?Twowinters ago, what had been a mediocre safety record at West Virginia?s Sago Mine grew dramatically worse. Over 23 months beginning in February 2004, two dozen miners were hurt in a string of accidents, some of them caused by rock chunks falling from the mine ceiling. Federal safety inspectors slapped the mine with citations 273 times, or an average of once every 2 ½ days. Despite this record, the price paid by Sago?s operators was light. Government regulators never publicly discussed shutting down themine and never sought criminal sanctions. The biggest single fine was $440, about 0.0004 percent of the $110 million net profit reported last year by the mine?s current owner.? -Washington Post, January 8, 2006

The Primero mine, operated by the Colorado Fuel & Iron Company, is located 17 miles west of Trinidad, Colorado, in Las Animas County. Unusually bad roof conditions, along with heavy side pressure and other conditions causing rapid decay of timbers, all combine to create a very serious timbering problem. The height of the coal averages six feet six inches. It is a heavy coking coal and has a tendency to become easily crushed and broken down in the seam. The seam lies about 35 feet below the sandstone and the intervening formation is composed of loose shaly rock, and as the coal is extracted, the air slackens this rock to such an extent that within 24 hours, roof falls varying from five to fifteen feet in height are likely to occur. Under these conditions it is necessary to use cross bar sets in both rooms and entries, and they must be spaced no further apart than three and one-half foot centers, and be maintained within a distance of three feet of the face. Rooms are spaced on fifty footcenters, and cannot with safety be driven to exceed 14 feet in width, and 200 feet in length. The large pillar must be maintained to protect from side pressure, and the rooms must be driven up and retreated with as quickly as possible to avoid the squeeze caused by the intense side and roof pressure. Best results in extraction have been obtained by driving rooms for only a distance of 150 feet. Under these circumstances, it is readily seen that timbers of small diameters cannot be utilized in timbering any development work of a permanent nature. Entries are driven nine feet wide, and special peeled piling with an average diameter of 12 inches are most commonly used. It, is necessary to use lagging between each set of crossbars . Conditions such as these necessitated an immense expenditure for mine timber. In addition to ordinary seven and eight foot props, we used a yearly average of 65,000 feet of heavy peeled piling, averaging in diameter from 10 inches to 12 inches. Annual expenditures for timber of all classes was in excess of $60,000.00. Timber costs per ton averaged around 29 cents. In view of these exceptionally severe timber conditions at Primero, the company, in 1920, had a survey made with a view of providing some remedy to this problem. A comparison of the life of main entry timber at other bituminous mines was made, and an average life of four years was established. The actual data collected at Primero indicated an average of less than two years in the manway or "return" airways, and up to five years on the haulageways or "intake" airways. While some of this timber will stand up for a much longer period than this, a close inspection will reveal in most cases that its period of usefulness is spent. It is very essential when discussing the life of timber, especially that used on, main haulageways and aircourses, that a distinction be made between the point of service, that is, the point where it is sound, serviceable and able to carry weight, and the point of breakdown or failure, where it is no longer sound and able to carry weight. In figuring the life of timber, the point of service only should be considered as timber will frequently stand for a considerable length of time when it is entirely decayed and unserviceable. The larger part of the timber used for our permanent work was Alpine Fir, or what is locally termed Red Spruce, and the supply of this I is gradually becoming depleted and has to be obtained at a point so distant

Good Morning. Thank you for your kind welcome, Lyle and thank you for having me here today. I spoke at the fall meeting of the Utah state RMCMI in Price and it's nice to be invited back. I can see by the program that you have two great days of interesting and informative meetings, including the mine rescue team exhibition and the safety recognition award presentations. As you all know, I am here standing in for Dave Lauriski, who is in China with Secretary of Labor Chao. As you also know, Utah is near and dear to his heart - and so is the Rocky Mountain Coal Mining Institute. I want to assure you Dave would be here if it were at all possible. But it is my good fortune that I could come in his place. We have made great progress as an Agency thanks to the hard work and dedication of MSHA's employees. But we are always looking for new ways to solve problems and continue to send more miners home safe and healthy every day. And we have been working on some great ways to do that, including thinking strategically. During my presentation today I'm going to talk about where the Agency is in terms of our transformation to the MSHA of the 21st century, a little bit about how we got to be where we are, and then describe our roadmap to the future state. And I'm going to focus on the significance of our plan and the planning process to demonstrate the implication for the mining industry. Former President Dwight Eisenhower once said, "In preparing for battle I have always found that plans are useless, but planning is indispensable." Now I do like Ike, but I would have to take exception to the first part of the sentence. I have found plans and the planning process to be indispensable - the plan to give me a roadmap to my goal, and the process to focus me on the steps I must take to get there. We all know that having a strategic plan makes the difference between success and failure. We've seen it time and time again, in business, in our lives - and in government: Having a strategic plan is crucial to success. And the process of making the strategic plan is crucial to its success. Putting together a workable strategic plan - a good roadmap - that will successfully lead you to your goals requires a thorough, careful process that takes into account each factor that you may encounter along your way to success, as well as those with whom you will travel. In order to talk about our current plan I want to take you back to three years ago, when Dave Lauriski went to Washington to lead MSHA. He knew that change was in the air. PRESIDENT LITTLEJOHN: We have with us a gentleman from Utah, who is familiarly known -as the "Mudite King," Mr. Reid, of the Lion Coal Company. Here is a letter I would like to read, and probably Mr. Reid will give us an idea of his Mudite machine, or the results he is obtaining. This question was brought up in Rock Springs, Wyoming, but Mr. Reid was not there personally during the discussion, but Mr. Burnell, who is general superintendent of the Lion Coal Com¬pany, as much as he possibly could, described the system and its effects. I believe Mr. Reid will probably be able to give a somewhat clearer statement this afternoon. This letter is from the Coal Mining Inspector of the State of Utah, John Crawford. "February 10, 1925. "The Industrial Commission of Utah, Building. "Statement of John Crawford, Coal Mine Inspector, in regard to Muditing in Coal Mines: "That Muditing used in connection with our present sprinkling system in coal mines is the missing link to the system we have had heretofore, because the water applied by the former system began to dry out, in heavy air currents, the moment it was put on. Consequently the dust that had been humidified by sprinkling, came back to its natural condition, and if anything, the combustible parts of it, in my opinion, were more intensified than previous to being wetted down. "The advantages that Muditing has over the old system of sprinkling are: "1st. The dust that is on the roof, timbers and sides of the entry is washed completely off and rolled up in the Mudite solution which entirely destroys the wings, crudely speaking, of the fine coal dust. "2nd. Sprinkling with the Mudite system, the water and mud is of greater extent than could be applied with a hand hose by a sprinkler. This sprinkling can be done while the mine is in operation, just the same as if water alone was being used. "3rd. The Mudite solution, when dried out, leaves a coating which serves as an armour to the coal, so that in the event of a local explosion, the inflammable matter on the coal is non-combustible; whereas, if that same coal had been sprinkled with water only, and made free of dust, the heat would have the same effect on the coal as it has on a stove when coal is thrown into it-instantaneous combustion. "Therefore, it is my opinion that the Mudite system is the missing link to the perfecting of our sprinkling system here in Utah. "(Signed) JOHN CRAWFORD." There is a large group of men around here I notice who come to this meeting year after year, and it occurs to me that they must be getting something worthwhile out of these meetings, the renewal of old acquaintances, the making of new acquaintances, and the opportunity to find out what is doing in the technical end of the coal business, and what is new. So, we greet you enthusiastically and trust that you will find this meetnig on a par with all those which have gone before and. that each one of you will leave these sessions determined that you will not miss next year but will be back again. So, with that introduction, we will proceed with the business of the convention. The coal producers of the Rocky Mountain states have led in one of America's true industry revolutions - the leaps in productivity and competitiveness that deliver coal-fired electric power to the U.S. economy at prices that are the competitive envy of the world. You are a primary reason the average price of industrial power in the U.S. - the power that creates and upholds jobs - is: ? 10 percent below the French average, where nuclear power is dominant; ? 37 percent below the average for industrialized Europe; ? 49 percent below the German average, where subsidized coal and nuclear rule; ? And 73 percent below the Japanese average where nuclear and liquified natural gas dominate. There are interests ambitious to change all of that; and they will be a subject of my remarks, some by name, rank, and affiliation. Coal-fired power plants in the Rocky Mountain states deliver some of America's lowest cost electricity; and America's coal-fired plants deliver some of the world's lowest cost electricity. Represented here in one room are producers from states that deliver more than 40 percent of America's coal and five of her top 10 producing states. You are cornerstones of America's economic strength and future growth. The theme for this meeting is "The Many Partnerships of Coal;" and, in this keynote, I'd like to offer a variation on the theme. I'd like to discuss a determined partnership that is dedicated to overturning everything you have accomplished, plus the structure of our society - very dedicated, very patient, very determined. This partnership masks itself as being in the public interest but behind the mask a political alliance of three distinct private interests can be seen: ? One is ambitious for economic reward as a right and without the trouble of effort; ? One is ambitious for economic advantage in trade without the trouble of competing; ? And one is ambitious for the power to govern people without the trouble of winning consent in elections - to change the way other people choose to live in accord with their own passionately held beliefs. The international agreement on climate is being used as an artifice to advance these interests, and the interests are making the United Nations a mechanism for achieving those objectives - for turning the screw, so to speak. The President that Americans elect this year soon will come under intense pressure from these partners to: ? First, quickly adopt policies that will raise U.S. energy prices and restrict use under the climate agreement; ? And in 1998 - if they follow their own published plans - to begin the subordination of the independence of the United States to a collective sovereignty in economic, political, legal and other matters. The Worldwatch Institute inaugurated this pressure last year with a policy monograph entitled Partnership for the Planet: An Environmental Agenda for the United Nations. This is but one indicator of the situation I ask you to consider. The pressure will increase after the election. Worldwatch is one of those intellect-oriented "public interest" groups whose work often leads to policy proposals and debate. Worldwatch gets money from the U.N. Population Fund and the MacArthur Foundation among others. And so my remarks require wading waist deep into one of the more sporting current propositions of American public policy - discussion of ambitions for and within the United Nations to achieve that which the ambitious call global governance. Profiled on these pages are the eight RMCMl 1998 Scholarship Award winners. Six of the eight winners were present as guests of the lnstitute at the June convention at Snowmass Village, Colorado. Each received recognition at the Institute Awards Luncheon Sunday. June 28. 1998. Each state vice president served as host for the collegiate winner and his firm provided travel and hotel expenses. In addition to receiving a plaque from the Scholarship Chairman, Jim Mattern, each winner receives $1.000 tuition credit for the coming academic year, as well as transportation, hotel lodging and meals at convention as guests of the Institute. Because this IS a continuing award, the winners from the previous year also receive a $1,000 tuition credit in their senior year if recommended by the dean of the college or university and if they remain full time students. A resident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards made annually is that the recipient (1) Is a full time sophomore student who will use the tuition credit during the junior year. (2) Be both a U.S. citizen and a resident of the member state. (3) Maintain good academic standing, be pursuing a degree in a mining related field and have an expressed interest in western coal as a possible career path. The scholarship program includes curricula other than in the mining departments, but in engineering disciplines, such as geology, mineral processing and metallurgy. Through annual donations of $100 or more. the Patrons of the Institute fund the scholarship program. A listing of current donors is found elsewhere in this book. He also enjoys reading, ghost town and old mine exploration, computer, Japanese conversation, and sketching cars and other forms of transportation. Chris hopes to attain a Masters Degree. Lengerich Colorado School of Mines Matthew, the son of Judy Lengerich, Durango, Colorado and Ronald Lengerich of Redlands, California, is pursuing his degree in Mining Engineering with a 3.93 GPA. He is a member of the National Honor Society and the German National Honor Society. An avid outdoorsman, Matt also finds time to pursue music and theater. He was unable to attend convention this year as he was on a collegiate trip to South Africa. He is Co-President CSM Newman Group and Youth Leader at Christ on the Mountain Catholic Church.

Benedict Shubart, Secy, Rocky Mountain Coal Mining Institute. Denver, Colo. Dear Sir: "Sorry not to be able to be with you but since my function in the Institute has been largely along the line of `stirrer up of trouble' (of course always with the aid of Dalrymple), I do not wish to fall from grace now so am sending you a pamphlet on the last page of which is a' tabulation as to accident indices of various coal mining states and it seems to indicate that the states comprising the Rocky Mountain Institute have the poorest accident record of all the states producing coal. "It seems to me that even allowing for possible deficiencies in connection with placing accidents upon basis of hours of exposure, our western states need to `tighten up' as to safety practices, hence I hope that the Safety Committee report will be both drastic and progressive and that western coal mines apply the drastic proposals in addition to approving them as the policy of the Institute. Why wouldn't it be advisable to have a committee appointed to ascertain why the safety record of the states comprising the Institute is so bad as to coal mines? On the back of it is this table; and it is a fact that the Rocky Mountain States are down at the lowest in almost every case, at the lowest point, with the highest accident rate in almost every kind of accident. Maybe he is wrong; maybe he states this for reasons. That is a rotten looking table for us.

The eightieth regular meeting and convention was called to order by the President, John T. Atkins, at 9:15 a.m. Monday, June 25, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. President Atkins welcomed the members and their guests to the convention and noted that the annual business meeting would be held Tuesday afternoon at 2:00 p.m. in the same room. A convention update was made by the Conven¬tion Liaison Officer, Loren V. Linville. This was followed with a program report by the Program Chairman, Doug Ingram. The chair then called on Clifford Barrett, Upper Colorado Regional Director of the Bureau of Rec¬lamation of the United States Department of the Interior. He presented the Bureau's Citizen Award to RMCMI former president Ira E. McKeever for his outstanding contributions to the joint private/ Federal effort and the open planning process for AQUATRAIN. According to Barrett, "from 1981 to early 1984, McKeever led private industry work in the AQUATRAIN project, a proposal for a 1,400 mile long pipeline system. AQUATRAIN was conceived as a possible alternative to solve the government's problem of rising salinity levels in the Colorado river, as well as the private sector's need for a more economical coal transport method. The Citizen Award cites McKeever's efforts in developing a model for future cooperative ventures between government and industry that can benefit the nation." Following this presentation, the formal program of the 80th meeting and convention began with the president, John Atkins, introducing the convention kickoff speaker, Andrew Franklin, President of Nerco Mining Co., Inc., followed by the convention keynote speaker, Dr. Margaret N. Maxey of the University of Texas. These speeches are printed in this Proceedings together with those of all other convention speakers. I'm Andrew Franklin, President of Nerco Min¬ing Company, and I'm delighted to be here to kick off the annual convention of the Rocky Mountain Coal Mining Institute. This has always been a very special convention in my eyes and I'm sure this year's will be no exception. I am also here to share my thoughts on the western coal industry and how we're all affected - for good and bad - by public policy decisions. Although the title of my talk is "Western Coal: An Industry Under Siege," I believe a more accurate title might be "Western Coal: The Pit and The Pendulum," because of the wide swings in public policy and coal development in the past 15 years which have cut a zigzag path for growth over this period. As one of the nation's largest coal producers, Nerco is well aware of the problems facing western coal production. Nerco Mining Company is the western coal mining subsidiary of Nerco Inc. We have been "in coal" for more than 25 years through our parent company, Pacific Power & Light. To state my conclusion at the outset, I feel it's extremely important that consistency and common sense should guide our national policy for the development of valuable energy resources. In particu¬lar, we must reduce the wide swings in government policy and activities which have affected energy development. In short, we must decide what kind of game we're playing so that the "players" and the "referees" can keep their eyes on the "ball." Business today faces two main types of uncertainty market uncertainty and public policy uncertainty. As businessmen, we expect and are used to facing the familiar challenges and uncertainties of the market in which we operate. Over the past 10 years, the market has appeared to be bullish on coal.
