THE liability for damages to the surface caused by subsidence is an ever present threat in all underground mining. In ordinary lode mining, this threat rarely materializes into an action, due to the method of mining metalliferous ores, the dip of the veins, and the nature of the ground itself. In the mining of coal, however, this threat is very real. The coal frequently lies close to the surface, in beds underlying large areas of land of which the surface is suitable for agricultural or urban development. Furthermore, the coal is generally mined by the "room and pillar " method and when the pillars of coal are removed, the subjacent support is destroyed. This question of the duty of surface support has now become a very live one in Colorado. What was waste prairie land a few years ago has become valuable agricultural land dotted here and there with growing towns. Frequent references will be made here to Colorado conditions and adjudicated cases, but those conditions and cases and the conclusions to be drawn therefrom are applicable to all coal-mining states. Briefly stated, the question is "Does the owner of the substrata or underlying mineral owe any duty of surface support to the owner of the superjacent strata or surface?" There is no absolute duty of support owed by the mineral owner and this assertion is made with full knowledge of numerous expressions to the contrary by courts of Pennsylvania, Illinois, Colorado and other coal-mining states. Whether or not any duty exists depends upon the circumstances surrounding each case, and since in the nature of things those circumstances are rarely identical, there can be no absolute rule.

DURING 1937 the subject of mining geology was probably given more attention and more mining geologists were usefully employed than at any previous time. Of the many contributing factors the most important were: (1) a higher degree of prosperity in many countries, (2) a. better understanding of geologic phenomena, and (3) the apparently diminishing reserves of several important minerals. Mining companies have come to look upon geology with a growing appreciation of its aid in the more effective exploration and exploitation of mineral deposits. Most of the larger and more active companies have one or more geologists permanently attached to their staffs and some have well organized and efficiently managed geological departments. Even the smaller companies, who feel they cannot afford to employ a geologist on a permanent basis, are seeking the advice of competent men in this field with increasing frequency. One of the most significant trends has been the growing tendency to base exploratory work on more thorough geologic studies instead of empirical "hunches,"on which so much off the work in the past has relied. Likewise, mining companies are apparently more willing to expend larger sums on the basis of geologic possibilities in a district.

New Mexico retained its position as the sixth largest oil-producing state for the year 1937 with a total production of 38,484,630 bbl. This was an increase of 11,680,184 bbl. over the 1936 production of 26,804,446 bbl., or a gain of 43 per cent. The production for Lea County during 1937 was 35,961,056 bbl.; for Eddy County, 2,136,251 bbl.; and for northwestern New Mexico (San Juan and McKinley Counties), 387,323 bbl. The average daily non-marginal well allowable for Lea County on Jan. 1, 1937, was 92 bbl.; at the close of the year it was 67 bbl. The average daily pipe-line runs were less than the allocations of the New Mexico Oil Conservation Commission, but slightly in excess of the state allowables recommended by the United States Bureau of Mines. The average daily production for the year was 105,437 barrels. The total number of completions in the state was 742, of which 638 were oil wells; 19 hydrocarbon gas wells; 5 carbon dioxide gas wells and 80 dry holes. Of the dry holes, 46 were in proven fields. Of these 46 dry holes, 13 were in the Artesia-Grayburg-Jackson-Maljamar area, Eddy County, two in the Getty Extension field, Eddy County, 11 in the Red Mountain field, McKinley County, three in the Rattlesnake field, San Juan County, and nine in the Aztec-Bloomfield area, San Juan County. There were only eight dry holes in the proven fields in Lea County. Southeastern New Mexico Lea County.—The Monument field was the largest producing field in Lea County, with 10,945,788 bbl., closely followed by the Eunice field with 10,927,929 bbl. The Hobbs field, formerly the largest producing field in Lea County, was relegated to third .place, with 7,292,522 barrels. Drjlling during the year closed the gap between the northern part of the Eunice field and the southern part of the Monument field. The wells in this area were relatively small, because of decreased porosity in the lime. The greatest activity in Lea County was in the Monument pool, with 199 completions, 197 being oil wells, one a gas well and one a dry hole.

PROCESSES employing controlled atmospheres in the heat-treatment of metals and alloys are now well established on an industrial scale, and the general principles involved and the advantages to be gained in the use of the technique have received considerable publicity over a period of years. During this time the greatest emphasis has been on the establishment of the process in industry, the main effort being devoted to development work on various types of atmospheres, their useful fields of application and the design of suitable heat-treatment furnaces in which they are to be used. The various types of controlled atmospheres are fairly well standardized, but there still remains a considerable field for the investigation of related problems, in connection with both the gas-generating equipment and the surface chemistry of the heat-treatment of metals, especially in complex controlled atmospheres. This paper describes certain investigations of this nature that were carried out in England up to 1939. The development of processes employing controlled atmospheres has been associated to a very large extent with the heat-treatment of steels, both because of the major importance of steel in industry and the many diverse and difficult problems of surface chemistry involved when steels of such a wide range of composition are heated in the presence of active gases Controlled atmospheres such as dissociated and burnt ammonia or charcoal gas are used in the heat-treatment of low-carbon and high-carbon steels, but from certain points of view a suitable atmosphere generated by the partial combustion of city gas is to be preferred. Both the ammonia derivatives are comparatively expensive, and even if the burnt ammonia is regenerated, thereby reducing operating costs, the capital expenditure of the gas plant may make it prohibitive for the smaller type of furnace installation. Charcoal-gas generators are not without their operating difficulties: especially those associated with the quality of the charcoal, clinker formation and the removal of carbon dust from the generated gas. City gas has the advantage of being comparatively cheap and "on tap" in most if not all industrial centers. The use of raw city gas as a protective atmosphere in the heat-treatment of steels has been described,1 but it presents certain difficulties because of its complex composition and its explosive nature when mixed with air. These factors, together with the tendency toward sooting at elevated temperatures, arising mainly from the hydrocarbon gases present, all militate against its use as a protective atmosphere in industrial furnaces. A review of production in the Eastern District for 1930 is necessarily brief. Drilling operations were curtailed, due to economic conditions, which in turn reduced production. However, in spite of these conditions, there have been a few outstanding developments which surpass any of recent years. The development of a field in Chautauqua and Cattaraugus counties, New York, has been rapid and probably reached its peak of production in 1930. The gas in this field comes from the White Medina Sand (Silurian), at an average depth of 2600 ft. Some of the wells had an open flow of 20,000,000 cu. ft. of gas per day,' with an original rock pressure of 965 pounds2 per square inch. Another area developed during 1930 was the Tyrone field, in Tyrone Township, Schuyler County, New York. This field was discovered 2nd is practically controlled by the Belmont Quadrangle Drilling Corpn. of New York. The production is from the Oriskany Sand (Devonian), which is found at an average depth of 2100 ft. The field covers approximately 2000 acres, and to date has 14 producing gas wells. The largest well had an open flow of 15,000,000 cu. ft. and an original rock pressure of 740 Ib. The gas from this field is impregnated with sulfur, and requires washing before it is marketed. Because little is known of the Oriskany Sand, a brief description may be of interest. This sand outcrops at Oriskany Falls, New York, and has a thickness of 10 to 12 ft. Its texture is coarse grained, it is composed mostly of quartz and is a regularly bedded sandstone. At Yauger's Wood, in Cayuga County, New York, it is exposed and shows a thickness of 26 feet. The discovery of the Tyrone field led to much prospecting in the New York and the northern part of Pennsylvania, and as a result of this search, the Allegany Gas Co. struck a large gas well in Farmington Township, Tioga County, Pennsylvania, which created considerable excitement through the Eastern District. In the Bingham district over a span of more than 90 years, 43,947,104 tons of "non-porphyry" copper, lead, zinc, gold, and silver ore have been mined from a folded and faulted alternating series of Pennsylvanian and Permian limestones and sandstones and from some Tertiary intrusives. This ore came from six major mine areas located east, south, and west of the Bingham stock, site of Kennecott's porphyry copper deposit. The sediments were affected by varying degrees and types of metamorphism within 2000 feet or more of the Bingham stock. The intrusives consisting of the mineralized Bingham and the unmineralized Last Chance stocks and numerous dikes and sills of granite and monzonite were intruded into the asymmetrical northwest-trending and plunging Bingham syncline. Extrusives, although present, contain no ore. The bulk of the non-porphyry ore in the district was found above the Midas thrust. The primary ores are found in three major types of deposits: concordant bedding fissures, crosscutting fissures, and replacement deposits. These deposits consist of both copper and lead-zinc ore bodies that contain various amounts of gold and silver. These are in places roughly zoned both laterally and vertically and have been mined for up to 10,000 feet outward from the center of the Bingham stock and up to 5000 feet vertically below the surface. Secondary ore was of minor importance and was found in and under the oxidized zone at shallow depths. Genetically the Bingham stock, the ores, and related phenomena have had a common source.

IN THE literature on the elimination of metalloids in basic open-hearth practice, there are a great many heats recorded in which excellent data on changes in slag and metal composition during refining are given, but in almost all of these heats either temperature data or weights and analysis of charge are unrecorded and observations on the physical charac- teristics of the slag are almost always lacking. With these points in mind, a test heat was made in which as complete as data possible on all the factors that affect the elimination of metalloids were obtained.

JUDGING from the inquiries that are constantly being received by the Utah Engineering Experiment Station as to the "Why," so to speak, of the flotation process of concentrating minerals, it occurred to me that perhaps a brief statement of the more important theories might interest those who have not followed the technical literature. Like many other industrial processes, flotation has hitherto been developed on an almost purely empirical basis, with relatively little practical contribution from the fundamental chemistry and physics on which the phenomena are based. In fact, its development by the trial - and - error method has been perfected to such a high state that it is becoming generally thought that further important advances can be brought about only by a thorough understanding of the actual mechanism of the process. Natur¬ally, such a complicated process has brought forth numerous theories, most of which have failed to withstand the test of time. It is significant that no theory has yet been advanced which is universally accepted.

THE Eastern Magnetite Industry produced approximately 7,850,000 long tons of crude ore in 1945 from which was obtained approximately 3,650,000 long tons of shipping product or a ratio of 2.10 to 1. Lack of skilled or experienced miners was the greatest handicap. Veterans returning to work improved the underground labor shortage in some localities but as a whole the labor shortage was keenly felt throughout the industry. One cannot now predict what may be accomplished in 1946 but barring major steel strikes a worthwhile improvement can be expected. At the Richard mine of the Richard Ore Co., the shipping product for the year amounted to approximately 124,650 long tons of concentrate and lump ore. Crude-ore production was 160,600 long tons. The average analysis for lump ore was 63 per cent iron and for concentrates 66.05 per cent. The Warren Foundry and Pipe Corp. at their Mt. Hope mine produced 73,000 long tons of lump ore averaging 59.5 per cent and 57,000 long tons of concentrate averaging 67 per cent. The total mine hoist was approximately 209,000 long tons. Operations were commenced through the new Leonard shaft on Jan. 18; the Brown shaft through which operations had been conducted since 1912 caved beyond repair on Sept. 26. No one was injured but pumping facilities were somewhat disrupted. In order to reach designed capacity a total of 400 men will be required with 300 underground. Due to shortage of labor all operations in 1945 were concentrated on the 1700 level. As fast as men can be hired and trained development of the 2100 and 2500 levels will commence. Mt. THE institute has established this lectureship to honor the memory of a great American metallurgist, one whose fame has continued long after his passing. As one scientist recently stated it," All metallurgical texts gradually become outdated and outmoded, except those of the great Henry Marion Howe." It seems fitting, then, that, once every year, we should review, in his honor, some aspects of the science in which he was such a distinguished leader, and also discuss any new data that may help to clarify our concepts. It is my privilege, for which indeed I express the deepest appreciation to this Institute, to offer for consideration a few thoughts on the toughness and fracture of hardened steels. Before proceeding to the data, I wish to express my great indebtedness to many associates whose stimulating discussions, generous contributions of data and cooperation in experiments are gratefully acknowledged. (But I wish to absolve them of any blame that may arise from the way in which their discussions and data have been used!) First, Dr. Edgar C. WITH the exception of the work of Vogel,&apos; and Rolla and Iandelli, very little information has appeared in the literature on titanium binary systems with the rare earth elements. Rare-earth additions to titanium alloys may possibly parallel the beneficial effects on the physical properties of certain steels. Having this in mind, some knowledge of solubility limits and intermediate phases, if any, would be useful. An investigation of the titanium-rich Ti-Ce system was started. Alloy Preparation The iodide titanium from the New Jersey Zinc Co. and the cerium metal from the Institute for Atomic Research Ames Laboratory used in this work were supplied with the typical analysis shown —iodide titanium: 0.0065 pct Mn, 0.0022 pct Fe, 0.0015 pct Cu, and 0.0042 pct Pb; cerium metal: <0.01 pct Fe, <0.03 pct Si, <0.05 pct Ta, <0.02 pct Pr, <0.03 pct Ca, <0.02 pct Mg, with no trace of Nd, La, or Th. The cerium metal, stored in oil, was washed and scraped just before weighing into capped cups machined from iodide titanium. The cold hearth helium-arc furnace described by Schramm et al3 was used for melting. The alloy buttons from the arc-melted cup were cut in two, mounted, and examined. Homogeneous alloys were demounted and rolled to approximately 1/4-in.sq bars. Sections l/8 in. thick were cut from the bar to provide samples. The Ti-Ce alloy buttons analyzed for cerium were of the following composition: 0.19, 0.36, 0.48, 0.61, 1.15, 2.52, 3.06, 3.70, 4.30, 9.20, 14.26, and 18.50 wt pct. Nominal

A two year study was made of the waste disposal of the pebble rock phosphate industry. Solid slimes are impounded in large settling areas and the process water is re-used. Clear effluent was not found to be toxic to fish, or animal life in field tests or in controlled experiments.

THE recurrence of mine-fires in Nevada during the past decade is not only a matter of interest, but also one of considerable concern to engineers and mine-managers. The more important fires may he enumerated as follows: Forman Shaft fire., Gold Hill, April 21, 1903 ; shaft-house, machinery, and shaft, destroyed; loss estimated at $50,000.; Cause Unknown. Union Shaft fire, Virginia City, July 14, 1904; shaft-house, machinery, and shaft in part destroyed; loss estimated it $100,000; cause of fire stated as the careless throwing of a match in the rope-house. Sutro Tunnel fire, Virginia City, Jan. 27, 1909 ; 700 ft. of tunnel-timbering destroyed, and direct damage of $10,000; cause &apos; probably electric wires." Belcher Shaft fire, Gold Hill, Aug. 9, 1910; shaft-house destroyed, machinery ruined, and upper part of shaft damaged; damage, $25,000; no cause given. IT is now well known that the structure of aluminum-silicon alloys can be refined in a rather remarkable manner, with consequent improvement of physical properties, by certain treatments applied to the molten metal shortly before casting. The differences between the treated and the untreated alloys are so marked that special terms are used to distinguish them, the untreated alloys being referred to as "normal" and the treated alloys as "modified." The first practical method of accomplishing this result was that of A. Pacz,1 which consists in treating the molten metal with a, salt flux of which the, active ingredient is sodium fluoride. The result can also be brought about, and in a more economical manner, by the addition of small quantities of metallic sodium (or potassium) to the molten alloy shortly before casting.2 The action of the Pacz flux evidently consists essentially in the production of free sodium by the reaction of sodium fluoride with aluminum. The changing of a normal alloy to a modified alloy is referred to as "modification&apos; and any process for accomplishing this result is a "modifying" process. Modified aluminum-silicon alloys were introduced several years ago, and it has been demonstrated both in the laboratory and in commercial practice that it is no simple matter to produce castings having the maximum or nearly the maximum properties which under favorable circumstances can be obtained. The alloys are rather sensitive to small changes in chemical composition, and the modifying process must be carried out in a very particular manner to obtain the best results. Levi Holbrook was born in Westboro, Mass., March 7, 1836. He was a descendant of John Holbrook, who came from England in 1660 and settled in the Massachusetts Bay Colony. Mr. Holbrook was prepared for college at Williston Seminary, East-hampton, Mass., and after one year spent in the West, he entered Yale. He was a, member of Phi Beta Kappa and of Linonia. During the six months following his graduation he was in Boston, under medical treatment for his cyes; then he took a horseback trip across the Rocky Mountains to the Columbia River and back, and resided in Danville, Va., for a time. From 1860 to 1863, as his eyes permitted, he was a student of modern languages and literature in Cambridge, Mass., part of the time being a resident graduate at Harvard University. Finally, however, he was obliged to abandon the idea of a literary life and from 1864 to 1867 he was engaged in financial business in Boston. The following year, he spent in New York, and then traveled for a year in Europe, Egypt and Asia Minor. In 1871, he returned to New York City. Mr. Holbrook was a member of the New England Historic Gcncalogical Society, the Society of Colonial Wars, and the Sons of the Revolution, was registrar general of the Order of the Founders and Patriots of America from 1915 to 1920, and had been governor of the New York society of that order. He was also a member of the American Fine Arts Society, the Order of the Cincinnati, the American Geographical Society (of which he was a councillor and secretary). and the Geographical Society of America. He joined the American Institute of Mining Engineers in 1878, and served as manager from 1895 to 1897. Mr. Holbrook died on July 26, 1922, from organic heart trouble, at his residence in Center Harbor, N. H. He was married Dec. 27, 1871, in Newark, N. Y., to Viola, daughter of John A, and Elizabeth (Failing)Vowers, who died on Sept. 10, less than six weeks after her husband. His two children, Clark Holbrook of Red Bank, N. J., and Mrs. Julian P. Smith, survive him

Levi Holbrook was born in Westboro, Mass., March 7, 1836. He was a descendant of John Holbrook, who came from England in 1660 and settled in the Massachusetts Bay Colony. Mr. Holbrook was prepared for college at Williston Seminary, East-hampton, Mass., and after one year spent in the West, he entered Yale. He was a, member of Phi Beta Kappa and of Linonia. About six years ago the writer had occasion to visit a large magnetic iron-ore concentrating-plant, and then saw for the first time rubber belts employed for conveying-purposes. These belts were from 20 inches to 30 inches in width, and some of them were as long as 500 feet between centers. When I spoke of the enormous amount of material they handled with a small expenditure of power, the superintendent assented, but at the same time complained that although he bought the best quality of belts, the abrasion of the ore wore them out very rapidly, causing continually very large bills for repairs and renewals. THE coal classification session* on Monday morning, Feb. 17, was opened by a paper by M. R. Campbell, entitled "Natural Groups of Coal and Allied Fuels," in which he pointed out, by means of graphical presentation of selected proximate analyses of coal, that coals can be classified on the basis of their moisture content. He proposes four groups of coal, brown coal, hydrobituminous, bituminous, and anthracite, each subdivided into two or three sub-groups. In a written discussion of this G. H. Cady, of the Illinois Geological Survey, showed that there is, in general, a progressive decrease in the moisture of Illinois coals from north to south, and that it would be very difficult to draw any arbitrary line dividing the coals of the State into two groups on the basis of moisture content.
