Although the crystallography of lattice transformations has been studied extensively during the past few years, these studies have been limited, with few exceptions1'2, to specimens in which the transformed lattice appears as a segregate phase. A realization of the technical importance of the segregation mechanism, especially in the formation of martensitic structures and in age-hardening phenomena, has undoubtedly stimulated research in this direction. In the crystallographic studies of segregation, the general problem has been to relate the orientation of the parent crystal to that of the segregate crystals. The technique has been complicated by the fact that it has been necessary to deal with the presence of as many as 24 ideal segregate orientations within one parent lattice; furthermore, the segregate lattices are invariably scattered (seldom less than ±2º, often as much as 15" or 20') about these ideal positions. It is probable that a more complete picture of phase transformations may result from a study in which complete lattice relationships between individual grains are evaluated, thereby providing an additional parameter which when it is necessary to work with multiple segregate orientations, cannot be evaluated. The present paper presents the results of such a study, ? wherein a peritectic reaction is made use of to produce the transformed lattices. The subject of this paper implies three questions: whether regulation is necessary; if so, what sort of regulation is wise; and, finally, by what government the power to regulate is to be exercised. In the year 1937 emphasis falls on the third of those questions. This contrasts with the situation prevailing a dozen years ago, when the question was whether regulation was necessary at all; and with the situation a few months ago, when the third question seemed answered by the Supreme Court decisions on the National Recovery Act, Agricultural Adjustment Act and Guffey Coal Control Act, and by the ratification of the Interstate Oil Compact. It then appeared settled that the State and not the Federal Government possessed the regulatory powers and, granting that conservation measures are a recognized necessity, the problem seemed to be to develop the wisest kind of regulation that the Constitution would permit. Today, by virtue of developments during the first months of 1937, the oil industry is faced again by the question of whether the Federal Government is to have power to control its operations, along with those of the other basic industries. Developments in Governmental Control There have been three recent developments. The dominating one is the President's proposal that he be authorized to increase the size of the Supreme Court to 15 members. The implications of that plan ought to be perfectly plain to the oil industry. This suggestion is made in lieu of offering an amendment to the Constitution, to reverse the Supreme Court decisions mentioned. In those decisions the Court held that production does not constitute commerce, and hence that the Federal power to regulate interstate commerce does not extend to the regulation of production. These holdings were contrary to the Government's contention that the stream of commerce begins in the factory and ends with the consumer and may be regulated at any point from beginning to end. That position was urged in the Government briefs in Amazon Petroleum Co. v. Ryan, defending the petroleum code, and repeated as late as Feb. 10, 1937, in the case of National Labor Relations

The possibility of deeper production in the Buena Vista Hills was first considered in 1933. At that time, however, the heavy state curtailment program served to deter any operator from drilling test wells, which, if successful, might upset the proration schedules. Because most of the acreage was held by several major operators and the remainder by substantial independents, the adoption of a plan of cooperative development was considered desirable. Such a plan was formulated for the development of any deeper oil and gas horizons that may be found to exist. This plan, which was signed by the Secretaries of the Navy and of the Interior on behalf of the United States on July 9,1936, is now effective for the development of lands within the area shown on Fig. 1. Unlike most unit plans, the present cooperative development plan permits each operator to drill and produce his own wells. For the purpose of this plan the Buena Vista Hills field is divided into two pools. The present production is classed as the " old pool,"' while any future production below a certain marker which roughly coincides with the bottom of the Santa Margarita formation is included in the "pool" to which the provisions particularly apply. Naval Petroleum Reserve No. 2 lies within the area and constitutes the major portion of the Federal leases subject to the plan. There are 39,040 acres and 27 operators within the area. Twenty-six operators controlling 99.5 per cent of the acreage have signed the agreement. Geology oF the Buena Vista Hills The Buena Vista Hills consist of a low range in the southern portion of the San Joaquin Valley, and are roughly parallel to the adjacent Temblor range to the south. Mining by hydraulic process of the important gold-bearing gravels of the Sacramento Valley in the basins of the Yuba, Bear and American rivers began in 1853, and continued at an ever-increasing rate for 30 years. In its most active days it reached an annual production of $15,000,000, and averaged $10,000,000 per year over the 30 years. During that period no provisions were made to prevent the debris from being discharged into the water courses, and ultimately large quantities of silt, sand and gravel were washed down to the lower valleys; filling channels, causing overflow of agricultural lands and difficulty in maintaining navigable depths in the Sacramento River. Agitation and suits filed because of these damages finally resulted in the injunction decision of Judge L. B. Sawyer,' in the U.S. Circuit Court, Jan. 23, 1884, which closed down practically all hydraulic mining operations not having means to restrain their debris. In 1893 (approved March 1, 1893), Congress passed the act introduced by Representative Anthony Caminetti, of California, creating the California Debris Commission, composed of three officers assigned from the Engineer Corps of the U.S. Army, and since that time it has been legal and possible within the drainage systems of Sacramento and San Joaquin rivers to conduct hydraulic mining of gold-bearing gravels behind dams built under this commission's permit and supervision. In the watersheds of the Trinity and Klamath rivers, which flow directly to the Pacific Ocean and do not affect navigation or agriculture, operating permits from the California Debris Commission are not required. There is a measure of restriction there, however, through what is known as the Trinity and Klamath River Fish and Game District. Chap. 215, Stat. 1931, in order to secure relatively clear water for the fishing season, provides that between July 15 and October 15 each year there must not be discharged into these rivers debris that will cause a turbidity greater than a content of 50 parts per million in the

EVERY mathematical statement of a measure of anything (as distin-guished from a count) is followed by a qualification always implied if not explicity stated--that the statement is only an estimate, which may vary from absolute accuracy within certain limits, according to the accu-racy of the measuring instrument. This basic fact, so obvious to engineers, is not so well understood by many that make use of laboratory coal tests. The tolerances that must be allowed in measurements of coal quality are very important in both their commercial and engineering applica-tions-and the significance of these tolerances depends upon the use made of the laboratory coal test. Only in recent years has there been any intensive study of this ques-tion of tolerances as applied to measurements of coal quality. There is very little in our published literature on the subject, and what has been published is not, readily comprehended by those who sell coal, or buy coal and use it, unless they happen to have made a study of the subject them-selves. There is great need for more widespread understanding of what has been discovered and how it applies to the use of laboratory coal tests. What follows is an attempt to condense into a few pages the results of the major investigations so far reported, and to explain their meaning in simple nontechnical language, with the addition of some recent illustrative experiments.

Much has been said and written on the shortcomings of the open-flow and restricted potentials of oil wells to determine their relative ability to produce. The oil industry in general is agreed that the open-flow potential in particular is grossly inequitable, wasteful and expensive, but that potential is still used in many pools. This is partly because no thoroughly satisfactory substitute has been found and partly because operators are reluctant to adopt other methods that have been suggested; or, as Hamlet would say, we would rather "bear those ills we have than fly to others we know not of." In a great many pools the use of tubing potentials has been substituted for open-flow potentials, but open-flow potentials through casing are still being used in many pools, particularly. in Oklahoma, although the expense of such potentials has been pointed out many times. In one of the most recent pools in Oklahoma it is the practice to take open-flow potentials through the casing with the tubing out of the hole. The well is usually tubed after it is drilled in for the purpose of washing it in and cleaning the hole. After preliminary tests are run the tubing is pulled under pressure preparatory to taking the potential. After the potential is taken the tubing is rerun, under pressure. In order to accommodate the large capacity of the wells, it is customary to set three separators, six vent lines and large oil-storage tanks. It is conservatively estimated that the equipment not needed for producing the well currently but which is installed solely for the purpose of establishing large potentials costs the operator at least $5000 per well—approximately 35 per cent of the cost of equipping a well for production. Such needless expenditure constitutes an economic waste in addition to the gas that is wasted in taking potentials. Meaning of Productivity Index A method of measuring the relative ability of wells to produce without open flow that shows considerable promise is the Productivity Index. In preparing a well for pumping, observations are often made of the fluid level in the well bore or bottom-hole pressures at various times before equilibrium has set in. From a qualitative point of view one may immediately infer that if the rise in the bottom-hole pressure or fluid level is rapid the permeability of the sand about the well bore is large, and converse conclusions may be drawn if the rise is slow. However, a more quantitative estimate will give additional information of value, as will be shown in this paper. To derive such an estimate we may proceed as follows. Let h be the fluid height, above the sand face, at time t, and let yo be the average density of the fluid that enters the bore. The bottom-hole pressure, for a fluid height h will therefore be p = rogh, neglecting, of course, the friction drop in the well bore, while the fluid is rising, as may be justifiably done for most pumping wells. If a is the free area of the open-flow string—assumed to be uniform— the rate of production from the sand during the rise of fluid will be: where the last part of the equation merely indicates that, in general, the production rate Q must be considered as a function of the back pressure, and is determined by it alone. In fact, equation 1 shows that if the rate of rise of the pressure or fluid level is determined as a function of the height of rise, or p, for a number of values of the latter, this functional relation between Q and p will be immediately given. Conversely, if we know this functional relation, the rate of increase of p or h may be predicted, or, by observing the rate of rise of p or h some of the constants of the sand may be determined. Only recently has it been realized that preferred orientations are common in hot-rolled steels. In a recent paper, N. P. Gossl stated that hot-rolled mild steel exhibits a texture different from that characteristic of cold-rolled steel. No complete study of these hot-rolling textures has been reported using the pole-figure method of Wever. The material used in the work reported in this paper was the same material used by Gensamer and Mehl2 in a recent study of preferred orientations in cold-rolled steel, to which reference may be made for the composition and thermal history of the steel. Automobile-body sheet bar 1/4 in. thick was hot-rolled at two temperatures, 780' and 910' C. (1436' and 1669' F.). These temperatures refer to the temperature of the furnace in which the steel was heated; after each pass the steel was returned to the furnace and held there long enough to return to temperature. Although no accurate method was used to measure the temperature after each pass, it was estimated by color that only a slight drop in temperature occurred. In order to determine the effect of any preferred orientation that might have persisted through the normalizing treatment, one specimen at each temperature was rolled in the same direction as the original working direction and the other at right angles to it. The total reduction in each case was 85 per cent, the specimens having been reduced from 0.250 to 0.0375 in. in five passes. Final cooling was in air. Pinhole reflection photograms were taken of all four specimens, with the rolling direction vertical and the X-ray beam at an angle of 7' with the transverse direction (the transverse direction is defined as that direction in the rolling plane perpendicular to the rolling direction). These photograms, taken with a Mo target at 35 kv., are reproduced in Figs. 1, 2, 3 and 4. They show that a more pronounced texture was developed by the low-temperature rolling (780' C.), and that of the two

Production of crude petroleum in Mexico during 1936 totaled approximately 40,309,000 bbl., showing a negligible increase over the previous year. While only four producing wells were completed in the Poza Rica area in 1936, its production increased from 9,468,000 bbl. in 1935 to 13,417,000, making it the ranking producing field in Mexico. This gain in output, however, was offset by abnormal losses due to artificial curtailment mainly the result of strikes and other disturbances in the heavy-oil district of the Northern fields, which declined 2,500,000 bbl., and in the South fields (Golden Lane), where output decreased 1,500,-000 bbl., while production in the Isthmus of Tehuantepec fields remained practically stationary. Production of natural gasoline for 1936 is estimated at 800,000 bbl., or 200,000 bbl. greater than in 1935. Crude run to stills in local refineries increased about 1,000,000 bbl., totaling 31,000,000 bbl. for 1936. Exports of crude and refined products were approximately 24,400,000 bbl., or over 2,000,000 bbl. greater than in 1935, the increase representing withdrawals from storage in Mexico. Exclusive of ships' bunkers, domestic consumption increased about 1,000,000 bbl. during the year, reaching an estimated total of 15,200,000 bbl. The Mexican domestic demand for gasoline is estimated at 2,540,000 bbl. for the year, an increase of 310,000 bbl. over 1935. In all, 70 wells were completed in Mexico during 1936, as compared to 74 in 1935 and 148 in 1934. In proven areas 59 completions resulted in 31 producers and 28 failures. Unusual results were obtained during the year over a scattered area in northeastern Mexico near the United States border, where out of eight completions six were fair-sized gas wells. A wildcat dry hole was completed in Chocoy in an attempt to extend the Northern fields to the northeast, and another in Quebrache, to the southeast of the heavy-oil district. A deep test (10,168 ft.) through the Cretaceous lime into the Jurassic was completed as a dry hole in Metlal-toyuca, 9 miles southwest of the Old Alamo field on the Golden Lane.

The most outstanding event in oil and gas development in Montana during 1936 was the discovery of oil in the Baker-Glendive gas field, in the extreme eastern part of the state. Other notable achievements were small extensions in the Cut Bank oil field; continued favorable results of acidization in the Kevin-Sunburst oil field; and the discovery of oil and gas in commercial quantities about 20 miles southwest of Billings, on what is known as the Mosser dome. Several wildcat wells were drilled. For the coming year of 1937, it is anticipated that the main activities will be confined to drilling in or near known fields. During 1936 Montana had seven fields producing oil, but over 95 per cent of oil production came from four fields, which in order of importance are: Cut Bank, Kevin-Sunburst, Cat Creek and Pondera. Total production for the state was 5,850,893 bbl., which is 1,251,761 bbl. more than the total for 1935. Natural gas was produced and marketed from eight fields, most important being Cut Bank, Baker-Glendive, Kevin-Sunburst and Dry Creek. These four fields accounted for over 85 per cent of total state gas production, which is slightly greater than the 1935 production of nearly 18 billion cubic feet. Increase in gas consumption is due in part to increase in smelter operation. More detailed information pertaining to the various fields is given in Table 1. In the Baker-Glendive field a test 8186 ft. deep, 15 miles southeast of Baker, was completed by the Montana-Dakota Utilities Co. in 1936. The first gas-bearing sandstone (Judith Hiver horizon, Upper Cretaceous) was found at a depth of 528 ft., and a second sand at 1167 ft. Sandstones of the Dakota formation, in which occurred water, were found from 3724 to 3853 ft. White sandstone correlated with the Tensleep (Minnelusa) formation of Pennsylvanian age was found from 5631 to 5751 ft. deep. The lower 1900 ft. of the well (below 6278 ft.) was essentially in limestone and dolomite, and information on correlation of formations in this mass of sediments is not available at this time. The upper portion of this part of the well contained much anhydrite. Cherty and dolomitic limestone below 7000 ft. may be equivalent to limestones of the Madison formation. The Workmen's Compensation Act of Ontario was passed in 1915 and Miners' Phthisis was added to the list of compensable industrial diseases in 1916. Under this provision of the Act only about two cases were compensated per year. In 1924, The Department of Public Health made a survey of miners in the four principal camps—Sudbury, Porcupine, Kirkland Lake and Cobalt—and the survey indicated that an alarming proportion of the men exposed to dust had silicosis in one or other of its several stages. A number of conferences were held between representatives of the Department of Mines, the Department of Public Health, the Compensation Board and the mine operators. The operators were advised that in the earliest stages of silicosis there was no physical disability and if men in that stage were removed from underground there would be little danger of permanent disability. They were further advised that if active steps were taken at once to compensate men that had some real disability and remove from the mines men in the early stages of silicosis, the first cost would be the greatest and thereafter their liability should decrease. As a result of this advice, and having at that time no reason to doubt the findings of the survey, the operators agreed to do all that was asked of them and cooperate with the Government in the steps believed necessary to meet the situation, and to provide compensation for the men affected. Amendments in 1926 Arrangements were made for the necessary amendments to the Mines Act and the Workmen's Compensation Act and these amendments were passed in 1926. The Amendment to the Mines Act provided that all underground employees must be the holders of certificates certifying that they were free from tuberculosis of the respiratory organs and further provided that the certificates must be renewed annually. The Government, however, at that time refused to adopt a form of certificate for applicants certifying as to their physical fitness for underground work. Certain dusts are dangerous when inhaled, but most hazardous of all dusts are quartz or other forms of pure crystalline silica. The inhalation of dusts containing silica in combination with other elements gives rise to changes in the lung which differ from those produced by pure silica. As a generality, silicates are less dangerous than pure crystalline silica and vary greatly among themselves in harmfulness. Repeated analyses have shown that approximately 70 per cent of the total number of particles involved in any dust-producing operation are below 1 to 2 microns in diameter. (A micron is approximately 1/25,000 in.) Similar studies of dusts recovered from silicotic lungs post mortem have demonstrated essentially the same size frequency distribution, except that the upper limit of size retained in the air sacs is approximately 10 microns. Experiments carried on by Gardner and the author have further demonstrated that greater changes were produced by a fixed weight of very fine quartz particles (2 to 3 microns and smaller) than by the same weight of slightly larger particles (8 to 10 microns). Any attempt to control a dust hazard should therefore be directed toward the removal from the working atmosphere of particles less than 10 microns in size, and particularly those below 3 microns. All industrial hygienists agree on this matter, but there remains considerable dispute as to the lower limit of particle size capable of causing injury. It has been generally conceded, however, that particles of harmful dusts smaller than 1/4 to 1/2, micron are not essentially concerned in the development of pulmonary fibrosis. This opinion is partly substantiated by the existence of large numbers of these small particles in practically all atmospheres that are not associated with any known hazard. Such particles are so small that they have very little mass, fail to settle even in quiet air, and probably are not easily retained in the lung. Until further research proves that they are involved in the dangers provoked by the inhalation of certain dusts, engineers will generally agree that it is better to disregard them.

WORK was undertaken two years ago at the Hammond Laboratory for the purpose of determining the magnitude of the elastic range in single crystals of pure metals by means of creep tests, the assumption being made that if a true elastic range exists, the elastic limit represents the maximum stress for no creep. A sensitive extensometer was constructed, and creep tests were made on zinc single crystals at a variety of loads and temperatures1. It was soon discovered that there is tip measurable elastic limit in ductile zinc single crystals at, or above, room temperature. The inference that pure metallic single crystals may not possess a definite elastic range was not justified, however, since zinc had been tested in creep only above its recrystallization temperature, and several investiga-tors2,3,4 had already shown that above the recrystallization temperature polycrystalline metals will flow under very small stresses, while below that temperature stresses of a much larger magnitude are required. For that reason, it was decided to extend the study of the elastic limit to other metals having a higher recrystallization temperature than zinc. Aluminum and silver were selected, because of the ease of obtaining pure materials and of preparing large single crystals, and because the crystallo-graphic glide system of these metals is well known. Owing to the limited time available, the elastic range was investigated by slow tensile tests rather than by creep tests.

Various chapters already written in the history of development of the North Dome of Kettleman Hills are monotonoysly identical in the one underlying' theme of conservation of oil and gas. Discovered on Oct. 4, 1928, by Milham Exploration Co. with its wildcat Elliot No. 1, the field has been subjected to practically every modern form of production restraint in the name of conservation. The record thus far developed shows that conservation was had for a time, at a price; and that unitiza-tion must be blessed by single ownership or 100 per cent participation to be effective. In fact, incomplete unitization places a heavy handicap upon its participants in the competitive development that follows. Shut-in Agreement of July 25, 1929 Not long after discovery at Kettleman but after the Continental Oil Co. and the Standard Oil Co. had completed several producing wells in the discovery group, came the so-called Shut-in Agreement negotiated at the instance of the Department of the Interior. This agreement became effective July 25, 1929. The fundamental purpose of the agreement was to prevent bringing on production of some 30 wells then being drilled and forestall a flood of Kettleman oil on the market. A cooperative scheme was developed whereby wells in the discovery group would continue to produce. Two of them could not be shut in. Drilling wells would be completed to a water shutoff in top of Temblor and operations suspended. Producing wells would contribute the value of 10 to 25 per cent of their production to the owners of suspended qualifying wells. The percentage rate of drainage contribution was left to a committee or umpire. Some acreage was not placed under the agreement. This same acreage later did not come into the Kettleman Unit Agreement. Several wells on this acreage did not contribute to the drainage fund. The total amount of oil produced during the 17 months of the shut-in agreement, by Milham, Continental and Standard from wells in the discovery group, was 5,297,262.22 bbl. The total amount paid out in "drainage" contributions was $2,046,048.18, representing sales value of 1,266,044.06 bbl. of oil.

AS in former years, Pechelbronn, in Alsace, was the most important producer in 1936, with 484,453 bbl., of which 283,151 from drilling and 201,302 from mining showed a slight increase in comparison with the preceding year. Gabian, in France and Tliouanet, in Algeria, are nearly exhausted. At Gabian, four wells drilled in intermittent exploitation produced during the year 2893 bbl. Four wildcats, one of which is producing, constituted all the activity in research on French territory. In Morocco, some wildcats have been drilled in search for new fields and exploratory drilling has been done in Tselfat and in Djebel Bou Draa in known fields, but the results have been inconsiderable. In Tunisia there was a gas outburst in Kebir 1, which is the first practical result obtained. In Madagascar, the Andrafiavelo region has been left and a new region has been tried in Folakara with the Tsimororo. In French Equatorial Africa, one drilling is in progress.

Equipment for treating lead ores was added in 1905 to a copper plant which the United States Smelting Refining and Mining Co. had built in 1902 at Midvale, Utah, about 12 miles to the south of Salt Lake City. By 1906 the lead section of the plant had been rounded out and consisted of a 90-ton gravity concentrator, fifteen hand-rabbled reverbera-tory roasting furnaces, six blast furnaces, a briquetting plant for handling flue dust and fine ores, a regulus furnace for concentrating the low-grade matte made in the blast furnaces, and a baghouse. The copper section was later abandoned and the plant has been operated for many years exclusively as a lead smelter. Some 45 years had elapsed at the time this plant was built since the first attempts to smelt lead ores in the West, and lead smelting had become a large and profitable industry but fundamentally little that was really new had been developed, which could be embodied in a plant built in this period. Principles and tools to work with had remained much the same as those borrowed earlier from European practice. Capacities had been increased and there were mechanical improvements but hand charging was still in vogue and there was little attempt to recover suspended particles carried out with the furnace gases, beyond settling in flues, which usually was only partly effective for recovery of the coarser particles. Satisfactory roasting and preparation of the fine components of the charge were still partially solved problems. The Midvale plant of 1906 may be regarded as more or less typical of the smelting plant of this period for treating complex western lead ores as distinguished from the recovery of lead from the simple lead ores to the eastward. The operation of a concentrating mill directly in conjunction with a lead smelter was, however, not common practice. The ores treated in this plant have from the beginning come from mines owned and operated by the company or have been custom ores purchased in the territory tributary to the plant. The treatment of custom ores is an important service to the small producer who does not have sufficient tonnage to warrant a plant, and serves to increase the tonnage of the operator of large properties, thereby helping to reduce
