As set forth in the decision of the Trail Smelter Arbitral Tribunal, dated April 16, 1938 This Tribunal is constituted under and its powers are derived from and limited by the convention between the United States of America and the Dominion of Canada signed at Ottawa, April 15, 1935, duly ratified by the two parties and ratification exchanged at Ottawa, August 3, 1935 (hereinafter termed "the Convention") . . . The duty imposed upon the Tribunal by the Convention was to "finally decide" the following questions: (1) Whether damage caused by the Trail Smelter in the State of Washington has occurred since the first day of January 1932, and, if so, what indemnity should be paid therefor? (2) In the event of the answer to the first part of the preceding Question being in the affirmative, whether the Trail Smelter should be required to refrain from causing damage in the State of Washington in the future and, if so, to what extent? (3) In the light of the answer to the preceding Question, what measures or regime, if any, should be adopted or maintained by the Trail Smelter? (4) What indemnity or compensation, if any, should be paid on account of any decision or decisions rendered by the Tribunal pursuant to the next two preceding Questions? In this decision reported to the Government of the United States of America and to the Government of the Dominion of Canada, the Tribunal answered the first question in its entirety and reserved decision on the other three questions in accordance with the following extract from their decision

"Long term contracts requiring delivery of 6,000,000 pounds of U308 per year to its customers have made it necessary for Denison Mines to expand its milling capacity from 7,100 tons per day to 15,000 tons per day.Previous papers (1) and (2) described the old leaching and product recovery practice. The flowsheet briefly includes a crushing and grinding circuit, sulphuric acid leaching in a Pachuca plant, liquid-solid separation with wash thickeners and two-stage drum filtration, concentration and purification by moving bed ion exchange followed by two-stage precipitation to produce an ammonia yellowcake.No. 1 Shaft ore, about 4,000 tons per day, will be processed through the truck dump into the old crushing and grinding plant and through the old leaching plant. Ore from Stanrock (No. 3 shaft) will be hauled by truck and also processed through the truck dump as No. 1 shaft ore. Beginning in 1982, ore production from Stanrock will gradually increase until 1985 when some 3,000 tons per day will be milled from the source.A new 8,000 ton per day circuit was designed and constructed to increase the milling capacity to 15,000 tons per day. The new circuit is separate from the old one except that it coins together for the precipitation and tailings neutralization sections of the plant. The feed to the new plant will be from No. 2 shaft.The flowsheet is much the same as the old plant with the exception of the grinding circuit and the ion exchange plant. A semi-autogenous grinding (SAG) plant, unique in the Elliot Lake area, has been installed rather than the conventional crushing and grinding plant; the ion exchange plant is the stationery bed type.This paper describes the major equipment installed for the expanded grinding and hydrometallurgical plant."

A stronger U.S. economy stimulated the domestic mineral sector in 1994. Metals demand was spurred by robust U.S. motor vehicle sales, while demand for major industrial minerals rose in response to highway and building construction. Domestic mineral and material demand is expected to increase in 1995, particularly if interest rates do not restrain the building industry and international monetary exchange rates remain advantageous to U.S. automobile manufacturers. Additional information on events, trends, and issues in the mineral and material sector is presented below and in the commodity sections that follow. Overall Performance Processed materials of mineral origin produced in the United States during 1994 increased to an estimated value of $360 billion. Domestic output of raw nonfuel minerals in 1994 was estimated at $34 billion, about 6% more than that of 1993. The value of U.S. minerals production has increased in 29 of the last 34 years.

New Trade Status for Mainland China--On January 24, the Congress approved a most-favored-nation trade status with Mainland China for both imports and exports. A Presidential Proclamation had been issued earlier in anticipation of the Congressional action. Import duties on such commodities as tungsten, mercury, and antimony are automatically decreased. Defense Production Act Extended--The Defense Production Act of 1950 was extended 60 days to March 28, 1980. The provision for the usual 2-year extension of the Act is reportedly included in an omnibus energy bill that is tied up in committee. The Act under Title III provides for the expansion of productive capacity and supply and, more specifically, it gives priority to defense contracting where defense and non-defense interests conflict

The Bureau of Mines conducted basic experiments to study the process of crack propagation with a wedge indenter. The work was conducted under plane stress conditions in a hard, brittle limestone. The purpose of these experiments was to first gain an understanding of the basic crack propagation process under a sharp indenter, and second, to determine how the crack propagation process could be used to improve mechanical fragmentation systems. Three methods of rock fracture with the wedge indenter were investigated in this program. These were the confined indentation tests, the unconfined splitting tests, and the edge chipping tests. The confined indention tests represent worst case conditions for crack growth and formed the lower bound on fracture efficiency. The unconfined splitting tests represented best case conditions and fixed the upper bound of fracture efficiency. The edge chipping tests represented an idealized fragmentation process based exclusively upon the highly efficient fracture propagation process. Edge chipping achieved a specific energy of 25 in lb f/in3 compared to conventional drag cutters, which required a specific energy of at least 2,385 in·lb f/in3? Thus edge chipping is up to 100 times more efficient than conventional drag cutting. Because of these promising results, more work is planned with the fracture propagation process in three dimensions.

THE zinc-smelting industry of the United States has grown very rapidly in recent years and bids fair to outrival that of all other countries in the future. On account of the geographical situation of the chief ore-supplies, the industry may be divided into two main groups, the eastern and the western. The eastern and older group includes the works of Pennsylvania, New Jersey and Virginia, which practically control their own ore-supply. The western group includes the works of Illinois, Missouri, Kansas, Wisconsin and Indiana, which do not control their own ore-supply, but are compelled to buy the ore in the open market. It is for this reason that the western zinc-smelting industry has been undergoing continual changes since its inception 40 years ago. During the early discoveries of lead- and zinc-ore in the lead- and zinc-districts of Wisconsin and northern Illinois, the zinc-ore (sinithsonite or " bone " as the miner calls it) had no value and was considered waste; but later, when this ore was found in large quantities, it attracted the attention of metallurgists, which finally resulted, during the early sixties, in the building of the Matthiessen & Hegeler Zinc Works at LaSalle, Ill., the pioneer zinc-works of the West. A few years later, zinc-ore was discovered associated with the lead-ore in Jefferson county, southeastern Missouri, which started the industry at Carondelet or South St. Louis. Still later, the discoveries of zinc-ore in the lead-ore region, first' at Granby and then around Joplin, lead to the introduction of the industry in the southwest Missouri and Kansas districts. At first the development of the industry was slow, but it progressed steadily and it is now one of the leading metallurgical industries of the middle West.

The development of a water accounting framework that enables consistent and contextual reporting of minerals operationsÆ water use, represents a key sustainable development objective that many Australian minerals companies have committed to. A future water accounting framework will require: key terms and definitions for water metrics for use in the Australian minerals industry that are consistent with the wider water sector, a suite of metrics representing key components of an operationÆs water balance, a calculation method for some of the metrics, and a reporting protocol. This paper presents the methodology that was used to derive these four components. Existing accounting frameworks were reviewed and key terms and definitions that were consistent with current regulatory requirements and voluntary approaches were proposed. A calculation methodology was developed to obtain some of the key indicators and variables that cannot be easily measured directly (eg water loss through evaporation). The adopted terms and definitions typically require a combination of empirical and estimated data. To test the proposed definitions and calculation methodology, values for water metrics were derived for eight sites, selected to test a variety of commodity and biophysical situations. The proposed framework and definitions could deal with the specific situations selected as case studies. The associated calculation methodology produced complete accounts at various levels. Some elements of the accounts could be directly checked against available data and simulations. The framework captured well variations in the reuse efficiencies; reuse efficiency could even vary for similar processes. It is concluded that this preliminary accounting framework provides a consistent language and metrics for quantifying and communicating water management, both at the intersection of the site with the surrounding landscape (through detailed reporting of site inputs and outputs) and within operational activities. Using this consistent framework for quantifying and documenting water use within an operation will provide a platform for compiling and comparing minerals industry water use with other sectors. This may support benchmarking activities within regions or companies and help demonstrate leadership amongst water users in water resource stewardship. The approach presented here is applicable to a wide variety of mining and processing activities, and biophysical environments, and following a period of stakeholder engagement and third party review, is being refined as a first step towards developing nationally consistent water use reporting for the Australian minerals industry.

The U.S. economy and, consequently, the demand for minerals grew at more moderate rates in 1995 compared with stronger performances the previous year. Demand for metals such as steel and copper was relatively stable. For example, the decline in steel consumed in motor vehicle manufacturing (reflecting lower vehicle sales) for the first half of 1995 was offset by an increase in steel consumed in construction during the same period. More detailed information on events, trends, and issues in the mineral and material sector Is presented below and in the commodity sections that follow. Overall Performance The value of processed materials of mineral origin produced in the United States during 1995 was estimated to be $395 billion, an increase of almost 10% compared with 1994. The estimated value of U.S. raw nonfuel minerals production in 1995 was $38 billion, about 7% more than in 1994. The value of U.S. minerals production has increased in 30 of the last 35 years.

The social license to operate (SLO) began as a metaphor for the ability of communities to stop mining projects. Soon people began to speak of levels of social license and the ability of communities to raise costs without completely stopping exploration or mining activities. Today the concept has spread to other industries and is evolving towards becoming a general management perspective on the socio-political rights and responsibilities of the corporation. The business case underpinning the SLO perspective on management is the need to assess and manage socio-political risk. For mining companies, socio-political risk has been steadily rising for several reasons, including the efforts of non-government organisations (NGOs) to pre-empt government policy options; the entry of mining companies into jurisdictions weak in the rule of law; and the weakness of global economic and financial regulation. In this perilous world beyond the comfort zone of effective government, mining companies must build their own socio-political stability by engaging directly with stakeholders to develop a strong SLO. In order to become a practical management perspective, the SLO needs to be measurable, which amounts to measuring the socio-political risks and opportunities presented by stakeholders. We present the results of efforts since 2009 to develop a globally reliable and valid measurement tool at the project and industry levels, validated in studies in Australia, Bolivia, Mexico and the USA. A factor analysis suggested four factors that mine management can address to raise their SLO level. The most chronically neglected factor involves the political right of the corporation to foster more equitable social contracts locally and regionally in both developed and developing countries. Methods for the direct spectrochemical determination of impurities at the parts-per-million level in tungsten metal and oxide are presented. Several published procedures were investigated and numerous modifications were made in establishing procedures with improved precision and extended lower levels of determinability. Details of standards preparation are presented, experimental work is described, and three preferred methods are described in detail. A germanium carrier-distillation procedure is applicable to the determination of 13 elements in tungsten powder; a silver chloride carrier-distillation procedure provides for the determination of 24 elements in tungstic oxide, and a sustaining ac arc method is applicable to 26 elements in tungstic oxide. The choice of methods to be used depends upon sample form, elements and concentrations to be determined, and the precision and accuracy required. The investigations reported here were undertaken to develop direct spec-trochemical methods with increased accuracy and precision to determine impurities in high-purity tungsten and tungstic oxide, to define the lower concentration levels of detectability and measurement for the common impurities in tungsten by direct spectrographic means, and to present the details of the developed or modified methods that have proved applicable.

The principal objectives of this study are to: (1) survey electrical practices in metal and non-metal mines, (2) survey electrical practices in metal and non-metal mills, (3) clarify the federal regulations governing electrical practices in metal and non-metal mines/mills, (4) analyze electrical accidents, and (5) make recommendations aimed at improvement of the safety of electrical practices in metal and non-metal mines. Information was obtained from literature searches, accident reports, visits to 27 mines and 12 mills, and discussions with knowledgeable industry and government people. The various electrical power systems and practices at the mines and mills visited are described. Similarities and differences based on the type of mining and the minerals being mined or milled are presented. The federal regulations governing metal/non-metal mine/mill electrical practices (Code of Federal Regulations, Title 30, Sections 55.12, 56.12, and 57.12) are presented and discussed. Explanations of each regulation are provided in an appendix. The attitudes of mine/mill operators towards the federal regulations are described. An analysis of the electrical accidents in metal/non-metal mines and mills during the period 1972-1978 is presented. Recommendations, including specific research and development activities, aimed at improvement of electrical safety in metal/non-metal mines are submitted.

The U.S. economy continued to expand during 1986, although at the slowest pace since 1982 when the current business expansion began. Real gross national product (GNP) grew about 2.6%, slightly below 1985 growth but significantly below that of 1984. The continuing expansion was fueled predominantly by rising personal consumption expenditures as well as growing government purchases of goods and services. Fixed investment, although positive, failed to grow at the rate of the overall economy. The trade deficit, which increased more than 30% over the record 1985 level, continued to depress economic growth despite significant declines in the price of petroleum and the value of the dollar. On a more positive note, domestic employment continued to grow--increasing over 2 million from the 1985 level--and inflation and interest rates declined. The unemployment rate dropped slightly to 7.0%. Of direct importance to the minerals-producing industries, expenditures for consumer and producer durables as well as investment in residential construction each grew faster than the overall economy, but investment in nonresidential structures fell more than 10% from the 1985 level. The low level of real capital spending declined about 3% in 1986, following strong gains in 1985 and in 1984. Capital expenditures for new plant and equipment bottomed out in the second quarter and expanded in the third and fourth quarters. The decline in the first half of the year was partially attributed to uncertainty arising from the then-proposed tax bill. Also, there was little impetus for corporations to invest in new capacity since factories were operating at less than 80% of capacity during most of the year, in part because of continued competition from imports.

In November 1989, the U.S. Bureau of Mines sponsored a 2-day conference to stimulate thinking and discussion about changing materials technologies and implications for the Government's materials information programs. On the first day of the conference, speakers provided overviews of developments occurring in each of the major materials groups. Emerging technological developments, applications, economic and national defense significance, intermaterial competition, and potential market growth in advanced plastics, polymer composites, ceramics, metals, and electronic materials were described. In general, the speakers forecast advanced materials market growth rates in excess of overall gross national product (GNP) though high costs will tend to limit growth outside of aerospace, defense, electronics, medical equipment, and other typically high value-added businesses. On the second day, a wide range of speakers representing several facets of the materials community described how advances in materials technology are creating a need for new types of data, statistics, information, and analysis. Reflecting the speakers' broad range of organizational, professional, and personal perspectives, an array of information needs was identified. Most requirements, however, seemed to fall into one of five major categories: Federal materials research activities, material standards, market and economic information, health and safety, and public policy.

This report records a chapter in the history of the development of an electrolytic manganese industry in the United States. Nearly all the manganese requirements of the United States have been imported. Although there are large quantities of manganese ore in the United States, most of it is low-grade and cannot be used for the production of ferromanganese. Since the electrolytic production of manganese carried out by a process developed in the laboratories of the Bureau of Mines offers a method whereby the extensive low-grade deposits may be utilized and since commercial development had proceeded slowly, the Bureau constructed a new and larger pilot plant at Boulder City, Nev., where abundant electric power was available. An authorization in November 1940 covered a plant of only several hundred pounds daily capacity. Additions to some sections author¬ized by subsequent appropriations have enabled the plant to produce over 2,000 pounds a day for extended periods.

"INTRODUCTION The South Hecla mine, one of the principal mines of the Alta United Mines Co., is situated at Alta in thee Little Cottonwood mining district, about 30 miles southeasterly from Salt Lake City, Utah. The mine has produced copper, lead, zinc, gold, and silver, and is reported to have been one 'of the principal sources of this country's bismuth from 1912 to 1925. The tungsten mineral, scheelite, has been found but has not been recovered. The extreme need for these minerals during World War II prompted an examination of the property by the Bureau of Mines and resulted in an unpublished report entitled ""The South Hecla Mine, Salt Lake County, Utah"" (fig. 1).A Bureau of Mines project 3301 was initiated, and operations were started early in 1943. The primary purpose of the project was to increase substantially the reserves of bismuth and tungsten ores. The critical situation in regard to lead, copper, and zinc developed during the early stages of the operation, and the work was expanded to include the development of ores 'of these metals.An investigation of 'the Albion, Rustler, and Greeley workings adjoining the South Hecla mine was made, and this work is also described (fig. 2); ACKNOWLEDGEMENTSIn Its program of investigation of mineral deposits, the Bureau of Mines has as its primary objective the more effective utilization of our mineral resources to the end that they make the greatest possible contribution to national security and economy. It is the policy of the Bureau to publish the facts developed by each investigative project as soon as practicable after its conclusion. The Mining Branch, Lowell B. Moon, chief, conducts preliminary examinations, performs the actual investigative work, and prepares the final report. The Metallurgical Branch, O. C. A survey and critical appraisal of published information about Young's modulus was originally made by the writer because of a complete lack of information about this very important quantity in works on. mechanics, physical metallurgy, physics, and other sciences. It was felt that a comprehensive summary of such information about Young's modulus might be of general interest and may suggest new problems or lines of attack on other problems that involve E. Hence this paper has been prepared even though it is only a review, with no new ideas or experimental data. The references are only those used in assembling the paper. No attempt was made to compile a complete bibliography on the subject of Young's modulus. CalculatioX oP YouNg's Modulus from Theoretical or Empirical CoNsidera-tions Many attempts have been made to compute E from theoretical considerations. The earliest calculations were probably those of Tomlenson (1883) and Souther-land (1891), but Fess'enden4',~ made extensive calculations a few years later and arrived at the relationship: £ = 78.TOw(i)* where V is the atomic volume. In 1923, Peczalski, working from the same standpoint but with more information available on atomic structure, arrived at an identical relationship, which he expressed as: where B is a constant of value about 8 . 107, p is density and mis atomic weight; the atomic volume, of course, being ml p. Portevind4 immediately pointcd out that while the equations of Fessenden and Peczalski were true of the common metals, they gave low values for the refractory metals with high moduli (Fig. I). He showed (Fig. 2) that much better concordance was obtained by means of an empirical equation of the form: F- KT" where K is a constant; T the absolute melting point; V, atomic volume, and a and b constants of value approximately I and 2 respectively. This constant K in the Portevin equation is not necessarily the same for all elements, as shown by Thompson. Other equations for E based upon theoretical considerations have been derived by Honda and Yamada49 and Lasareff.50 The most recent calculations of elastic moduli based upon quantum mechanics are probably those of Fuchs He extended the method of Wigner and Seitz for calculating the lattice energy and compressibility of monovalent metals and computed the elastic constants of lithium, 18

This paper evaluates current environmental protection legislation, guidelines and criteria, focusing mainly on the land and water disposal of mill tailings. Effluent criteria and regulatory mechanisms are proposed, and submarine tailing disposal is discussed at length. The importance of basing regulations on the best available rationale is stressed.
