In 2006, the Mine Improvement and New Emergency Response Act (?2006 MINER Act?), Pub. L. No. 109-236, 120 Stat. 493 (2006) was enacted in a bi-partisan move to strengthen the 1977 Mine Safety and Health Act. This action followed several underground coal mining accidents at the Sago and Aracoma Mines in West Virginia and the Darby Mine in Kentucky. The focus of that legislation was, in part, to force technological development and implementation. It involved the recomposition and training of rescue teams. Requirements for sealing worked out areas of mines were changed when MSHA invoked its Emergency Temporary Standard (?ETS?) authority for the first time in many years. Increased penalty amounts were established for certain types of violations for all types of mining, and minimums were set for unwarrantable failure violations issued under Section 104 (d)(1) and (d)(2); 30 U.S.C. Section 814 (d)(1),(2). The entire 30 C.F.R. Part 100 penalty criteria was revamped in a rulemaking, effective in April 2007. The visions were ambitious and noteworthy and those in industry and government have spent the last four years working through the aftermath of intended and unintended consequences of these changes. The penalty structure arrived at in 2007 has proven unwieldy and has contributed to the increase in contested caseload now before the Federal Mine Safety and Health Review Commission. In essence, litigation under the Mine Act ground to a virtual halt when the number of cases increased but the budget for Administrative Law Judges, who hear the cases, and the Solicitor?s office who represents MSHA, was not increased. Addressing the backlog effectively was one of the major challenges when Joe Main was confirmed as Assistant Secretary in early 2010.

Inauguration of the new political dispensation in South Africa in1994 initiated a dynamic shift in the ownership, management and development of the country?s affluent mineral heritage. The process of substituting the old South African regime with a new equitable system started soon after the 1994 election of the African National Congress (ANC) to parliament. The Congress?s Freedom Charter revealed the intent of the new dispensation when it called for radical transformation of mineral development. However, since then there have been important changes affecting the rules of mineral development. These are: ?A drastic change in politics ushered in by negotiation, a spirit of reconciliation and a desire to settle disputes peacefully ?The globalization of the South African mining industry in tandem with the opening of domestic mineral resources to foreign capitalists and ?The introduction of sustainable development as a holistic approach to mineral development in order to replace traditional narrow-minded environmental management. Each of these significantly shaped the new mineral investment environment of South Africa. This paper represents a summary of the historical developments leading to the current Mineral and Petroleum Resources Development Act No. 28 of 2002, its regulations, the much publicised Broad-Based Socio-Economic Empowerment Charter, its associated Scorecard, and the Draft Royalty Bill.

This research report was produced in response to the release of the Mineral and Petroleum Royalty Bill. It involved are view of the mineral investment environments of selected countries in order to form an opinion on the appropriateness and competitiveness of the proposed royalty structure for South Africa. Many emerging countries have recently attracted a significant share of foreign investment, as a direct result of changes in policy. These are, by implication, the least risky and most favourable destinations for the ?investment dollar?. The five most competitive countries, namely Chile, Argentina, Peru, Mexico and Brazil have been identified as succeeding with their policy visions of creating favourable domestic investment environments. The investment rules of these countries served as a basis for the compilation of a Competitive Investment Framework (CIF). This is a template of best practice against which other investment environments, such as that of South Africa, can be measured. The framework indicates that mineral royalties should ideally be no more than three per cent, demonstrating that the regime proposed in the Royalty Bill is out of step with international best practice. Mineral royalties can never be viewed in isolation and in the assessment of the rates proposed in the Royalty Bill, one must consider the total taxation package. Such assessment appears in Section 5 of this report, demonstrating that there is reason for concern if National Treasury were to impose the rates stipulated in the Royalty Bill. The alternatives, conclusion and recommendations of the review appear in Sections 9 and 10. These are the result of independent analysis and assessment of the fundamental principles. It is done through the application of a Competitive Investment Framework that avoids the highly subjective and emotional views that often accompany a process like this.

The following note on the mineral association in the ores of the Tennant Creek Goldfield, Northern Territory, is largely based on Mineragraphic Reports Nos. 49, 89, 117 and 193 of the Council for Scientific and Industrial Research. These reports are the results of the examinations of auriferous specimens from a number of mines of the goldfield and are now supplemented by the examination of further specimens from Mt. Samuel forwarded by Mr. V. G. Martin.The Tennant Creek Goldfield lies in the central portion of the Northern Territory, about Lat. 190 35', Long. 1340 15', on the Overland Telegraph Line and about 369 miles north of Alice Springs. It comprise an area extending about 50 miles east and west, by 30 miles north and south.The geology of the goldfield has been described by Woolnough. (2)The rocks of the area are of pre-Cambrian age, and consist of talcose, chloritic, micaceous and siliceous schists of sedimentary origin, interbedded with flows or dykes of schistose quartz porphyry, and of granites which were intruded subsequent to the regional metarporphism of the area. The rocks are moderately folded, but the beclding tends to be obscured by a pronounced east-west cleavage. The most continuous orebodies run east and west, parallel with this cleavage.Numerous lenses of hematite occur in the schists, with their long axes, parallel to the cleavage, and the gold values of the field are frequently associated with such hematite bodies. The dimensions of these hematite bodies are variable but rarely exceed a length of 300 ft., with an average thickness between 10 and 30 ft.; the original vertical dimensions are thought to be comparable with their length. The lenses tend to occur in groups when they are arranged en echelon both horizontally and in depth; and erosion has exposed individual lenses to different degrees, ranging from incipient exposure to complete removal. The existence of unexposed hematite lenses at depth has been proved by geophysical surveys, coupled with drilling tests. (3)A few of the bodies are pipe-like. Many are surrounded by a casing of brecciated rock, composed of fragments of hematite and shattered country rock, and presumably caused by subsequent earth movements which crushed the country rock against the resistant hematite bodies. In the early days of the field most of the important gold occurences were found within these crushed zones, or, to a less extent, within the hematite bodies themselves.These occurrences appeared to be associated only with those hematite lenses which were intersected by quartz veins or other lines of weakness, of later origin than the crushing. Ore from the Hill 50 Gold Mine, consists essentially of pyrrhotite, with minor amounts of pyrite, chalcopyrite, galena and gold, replacing "jaspilite." The gold is associated with the sulphides as shotty particles. About 8 per cent. of the particles are less than '0.010'mm.The Hill 50 Gold Mine, at Boogardie in the Murchison goldfield, about 300 miles north-west of Kalgoorlie, was first operated in 1898. From 1898 to 1917 it yielded 20,000 short tons of ore for a recovery of 6,225' fine oz. gold, equivalent to a recovery grade of 6.22 dwt. gold per ton.The present company since the beginning of its operations in September 1936 to June 30, 1954, produced 811,081 short tons of ore for a recovery of 242,554 fine oz. of gold, equivalent to a recovery grade of 5.98 dwt. gold per ton.The grade of ore (recovery grade) has shown a remarkable variation with depth. From the 120 ft. Ievel to the 300 ft. level, it averaged about 7.5 dwt. Au per ton. Below the 300 ft. level it declined, and from 300 ft. to 400 ft. averaged 4.9 dwt. per ton, falling further with increasing depth to about 4.5 dwt. per ton at the '600 ft. level.On the 820 ft. level the grade improved sharply to about 14 dwt: per ton, and this grade has persisted down to and on the 1060 ft. level.The orebody has been described by Finucane (1953) as a series of lenses of finely banded jaspilite conformably enclosed by greenstones. The jaspilite is tightly folded and faulted and intruded by dykes of felspar porpnyry.Mineralization is practically restricted to the jaspilite.

A suite of specimens from the newly developed Black Star copper ore body at Mount Isa was made available for mineragraphic study by the Mount Isa Mines, Ltd. The specimens were selected as representative of the different phases of mineralisation found in the ore body, rather than with a view to furnishing a complete cross-section of it; and the examination has been carried out with a view to ascertaining (1) the nature, extent and association of the arsenic, antimony and possibly bismuth, minerals in the ore, (2) the mode of occurrence of silver in the ore, and (3) whether galena and sphalerite occur in minute forms well below the sIzes readily observed in hand specimens.Analyses of the January to June, 1944, mill head composites show that the proportions of the elements Ag, As, Sb and Bi in the ore are as follows:Ag 0.000013 = 0.35 oz./tonAs 0.024Sb 0:002Bi 0.0005The copper content of the mill heads ranges from 3.5% to 4.75%, the lead content from 0.03% to 0.08,% and the zinc content from 0.09% to 0.23%.MINERAL COMPOSITIONThe specimens range from massive sulphide ore, consisting of areas of chalcopyrite, pyrrhotite, and rarely sphalerite, from 1 to 3 cm. across, to fragments of extremely finely banded pyritic shale in which no minerals other than pyrite are visible. The gangue associated with the massive sulphides is chiefly dolomite, and sometimes white quartz. The pyritic shale fragments show evidence of shearing and faulting on a micro-scale, the fractures sometimes being filled with sulphides and vein minerals.The ore minerals found in the polished sections are pyrite, arsenopyrite, marcasite, sphalerite, chalcopyrite, valleriite, chalcostibite, galena, dyscrasite, jamesonite, magnetite, gold, graphite and rutile.Pyrite (FeS2)Pyrite occurs chiefly in two forms according to whether deposition took place along the bedding planes or along the intersecting faults and fractures. The 53 countries that constituted Africa in 1992 accounted for a significant portion of total world output of a number of mineral commodities. However, the continent's total output for a number of major mineral commodities declined relative to the volume produced during 1991. (See tables 1 and 2.) The most conspicuous declines in mineral production from 1991 to 1992 were for cobalt and copper (declines of 28.6 % and 23.4 %, respectively), which could be partially attributed to mining and metal processing difficulties caused by political and economic disruptions in Zaire and for uranium (12 % drop), for which much of the continental production decline was ascribed to Namibian cutbacks in response to lower world prices. The severe regional drought also adversely affected the mineral industry in a number of sub-Saharan nations.

This section of the Minerals Yearbook reviews the minerals industries of 29 countries: the 12 nations of the European Community (Belgium, France, the Federal Republic of Germany (FRG), Italy, Greece, the Netherlands, Denmark/Greenland, Spain, Portugal, Luxembourg, the United Kingdom, and Ireland); 6 of the 7 nations of the European Free Trade Association (Sweden, Nor-way, Finland, Iceland, Austria, and Switzerland); Malta; the 8 Centrally Planned Economies of Eastern Europe (the German Democratic Republic (GDR), Poland, Yugoslavia, Albania, Hungary, Czechoslovakia, Romania, and Bulgaria); and the U.S.S.R. Western Europe Western Europe [loosely defined to include the 12 nations of the European Com-munity (EC) and the 7 nations of the European Free Trade Association (EFTA)] is the single largest trading area and consumer of raw materials in the world. If Western Europe was at one time an important mining sector, it has now increasingly relegated the role of supplying minerals for its minerals processing industry to its ex-colonies in North and South America, Africa, and Australia. In this regard, Western Europe is the most important determinant of raw materials consumption (and thus raw materials production). There is an important reason for this since Western Europe lies somewhere between Japan at one extreme and the United States and the U.S.S.R. at the other extreme as regards the availability of natural resources.

This regional report covers the mineral industries of Canada and 40 countries and areas in Latin America and the Caribbean Basin. Also included is a brief description of the mineral potential of Antarctica. The Latin American region encompasses an area twice that of the United States. Latin America and Canada have a rich and diversified endowment of mineral fuels, metals, and industrial minerals. Tables 1 and 2 provide a summary view of Latin America and Canada's output of its major mineral commodities in world mineral supply in 1990 and 1991. Table 3 shows the relative importance of a selected group of minerals produced in Latin America in the world mineral economy.

At the last annual meeting of this Institute the programme very properly was drawn up and carried out with the special object of calling attention to the Dominion's position and problems with regard to fuel supplies. That subject, always one of serious concern, was a source of considerable anxiety twelve months ago. It is still so, but in a decidedly less degree than at that time. So far as the immediate fuel situation is concerned our anxieties have been relieved. And I think we can safely say that such a consciousness of our difficulties and determination to overcome them, has been developed in the minds of our people that there will be no slackening of the offensive until a final solution is reached. In selecting a subject of major importance for the present occasion I have felt free to digress from the pressing problems of last year and to go back, for a starting point, to the presidential address of two years ago .. I do not, however, wish to enter the controversy that has developed as a result of that address, though in spite of my own failure to amass a fortune from participation in certain mining ventures, I am decidedly inclined to the optimistic view that Dr. Corless presented of the future of our mining industry. You will perhaps have observed that in its general wording the title of my paper bears a marked resemblance to that of that address. This simila1ity of titles is not accidental. It is intentional on my part.

RECORD production of marble, kaolin, scrap mica, and talc high-lighted the mineral industry of Alabama in 1962. Among the States, Alabama ranked second in scrap mica, third in the production of bauxite and native asphalt, and fifth in iron ore. The mineral industry of Alabama was dominated by mining and processing of coal and iron ore, and the manufacture of cement, which together comprised 73 percent of the total value of production, compared with 72 percent in 1961. Other important industries were the production of crude petroleum, and stone quarrying. Leading companies were Tennessee Coal & Iron, Southern Cement Co., Southeastern Electric Generating Co., Alabama By-Products Corp., and U.S. Pipe & Foundry Co.

Alabama's non fuel mineral industry produced $560.6 million of mineral commodities in 1990. This was an increase of $99 million over the 1989 value and a new State record, a record achieved despite the slowdown in the national economy. This was the first year that Alabama's mineral value exceeded one-half of 1 billion dollars. The value of stone and cement, the two leading mineral commodities in terms of sales, increased $71 million over that reported for 1989 and was the primary reason for the new mineral value record. The State ranked 21st among the 50 States in total mineral value and contributed 1.68% of the total U.S. mineral value of $33.3 billion.

AGAIN in 1963, as in nearly every year since 1946, the Canadian mineral industry has established a new national record in value of mineral production. The 1963 estimated total value of $2,976 million is 5 percent higher than the 1962 value of $2,845 million.2 As in previous years, metals made up more than half the value of total production. For selected years since 1949 the category percentages and total value are as follows: [ ] Crude petroleum, Canada's most valuable mineral product, accounted for 21 percent of the total value of minerals in 1963. In descending order came nickel 12 percent, iron ore 10 percent, copper 10 percent, gold 5 percent, and uranium 5 percent. Asbestos accounted for 5 percent, sand and gravel 4 percent, and cement 4 percent. The complete list of Canada's mineral products includes more than 50 basic commodities.

Mineral output and trade in the Central American countries were directly or indirectly affected by the sometimes violent civil unrest and recessionary economic developments that have pervaded the region for several years. Central American countries found their foreign exchange export earnings and traditional market areas shrinking while essential import costs were rising. Restricted spending measures were adopted by governments and private industries. Domestic investment funds for mineral development and exploration projects were among the first casualties of these austere budgetary measures, especially since weak demand and depressed mineral prices diminished the probability of a favorable cost-benefit ratio. The lack of physical security and political stability also discouraged private foreign investment. The United States Congress enacted the Caribbean Basin Economic Recovery Act of 1983 (19 U.S.C. 2702), more popularly known as the Caribbean Basin Initiative (CBI). This legislation was designed to stimulate economic recovery and promote economic development by increasing private investment and trade in the Caribbean Basin countries. The act provided for the elimination of U.S. duties on most trade items imported directly from eligible Caribbean countries, provided at least 35% of the product value originated in the region. The financial assistance components of the CBI were to be supportive of the basin's private sector as well as assist general economic stabilization programs.

The Government of Belize maintained strict control over spending in 1982 as a means of protecting its import-dependent economy against the effects of a general worldwide recession. The modest economic performance was not expected to differ substantially from the $152 million2 gross national product (GNP) estimated for 1981. Exports and reexports were expected to decline in 1982, partly as a result of the Mexican peso devaluation. Imports were also expected to decline slightly in 1982, but the overall trade deficit was projected some-what higher than the $44 million experienced in 1981. On September 21, 1982, Belize became an independent state. As a result, the new Government became eligible for assistance from international organizations such as the International Monetary Fund, the International Bank for Reconstruction and Development (World Bank), and the United Nations Development Program (UNDP). Belize's independence from its former status as a colony of Great Britain was marred somewhat by the unsettled territorial dispute between Great Britain and Guatemala. Guatemala declared Belize was a part of Guatemala and. therefore. refused to recognize it as an independent state. Negotations between Great Britain and Guatemala continued without resolution.

Mining activity during 1977 was limited to the production of limestone, marl, and sand and gravel, all of which were used domestically. Public works projects consumed the major portion of the construction material produced. The consortium of oil companies operating as Esso Ventures Inc., drilled one exploratory well off the coast of southern Belize. For drilling the well, Exxon Corp. received a 57% working interest in the consortium's concession located 40 kilometers east of Puta Gorda. No other offshore drilling was attempted in 1977. Esso also drilled a well on the Anschutz Overseas Inc. concession in the Toledo District of south- eastern Belize. The attempt wee abandoned, but seismic activities continued.

The Belize economy recorded modest growth during 1980; the growth of the gross domestic product (GDP) in real terms was between 1% and 2%. At current prices, the 1980 GDP reached $108 million2. This output was largely attributed to the performance of a few industries, mostly nonminerals. Such performance improved significantly the balance of payments situation by reducing the deficit from $19 million in 1979 to $4 million in 1980. The rate of inflation was an estimated 18% in 1980 and would have been greater if not for a conservative monetary policy and price control on a number of essential items. Expert earnings increased $43 million, or 50%, from the 1979 level. After increasing more than 25% in 1979, imports increased only 6% in 1980 to a level of $141 million owing to the decline in investment and stabilization of petroleum prices. The balance of trade deficit was $9.8 million in 1980, a marked improvement from the 1979 level of $45.1 million. The mineral output for Belize accounted for only a fraction of 1% of the GDP. Such activity was limited to the production of limestone, marl, and sand and gravel, all of which were primarily used in construction of the Northern Highway between Orangewalk and Belize City. Mineral resources are deficient or nonexistent in Belize for the majority of metals and nonmetals, although the Government and others continue to believe that petroleum must exist in Belize. The proximity to Mexican oilfields and the growing finds in the Peters area of Guatemala support this expectation. The Belizean economy registered a modest real growth of 1.3% during 1981. The gross domestic product (GDP), based on current prim was $121 million' with an inflation-rate of 10%. The country received $19 million in economic aid during 1981. In early 1981, Belize'e four commercial banks raised the interest on deposits to 15% in an effort to curb capital outflow. During 1981, the financial situation deteriorated somewhat, particularly the balance of payments. For the year the total value of imports exceeded exports by almost $38 million, while the Government continued to maintain a fairly free trade policy. Import duties and term averaged about 8% on essential item and 40% on nonessential ones.

The only mining activity in Belize during 1976 involved the production of construction aggregates, which were used domestically. A comprehensive ordinance regulating mineral prospecting and mining was proposed during the year. Under the ordinance, which would supersede all grants and titles, ownership and control of all minerals except petroleum would be vested in the Government. Exxon Corp. entered into an agreement with three oil companies to achieve a majority interest in nine oil prospecting leases covering 1 million acres, mostly offshore Belize. The agreement was with Weatherford International Inc. which had 30% interest in the leases, Ajax Petroleum Co. with 40% interest, and Canadian Superior Oil Ltd, with 24% interest. A new entity, Esso Ventures Inc., was established to be responsible for conducting extensive geophysical operations and drilling an exploratory well offshore Belize.
