Many, if not most, of today's pollution liability claims are related to events ("occurrences") that happened in the past. This fact creates an opportunity to obtain a large amount of insurance coverage at essentially no cost. Furthermore, in many cases, this insurance coverage is readily available. Scenario #1 For some 15 years, an underground gas tank has had a slow leak. The leak has now been discovered because the gas has contaminated nearby wells. As a result, an expensive $1 million cleanup is required. In addition, a liability suit has been filed for damages due to the contamination of nearby wells. Consequently, legal expenses are being incurred. Are all of these actual and potential costs insured? Obviously, if you have a pollution liability policy in place, the above costs will probably be insured. I say probably because business liability policies are not uniform. But, what if you don't have a pollution liability policy and what if your current general liability policy excludes all pollution liability (as most of them do today)? Under these circumstances, it first appears there is no insurance for this $1 million cleanup and liability suit. But this is probably not the case. You may well have insurance coverage, and you may well have much more insurance coverage than you ever expected. And, the insurance that I'm referring to is already in place. You simply need to find it and learn how to use this insurance - I'm referring to your old policies. In many cases, old liability insurance policies provide coverage for claims made today, because these policies were written on an "occurrence" basis of coverage. In fact, most still are written this way. This means that the insurance policy covers bodily injury or property damage liabilities (as defined in the policy) arising out of' "occurrences" or accidents that happen during the policy period regardless of' when the claim for damages is made. Therefore, for insurance purposes, the key question is: when did the "occurrence" take place? If someone falls and breaks a leg, that is clearly an "occurrence." The broken leg occurrence is, therefore, insured by the liability policy that was in existence at the time of the fall - regardless of when the claim or suit is filed, if ever. However, the answer to this question is seldom an easy one when you are looking at a pollution claim. In our scenario, the tank had a slow leak over 15 years, but property damage was not discovered until now. The question of when the "occurrence" (as defined in the insurance policy) took place has been litigated and continues to be litigated in many courts across the country. But, most often the answer has been that, for insurance purposes, the "occurrence" is the entire period that the tank was leaking (15 years), even though the contamination to the water was not discovered until 1987. This means that the person or company that is insured can potentially use all of its general liability policies (if they are "occurrence" policies, and most were), which were purchased during the 15 years from 1972 until 1987. And, these policies will potentially insure all of the claims and related exposures that arise out of this leaky underground gas tank. Scenario #2 In our first scenario, the claims and expenses were insured by past general liability policies because the claims arose out of events in the past, which, in turn, caused damage. Let's look at another example. In this scenario, Company XYZ has received a request to help clean up a landfill site because 10 years ago, XYZ dumped some toxic substances at the site, which was totally legal at the time. XYZ has not dumped anything at the site since this time. Nevertheless, XYZ is now being required to contribute $2 million to the cleanup of this site. In this scenario, if you had purchased "occurrence" general liability policies 10 years ago, these 1977 policies would (potentially) apply to the current $2 million cleanup claim. And, the reason is that the "occurrence" leading to the 1987 claim took place in 1977.

INTRODUCTION Generations of tunneling engineers had to fight not only against bursting rock and squeezing ground but also against the destroying power of water. Intrusion of groundwater into the tunnel opening affects the stability of the tunnel support system, reduces the safety of the traffic inside the tunnel, induces corrosion of installed equipment, and provides for creeping currents at electric facilities. Aware of these problems, engineers of the Washington Metropolitan Area Transit Authority and their consultants opened the way for a new approach in sealing a tunnel. It was made possible by accepting a new method of tunnel construction scarcely applied in the U.S. before. This new technique, the New Austrian Tunneling Method (NATM), provided the basis for the successful installation of a PVC-membrane between two separated shells of tunnel lining, and the carefully directed drainage of groundwater. Beside of the economic benefits already attained by applying the NATM for tunnel construction, the Authority now saves millions of dollars otherwise necessary to maintain the tunnel during its lifetime (Garrett, 1986; Setzer, 1986). But there is a large number of leaking tunnels built according to conventional methods, some of them facing severe problems jeopardizing the safe utilization of these structures. Recently developed methods indicate that even those tunnels can be rehabilitated without extensive costs by draining and sealing them afterwards. A road tunnel in the Austrian Alps provides the scene for a major attempt to convert one of those leaking tunnels into a dry structure.

On June 25, 1999, BHP Billiton (BHPB) announced the suspension of operations at the BHP Copper Inc.(BHP) San Manuel copper mine in Pinal County, Arizona. Subsequent to this announcement, BHPB aggressively pursued a number of alternatives for the underground mine and open pit facilities, including continued curtailed operations, sale to a qualified mining operator and closure of the property. After consideration of these various alternatives over a 2.5-year period, BHPB announced final closure of the mine site on January 15, 2002.This paper describes how the BHPB charter and HSEC policy apply during the closure process.

Explosion-resistant seals in underground coal mines isolate the environment within the sealed area from the active workings of the mine. The current United States Title 30 Code of Federal Regulations (CFR) requires these seals to be constructed of solid concrete blocks. The CFR also allows for alternative methods or materials to be used to create a seal if they can withstand a static horizontal pressure of 138 kpa (20 psi), provided the method of installation and the material used is approved in the ventilation plan. The purpose of this report is to identify those explosion- resistant seals that have been tested and meet or exceed all the requirements of the CFR.

Problems discussed concern encountering of high temperatures [up to 66°C] and heavy flow of water [150 L.P.S] during the construction of the 10.15 MØH.R.T. for the 2500 MW Nathpa Jhakri Hydro Power Project in the Himalayas(India). Over a length of 2500 M progress of work got seriously affected resulting in excessive time for completion - two years [max. monthly progress achieved was 178 M [Heading]. Many innovative and simple steps were taken to complete the work in these inhospitable environs affecting working of both men and machines. Also it meant a review of the design of concrete lining. Other geological conditions affecting the progress are also described.

THE PROBLEM Two and a half years have gone by since the December, 1976 Civil Engineering article on subway costs caused such a furore. What has happened in this interval? Even after discounting the crushing inflation rate, costs are still increasing, and there is no sign of a turndown, even in the rate of increase. Some steps outlined in the article have been taken. In April this year, the first D.O.T.-sponsored Peer Review Group, made up of managers of other transit properties, met in Boston to review MBTA's $500 million Red Line Extension-Northwest for cost effectiveness. While the impact of a review at the end of the design phase, with substantial segments under contract, cannot be as effective as a review early in the design phase, it is nevertheless a start. This first meeting will be followed by a review of Boston's Orange Line relocation, the final design for which is just underway. In the industry at large two facts are evident: 1. We are failing to reduce underground construction costs. 2. Underground construction is in danger of pricing itself out of the market place. It has always been a greater challenge to design a Chevvy than to design a Cadillac, but it is the Chevvy we need today. Much attention has been focussed in the past on engineering design in the narrow sense: areas such as ground loading conditions and concrete design. Environmental impacts from acidic mine drainage are growing national concerns that are particularly acute in the headwaters of the Rocky Mountain region. In the Black Hills of South Dakota, approximately one thousand mines are inactive or abandoned, most of them in the headwaters of major drainages. This paper examines the Bear Butte Creek basin, a heavily mineralized watershed with significant historical mining impacts and a surface gold mine permitted in 1997. The watershed loses its surface discharge to swallow holes in the karstic Madison Limestone. The integrity of the aquatic ecosystem was monitored with a suite of sitespecific bio-indicators. Stream surveys covered the entire reach of Bear Butte Creek from near its headwaters to the swallow holes in the Madison aquifer. Data from the stream surveys, water-quality sampling, and bio-indicator surveys clearly showed that water-quality impacts are limited mainly to Strawberry Creek and to the area of Bear Butte Creek near and downstream of the town of Galena.

The attapulgite industry saw a year of solid growth after a weaker 2003. Demand was up between 5 percent and 6 percent driven by almost all of the key markets. Construction continued to show record new housing demand, assisted by continued low interest rates. That drove strong growth in construction related markets like coatings, tape joint compounds and other construction materials applications. The agricultural markets rebounded modestly to increase sales for suspension fertilizers, animal feeds and pesticide carriers. Oil drilling also showed strong growth due to high oil and gas prices. Sales to molecular sieve applications grew due to petrochemical and construction demand. The export markets were assisted by further depreciation of the dollar. The only weak area was in nonagricultural granular sorbents, where other sorbent materials continued to dominate.

The design/optimization of the pump and cyclones to maximize grinding circuit efficiency first requires a concise understanding of, and clearly defined specifications for, desired grinding circuit performance. Subsequently, the pump and cyclone performances that provide the desired grinding circuit performance can be defined. Once the performance requirements of each process unit are determined, selection of physical equipment parameters that will deliver those performances can be carried out. The Functional Performance Equation shows that there are two distinct efficiencies in closed circuit ball milling. One of these, ?Circuit Classification System Efficiency? (CSE), is the fraction of ?coarse? material inside the ball mill upon which grinding energy is deliberately expended, versus the remaining fraction of ?fines? or finished size material inside the mill, upon which grinding energy is wasted (on over-grinding). The role of the pump and cyclones is to maximize CSE, which is the desired grinding circuit performance. The obtainable, target CSE for any given circuit can be estimated, for example by referring to a plant data base of CSE?s. Design/optimization guidelines then allow us to specify the pump and cyclone performances that will achieve the target CSE. This paper outlines the step-by-step, systematic method of pump and cyclone selection which maximizes CSE. Numerous examples of its successful application are provided.

San Martin Mine is an open pit, gold heap leach operation located approximately 70 kilometers from the Honduran capital of Tegucigalpa. Mining operations commenced in 2000 and were completed late in 2007, while heap leaching operations continue. Reclamation was executed concurrently with operations to the extent practical. The area has distinct rainy and dry seasons and closure objectives include: prevention and mitigation of acid rock drainage, sediment and erosion control, and mitigation of visual impacts. Final closure is well underway at San Martin and this paper describes the closure processes conducted to date, problems encountered, and the subsequent lessons learned.

INTRODUCTION Mica Dam is located on the Columbia River just downstream of the "big bend" of the Columbia, where it leaves the Rocky Mountain Trench and begins to flow southwards, approximately 85 miles north of Revelstoke, B.C. (Fig.l). The dam was built as one of three Columbia River Treaty dams in British Columbia which regulate the flow of the river and provide flood control downstream in Washington and Oregon. In addition, the three Canadian dams make possible greatly increased power generation at existing power plants in the United States and further development along the Columbia and its tributaries in British Columbia. History Mica Dam, constructed during the period 1967 to 1973, is a zoned earthfill embankment 650 feet high, which has 12,000,000 acre feet of live storage and an available head of 550 feet. Power intakes which would serve either a six-unit surface or underground plant were incorporated into the design and construction of the right abutment of the dam (Fig. 2). Prior to 1971 alternative 2500 MW capacity surface and underground powerplant arrangements were studied. Cost estimates for the two alternatives were the same within the limits of estimating procedures. However, it was believed there was a certain continuing risk in locating a surface plant at the toe of a steep canyon wall. Machine guidance and control systems have become more pervasive in the mining industry in recent years but not always from mining-experienced providers. Dozers, motor graders, scrapers, excavators, shovels, draglines, drills and haul trucks are just a few examples of the types of heavy machinery now equipped with global positioning system (GPS)-aided guidance systems. While equipment manufacturers are offering their own software, many only supply solutions for the machines they produce. The proliferation of GPS equipment manufacturers entering the machine guidance and control arena has resulted in a multitude of makes and models of GPS receivers. Some of these companies also produce their own guidance software. But they usually just specialize in a narrow range of heavy machinery. So customers are forced to use multiple systems and face new challenges in implementation, training, reporting and inter-system communication.

Adaptations and redesign of the existing already very successful and proven road milling machine concept and technical innovations such as an optimized, specifically for mining application developed cutting drum, cutting housing design and cutting tools, high manoeuvrability achieved via a tight turning radius, a three disk clutch system and a cutting drum drive that allows for the acceptance of higher loads, a complete reinforcement of the chassis to withstand higher vibrations and torque, the installation of increased engine power via a modern drive unit, a specifically for mining/construction applications developed operator’s platform and finally a redesigned air intake system and the adaptation of the levelling system resulted in far more cost effective and advantageous capabilities of Wirtgen Surface Miner in soft to medium hard mining and construction applications. As the achieved results show for the first time in modern surface mining history mechanized cutting is capable to compete successfully against traditional drill, blast/ripping and other conventional mining methods.

INTRODUCTION It was not very many years ago that tunneling machine manufacturers spent considerable time trying to convince contractors and mine operators of the advantages of mechanical tunnel boring over conventional drill and blast methods. Today there are few doubters left. There is universal agreement that, not only are tunneling machines here to stay, but the ratio of bored rock tunnels to blasted rock tunnels is increasing at an accelerated pace, and within the next twenty years I predict almost all tunnels will be bored by machine. I believe we are today at a very important mile-post in the development of tunnel boring systems. Felix Gaye stated in his recent article (1) "It is important to disseminate between the efficiency of cutting tools and the overall efficiency of the boring operation". Mechanized tunnel boring in the past placed almost total emphasis on the rock cutting and boring ability of the tunneling machine. With advancements in technology and better solutions to the problems of rock fracture, steering control, and structural design, the emphasis today can be placed on the total-system concept. Tunneling machine design, as one of the key elements in the overall system, presents many problems that are not totally solved today. These design problems are, in the most part, not related with rock fracture, but rather with criteria associated with the over-all operation.

Two great revolutions in mining occurred during the 20th century. The first took place almost 100 years ago (1903-1905) with Daniel Jackling’s experiment in the economies of scale for large-scale mining at Bingham Canyon. Jackling’s ideas changed the focus of base metal exploration toward lower-grade, high-tonnage deposits. The second revolution was the impact of environmental and social concerns on mining. It started near the end of the 20th century and is still under way. This article speculates on the effects of this second revolution on the future of mineral exploration.

Cable shovels are capital-expensive and primary production equipment in many surface mines. The forces acting on the shovel dipper vary as the dipper moves through the muck-pile. The variations in the forces cause stress loading of the components of shovel and dipper resulting in unplanned downtimes, reduced shovel efficiency, and high mining costs. A potential solution to the above problems is the deployment of an intelligent shovel excavation (ISE) technology, with real-time formation identification, recording, and knowledge transmission capabilities. This research advances the ISE technology by developing dynamic model of cable shovel dipper using Newton-Euler techniques. The model includes the dynamic cutting and dynamic weight forces acting on the dipper as it moves through the muck-pile.

Thallium is an uncommon heavy metal that may be found in concentrations that exceed regulatory limits in mining influenced water associated with processing cadmium, copper, gold, lead, and zinc ores. This study evaluated cost-effective modifications to lime precipitation treatment to reduce thallium concentrations to below the EPA drinking water MCL of 2 ppb. The oxidative precipitation of Tl+ to Tlß+ by potassium permanganate was explored for thallium removal at low concentrations (1 ppm initial thallium). Laboratory batch tests were performed to evaluate the removal of thallium from synthetic solutions. Three ratios of potassium permanganate to oxidizable metals in solution were used (one-half, one and two times stoichiometry). Thallium was removed to less than 1 ppb for all stoichiometric ratios evaluated within 10 minutes of reaction. The efficacy of oxidative precipitation for thallium removal is presented.

Accurately estimating load distributions and ground responses around underground openings play a significant role in the safety of the operations in underground mines. Adequately designing pillars and other support measures relies highly on the accurate assessment of the loads that will be carried by them, as well as the load-bearing capacities of the supports. There are various methods that can be used to approximate mining-induced loads in stratified rock masses to be used in pillar design. The empirical methods are based on equations derived from large databases of various case studies. They are implemented in government-approved design tools and are widely used. There are also analytical and numerical techniques used for more detailed analysis of the induced loads. In this study, two different longwall mines with different panel width-to-depth ratios are analyzed using different methods. The empirical method used in the analysis is the square decay stress function that uses the abutment angle concept, implemented in pillar design software developed by the National Institute for Occupational Safety and Health (NIOSH). The first numerical method used in the analysis is a displacement-discontinuity (DD) variation of the boundaryelement method, LaModel, which utilizes the laminated overburden model (Heasley, 1998).

Extraction of Al(III) from aqueous sulfuric acid solutions into organic Cyanex 272®-carbon tetrachloride systems was investigated from a multi-component mixture containing aluminum, cobalt and nickel. Al(III) extraction efficiency was quantitative with 1.0 M Cyanex 272® in two stages at an aqueous: organic (A:O) phase ratio of 1:1 and an equilibrium pH of 3.2. The stripping of Al(III) from the loaded organic (LO) with different acids indicated sulfuric acid to be the best stripping agent. More than 99% stripping of Al(III) from the LO was achieved using 2 M H2SO4 at an A:O phase ratio of 1:1 in a single stage. The stoichiometry of the extracted species of Al(III) was determined by the slope analysis method. The extraction reaction proceeded via the cation exchange mechanism and the extracted species was assumed to be AlA3?3HA, where HA refers to the dimeric and A the anionic form of the extractant, Cyanex 272®. The extraction of Al(III) was studied in the presence of various ions to ascertain the tolerance limit of individual ions.
