A methodology of environmental performance evaluation in mining developments is proposed, as well as guidelines and procedures for obtaining information to improve their environmental performance. Environmental performance is the results of the mining activities and their relation to environmental issues. If this evaluation is carried out on an on-going basis, it is possible to anticipate or to identify the formation and development of an environmental impact in its early stages. Evidence or trends identified by environmental evaluation provide valuable information to prevent further damage. The proposed methodology is based on the significant environmental aspects of a selected monitored job site by environmental indicators which are then compared with previously defined environmental criteria and targets or goals. The methodology procedures also take into account the environmental accounting of the investments and expenditures.

The mining industry in Western Australia is a large sector of the WA economy providing $12 billion (1993) of the export income for the State. Historically, mining in WA developed from traditional prospecting in the late-1880s leading to major underground operations by the turn of the century. Large open pits were developed in WA following World War II and became increasingly common since the gold boom of the 1980s. With the development of the open pits has been concomitant evolution of mining legislation, principally the Mining Acts of 1904 and 1978, which has been also accompanied by a practical evolution of the administrative system within the Department of Minerals and Energy. The mining industry has recognised the need for sound environmental management at mine sites, taking up the challenge and becoming a world leader in rehabilitation techniques. Any environmental management program in the industry has three stages: approval by government; management by the industry; and return to the State in an environmentally acceptable condition. The WA environmental requirements, procedures and industry performance in these three stages are discussed.

Mining project development, permitting, environmental regulatory and compliance issues in Uzbekistan and the CIS are every bit as complex as those in the western world. The vast array of environmental permitting, monitoring and reporting regulations for mine project development and operation in the CIS are based on existing Soviet environmental regulations and policies which have remained in place after these countries gained independence from the former Soviet Union. The approach to mine project permitting in the CIS differs from the western world. Similar pre- feasibility, baseline data collection, and environmental monitoring requirements allow the project proponent to coordinate preparation and submission of documentation to support project permitting for Uzbek regulatory requirements with environmental requirements imposed by financial institutions and western environmental compliance structures. Implementation of generally accepted western environmental best management controls and monitoring into mine design, construction, and operation will not, however, ensure automatic compliance with Uzbek environmental regulations. Uzbek environmental compliance requirements that differ from western requirements include: 1) development and maintenance of an environmental database constructed specifically to address annual, biannual and quarterly statistical reporting requirements for emissions of "environmental pollutants" from the facility into air, surface water, ground water and soil; 2) preparation and submittal of specific permits for water utilization, hazardous waste storage and disposal, landfill construction and operation, and stack emissions inventories; and 3) procurement of approvals from the Uzbekistan State Committee for Nature Protection (generally analogous to the US Environmental Protection Agency). This paper outlines and summarizes the regulatory requirements for mine site permitting and the procedures for environmental monitoring and reporting during mining operation in Uzbekistan and the CIS.

This paper presents methods and results of environmental planning conducted for a proposed coal and iron ore transshipment terminal which would be located on reclaimed land west of Lisbon, Portugal. Oceanographic, navigational, marine, structural, material handling, and financial studies of the terminal were conducted along with the environmental analyses. However, because of the proximity of the terminal to heavily used recreational resources, residential areas, and biologically valuable habitat, anticipating and reducing the environmental effects of the terminal to minimum levels was a very important part of the overall project. The results of the study indicate that even the impacts associated with worst-case conditions would be acceptable because of appropriate pollution control measures and planning.

In July 1986, Cable Sands (W.A.) Pty Ltd commenced mining for mineral sands at Minninup, approximately 16 km south of Bunbury, Western Australia.The area being mined is from the heel of the foredune to the rear of the hind-dune. The vegetation is mostly native vegetation with some old degraded pasture.The mining operation will be by suction cutter dredge, with continuous dredging, mineral separation and re-depositing of the sand.

At the 25th Annual B.C. Mine Reclamation Symposium in September 2001, Huckleberry Mines Limited received the Jake MacDonald Reclamation Award for its exemplary mine waste management plan, conceived to prevent the onset of acid mine drainage and facilitate reclamation of the site. The mine is an excellent example of a total mine waste management plan, with all materials scheduled in detail for the life of the mine. The filling plan for the waste management facility takes into consideration the requirement for permanently flooding the potentially acid generating rock. From an acid generation point of view, the tailings fall in the zone of potentially acid generating material. To avoid long-term ARD concerns, it is planned to float pyrite out of the tailings towards the end of the mine life, thereby generating a non-acid generating tailings stream which will be used to cap the deposited mine waste. The pyrite-rich tailings will be discharged into the deeper portion of the impoundment. On closure, a permanent water cover will be maintained over the mine waste. Only beaches of non-acid generating tailings will remain exposed. Mining will be phased to also allow one of the pits to provide storage for potentially acid generating rock and to be flooded at the end of mine life.

Typically, environmental work on mine sites in Northern Australia involves addressing an individual problem as it arises. However, individual mining companies are moving toward a more holistic approach to managing the interactions between the environment and the mining process and are thus pre-empting environmental problems. This paper presents a broad overview of this holistic approach and provides a few examples, drawn from our own experience, which illustrate some of the tangible benefits to be gained from Environmental Planning.

These encompass all adverse effects of oil shale mining, processing, and ancillary developments on the environment. Specific problems concern: land, vegetation, wildlife, water, air, population growth, aesthetics and public emotion; and fall into four categories of: land, water, air and emotion. Land includes excavations, spent shale disposal, loss of vegetation and impact on wildlife and domestic grazing, plant sites, buildings and roads, necessary urbanization and the total aesthetic or visual Impact. Water considerations are: requirements for Industrial and domestic supplies, adverse effect of underground water on mining, avoidance of pollution or adverse effect on surface or near-surface water, and the utilization or safe disposal of liquids. Air problems include dust, smoke and stack gas, Public emotional problems include reaction to the above problems, and misconceptions of oil shale country and an oil shale Industry. Government and industry are aware of the problems, and are seeking solutions. Last year, the three affected states studied oil shale environmental problems and solution costs. Colorado estimated environmental costs would add approximately 7% to construction and 7% to operation. The report suggested research in: (1) Water availability and impact; (2) Disturbed lands revegetation and rehabilitation, including spent shale; (3) Environmental inventory and impact; and (4) Regional development and land use planning. Governor Love appointed a 47-person committee representing Industry, government and environmentalists to attack the problems. Research pro-posals were prepared to focus on each problem. $715,000 state, federal and industry money is being committed. Results should provide data for industrial solutions and equitable agency administration.

The abandoned Belle Eldridge Mine near Deadwood, South Dakota, is on land controlled by the U.S. Bureau of Land Management (BLM). The mine produced lead and zinc during the first half of the 1900s. Because of acidic drainage and elevated levels of metals in tailings and waste rock, the site was evaluated in 1998 and 1999. After evaluation, the mine was remediated during 1999-2001 by the BLM. Since remediation, values of pH in water samples have been nearly neutral and specific conductance values have been much lower than before remediation. The Grizzly Gulch forest fire of July, 2002, consumed much of the Belle Eldridge site and resulted in greater than normal erosion and sediment flushing during the months following the wildfire. Had the site not been remediated and the tailings emplaced within a capped repository, generation of acidity and off-site migration of heavy metals within sediments could have been severe at downstream locations.

Coal mining reclamation is a worldwide concern. This paper presents a Brazilian example where the economic aspects of reclamation are considered. The basic goal of the study is to transform the reclamation procedures into an economic process by integrating the use of land after reclamation and developing profitable post operations. Some of the activities considered in this case study include: using of the coal pit as a landfill, considering appropriate landfill design and construction; using the area for forest development; and developing grassland, forests of native species and the construction of ponds for fishery. This study will conclude that the mined area is: capable of storing large quantities of waste at a competitive cost and at a low environmental risk; commercial forest development is economically feasible; and the lakes and other reclaimed areas can be integrated into the landscape creating a fresh water supply and an area to raise cattle.

INTRODUCTION The Scope of the Chapter This chapter discusses environmental regulation and closely-related public policies associated with mineral development in the United States. This chapter outlines the nature, extent, and amelioration of secondary effects of mineral development. It sketches the policy foundations of regulation; discusses the implementation of environmental law; describes land use conflicts and land management regimes; and surveys the costs and benefits of environmental regulation. Since regulations are subject to frequent change, the chapter emphasizes basic factual and conceptual material, rather than specific regulations. The goal is to familiarize the reader with the general nature of environmental impacts and mitigation which arise in the minerals industry, and with the issues surrounding the regulation debate. The chapter is organized as a series of sub- chapters. The first of these is a discussion of the conceptual foundations of regulatory policy. The second section summarizes the principal federal environmental statutes, and the implementation of such regulation. Following that, the third section summarizes the current state of knowledge regarding the types of environmental impacts associated with mineral development. This discussion, organized in a format similar to that used in environmental impact statements, can be thought of as a guide to reading and understanding such statements. Next, the fourth section surveys studies of the costs and benefits of environmental regulation. 'These empirical studies are evaluated in terms of the framework developed in the first section of the chapter. In the fifth section, the discussion turns to federal, state, and local approaches to land use control and siting, and the economic analysis of such conflicts. Environmental and related regulation occurs because the public believes the free market does not properly value environ- mental quality. In this section, concepts are advanced to aid the reader in understanding the government's role in this respect.

To operate a mine in California requires compliance with State environmental regulations, including assessment of risks and associated financial assurances for postulated worst case catastrophic event scenarios. Carson Hill Gold Mine, an open pit, heap leach operation, completed new risk assessment catastrophic event analyses in 1988. The risk assessment was performed at the same time that a new leach site (Leach Site 3) was being designed. Leach Site 3 is located about 400 m upslope of New Melones Reservoir, which is a public recreation facility and a source of drinking water. Release of leachate (pregnant solution) or ore containing cyanide and metals from Leach Site 3 into New Melones Reservoir was considered to pose the largest risk of environmental damage.Flow failure of the ore heap, potentially induced as a result of liquefaction of the saturated portion of the ore, and/or overtopping of the leach site containment embankment due to excessive precipitation were found to be the most plausible leachate release scenarios. Yearly combined probabilities of various downstream release volumes were estimated. The release volume corresponding to a yearly probability of 0.05 percent was then used to estimate potential environmental impacts and mitigation costs. The costs include earthwork to restore the geometry of the ore heap and repair the fill slope below the Leach Site 3 containment, and impacts on New Melones Reservoir.

The rapid industrialisation in China has consumed large amounts of various industrial raw materials, which has left behind large quantities of industrial solid wastes produced from the processes of mining, mineral processing and smelting. The storage of huge quantities of industrial solid wastes is an obvious risk to the environment and human well-being. As the first step to fully appreciate the scale of this risk, it is necessary to carry out research for developing a pollution source environmental risk assessment system (PSERAS), especially for the typical staple industrial solid waste (TSISW). This paper aims to discuss the frame of the PSERAS for TSISW for large scale production. This system consists of two aspects: predicted factors and accidental ones, which involve physical, chemical and biological risk assessments, on-site and during transportation process. Two analysis methods, the analytic hierarchy process (AHP) and fuzzy logic assessment (FLA) were used to handle the complexity of environment and non-quantitative data. The risk assessment system for such a complex objective is difficult and the assessment of relative factors is problematic through the usual quantitative analysis. With the proposed PSERAS, it is possible to define the risk class of pollution sources. Furthermore, the risk assessment results will be helpful to the decision-maker, especially when facing unknown risks in the environmental management of industrial solid wastes. Toxic substances in On solutions can retard biological leaching of copper sulfide dump ores. On solutions were analyzed for metals, organics, and chloride, and showed inhibitory concentrations of aluminum, manganese, and chloride. Inhibition of bacterial activity by the solid fraction of On solution, with and without the organic constituents, was evaluated. Toxicity to bacterial species was evaluated by monitoring bacterial numbers, pH, Eh, and rates of iron oxidation. The On solution solids were toxic at 50 -60% of their field concentration. Most of the toxicity of the On solution was due to the organic fraction. Different SX reagents show varying degrees of inhibition of T. ferrooxidans. Bacterial inhibitory effects of carriers and lixiviants used in the SX plant should be determined so that entrained SX reagents do not retard biological dump leach systems. The reagents used should be the most cost effective and the least toxic.

Significant amounts of arsenic are often present in effluents arising from the mining of sulfide ores for the extraction of metals such as copper, gold, lead and zinc. The arsenic is usually removed from the process effluent by co-precipitation with iron because of its common occurence in the mined ore bodies and the excellent adsorptive property of the precipitated hydrous ferric oxide compound. There has been controversy, however, over the long-term stability of the arsenic-bearing ferrihydrite which is produced. This paper presents the results of laboratory studies which indicate that the cations of calcium, magnesium, zinc, cadmium and lead, increase the pH range of effective arsenic adsorption in the Fe-As precipitate from 4-7 to 4-9. The increase in the pH range is similar for all of the added cations investigated. Sulphate ions are shown to have a minimal effect on the residual dissolved arsenate concentration. Silicate ions reduce the adsorptive capacity of ferrihydrite if they are present before the arsenic is adsorbed.

Compacted, fine-grained soils, often referred to collectively as clays, are used as permeability barriers in many mineral engineering projects such as heap leaching, containment ponds, tailings disposal and earth dams. Source materials for these liners include a variety of sand, silt and clay admixtures. These exhibit dramatically different engineering properties when densified. Therefore, it is imperative to adequately assess and characterize any soils being considered for compacted liners. The permeability and plastic properties of fine-grained soils are reviewed with respect to the state of compaction as the water content varies. Because they are weak in tension, compacted clays are susceptible to cracking when subjected to differential flexural movements. Designs of compacted clay liners also must include an evaluation of their flexibility. That is the ability of a fine-grain soil to bend plastically without cracking. This paper will also discuss the importance of flexibility with respect to soil types, compaction effort, failure mechanism and testing evaluation to the performance of clay liners in preventing seepage of pollutants from a containment site.

The sorptive and impervious nature of clay materials was recognized long before modem technology allowed us to understand the physiochemistry of clays. In Cyprus, around 5000 BC, sorbent clays were used for fulling woolen cloth. One of the earliest recorded uses of clays as an impervious liner was more than 3200 years ago in the construction of a bitumen-sand-gravel-clay liner built along the embankment of the Tigris River at Assur. Today one of the most common applications for clay minerals in the environmental industry is for use as impermeable barriers to fluid transport. Clay minerals are fine in particle size and thus have large surface areas, which, as a result of intermolecular forces and ionic substitutions, make them excellent materials for both ion exchange and ion sorption. Therefore it was logical to consider certain clay materials for applications in the environmental industry, where they can act as physical and chemical traps for potential contaminants. Certain bentonites have historically been used as sealants for fluids (Grim, 1962), and other clays have been used as sorbents for both water and oil (Haden, Jr., 1972). Prior to the 1980s, disposal of the nation's municipal, commercial, chemical, and nuclear wastes was largely indiscriminate and poorly regulated. This created environmental pollution problems, especially with respect to groundwater contamination. Promulgation of federal regulations like the Resource Conservation and Recovery Act (RCRA) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA - commonly known as Superfund) have forced a more careful and costly approach to waste disposal. The US Environmental Protection Agency (EPA) is the government body charged with enforcing and ensuring compliance with federal regulations governing toxic waste production, storage, and disposal. Widespread application of geotechnology to the design and construction of waste containment systems and to pollution remediation has become necessary due to such laws and because of increasing use of the subsurface environment for the disposal of hazardous wastes. In the United States nearly 1.8 kg of trash is disposed of per person per day, which amounts to nearly 181 Mt per year. This amount is more than double the waste produced in 1960, and these numbers are expected to continue to increase. Canada produces approximately 1.68 kg of waste per person per day. The EPA estimates that in the United States 64% of our garbage is landfilled, 18% recycled, and 18% incinerated. Even with continued increases in recycling and incineration efforts, the EPA projects that the United States will still need 82% of today's landfill capacity in the year 2000. Data on the exact number of landfills in the United States and Canada is conflicting in part because of changing definitions of what constitutes a landfill and because of inadequate record- keeping by some states and provinces. An estimate of the number of municipal solid waste (MSW) landfills in the United States in 1990 to 1991 ranged from 4 462 to 10 467 with an average estimate of 6 600. In Canada the number of MSW landfills reported varied from 5 493 in a 1982 survey to 1 766 reported in a 1991 National Solid Wastes Management Association (NSWMA) survey (Repa and Sheets, 1992b). A properly operated MSW landfill on average requires 1 hectare of land per year per 25 000 people (Coates, 198 1). In addition to MSW facilities, there are also waste disposal facilities needed for hazardous waste and low level and high level radioactive waste. In 1983, approximately 266 Mt of hazardous waste was generated in the United States, almost 50% of this by industrial production. About 68% of the hazardous waste generated in the United States and Canada and almost 50% generated in Europe are still landfilled (Egger, 1987). In 1985, approximately 51 000 m3 of commercially produced low level radioactive waste was disposed of in radioactive waste disposal sites across the United States (Jungling and Greeves, 1989). By 1987, the US defense program had produced approximately 10 000 t of high level nuclear waste. In addition, there were approximately 14 000 t of spent fuel assemblies from commercial nuclear power plants in temporary storage; the amount is expected to nearly triple by the year 2000. Presently most commercial spent fuel assemblies are stored in water-filled pools at nuclear power plants. Defense waste is stored on federal reservations in surface and underground steel tanks (Anon., 1987). Under federal law nearly all waste disposal and containment sites are required to have a liner or barrier and a cover system design that meets federal- or state-approved hydraulic conductivity requirements for the type of waste that the site will receive. When approved materials, necessary for constructing the waste containment structure, are not available on site, one of the most economical ways to meet these requirements is through the use of clay, soil/clay, or clay/geotextile materials. In a 1991 survey by NSWMA of its members and other select private sector facilities, 81% of the surveyed landfills had some type of liner system. About 75% of these liners were clay materials (either recompacted or natural). The remaining 30% were using flexible membrane liners as part of a liner system. Clay liner materials are most commonly used in the South, Midwest, West-central, and South-central regions of the United States. About 93% of the landfill facilities had closure plans, and of these 91 % were using clay materials in some way for the final cover material (Repa and Sheets, 1992a). Waste barriers and containment structures take several basic forms, and they are used in a variety of different applications: 1) cutoff walls, 2) soil or soil/clay-admix liners, 3) geosynthetic bentonite-clay/geotextile membranes, 4) radioactive waste containment barriers, and 5) synthetic geomembranes. Environmental, social and governance issues (ESG) have become a defining feature in the marketplace to differentiate preferred investments. With the sustainability commitment and reporting landscape anticipated to evolve exponentially, it is now imperative to rapidly develop the approach taken by mineral companies to adequately identify and address ESG risks and opportunities in the reporting of Mineral Resource and Mineral Reserve (MRMR). MRMR cannot be effectively reported as technically and financially assured and realistically executable, if ESG is not integrated into the strategy, business model, input assumptions and process that defines and drives robust MRMR public reporting. Regulatory reporting codes across the globe are presently in various stages of being updated and modified to ensure ESG factors are appropriately covered as a key part of diligent and transparent disclosure. Security exchanges are making it clear that companies must not omit ESG risks from reports to investors. This paper discusses associated challenges for MRMR reporting and suggests avenues for improvement. Key themes include: the importance of procedure rather than prescription and checklists; how ESG criteria impact Modifying Factors and determination of Reasonable Prospects for Economic Extraction (RPEE); the need for financial models to account for material ESG commitments; the uniqueness of each mineral asset; the need for education, upskilling and accreditation of both ESG experts about MRMR reporting and equally Competent Persons in ESG matters; and the need for clear and balanced reports that meet the needs of end users. (RPEE is adopted here for simplicity and consistency, recognising that some reporting codes still include ‘Eventual’ in the term (ie RPEEE). Whilst RPEE and RPEEE are subtly different the intent is to point to the process of assessing ESG factors in determining reasonable prospects.) The principles of transparency, materiality and competence remain paramount when considering the impact of ESG matters on MRMR reporting, and this necessitates an inclusive, cohesive, and integrated approach to assessing ESG issues to ensure the necessary expertise and diligence is applied.
