Risk and dispute resolution are linked. Dispute resolution techniques are brought to bear on a dispute - which is an outcome of a risk being wholly or partially realised. There has been an increasing awareness by business of risk as a component of doing business. There is an accompanying awareness of the need to manage risk - including legal risk. Many companies have undertaken a systematic review of their potential risks and endeavoured to put in place systems to help to avoid or manage risks. A legal risk management program will not prevent disputes arising. However, such a program should prescribe how that dispute will be managed. The management of the dispute will involve consideration of the dispute resolution procedure to be adopted. The most appropriate processes will take into account the practical, personal and commercial considerations surrounding the dispute and be as efficient, cost-effective and user friendly as achievable in the circumstances for the benefit of all the parties. Carrying on business in South East Asia, whether as an explorer or a mining operator, brings additional considerations to bear in legal risk management and the dispute resolution process. A significantly different perspective is required due to the varying nature of the legal systems in many South East Asian jurisdictions. These jurisdictions often have relative uncertainty as to the law. This impacts on the dispute resolution processes and also raises further timing and cost issues. The authors contend that this is all the more reason to endeavour, as practically as possible, to adopt a legal risk management and dispute resolution profile which will provide business with the greatest prospects of maintaining control of the dispute resolution process. This presents a greater chance of a successful outcome to the dispute. In these times of increasing pressures on profitability because of low mineral prices, all costs of a minerals business are being reviewed. In such times, a significant legal dispute may have even greater potential to adversely impact on the companies concerned, together with the careers of the people involved. In this paper possible approaches to managing disputes and a case study a legal dispute in which Freehill Hollingdale and Page were involved are discussed. The dispute concerned an international mining company developing a gold mine in Indonesia and one of its contractors in Indonesia. Described is how that dispute was resolved. This achieved a very satisfactory result for the client - all things considered. Given the æadditionalÆ problems associated with ascertainment and enforcement of ærightsÆ in South East Asia, the longer the parties can retain control over their dispute the better off they will be. For this reason, the authors set out in this paper the main additional dispute resolution tools available - that are appropriate for use throughout South East Asia.

Newmont Waihi Operations is participating in the initiation of a community liaison forum in association with the local district council. The objective is to provide a forum for the free and regular exchange of ideas, concerns and information, and through improved communication seek to achieve a more comprehensive set of solutions to community, operating and closure issues associated with Martha Mine. A similar liaison forum has been operated on two previous occasions during earlier phases of the present mine's operation. This paper deals with the practical aspects of setting up a liaison forum to act as an effective conduit between regulators, mine operators, local businesses and the community. The mechanisms and procedures for identifying community issues and concerns are dealt with. The actions and structures required to ensure effective ongoing community 'buy in' at all levels are discussed. Corporate philosophies are addressed. Specific examples from Martha Mine, Waihi New Zealand will be used to illustrate the paper. This will include a brief explanation of previous and current community issues, Newmont Waihi's operations both at Martha Mine and the proposed Favona underground mine, and the practical issues involved in setting up a liaison forum.

Since its inception in 1962, the Julius Kruttschnitt Mineral Research Centre has adopted the view that an effective method of training highly qualified engineers for the mineral industry is the pursuit of postgraduate research programmes conducted in operations, that is, in the mines and processing plants of the industry which the research serves. The paper describes how this is achieved in practice, at little or no cost to the taxpayer, and explores the strengths and weaknesses of this approach in the context of a dual mission for the Centre: 1. The postgraduate training of engineers for the mineral industry. 2. The production of useful R &I) for the mineral industry. Topics discussed include financing, relationships with industry and Government, the maintenance of academic excellence, research style, the marketing of research, and limits to growth.

Within the last decade, major research discoveries have been made in the submarine realm of magmatic and hydrothermal activity of arc-backarc systems in the southwestern Pacific. These include identification of numerous particulate-poor, gas-rich (CO2-CH4) hydrothermal plumes emanating from arc front volcanoes, actively forming porphyry-copper-gold style mineralisation, and new backarc spreading systems erupting alkali basalt-trachyandesite magmas. Major goals of these studies have been identification of modern analogs to ancient volcanogenic massive sulfide ore bodies, and quantification of the volatile fluxes though supra-subduction zone systems.

At the Red Dome and Mungana deposits in north Queensland, Australia, it is proposed that mineralisation and alteration developed as a 'telescoped' overprinting continuum, ranging in style from hypothermal to epithermal, reflecting the major changes that developed in the regional setting over the period circa 325 - 290 Ma. Regional assessment suggests that this also applies to many other precious and base metal deposits within a 40 km length of the host Siluro-Devonian Chillagoe Formation.   A ten stage paragenetic sequence of structural preparation, multi phase intrusion and associated mineralisation, alteration and brecciation is postulated for the Chillagoe district.

Traditionally comminution optimisation has been focused on energy minimisation, whereas flotation optimisation has been focused on recovery improvement. One of the largest, if not the largest, operating cost over the life of a flotation circuit is electrical energy. With increasing pressure on operators to lower production costs and the cost of energy increasing, reducing the energy consumption of the flotation circuit can be beneficial to site economics. This paper reviews the use of energy by mechanically agitated flotation machines and discusses the measurement and benchmarking of energy consumption in modern flotation concentrators. Mine rehabilitation is a sustainability issue that has been revisited ad infinitum; however, the persistent lack of demonstrated on-the-ground performance and an increasingly intractable rehabilitation liability in Queensland continue to erode the credibility of the mining industry and regulatory bodies. For at least ten years the need to change the current, process-based approach to rehabilitation to an outcomes-based approach has been apparent. The ISO 14001 series temporarily diverted attention from this important point, however it would appear the limitations of an ISO 14001 approach are now more widely accepted. It is proposed that a successful outcomes-based approach cannot be achieved without meaningful community engagement. The apparently intractable nature of the rehabilitation issue will continue to generate conflict and criticism unless all stakeholders are encouraged to participate in the process of developing robust and practical outcomes for rehabilitation. Sharing the responsibility will ensure the best possible outcome. It is important to recognise the valuable resources inherent in community groups, many of whose committed volunteers have considerable expertise in relevant areas. Community groups should not be seen as adversaries but as allies in the process of solving problems that affect the wider community. Several projects that can be seen as test cases for the engagement of stakeholders exist, and in this paper the process of achieving multiple stakeholder engagement in the context of Environmentally Sustainable Development is discussed.

The Kulumadau deposit represents an intermediate-sulfidation epithermal gold deposit (3.8 Mt at 2.3 g/t, Ag:Au = 1). Mineralisation is primarily confined to hydrothermal breccias within pre-existing fault zones, where it is disseminated throughout a hydrothermal matrix comprising chlorite-quartz-adularia-illite-I/S clays-calcite-pyrite. The host sequence represents numerous mid-Miocene pyroclastic flow eruptions within a tectonically active emergent shallow marine to subaerial depositional setting. Subsequent growth faulting was responsible for debris avalanches, which were subsequently cut by reverse faults. Faults were exploited by hydrothermal fluids, with the heightened porosity at the juncture between faults and debris material facilitating boiling of the ore constituents. Fluid inclusion studies suggest that fluid mixing between meteoric fluids and magmatic fluids, accompanied by boiling, were the primary mechanisms for gold deposition. Observed mineral assemblages in the Mt. Lyell copper deposit can be correlated with phase equilibrium investigations in the systems Cu-Fe-S and Fe-Zn-S. The trend of crystallization (or paragenetic sequence) of the ores is reflected in a progressive increase in the Cu: Fe and metal: sulphur ratios of the assemblages. This trend agrees with the regional zoning of the district. Tentative relationships between the paragenetic sequence, sulphur vapour pressure, and temperature are presented graphically. The absence of a suitable geological thermometer prevents precise elucidation of the range of temperatures and pressures which existed during crystallization.INTRODUCTIONRecent phase equilibrium investigations of metal-sulphur systems at the Geophysical Laboratory, Washington, D.C. provide valuable information on the stability relations of a number of important sulphide minerals. This data, when applied to natural ore deposits, may be expected to clarify two special problems which confront the ore petrologist seeking to interpret observed data in terms of a particular physical and chemical environment of ore deposition. These two problems are the sequence of formation of sulphide minerals (commonly designated the paragenetic sequence) and an elucidation of the range of temperatures and pressures which existed during crystallization. The object of this paper is to make such an interpretation of the copper mineralization of the Mt. Recent work on decoppering lead is reviewed CUS is formed rapidly even from dilute solutions of copper in lead. The mechanism of decoppering is discussed and an explanation for the retention of metals such as silver in lead is advanced. As decoppering tin appears to be an analogous process, the, Cu-Sn-S system is studied at 300°C.. CuS, which is not an equilibrium product, is found m decoppermg drosses. In the removal of nickel from lead, Ni3Pb2S2 is formed; preliminary measurements show the equilibrium nickel content to be greater than that obtained by stirring in sulphur. Decoppering bIsmuth IS thermodynamically favoured, but is complicated by the occurrence of CuBiS2 The Cu-Pb-S system IS the only one of the four studied where the equilibrium can be calculated simply, as the presence of ternary sulphIde or other phases invalidates calculations based on binary data.

In panel caving in underground mines, it is essential to characterise and monitor the stress and stability state of production level pillars to ensure the extraction of the mineralised ore column and the safety of workers. Pilar Norte is a sector in the El Teniente mine that forms a pillar between the undercut fronts of the adjacent Esmeralda and Reservas Norte sectors. It exists in a high-stress environment, which may induce damage to the rock mass production pillars. Generally, numerical models are calibrated using observed damage in galleries. This procedure does not discriminate between the structural condition and/or the blasting damage effects. This paper proposes a technique that uses borehole cameras to measure stress-induced damage. This has the advantage of being at the intact rock scale, meaning that the effect of geological structures is negligible and the blasting damage factor is eliminated. Comprehensive geotechnical characterisation and tomography monitoring has been undertaken at Pilar Norte to describe and determine the rock mass behaviour of the production pillars. By combining analytical, empirical and numerical models, a correlation between the measured overbreak recorded by the borehole cameras and the stress level of the pillar was developed.
