MR. MARGOLF: Our final speaker this afternoon before we have an opportunity for some questions for the members of the panel, is a gentleman who has spent more than 40 years in the newspaper industry. He started out as an office boy while he was still in high school. He worked his way through college working for a newspaper in Lexington, Kentucky where he graduated from the University. He has a long association with the Albuquerque Tribune but what brings him here today is in his position as editor of The Rocky Mountain News which is certainly one of our largest circulations. Up until a few years ago most of the electrical equipment used in the mines of this country was developed for industrial purposes and was adapted for use in mines by slight modifications. It became apparent, however, that mining conditions differed widely from most industrial applications and it became necessary to design and develop apparatus, particularly suited for use under mining conditions. Most of the electrical apparatus used in mines today, however, does not owe its success entirely to mining development, but in many cases developments in other branches have been taken and improved upon and modified to meet mining conditions. Power Plant: In the earlier days the power plant for the production of electric power usually consisted of fairly small belt driven direct current generators operated from reciprocating non-condensing steam engines. Today where possible the mines purchase power from central stations and where not possible it is ususally produced from turbine driven plants using non-condensing turbines for the smaller plants and condensing turbines for the larger plants. The bad water conditions at many of the coal mines in this country is, responsible in a large measure for the high cost of upkeep and repairs in isolated power plants. This feature with the type of labor available makes it difficult to operate an isolated plant condensing except in the larger mines where water conditions are good and the apparatus can be taken care of. The geared turbine is a particularly simple and rugged piece of apparatus and requires very little attention over long periods of time. Hoists: The first electric hoists to be installed used various types of motors designed for railway or industrial purposes, and the control furnished was far from satisfactory. Today most of the mine hoist motors are of the alternating current type, especially designed for hoisting service. The control for motors of 200 H. P. or over is usually of the magnetic of liquid rheostat type, and as built today will operate over fairly long periods with a very moderate cost of up-keep. Hoists of 1000 H. P. or larger are usually of the direct current type using field control and receiving power from a flywheel or synchronous M. G. set. Hoists of this type have made remarkable records in regard to continuity of operation and low cost of up-keep. Where high speed operation is desired in either coal or metal mines, the D. C. equipment using field control and a separate M. G. set to supply power to the hoist motor is not only the safest and most economical but in many cases is the only type of equipment capable of satisfactorily obtaining the output required. A number of improvements have been brought out with the field control scheme in connection with the acceleration, retardation, overfeed and overwind of the hoist. With these new developments the hoist operator can no longer abuse the hoist by improper manipulation of the control handle. Until a few years ago the matter of safety devices was not given much consideration when installing hoisting equipment. The labor turn-over at coal mines has long been a fertile subject for parade by complaining coal operators, the question invariably occupying a place of prominence in the list of disabilities that tend to increase the cost of producing coal, adding likewise to the now startling number of accidents that occur in coal mines. This disability, however, is like the weather question, which some humorist once remarked of by saying, "The weather is something we all talk about, but nobody does anything to improve it." Endless compilations covering the shift of employment by coal mine labor have been made and published, and while the actual loss expressed in cents per ton in cost of coal produced has never been determined, the fact remains that such represents a substantial item, taking the mines of the country as a whole. Efficiency engineers who have made studies covering the cost of breaking in and training each new man employed in certain manufacturing industries, fix same as averaging not less than $100.00 per man, and when the character of mine employment is given due consideration, including its ever-present hazards, the difficulty of close personal super- vision of individual employes, and the, at times, almost impossible ability to transmit to men of many diverse nationalities understandable instructions, it is quite safe to say that the cost of securing and breaking in new men for underground mine work will fully equal that suffered by the factory managements. When we speak of mine labor turnover we must necessarily exclude the enforced shifting about of men who are laid off by the closure of mines due to accident or lack of market, con- fining ourselves to the turn-over occasioned by- (a) the dismissal of individual men or groups of men; (b) the voluntary resignation of the individual workman. It is these two methods of severance that the employer and employe alike suffer from; the item "Unclaimed Wages" carried in the accounts of every large coal company illustrative of the "quit this job, get another one" attitude of many workmen, who frequently, when leaving, fail to claim small sums due them, while others, in turn, leave a train of debts, large and small, behind. Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement

Dear Mr. Pryde: In accordance with suggestion in your letter to me of June 21, 1923, Mr. Roberts, Mr. Dalrymple and I had a meeting and attached find our contribution to the proposed August report of the Committee on Safety. You will note that we have confined ourselves to matters in connection with explosions and prevention of explosions, in coal mines. If the committee is to report on general safety in coal mines, including accidents from haulage, timbering, rock falls, electricity, etc., we would like to suggest that you ask other members of the committee to specialize on one or more of these subjects. Especially we believe it would be advisable to specialize as to precautions against electrical accidents with giving of data as to maximum voltage, precautions to be taken as to gas ignitions by mining machines at faces, best methods of placing power wires underground, etc.; also give information as to up-to-date safety installations, such as whistle devices notifying of disarrangement of ventilation or devices for quick cutting off of electrical power from mines under certain conditions; also give data as to efficient safety man cars on various pitches, etc. Yours truly, D. It is a well established fact that 60 per cent of all accidents in coal mines occur from falls of roof and coal at or in the proximity of the working face. Notwithstanding that this is well known, and has been frequently discussed by mining men, this seems to be the irreducible minimum. It is even said by those in a position to know that the percentage stated is increasing. With this, information before us it would seem that not enough attention is being given to close supervision at the working face, and until this is done we may expect to continue experiencing an increase in the accidents in this area. No workman generally feels that it is more important to finish loading a car of coal than to set a timber for protection, and many accidents happen from this source, not from a lack of knowledge of the dangerous conditions existing, but negligence in taking remedies necessary to remove the danger. It is true that nearly all state laws require the mine foreman or his assistant to visit each working face every day, but with the constantly changing conditions on account of the advance of the working faces, these daily visits may be entirely inadequate to discover possible dangers and prevent accidents. The obvious remedy then is closer and more systematic inspection and supervision of the working faces. Many accidents are caused in mines on account of not enough clearance between the rib and track or between timber and track. On all main haulage ways. there should be a space of at least 30 inches between the rib and track, or timber and track, and on all rooms not less than two feet should be left between the track and upright timbers.. A great deal has been said and written with regard to systematic timbering. We doubt very much the feasibility of adopting any standard of timbering that would be suitable for all roof conditions, and any such system in our opinion would not tend to cause a decrease in the number of accidents. The proper place to put up a prop, regardless of whether it conforms to any established system, is under a piece of loose roof. No habit is becoming more prevalent among miners and other mine workers than wearing gloves, principally flimsy canvas gloves, which afford no protection to the wearers and are the direct cause of many hand injuries. If gloves must be worn, and no doubt they will be as the habit has become well established, then they should be made from some heavy material and should fit the hands fairly snug.

Dear Sir: Yours of July 23rd, relative to my appointment on the Safety Committee in connection with the Rocky Mountain Coal Mining Institute. As you say in your letter, "The duty of this committee is to draft suggestions as to safer mining practices with the idea of preventing disasters in coal mines." Much has been written and many suggestions made on this same subject, and it is very hard to put up further recommendations than have already been made. The disasters you mention in your letter unquestionably have direct reference to coal mine explosions, which from time to time still occur in this and other countries. As far as our Western mines are concerned, you know that sprinkling and shot firing by electricity have been very extensively carried out. Notwithstanding these precautions; we have had a few rather serious disasters in the past in these mines. I do not care to place any blame or responsibility on the companies having these disasters, but it is a fact that in each and all of them, after careful investigation has been made, that the human element has had more or less bearing on the accidents happening. From most reports that we gain, either directly or indirectly, it is very evident that investigation shows after an explosion that the rules governing one or both of the above safety measures have been somewhat carelessly or negligently carried out. Much has been written and read about rock dust sprinkling, but it is questionable if this method is doing a great deal toward the eliminating of disasters. While it is true it may have the effect of preventing propagation, still I do not believe anyone claims for it a sure preventative against initial explosions. I had occasion not long ago to visit a mine, after an explosion, in which dust barriers were supposed to be hung, and from indications it was quite evident that the dust barriers had been in operation, but they did not prevent the explosion from reaching. all open parts of the mine. It is also true that profuse scattering of rock dust throughout a mine would have a beneficial effect, but there is a question arises here as to whether the sprinkling by rock dust or the spraying by water, if available, is the most effective. I am satisfied that if all coal mines are kept well sprinkled and all open workings maintained in a thorough moist condition, that the biggest factor in a coal mine explosion is in this way eliminated. There is no doubt but what the use of permissible powder, particularly if shot by electricity, has had a very marked effect on the number of dis¬asters in mines, and if this method of shooting was energetically carried out there would be a difference in the number of explosions, both minor and Major, all over the country. Some of the recent explosions have taken place where no shooting was being done, but there is no denying the fact that the other ingredient, namely, coal dust, entered in the elements very extensively. Executive Summary The future of coal as an important energy source in the 21st century will depend heavily on whether or not our industry is recognized for its performance. We have had a major role in powering our nation through the 20th century ... but many today do not understand that role nor do they know that 56% of our nation's electricity today comes from coal. Corporate communications, marketing, and public relations must be a high priority of our industry if we are to survive in the society of the 21st century as a viable energy option for powering our nation. The time to start is now. The place to start is locally. The way to strengthen local and regional efforts is to network on a regional and national level with associations who have the ability and the will to develop effective communications strategies. Introduction The Minnkota Power Systems is a regional association of 26 electrical suppliers. Serving more than 96,000 customers in a 34,500 square mile service area in Minnesota and North Dakota, the association includes 12 municipal utilities, 12 distribution cooperatives, a municipal power agency, and a generation and transmission cooperative. The Minnkota Power Systems generating capacity totals 613 megawatts, and 83% of it is fired by lignite coal. On an annual basis, 80% of our total energy is derived from coal. We are proud of our long association with the coal industry. Our pride shows in the very visible role that coal plays in our marketing and public relations efforts. In 1993, the Minnkota Power Systems had one of the lowest wholesale rates in the country, at 3.1 cents per kWh. Average residential rates were 5.8 cents per kWh. Minnkota Power Cooperative, One of the Minnkota Power Systems, is a generation and transmission cooperative headquartered in Grand Forks, North Dakota. Minnkota's Strategic Plan - Shaping the Future Minnkota recently completed a strategic planning process which is intended to give direction to our future and allow us to proactively influence the shape of that future. MORTENSEN: On behalf of the Rocky Mountain Coal Mining Institute, I take great plea¬sure in saying good morning to you at Vail. With a few clouds in the sky, at least we won't get sunburned. We won't have to worry about our kids in the swimming pool, perhaps. It is delightful for me to have been able to have represented the Rocky Mountain Coal Mining Institute for the year 1982-1983. This has been our 71st year and this is our 79th meeting. In recognizing the attendance here, that dinner we had last night, and some of our entertainment must have gotten to some of us, or it is a little early. But I'm sure as the day goes on, and with the speakers outlined, it will be very beneficial for those who do attend. We do appreciate your attendance. I'd first like to make an introduction of our head table. Doris Finnie, she is our executive secretary. As most of you are aware, Gussie Whiteside retired as secretary. This will be the first time since the Institute started that there has not been a Whiteside present at one of our conventions. I'm sure Gussie would appreciate any calls or letters that any of you would care to make to her. Doris, I might add, has been a great help to me and all of the people who have been working on the program for the Institute this past year. There's been lots of reorganization and we are very pleased with Doris's ability to take hold from Gussie without any waves. Much credit must be given to you Doris for this and we do appreciate the help you have given us and believe me she has kept us out of trouble. Next, we have Art Neill. He is our vice president of the Institute from Montana and he also works with Western Energy Company. We appreciate the help that all of these session leaders and chairmen give to us. We have other names on the head table, but they will fill in as the morning goes on, so we won't bother you with any of those at this time. To set the stage for business, first I would like to call on Doris for a motion to approve the minutes of last year. MS. FINNIE: Thank you, Vernal. The 81 st Regular Meeting and convention was called to order by the President, Charles W. Margolf at 9:00 a.m. Monday, July l, 1985 in the Silverton Room of Tamarron, a resort hotel near Durango, Colorado. President Margolf welcomed the members and others in attendance to the convention and noted his theme of "Make It Happen!" He introduced those present of the 1985-86 Board of Directors and Officers who were elected by the Board of Directors at their Annual Meeting June 29. They were: Arthur K. Neill, President; Bernard Bernstrom, President-Elect; Loren V. Linville, Convention Liaison Officer; Vice Presidents Douglas J. Hammer of Colorado, C. Joe Presley of Montana, Alva L. Smith of New Mexico, Fred Wertz of North Dakota, Rex Berry of Utah and Thomas J. Lien of Wyoming; and Doris G. Finnie, Executive Secretary & Treasurer. He also introduced Ira. E. McKeever who was elected to serve as chairman of the Advisory Board by that group. The eightieth regular meeting and convention was called to order by the President, John T. Atkins, at 9:15 a.m. Monday, June 25, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. President Atkins welcomed the members and their guests to the convention and noted that the annual business meeting would be held Tuesday afternoon at 2:00 p.m. in the same room. A convention update was made by the Conven¬tion Liaison Officer, Loren V. Linville. This was followed with a program report by the Program Chairman, Doug Ingram. The chair then called on Clifford Barrett, Upper Colorado Regional Director of the Bureau of Rec¬lamation of the United States Department of the Interior. He presented the Bureau's Citizen Award to RMCMI former president Ira E. McKeever for his outstanding contributions to the joint private/ Federal effort and the open planning process for AQUATRAIN. According to Barrett, "from 1981 to early 1984, McKeever led private industry work in the AQUATRAIN project, a proposal for a 1,400 mile long pipeline system. AQUATRAIN was conceived as a possible alternative to solve the government's problem of rising salinity levels in the Colorado river, as well as the private sector's need for a more economical coal transport method. The Citizen Award cites McKeever's efforts in developing a model for future cooperative ventures between government and industry that can benefit the nation." Following this presentation, the formal program of the 80th meeting and convention began with the president, John Atkins, introducing the convention kickoff speaker, Andrew Franklin, President of Nerco Mining Co., Inc., followed by the convention keynote speaker, Dr. Margaret N. Maxey of the University of Texas. These speeches are printed in this Proceedings together with those of all other convention speakers. I'm Andrew Franklin, President of Nerco Min¬ing Company, and I'm delighted to be here to kick off the annual convention of the Rocky Mountain Coal Mining Institute. This has always been a very special convention in my eyes and I'm sure this year's will be no exception. I am also here to share my thoughts on the western coal industry and how we're all affected - for good and bad - by public policy decisions. Although the title of my talk is "Western Coal: An Industry Under Siege," I believe a more accurate title might be "Western Coal: The Pit and The Pendulum," because of the wide swings in public policy and coal development in the past 15 years which have cut a zigzag path for growth over this period. As one of the nation's largest coal producers, Nerco is well aware of the problems facing western coal production. Nerco Mining Company is the western coal mining subsidiary of Nerco Inc. We have been "in coal" for more than 25 years through our parent company, Pacific Power & Light. To state my conclusion at the outset, I feel it's extremely important that consistency and common sense should guide our national policy for the development of valuable energy resources. In particu¬lar, we must reduce the wide swings in government policy and activities which have affected energy development. In short, we must decide what kind of game we're playing so that the "players" and the "referees" can keep their eyes on the "ball." Business today faces two main types of uncertainty market uncertainty and public policy uncertainty. As businessmen, we expect and are used to facing the familiar challenges and uncertainties of the market in which we operate. Over the past 10 years, the market has appeared to be bullish on coal. Profiled here are the eight RMCMI 2001 Scholarship Award winners. Seven of the eight attended the 97th Regular Meeting and Convention at the Steamboat Springs Sheraton Resort in Steamboat Springs, Colorado in lace June. Each spoke during the Scholarship Awards Monday luncheon and shared their goals with attendees. Thanks to the Patrons of the Institute each student received a 52,000 tuition credit, a plaque signifying the honor and the opportunity to thank the membership. The winners were guests of the Institute Sunday through Tuesday noon and had an outstanding opportunity to meet many in the coal industry that could be potential employers. The state vice presidents host the winners anti pay for their travel and hotel expenses. This is a continuing scholarship and may be renewed for tuition credit again in the senior year it the winner is a full time student and is recommended by the dean of the college or university. A resident from each of the eight member RMCMI states is selected by the Scholarship committee from Board approved institutions. Criterion for the awards is chat the recipient be (1) a full time sophomore student who will use the tuition credit in the junior year. (2) a U. S. citizen and a legal resident of the member state. Shipley University of Arizona The son of Bonnie Fawcett and David Shipley, Steven graduated from Catalina Foothills High School, Tucson, Arizona where lie attained a 3.5 GPA. In his third year at the University of Arizona lie is pursuing, a degree in mining engineering. He is a member of SME, Northwest Mining Association, and a volunteer at San Xavier Mining Laboratory -Miner. He participated in Football, Track, Wrestling and the DECA club while in high school He is the recipient in both the WAAIME and the Phelps Dodge scholarships. Steven volunteers during the academic year at the U of A San Xavier Mining Laboratory. He worked the summer of 2001 at the Black Butte Coal Company in Point of Rock, Wyoming. [ ] COLORADO WINNER Brian Gerdes Colorado School of Mines Graduating as the Valedictorian of Horizon High School with a 4.0 GPA, Brian is well prepared for the rigors of academia. In high school he was recognized in rite President's Education Awards Program and as a Radio Shack Tandy Scholar. lie belongs to SME, is a member of Fellowship of Christian Athletes, and volunteers at a local elementary school tutoring children. He enjoys intramural Sports. His father is Bruce Gerdes of Broomfield, Colorado Brian is holding a 3.75 GPA while studying for a mining engineering degree. He would like to go into reclamation scaring that his dream would be to reclaim an old mine and restore it to a function, al role in society again.

Pictured on these pages are the eight RMCMI Scholarship Award Winners for the 1990-1991 year followed by a brief profile. All winners, except John Nixon from Texas, were present as guests of the Institute at the June convention in Keystone, Colorado to receive recognition at the Welcome Session Monday, July 1, 1991. Each state vice president served as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman, Dr. Donald Gentry, each winner receives $750 tuition credit for the coming academic year. As this is a continuing award, the winners from the previous year will receive another $750 for tuition credit in their senior year if they have maintained good academic standing and are recommended by their university. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the state involved. (3) That the recipient have good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in the engineering disciplines, such as geology, mineral processing and metallurgy. [ ] Walter Mengel III University of Arizona Tucson, Arizona Walter has attended the Mining Engineering program at University of Arizona since fall, 1990. He is a very diligent student and has recently been selected student mine foreman for the San Xavier Mine. Walter is secretary of the U. of A. AIME Student Chapter and a student member of the AIME Tucson Chapter. His career interests lean towards western coal mining. [ ] Matthew Madden Colorado School of Mines Golden, CO Matt carries a 2.619 cumulative grade point average in the Mining Engineering Department and ranks 194 in a class of 440. He is involved in a number of school activites such as a member of the Society for Mining, Metallurgy and Exploration, Inc., member of the Resident Hall Association, a Admissions Ambassador, and will be a Resident Hall Director for 1991-1992. Matt is also involved in wrestling and received a Colorado School of Mines Athletic Scholarship in 1990.

She is majoring in Mining Engineering at the University of Arizona in Tucson, Arizona, but recently is considering switching to Environmental Engineering with emphasis on mining. She told the Scholarship Chairman that if she wasn't part of the solution, she was part of the problem. Christy has received numerous awards during school including being on the honor roll and university chapters of Society of Mining Engineers. Besides her academic activities, which includes being a member of Student Council, Christy is quite an athlete and enjoys basketball, softball, tennis, golf, and soccer. Last summer, she worked as a safety assistant/laborer for the Magma Copper Company. This summer, Christy is working in the safety department at Magma Copper Company's Pinto Valley Mine in Arizona. Bowler University of Arizona Tucson, Arizona Tony has taken a well balanced curriculum and at the same time maintained significant progress toward a Geological Engineering degree. He is interested in computer science and programs as a hobby He is the master of several computer languages including machine language on different personal computers. [ ] Christopher Taylor Colorado School of Mines Golden, Colorado Before matriculating at Mines, Chris served four years with the U.S. Army Special Forces attaining the rank of sergeant. He is active in the military, serving in the Reserves and R.O.T.C. This duty precluded his attendance at the Breckenridge meeting. He plans to get summer work experience in mining before graduation and is interested in the managerial and technical aspects of the mining business. [ ] Laverne West New Mexico Institute of Mining & Technology Socorro, New Mexico A native American of Laguna/Navajo ethnic origin, Laverne graduated from the Sante Fe Indian School as valedictorian. She served as both secretary and president of the American Indian Science & Engineering Society. She works at the Nevada Test Site with contractors assisting project engineers in a variety of jobs. She plans to earn a dual degree in Mining and Geological Engineering then pursue a Master's degree in Mineral Economics at the University of California at Berkeley. Among her honors are a four year scholarship from Sante Fe Southern Pacific Foundation, a one year scholarship from Mobil Oil Corporation and another from Eastman Kodak.

He is pursuing a degree in Mining Engineering as a junior at the University of Arizona. He enjoys outdoor sports including skiing, mountain biking, golf, and hiking. He also enjoys reading, ghost town and old mine exploration, computer, Japanese conversation, and sketching cars and other forms of transportation. Chris hopes to attain a Masters Degree. [ ] COLORADO WINNER Matthew D. Lengerich Colorado School of Mines Matthew, the son of Judy Lengerich, Durango, Colorado and Ronald Lengerich of Redlands, California, is pursuing his degree in Mining Engineering with a 3.93 GPA. He is a member of the National Honor Society and the German National Honor Society. An avid outdoorsman, Matt also finds time to pursue music and theater. He was unable to attend convention this year as he was on a collegiate trip to South Africa. He is Co-President CSM Newman Group and Youth Leader at Christ on the Mountain Catholic Church.
