This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World," (Information Circular 80 1 7, 196 1. ) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then bronze, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. More than a few discussions are taking place these days among management economists seeking a way out of the dilemma of lower productivity vs. higher labor costs. Most suggestions would be illegal under present antitrust laws. Otherwise interindustry cooperation could be used to divide up some of management's tasks. Or price structures might be tuned to the special machinery and skills of some plants. Both remedies would be under attack almost immediately. There is one other remedy that is getting lots of attention: some form of compromise between management and labor to phase out no longer needed work practices that unions insist shall be retained. Railroads are the national industry suffering the most from this disease, still known as "featherbedding," an epithet coined by the railroaders themselves.

Discussion held at the sessions of the Canal Zone meeting, November, 1910. [SECRETARY'S NOTE.-As a result of this discussion, an expression of opinion covering all points of unanimous agreement was adopted and signed by members of the Institute party as individuals. This statement, which was printed in the Bulletin of December, 1910, is reprinted below, as an introduction to ,the detailed report of the discussion. It should be clearly understood that it does not constitute an official declaration by the Institute, the rules of which forbid any such action. At the New Haven meeting of February, 1909, a free discussion of the plan of the canal took place, in which the critics of the present scheme had full opportunity to state their views. That discussion was continued at considerable length in the newspapers ; but the Institute was never committed to either side. In this latter instance, the situation is precisely similar. Certain members and guests of the Institute, having had the advantage of later developments and of personal inspection, have expressed the conclusions at which they have arrived on their own responsibility ; and these conclusions are published by the Institute, subject to further discussion, like any other part of its proceedings. The general statement referred to contained a promise that the full discussion, of which it was a result, would be subsequently printed ; and this promise is fulfilled, so far as practicable, in the subjoined report, concerning which I beg to offer the following explanations: 1. It is made up of the remarks of the members of our party, as subsequently written out and mailed to the Secretary. 2. In editing these contributions, I have condensed the material considerably by cutting out much repetition of opinions and phrases ; and in such excision, I, frankly confess, the authors whose communications were delayed, have been the sufferers. Nevertheless, there is a good deal of repetition left, as there must be, when so many persons had talked so much, and come to agreement upon so many points. 3. It has been found impossible to preserve in this report the actual order of the free and informal oral discussion represented. Consequently the several contributions have been arranged in alphabetical order under the names of their authors. These curves embrace a large number of specific gravities, and for each specific gravity the relation of the diameter of the mineral particle to the velocity of its fall in water is given for all diameters and velocities used in practice. The second diagram is an enlargement of the lower left-hand corner of the first, the third bears the same relation to the second, and in like manner the fourth to the third. Hydraulic fracturing methods for production stimulation have become a common procedure in the oil and gas industry. Fracturing treatments are performed on wells of various potentials to help increase the production rate. In addition to the desire for increased production is the need to predict what increase might be expected. This knowledge is useful in economical treatment planning to accomplish the desired production goals for the well. Theoretical production increases due to horizontal radial fractures may be calculated using equations developed from mathematical analyses and electrical models.1,2,6 It also is possible to predict theoretical production increases due to vertical fractures using curves developed from electrical3 and mathematical models.8 However, these studies assumed that the vertical fracture height and the formation height were equal, which may not be true." In addition, the final fracture height through which fluid is produced may not be equal to the created height. The development of vertical fracture proppant transport relationships has made unrealistic the assumption that propped fracture height is equal to created fracture height. Through the use of published proppant transport equations,4'12 it is possible to calculate the height of a bed of propping agent deposited in a fracture of a given height. Assuming that the fluid flowing in the fracture moves through only the propped portion of that fracture (i.e., that the un-propped part of the fracture heals) it becomes essential to know how production increase varies with the ratio of propped fracture height to formation height. It should be recognized that future investigation may determine that the fracture does not heal completely and that a highly permeable channel exists over the deposited bed of proppant. The effect of this channel was not considered for the present study. The following analysis of experimental data allowed development of curves to determine theoretical production increases considering fracture height as a variable. Discussion In designing a fracturing stimulation treatment a number of variables must be considered. The size of the treatment, type of proppant used, proppant concentration, treatment fluid properties and well conditions are all factors affecting the dimensions and permeability of the fracture. Production increase due to a vertical fracture is affected by propped length, height, width and permeability of the fracture for a given set of formation conditions. The following review covers published information on pressing of metal powders at room temperature. Only those operations are considered which occur between the time the powder is filled into the cavity and the compact is ejected from the die. Thus, this review does not concern hot pressing, coining or sizing feed or flow problems, commercial presses nor designs. It was also necessary to disregard to a large extent the effect of pressing on subsequent operations and on properties after sintering. 'The pressing operation is considered independently in its function to compact loose metal powder into useful shapes which can subsequently be handled. There are some comments by the writer in connection with a few of the findings quoted in the literature in order to stimulate thought and discussion. The selection of references quoted in the text is in some cases arbitrary although an attempt was made to favor papers containing novel ideas, techniques or results which mag stimulate future research. In order to enable the reader to check further into the subjects mentioned, the original, rather extensive, bibliography is appended even though not all the references are touched on in the printed version of this review. The equipment used by various workers, for example a die design created by Bridgman,22 is very interesting. 'The die insert has a conical external surface. The vertical pressure exerted on the punch transmits itself to the die which in turn is pushed harder into its tapered retainer. Thus, the higher the pressure exerted on the punch, the higher also the pressure exerted inwards on the die inserts. Inasmuch as this pressure counteracts the internal pressure from the compact the two stresses balance each other so that it is possible to obtain tremendous pressures without breaking the die. The die collar was made from an oil hardening tool steel, heat treated to a tensile strength of some 300,000 psi. The die was closed at the bottom by a plug made from special tool steels. Bridgman found that there is no steel which will withstand a com-pressive stress of 700,000 psi without continuous slow flow or immediate fracture. Therefore, the only material suitable for use in the pressing punch was sintered carbide. In view of the ingenious design it was possible to use special tool steel as die material. Jones22 raises the question whether this method of pressing has practical application in powder metallurgy. Although these tremendous pressures cannot readily be utilized without many special precautions, the tapered die and retainer idea is believed to be useful even for lower pressures. Alaska is a land of immense proportions and resources. Its very name, derived from an Aleut term, means "The Great Land." Yet, in a state slightly larger than Texas, California, and Montana combined, there are presently only two-large scale mines in production, excluding dredge operations. Once referred to by its territorial governor as "a storehouse of minerals," Alaska is, in the opinion of many industry observers, at least 20 years away from a healthy, productive mining industry. The mineral potential of the state is tremendous: coal deposits on the North Slope alone have been hypothetically pegged at 1.5 trillion tons. Copper-zinc deposits on the south flank of the Brooks Range are conservatively estimated to be worth $4 billion to $6 billion. POWDER metallurgy has been established for some time as a novel method for manufacturing a great variety of articles generally specialties that could not be made conveniently by any other method. In this category are such parts as porous hearings cutting tools of sintered carbides, and electrical contacts in which the metallic constituents do not tend to alloy in the proportions employed. The industry, however, is now at a stage where it has begun to manufacture articles that can and have been made by other methods. Thus, powder metallurgy is now preferred technique for the production of numerous machine parts characterized by high strength, accuracy of configuration, and substantial lack of porosity. Manufacture of such machine parts from metal powders has no doubt been stimulated by the war, although the trend in this direction has been apparent for several years. In any case, quantity production of high-density precision pieces by ponder metallurgy is now in full suing in the United States, and such production can and should continue to expand during and after the war.

THE year 1935 is noteworthy for the superior legislative measures passed by several states. Sincere efforts have been made to establish equity between the various producing tracts in oil and gas fields. Outstanding legislative measures include the New Mexico law, known as Senate Bill No. 79, approved on Feb. 23; the Oklahoma law on April 22; the Texas law on April 30; and the Kansas law, which became effective July 1. Primarily designed to prevent waste, but more or less the direct out- growth of the current excess of potential oil and gas production, these statutes fall in the class of "Proration Laws."

In the year 1948, more than ever before, the coal industry established itself on the threshold of a new and exciting future expansion. While production did not equal the wartime and peacetime peaks of 1944 and 1947, it was, in review, a good coal year. During the latter part of the year a combination of mild weather, record stock piling, and general business slackening reduced coal demand to the extent that marginal mines suspended operations, while mines remaining active found it necessary to renew their attention to producing better products at lower operating costs.

ALL live producers and manufacturers of metals and alloys are investigating new uses for their products. The tin and tin-plate industry is no exception. One-third of all the new tin mined and refined is consumed in making tin plate. Several billions of cans are each year made from tin plate for the preservation of nearly 200 kinds of food. There are more than 500 tin-plate mills or individual stacks in the United States, which country makes more tin plate than all other countries combined and exports large quantities. As much as 1,800,000 tons of till plate has been made in a year in this country, and 28.000 tons of tin has been used in this period for this purpose. In sonic years a third of the till is so consumed; in 1933 it was half of the supply.

THE development of the North Lily ground, which lies in the East Tintic district, Utah,. about half a mile northwest of the famous Tintic Standard mine, was undertaken by the International Smelting Co. on purely geological reasoning. The geologic theory on which this work was based resulted from several years' intensive study of the East Tintic district by the geological department of the International Smelt-ing Co., who were, during this period, indebted to many for valuable suggestions that were adopted and became part, of the gradually maturing concept. For example, E. J. Raddatz, president of the Tintic Standard Mining Co., first called attention to the significance of rhyolite alteration; J. W. Wade, assistant manager, contributed greatly to our knowledge of the great Tintic Standard orebodies; and so on all along. the line. In short, the ultimate theory embodies the aggregate experience and thought of all those most familiar with the area in question. The problem in brief was this: is the Tintic Standard deposit an isolated occurrence of ore, or are other ore deposits to be found in the vicinity? If the latter is the case, where can these others be looked for? The difficulty of the problem lay in the fact that most of the area is covered by rhyolite; beneath which lies the limestone in which the orebodies occur; so that the available evidence as to the structure of the formations, and, their mineralization; is of the slightest. The sav-ing features of the case, by means of which it proved possible to solve the problem, are three in number first, the rhyolite is pre-mineral and hence has been exposed to alteration by the mineralizing agencies; second, certain persistent dikes and fissures are con-tinuous through the rhyolite into the limestone below; and third, the extensive underground workings of the Tintic Standard gave a good basis for study of the sub-rhyolite structure and the occurrence of ore. The rhyolite overlies the Tintic Standard orebodies, and over them shows a large patch of brownish altera-tion. This patch proves to be due to chloritization and sericitization, which has spread out from certain zones of dikes, pebble-dikes and fissures. The dikes are com-posed of a light fine-grained rock which has been altered to an aggregate of quartz, alunite, and magnetite. They can be traced southwest to a common center in Big Hill, the entire mass of which is composed of the same material. The pebble-dikes, which consist of a mass of rounded pebbles, mainly quartzite, in a matrix ranging from the same quartz-alunite-magnetite rock as above to almost pure vein quartz, are closely asso-ciated with these light dikes, but in general extend farther northeast. They thus represent a specialized phase of the intrusive action of which Big Hill is the center. The brown chloritized rhyolite, then, is an alteration product due, in all. probability, to emana-tions closely associated with this phase. Since it coin-cides geographically with the Tintic Standard area of highly altered limestone, with its many great ore-bodies, it has been concluded, that it is the expression in the rhyolite of activities which have also altered and mineralized' the underlying limestone.

The role of the precious metals is changing rapidly. They are becoming primarily materials of modern industry, and their decorative and monetary functions are diminishing in relative importance. Certainly gold is still the premier metal for jewelry, as silver is for silverware. But these uses are not growing nearly so fast as are the uses of these metals in a variety of industries. This is even more true of the platinum metals. Moreover, this is true despite the fact that the precious metals are highly expensive and liable to substitution by the base metals in cases where this is feasible. For the fact is that the physical and chemical properties of the precious metals make them relatively invulnerable to substitution; where they can be replaced by the base metals, they have been, and the opportunity for further substitution is, therefore, limited. SILVER In November 1969 the United States Treasury stopped minting the only remaining coin with any silver content. That was the silver-clad Kennedy half dollar, which had a silver content of approximately 40%. The step was taken out of necessity, because of the rising shortfall between world mine production and consumption. It was important to divert the 35 to 40 million oz of silver per year used for the minting of this coin into the open market, where it would be available for industrial consumption. This decision was important, not only for its practical effect but also for what it symbolized. Only four years earlier, in 1965, the Treasury had used 320 million oz of silver" for the full range of coinage. Now not an ounce of silver goes into the United States coinage. The reason is simple and yet complicated. For many years the U.S. Treasury had purchased silver at prices which provided a subsidy to domestic producers. As a result, silver producers were eager to sell to the Treasury, and that agency built up a huge supply of the metal -almost 2 billion oz by- 1961. But, as the free-market price neared $1.29, the basic melt value of the coinage, the Treasury became a seller of silver, not a buyer, and its stock was depleted rapidly. The Treasury lost more :than a billion ounces of silver in the years 1962 through 1965, and it continued to lose silver, both through coinage and through sales to consumers, through 1969. The Government continued to sell silver to consumers at the rate of 1.5 million oz a week, even after terminating the 40% silver Kennedy half dollar. I HAVE been puzzled by two lines of thought'; one emanating from Washington, D. C., to the effect that we must all cheer up, that in a very short time, measured in terms of months, prices would begin to recover, business would become normal, and prosperity would continue on its way just as before the interruption of a year ago; and a second, coming from certain industrialists and economists, expressing fears that all commodity prices were in for a long downward trend, which would cause much unemployment, eventually drag down wages and so restrict purchasing power as to further aggravate the situation. One basis for the fear of a downward trend in commodity prices' is that ifter great wars a depression could last for something like 40 years-the downward trend to such a depression after our recent World War having been postponed for some reason or other; and the basis for another fear was that the production of gold was becoming less. I had 'also been trying for some time past to refresh my recollection as to how my ow11 particular lead interest climbed out of the depression of 1893; and as all the metals have had, and still have. relative values and prices, I can best express what I have in mind by talking principally about lead.

F. C. Bond: This is an outstanding paper on comminution theory and represents a considerable advance in mathematical formulation. It clears the way for a discussion that should ultimately decide whether the work index should be considered as a parameter according to the Third Theory or as a constant. In the empirical differential equation dE = —Cdx/x [1] either Corn must be treated as a variable to satisfy known crushing and grinding conditions. The author has chosen the exponent n as the variable, with C as a constant. According to the Third Theory, in the general case n is a constant equal to 3/2, and C is a variable related to the work index Wi. If x is placed equal to P (the size in microns which 80 pct of the product passes) and F is the size 80 pct of the feed passes, then C equals 5 W1, and dE = 5 -5 Widx/x = 10 Wi 10 Wi w = vP vF which is the basic equation of the Third Theory. It is apparent that this integration involves the error of treating the parameter Wi as a constant, just as the author's treatment involves the error of integrating his variable n as a constant. These errors are probably relatively unimportant, considering the small range of the variables. When more is known about the factors contained in the work index, Eq. 1 can be revised as a partial differential equation. The Third Theory exponent of 1/2, or n = 3/2 in the Charles' differential equation (Eq. l), was not chosen primarily because it is the average between the Kick and Rittinger exponents; this may be merely fortuitous, since it is illogical to define truth as the average between two errors. It was first discovered from the study of a large mass of crushing and grinding data and confirmed by laboratory testing. The general correspondence of the Third Theory equation to actual crushing and grinding results over the entire size reduction range argues strongly that a fundamental phenomenon is involved. The a posteriori theoretical explanation of the constant Third Theory exponent is that the work done in breaking rock is proportional to the length of the crack tips formed. Compressive force applied to the rock results in deformation and strain energy. When this locally exceeds the breaking strength a crack tip forms, the surrounding strain energy flows to the crack tip and extends it to split the rock, with release of the energy as heat. Under rapid impact the crack tip may form before the strain has reached equilibrium, resulting in less energy expenditure and probably a coarser product. In any case, the elastic limit of a brittle material is practically the same as its breaking strength, and the work necessary to form the crack tip is the work required to break. The crack length of a ton of broken rock cannot be measured directly. However, the particle shapes of feed and product are similar, and the crack length is considered equal to the square root of one half of the new surface area formed. It is, therefore, proportional to 1/vD, where D is the equivalent product particle diameter. This is the basis of the Third Theory equation. Many secondary factors can be imposed upon the crack length breakage. These may cause the Third Theory work index to increase or decrease somewhat as the product size becomes finer. The work index is properly a parameter rather than a constant, making it an increasingly valuable practical criterion of the work input required in crushing and grinding.
