Under the United Nations Convention on the Law of the Sea (UNCLOS), the international seabed area (Area) and its resources are the common heritage of humanity (CHH). Patent rights can be incompatible with the CHH doctrine and its underlying principles because patent holders might charge unjustifiably high prices to license patented technology for exploring and exploiting the Area’s resources (creating a "patent holdup" situation), might choose not to license, or might license exclusively when doing so would contravene CHH principles. However, a reasonable patent licensing regime can contribute to sharing the benefits derived from the Area and promote environmental sustainability. Provisions of the UNCLOS that stipulated compulsory technology and financial transfers were removed in the 1994 Agreement relating to the Implementation of Part XI of the UNCLOS but to promote equity and sustainability I propose a voluntary licensing regime modeled on the concept of reasonable and non-discriminatory patent licensing that has been used in other contexts. The International Seabed Authority or another entity will need to coordinate and promote this licensing regime through governance of intellectual property derived from the Area. This proposed approach can better effectuate the CHH doctrine and its underlying principles.

The mining industry has had three difficult years. Commodity prices have remained low and investor confidence in the industry has been shaken. And even though the Asian economy appears to be improving, it will be some time before this improvement will translate into better commodity price conditions for mining. In addition, increased environmental and social restrictions that have been placed on the industry in developed and developing countries have made mining a more difficult proposition. And, if that is not enough, the global mining industry has found itself in fierce competition with Internet businesses for investor capital. Despite that gloomy picture, more than 10,500 mining industry professionals from about 70 countries gathered in Toronto, Ontario March 5-10, 2000 for the Mining Millennium 2000 conference. This meeting was a joint effort between the Canadian Institute of Mining, Metallurgy and Petroleum(CIM) and the Prospectors and Developers Association of Canada (PDAC).The joint meeting also featured two trade exhibitions and more than 150speakers. PDAC’s trade show attracted about 400 exhibitors and an additional 200 in the concurrent Investors’ Exchange. CIM’s exhibition attracted about 600 equipment and service companies.

Although primarily cut-and-cover excavations are required for replacement of the existing elevated I-93 interstate highway through the heart of Boston for the Central Artery/Tunnel (CA/T) project, some mined tunnel construction was also undertaken. The mined tunneling conducted was the 22-m-wide northbound roadway structure which passed below a 20-m-deep operating underground subway station that was built in 1913. The innovative underpinning scheme used to support the subway station during construction resulted in the successful mining beneath the subway station with negligible vertical settlement. Two grouting galleries were carefully mined below the subway structure, and pre-grouting of the granulary, pervious glacial soils and weathered bedrock was carried out from these galleries. The reinforced concrete walls of the underpinning structure were constructed within three stacked drifts that were sequentially mined below each grouting gallery. After 11 cross adits were mined between the grouting galleries, cast-in-place post-tensioned girders that spanned between the stacked-drift walls were constructed to support the subway station. The stacked-drift walls also provided lateral support for the 22-m wide by 29-m long by13-m high opening beneath the girders.

LKAB’s Kiruna Mine, located in northern Sweden, produces about 24 Mton of iron ore yearly using sublevel caving. For efficiency, the mine must deliver planned quantities of three ore products. We use mixed integer programming to schedule Kiruna’s operations, specifically, which production blocks should be mined, and when they should be mined to minimize deviations from planned production quantities while adhering to mining restrictions (e.g., sequencing). A new production block database and a well-formulated mixed integer programming model dramatically reduce the size of the original problem; in less than ten minutes we generate five-year schedules with time fidelity of months.

Barrick Goldstrike’s (Goldstrike) AA Heap Leach Pad is an HDPE lined facility used for gold recovery from low grade ores using conventional cyanide heap leach technology, operated from 1987 through 1999. Goldstrike prepared a unique reclamation plan for the AA Leach Pad Facility to provide for a cost-effective, environmentally sound facility closure and to fulfill the State of Nevada’s closure requirements. Traditional Nevada leach pad closure has involved rinsing to reduce cyanide concentration to an acceptable level, followed by reclamation. However, certain metals and compounds are not typically reduced by rinsing and some constituents may increase in concentration with rinsing. A closure scenario to effect limited infiltration through installation of a capillary cover for the leach pad was developed. The capillary cover was constructed by placing a fine-grained layer above the coarse-grained spent leach material to create a capillary break. In an arid climate such as Nevada, the fine-grained layer will rarely reach full saturation and the cover will be able to store water during precipitation and allow removal of water through evaporation and transpiration (ET) during the growing season. A 1.22 m (4 ft) cover thickness was selected as the optimum design cover thickness. The drainage network on the surface of the re-contoured AA Heap Leach Pad was specifically designed to enhance the revegetation, reclamation, and sediment yield control aspects of the AA Heap Leach Pad closure, while resulting in a natural looking surface, compatible with the surrounding topography. Adjacent natural topographic features were used to establish target design parameters for re-contouring and erosion control design.

In the world of tunneling the glamour is in the large diameter, long tunnels, but perhaps the number of projects for small diameter and short length tunnels are greater and generally have higher risk factors. Reasons for these higher risks include both the ?boiler plate? contract provisions used on these types of contracts, the technical specifications related to the tunnel work (versus the pipeline construction), the bid practices including measurement and payment and the construction. This paper reviews and comments on some of the key issues the authors have observed in recent major pipe-line projects that involve a small percentage of tunneling footage of the total contract.

Experimental animal studies comparing asbestos and non-asbestos varieties of tremolite indicate tremolite asbestos is markedly more carcinogenic. By direct analogy, the differences in carcinogenicity between tremolite asbestos and non-asbestos prismatic tremolite should be the same for the other types of amphibole that also crystallize in the asbestos and non-asbestos habits. The earliest of the experiment animal studies, done more than 25 years ago, have design limitations by modern standards including the use of injection or surgical implantation as the route of administration rather than the more relevant route of inhalation. However, the differences in the carcinogenicity of amphibole asbestos and non-asbestos amphiboles are sufficiently large to be clearly discernable even with the study limitations. Together with later studies on these and related minerals, there is strong evidence of a much lower hazard associated with the shorter, thicker fibers of the non-asbestos amphiboles, than is found for the asbestos analogues of the same mineral. It is possible that the non-asbestos amphiboles are no more hazardous than other silicate minerals widely considered nuisance dusts. © 2007 Elsevier Inc. All rights reserved. Frictional ignitions (also called face ignitions) is defined as the rapid oxidation of a mixture of methane and air with a visible flame that could last from a few seconds to several minutes. These ignitions have a potential to turn into a mine explosion and eventually a large-scale mine fire. Over the last 22 years, U.S. coalmines have had 1566 frictional ignitions. There were no fatalities but serious injuries have occurred. Every effort, therefore, should be made to prevent frictional ignitions. The preventative measures fall under four categories: (a) degasification of coal seams prior to mining, (b) adequate ventilation, (c) wet cutting or water-jet assisted cutting and (d) machine design to minimize ignitions. The paper discusses each of these techniques in detail.

The Gumuskoy silver mine, owned by the Etibank, in the province of Kutahya, Turkey, has been operating since 1987 with primary, secondary and tertiary crushers, and two parallel single stage ball mill circuits. Continuing problems with crushing and feeding of the ore to the ball mills, because of the moisture retaining and sticky nature of the ore, prompted an investigation into the possibility of converting the grinding circuit to an autogenous or semiautogenous grinding circuit. This would remove the bottleneck associated with the secondary and tertiary crushing. At the same time the target feedrate is to be raised from 140 t/h to 175 t/h. This paper demonstrates the response of five ore types, and blends of ore types in an onsite pilot plant test program, and also suggests how the variations can be handled in a SAG mill/ball mill circuit incorporating just one of the present ball mills.

Since 1928, nearly 64 km (40 mi) of tunnel have been excavated within the relatively soft Cooper Group, more commonly known as the “Cooper Marl,” for water supply and transporting wastewater in the Charleston area. The majority of these tunnels are unlined and still in operation, while others collapsed shortly after excavating. Tunnel behavior and support requirements vary considerably in this material due to differences in geotechnical properties. The 4.8 km (3 mi) long, 2.4 m (8 ft) diameter Bushy Park Water Tunnel, completed in 1997 for Charleston’s Commissioners of Public Works(CPW), required no ground support. By comparison, the 1.6 km (1 mi) long, 2.4 m (8 ft)diameter Harbor Wastewater Replacement Tunnel now under construction needs continuous support close to the advancing face, despite being located in the same geological formation. Case histories and general guidelines for designing tunnels in the Cooper Marl are presented.

Increasingly new interceptors or new Combined Sewer Overflow (CSO) projects require connections to existing tunnels. More often than not, the existing facilities are old, in poor or questionable conditions, without proper construction records or as-built drawings. Many cannot be easily inspected unless major construction effort provides flow by-pass for safe access. This paper provides general guidelines on how to approach the problem of assessing the condition of old tunnels, how to plan and design the connection with limited physical assessment, how to develop the scope of work for the bid documents and how to provide geotechnical guidelines and designs for the bid documents.

The Bureau of Mines, in cooperation with the Illinois Mine Subsidence Insurance Fund, is monitoring the response of two foundations to ground movements induced by subsidence from high extraction mining in southern Illinois. The objectives of the monitoring program are to study the inter- action between the ground surface and a foundation during a subsidence event and to determine the capability of the tiltmeter to detect and monitor subsidence movements. Tiltmeter data were obtained on two foundations constructed near Sesser, IL. One of the 30-by 40- ft foundations was constructed with a typical poured concrete footing, the other with a rein- forced-concrete footing poured on top of pol yethylene sheeting placed over a compacted layer of sand. Soil-filled bins were placed on the perimeters of both foundations to simulate superstructure loads. Monitoring pins and tiltplates were installed on the corners and midpoints of the footing. Additional survey points were established on the five-acre site to track the mining advance. This paper describes the monitoring instrumentation and techniques as they relate to the mining and site conditions. The capability of a tilt- meter to detect and follow the tilt of the foundations is demonstrated.

Carbonaceous gold ores containing gold dispersed in sulfides are refractory to cyanidation because: (1 ) the carbonaceous materials adsorb gold during cyanidation; (2) a portion of the gold s so finely dispersed in the sulfide mineral lattice as to preclude contact with cyanide solution; and (3) a portion of the gold is chemically combined with carbonaceous material. Techniques which have been used to treat these ores are: (1) roasting or chemical oxidation to decompose sulfide and carbonaceous materials; (2) flotation to reject carbon; (3) the use of kerosene or other reagents to passivate the adsorptive carbon compounds; (4) carbon or resin in pulp; (5) flotation of a bulk concentrate which is treated by one of the above methods; and (6) the use of chelating agents which have a stronger affinity for gold than the activated carbon in the ore.

Increased TBM performance is leading the way for resurgence in tunneling activity in NYC. Tunnels will be excavated in the same geologic formations as previously excavated D&B tunnels whose construction records are providing valuable insight into the prediction of rock mass behavior. This report compares an eight mile stretch of NYC Water Tunnel #2 with the recently excavated eleven mile stretch of the TBM driven Water Tunnel #3. Comparisons of the type and amount of rock support installed as well as water inflows and grout quantities are made. Rock mass characteristics specific to TBM performance are also evaluated.

Reverse osmosis (RO) and nanofiltration (NF) are widely regarded as being best available technologies (BATs) for removing contaminants of concern from water. In recent years, NF or RO treatment has increasingly gained more acceptance in the mining industry for treating mine water to remove a wide assortment of contaminants, either for meeting discharge standards or for internal re-use in mining processes. Consequently, the number of NF or RO membrane mine water treatment facilities has steadily increased. Although NF or RO membrane filtration can be a powerful tool in mine water treatment, especially when multiple contaminant removal is required, it also has many potential disadvantages. Besides the generally higher capital and operational costs for the high pressure membrane processes, organic constituents in mine water may foul the membranes, while inorganic compounds such as gypsum, calcite, or silica are liable to scale the expensive membranes if proper pre-treatment processes are not implemented. Additionally, because these membrane treatment processes generate a substantial reject or brine waste stream in addition to the clean treated water or permeate stream, brine management also needs to be considered carefully when deciding upon the viability of an NF or RO mine water treatment process. Because of these issues, it is important to conduct detailed analyses of the trade-off between selecting NF or RO vs. using chemical treatment processes when designing a mine water treatment facility.

The Devil?s Slide portion of Highway 1 between Pacifica and Montara is often closed due to the instability of the adjacent slopes. Following many years of public input and careful evaluation of alternatives, Devil?s Slide will be by-passed via two inland tunnels, providing a safe, dependable highway between Pacifica and Montara. For the twin tunnels, each 9m diameter tube will accommodate only one traffic lane. Each tunnel tube will accommodate a 3.6 meter roadway, 0.6 meter and 2.4 meter inside and outside shoulders respectively, and 1.2 meter walkways on each side. Cross passages will connect the bores at about 120 meter intervals and jet fans will provide tunnel ventilation. The twin tunnels are approximately 1,250 meter long and 9 meter wide. Excavation will progress from south to north using tunneling techniques that rely on inherent rock strength for support known as the New Austrian Tunneling Method (NATM). Both tunnels will be excavated at the same time, one tunnel face approximately 40 meters ahead of the other. Staggering the tunnels reduces the likelihood of damage from blasting in alternate tunnels. The work schedule is 24 hours a day, 7 days a week resulting in a 24-month timetable to break through to the north portal.

The Gualcamayo Mine is located in the Andes Mountains north of San Juan, Argentina (Figure 1). A property of Yamana Gold Inc, it declared commercial production in July 2009 and has a total mineral reserve and resource base of approximately 88,000 kg of gold. Crushing operations for the open-pit mine are located in a 13,500 m3 underground cavern with a ceiling height of 22 m. More than 3,600 m of tunnels are used to access the cavern and convey the ore. The Project as described in this paper relates to the design and construction of the Main Cavern, Conveyor System Exit Tunnel, the Mechanical System Access Tunnels, and two 4.20 m diameter shafts (Ore Pass #1 and Ore Pass #2) as shown in Figure 2. [ ] Preliminary engineering for the Project was performed by Hatch Chile. Rizzo Associates Argentina, S.A., a division of Paul C. Rizzo Associates, Inc (Rizzo) was contracted to provide geomechanical and geotechnical support for the construction of the access tunnel system and geomechanical design and construction supervision for the cavern and shafts.

Supply and Demand After a dismal first half, the industry saw a marked improvement in its markets during the final six months of 1983. Domestic consumption was 17.6% higher in the second half of the year, primarily due to a surge in electric power requirements. The sharp increase in demand for electric power during the third and fourth quarters afforded utilities the opportunity to lower stocks that had accumulated to record levels during 1982. Consumer stocks were reduced from 179 Mt (197 million st) at the end of June to 153 Mt (169 million st) by the end of the year. That is the largest inventory drawdown on record during a six-month period without a major coal strike. Despite the huge depletion in inventories, coal production in the second half of 1983 rose 1.3% above output in the second half of 1982. However, because of the disappointing first half, production in 1983 totaled only 712 Mt (785 million st), 6.4% less than the 760 Mt (838 million st) produced in 1982. Demand The extent to which the economic recovery affected coal markets in 1983 varied: • total domestic coal consumption increased 4.2%; • electric utility coal consumption increased 5.3%; • exports declined by about one-fourth; • coal consumption at coke plants declined 9.5%; and • coal consumption in the other industrial sectors increased 2.9%. Domestic coal consumption totaled 667 Mt (737 million st) it 1983, 27 Mt (30 million st) more than 1982. Electric utility consumption increased from 539 M1 (594 million st) in 1982 to 567 M1 (625 million st) in 1983. Coal consumption at coke plants declined from 37 Mt (41 million st) to 34 M1 (37 million st). Residential and commercial use increased 181 kt (200,000 st) - from 7.4 to 7.6 Mt (8.2 to 8.4 million st). Electric Utilities: Electric power generation increased 3.1% in 1983. Demand for electric power increased in all major consumer categories. Residential and commercial use rose 2.7% and 3.3%, respectively. The most striking increase, however, and indicative of the economy's strong upturn, was the increase in industrial electric power use. Industrial power requirements, which declined 9.8% in 1982, rose 4.1% in 1983. The challenge of managing geological uncertainty in mine planning is central to optimizing resource extraction while minimizing risks and costs. This paper introduces a novel approach to coal mine planning by integrating chance-constrained programming to address the uncertainty inherent in mining operations. The main takeaway from this work is the demonstration that focusing on reducing the variance of high-quality coal blocks, rather than low-quality ones, can lead to better blending outcomes, higher profitability and more efficient resource utilization. The study presents a case study of a coal mining operation, using chance-constrained programming to manage the uncertainty surrounding coal property predictions, specifically the predicted coke strength after reaction (CSR).

The perlite industry in the United States continued to undergo rapid change and increased competition last year as it did in 2002. U.S. production in 2004 was 510 kt (562,000 st),an increase following five consecutive years of decline (Table 1). Perlite is exported to Canada and to the Pacific Rim. These partially offset imports. Perlite imports from Greece to the eastern and Gulf Coasts of the United States declined by about 22 percent after reaching a record 240 kt (264,000 st) in 2003.But their market remains protected by high rail rates from western U.S. plants. Minor imports of perlite persist by Termolita from Mexico.
