The development of marine mining in the offshore areas adjacent to most of the insular and continental European States is limited by the complex and evolving nature of its legal regime on the basis of the relevant applicable international, European and domestic rules. As the development of marine mining requires investments in capital-intensive technologies, the bankable feasibility of marine mining projects is very much dependent on the legal security of mining rights, assets and operations in offshore areas. This is quite difficult to assess due to the constant accumulation of applicable and potentially conflicting international and domestic laws in these areas, in particular the coastal zone, the territorial sea, and the Exclusive Economic Zone (EEZ). The often conflicting interaction of international treaties, laws and regulations in offshore areas raises specific and major issues in terms of permitting processes, access rights, ownership rights over the mineral resources explored and mined, flag vs. coastal State jurisdiction over mining vessels and marine mining equipment, international environmental liabilities, and unitisation and multi-forum disputes. In addition, the determination of jurisdiction and the legal regime under which marine mining could take place is becoming even more complex with the development of EU Law and the recent revision of the International Law of the Sea, particularly the new extension regime of the EEZ and jurisdiction over the continental shelf.

In the western Woodlark Basin, propagation of seafloor spreading is occurring directly into the continental crust of Papua new Guinea. The spreading is not strictly in a back-arc tectonic setting, rather it appears associated with microplate rotations related to the complex convergence of the Indo-Australian and Pacific plates in the southeastern Pacific region. Volcanic rocks along the western Woodlark spreading axis range from normal mid- ocean ridge basalts to basaltic andesites with back-arc geochemical affinities. Rare peralkaline rhyolites also occur. Hydrothermal deposits occur at a basaltic andesite volcano located on the neovolcanic zone near its westernmost propagating tip. Franklin Seamount is a 250m-high cone constructed largely of pillow lavas and talus which sits astride a 450m-high ridge of similar lavas oriented subnormal to the spreading direction. At its crest, 2150m below sea level, there is a 100m-deep caldera.

Every year approximately 22 million tonnes of marine sand and gravel are dredged form British waters. The eastern English Channel (EEC) contains substantial reserves, a proportion of which have been identified by the aggregates industry for potential future exploitation. The main aim of this study is to produce broadscale marine habitat maps of the EEC area. The UK aggregates industry has formed a consortium of representatives (the eastern English Channel Association), and have sponsored an initial baseline survey and follow-up sampling programmes as part of a Regional Environmental Assessment (REA) covering a patchwork of aggregate prospecting areas. To complement this effort, a large-scale geophysical survey was conducted in 2005 to place the REA in a wider spatial context and, thereby, to help assess the environmental significance of any future impacts arising from commercial aggregate extraction over the broader region of the EEC.

The China Ocean Mineral Resources Research and Development Association (COMRA) conducted a topographic survey in its deep seabed claim area with the SeaBeam system in 19475. After analyzing the data, it was determined that there is a group of living things several hundreds of meters in depth that significantly affect the sound waves in the frequency range of interest. We will attempt to investigate more about such influences. Physical model testing is an important means for studying the theory, and for development of the technology for geophysical prospecting. Because the manganese nodules are distributed over the sea floor in irregular patterns, it is hoped that study of the acoustic properties of manganese nodules by means of physical model testing can improve interpretation of the data of the multi-beam system and the SeaBeam system. This will provide a more reliable basis for delimiting the mineral site and evaluating the reserves in the Pioneer area of China.

In October-November 1993, the Centre for Cold Ocean Resources Engineering, Memorial University of Newfoundland and University of Victoria jointly carried out reconnaissance surveys at Pine Cove, Baie Verte, Newfoundland. Pine Cove is the site of a multi-year study examining the environmental impact of a shallow water small-scale marine placer gold mining operation. The reconnaissance survey data collected will be used to develop a multi-year environmental effects monitoring (EEM) program for Pine Cove, Baie Verte, but more generally an EEM protocol for shallow water small-scale marine placer mining, which meets the requirements of Canadian government regula¬tors such as Environment Canada and the Department of Fisheries and Oceans. The Pine Cove mining operation is currently scheduled for the summer of 1995, and will use two mining methods: a hydraulic suction dredge in shallow water (<10 meters) operated by a scuba diver, and a hydraulically actuated clamshell dredge in deeper water (-30 m). A centrifugal concentrator will be used to extract the heavy minerals from the mined marine sediments, and the tailings will be returned to the sea floor via a suspended discharge pipe. The reconnaissance work at Pine Cove included geophysical, geochemical, oceanographic and biologi¬cal surveys, providing data which will enable prediction of the potential environmental impacts of the proposed mining operation. There are two environmental issues which have only recently begun to need planning in detail for marine mining. One is the environmental consequences of mine closure; the other is environmental terrorism. In principle it is not difficult to predict the pattern and rate of biodiversity recovery after mine closure on metalliferous depositional seabeds. 1-5 years to a self-sustaining community of organisms is a generalized guideline, depending on depth and particulate composition. The rate and pattern of biodiversity recovery on some metalliferous hard-rock habitats is far less predictable due to the patchiness and rareness of the habitat. Ecoterrorism at mines, whether on-land or marine, is now to be expected. A good example of resource industry ecoterrorism is the fire-bombing of logging and cement trucks in Oregon in 2001. But there have also been bombs at mine sites, as at Asbestos, Quebec. It is also possible to regard some resource-loss lawsuits as frivolous, hence forms of ecoharassment. Marine mining operations should take note of the development of environmental terrorism (and terrorism in general) and its various manifestations and impacts. Potentially these range from minor work stoppage inconveniences, to serious financial risk jeopardizing the economics of a mine, to jail for company executives, managers and environmental staff, and to harassment and killing of mine personnel.

The future exploitation of crust deposits will require a dependable characterization system. The U.S. Department of the Interior, Bureau of Mines (Bureau) initiated research to develop a new sampling dredge by conducting a series of cutting and physical property tests on previously collected cobalt-rich manganese crust and substrate samples. Using the engineering parameters derived from these tests, a large, heavy dredge was designed and tested. This heavy dredge was capable of fragmenting and collecting in situ crust, but it created handling problems for the research vessel, thus an aggressive cutting, light-weight dredge was conceived and fabricated. The light-weight dredge is capable of fragmenting and collecting crust and some talus. This dredge can be used on flat or rough seabed terrains. It can be easily retrieved from hang ups and reset to sample again.

Marine mining is driven by profitability, and profitability is driven in turn by people and equipment that can work productively and safely at sea. Design challenges faced by the marine mining community have much in common with those faced by the offshore construction community. Technical solutions continue to move freely between both communities. A brief pictorial history summarizes the evolution of offshore construction technology as it grew in the Gulf of Mexico and expanded worldwide. Attention is focused on those areas of platform and pipeline construcion where there is potential technology application to underwater mining. An especially difficult challenge faced by both communities is work in the surf zone. Some innovative concepts for surf zone construction operations are presented and possible applications to marine mining are suggested.

Issues of deep-seabed mining are discussed since four decades and extensive efforts have been invested in oceanographic studies related to environmentally sound harvesting of polymetallic nodules. Because mining on the deep seafloor seems to range from large-scale, two-dimensional dredging or scooping up of the ore from the uppermost surface sediment layer to more localized drilling or deeper digging into a three-dimensional ore body, it appears to be justified to reconsider some concepts for environmental impact evaluation. Based on the experience gained during preceding years in environmental studies related to polymetallic nodule mining, some interrelated hypotheses and proposals will be presented. It is suggested that these proposals be considered in future plans for environmental impact evaluation and that observations on community re-establishment be conducted before massive sulphide mining or other ore extractions enter the commercial mining phase.

Ferromanganese crust samples collected from Central Pacific sea-mount areas became of special interest after surprisingly high nobel metal contents have been analyzed. Hydrogenetic crust growth is controlled by the conditions of the oceanic water column. Thicker encrustations show two crust generations of different age ranges. The mean values of the chemical composition state that the older generation is richer in P, Ca, Ni, Cu, Zn, and Pt and depleted in Fe, Ti, Co, Al, and Si. The differences apparently indicate a distinct change of the geochemical environment. The Pt concentrations vary up to 1800 ppb and do not clearly correlate to one of the other metals. This might indicate a bond of multiple nature. Several mechanisms have been proposed to explain the Pt concentrations in ferromanganese samples. Our models consider seawater and cosmic spherules as responsible Pt sources. In seawater the main species of dissolved Pt probably exist as the doubly negatively charged tetrachloro-complex. A precipitation of Pt in seawater may take place if the chloro-complex is decomposed by reduction of pt2+ to pt0. On the other hand, the Mn02 precipitation is caused by an oxidation of Mn2+ which is supplied from the oxygen-minimum zone. Up to now, much data on marine minerals, as well as on marine geochemistry, have been accumulated. Modem computer databases provide optimum flexibility and power for manipulating these data. The best worldwide marine mineral database is currently the Marine Minerals Bibliography and Geochemical Data Base created by Carla Moore et al. at the National Geophysical Data Center in the United States. In fact, in the course of studying marine minerals and geochemistry we may collect not only digital-character type data but also graph and image (black-white, grey and color image) data types. For instance, correlation diagram between chemical compositions of minerals, spectroscopic graphs, (e.g. infrared spectra, Mossbauer spectra, etc.), grey or color images from both optical and electron micro- scopes (scanning or transmission electron microscopes) as well as seabed photographs. Charles L. Morgan et al. (1993) reported that 10,000 photographs and some video images of the seabed in the Clarion-Clipperton region of the northeastern tropical Pacific have been collected by the Ocean Minerals Company. If both graphic and analytical information were stored in a database, it would be very useful and convenient to marine geologists. This system would not only be able to search for all the data based on one parameter, but also for both size and composition distributions. If possible, geostatistical methods could be combined with fractal dimensional methods. Of course, this would require enormous efforts. Before multimedia technology emerged, it was very difficult to create image databases. The emergence of large-capacity compact discs, high-speed central processing units, and high-speed digital signal processing techniques makes it possible to establish multimedia database management systems (DBMS), image-text DBMS, that involves graphs, text, images, and sound. In order to store image fields in a DBMS, we have to take into account two problems: (1) image access format and (2) image compression code standard.

Since industry is progressing into the deep sea, marine scientists have expressed their concern about environmental disturbances which will be introduced by using the deep seafloor for mining metalliferous resources or as a repository for wastes. Environmental studies have been conducted on national levels and in bilateral or multilateral cooperation in the development of manganese nodule mining, as this is generally achieved in marine research. These investigations were partly large-scale and experimental approaches aiming at the assessment of the impacts expected to occur in commercial mining. The results elaborated till today and expected to be acquired in the foreseeable future may remain limited. Reliable impact evaluation will result from monitoring a Pilot Mining Operation (PMO). The lecture will present the broad outlines of a possible program and a preliminary calculation of approximate costs for such a combined industrial test and environmental monitoring event. Although the extent of necessary efforts for the environmental risks evaluation can only be estimated rather vaguely, it will become evident that the required human, technical, logistical, and financial resources to be mobilized will exceed industrial capacities and go beyond national funds. Therefore, such assessment of environmental risks is calling for broad international cooperation. While industrial developments for mining the deep sea will be ruled by competition or probably by restricted joint ventures, environmental care ranges outside competition and falls within the interest of all parties involved. Environmental studies, unlike technologies for the same function, do not primarily need duplication. International cooperation in PMO monitoring would equally well support all mining companies or consortia, it would minimize the efforts for all engaged in this challenging venture of deep-sea mining and it would maximize the precautionary discussion on and the care for the deep-sea environment.

The present three-year long phase of the SOPAC/Japan Deep Sea Co-operative Mineral Resources Programme [Programme], commenced in 2000. The Programme has been funded by the Government of Japan through the Japan International Co-operation Agency (JICA) and the Metal Mining Agency of Japan (MMAJ), since 1985. Field survey activities and associated data analysis and interpretation, for the Programme, has largely been carried out by the Deep Ocean Resources Development Co., Ltd. (DORD). The Government of Japan has, since 1982, recognised DORD as one of its ? Pioneer Investigators? for manganese nodules in the Clarion Clipperton Fracture Zone . Although the objective of this paper is to present the results of the drilling cruise that was conducted from December 2001 to January 2002, within the North Fiji Basin, in Fiji?s EEZ, it will also seek to provide a broad overview of the results of the cruise conducted within the Cook Islands in May to June 2000, as well as present preliminary results of the cruise conducted in the Marshall Islands in June to July 2002.

The Continental Shelf Division of the Marine Minerals Technology Center has recently completed field tests of the percussion- waterlift drill and the vibracore/vibralift convertible drill. The two systems have been modified from existing drills to increase their effectiveness and flexibility for nearshore minerals exploration. Originally the percussion-waterlift drill was designed for iand based operations, but it has been modified for use in protected shallow water areas. This drill is easily maintained, inexpensive to construct and operate, and is able to accurately recover representative samples from a variety of sedimentary deposits. Sampling is accomplished using either a reverse circulation method for the recovery of a slurry of sediment cuttings and water or employing a thin walled "Shelby tube" to core zones of interest. The vibracore/vibralift convertible drill is a modification of the remote placer drill (RPD). By combining these drills into one convertible system, it is possible to recover continuous cores of unconsolidated fine-grained sediments (vibracore), a slurry of clay to gravel size sediments over 1.0 meter intervals (vibralift), and to sample sedimentary material in environments where indurated

Studies of benthic recolonization following the cessation of dredging in U.K. waters and elsewhere are limited, and are largely confined to experimental circumstances. Investigations of the physical and biological status of licensed areas in the U.K. at various times following cessation of commercial dredging are very limited and so judgments as to the likely progress towards environmental restoration and the time-scales are often based on predictions rather than real data. This study was established to address this deficiency by assessing the status of seabed substrata and associated benthic fauna within and outside areas where dredging had ceased and to conduct follow up sampling to monitor progress towards full recolonization.

The U.S. Geological Survey (USGS) recently completed phase 1 of a mapping effort that makes the United States the first nation to systematically acquire image maps of its underwater lands. In 1984, the USGS, as part of its mission to map and characterize the resources of the Federal lands, began a mapping effort in the newly proclaimed Exclusive Economic Zone (EEZ). The goal was to provide sonar image maps of this frontier area within 10 years. The mapping program is on schedule, with two-thirds of the EEZ sea floor, approximately 2 million square nautical miles, happed in 7 years. The deep water EEZ (depth greater than 200 m) around the 50 states is now complete except for the North Slope of Alaska, where ice precludes our surveying with a surface ship. Phase 2 of the EEZ mapping effort will begin in 1994, focusing on the American Flag islands of the western Pacific. Approximately 1 million square nautical miles of sea floor remain to be mapped around the islands.

"A deposit of phosphate nodules is on the Chatham Rise approximately 450 kilometres to the east of Christchurch in the South Island of New Zealand. The deposit contains sufficient rock phosphate to supply New Zealand’s phosphate fertilizer needs for at least 20 years. It was first investigated commercially 50 years ago by Global Marine, followed by JBL Minerals in the early 1970’s. NZ and German government research and industry groups then took it up again, with major field programs in 1978 and in the early 1980s.Due to difficult global and local economic conditions the project ground to a halt in 2004.The project was resurrected in 2007 when Chatham Rock Phosphate applied for a prospecting licence. This was granted in 2010 and a successful subsequent mining permit approval followed in 2013. The initial application for the separately required environmental permit was declined in February 2015.A lot has changed then and the significance of this will be the subject of the presentation. Chatham Rock Phosphate is confident that an environmental permit will be successfully granted next time."

Mining is a waste intensive industry, oftentimes producing hundreds of kilograms of waste rock and tailings for every gram of metal recovered. Disposal of mine tailings is a major concern in most mining operations. In Southeast Alaska the steep terrain and high seismic hazard province limits cost effective opportunities for land disposal of tailings. The lack of infrastructure and long travel distances generally limits secondary utilization of tailings, as well. Since the mines are located close to tidewater, submarine tailings disposal is an attractive option for tailings management. At the present time the EPA will not issue a permit that authorized marine tailings disposal from any mining process that includes flotation technology. Upland disposal is the "Best available technology" and must be used. Consideration of submarine disposal is generally precluded because the tailings are contaminated with fluids from the flotation process. However, when developing technological solutions to minimize environmental disturbance, destruction, pollution, and risk, submarine tailings disposal deserves another evaluation. In Southeast Alaska it may be the "Best available technology" based on an assessment of all issues and concerns in these mining projects.

Under the provisions of the U.N. Law of the Sea Convention Ireland is likely to have mineral rights to an area of continental shelf some six times its present land area. Apart from the major potential hydrocarbon basins which are currently the focus of active commercial exploration, little is known about the mineral resources of this vast area. In recent years a variety of mineral resources however have been identified from the coastal region. These include Sand and Gravel aggregates, Calcaraeous Algae (Lithothamnion), Heavy Mineral Sands and Coal deposits. The potential also exists in the coastal zone for buried placer deposits and base metal deposits. Several million cubic metres of gravel and hundreds of millions of cubic metres of sand have been identified by the Geological Survey of Irelands (G.S.I) Marine Unit off the east coast. The greater part of these deposits lies within the 10 metre depth contour and are easily recoverable. Irish aggregate needs at present are well supplied by onshore Pleistocene glacial deposits. Commercial interest in offshore deposits is in supplying coastal areas which are locally poor in aggregate and major coastal construction works. The possibility of supplying the large British and Continental European Market nearby also exists.

Diamond mega-placers, in order to rank amongst the primary diamond deposits, are defined as => 70 m carats at =>95% gem quality. There is only one mega-placer known and that is found along the coast of southwestern Africa fringing the Kaapvaal craton. Placers are classified as residual when they are left on the craton, transient when being eroded into the exit drainage and terminal. Terminal placers, in being the final depositories of diamonds off the craton, have the greatest probability of being a mega-placer and such is the case in the placer deposits near the Orange River mouth, southwestern Africa. There are four main groups of conditions leading to the development of a mega-placer: the craton, the drainage, the nature of the environment at the terminus and the timing. The craton, in its role as the producer of diamonds is significant in respect to its size, diamond-fertility, the degree to which diamonds from successive kimberlite intrusions have been retained there and their availability to the final drainage yielding the mega-placer. Cratons in being buoyant have a tendency to leak diamonds into surrounding basins but in being incompressible often have orogens converge onto them resulting in lost sediment being returned as foreland basin fills. In order to concentrate a bulk of diamonds the drainage basin has to be large with a high proportion of it on the craton. The drainage yielding the mega-placer should ideally not have been preceded by older drainage and other systems that may have robbed the craton of earlier diamonds. The exits of diamonds from the craton need to be few in order to focus on their supply and the drainage network needs to be efficient in order to remove the maximum volume of diamonds off the craton. This efficiency and the focused termination is best achieved by the rejuvenation of a pre-existing drainage network. The drainage should be young enough to yield host sediments friable enough to allow brittle diamonds to be recovered from them.
