Arbitration is a legally recognized alternate litigation for the resolution of civil disputes. The parties agree, either before or after a dispute arises, to submit that dispute to an independent third party for resolution. The decision of that third party is binding on the parties. A decision of an arbitral tribunal, typically referred to as an "award," cannot be reviewed by a court except on very limited grounds, such as fraud. See, e.g., Va. Code 8.01-581.010. Indeed, an arbitral award is typically less subject to judicial review than the decision of a trial court, whose decisions are almost always subject to appellate review as a matter of right. Arbitration is typically the result of a contractual agreement between the parties to submit disputes to arbitration. On occasion, arbitration can be required by statute. For example, the California Department of Transportation requires the arbitration of all disputes arising under its contracts. Public Contract Code, Article 7.1 (§§10240-10240.13). There may be a question whether statutorily required arbitration is truly arbitration or an administrative law disputes resolution procedure. The significance of the difference is that the decisions of administrative law bodies are typically reviewable by a court of law as a matter of right while, as set forth above, arbitral awards are almost never reviewable.

"An EXTENDED ABSTRACT is available for download. A full-length paper was not prepared for this presentation. The Kainantu Project is located within the New Guinea Thrust Belt in northern Papua New Guinea. The area has a long history of exploration and production, with the discovery of alluvial gold in 1928 followed by the discovery of vein deposits of gold and copper at Kora in the 1950s and the current Irumafimpa vein gold mine. Current resources on the Kora-Irumafimpa Vein System (KIVS) stand at 1.5 Moz Au, 5 Moz Ag and 217 Mlb Cu.Mineralisation in the region includes gold, silver and copper associated with mid-Miocene age mafic to felsic intrusions. The KIVS occupies a broad north-west-trending mineralised zone more than 2.5 km long and 200 m wide, with the Kora, Eutompi and Irumafimpa veins on the western side and the Judd and Upper Kora veins on the eastern side. Economic mineralisation occurs in two closely related events occupying the same strongly structurally controlled shearing (quartz-Au-telluride veins and sulfide Au-Cu-Ag veins with free Au) and is best described as a significant intrusion-related event with both epithermal and mesothermal facets that does not appear directly related to known porphyry Cu-Au systems as seen at the surface. Significant wolframite is associated with vein quartz of a slightly older age but also occupies the same shear system.The KIVS occurs within a larger mineralised area of approximately 5 × 5 km. It has complex multiphase intrusions, breccias and diatremes that are only partly delineated by drilling and comprises multiple occurrences of Au-bearing veins and porphyry Cu-Au mineralisation. The area is considered to have high potential for extending the current resources and is being actively explored. The proposed recommencement of mining activities recognises the complexity of the KIVS and later disruptive faulting and will require tighter grade control systems, targeted mining techniques and a gravity circuit to maximise free Au recovery.CITATION:Vigar, A J, Lueck, B, Taylor, I, Prendergast, K and Dale, P, 2015. The individual or company director who ignores his or her obligations under the Resource Management Act 1991 and under the proposed hazardous substances legislation, ignores them at their peril. Two recent cases in Canada and the United Kingdom concerning environmental offences under similar legislation illustrate the risks well.

"This repot continues the series of papers being prepared at the Southwest Experiment Station of the Bureau of Mines in cooperation with the department of mining and metallurgy, University of Arizona, on factors involved in the leaching of ores. A list of previous publications is given in the bibliography at the end of this paper.Four factors are essential to the leaching of any copper-bearing ore: (1) A solution that will attack the copper minerals must get into the body of the ore particles; (2) the copper minerals must be dissolved by the solution; (3) the solution containing the dissolved copper must find its way out of the voids of the rocks into the main solution; and (4) the copper in solution must be recovered by some means of precipitation.This paper considers the third step -- the extraction of the water-soluble copper. From leached ores. The usual commercial practice in leaching copper ores consists of: (1) Crushing the ore to pass through a screen with approximately one-quarter or one-third inch openings; (2) charging the crushed ore into a fat; (3) adding, usually by upward percolation, a solution that will attack the copper minerals; and (4) washing the copper-laden solutions out of the ore with solutions weaker in copper than the pregnant solution, and finally with water. A countercurrent system of leaching and washing is usually employed. In some plants the solutions are circulated during leaching and washing, and in others they are not. In some plants the wash solutions are added by upward percolation, while at Chuquicamata the so-called ""piston-displacement"" method of washing is employed.The following condensed resume of the leaching cycle of the plant of the Inspiration Consolidated Copper Co. is given to present to the reader a picture of the steps involved in a typical leaching cycle. This plant was recently described in detail.4 The ore, crushed to pass openings 11/2 inches in diameter, passes over a screen with ¼-inch openings. The undersize from the screen goes to a Dorr howl classifier that removes the primary slime from the circuit. The overflow from the classifier is treated in a slime-leaching plant. The oversize of the ¼-inch screen passes through rolls, where it is crushed to pass a 3/8-inchscreen. The undersize from the 3/8-inch screen join with the coarse material from the classifier, and the combined products become the feed to the leaching vats. There are 13 concrete lead-lined leaching vats. The complete leaching cycle is 13 days. Eight tanks are under acid-iron content at all times; three are being washed, one tank is being filled, and the one is being excavated. The electrolyzed solution from the tank house, to which amount of new acid has been added, is put on the oldest tank of ore under need This solution travels from tank to tank and finally emerges from the newest ore"

Deformation of underground salt, trona and potash mines is generally time dependent, providing for gradual adjustment of strata to mining induced stresses. Time dependence can allow for higher extraction ratios provided eventual failure can be tolerated. However, this eventual failure can be violent if creep deformation can shift stress and potential energy to strong, brittle geologic units. The mine failure case studies reviewed here illustrate this process. Yield pillars and defects in bridging strata figure prominently in these cases. Yield pillars provide local and temporary support to the roof, temporarily delaying the cave; and allowing extraction ratios and overburden spans to increase beyond the long term capacity of overlying strata. Defects (faults, voids, thinning) of strong overburden strata reduce the critical span, sometimes to less than panel width. Analyses of many of these cases have focused on a cascading pillar failure mechanism, but recent work and this review point to failure of strong overburden strata as the essential element. The suddenness of failure and attendant seismic events pose hazards to miners and, in some cases, to those on the surface. Characterizing these failures is a first step towards recognizing and managing the risk of catastrophic collapse in underground mines.

It is often necessary to undertake some form of pile testing to verify design calculations. Historically this has been limited to static and dynamic tests. Newer rapid testing methods such as Statnamic are seeing more frequent use. This form of testing can be advantageous due to short set up time and test duration. Although the methodology suffers from a lack of formalised guidance and may prove difficult to analyse in certain soil conditions. This paper investigates the suitability of Statnamic testing and analysis for a range of soil and pile types as well as different installation methods through a number of case studies undertaken in the UK. Recommendations are made on test specification and analysis.

The Kingsgate molybdenite pipes are considered on petrochemical data and field occurrence to be, possibly, epi-magmatic plutonic offshoots grading into hydrothermal bodies. There is reason to believe that the ore is derived from a highly acid granite of type similar to that of the tin bearing areas of northern New England. The mineralogy, microtextures and paragenesis of the ore are discussed.INTRODUCTIONThe Kingsgate Mining Field is situated in steep, heavily timbered terrain 18 miles E.N.E. of Glen Innes and 430 miles north of Sydney. Bismuth and molybdenum ores were discovered at Kingsgate (Yarrow Creek) in 1877. Subsequently some 50 pipes were developed yielding tonnages which at the peak of operations, 1905 to 1920, rivalled production from the rich deposits of northern Queensland.Attempts to revive the field have been made periodically and small parcels of ore have been forthcoming.' During World War II demand for piezioelectric quartz again focussed attention on Kingsgate but twinning and other imperfections of the quartz prevented all but a minor exploitation of the otherwise noteworthy crystals of this locality.There is reason to believe that the ore at Kingsgate is not exhausted through exploration and mining costs would probably be high due to the capricious nature of the pipes and to the irregular distribution of rich ore shoots within them.

The mining industry has come to rely on imaging devices to monitor and record all kinds of activities. We use them to measure, improve the process, ensure security, increase production and automate machinery. Cameras can be installed in locations most people wouldn?t want to live and be our ?eyes? to record the events at that location. This paper discusses digital imaging, the equipment, methods, techniques and information that can be learned from digital devices used in mining operations. The guy who said ?a picture is worth a thousand words? probably understated it. Images are the perfect way to document conditions before, after and even during mining activities. Today?s wide choice of cameras, camcorders and other digital devices allow us to record most activities and events. The technology is advancing at a high rate. Digital cameras and camcorders are marvels of technology with high resolution optics, compact size, automatic time and date stamp, great battery life, shutters to freeze motion and computers to auto focus and eliminate jitter (image stabilization). Add to this the economical price and ease of use and everyone in this industry should be aware of the possibilities.

Over the past several decades, the use of cement-based grouts using ultra fine cement as a replacement for portland cement has begun to gain acceptance as an alternative to chemical solution grouts used in permeation grouting. The amount of information currently available on grouts made with ultrafine cement is limited. The authors used a previously developed field testing program to perform additional tests to evaluate the permeation performance of portland and ultrafine cement-based grouts. For the first time, the 2003 testing program included an attempt to determine the 28 day compressive strength of the sand permeated by the grout.

Ever since opening, the M25 motorway to the west of London has carried a rapidly increasing volume of traffic. The section of M25 between the junctions with the M3 and M4 motorways, which is in the near vicinity of Heathrow airport, is the most heavily trafficked section. Piling and ground treatment was required for motorway widening works over this route, which is 7 miles long. The foundation works were undertaken next to the live motorway and beneath the flightpath for aircraft landing and taking off at the airport. The paper describes the foundation construction techniques used, and the how the methods were affected by the live motorway and the height restrictions imposed by the airport. A unique method of piled retaining wall construction is also described.

Today, with a stringent economic and environmental climate prevailing in the copper business, there is increased interest in evaluating new processing alternatives for production. Hydrometallurgical pressure oxidation of copper concentrates is one of the more viable approaches and several technological candidates have emerged. Of these, an overlooked but, ironically the first industrially proven methodology, utilized nitrogen species catalyzation in the oxidizing pressure leach system to produce copper via SX/EW. Given its many inherent process advantages, this may prove to be a feasible process alternative for the future. In this paper, the history of the system and its application to copper concentrates and ores will be outlined. In particular, a novel methodology for effective recovery of precious metals from chalcopyrite concentrates will be discussed. Finally, the perceived economics of chalcopyrite concentrate treatment with this unique industrially proven process will be delineated.

Around the world, mining has been done for thousands of years for the benefit of humankind. The winning process in mining operations ends with the depletion of the deposit or its closure if the operation becomes economically unprofitable. After that, a period of post-mining follows which may last for a very long time and which is generally regarded as a period of hazards, risk and high cost. In the USA alone, approximately 500,000 abandoned mines do exist; worldwide, there are millions. In Germany, too, we have had to deal with abandoned mines for a considerable period of time now.

The $58,000,000.00 Columbia Heights Metro Station project (Section E3-a) forms a part of the Washington Metropolitan Area Transit Authority's (WMATA) Greenbelt Route - Green Line subway system. The Greenbelt route is one often segments that make up WMATA's subway system. Construction of the "cut and cover" reinforced concrete station includes 600 linear feet of an underground center platform, two ancillary service areas totaling 466 linear feet, two surface entrances, and vent shafts (See Figure No. 1). Station subgrade is approximately 60 feet below existing grade. The project can be divided into five main areas: 1. North Service Rooms and Passageway; 2. West Entrance and West Passageway; 3. East Entrance; 4. Center Platform; 5. South Service Rooms. Station dimensions are approximately 1068 feet long by 64 feet wide. Construction commenced at the site in January of 1995 and is expected to be completed by December of 1999. Franki Northwest Company, Crofton, Maryland, was awarded a subcontract by general contractor Blake Construction Company, Washington, D.C, to install the support of excavation and temporary decking systems. Franki's scope of work included the installation of 490 drilled soldier piles plus two elevator shafts totaling 29,700 linear feet of drilling; 1,150 tons of steel decking covered by 37,000. square feet of precast concrete deck planks; 120,000. square feet of timber lagging; 2,500. tons of struts and wales; and temporary support of underground utilities. In conjunction with Franki's work, Bencor Corporation of America, Dallas, Texas, constructed parallel, 600 foot long slurry walls which serve as permanent walls for the center platform portion of the station.

This program was initiated by USBM to quantify the respirable dust problem caused by the use .of roadheaders in underground metal/nonmetal mines with special emphasis on this problem in uranium mines. The contract called for the development of methods or equipment to alleviate the respirable dust and to implement the solution in a mine. Attempts to quantify the dust problem were made in the following way: survey of MSHA records, survey of state mine enforcement agencies, survey of mine records, dust measurements taken at two mines using roadheaders. The results of this study are not conclusive due to very limited and sometimes less than useful data; however, the study does indicate that a serious dust problem could and may exist. If and when roadheader use becomes more popular, it is almost certain that development of dust control procedures and equipment will be necessary. This contract was concluded without developing this equipment since only one roadheader is currently in use in an American uranium mine and the mine prefers not to participate in the program at this time. This report discusses the available data concerning respirable dust problems and presents a solution which can potentially help to solve the problem. The solution requires the use of blowing ventilation, on-board dust extraction at the source, and filtration, as well as continued use of water sprays. The on-site tuning of such a system is necessary to demonstrate the degree of improvement possible.

The use of machine vision in the monitoring and control of metallurgical plants has become a very attractive option in the last decade, especially since computing power has increased drastically in the last few years. The use of cameras as a non-intrusive measurement mechanism not only holds the promise of uncomplicated sampling but could provide more consistent monitoring, as well as assistance in decision making and operator and metallurgist training. Although the very first applications of machine vision were in the platinum industry, no automated process control has been developed for platinum group metals (PGMs) as yet. One of the reasons is that to date froth features could not be related to key performance indicators, such as froth grade and recovery. A series of laboratory experiments was conducted on a laboratory-scale platinum froth flotation cell in an effort to determine the relationship between the platinum grade and a combined set of image features and process conditions. A fractional factorial design of experiments was conducted, investigating 6 process conditions, namely air flow rate (x1), pulp level (x2), collector dosage (x3), activator dosage (x4), frother dosage (x5) and depressant dosage(x6), each at levels. Videos were recorded and analysed to extract 20 texture features from each image. By using artificial neural networks (ANN), the nonlinear relationship between the image variables and process conditions and the froth flotation grades could be established. Positive results indicate that the addition of image features to process conditions could be used as sufficient input into advanced model based control systems for flotation plants. Recent hotel investment projects in China often involve very tight programmes for design and construction. An example given in this paper involves a 24-storey reinforced concrete hotel tower with 460 bedrooms and a 3-level podium commercial complex. The building is supported by relatively widely spaced columns and shear walls below which 88 number large diameter piers were excavated through fill, silty and bouldery clay on to dolerite and slate at depths between 15 to 3 0m below ground level. Whereas much experience has been accumulated in Hong Kong, hand-excavated pier foundation was only adopted for the first time in Dalian. This paper describes and discusses the various factors influencing the choice of the type and design of the foundation system. The criteria for determining appropriate founding levels are then explained. During installation, revisions to the acceptance procedure were made to cater for local conditions. Emphasis is placed on the role of the geotechnical engineer in making on-site decisions during construction. The advantage of the foundation system in accommodating on-site changes resulting from local complex ground conditions is demonstrated. The pier foundations were successfully completed ahead of programme.

This report describes the loading and transportation practices employed at the zinc-lead mines of The Eagle-Picher Co., Jo Daviess County, Ill., and Lafayette County, Wis. The report also gives a brief history of the Illinois-Wisconsin zinc-lead district and the operations of the company in the area. The diesel-powered, rubber-tired loading and haulage equipment is described and illustrated from the operational point of view only, and an analysis is made of the materials-handling system without going into health and safety factors. The costs per ton of the various components of mechanical loading, underground haulage, underground crushing, and hoisting for fiscal year 1960 are tabulated.

Many excavation and loading tasks require equipment operators to simultaneously coordinate the motion of multiple machine links, in order to achieve complex tool trajectories. Efficiency, ore selectivity, and machine wear, are all affected by the skill level and attentiveness of the operator. A software-based kinematics reconfiguration system designed to assist operators with various tasks has been implemented on a small experimental excavator using our new differential control architecture. Kinematics transformation and feedback control algorithms are being developed and tested using computer simulation, and the results implemented on the experimental excavator. Several task-specific kinematics transformations, including a virtual revolute-to-Cartesian machine reconfiguration and computer-assisted bucket steering and stabilization have been successfully tested. Progress, challenges, results, expected benefits, and planned work are described.

This report describes the development of training materials for the operators of underground mining equipment in the underground metal and nonmetal mining industry. The objective was to determine the effectiveness and acceptability of these training materials and to provide the validated training materials to the industry. Ten modules were developed, based on industry need according to accident frequency, accident severity and exposure to the equipment. The final modules were an average of 20 minutes in length and used slides with synchronized narration on cassette tapes. Testing materials are included for use by the mines.
