Arbitration is a legally recognized alternate litigation for the resolution of civil disputes. The parties agree, either before or after a dispute arises, to submit that dispute to an independent third party for resolution. The decision of that third party is binding on the parties. A decision of an arbitral tribunal, typically referred to as an "award," cannot be reviewed by a court except on very limited grounds, such as fraud. See, e.g., Va. Code 8.01-581.010. Indeed, an arbitral award is typically less subject to judicial review than the decision of a trial court, whose decisions are almost always subject to appellate review as a matter of right. Arbitration is typically the result of a contractual agreement between the parties to submit disputes to arbitration. On occasion, arbitration can be required by statute. For example, the California Department of Transportation requires the arbitration of all disputes arising under its contracts. Public Contract Code, Article 7.1 (§§10240-10240.13). There may be a question whether statutorily required arbitration is truly arbitration or an administrative law disputes resolution procedure. The significance of the difference is that the decisions of administrative law bodies are typically reviewable by a court of law as a matter of right while, as set forth above, arbitral awards are almost never reviewable.

"Abstract The economic and safe design of deep foundation systems in difficult soil conditions is based on a reduction of construction material used, construction time spent, energy consumed and a high-level modelling of the soil-structure-interaction. The special foundation system Combined Pile- Raft Foundation (CPRF), in-situ load tests on the construction site and a sufficient soil investigation allow cost optimised constructions. In any case at challenging projects the observational method has to be applied for verification and quality control of the design. Regarding the 4-Eye-Principle as basis of the quality control management an independent peer review of the planning, design and construction phases is the guarantee for safety, serviceability and optimisation of all projects. Main execution standards for the construction of deep foundations based on the Eurocode 7 are summarised and discussed. The paper presents the basics of the safe and qualified design and construction of foundation systems including quality assurance. The widely employed IPCC models for the release of methane from underground coalmining operations are reviewed, and put in the context of the South African National Communication on greenhouse gas emissions. Then attempts to calibrate the model via measurements on South African coalmines are described. These attempts failed because it rapidly became clear that the IPCC model, involving methane adsorbed by the coal and released (a) by the depressurization of the strata caused by mining, (b) from the broken coal and (c) from coal remaining in roof, floor, pillars or goaf after mining, was not valid. Instead, measurements showed that the methane release was very variable, sporadically falling to zero. Carbon dioxide concentrations were monitored at the same time as methane, and followed methane concentrations. An alternative model was developed, in which methane was largely displaced from the coal and held in fissures, cleats and pores, which, when intersected by mining, released methane into the ventilation stream. In a key test of this hypothesis, methane concentrations around a continuous miner were monitored both during operation and after shutdown. Even during operation, methane became undetectable. It is hypothesized that heating of the South African coal-seams during the emplacement of the igneous dykes that cut so many of the seams caused displacement of the methane from the coal into the pores. This fissure-held methane, or free methane, is released rapidly once a pathway through the coal into the mine atmosphere is established. In contrast, methane adsorbed in the coal, and measured as the seam gas, desorbs relatively slowly. Measurements suggest that on average about 50%of the adsorbed methane is lost one day after mining. By that time, the coal will have left the mine, so that the remaining seam gas will be released to the atmosphere outside the mine. Attempts to measure methane emissions from surface coal-mining operations showed very little detectable methane. Coal from surface operations, which was milled and exposed to atmosphere, adsorbed gas from the air. It is concluded that methane release from surface operations is probably less than 3Gg/a. It is estimated that the total methane release from the coalmining industry amounts to about 72 Gg/a, as opposed to the National Communication estimates of 323 Gg/a in 1990 and 317 Gg/a in 1994. However, there are large errors associated with these estimates, and it is recommended that the methodology outlined in this report be extended to as many mines as possible to reduce the errors that are inherent in the physical processes underlying the release of methane from South African coalmines.

The mining industry has come to rely on imaging devices to monitor and record all kinds of activities. We use them to measure, improve the process, ensure security, increase production and automate machinery. Cameras can be installed in locations most people wouldn?t want to live and be our ?eyes? to record the events at that location. This paper discusses digital imaging, the equipment, methods, techniques and information that can be learned from digital devices used in mining operations. The guy who said ?a picture is worth a thousand words? probably understated it. Images are the perfect way to document conditions before, after and even during mining activities. Today?s wide choice of cameras, camcorders and other digital devices allow us to record most activities and events. The technology is advancing at a high rate. Digital cameras and camcorders are marvels of technology with high resolution optics, compact size, automatic time and date stamp, great battery life, shutters to freeze motion and computers to auto focus and eliminate jitter (image stabilization). Add to this the economical price and ease of use and everyone in this industry should be aware of the possibilities.

Two of the most important issues mines have to deal with are tracking the ore mined from pit to plant and to test the efficiency of beneficiation equipment. Kumba Resources and Saco Systems are working together at moment to develop a RFID tracer system to help address these issues. This paper will focus on the tracking of ore from pit to plant. The main advantages for ore tracking is to ensure plant feed blending and dilution according to plan. The RFID tracer system works on the basis of a tracer that physically simulates the ore properties and radio frequency technology that facilitates communication with the tracer and allowing information to be stored on the tracer. This paper tends to indicate the progress on the application of RFID tracer technology in the minerals processing environment as tested at Kumba Resources so far. It is concluded that the system has great potential, but some important problems remain

Charleston, SC is anything but boring. The city was founded in 1670 and has played a significant role throughout the history of the United States. Located along the coast of the Atlantic Ocean in the southeastern United States, Charleston was a vital city in America?s early existence. Charleston?s coastal location has helped the city become the fourth largest cargo port in the United States and earn the 2011 designation as the number one travel destination in the United States by the Conde Nast Traveler Magazine. Part of Charleston?s charm and beauty can be attributed to its historic structures and churches that line nearly every sidewalk, roadways that were laid out based on the width of horse carriages, great weather, southern hospitality and coastal living. Now imagine the challenges of installing new, or re-placing aging infrastructure, in this setting. Every shovel full of dirt, every stick of pipe and every roadway sub-surface has its own historic story to tell. For engineering minded individuals, Charleston?s infrastructure has almost as fascinating a history as its more visible surface structures. Charleston was among one of the first American cities to construct separate sanitary and storm water drainage infrastructure. This concept has roots dating back to the city?s founding and is a credit to the foresight of its founding fathers who understood the basic health differences between sanitary and storm water.

This project had as its objective the experimental investigation of water capsule production utilizing the Southwest Research Institute's submerged nozzle encapsulation apparatus (U.S. Patent 3,389,194). Initial efforts on this project involved nozzle configuration and shell formulation optimization. The shell formulation developed on a prior program was modified during the course of the project to obtain the best balance of capsule breakage resistance and water retention. Subsequent effort centered on determining operating conditions which would produce the best quality capsules for each candidate shell formulation as determined by laboratory tests. Some preliminary work was done to increase the production capacity of the encapsulation equipment. The program was extended with major emphasis concerned with scale-up studies of capsule production capacity and the treatment of problems associated with grouting cartridge fabrication. During the course of the program, water-containing capsules were produced which have good long-term water retention, block resistance and adequate strength. Using a single-nozzle design, a production capacity of 15.9kg (35 pounds) per hour was demonstrated to give acceptable capsules based on initial results.

"The mining industry has to face increasing restrictions concerning the use of fresh water in Québec and throughout the world. Increasing recirculated water usage could lead to a better control of the quality and the quantity of water supplied to the mineral processing units. Furthermore, it could reduce the volume of waste water to be managed and treated before its release to the environment. However, process water may have a negative impact on mineral processing operations, thereby limiting the incentive for sustainable development initiatives. As a first step into selecting and testing remediation strategies, one of which being blending local waters, a mapping of process water quality (inorganic and organic fractions) allowed to locate zones in an industrial case study where fresh water is introduced into the circuit and to detect dissolution and precipitation zones. A complementary hydro-geochemical modeling study on water blends was also performed showing encouraging results towards the objectives of the project.INTRODUCTION The industry has to face increasing restrictions on the use of fresh water in Québec (Quebec Government, 2009) and throughout the world (Brown, 2003; UNESCO, 2006). The cost for the use of fresh water and for water management is highly variable and case-dependent (from 0.2 to up to 7 million dollars/year according to available private estimations, excluding the capital expenditure). It may be, or may become, significant for any plant; thus, risk assessment is of concern here. Using recirculated water could lead to a better control of the quality and the quantity of water supplied to the mineral processing units. Furthermore, it could reduce the volume of waste water to be managed and treated before its release to the environment. However, process water may have some positive and negative impacts on mineral processing operations (Janssen, 2003; Johnson, 2003; Rao and Finch, 1989). Negative impacts could limit the incentive for sustainable development initiatives. Water management strategies at mineral processing sites are supported both by a strategic plan and a water management plan. The strategic plan includes legal aspects, investment costs, potential benefits and various risk levels (Corder and Moran, 2006; Côte et al, 2006; Evans et al., 2006; MacIntosh and Merritt, 2003; McLellan et al., 2008; Merritt and MacIntosh, 2006; Robinson and Keddie, 2006; van Beers et al., 2007a; van Beers et al., 2007b; van Berkel, 2007). In practice, the strategic plan evaluates technical possibilities and costs of various scenarios, such as for example: bringing fresh water to the plant or recirculating waters, or using blends of both. Two important factors to consider in order to enhance the future production efficiency and to minimise risks are: the durability and the stability of the resource, both from quality and quantity points of view."

The upswing in prices for base and precious metals, industrial minerals and coal has allowed the global mining industry to ramp up production at existing mines and begin construction of proposed projects. In addition to satisfying shareholders, the industry is also providing good paying jobs and creating needed infra-structure in places that previously did not have either. However, the industry has learned that the prospect of jobs and infrastructure is not necessarily a guarantee that communities will allow mines to be built. The industry must maintain even higher environmental and reclamation standards. And mining companies must help communities plan for life after a mine is closed and the company moves out.

Analysis of Electrostatic Separation for Rutile Cleaning Duty Using a Plate Electrode Assisted High Tension Roll Separator A plate assisted electrostatic high tension roll separator has been used for the removal of impurity mineral grains from a rutile rich product stream. A laboratory study and a subsequent production study explored the effect of machine conditions with a view to the optimisation of the separation performance of the separator. The performance requirement was that the TiO2 grade in the non-conductor stream was to be less than ten per cent whilst at the same time the ZrO2 grade in the conductor stream had to be less than 0.5 per cent at mass recoveries of greater than 90 per cent to the conductor stream and less than 5 per cent to the non-conductor stream. Mineralogy data was utilized to determine the feasibility of achieving the production targets with the feed under study. Since the feed stream mineralogy was dominated by rutile, leucoxene and zircon, it was possible to use an approximation to the actual mineral assemblage as well as the raw X-ray fluorescence data to understand the separation duty of the Carrara machine. Since there were four conflicting criteria used for the performance requirement, an index was devised that incorporated all the requirements simultaneously. This new index was the sum of the squares of the difference between the achieved and desired values, weighted with respect to the variance of each variable. If the desired value for a particular criterion had been met its contribution to the sum was set to zero, no matter how well the criterion had been met. For the production machine the strict requirements were almost achieved. As expected, the achievement of the target performance was dependent of the feed conditions at the time of measurement. This paper reports the results of this study.

"Zn-Pb sulfide mineralization at Abbeytown mine and Twigspark quarry comprise the only known car¬bonate-hosted base metal sulfide deposits in the Sligo syncline, northwest Ireland. Limestone sedimentation occurred uniformly throughout the region during the Early Carboniferous (Mississippian) as observed by field relationships and lithofacies; however, petrographic and stable isotope evidence indicate that host-rock dolomitization occurred under different conditions at localities to the west and east of the Ox Mountains inlier, suggesting significant uplift and geologic isolation of these areas prior to dolomitization. Localized fluid flow systems are thought to be responsible for sulfide mineralization and associated epigenetic carbonate cements. West of the Ox Mountains inlier at Abbeytown, evidence of three geochemically distinct fluids are observed: (1) a lower-temperature, lower-salinity fluid (70°-130-°C, 4-9 wt.% equiv. NaCl); (2) a lower-temperature, higher-salinity fluid (70°-140°C, 15-24 wt.% equiv. NaCl); and (3) a higher-temperature, moderate-salinity fluid (165°-220°C, 8-14 wt.% equiv. NaCl). Similar fluid types were observed at the Twigspark deposit. The source of the higher-salinity fluid is likely seawater evaporated to near the point of halite precipitation. The higher-temperature fluid is thought to have been derived from deep circulation of basinal brines. It is speculated that mixing of the higher-salinity fluid with the high-temperature fluid was vital for ore formation at Abbeytown because fluid inclusions in sphalerite have homogenization temperatures and salinity values that fall along a mixing trajectory of these end member fluids. Also, areas where the high-salinity end member fluid is absent are barren of sulfides. Less complex fluid systems are indicated for sites east of the Ox Mountains inlier where no sulfide mineralization was observed. Data from base metal sulfide prospects in northwest Ireland indicate no connection with the regionally extensive flow system thought to be responsible for Zn-Pb deposits throughout the Irish Midlands.Les minéralisations en sulfures de Zn-Pb de la mine Abbeytown et de la carrière Twigspark sont les seules gîtes de métaux usuels à encaissant carbonaté connus dans le synclinal de Sligo, au nord-ouest de l’Irlande. "The New Afton concentrator was commissioned in June 2012, reaching the design milling rate in September 2012. By late 2013, through a campaign of optimization and de-bottlenecking, it was recognized that the installed plant was capable of greatly exceeding the design throughput of 11,700 tpd. Because the value of the metal contained (by increasing the plant feed rate) exceeded the offsetting losses of copper and gold recovery (as the operation moved to a coarser grind), the concentrator feed rate was strategically increased with support of New Gold, while the operations team was given a mandate to evaluate, and then implement, flow sheet options that could re-establish the original design criterion grind target and achieve the corresponding improved recovery. Broadly, the two options implemented were the addition of a tertiary grinding stage consisting of Metso Vertimill® prior to rougher flotation (in order to address the grinding required at increasing throughput by increasing the power), and the addition of three Woodgrove Staged Flotation Reactors (SFR) added to the cleaner circuit after regrind of the rougher concentrate (to address the increased mineral loading to the cleaner circuit). Through test work, it was anticipated that the SFRs would be capable of achieving final concentrate grade in a single pass without the integration of recirculating loads, a strategy sometimes referred to pre-cleaning. This paper describes the expectations generated for the Woodgrove SFR unit operation through pilot plant testing on site, and compares those results with the performance of the expanded circuit that exceeded the original design criterion of P80 160 µm, which was commissioned in the second quarter of 2015.INTRODUCTIONThe New Afton concentrator, located near Kamloops, BC Canada, commenced operation in June 2012. The mill achieved the design throughput of 11,000 tonnes per day average during the month of September 2012 and, following various operational optimization efforts (O’Hara et al, 2015), achieved the design p80 grind size of 160 µm at the design milling rate in July 2013.During August 2013, trials were carried out to determine the throughput rate limits of the mill circuits and to evaluate mill metallurgical performance at higher rates. Milling rates up to 15,500 dmt per 24 hours were achieved during this trial, demonstrating potential capability for sustained milling rates exceeding the nominal design capacity. As was expected, the higher milling rates resulted in a coarsening of the grinding circuit product size, and resulted in marginally lower recoveries in the rougher flotation circuit. Despite the lower recoveries, the higher milling rates resulted in higher metal production and the financial analysis favored running at rates of at least 13,000 tonnes per operating day, with the higher cash flow in the near term offsetting the value of metal production loss at the end of the mine life (due to the short term increase in the rate of reserve depletion). Milling rates were sustained above 13,000 tonnes per day through the second half of 2013, and increased above 14,000 tonnes per day by mid-2014 (Figure 1)."

For many years practicing geotechnical and structural engineers in Texas and Louisiana were reluctant to include augered cast-in-place (ACIP) piles as a viable deep foundation alternate. Three primary concerns were the lack of a final driving resistance to confirm adequate capacity, the inability to inspect ACIP piles prior to installation, and the fact that pile integrity is highly dependent on the skill of the ACIP pile contractor's field personnel. The Deep Foundations Institute (DFI) Committee on Augered Cast-In-Place Piles has responded to these quality control concerns by establishing standards of practice for ACIP pile installation and ACIP pile inspection. Regional areas of the country have different subsurface soil and rock conditions and many times this will influence local installation and inspection requirements. The best way structural and geotechnical engineers can address quality control concerns is to be familiar with the DFI standards of practice, to know the special requirements for a particular project site, and to incorporate them into a well-written ACIP pile specification. The purposes of this paper are to: 1) review the main fundamentals of a successful quality control program, 2) describe how these fundamentals can be applied to the installation of ACIP piles, and 3) add personal experiences from ACIP pile projects in Texas and Louisiana. Nondestructive test methods are frequently used as a quality control tool to evaluate questionable piles. An additional brief discussion of two nondestructive test methods is presented to complete the paper.

"Abstract The present study proposed a new liquefaction countermeasure to improve sandy ground and conducted a trial execution. The new method is a floating-type and lattice-shaped cement treatment method, where cement-treated soil is not fixed to a non-liquefiable stratum. A fixed structure such as treated soil should be formed at the side of the floating-type treated soil to reduce its lateral displacement. In the study, one-dimensional dynamic response analyses were first conducted to confirm the mechanism of the new method. Then, a series of centrifuge model tests were performed to demonstrate the effect under a stress condition at the prototype scale. The analyses and model tests confirmed the effect of the liquefaction countermeasure. Finally, trial executions were carried out to confirm high-quality vertical execution.INTRODUCTIONLiquefaction induced by an earthquake generates sand boiling and ground settlement. Other problems have also been reported, including a decrease in bearing capacity and an increase in the horizontal earth pressure against retaining walls. To prevent these problems caused by liquefaction of the ground, various countermeasures have been proposed, such as cement deep mixing and high-pressure jet mixing methods. These methods have the big advantage of being applicable to ground that contains soil with a fine-grain fraction. Furthermore, the unnecessary displacement caused by the construction can be reduced. In Japan, a lattice-shaped cement-treatment method has frequently been used at many construction sites to prevent liquefaction, where cement-treated piles are intersected to form a lattice, as shown in Fig. 1. The lattice-shaped walls can reduce the shear stress generated by an earthquake, restricting the liquefaction at that location. However, the construction cost of the cement treatment is relatively high compared to other methods such as the sand compaction pile (SCP) method, and needs to be reduced. In particular, the cost of the high-pressure jet mixing method, which can be applied to the liquefiable ground under existing structures, is significantly high. Therefore, decreasing the total volume of the cement treatment is necessary to reduce the construction cost."

Objective To develop safety training tools for mine safety and health professionals that fill gaps in currently available materials. Background Over the past 4 years, NIOSH has developed and released a series of training videos targeted at underground mine safety. These videos were developed in close cooperation with the mining industry and safety training professionals and were intended to provide realistic, interesting, effective training to both new hires and experienced miners. The videos cover the mining cycle, starting with the breaking of the rock (Handling Explosives in Modern Mines), making certain the work area is safe after a blast (Rock Falls— Preventing Rock Fall Injuries in Underground Mines), installation of ground supports and recognition of failed supports (Miner Mike Saves the Day), and hauling both ore and materials in the mine (Hazards in Motion). A separate video (Hidden Scars) captures the story of a fatal rock burst through an interview with a miner who nearly died and who lost his partner in the accident. These videos have been extremely popular in the mining industry and are being used across the nation as well as in 18 other countries. Two of them, Rock Falls and Miner Mike Saves the Day, have won Alice Hamilton awards, NIOSH’s highest recognition for Excellence in Occupational Safety and Health, in the Educational Materials category. Approach A recently completed independent evaluation of the SRL mining videos identified five themes that mine safety trainers consider necessary for successful training materials: high quality, credibility, accurate content, effectiveness, and an engaging nature. All of the NIOSH videos were rated very high for each theme. Using these measures of effectiveness, a more difficult challenge has been undertaken. Much has been written in the mining industry about the coming turnover in employment. The average age of miners in the United States is approaching 50, and many of the “experts” will be leaving the industry as they reach retirement age. The mining industry, like many industries involving skilled labor, relies heavily on a master-apprentice relationship between new hires and older miners. New hands learn from experienced miners. Their learning falls into three primary categories—they learn what’s important to know, they learn how to do things correctly and safely, and they learn the culture.

INTRODUCTION New York City Water Supply—Background and History Since the 1840s New York City has been developing the largest, and perhaps, the best urban water supply and distribution system in the world in terms of quality and reliability. One of the engineering marvels of the modern world, the New York City water supply and distribution system serves a population of almost nine million, including residents in nearby Westchester, Putnam, Ulster, and Orange Counties of New York State. The average daily supplies presently are running at almost 60 m3/sec(about 1,350 million gallons per day). The watershed for the New York City water supply system, under the jurisdiction of the New York City Department of Environmental Protection (NYCDEP), consists of19 reservoirs and three controlled lakes, and covers an area of approximately5,000 square kilometers (about 2,000 square miles) north of New York City. The watershed total available storage capacity is about two billion cubic meters (560 billion gallons) and is divided into three reservoir systems: the Catskill and Delaware watersheds located West of the Hudson River; and the Croton watershed, located east of the Hudson River, see Figure 1. The first element of the system, the Croton Aqueduct, started operations in 1842.Through several updates and expansions, the present-day Croton system was in place by 1911, providing a potential maximum supply of about 15 m3/s (about 340 mgd). The system includes ten reservoirs and three controlled lakes. In the late 1800s, with the tremendous growth of the City, New York City water engineers began to look for additional sources. Between 1907 and 1929, the City acquired water rights and constructed a new 148 km (92 miles) Catskill aqueduct to convey water from the Ashokan Reservoir to the City. Tenova Pyromet has developed innovative technologies for copper smelting and electric slag cleaning furnaces. Based on client feedback and requirements, innovative designs have been developed to address key design areas and improve furnace reliability, operability and hygiene. These developments include the NovaLance™ lance system to prevent lance bending on top submerged lance furnaces, the SlagFlo™ slag tapping flow control device to better control bath levels and tapping rate for granulation, and an electrode seal for improved sealing directly onto the electrode casing to allow water-cooled electrode components to be located above the furnace roof. The potential application and benefits of these innovative designs are discussed. INTRODUCTION Tenova Pyromet has a long history in the engineering and supply of innovative electric furnace and related equipment for the base metals and platinum industries. Recently Tenova Pyromet has used its furnace equipment design experience to engineer innovative solutions for top submerged lance (TSL) furnaces, and potentially other furnace technologies. These equipment design solutions are developed to address specific operating challenges and operator requirements. Three of these innovative equipment developments are discussed in this paper. First the NovaLance™ lance technology to prevent lance bending during operation in TSL furnaces, such as used for primary copper smelting, is described. Lance bending has been identified as a significant problem for TSL furnace operators as it causes down time and affects furnace availability. The SlagFlo™ device to control the slag flow rate during tapping has been developed based on specific requirements in the mineral wool industry. The SlagFlo™ device can be used to control slag bath levels in primary smelting, converting and slag cleaning furnaces for base metals including copper. In addition, it can be remotely activated for the safe closing of slag tapholes located upstream from a water granulation system. Finally, Tenova Pyromet developed an electrode seal that seals directly onto an electrode surface. This is a special requirement related to base metals and platinum electric smelting and slag cleaning furnaces where furnace operators prefer to keep the water-cooled electrode equipment above the furnace roof. The seal can be used to seal directly onto the potentially hot and uneven surface of Söderberg, pre-baked and graphite electrodes.
