As set forth in the decision of the Trail Smelter Arbitral Tribunal, dated April 16, 1938 This Tribunal is constituted under and its powers are derived from and limited by the convention between the United States of America and the Dominion of Canada signed at Ottawa, April 15, 1935, duly ratified by the two parties and ratification exchanged at Ottawa, August 3, 1935 (hereinafter termed "the Convention") . . . The duty imposed upon the Tribunal by the Convention was to "finally decide" the following questions: (1) Whether damage caused by the Trail Smelter in the State of Washington has occurred since the first day of January 1932, and, if so, what indemnity should be paid therefor? (2) In the event of the answer to the first part of the preceding Question being in the affirmative, whether the Trail Smelter should be required to refrain from causing damage in the State of Washington in the future and, if so, to what extent? (3) In the light of the answer to the preceding Question, what measures or regime, if any, should be adopted or maintained by the Trail Smelter? (4) What indemnity or compensation, if any, should be paid on account of any decision or decisions rendered by the Tribunal pursuant to the next two preceding Questions? In this decision reported to the Government of the United States of America and to the Government of the Dominion of Canada, the Tribunal answered the first question in its entirety and reserved decision on the other three questions in accordance with the following extract from their decision

In coal mines equipped with electrically driven mechanical mining equipment, the problem of protection for electrical circuits and machinery important, because the hazards of fires and explosions resulting from electrical failures is greater than in most other industries. There is need for better methods and improved protective devices for this service. Studies and tests designed to determine possible value of the short-circuiting contactor as an electrical device for coal mine service were investigated. Preliminary made to determine the operating characteristics of the device, after which tests were made under actual service in three coal mines. Ordinarily, electrical protection in coal mines is divided into three classes, as follows: 1. Overload protection that is intended to protect against damage from overheating and excessive mechanical strain due to overloading. 2. Short-circuit protection that provides a means of de-energizing the equipment instantly when an accidental short circuit occurs in the equipment or on the power system. Short cm protection tends to damage from fires and, explosions resulting in the dissipation of large amounts of electrical energy in a short circuit. 3. Ground fault protection that, in its various forms, is intended, to maintain the frames of electrical equipment at or near the same potential surfaces in contact with the earth for the purpose of safe-guarding human life.

The computer program, HYBMODE, has been developed to meet the need for a fast and economical method for clustering data points on the sphere. The algorithm used in this development is an extension of D. Wishart's one-level mode analysis. The program can be used to cluster either vectorial or axial data; it is currently being used by the Bureau of Mines to cluster fracture orientations.

(Cleveland Meeting, October, 1912.) IN, August, 1911, I read a paper before the Lake Superior Mining Institute' on surveying and sampling diamond-drill holes. The present paper gives a more thorough description of these methods, together with a few changes and notes suggested by further experience. Since August, 1911, the methods, used constantly by the Cleveland-Cliffs Iron Co., have been developed to a higher degree of efficiency, and have given great satisfaction. Until a few years ago but little attention was paid to the determination of the actual course of drill-holes, to the accurate sampling and analysis of the material, or to the scientific location of the drill-holes. It has now been common practice for several years in many districts to test the inclination of drill-holes by etching glass tubes with hydrofluoric acid, but the direction of deviation from the vertical has not often been determined. Methods of determining the direction by means of a compass were first developed in connection with drilling in Victoria. The latest method used on the Rand in South Africa has been recently described by John I. Hoffman.2 In the same paper Mr. Hoffman describes an ingenious method of wedging-off a drill-bole so as to start new holes at several successive points. By this means a hole can be deflected in any desired direction, and the curvature can be controlled to a considerable extent, provided the rock is soft enough to permit the hole to be wedged off. Unfortunately, in the Lake Superior district, the jasper iron-formation is so hard that it is very difficult, if not impossible, to do this. 1. Domestic Production and Use: In 1974 twelve companies operated 31 primary aluminum reduction plants, three firms accounting for 64% of production. Washington, Oregon, and Montana accounted for 32% of the total production; Gulf Coast States, 24%; Northern States, 33%, and other Southern States 11%. Output of primary metal in 1974 was valued at $3.4 billion. About 80% of the secondary recovery was from new aluminum base scrap and 20% was from old scrap. Aluminum consumption by 25,000 firms was centered in the East Central United States. Of aluminum consuming industries in 1974, building accounted for about 27%; transportation 19%; electrical, 13%; packaging, 15%; and consumer durab1es, 9%.

This report has been prepared, not only for the purpose of recording the results of the first series of coal-dust tests conducted in the experimental mine of the Bureau of Mines, but also to place before the mining public a description of the mine and an account of the objects sought in its establishment. Soon after the organization of the technologic branch of the United States Geological Survey, J. A. Holmes, then chief of the branch, concluded that for the solution of various problems relating to the causes and prevention of mine explosions it would be best to carry on large-scale tests in a mine rather than in a surface gallery. The idea of utilizing the underground passage of a mine for making explosion experiments did not at' first meet with general approval among investigators in this country or abroad. Many thought a mine passage was not a proper place in which scientific tests could be conducted, as great difficulty in controlling conditions was expected. However, after all arguments for and against such an investigation had been carefully considered, plans for opening an experimental mine were definitely adopted by the Bureau of Mines in 1910, and an allotment of funds was made to carry out the project. The first endeavor was to find an existing mine suitable for the purpose, but the mines offered by owners were either worked out, were wet, had poor roofs, or presented complications of various kinds, so that it was finally decided to open a mine if a site could be obtained having natural conditions that would fill the various requirements. A most desirable location was found on property of the Pittsburgh Coal Co., near Bruceton, Pa. The president of this company, Mr. W. K. Field, the general manager, Mr. G. W. MUCH has been said in print, and much more that was unprintable, about burdensome controls, taxation, and multiplying restrictive, regulatory, or taxing activities of the Federal Government, but not so much has been said about ways and means whereby the Government can and does render economic assistance. Economics has been defined as the study of men earning a living, and economic assistance to industry as well as to individuals properly should take the form of helping enterprisers to help themselves rather than charity. Proposals to have the Government play Santa Claus must be examined carefully if -only to avoid undue favoritism to politically important persons and downright venality by potentially crooked public officials. Thomas Jefferson is credited with the remark that the best government is the one which governs least. Paternalism is abhorrent to most Americans.

Decision theory is the formal theory of the logic of decisions in view of the decision maker's objectives, preferences, I beliefs, and available information, It usually deals with weighty economic problems involving irrevocable (or costly to reverse) decisions. Capital investment planning problems constitute an instance par excellence for application of the decision theory concepts. Decision theory as it is presently conceived has evolved in recent years. At first it concentrated on decisions in the face of total lack of information and on games with intelligent adversaries. The results of these efforts proved theoretically interesting, but practically of little applicability. In the last few years, stress has shifted to the introduction of subjective probabilities and preferences, and the results have been eminently successful in applications both in government and with- in business firms in the resolution of complex problems.

Law of the Sea. - The Ninth Session of the Law of the Sea Conference resumed July 28 at Geneva and will run for 5 weeks. The 160-nation Conference began in 1973. Two of the major factors to be discussed are the transfer of technology to the UN-controlled Enterprise or mining authority, and how the 36-member Council will make decisions. As the session completed its third week, delegates expressed little hope of completing a treaty text this year. There was a feeling, though, that substantive issues might be settled so that a treaty text can be completed next year. The Deep Seabed Hard Mineral Resources Act signed by the President on June 28, provides an interim regulatory procedure for ocean mining activities conducted by U.S. nationals that may be superseded by a law of the sea treaty.

The extremely cold weather and heavy snowstorms of January and February in northeastern Pennsylvania--with frozen mining equipment, diminished preparation and lack of railroad cars--severely hampered the production and distribution of anthracite. As a result, the previous estimates for the 2 months have been revised. On March 1, 1977, at the Porter Tunnel of the Kocher Coal Company at Tower City, Pa., an underground flash flood, which apparently broke through the wall of an adjoining abandoned shaft, swept through the mine. As of March 9, 1977, four miners were reported killed, three injured, and five trapped in the wreckage. The Kocher Coal Company began operations at the Porter Tunnel in 1968 and has had no fatalities until this current tragedy. The mine employs 20 persons on the surface and 115 miners underground, producing 750 tons of coal per day. Of the 109 underground mining operations in the anthracite region, this is the one remaining large mine that employs over 100 men.

On November 9, the Reynolds Metals Company cut production by 12 at its primary aluminum smelters at Troutdale, Oreg., and Longview, Wash., as a result of an earlier 25% power cutback by the Bonneville Power Administration due to lower than normal stream flow in September, the Aluminum Company of America had closed one potline at its Vancouver smelter because of the power cutback. Nearly 700 union workers at Anaconda Aluminum Company's primary aluminum smelter at Sebree, Ky., walked off the job when their contract expired or, November 15, after rejecting a proposed 3-year contract. The smelter has an annual capacity of 180,000 tons mid accounts for 50% of Anaconda's aluminum production. No talks are scheduled.

Abstract - The basis of the tomographic velocity imaging technique is briefly described and an application of the method to detect and image a cross-section through a chromite pod is presented. Using the chromite application as an example, the relative costs of tomographic data acquisition and processing are compared with those of diamond drilling to obtain similar resolution. A number of different tomographic survey configurations and the potential role of the method in surface and underground exploration are discussed.

EDWARD COOPER, was born in New York City, October 26, 1824. His father, Peter Cooper, to say nothing of manifold reasons for fame as an inventor and philanthropist, deserves to be remembered as a pioneer in the establishment of public schools; and it is not surprising that he sent his son to one of the democratic institutions in which he was himself so ardently interested. From the public school Edward Cooper went to Columbia. College, where he made the acquaintance of Abram S. Hewitt, who was first his tutor, afterwards his traveling companion, brother-in-law, business partner and life-long friend.* For twenty years I was the consulting engineer of the firm of Cooper & Hewitt, and also connected with the work of the Cooper Union, in which they were both deeply interested and faithfully active. On the basis of the intimate knowledge thus gained, I venture an estimate of Edward Cooper's character and career which, if not fully comprehensive, may facilitate a juster estimate than would be reached by the strident of those data which the modesty of the man permitted to be placed upon public record. Edward Cooper's mind was one of the most active, accurate and subtle with which I have ever come into contact: He had inherited from his father a sunny, benevolent temperament, and' the irresistible impulse to attack all new problems which challenged his attention. His thorough education had 'indeed made him wiser than his father, both in philanthropy and in technical inventions. He could condemn and reject a proposition which Peter Cooper would have embraced, in a splendid, though ignorant, faith that nothing was impossible to an. American, and that the word ? impossible " was simply a label,

ALTHOUGH the midday lunches of business associations have been re-echoing the phrases that re- search would lead us out of the depression and that the last place to economize is on research, nevertheless most executives apparently concluded that it was their neighbor who ought not to economize in research, and that in their own plants what had been discovered in 1929-30 was sufficient to lead them out of the wilderness. At any rate, I have discovered much less that seems worth noting, and compared with 1931, the report volume of the committee members is off about 40 per cent, and compared with 1929, about 80 per cent. Evidently there is some hookup with the +tee1 industry as to output, and the Report Reading Committee should investigate this and the relative use of commas and periods.

THE statisticians had defeated Germany months before she invaded Poland. With batteries of adding machines they had proved that she was suffering from serious deficiencies in critical food- stuffs and in practically all of the raw materials necessary for the conduct of modern warfare. Their calculations showed that with respect to fats, oils, wool, cotton, hides, petroleum, iron, copper and other metals, the Reich was bound to be at a great disadvantage vis-a-vis the French and British as long as the latter could keep open the lines of sea communication. The conclusion seemed obvious-"Germany can't win." The more cautious of the commentators introduced qualifications as to the length of the war and the tightness of the British and French blockade. They also made a third qualification as to the character of the struggle- whether it was to be a war of attrition or a war of movement. But since the invasion of Norway in April, there is no longer any doubt on this score. It is a war of movement-a war in which fuel, lubricants, and metals are being consumed on a scale never before seen.

THIS paper presents in an abbreviated form the chief points of interest in an investigation of the tarnish-resistant qualities of silver alloys, an investigation which has been carried out as a joint research by the Bureau of Mines and the Bureau of Standards and will later be reported in detail in an official publication from these bureaus. In 1923 a Commission of Gold and Silver Inquiry was created by a Resolution of the U. S. Senate to study the causes of the depressed condition of the gold and silver industry. In cooperation with this commission the Bureau of Mines made a preliminary survey to determine in what ways, if any, it might be possible to increase the uses of silver. One of the possibilities indicated by this survey was the development of silver alloys which should be non-tarnishing, or at least less-tarnishing, than the usual sterling silver (copper-silver). The preparation of a rather wide variety of silver alloys and the determination of their behavior under accelerated tarnish tests in the laboratory was therefore undertaken by the Bureau of Mines and Bureau of Standards as a joint investigation.
