As set forth in the decision of the Trail Smelter Arbitral Tribunal, dated April 16, 1938 This Tribunal is constituted under and its powers are derived from and limited by the convention between the United States of America and the Dominion of Canada signed at Ottawa, April 15, 1935, duly ratified by the two parties and ratification exchanged at Ottawa, August 3, 1935 (hereinafter termed "the Convention") . . . The duty imposed upon the Tribunal by the Convention was to "finally decide" the following questions: (1) Whether damage caused by the Trail Smelter in the State of Washington has occurred since the first day of January 1932, and, if so, what indemnity should be paid therefor? (2) In the event of the answer to the first part of the preceding Question being in the affirmative, whether the Trail Smelter should be required to refrain from causing damage in the State of Washington in the future and, if so, to what extent? (3) In the light of the answer to the preceding Question, what measures or regime, if any, should be adopted or maintained by the Trail Smelter? (4) What indemnity or compensation, if any, should be paid on account of any decision or decisions rendered by the Tribunal pursuant to the next two preceding Questions? In this decision reported to the Government of the United States of America and to the Government of the Dominion of Canada, the Tribunal answered the first question in its entirety and reserved decision on the other three questions in accordance with the following extract from their decision

"INTRODUCTION The Rodessa oil field in Marion and Cass Counties, Tex., Miller County, Ark., and Caddo Parish, La., was discovered in August 1930, when a well drilled to a depth of 5,506 feet in Caddo Parish, close to the surface trace of the Rodessa fault, produced gas in commercial quantities. During the next 5 years 21 gas wells were drilled, and a large reserve of natural gas was developed in the high part of the Rodessa structure underlying the Massive Anhydrite member of the Glen Rose formation.In July 1935 oil was discovered on the flank of the structure when a well drilled to 6,048 feet also in Caddo Parish, was completed as an oil well. The discovery of oil in the Rodessa structure initiated art intensive development program of more than usual interest to geologists, engineers, and operators in the petroleum and natural-gas industry. The complex nature of the different reservoirs, the large volume of ""free"" gas under high pressures and temperatures in the upper part of the reservoirs, and the high gas:oil ratios of some of the wells during the early production of oil presented many problems the solution of which taxed the ingenuity of those responsible for the development and exploitation of the Rodessa field.Early waste of gas and resultant dissipation of reservoir energy led to State intervention, which brought about effective regulation of the quantity of gas blown to the air. Oil production from wells producing more than 2.000 cubic feet of gas per barrel of oil was restricted, and oil allowables generally were based equally upon acreage and upon reservoir pressures. Consequently, oil-production statistics of the field are closely associated with gas:oil ratios and reservoir pressures.The primary object of this report is to present factual and statistical data on well performance in the Rodessa field and to show established trends under certain operating methods and practices in high-pressure gaseous reservoirs, which have been carefully developed and outlined by modern technique and exploited under close engineering supervision.The large size of the Rodessa field, it’s fairly well defined gas caps, and a somewhat definite water table in a part- of the oil- and gas-producing region are of special interest and importance in a study of the fluid and energy relationships in reservoirs. Consequently, the results of much of the authors' work in collecting and compiling date are presented in the form of tables, maps and cross sections to show the relative thicknesses of the different oil-and gas-producing members and their permeability and porosity relationships, and, when possible, the variations in stratigraphy are exhibited in cross sections. Results of a detailed analysis of cores from a number of wells also are presented in tabular and graphic form."

Traditional practice to resist large lateral loads on foundations is the use of large diameter caissons, battered driven piles, or battered micropiles. Dense urban construction environments, however, limit the usefulness of these systems due to the close proximity of below- and above-grade obstructions. This paper presents two micropile construction projects in the United States where a complex scheme of battered micropiles and grade beams was developed to counteract large lateral loads at the foundation level. The paper also presents a procedure used to design vertical micropiles for large lateral loads, which can greatly simplify the design of foundations subject to significant lateral loads in urban environments. A design example shows a case where vertical micropiles were used to support allowable design lateral loads greater than 80 kip per micropile.

A discrete fracture network (DFN) approach involves numerical modelling that explicitly represents how defects may be spatially distributed through a rock mass. A DFN is a 3D realisation of the ‘smaller scale’, non-deterministic defects; it is not an attempt to model larger, deterministic structures that should be identified as part of an engineering geology model. The approach utilises structural data in stochastic analyses to give a range of possible models that provides a tool for visualisation and analysis of a rock mass and indicates the potential large-scale slope or tunnel performance and stability.Stochastic fracture modelling for rock mass characterisation has significantly advanced over the past 25 years. With recent improvements to field data collection and computational power, it has become recognised internationally as a valuable tool for modelling some geomechanical problems encountered when designing excavations in fractured rock masses.This paper provides an introduction to the DFN approach, particularly the necessary input parameters and derivation of these from typical structural data sources, such as boreholes or scan line mapping. Of particular importance for engineering applications is validation of the simulated fracture network and techniques for doing so are discussed here.CITATION:Weir, F M and Fowler, M, 2014. The weathering of coal mine waste rock releases iron, calcium, sulfate and associated trace elements like selenium [Se], which are introduced to seepage waters. Nitrogen species, such as nitrate and ammonia, are also found in association with coal-mining drainages mainly due to leaching of residual blasting compounds. Elevated concentrations of Se are a ubiquitous occurrence in coal mining environments in British Columbia, with values ranging from below 50 to over 500 µg/L in site waters. Selenate is the most common form of selenium found in waste rock seepages, and is exceedingly mobile in aerobic freshwaters. A major concern with waterborne Se in British Columbia is the potential for its bioaccumulation in aquatic food chains. Treatment to remove Se from coal-mining wastewaters has proven to be challenging for conventional water treatment technologies. Compounding this challenge, many streams are characterized by high flows and low selenium concentrations. Conventional membrane and ion exchange treatments produce concentrated brine streams that are difficult to treat or require disposal. Conventional biotreatment systems use excess nutrients to provide the required electrons to compensate for inefficient and variable electron availability, as well as to adjust reactor chemistry. The Electro-Biochemical Reactor (EBR) technology provides electrons to the microbes directly at a low voltage potential (1-3 V), supplying a controllable and consistent supply of useable electrons to the system and microbes at low current. In this manner, the EBR technology overcomes the shortcomings found in conventional systems, as it reduces the required nutrient addition and provides a more controllable, efficient, economical, and robust biotreatment system than found in past generations of biological treatment systems. Additionally, the EBR process does not produce excess solids or biomass; therefore, solids management post-treatment is not required. Laboratory EBR bench-scale and on-site pilot-scale systems were used to treat five British Columbia coal mine wastewaters; influent Se concentrations ranged from 35 µg/L to 531 µg/L. Se treatment targets for the tested waters ranged from 5 to 10 µg/L. Mean Se concentrations in EBR effluents ranged from 0.5 µg/L to 1.4 µg/L, while reducing sulfate concentrations. The test data demonstrate that the EBR technology is an effective Se removal option for British Columbia?s coal-mining wastewaters.

MANY metals by virtue of their place of occurrence as ore, and their uses are travelers! Iron and steel, for instance, is one of the greatest of travelers in the form of ships and the romance of iron in this respect is only just beginning to be superseded by the stories which can be told of the travels of aluminum and its alloys, used in the building of airplanes. Tin is a traveler from the Straits Settlements to this country and Europe, for use in the canning industry; afterward traveling all over the civilized world as a part of the container for preserved foods. Silver is somewhat of an aristocrat, when its uses are measured against those of the baser metals. From earliest times it has been used for adornment (first perhaps o4 the person and later for the embellishment of weapons and' buildings), for the making of fine ar¬ticles used in the household, and as money. While its uses have been widened by the discoveries in chemistry, electricity and other sciences, its early uses are still much in evidence in our modern life.

TWO days of solid discussion, with barely time out for meals, characterized the Tulsa meeting of the Petroleum Division. It was preeminently an earnest gathering devoted to technical matters. Sessions were held in the Crystal room of the Mayo Hotel with luncheon served each day in the back of the same room so that talk of methods, while slightly less formal, extended right through the lunch hour. Thursday evening the Committee did provide a little relaxation in an informal dinner at the Tulsa Club where, after a brief musical program and an amusing skit by the local Herman the Great, brief addresses in non-technical vein were made by President Farish and Vice-president Rice of the Humble Company, Henry L. Doherty of Cities Service, Secretary. Bain of the Institute, and others. The presence of leading executives of a number of the oil companies at the dinner and the sessions, and the cordial approval they expressed of the work of the Division were especially gratifying. The total registration was 215 with 100 at the dinner and 70-to 80 lunching together each day.

Next year, in 1964, Butte will celebrate its Centennial. It was in May, 1864, that the first recorded mining activity took place. During that summer, several rich placers were found on Silver Bow Creek and its tributaries, and a gold rush followed. As placer mining proceeded in the creek beds, the quartz lodes on the hillsides were located and the veins were prospected. Mining in Butte entered its second phase when the rich silver mines, the Alice, Moulton, and Lexington, were opened. The silver boom lasted until the decline in the price of silver in the early 1890's forced the closure of many of the mines. An indication of the beginning of the copper mining era in Butte was in 1866 when it was noticed that green copper carbonate discolored some of the, lode material. It was not until ten years later, however, that the Anaconda and St. Lawrence claims were located by Michael and Ed Hickey. The claims were sold in 1880 to Marcus Daly and in 1881, Daly obtained financing and organized the Anaconda Silver Mining Company to exploit the vein The silver venture was a failure because of the predominance of copper which diluted the bullion to only 400 fine.

DURING the year 1907 an investigation of the Clinton formation in New York has been carried out under the direction of the State Geologist, and a full account of the results has been prepared for publication.1 The more important economic features of the report are summarized in the present paper. Previous knowledge of this, the type, section of the Clinton has been contributed mostly by Hall and Vanuxem in their reports for the Natural History Survey of New York, which were issued in their final form in 1842-43. Brief accounts of the ore-occurrences have been given by B. T. Putnam,2 J. C. Smock,3 A. H. Chester,4 and E. C. Eckel.5 Prof. C. H. Smyth, Jr.,6has discussed the origin of the Clinton ores in two papers, which, so far as the local occurrences are concerned, have removed all doubt that may have existed on that subject. The materials containing copper which are refined in the United Statrs, are, for the most part, the natiye noppers of Lake Superior. IJntil quite recently but little pig copper Was made for sale, and that came principally from the pure sulphorous ores of New England and the Sonth, and was generally sdd to reSneries not far from the ore filrnaceu. A stnall aiuoiint found its way into the'niarket which was produced either as the by-product of the treatment of gold and silver ores, or as the result of the treatment of impure copper ores; but both these grades, on account of the impurities they contained, were loolced on with stlspicion, and were not sought for. A11 the grtlGis of pig coppcr are sold by the unit of oopper contents, a great redtiction being made in the price when impurities are present. There are at the present time only three works which treat native copper, the two of the Detroit and Lake Superior copper Company, and the works of C:G. Hussey & Co., in Pittsburgh. There are a few works ivhich smelt sulphuroris ores and refine their pig; bo sides these t1le1-e arc a few siuall works where gig copper is refined uuly. Some of these purcIlase blscir copper, refine scrap, or simply refine such grades of ingot copper as are found in the market, but nlostly that from Lake Superior, for the purpose of getting it into swh shapes that can be handled cpmtriercially to advantage, such as in making large plates or high grades of wire fir electrical purposes. In this paper, the effects of some organic compounds on the current efficiency, cell voltage and specific energy consumption during nickel electrowinning, and on the deposit features (morphology, crystallographic orientation and nanohardness) were described. The organics tested here (extractant, diluent, flocculant, lubricating oil and acid mist suppressant) are currently used in industrial plants. The results indicated that only the flocculant and acid mist suppressant exhibit relevant negative impacts on the current efficiency and energy consumption. The current efficiency dropped from 93.6 % (organic-free solutions) to 86.0 % and to 92.8% in electrolytes containing 100 mg.L-1 of acid mist suppressant and flocculant, respectively. At this concentration, their addition to the electrolyte led to increases of the specific energy consumption in the order of 18 % (acid mist supressant) and 2 % (flocculant). Cyclic voltammetry showed that Ni nucleation occurs at more negative potentials at 50 and 100 mg.L-1 of these organics in the electrolyte, thus indicating an inhibition of the deposition process. The deposit quality decreased at the higher concentration of all organics, when more hydrogen pitting was observed. The acid mist suppressant caused delamination of the Ni deposit at 50 and 100 mg.L-1. The addition of 100 mg.L-1 of flocculant and acid mist suppressant to the electrolyte increased the nanohardness of the deposit around 31 and 72%, respectively. The increase in Ni deposit hardness may lead to a decrease in the material ductility, thereby affecting the stripping and cutting of Ni sheets. Our findings may be helpful since strong adverse effect of some organics that may be present in the electrolyte were identified, thus the industry can control and optimize the organic´s dosage in the corresponding operations.

The accident-prevention record of the coal-mining industry in the United States was more favorable in 1936 than in 1935, both from the standpoint of the relative safety of the individual miner on the job and of the price in life and limb that the Nation paid for its year's supply of coal. The increase in relative safety of the individual miner was indicated by a lower death rate and a lower injury rate than in the preceding year per million man-hours of exposure to the hazards of mining; that is, per million hours of work performed by the employees. (See table 1.) A reduction in the price in life and limb that the Nation paid for a year's supply of coal was indicated by a smaller death rate and a smaller injury rate per million tons of coal produced. Thus the individual miner was a better insurance risk, as far as accidents were concerned, in 1936 than in 1935, and a ton of coal used in the homes and industries of the country represented less human suffering than in 1935. The two points of view are distinct, and both should be kept in mind when considering accidents and safety in coal mining or in other industries. More men were employed in 1936 than in 1935, and more workdays were available for the individual miner. Large gains were also made in the total number of man-shifts and man-hours worked in the industry as a whole. In number of tons of coal mined, 1936 showed large gains over 1935. Moreover, the average output of coal per man-hour worked was higher in 1936 than in 1935. All of these gains were made without lengthening the average number of hours of work per man per day.

The Holmes Safety Association was organized and named in honor of the late Dr. Joseph A. Holmes, first director of the United States Bureau of Mines. The association is a national organization and operates through local, sectional, or State chapters in mining, petroleum, and allied industries. The National Council of the Holmes Safety Association consists of representatives of State councils and local chapters, with the Director of the Bureau of Mines as president.

A mathematical model of a decision is represented by the table in Figure 4. The numbers in the matrix are a measure of the effectiveness of each alternate for an objective. In this case, it is the per cent of desired profit that is satisfied by each alternate for each objective. By adding all of the values in a row, we have a measure of which alternative is best for both objectives. However, if you think that alternate 1 is necessarily better than alternate 2, you are wrong. Why? Because the weight of the objectives may not be equal. It could just be that this plant can sell more than it can produce, so that the loss in profit represented by increased sales is more than twice as important as reductions in costs. (See Figure 5). In that case, let us weigh objective 1 as 30 per cent and objective 2 as 70 per cent. It must also be obvious that the sum of all the "objective weights" must equal 100 per cent. Now, by evaluating our alternates according to their weights. we find that alternate 2 is better than alternate

The theory of sampling (TOS), and therefore representative sampling, is based on three fundamental principles: sample correctness, which handles the search for non-bias; segregation, the effects of which must be eliminated or minimised; and variance control to help achieve the desired reproducibility. After briefly reviewing these very few, albeit essential first principles of Gy’s TOS, the state-of-the-art in TOS is examined through the prism of these principles and the prospects for the future are explored, with suggestions for further research where relevant. Regarding segregation, which is currently the focus of much research, new orientations are proposed. For correctness, which takes on a major importance when it comes to sampling devices, some new, important principles that have been put forth by recent research, are described in details.CITATION:François-Bongarçon, D, 2014.
