Under the United Nations Convention on the Law of the Sea (UNCLOS), the international seabed area (Area) and its resources are the common heritage of humanity (CHH). Patent rights can be incompatible with the CHH doctrine and its underlying principles because patent holders might charge unjustifiably high prices to license patented technology for exploring and exploiting the Area’s resources (creating a "patent holdup" situation), might choose not to license, or might license exclusively when doing so would contravene CHH principles. However, a reasonable patent licensing regime can contribute to sharing the benefits derived from the Area and promote environmental sustainability. Provisions of the UNCLOS that stipulated compulsory technology and financial transfers were removed in the 1994 Agreement relating to the Implementation of Part XI of the UNCLOS (1994 Agreement), but to promote equity and sustainability I propose a voluntary licensing regime modeled on the concept of reasonable and non-discriminatory patent licensing (RAND) that has been used in other contexts. The International Seabed Authority (ISA) or another entity will need to coordinate and promote this licensing regime through governance of intellectual property (IP) derived from the Area. This proposed approach can better effectuate the CHH doctrine and its underlying principles.

This restricts the visibility around the machines even further. To help address these problems, the U.S. Bureau of Mines has developed a PC based software package to aid in the analysis of certain human engineering aspects of mining equipment design. The software is available for use by equipment manufacturers and mining companies for design work on new machines, as well as for evaluating proposed modifications to existing machines.

The usual tasks performed by a mine store include .removal, replenishment, ordering and deletion of items and updating of stocks. A personal computer Mine Store Inventory Database System MIDSYS for monitoring stocks in such a store is presented. The system consists of series of relational databases developed in dBASE III+ environment. The system has three main modules comprising of a store management module, a display module and an employee-store operation module. The third module is useful in tracing movement of store goods. The MIDSYS is menu .driven with help functions at all levels.

Following lip on a USBM-sponsored research project, the authors have utilized the knowledge-base structure and system concepts from the Sun Sparcstation-based worker scheduling system of the Mine Management Support System to develop a PC-based application. The new software adopts the nested-window concept to facilitate data collection and modification on personnel, their availability on a shift, and work priorities for a shift as well as to allocate manpower optimally on a work shift and delineate supervisory training responsibilities. The various components of the software are described in detail, along with enhancements made to the original system.

The performance of five dense-medium washers was evaluated in four preparation plants. Three of the plants were making a two-product separation that produced a clean coal and a refuse; one plant employed dense-medium vessels in series to effect a primary and a secondary separation. The secondary drum-type washer produced a low-ash metallurgical coal and an intermediate-ash product suitable for plant fuel or steam generation. The sharpness-of-separation was excellent for all four primary separations and the secondary separation.

Techniques are being developed for measuring the mass concentration of respirable diesel exhaust particles found in underground coal mines. Studies have been conducted over the past five years to investigate size selective sampling techniques to measure the respirable mass concentrations of diesel exhaust and mine dust aerosol particles in underground coal mines. Results from these studies have been used to develop design and performance criteria for a personal diesel exhaust aerosol sampler. Three personal diesel exhaust aerosol samplers have subsequently been designed and evaluated in both laboratory and field settings. These samplers use size selective classifiers for the determination of the respirable mass concentrations of mineral dust and diesel exhaust particles. Their designs are based on the premise that diesel exhaust particles are predominantly less than 0.8µm while mineral dust is greater than 0.8 µm. One design, selected for field evaluation, consists of a 10 mm nylon respirable dust cyclone followed by a 0.8 µm cutpoint impactor and afterfilter. The cyclone removes the large nonrespirable particles while the inertial impactor stage, collects the mineral dust on an impaction plate and allows the diesel particles to penetrate to an afterfilter. The two sample fractions of the respirable particles (<0.8 µm and >0.8 µm) are gravimetrically analyzed to determine the concentrations of the diesel and mineral dust portions in the respirable coal mine aerosol.

The large population base, complex geology of the large land mass, and notable commercial activity have accelerated the development of underground construction market in China. The projected lengths of underground openings per year in the various sectors are: hydro-tunnels, 180 km; coal mine entries, 40 km; transport-tunnels, 300+ km. An example of the mega projects (being planned by the Government) is the water supply scheme for connecting Yangtze river to Yellow river involving 131 km of water tunnels with a diameter of 8-10m. Several large projects are highlighted in the paper with reference to the schemes for generating hydro-power, mining of coal and minerals, and constructing transportation networks. The related problems of construction and geomechanics are outlined.

EXECUTIVE SUMMARY An approach borrowed from the petroleum industry was applied to the gas development evaluation for the Bulga underground coal mine in New South Wales, Australia. The results enabled the coal mine operator, Xstrata Coal, to systematically plan the extraction of gas in harmony with mine production planning of multiple coal seams. This has allowed for a more proactive approach in preparing the resources and infrastructure needed to capture the gas and accelerate coal mining while maintaining their high level of commitment to safety. Norwest has for decades used gas recovery simulation models to assist the petroleum industry and the coal bed methane (CBM) industry in understanding and forecasting fluid saturations and flow behavior. Norwest developed a similar process with Xstrata to migrate existing mine data at Bulga into reservoir simulation models to study various drainage alternatives. An interesting feature to the evaluation was also developing an understanding of test procedures and nomenclature from the mining industry to properly translate the data for input in simulators developed for the petroleum and CBM industries. The model was then calibrated to actual field data collected from drainage pilot tests that Norwest helped design and monitor at Bulga. The resulting calibrated predictions were then used to develop budgets, schedules, resource requirements, and alternatives for capturing the gas and delivering it to market ahead of mining. Increasing revenue, reducing emissions, improving schedules and cutting costs for the mining operations have all contributed to justifying this advanced approach at Bulga. It has also allowed Xstrata to expand their focus to the sizable gas reserves in seams not currently planned for mining. Several of these seams would be economic gas development targets once the gas recovery infrastructure is installed for the mine. The evaluation process was refined throughout this project and the resulting approach will benefit Xstrata with their broader strategic development of resources in the Hunter Valley and beyond to their worldwide operations.

The Alabama tar sands of the Hartselle Sandstone formation present a more difficult problem in primary extraction than do the Athabasca tar sands. In contrast to the Athabasca tar sands, the Alabama tar sands are "oil wetted" and the contained tar, or bitumen, is of much higher viscosity. A physical beneficiation scheme was developed in which clean sand from an external source was used as a scrubbing medium. High intensity scrubbing liberated the tars which are readily recovered by froth flotation. Locked cycle tests have shown that, after the use of an initial ration of clean sand, the system produced enough new clean sand to be self sustaining.

Differential settlement on reclaimed land presents a particular problem when the land is to be used for row crops. The poorly drained depressions caused by differential settlement restrict crop yield resulting in additional costs to alleviate the problem. Potentially more serious is the threat of failing to meet target yields due to settlement: related reductions. Because the mechanism by which the problem occurs is not well understood, a physical model study was conducted to investigate the importance of several factors. Although the importance of such factors as the relative amounts of rock and unconsolidated overburden in the undisturbed condition and the size distribution of rock fragments were considered, the analysis concentrated on the causes of settlement in the reconstructed soil layer above the rock spoil.

A physical model has been developed to simulate the flows and mixing of gases in the waste of a longwall retreat coalface. The model is used in conjunction with computational modelling, and the distributions of permeability and gas emission in the model waste follow those in computer simulations (Pokryszka et al 1996). The physical model represents at 1170th scale a 200 m long, 3 m high coalface with a waste extending up to 280 m to the face start line. The model is tilted to the same seam slopes as the real face, e.g. 22° ascensional ventilation along the face and 7" slope to the dip. The purpose is to investigate the flow of three components: ventilation seepage flow through the waste; methane; and nitrogen injected to quell spontaneous combustion. A heavier-than-air surrogate gas (SF,) is used in place of methane, and therefore the model is inverted so that gas layers form along the &apos;roof". The main forces driving the flows in the waste (pressure gradients due to ventilation and the density difference of gas layers) are kept in proportion by appropriate scaling of the permeability. Calibration and validation used data from a coalface at a mine in the Lorraine coalfield. The model is now in operational use.

Land Application Discharge (LAD) is a useful method of disposing of waste water from mining operations and in certain climatic regimes, stormwater runoff. LAD systems function under the premise that metals, salts and nutrients in water are dispersed over a large area and are effectively assimilated into the soil profile. Depending on the soil structure, migration or mobilization of dissolved metals through the soil profile can be Substantially reduced. Land application of treated effluent from sewage lagoons or waste water plants was probably the first general use of land applied water. LAD has gained popularity with the mining industry as a means of disposing of waste water and process water. In addition, large volumes of snow meltwater and stormwater are often placed in storage in Montana during spring, and Land Application Discharge has shown to be an effective method for disposing of stormwater during the dry, summer season. LAD can also provide an alternative to recycling or treating waste water at on-site waste water treatment plant&. Application of stormwater or process water can result in little or no change to the background concentrations of metals in baseline water quality samples. One cautionary note about LAD: high salt concentrations and pH values are associated with process water from heap-leach facilities and are known to cause burning of local vegetation. Some pre-treatment of process water may be necessary to prevent such environmental problems.

The Parachute Creek Member of the Green River Formation in the Piceance Basin, Colorado, contains vast reserves of oil shale, nahcolite, dawsonite, and other accessory minerals. The dry alkali process of sulfur dioxide removal using nahcolite (naturally occurring sodium bicarbonate) has great potential. A room and pillar mining scheme has been designed to extract a nahcolite zone occurring at a depth of 472 m, from the lease application area of the Yankee Gulch Joint Venture. Geotechnical parameters affecting mine design will be discussed. A preliminary development plan for mining at the rate of 1000 t/d will be described in detail.

A number of authors have examined particular facets of the problem and have proposed models for their area of interest. Bureau of Mines personnel brought together many of these individual studies, and from them have attempted to develop a coordinated plan for modeling radon daughter concentrations in the uranium mine environment. This approach is described.

The federal standard for limiting exposures to miners from radon daughters was reduced from 12 working level months (WLM) per year to 4 WLM per year in 1971. However, even at that time some researchers were concerned that the new limit would eventually be shown to result in an excess risk for lung cancer mortality in miners. The National Institute for Occupational Safety and Health (NIOSH) is now engaged in a comprehensive review of this topic. As the lead agency in this project, NIOSH has developed a work plan and established a work group to implement this plan. The procedure and specific considerations are outlined in the work plan for developing a comprehensive ionizing radiation standard recommendation for all miners, underground and surface. Such a recommendation will not only include estimates of health risks at various levels of exposure, but also appropriate recommendations for medical monitoring, sampling and analytical methods, sampling strategies, posting, engineering controls, personal protective equipment and recordkeeping. The work group has twenty-four members. Eleven members are NIOSH personnel representing six divisions of the Institute. The remaining thirteen members represent other federal agencies, specifically the Bureau of Mines of the Department of the Interior, the Mine Safety and Health Administration and the Occupational Safety and Health Administration of the Department of Labor, the Office of Radiation Protection of the Environmental Protection Agency, and the Bureau of Radiological Health of the Food and Drug Administration, Department of Health and Human Services. Several factors contributed to the decision to initiate this project. First, the efficacy of the current standard was considered. An initial study group was formed in the spring of 1980 by NIOSH to identify and evaluate articles that contained information on lung cancer mortality risks at and below the present permissible exposure limit. The conclusion drawn from their evaluation was that a two-fold excess risk of lung cancer mortality at and below 120 cumulative working level months (CWLM) of exposure to radon daughters is evident. This composite indication from selected studies was of sufficient magnitude to justify further evaluation. The study group, however, recognized that other studies and information must also be considered in a quantitative risk assessment which would form the basis for recommending an acceptable and feasible permissible exposure limit. A second factor in the decision to pursue further evaluation was the gaps in the current standard that had previously been identified by the Mine Safety and Health Administration (MSHA). These included lack of medical monitoring of underground miners and absence of regulations for surface miners. The seriousness of the health hazard relative to other hazards in mining was also considered. Along with exposures to silica and asbestos fibers, radiation was judged to be one of the major health hazards in mining, These combined factors constituted the justification to develop criteria and recommendations for improved mandatory health standards. The development process begins with a survey and review of the available world-wide information on the topic, including data and information developed by NIOSH. The end product of this review is to be a document that will contain an evaluation of the collected information and support for any recommendations that are made. To develop this document, the present work group has been divided into five task groups with the following emphases: Health Effects, Medical Aspects, Monitoring, Environmental Exposures, and Engineering Controls and Work Practices. The Health Effects task group is to evaluate the evidence from epidemiologic and animal studies of adverse health effects associated with all forms of ionizing radiation encountered in mining and milling operations. The "weight-of-evidence" of the results of all relevant and useful studies will be summarized, with the reasons for emphasizing the cited studies. The critical cells or tissues and the factors that should be considered in estimating the dose to these areas from various types of radiation will be identified. An evaluation will be made of the possible impacts of smoking and exposure to diesel exhaust on the determination of health effects related to radiation. The implications of biologically redundant dose in terms of the time between tumor initiation and death will also be analyzed. The Medical Aspects task group is to review the generally-accepted and the state-of-the-art medical technology for the detection of adverse health effects from ionizing radiation exposure. An evaluation will be made of the accuracy of urine and fecal analysis, wholebody counting, chromosome analysis and nose blows, as well as their usefulness for early detection of adverse health effects. Early detection is of little utility to the affected individual unless subsequent medical care can improve the prognosis. Recommendations for screening tests will be made after carefully considering the accuracy of the diagnostic procedures and the usefulness of early detection. Required recordkeeping and transfer rights will also be addressed. The Monitoring task group is to consider the state-of-the-art technology for the monitoring of occupational radiation exposures. Instrumentation, sampling strategies and analytical procedures will be reviewed for both personal and area sampling. The implications of the associated levels of confidence for non-compliance decisions will be evaluated. The discussion will also include an evaluation of the feasibility of replacing present monitoring systems with recent technology and the impact that a possible lower permissible exposure limit would have on monitoring requirements. The Environmental Exposure task group is to investigate the field procedures and mathematical methodologies which have been used to quantitate exposure levels to the various kinds of ionizing radiation. The magnitude and direction of the possible biases in past exposure assessments will be estimated. Specific attention will be given to the controversies concerning the quantification of the biological dose equivalent and the feasibility of recommending standards for mixed radiation exposures which use "rem" as the unit of measurement. A plant trial was conducted at the Paddy's Flat plant of Dominion Mining Limited with the aim of comparing the ef evenness of oxygen and hydrogen peroxide as leaching oxidants. The Paddy's Flat plant is designed such that the leach train can be divided into two parallel streams, allowing the same or lurry to be eated in two identical trains. By effectively ehminatmg the influence of the ore variations on the results subtle differences in the performance of the two reagents hav been identified. . . The results of the plant trial indicate that the two reagents act m different ways, and that each may be more suitable than the other _for _the treatment of certain types of ore. In some cases a co bmation of the two reagents may be the most cost effective option. . or t e same chemical conditions in the leach pulp, including dissolved oxygen levels , the reagents achieve different gold leaching rates, and in some cases different ultimate leach extraction.

Most modern mines can profit from improvements in information handling. Recording systems in many cases were designed to satisfy certain necessary legal requirements, but not specifically to provide management information. As a consequence, the top managements of these properties work with cost data and production information that is dated, lacking in detail and clouded with supposition. It is the intent of this paper to describe an information system for a mine-plant complex in terms of the type of data, application areas and the existing equipment technology that may be applied to improve this situation. The economics of information processing and data handling will not be discussed in detail. This paper is based on the premise that information is something of value and that information processing like a manufacturing operation works for and is subject to management control. Information, the product, must be of quality, and the cost must be favorable in terms of its use.
