ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. (b) An individual who has devoted long and dedicated service to the corporation and to its goals and purposes may become a life member of the corporation upon being elected to that status by the Board of Directors, and such individual shall retain such status for life. (c) An individual who has been at any time an active member of the corporation and who has reached 70 years of age may become a senior member upon payment of such annual dues as the Board of

The coal producers of the Rocky Mountain states have led in one of America's true industry revolutions - the leaps in productivity and competitiveness that deliver coal-fired electric power to the U.S. economy at prices that are the competitive envy of the world. You are a primary reason the average price of industrial power in the U.S. - the power that creates and upholds jobs - is: ? 10 percent below the French average, where nuclear power is dominant; ? 37 percent below the average for industrialized Europe; ? 49 percent below the German average, where subsidized coal and nuclear rule; ? And 73 percent below the Japanese average where nuclear and liquified natural gas dominate. There are interests ambitious to change all of that; and they will be a subject of my remarks, some by name, rank, and affiliation. Coal-fired power plants in the Rocky Mountain states deliver some of America's lowest cost electricity; and America's coal-fired plants deliver some of the world's lowest cost electricity. Represented here in one room are producers from states that deliver more than 40 percent of America's coal and five of her top 10 producing states. You are cornerstones of America's economic strength and future growth. The theme for this meeting is "The Many Partnerships of Coal;" and, in this keynote, I'd like to offer a variation on the theme. I'd like to discuss a determined partnership that is dedicated to overturning everything you have accomplished, plus the structure of our society - very dedicated, very patient, very determined. This partnership masks itself as being in the public interest but behind the mask a political alliance of three distinct private interests can be seen: ? One is ambitious for economic reward as a right and without the trouble of effort; ? One is ambitious for economic advantage in trade without the trouble of competing; ? And one is ambitious for the power to govern people without the trouble of winning consent in elections - to change the way other people choose to live in accord with their own passionately held beliefs. The international agreement on climate is being used as an artifice to advance these interests, and the interests are making the United Nations a mechanism for achieving those objectives - for turning the screw, so to speak. The President that Americans elect this year soon will come under intense pressure from these partners to: ? First, quickly adopt policies that will raise U.S. energy prices and restrict use under the climate agreement; ? And in 1998 - if they follow their own published plans - to begin the subordination of the independence of the United States to a collective sovereignty in economic, political, legal and other matters. The Worldwatch Institute inaugurated this pressure last year with a policy monograph entitled Partnership for the Planet: An Environmental Agenda for the United Nations. This is but one indicator of the situation I ask you to consider. The pressure will increase after the election. Worldwatch is one of those intellect-oriented "public interest" groups whose work often leads to policy proposals and debate. Worldwatch gets money from the U.N. Population Fund and the MacArthur Foundation among others. And so my remarks require wading waist deep into one of the more sporting current propositions of American public policy - discussion of ambitions for and within the United Nations to achieve that which the ambitious call global governance. The Colorado Fuel and Iron Company has divided their coal mines into groups or divisions: Las Animas, Huerfano, Fremont and Gunnison counties. Each division is represented by a safety committee composed of three men appointed by the management and three men selected by the employes? representatives. The three men appointed by the management are usually from a group engaged in routine work that is primarily of a safety nature. Mr. Robert McAllister, chief mine inspector; Mr. George B. Parker, superintendent of first aid and mine rescue training; Mr. F. C. Miller, chief chemist, fuel department; and Mr. 0. C. Irwin, assistant chief electrician. The three men appointed by the management act in each of the four divisions. It is the duty of the safety commit- tee to visit each mine three times per year and make a thorough investigation of conditions underground and on top. Their report is in the form of recommendations to the management for their consideration. They are also called to investigate all fatal accidents and learn, if possible, the cause leading up to the accident and recommend precautionary measures that will prevent the recurrence. This committee inspects the haulage roads, air courses, manways, electrical equipment, ventilation, timbering, working places and humidity. In addition, each mine has a local safety committee with the superintendent acting as chairman. It is the duty of this committee to keep in daily touch with conditions underground and on top. They hold weekly meetings and discuss problems related to safety. These men work on local conditions that govern their affairs. As an example: One of the mines has a checking out board at the man-trip parting in addition to the regular checking in and out system as required by law, and this board is checked before the man-trip leaves for the outside, giving the officials a chance to take prompt action in looking up a man who may have become ill or injured. Should a man walk out and forget to check off, there is a penalty imposed. The ventilation of a coal mine is most important and the method of conducting the air to the working face is one of the greatest precautionary measures linked with safety. A quantity of air must be maintained at every working face to insure rapid diffusion of explosive or noxious gases and in a manner without interruption. With this intent in, view, the Colorado Fuel and Iron Company is installing fan equipments with capacities of 200,000 cubic feet per minute with dual drives, twin fans in some instances, for insured circulation. Discussion was prepared by A. L. Jones and Frank A. Rank, of the General Electric Company, read by Mr. Jones; by C. B. Officer, of the Sullivan Machinery Company, read by Mr. J. H. Emrick; by Mr. D. C. McKeehan, Chief Electrician of the Union Pacific Coal Company; and by Mr. L. C. Ilsley, of the United States Bureau of Mines, read by Mr. K. P. Marshall. Their prepared answers are inserted in the body of Mr. Harrington's paper, as answers to his questions. Introductory Remarks PRESIDENT MARKS: We have made special assignments for the discussion of this paper, and I believe these discussions are to be answered in sections, and as the different sections are read applying to this paper, we will just have a brief discussion on that particular point and proceed to the next and try and expedite this discussion as much as possible, be- cause I realize a good many of you have something to say. The first discussion is by Mr. Frank A. Rank, of the General Electric Company, Salt Lake City. MR. F. A. RANK (General Electric Company, Salt Lake City, Utah) : Mr. Chairman, while my name has been put on the program as being the one to discuss this paper, I believe Mr. Jones of our company has prepared a discussion on it, and therefore will let him talk in my place. MR. A. L. JONES: I think that it is passing the buck. However, Mr. Rank sent me a copy of the paper, and I read it over with a good deal of interest. There is one thing I want to say: Mr. Shubart, in his breezy letters, stated this paper was to be written by Mr. Harrington, assisted by a number of manufacturing and operating companies, among them the General Electric Company. We did not function. The paper was completed, and we were not consulted, and I believe that is true of the others. After reading the paper over, I dictated a few notes which I want to read, to give you the view-point that we have on the subject We do not want to minimize electrical dangers, or in any way slow down high-grade construction maintenance, but there is such a thing as overstating the case. It is so full of condemnation of most existing practices and conditions that it reminds me somewhat of the nerve-racked mother who sent an older brother to see what Willie was doing and to tell him to "stop it." His recital of electrical dangers is harrowing and if I felt it were a true picture I should feel that any of us having anything to do with the recommending or selling of electrical equipment for mines would be party to a crime. The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. Additional resolutions were read by Linville as follows: Item 1: WE RESOLVE herein that in the year since the last convention of the RMCMI, the Institute and the coal industry have suffered the loss, through death, and the services of: Lloyd W. Item 2: RESOLVED, that in recognition of their long and faithful service to the coal industry that the status of Life Member be conferred upon: Bernard Bernstrom Roy Coulson Shirl C. McArthur Item 3: RESOLVED, that we commend and express our gratitude to our Executive Secretary, officers, chairmen and committees for an outstanding job in presenting. the 80th RMCMI meeting. Item 4: RESOLVED, that the RMCMI express its gratitude to K&P, INC. of Golden, Colorado for their generous donation of office facilities and furniture for the RMCMI office and to K&P SALES ENGINEERS, INC. also of Golden, Colorado for their assistance in telephone answering, other office procedures and the use of certain office equipment. 9:00 a.m., June 28, 1983 MR. MORTENSEN: Good morning ladies and gentlemen. Again, it gives me great pleasure to welcome you to another session of the 79th meeting of the Rocky Mountain Coal Mining Institute. The thing again that has always been impressive are the activities that we've had so far. The success in the meetings has been delightfully encouraging to all of our committee people. Please welcome the chairman of the session, Charlie Margolf. MR. MARGOLF: Thank you, Vernal. Good morning, ladies and gentlemen. It would be my privilege to serve as the session chairman this morning. To allow the maximum time for our speakers, I'll turn the microphone over to Bernie Bernstrom who will introduce our first speaker. MR. BERNSTROM: Thank you. As Vernal mentioned, Dan Jackson will be our first speaker. He is the Western Editor of Coal Age Magazine. Dan really doesn't need an introduction to this group. He's belonged to the Rocky Mountain Coal Mining Institute about 25 years. Dan is a native of West Virginia and he's an ex-coal miner. He graduated form West Virginia University as an electrical engineer and worked for Amherst and West Bending Coal prior to employment by Coal Age Magazine. Back in 1972 Coal Age moved him to Denver from New York City. MR. JACKSON: When Vernal Mortensen asked me speak to the members of the Rocky Mountain Coal Mining Institute earlier this year I found it impossible to say no to the guy because of what he has contributed to western coal. Little did 1 know that the subject he had in mind would be entitled, "An Outsider's View of Western Coal." At first I asked myself-I've been associated with the coal industry for some 38 years, 12 years in national operations and 26 years reporting on it. You might say that I've been married to two industries, coal and the business press for 26 years, but today I'll put on my business press hat and try to make an impression of what an outsider might think of western coal. But at the outset, let's get one thing straight: When you say press, whether it's business press, the media or whatever, and you heard some comments yesterday as far as what the media has done .to this industry and there's been some definitions bandied around as to just what an editor is. One of the most recent ones has defined an editor as a person who can talk on any subject with an open mouth. Now that's not my case. Secondly, I don't give long talks. Several years ago I was giving a rather lengthy talk to a group similar to this and it was halfway through the talk when I noticed one guy on my right looking at his watch quite frequently. I didn't mind that too much because all of us do that once in a while, but when he looked at his watch, took it off and shook it, I thought, "My God, better cut short." But for more than a decade western coal has enjoyed substantial annual increases in production from some 30,000,000 tons in 1970 to some 264,000,000 tons in 1981, but 1982 was a different story. We lost about 6,000,000 tons of production in that year. In 1983 it's expected to be a little worse than '82. Coal historically doesn't rebound from a recession as quickly as other industries. It takes about eight to 10 months longer for us to really get moving again and I'm afraid that you'll still have to don your fighting helmets and flack jackets when you go out into the market to sell your product. Western coal, as you know, has problems and al l of them are not going away when the recession ends and they won't go away overnight. I'm sure most of you are aware of what those problems are. Carl Bagge and Jim Harris, along with other speakers, at this meeting have educated us well on those problems and I'm sure you'll hear more from Jim Watt at today's luncheon. If everyone in this room were asked to list three orfourof the most serious problems facing western coal, I'd make book that the total of the answers wouldn't vary by more than 3 to 5%, if that much. But coal is not the only mining segment in the U.S. with problems. Metal and non-metal mining has its share, too. I'd like to step back into the past for a few minutes, if I may, to a time when our problems were just beginning. Since 1979 a third of the nation's mines, including coal, metal and nonmetal have been shut down. The total volume of all mining in the U.S. in that year totaled some $24 billion. Today that figure has dropped some 21 %. The after tax rate on return for mining companies has fallen from 6'/% in 1980 to minus 3% in 1983. But that's really not where our problems began. They began 20 years ago when a profound change began taking place in the U.S. economy. Our economy had been growing at about 2'/-3% annually without exception except for the great depression. Our inflation rate was about I'/%, interest rates were running about 6%, and the federal budget was $77 billion, really great figures compared to today. From 1960 to 1980 the federal budget increased almost 1.000% and taxed paid by individual families increased by 700% during that same period. Despite the huge increases in taxes, the federal deficit kept getting larger and larger year after year and within this 20 year period the national debt climbed to a trillion dollars. Economic progress of this type can't continue indefinitely without some serious consequences. The result of that economy, well, you know what happened and there is a direct relationship of that

CHAIRMAN ALLEN: Gentlemen, I have been asked to call this meeting to order by Mr. Marchant, and am acting here temporarily in the absence of Mr. Nyman, who is unable to be with us. Mr. Nyman sends the following telegram: "Will not be able to be present at the Institute meeting. Serious illness of my father has made it necessary for me to remain in Salt Lake Please arrange substitute. Very sorry." In addition to having to pinch-hit for Mr. Marchant and President Nyman, I am here representing the Governor of the State of Colorado also who is unable to be here. The Governor of Colorado is a very busy man. His appointments are made months ahead. We only got word of the possibility of his addressing this meeting yesterday morning, and I went over to the Governor's office this morning to see if there was any possibility of getting him here, but he had been booked up for two months ahead of this time to appear at the convention of the Veterans of Foreign Wars in Trinidad, Colorado, where he is today, and which makes it impossible for him to attend this meeting. I know that he would have liked to have been here with you, as there is not any doubt but what the Governor of Colorado has the interests of the mining industry at heart. This was manifested last week when he called a meeting of representative men of the different lines of industry so that we could arrive at some results and some arrangements to see if it was possible to get at the bottom of the condition causing our bad times, and the appointment of commit- tee groups to find out what these problems were and to see if they could get any possible solution to them. The meeting was adjourned with the suggestion that those who were present would among themselves select such committees to investigate the conditions of the coal mining industry, and offer suggestions for betterment.

We have listened to many papers describing mechanical loaders, and systems of mining planned to increase their efficiency. We have become familiar with the various types and in a general way, their capacities and limitations. Messrs. F. E. Cash and E. H. Johnson in Bulletin 17 of the Carnegie Institute of Technology, subject Coal Mining Investigations, have a very complete review of the loading situation then. Mr. A. W. Dickinson, in a recent paper before this Institute, gave a later illustrated review of mechanical loaders. On page 28 of Cash & Johnson's paper is a list of loading machines to which might be added to bring the list down to date, the following: Under Digging and Loading Machines The Goodman Power Shovel Under Scraper Loaders The Goodman 436-G-3 125 H. P. three drum Scraper loader The Goodman 35 H. P. Entry loader and the Two Drum 125 H. P. Hoist built by Vulcan of Denver for scrapers Under Shaking Trough Conveyors The Eickhoff Conveyor The Link-Belt Conveyor The McCarty Duck-bill which is really a digging and loading element built to attach to the end of and operated by a reciprocating conveyor. The outstanding feature in this line of work in the past few years is the fact that a few very successful operations have been worked out on a large scale; the officers and staff in charge of this work have gone into details very thoroughly and altered and improved, in many cases, their mine equipment and mining methods, and by the exercise of persistent energy and intelligent effort, in the face of frequent difficulties and discouragements, they have attained results that are far ahead of the average loader operation. The coal mining industry owes much to these men for the pioneering and development of mechanical loading; their investigations in transport, shooting, shearing, snubbing, cleaning, and production costs, the results of which they have given freely and frequently to the public, are of great value. Foremost among the pioneers in this work are the Union Pacific Coal properties, the Quealy properties, the Sheridan Wyoming Coal Company and in the Central West, the Union Colliery Company of Illinois. On the other hand, in the great majority of installations, one loader, or possibly two or three loaders have been started in a given operation and through failure to make the proper effort to improve their transportation and work out the systems to utilize their loading machines, the loaders have not shown appreciable savings and in many cases, the installation has failed. It has been frequently stated in many meetings where loading has been discussed, that the idea of mechanical loading must first be sold not only to the operating staff but to the entire personnel of any company where installations are made. The problems involved in the successful application of this equipment are such that it requires enthusiastic and wholehearted teamwork on the part of everyone connected with the work and when difficulties arise, they must be ready to exercise initiative and try new ways oftentimes of overcoming impediments. The closest attention now is given to the question of economics how much will a loader reduce the cost of coal in any particular situation? Without fear of successful contradiction, I believe that experience up to date has unquestionably shown that where the shovel type of loader can be properly used, it produces in wide work, the cheapest coal of any loading device yet brought onto the market. Naturally there is a considerable difference between the results from different makes of shovels.
