audits is to review company facilities and operations to determine whether they comply with applicable federal, state and local environmental laws and regulations. Why Audit? Companies adopt assessment and audit programs for legal and business reasons. The business reasons include: (1) ensuring efficient and cost-effective compliance through early problem identification and resolution; (2) planning and implementing business transactions such as real estate conveyances, loans, mergers and acquisitions, and waste disposal service contracts; and (3) employee training and relations. Legal reasons for audits include: (1) avoiding enforcement actions and penalties; (2) meeting environmental permit certification requirements; (3) avoiding corporate officer liability; and (4) meeting Security and Exchange Commission disclosure requirements. The Environmental Protection Agency ("EPA") encourages environmental auditing by regulated entities. The EPA Environmental Auditing Policy Statement was published in the Federal Register on July 9, 1986 (51 Fed Reg 25,004). Although the existence of an auditing program does not create a defense to or otherwise limit a company's regulatory responsibilities, EPA considers compliance programs in setting inspection and enforcement priorities. If a company makes an honest effort to identify and correct its own problems, EPA's enforcement approach is influenced, especially if violations are promptly reported. Perhaps more significant to many executives, the U.S. Department of Justice issued guidelines last year on when it will pursue criminal prosecution for environmental violations. See Department of Justice, "Factors and Decisions on Criminal Prosecutions for Environmental Violations in the Context of Significant Voluntary Compliance or Disclosure Efforts by the Violator," (July 1, 1991). It is now commonplace to read about major companies pleading guilty to criminal violations and paying millions of dollars in penalties. For example ALCOA recently agreed to pay criminal fines and civil penalties totaling $7.5 million for unauthorized excavation of PCB-contaminated soil and improper dumping of spent caustic solution. No executive wants to explain to the Board of Directors or shareholders why the company was criminally indicted. The Department of Justice considers factors such as voluntary disclosure, preventive measures and compliance programs, such as a regular compliance auditing program, the effectiveness of the disciplinary system for employees who violate the company's environmental policies, and subsequent compliance efforts by companies to remedy ongoing noncompliance. The Department of Justice looks closely at whether audit recommendations were implemented in a timely way and whether environmental compliance was a standard by which employees were judged. The Lawyer's Role. The role of the lawyer in an audit team deserves special attention. When enforcement action or litigation has begun or is contemplated or a government agency has asked for information, attorneys always should be directly involved in environmental audits. In most situations, however, environmental audits are management tools, and the attorney's role should be to advise the team. The attorney can help make sure the team understands the laws and regulations the facility must

A crucial step in the acquisition by one company of the assets of another, the acquisition of the stock of another company, or the merger of two com-ponies, is the legal due diligence which needs to be performed in order for the acquirer to ascertain or confirm the obligations, liabilities and exposures to risk that are being assumed along with the assets or corporate stock being acquired. Where the obligations, liabilities, or exposures to risk arise from existing contracts, or from pending lawsuits, administrative proceedings, or threats of these actions, those matters are relatively straightforward to discover by careful review of the files of the party whose assets or stock is being acquired. However, where a company is engaged in ongoing mining or processing operations and has operated or owned mining proper-. ties, there are many sources of liability and exposure to risk which could have major adverse economic consequences to the acquiring party and which are not revealed, or at least are not clearly delineated, by the records of the company whose stock or assets are being acquired.

I. INTRODUCTION Lawyers are a cautious breed; and it might be expected that a paper concerning a broad and complex area of legal regulation, prepared by lawyers for presentation to a predominantly non-legal audience, would commence with several caveats. Ours are the following: First, we have written a broad (and, in some instances, simplified) overview of the regulatory system and of some of the more important requirements generally applicable to uranium mine and mill wastes in the United States. Our paper is not a legal opinion setting forth all of the governmental requirements that would have to be met by any particular mine or mill. Similarly, we do not imply that the requirements we mention are necessarily applicable to each and every mine and mill in the country; depending on the facts, some of the requirements may be inapplicable or avoidable through exemption or variance proceedings. Compliance decisions and strategies for particular facilities must be considered on a site-specific basis. Second, we have undertaken merely to describe the regulatory framework and some of the generally "applicable" requirements which have been promulgated and proposed by administrative agencies. We express no opinion on whether, under the U.S. Constitution and statutes, the existing and proposed agency regulations are valid in general or as applied to any particular mining or milling operation. There are, of course, procedures for judicial review of agency action; and newly promulgated environmental regulations have frequently been challenged, with varying degrees of success, before the courts. For us even to begin to consider such issues would expand an already forbiddingly long paper to totally unmanageable proportions. Third, in light of the subject of this Conference we have limited our paper to the legal framework and requirements applicable to uranium mine and mill "wastes" -- primarily mine overburden and waste rock and mill tailings (including waste tailings solution). We treat operating discharges (e.g., emissions from yellowcake drying) only peripherally. Fourth and finally, it is important to note that this paper, at least in so far as it concerns the specific requirements of particular regulations, will likely soon be out of date in some important respects. Safety and health at work is about people. It is about people who plan for work, organise work and perform work. It is about those who come in contact with the workplace and those who are responsible for the workplace. There are wider ranging safety and health obligations that are imposed on the industry stakeholders that span all phases of the production process. In all cases, those responsible for discharging the obligations must ask the questions: Is what we propose safe?, can it be done safer? and are we sure? What we learn from recent legal cases before the courts is that it is essential that all stakeholders work together in a collaborative way when discharging these obligations. Safety and health at work cannot become an issue that is viewed only through the eyes of a single stakeholder group. The reason for this is quite simple. The interrelatedness of the responsibilities that are imposed on each of the stakeholder groups, means that the performance based legislation simply wont work, where an active model of communication and consultation is not in place.

"One of the major issues that the Rare Earth Elements Mining Industry has to deal with is the legislation vacuum that exists in many countries around the world. Among these, are countries which have long history and tradition in mining. In many cases the lack of direct legislation for REE mine management as well as for other potentially polluting industries can be a barrier to sustainable development. Moreover, the case of lax legislation in China has led to environmental pollution problems and extended smuggling of rare earth elements. This paper looks into the current regulatory status on the mining of REEs, identifies the loopholes and suggests some elements for a new global legislation framework for sustainable development in the REE mining industry. The setting of this regulatory framework will be in line with the present and future challenges of the rare earths market as well as with the policy strategies that are defined internationally. The aim of such a legislative framework will be to strengthen the global rare earth elements supply chain, appease social concerns and ensure the preservation and conservation of the environment. INTRODUCTION The general public received their first introduction to rare earth elements (REEs) in 2010, when the previously inconspicuous commodities became the subjects of front-page headlines. It was when China created a furore in global high-tech markets after imposing an embargo on Japan following a minor marine dispute (Barakos et al. 2015b). Soon enough the Chinese embargo was extended on REE export restrictions all over the world and thus aroused concerns to many countries over potential supply disruptions. The world had suddenly realized that these wonder materials underpin products that they care about. Governmental and industry executives, policymakers and material scientists voiced concerns and conducted numerous reports stating the situation and the risks of a supply crisis. The price spike of 2011 intensified the crisis and the public turmoil, yet the drama did not last for long as the prices declined significantly in 2012. Nevertheless, the world was nonplussed by the fact that China has the total control of the market with more or less the 90% of the global production. More potential entrants became interested, thus initiating an exploration boom during the recent years that has resulted in a significant increase in known global REE reserves that could have potentials for exploitation."

The mining industry has waited a long time for the resurgence in commodity prices and demand for its products that it is now experiencing. Base and precious metals prices have reached levels not seen before. Coal prices have also shot up. And there are encouraging signs in the uranium market. China’s nearly out-of-control economic growth is said to be the leading driver for much of this resurgence. But demand for energy, metals and building materials in the United States and elsewhere are also major factors. The result is that expansions and new mines for nearly every commodity are in the works.

Addressing nutrient deficiency, among other factors, is vital to the growth and establishment of plants in mine spoils and tailings ponds. Although several organic amendments are available for this purpose, it is important to determine the appropriate ameliorant for the selected plant species. This research examined the effect of different amendments on the growth and ground cover of Centrosema molle, Calopogonium mucunoides and Sorghum spp. in copper/gold tailings. Plant growth and ground cover drastically increased with the application of organic ameliorants, especially manure. Among the three plants, Calopogonium exhibited the best growth and has shown its capability to establish a dense ground cover even in unamended tailings. Results suggest that the plant species and the ameliorants used in this study could be effective in a low-input approach to mine rehabilitation.CITATION:Domingo, J P T and David, C P C, 2014. "Les mineralisation d'or des gîtes de la SOQUEM - Silver Stack dans is canton Bousquet se situent dans une bands de roches pyroclastiques asides du groupe de Blake River, d'âge archéen, dans le même horizon géologique que lee gites aurifères de Thompson Bousquet et Dumagarni situés plus a rest. La propriété a été explores anterieurement a maintes reprises depuis les années 1930, parfois jusqu'aux travaux souterrains, notamment par les groupes Mooshla, Warrenmac et Westwood Cadillac ainsi que par Silver Stack Mines.Ces zones auriferes se situent a l'intérieur de larges halos (jusqu'à 1,000 m x 400 in) de pyrite disséminée (2-5%) dans des tufs a lapilli et des agglomerate acides montrant des concentrations locales de pyrite. La zone 1, découverte en vérifiant par sondage une anomalie E.M., coincide avec une de ces concentrations de pyrite et la teneur en or est ici proportionnelle a la pyrite. Ce secteur se distingue par l'intensité de l'altération en séricite. La zone 2, qui s'étend sur près de 600 m, se situe dans un agglomérat acids, avec une faible teneur en pyrite, et montre de fines veinules de quartz-carbonate.Du point de vue géophysique, aucune methods ne donne des résultats probants: la polarisation provoquée montre de tree grandee anomalies correspondant aux halos de pyrite, tandis que lee concentrations de pyrite détectées par les méthodes E.M. (VLF ou EMH) sont loin d'être toutes aurifères. Les relevés magnétiques aident a établir la structure la où un certain contraste de susceptibilité magnétique est present. Les essais minéralurgiques préliminaires indiquent que la concentration de Bette mineralisation aurifère ne présentera pas de problems majeur."

"Un trait marquant du cadre tectorwstratigraphique de la Sous-province de l'Abitibi est la présence de nombreux couloirs de déformation d’extension régionale et sub-concordants au grain stratigraphique. La présence de grandes masses granitoïdes qui perturbent l'allure du grain tectonique est typique de la partie nord de la Sous-province de l'Abitibi. Des rides E-W constituées de complexes plutoniques précoces forment des reliefs structuraux agissant comme des moles résistants qui interfèrent avec la déformation régionale.Deux types de couloirs de déformation sont distingués, les couloirs de bordure et les discontinuités structurales. Les couloirs de bordure représentent des auréoles de déformation élevée qui s’accompagnent généralement d’un métamorphisme au faciès amphibolite. lls suivent /'interface entre les roches granitoïdes et les assemblages supracrustaux. Ces couloirs sont de puissance kilométrique et sont confines, surtout au sein des roches vertes, a l’interface des complexes granitoïdes d’importance. La limite entre la Sous-province de l'Opatica et les roches supra crustales de l'Abitibi est caractérisée par un important couloir de bordure issu possiblement d'un chargement tectonique irrégulier et concentre lors du raccourcissement horizontal.Les discontinuités structurales sont des failles ductiles qui se propagent surtout en direction E-W mais avec des variantes de directions SE et NE. Les discontinuités E-W se caractérisent par la présence d'une linéation d'étirement à fort angle de chute. Les discontinuités SE sont caractérisées par des linéations d'étirement horizontales et directionnelles et les mouvements observes sont system attiquement dextres. Les discontinuités NE sont des failles à comportement beaucoup plus fragile et se distinguent par des composantes de mouvement senestre. Elles sont tar dives par rapport aux discontinuités E-W et SE et ne représentent pas la symétrique du système SE.La combinaison des systèmes E-W et SE décrit un motif anastomose a l' échelle régionale. Les failles ductiles se rejoignent defaçon asymptotique, isolant des blocs peu ou pas affectes par la déformation. L'anastomose est un phénomène qui se produit a toute échelle et est reliée principalement aux Mt érogénéités et aux anisotropies 1) des forces agissantes (champs de contraintes régionale et locale) et 2) de la réponse del' empilement supra crustal (compositions différentes, fabrique initiate, propriétés mécaniques variées, niveaux d'altération).Dans le but de respecter un raccourcissement horizontal N-S, différents modelés sont proposés; ils mettent en cause soit une transpression dextre, soit des failles inverses réactivées en failles décrochèrent dextres soit des failles de chevauchement redressées."
