The Bituminous Coal Industry has for the past year been faced with a most serious problem. I am sure that you have had your own individual and local problems, as do we all. In my thirty years of practical experience with coal mining, I have never found an operating man nor a coal mine without problems. The very nature of mining, with so many unknown factors involved, precludes the absence of problems. But they are not insurmountable, and one should not dwell on them interminably. They should be recognized as a challenge to our ability and ingenuity to solve them, and once the proper solution is found, it should be applied and the problem dismissed. However, we find ourselves at the moment in the midst of a serious challenge to our very existence. In the early thirties, many in the industry welcomed the re-establishment of Unionism as a balance wheel, in the belief that the stabilization of wage scales would also stabilize prices and eliminate disastrous price cutting practices. The ultimate effects of having twenty-six years of benevolent paternalism in the administrative branches of Federal and State Governments with their labor courting policies, could hardly have been anticipated. And so with wages spiralling under government sponsorship, we have finally reached the point where competitive fuels, such as natural gas and oil are more attractive to the consumer, from the economic angle of cents per BTU cost, than coal.

Thank you very much for that introduction. I spent part of my early career in the coal industry here in Colorado, and I am always happy to return. In such a beautiful setting, it seems out of place to talk about "Improving the Climate". But in our work-a-day worlds, we know the climate for the coal industry is something less than picture perfect. But unlike Mother Nature's climate, there are some things we can do about the climate for coal. Today, I want to talk to you about sonic of the activities that we are engaged in... and that you can support... to improve that climate. A number of challenges and opportunities face our industry. I will try to set the stage for this conference by briefly describing the current climate for coal - which is indeed very challenging. I will then outline some of the steps we are taking to broaden our base to include our allies in the rail and electricity industries and the public at large.

The eighth annual RMCMI Mine Rescue Evaluation was held during the 1999 Institute convention at the Crested Butte Marriott Resort, Colorado. [ ] Elliott Tsosie, Mary Rowell, Janna Aune, Guy Horton, Art Saenz and Bill Balaz were pleased with the 1999 Mine Rescue Program, The Mine Rescue committee is but one of 17 volunteer committees; this one co-chaired by Bill Balaz, Elliott Tsosie and Janna Aune. There were three evaluators, Art Saenz, Western Environmental; Mary Rowell, ProCare and Guy Horton, Horton Rope Rescue. Nine teams participated and brought 89 participants, 26 spouses, nine children and five teens. The teams were BHP LaPlata, BHP Navajo, BHP San Juan, all from Farmington, NM; Bridger Coal Co., Rock Springs, WY; The Coteau Properties Co., Beulah, ND; Northwestern Resources, Jewett, TX; Powder River Coal Co., Gillette, WY; Solvay Minerals, Green River, WY and Western Energy Co., Colstrip, MT. To observe were members from Centralia Mining Co., Centralia, WA. [ ] Evaluators: Mary Rowell, Guy Horton &Art Saenz The three professional evaluators provided challenging scenarios for the Mine Rescue participants on the grounds of the resort property. Some attending convention were alarmed to see stretchers with "victims" and phoned the hotel switchboard to report the catastrophe. Team members had no prior knowledge of what the scenarios might be and derails were provided only as they arrived at the scenario location, with one exception. Seven to ten or more articipants make up each team. Some teams also ring an alternate and team trainer. For identification purposes, the "victims" wore white shirts emblazoned both front and back with a red VICTIM designation. There was a staged demonstration by three response teams who had not previously worked together. This was enacted on the convention floor following a Technical Session meeting attended by about 200 members. Three response teams from BHP's Navajo and San Juan Mines together with Coteau Properties' Freedom Mine provided a demonstration of their response skills. For never having worked together before, they presented a very professional enactment. This is described at length in the Welcome Session copy. Training sessions were held Saturday and Sunday to enable the teams to prepare for the scenarios. A swap meet was Saturday evening for teams to swap hats, shirts, belt buckles, stickers etc. Each participant received a royal blue golf shirt and ivory cap with royal blue bill. Culmination of the Mine Rescue program was a Tuesday morning Awards breakfast when teams were presented with jade acrylic plaques. [ ] Teams participating in the Mine Rescue Evaluation received trophies on Tuesday morning. The 73rd Regular Meeting of the Rocky Mountain Coal Mining Institute convened at The Mark Conference Center, Lionshead Village, Vail, Colorado, and was in session at 10:00 a.m. Past President, Robert W. Wilson, President and General Manager, K&P, Inc., Golden, Colorado, called the meeting to order. The membership was asked to stand and pledge allegiance to the flag. As your immediate past president, it is my pleasure to have the responsibility of introducing our current President. But before I tell you about Ralph, I would like to make the following brief reflection, which I feel very strongly about: In these days of so much negativism toward our coal industry by so many people, we all must remember one thing as we go about producing energy for our country. Coal mining is just as American as the American hamburger, the American hot dog, and just as American as the flag to which we just pledged allegiance.

Mr. Chairman and Gentlemen: The subject assigned to me would cover a great many pages if it were gone into thoroughly. Therefore. I have just touched on a few of the most important points. I think that everyone engaged in the production of commercial coal understands all about its preparation, but I will set forth my views as to how I believe it is best accomplished. In order to produce the best prepared coal, your first attention should be to the miner at the working face. The most careful system of blasting should be adopted to avoid heavy charging of holes which results in the shattering of the coal. The lump, or any other screened sizes that may be screened from coal that has been improperly shot, are subject to greater degradation in transportation and handling, as well as reducing screened sizes, which results in dissatisfied customers in the first case, and lower realization in the latter.

It's my pleasure to welcome the Rocky Mountain Coal Institute to Montana. Now that you've ended a 74 year history of meeting outside our borders, I hope you'll be back more often. Even if I can't convince you to come back before 2060, when another 74 years will be up, I'm confident the Kalispell and Flathead Lake area will do the persuading for me. In recent weeks, I've made a number of speeches around the state pointing out just how wrong the revenue projections in Montana's state government made in April of '85 were when we came to April of '86. Since the middle of this month, Montana's legislators have been in Helena struggling to balance a state budget that, by the end of fiscal year '87, threatened to be some $88 million in the red. Other western states reliant on natural resource and agricultural economies have found themselves caught in the same deflationary spiral. The "window of opportunity" I proposed and the 1985 Montana Legislature passed, couldn't have been opened at a more difficult time. What was envisioned as an incentive to expand Montana's coal production, and our tax base, ran aground on low oil prices and excess hydroelectric power. De- spite the one-third severance tax rebate offered on new coal production, year-to-date figures published in the June 2nd Coal Week show that production in Montana is down almost 10 per- cent from last year. Again, we're not alone. Production in Wyoming is down 8 percent and in North Dakota, it has dropped 13 percent. An over- all 3 percent production decline in western states looks even worse when contrasted against a 12 percent increase for your eastern competitors. Montana's "window of opportunity" had the potential to be a significant signal to your industry. That potential was quickly tempered by the inability of Arab nations to stabilize world energy prices. If any of us had forgotten, the last twelve months have reminded western states that the well-being of our natural resource economies has a tremendous impact on the ability of all levels of government to provide services. The past year has also driven home that in the world of business and in the business of the world, risk-taking is still the name of the game. The Western Governors recognize the problems facing this industry - and our states - and we're prepared to fight for the future of western coal. In the past two decades, legitimate environmental concerns have created a vast body of new legislation affecting coal producers. The industry has been required to meet new reclamation standards - tough regulations relating to ground water, air quality and wildlife habitat. To the industry's credit, coal companies have hired professionals with the technical know-how to do it right. Rather than considering reclamation laws to be an unreasonable burden, today's coal company is more likely to view its reclamation efforts as a source of corporate pride. In a sense, the industry and the agencies which regulate it have matured together . . . although at times OSM is reluctant to admit that either of us capable of or willing to play by the rules. Certainly some abuses exist and OSM's oversight has been helpful in ensuring parity between those states willing to comply and those that would rather defy federal law. Nonetheless, penalizing the more modem and responsible western coal industry for abuses that occur elsewhere is both unfair and counterproductive. Federal penalties range from "cruel and unusual" reporting requirements to the proposed electricity tax that would effectively force utilities and ratepayers who have already met the sulphur emission standards to subsidize those who have dodged their cleanup responsibilities. Members of the Institute: It is with great pleasure and honor that we welcome you to the thirty-ninth regular meeting of the Rocky Mountain Coal Mining Institute. I assure you that Mr. Krippner, the General Chairman, and his associates have an outstanding program in store for you, and trust it will be of much interest to the industry. I note by the program they have me slated for an opening address, but I am going to defer that, proceed with the remainder of the program, and endeavor to go on schedule and keep matters on schedule as outlined on our program. The first item on the program is the reading of the minutes of the thirty-eighth regular meeting by the Secretary. I might say that it has been customary in the past that we omit the reading of the minutes. If that is not agreeable, we will read them; otherwise, I would like for someone to make a motion that we dispense with the reading of the minutes, inasmuch as they are published in our annual report each year. Hair, General Superintendent, Coal Mines, Colorado Fuel & Iron Corporation, Pueblo, Colorado, opened the meeting at 10:00 a.m. "I will now call the Fifty-Third Regular Meeting of the Institute to order this morning and welcome the members and the guests. I'm on the program to introduce John Peperakis, President of the Institute for this year. I regret to announce that Mr. Peperakis received word this morning of an emergency at his mine and left to attend to this. We hope it is of a minor nature and he will return. (Editor's Note: Please refer to the index for printed text of the President's address which he had intended delivering, had he not been called away.) However, in the meantime, Robert von Storch has graciously consented to act as president until John Peperakis returns. "I needn't tell you who he is. Robert M. von Storch is General Superintendent of Coal Mines and Quarries, Columbia-Geneva Steel Division, United States Steel Corporation, Columbia, Utah. I now present Bob von Storch." Mr. von Storch: "As most of you know, the Rocky Mountain Coal Mining Institute cannot compare to the Mining Congress, as it is not a professional organization. It represents the coal operators in New Mexico, Utah, Colorado, Montana and Wyoming. We have a group of volunteers to put this together and use this occasion to get together and exchange ideas.

Discussion was prepared by A. L. Jones and Frank A. Rank, of the General Electric Company, read by Mr. Jones; by C. B. Officer, of the Sullivan Machinery Company, read by Mr. J. H. Emrick; by Mr. D. C. McKeehan, Chief Electrician of the Union Pacific Coal Company; and by Mr. L. C. Ilsley, of the United States Bureau of Mines, read by Mr. K. P. Marshall. Their prepared answers are inserted in the body of Mr. Harrington's paper, as answers to his questions. Introductory Remarks PRESIDENT MARKS: We have made special assignments for the discussion of this paper, and I believe these discussions are to be answered in sections, and as the different sections are read applying to this paper, we will just have a brief discussion on that particular point and proceed to the next and try and expedite this discussion as much as possible, be- cause I realize a good many of you have something to say. The first discussion is by Mr. Frank A. Rank, of the General Electric Company, Salt Lake City. MR. F. A. RANK (General Electric Company, Salt Lake City, Utah) : Mr. Chairman, while my name has been put on the program as being the one to discuss this paper, I believe Mr. Jones of our company has prepared a discussion on it, and therefore will let him talk in my place. MR. A. L. JONES: I think that it is passing the buck. However, Mr. Rank sent me a copy of the paper, and I read it over with a good deal of interest. There is one thing I want to say: Mr. Shubart, in his breezy letters, stated this paper was to be written by Mr. Harrington, assisted by a number of manufacturing and operating companies, among them the General Electric Company. We did not function. The paper was completed, and we were not consulted, and I believe that is true of the others. After reading the paper over, I dictated a few notes which I want to read, to give you the view-point that we have on the subject We do not want to minimize electrical dangers, or in any way slow down high-grade construction maintenance, but there is such a thing as overstating the case. It is so full of condemnation of most existing practices and conditions that it reminds me somewhat of the nerve-racked mother who sent an older brother to see what Willie was doing and to tell him to "stop it." His recital of electrical dangers is harrowing and if I felt it were a true picture I should feel that any of us having anything to do with the recommending or selling of electrical equipment for mines would be party to a crime. "It now becomes my privilege and duty to call to order this fifty-first meeting of the Rocky Mountain Coal Mining Institute. "I bid you a hearty welcome and I know by your attendance at these meetings you will gain a great deal of valuable information, as well as have a wonderful time. "We have been very ably represented by Mr. John H. Emrick as General Chairman, assisted by our good friend Mr. Fred W. Whiteside, our secretary and treasurer. I know they have worked very hard in selecting the various committees, who in turn - by the looks of our program have gone all out to prepare material that should be of great interest to us. I trust we will be attentive to the subjects presented and freely enter into the discussions, also relating our problems and experiences. I am sure this will prove both profitable and beneficial to all present. "The main purpose of these conventions is to become acquainted with each other, renew old acquaintances, talk over our problems, and have a little fun and relaxation from our every day routine. "Let us not forget the manufacturers, the distributors, the operators, or the press because it is through their splendid support that this organization is successful. "Since our last meeting we have gained many new members, whom we especially welcome. We are sorry to have lost a few. I am mindful, at this time, of two very good members from my home state who have passed away, Walter Wetzel, a former president of this institute, and Lee Alger, at the time of his death, Vice-President from Utah. We also lost very recently our assistant Secretary-Treasurer, Everret Davis. These men contributed a great deal to the institute and the coal industry in general. I am sure they are greatly missed by all who knew them."

Presiding was Robert E. Murray. The first speaker was Frank L. Natta, Administrative Manager-Trapper Mine, Utah International, Inc., Craig, Colorado. Subject - "Long Term Coal Contracts." Mr. Natta graduated in 1973 from Colorado School of Mines with a B.S. in Metalurgical Engineering and a M.S. in Mineral Economics. Since 1974, he has been employed by Utah International having spent 5 years in San Francisco as Senior Market Analyst. In this capacity he was responsible for market development efforts for Utah's U. S. coal reserves. Recently, he was transferred to Craig, Colorado, as Administrative Manager of Utah's Trapper Mine. In this position, he is responsible for purchasing, warehousing, accounting and sales contract administration. The second speaker was Brucks Mitchell, President, Human Resources Management, Inc. Richardson, Texas. Subject-"Making Unions Unnecessary in the Coal Industry." Mr. Mitchell has a B.A. degree in English-Oklahoma State University. M.B.A. degree in Organizational Behavior-Southern Methodist University. Ph.D Candidate - Organizational Behavior - North Texas State University. Mr. Mitchell formed an Association of Consultants to perform assignments in Industrial Psychology and Human Resources Management. Particular emphasis has been to establish policies and procedures to make labor unions unnecessary. He has been consultant to various industrial and municipal organizations.
