PRESIDENT LITTLEJOHN: Before we open the discussion on the Utah mining laws, I want to bring out what I consider a slight misunderstanding on some of the things that I said this forenoon relative to our comparison of accidents. I did not mean to infer that we, as mine officials, are satisfied we have done the best we can to eliminate the accidents, when I was talking about a four-to- one comparison. I do not want any- one to get the idea in their heads that I do not think we are doing all we can. There is not any of us who can state that, even if we better these figures. It is the general understanding that these figures are based upon ratios per thousand man shifts and not upon the tonnage basis that we use. If it were based upon a tonnage basis, I think the figures would be pretty nearly reversed, for we are producing from two to four tons more per man than they do in Great Britain. The discussion will now be continued as I said this morning. There is a gentleman in the audience here that is as guilty of making these laws as I was, and I am quite sure when speaking he will confine himself to the subject of Utah Mining Laws and the prospective results. Before Mr. Monay starts with his paper, I want it understood that this discussion must be finished by 2:30 for the reason that we have still quite a lot of business before us this afternoon.

Dear Mr. Pryde: In accordance with suggestion in your letter to me of June 21, 1923, Mr. Roberts, Mr. Dalrymple and I had a meeting and attached find our contribution to the proposed August report of the Committee on Safety. You will note that we have confined ourselves to matters in connection with explosions and prevention of explosions, in coal mines. If the committee is to report on general safety in coal mines, including accidents from haulage, timbering, rock falls, electricity, etc., we would like to suggest that you ask other members of the committee to specialize on one or more of these subjects. Especially we believe it would be advisable to specialize as to precautions against electrical accidents with giving of data as to maximum voltage, precautions to be taken as to gas ignitions by mining machines at faces, best methods of placing power wires underground, etc.; also give information as to up-to-date safety installations, such as whistle devices notifying of disarrangement of ventilation or devices for quick cutting off of electrical power from mines under certain conditions; also give data as to efficient safety man cars on various pitches, etc. Yours truly, D. Our next speaker this afternoon is a good friend of mine of some years. I must introduce him by way of a little story. Now Harris Sherman, many of you know because he was really in charge of everything to do with the mining industry in the State of Colorado for a good many years. Some of you may know that before he became part of Governor, Lamm's first cabinet as Director of Department of Natural Resources, he was an attorney for the Environmental Defense Fund and that caused me considerable panic as I think it might have caused some of you. I have observed Hams from the time he stepped into that office until he retired from that office to go into private practice as the senior partner of Arnold & Porter's Denver office, one of the , nation's most prestigious law firms. Hams is a Colorado native. He's lived here all of his life. He's a graduate of Columbia Law School for his law degree and a graduate of Colorado College down at the Springs for his BA. He has served in state government, but I thought it might be appropriate, since he is no longer in state government, if we used Harris, today, to tell us from a former state official's perspective what the image is of the coal industry from the seat he held in Governor Lamm's cabinet for a good many years. The twenty-eighth regular meeting of the Rocky Mountain Coal Mining Institute, which was held jointly with the Utah Section of the American Institute of Mining and Metallurgical Engineers, was called to order at eleven o'clock A. M., Monday, March 11, 1929, President Otto Herres presiding. Introductory remarks were made by John M. Boutwell, Chairman of the Utah Section of the American Institute of Mining and Metallurgical Engineers, who outlined the intent and purpose of the joint meeting, and its co-operative program. He spoke of the in- creased recognition being given to men in the engineering profession by the public, which has recently been manifested by the election of President Hoover, an engineer of outstanding ability, and the re-election of Governor Dern to the Governorship of the State of Utah. He then introduced Governor Dern, a fellow member, to make the address of welcome. Governor Dern assured the meeting a hearty welcome. He spoke of Utah as one of the important mining states of the Union, particularly in metal mining; the magnitude of Utah as a coal mining state being limited only by its market; of the enormous coal resources of Utah, and the problems of the coal mining industry.

For several years the C. F. & I. Co. men have been working on a fan signal and many different schemes have been tried. I will describe a few of them. A make-and-break attachment was placed on the fan shaft which caused a light to flicker. A hinged door was placed on air course and counter balanced so that it would have a slight travel when the air pressure was reduced an appreciable amount. This motion was used to open the power circuit, blow a whistle, or ring a bell. Series transformers were placed in motor leads of fan drive motor and the variation in amount of power to motor was used to control the fan signal through a magnet or relay. A governor was placed on the fan shaft which opened a signal circuit when speed of fan was reduced. We tried to produce a machine actuated by the volume of air, (that is on the principle of the anemometer) but had to discard this due to its being too delicate. None of the above schemes seemed to fill the conditions which the State and our Mine Inspector wanted covered. They gave us the following demands for a signal: 1. Must open mine circuit and sound alarm when air pressure was reduced below a certain amount. 2. Must be fool proof. 3. Must work on any kind of fan drive (steam or motor). 4. Must be safe to ' install- in any mine or fan house. 5. Must not depend upon mechanical device which could become inactive due to friction or other causes. 6. Must be as simple and easy to adjust as possible.

The Tuesday morning session of the Rocky Mountain Coal Mining Institute was opened at 9:00 a.m. by Bob von Storch, in the absence of the President. Mr. von Storch appointed the following new members to the Resolution Committee in the absence of three of the members: Albert Keenan, E. S. O'Connor and Howard Crandell. This committee was asked to be ready to report at the Wednesday morning session. Mr. von Storch then introduced Lyman Fearn, State Mine Inspector for the State of Wyoming, who presided over the morning session. Mr. Fearn introduced the first speaker for the morning, Louis A. Engstrom, Engineer at Kemmerer Coal Company, Kemmerer, Wyoming, who delivered a talk illustrated with slides in the absence of Mike Zakotnik, Jr., who was unable to attend. The next paper, "New Horizons -Coal for the Steam Plants of the West," was delivered by Don Newberry, superintendent of the Castle Gate Mine of the Independent Coal and Coke Company, Castle Gate, Utah, in the absence of W. C., who delivered a paper on "A New Era in Labor Relations."

Mr. Pickett's remarks were primarily concerned with the legislative aspects of the coal industry. Mr. Pickett stated that as a result of the 1952 election, only two senators and eleven representatives are now in the legislature who have ever served under a republican administration. He said there are 425 legislative issues now on the floor of Congress concerning the coal industry, but the coal industry has difficulty in legislation, because, although there are 31 coal states, only 11 states produce more than 5,000,000 tons per year, and 11 states produce between 500,000 and 5,000,000 tons of coal a year. In these states there are 44 senators and 195 representatives, less than a majority in either house, if all could be counted on to support the coal industry. An important committee to the coal industry is tile House Ways and Means Committee, composed of 25 members, 15 Republicans and 10 Democrats. Even with the support of the senators and representatives from these 22 states, legislative action is difficult.

MR. MARGOLF: Thank you very, very much Harris. There's sure a lot there to think about in terms, of our image, particularly. I think we should keep' in mind what Harris said about our history not being monolithic. Therefore our image can only be that, which is reflecting the weakest link in our industry and I think that's a burden on all of us. Perhaps to do some policing amongst ourselves to try to improve whatever might be our weakest link and thereby elevate our entire industry. Our third speaker this afternoon is another good friend of mine of long standing and I am very pleased to be able to introduce to the Rocky Mountain Coal Mining Institute Bob Golten. Bob is a graduate of the University of Michigan with a degree in Economics and Harvard Law School. His professional experience encompasses private practice in Chicago where he was born and in the federal government as a public defender in Washington, D.C. and in the Department of Justice as a tax , attorney. Some of us have come to know Bob more in his present role as the senior counsel for the I National Wildlife Federation. He's also Adjoint Professor of Law and Director of the National Wildlife Federation Resource Clinic, University of Colorado. Boulder campus. In addition, Bob has served with the Rocky Mountain Center on Environment as one of its directors for a number of years. He's very active in a number of areas that are not only civic but he does reflect what I would present by way of introduction as a perspective

To make the statement that coal mine operation has been entirely revolutionized within the last ten years is a mild statement. This has been entirely due, of course, to the almost universal introduction of mechanical loading in coal mines. Under the old system of contract loading too much was left to the individual miner's judgment and willingness to do the right thing. Each miner regarded the place in which he worked as "his place," and depending upon the judgment and ability of the miner, conditions as found in these places largely reflected that man's individuality or personality. Many men kept their places well timbered and in such condition that they were not only able to load their turn but were able to take advantage of any surplus cars that might be available in their particular entry. These men were often regarded as "coal hogs." However, these men's places were usually found to be well timbered and well maintained. Supervision under this old system in a strict sense of the word amounted to casual visits to the man's working place by the foreman or his assistant once each day as required by law.

The 69th Regular Meeting of the Rocky Mountain Coal Mining Institute convened in Manor Vail Lodge, Vail, Colorado, and was in session at 10:00 a.m. The meeting was called to order by Past President Joseph E. Ward, former District Manager, Denver Office, Coal Division, Joy Manufacturing Co. and now retired. Mr. Ward, after reading a brief biography of President O. F. "Os" Lewis, introduced him to the assembly. Biographical sketch read as follows: Mr. Lewis is President, General Manager, and a Director of Colowyo Coal Company. "Os" was born in Reno, Nevada. He attended the University of Utah at Salt Lake City, Utah, and later the Denver University in Denver, Colorado. His career in the Western Coal Industry started back in 1923 when he was employed by the Central Coal and Coke Company of Salt Lake City, Utah, as a clerk, then chief clerk and as a traveling sales representative for a period of 13 years. Later, in 1936, when that company was acquired by an affiliated company of Harris Coal Company, he was transferred to Denver as Assistant Sales Manager, Purchasing Agent and later as Executive Assistant to the President.

MR. GIBSON (continuing): In connection with the coal from this mine, I will say that it is not a very dirty coal. The vein where most of the coal comes from is about eight feet thick, and two feet from the bottom there is a small boney band about two inches thick. The breaking shot has to be placed over the, band, therefore breaking the boney into fine particles which goes off with the slack. This coal is a very good domestic coal and the slack is in great demand for various power, plants, such as sugar plants, smelters and other industries, but where this, boney is broken up and goes into the slack, it is very injurious in effect and retards the sale of the slack. Therefore the Spring Canyon Coal Company went to the expense of' building this plant, costing over $250,000, just in order to get that, two inches of boney coal out of the rest of the vein. The market in, Utah is very critical, and in order to sell coal, the product must be thoroughly clean in every way and, as Mr. Murphy says, I believe they have succeeded in making a very good commercial product. In any event the Spring Canyon Coal Company put out more coal than any other one mine during the last year, 1924, they had the largest production. I thank, you. (Applause). All low cost coal has been mined. Engineers are searching for a safe and effective way to mine coal seams' deep within the earth. The most modern of these is the RL, an acronym for Robotic Labor. Mining robots are programmed to do specific jobs but can think on their own during an emergency. MR's, or mining robots, usually have a same basic shape. A torso is mounted on treads. Designers chose treads because it gives the robot a great deal of mobility. The torso has two arms. One arm is equipped with a human hand. The other has a human-like hand. Mining is done underground. A small robot goes around punching holes in the coal. A small charge is inserted in the hole. The MR ignites the charge with his laser. It explodes after three minutes. The MR returns to the station where his battery is recharged. Mobile cement barricades are moved between the blasting area and other working MR's. After the charge explodes the barricades are moved to another area. The MR returns and cuts the coal chunks into pieces. Another robot comes and loads the coal and carries it to the loading bin. From there it is taken to the surface where it is weighed and shipped. The whole process was done by robots. Humans just supervise but help in an emergency or malfunction.
