THE oil and gas lease is the basic contract of the oil and gas industry; it is the foundation stone upon which the producing industry, particularly, is based. As the industry is precarious and highly speculative, the foundation contract should be of the utmost integrity and certainty. But right there an anomaly exists; the oil and gas lease is the most obscure, most uncertain, doubtful contract in the realm of law today. That is a condition that must be considered when taking oil and gas leases, and when buying, selling, and holding them. It may fairly be asked why should this industry rest upon so insecure a foundation. Why should not the oil industry rest upon the contract that is the basis of all industry, the warranty deed? There are many contributing reasons, but the principal one is business expediency. The Anglo-Saxon idea of ownership of land is that every land owner owns from the center of the earth to the sky all that is above and all that is below-consequently the oil and gas are owned by the person who owns the surface. That idea is not exactly true with reference to oil and gas, for many states have adopted the doctrine that oil and gas are like wild animals; they are fugacious and migratory and belong to the man that traps them. But, except for that doctrine, we believe that oil and gas are owned by the owner of the surface, wherein we differ from the Latin-American countries where the mineral rights are owned by the government. The United States was settled largely by homesteading. The owners of land were, in the main, farmers, who did not have the means or the faith to drill for oil or gas. The operators or speculators did not want to buy the land on the mere possibility of finding oil; hence a compromise resulted by which the land owner gave the speculator or the operator what he called an oil and gas lease, or a right to go upon his land and drill for oil and gas. What is supposed to be the first oil lease placed on record reads as follows: Agreed this 4th day of July, A.D. 1853, with J. D. Angier of Cherrytree township in the county of Venango Pennsylvania that he shall repair up and keep in order the old oil springs on land in said Cherrytree township, or dig and make new springs, and the expense to be deducted out of the proceeds of the oil, and the balance, if any, to be

The intermetallic compounds NpAl2, NpAl3, and NpAl have been prepared, and examined by X-ray diffraction methods. The compounds are isostructural with the corresponding U-Al compounds. NpAl3 is face-centered cubic with a = 7.785A and has the MgCu2 structure. NpAl is simple cubic with a = 4.2624 and has the AuCU3 structure. NpAl4 is body-centered orthorhombic with a = 4.428, b = 6.268, and c = 13.71A. The published description for the atomic positions in UAl, applies also to NpAl4 THE U-Al system has been examined by Gordon and Kaufmann.1 They identified the following intermetallic compounds: UAI2, UAl3, and a third, tentatively identified as UAl5. A structure analysis of the latter compound by Borie2 proved that the formula UAl4 was more consistent with the X-ray data. The crystal structures of UAl2 and UA have been reported by Rundle and Wilson.3 UAl2 was found to be isostructural with MgCu. The atomic positions in the simple cubic UA1, cell were found similar to those in the AuCu3 structure. Three analogous compounds exist in the binary system Np-Al. X-ray data for the compounds NpAl2, NpAl3, and NpAl4 are reported below. The neptunium used in the investigation was supplied through the courtesy of the Argonne National Laboratory as neptunium (V) nitrate. It was stated to have a radioactive content of 99.25 pct Np237. The impurity limits had been established by a spectrographic analysis given in Table I. Any titanium, boron, or bismuth impurity should be effectively removed during the fluorination of NpO2 to NpF4, and sodium, lithium, magnesium or strontium during the alloying procedure. The oxalate ignition technique, described by Westrum for the preparation of finely-divided reactive PuO2, was used.The neptunium (V) nitrate solution, containing 100 mg Np, was evaporated to dryness on oxalic acid crystals. The resulting oxalate was calcined to NpO, by heating in platinum at 650°C for 2 hr. An equimolar mixture of anhydrous hydrogen fluoride and purified hydrogen was passed over the NpO2 for 2 hr at 500°C. According to Fried and Davidson" the above fluorination conditions should produce the purple-black fluoride, NpF3 However, the light-green product showed only NpF4 lines on an X-ray diffraction pattern and contained only an estimated 5 pct of finely dispersed black NpF3 particles on microscopic examination. NpAl3: An intimate mixture of 50 mg of neptunium fluoride and aluminum powder (99.99 pct pure, —28 to $60 mesh) was heated to 900°C in a BeO crucible in vacuum by a tungsten coil for 2 hr, to allow the following reaction to proceed: NPF4 + 7Al + NpAl, + 4AlF. [1] The formation and sublimation of aluminum mono-fluoride in this system was verified from an X-ray diffraction analysis of the sublimate. The diffraction pattern was similar to one obtained in the aluminum reduction of UF4 to UF3,6 showing both Al and AlF3 lines. The resulting alloy was sintered at 1100°C for 1 hr. A powdered specimen of the crystalline product was sealed in a thin-walled quartz capillary for X-ray examination. The photograph was taken on a 14.32 cm General Electric powder diffraction camera, using filtered copper radiation. The films were calibrated in terms of a NaCl standard pattern. The wavelengths used in the calculations were 1.5418A for Cu K and 1.5405A for Cu K The powder diffraction pattern showed that NpAl is simple cubic with a = 4.262 % 0.005A, and is isostructural with UA13 where a = 4.27A1 or a =

The development in the perfection of mine-surveying instruments has been by no means rapid, as it has depended somewhat on the details of construction borrowed from astronomical and geodetic theodolites, largely on the restrictions laid down by mining companies and the prejudices of mine managers themselves, but more than all on the methods used in conducting surveys and the importance attached thereto. Mine-surveying, in some form or other, has been practiced from the very earliest times; but it has never kept pace with the other branches of surveying, or even with the art of mining itself, and cannot be recognized as an exact science until shortly before the beginning of this century. The works of Hero of Alexandria, who lived in the second century B.C., are still extant, and contain descriptions of a rectangular sighting-instrument, which he invented and called a diopter. His improvement upon this simple construction, which possibly he devised for use in the Greek mines for rough leveling-purposes and for laying out any angle, must be considered, says Hübner," as the origin of the highly perfected theodolite of to-day. Whether this instrument came into general use during the first centuries of the Christian era, is not recorded; in fact, no writer undertakes to tell how mine-surveying was conducted until 1556, in which year Agricola expounds the principles of mining and metallurgy in his De Re Metallica, devoting the entire fifth chapter to the practice of mine-surveying (see Fig. 1). In mediæval times those who possessed any knowledge of engineering skill made strenuous effort to keep their art a secret, partly on account of the miners' proverbial conservatism and partly for their own personal aggrandizement, and were, in

Large deposits of titaniferous magnetite occur associated with anorthosite and gabbro in the Lake Sanford area, Essex County, New York. The ore, gabbro, and anortbosite show consanguineous relations. Anorthosite grades through gabbroic anortbosite into gabbro but is locally intruded by gabbro. Structural and petrographic evidence suggests that gabbro was differentiated from anorthosite by filter pressing. Field and laboratory study of ore occurrences indicates that an ore residuum concentrated in the gabbro through magmatic segregation' by normal crystallization and flowage. Ore occurs as bands which grade into gabbro, and also as large masses which replace anorthosite. Ore in the gabbro is finer grained and richer in ilmenite than ore in anorthosite. Introduction The Lake Sanford area lies in the heart of the Adirondack Mountains, in the southeast portion of the Santanoni Quadrangle (Fig. I), and there are four ore bodies in the area immediately surrounding Lake Sanford. The area lies 30 miles by highway from the railroad at North Creek. The deposits were discovered in 1826, and from then until 1858 iron was produced in small quantities. They were idle from 1858 to 1906. Between 1906 and 1913, extensive development work was carried on. These early attempts to produce iron ore were thwarted by transportation difficulties and by the titanium content of the ore, which, ironically, has been the element responsible for the present development. In 1941 the National Lead Co., Titanium Division, developed the Sanford Hill ore body and is now producing ilmenite and magnetite concentrates.18 The Defense Plant Corporation is extending the railroad to the property from North Creek and is building a sintering plant to treat the magnetite concentrate. Investigations OF the Deposits* Early studies of the Lake Sanford titaniferous magnetite deposits were made by Emmons in 1842,l2 by Kemp, in 1897-98'0 and by Newland in 1908.22 Singewald26 and Osborne23 considered these deposits along with numerous other titaniferous magnetite deposits in 1913 and 1928, respectively. None of these reports entailed a detailed study of the ore occurrence in this area. The present study was begun in 1940. WITH the example of the steel open-hearth men and their round table conference before the copper men, the query naturally arose "Why cannot we do likewise?" The advantage of pooling and comparing knowledge on smelting in the copper reverberatory furnace seems particularly pertinent at this time when all metallurgical economies possible must be rigorously enforced. A great deal of data had also been obtained and filed during the period of litigation over the Carson patent, and it would naturally be available with the cessation of further suits. With these ideas in mind, H. Foster Bain took up the advisability of holding such a conference directly with the heads of all the companies in the United States operating copper reverberatories, and found a nearly unanimous response. The mining companies appointed representatives directly, or indicated to the heads of various metallurgical operations what members of their staffs should be sent to such a conference.

The experimenlal YeSnllS were compaved with the results of an elastic-plastic wodel that relates the size of the pluslic .zone to the cvack length, internal pressure, and yield stress. it was found that the clzunges in the dislocctlion cryrays with lemperature and combosition can be e-kplaincd by the lemperatrnre and composilion dependence of the yield stress. An wmtsual feature of this study was the observation of low -temperature noncrystrrllogruphic cracks. PLASTIC relaxation can occur at the edge of a moving crack by the operation of pre-existing dislocation sources or by the creation of new sources in a region of perfect 1attice.l'2 The amount of relaxation in a given crystal depends on the crack velocity and the temperature, and can determine whether a crack propagates in a brittle or a ductile manner.1-3 Tetelman and Robertson4 observed microcracks m Fe-3 pct Si single crystals that formed on (100) planes by the precipitation of hydrogen gas during electrolytic charging at 23°C. The plastic deformation accompanying crack propagation was observed in the form of dislocation etch pits and an extensive analysis has been made of the size, shape, and crystallography of the dislocation arrays5-7 This paper describes the effect of temperature on the plastic deformation generated around hydrogen-induced cracks in Fe-3.1 pct Si and Fe-4.2 pct Si single crystals. The observations are compared with the results of an elastic-plastic model for yielding around a crack containing an internal pressure. 1) EXPERIMENTAL PROCEDURES The composition of the materials used in this study are given in Table I. For the second consecutive year, the production of crude petroleum in New York has fallen below the 5,000,000-bbl. Mark that had prevailed previously since 1937. In 1945, the output totaled 4,658,000 bbl., a decrease of slightly more, than one per cent from the 1944 production. This total represents 2 per cent of the stripper-well production of the United States, which in turn is I 3 per cent of the total annual yield of the nation's petroleum.

ThE primary slip plane in hcp metal crystals can usually be inferred from the c/a ratio. Basal slip is the primary system at room temperature for zinc, cadmium, magnesium, cobalt, and rhenium, all of which have a c/a ratio greater than 1.60. Zirconium and titanium, on the other hand, each with a c/a ratio of 1.59, deform primarily by (1010) [ll20] prismatic slip. The increasing tendency toward prismatic slip in these materials is generally thought to be associated with the increase in atomic density on (10i0) as c/a is reduced. Beryllium, with a c/a ratio of 1.57, would, according to the above scheme, be expected to exhibit prismatic slip. However, in beryllium of commercial purity, the primary deformation mode at room temperature is basal slip.' The ratio of critical shear stress for prismatic to that for basal slip at room temperature is approximately 5:l. The critical shear stress for prismatic slip decreases quite rapidly with increasing temperature, however, and at 500°C the ratio is approximately unity. The apparently anomalous behavior of beryllium has led to speculation that prismatic slip in this material may be restricted by an anisotropic effect of impurities,' and that, if beryllium could be purified to a sufficient extent, prismatic slip might predominate at room temperature. In such a case, the conditions under which basal cleavage can occur would be suppressed, and enhanced low-temperature ductility might result. With the advent of the floating-zone method for purification of beryllium,3 it has become possible to determine experimentally the effects of purification on basal and prismatic slip. Tensile tests were performed at room temperature on single crystals oriented favorably either for basal or prismatic slip. The crystals had been purified to various extents by zone-refining, employing procedures that have been described elsewhere.4 Relative purities of the crystals were estimated by measuring the ratio of electrical resistance at 4.2"K to that at 298°K. Typical values ranged from 0.40 for commercial-purity material to 7.7 X 10"4 for crystals prepared from vacuum-distilled beryllium and subjected to six zone-refining passes. The purity dependence of the critical shear stresses for basal and prismatic slip is shown in Fig. 1. In the purity range studied, the critical shear stress for basal slip is decreased from 1.4 to 0.14 kg per sq mm. The critical shear stress for prismatic slip is decreased from 6.7 to 5.3 kg per sq mm. The decreases in critical shear stress for each deformation mode, therefore, are approximately equivalent. No purification anisotropy is observed. Because of the absolute magnitudes of the critical stresses, the ratio of the critical shear stress for prismatic slip to that for basal slip actually increases from 5:l to 38:l at the highest purity level studied. It is evident, therefore, that basal slip is the primary deformation mode in high-purity beryllium. This fact must be accounted for in any rationalization of the deformation behavior of hcp metals. LONG before the role of dislocations in the plastic deformation of crystals was recognized, the stress-strain field around dislocations received considerable attention in the theory of elasticity. It seems that Weingarten1 was the first to consider dislocations as simple and typical sources of internal stress in elastic solids, and Volterra2 and Timpe3 investigated their elastic field. Fig 3-1 shows the two basic types of dislocations considered by Volterra. The first arises by making a straight-edged .plane cut in a solid, displacing the two surfaces of the cut in their own plane relatively to one another by a constant amount in a direction perpendicular to the edge, and welding them together; this is shown in Fig 3-la, where the outer cylindrical surface represents the boundary of the solid, and the thin spiral cylinder around the edge of the cut has been removed in order to avoid infinities of stress and strain. The second type of dislocation is shown in Fig 3-lb; here the surfaces of the cut have been displaced relatively to one another by a constant amount parallel to the edge, and then welded together. After J. M. Burgers,4 these two types are called edge and screw dislocations, respectively. They represent simple limiting cases; in the general case, the surfaces of the cut are displaced by a constant vector that lies in the plane of the surface but has components both parallel and perpendicular to the edge of the cut. The oil man, like the miner, is an American business man in which this special characteristic is even more pronounced. It may be because he has been an explorer and is more nearly like those pioneering Americans who explored, developed, and built these United States.

PROGRESS in the petroleum industry in 1929 has been characterized by outstanding accomplishments in the fields of new discovery of supply, economic control of production, increased efficiency and reduced costs of recovery, and lowered costs and greater flexibility in manufacture. Resources have been developed in an outstanding degree in the Kettleman Hills. California, the Oklahoma City field (which adds a large potential area in central Oklahoma), the discovery of Woodbine sand production in East Texas, and the discovery of Wilcox sand production in west-central Kansas. Engineering technique has progressed both along the lines of development and production, with a net result that costs have been reduced and extraction increased in notable degree, although it is impossible to give a close measure of either. In the field of re- fining crude oils variations to the end of promoting reduced cost and greater flexibility has been more important than genera! acceptance of innovations in practice.

(San Francisco Meeting, October, 1911.) THE first successful bucket-elevator dredge to operate in California was put in commission at Oroville in March, 1898. There had been numerous previous attempts at dredging, but none of the earlier boats proved a success. The gold-miners in California early conceived the idea of a machine to dig gravel from the beds and bars of auriferous streams that were inaccessible by the methods then employed, and it was only a few months after the discovery of gold in California that such a machine was. shipped around Cape Horn from New York to San Francisco. This was, however, but the forerunner of many failures in gold-dredging, and was soon at the bottom of the Sacramento river. During succeeding years many other unsuccessful attempts were made, and it was not until 1897 that a dredge of the single-lift bucket-elevator type was floated on the Yuba river. This dredge was built by the Risdon Iron Works for R. H. Postlethwaite, and would probably have been a success if it had been operated on some of the rich Oroville ground instead of in a turbulent stream, where the dredge was wrecked during a flood, and was not repaired. Fig. 1 is a sketch-map of California, showing gold-dredging areas. It is not my intention to narrate in detail the history of the early failures in gold-dredging, and the various steps in the development of the modern boat, but merely to touch upon this in a general way, and to call attention to the wide difference in capacity and operating-cost between the first successful dredge, with an actual capacity of 600 cu. yd. per day-though its rated capacity was in excess of this-and the present modern dredge with 15-cu. ft. buckets, and an average capacity of 250,000 cu. .yd. per month. . F. W. SPERR, JR.,* Pittsburgh, Pa.--Mr. Malcolmson states that the Carbocoal process produces ammonium sulfate in excess of that normally recovered in the ordinary byproduct coke process. Table 3 indicates that 20,000 to 25,000 lb. of sulfate of ammonia are obtained in carbonizing 1000 tons of Clinchfield coal. This is a high-grade coal and yields from 26 to 28 lb. of ammonium sulfate per ton in a modern byproduct coke oven. On the next page, 21 lb. is stated as the yield of ammonium sulfate per short ton of raw coal; this is less than the average production from any well operated byproduct coke-oven plant treating coal of the character usually coked, in Pennsylvania and Ohio. The statement as to the comparative yields of light oil is somewhat misleading in view of the results obtained during the past year or two by the more modern byproduct coke plants. The plants put in operation by the H. Koppers Co., during the past two years, are producing about 3.5 gal. of light oil per short ton of coal, and several of these plants are producing more than 4 gal. per ton. The yield of pure toluene runs from 0.45 gal. to 0.55 gal. per ton. .The quality of the light oil .obtained from the Carbocoal process is of much greater importance than would be inferred by one not closely familiar with the subject. The presence of paraffins in the benzol and toluol fractions seriously detracts from their commercial value; the benzol and toluol fractions derived fro in the Carbocoal process contain about 50 per cent, of paraffins. It should be thoroughly understood what these paraffins are. They are simply hydrocarbons that go to make up ordinary petroleum, and if a successful method for the removal of paraffins from benzol and toluol has been developed, this can at once be applied to several well known processes by which benzol and toluol can be made directly from petroleum, which have as yet been total failures on account of the contamination of these products by paraffins.

Means and relative standard deviations were calculated for eU, eTh, K, and their ratios for aerial gamma-ray spectral data in 29 quadrangles at 1:250,000 scale. Known or suspected uraniferous provinces were characterized by: 1) Higher eU, eTh, and K means (due to generally higher radioelement concentrations); 2) Higher relative standard deviations for eU, eU/eTh, and eU/K (reflecting the presence of local uranium enrichments); and lower mean eU/eTh and eU/K values (showing uranium loss from "average" rocks to form local enrichments). "Uranium favorability indexes," i.e., combinations of the sensitive variables, show an excellent qualitative relationship to known occurences and geologic favorability. Results appear to confirm the existence of long-term crustal uranium provinces formed at the time of emplacement of the oldest known rocks.

THE particular field of application of machines utilizing air cur¬rents as the primary separating medium is in the cleaning of the fine sizes of bituminous coal. Approximately 12,000,000 tons of bituminous coal were cleaned by air machines during 1940. They have not found any application for cleaning anthracite. Since the development and introduction of the first successful com¬mercial pneumatic oscillating machine for cleaning bituminous coal in 1916, by the Sutton, Steele and Steele Co., Dallas, Texas, and the Ameri¬can Coal Cleaning Corporation, formerly of Welch, W. Va., four other successful pneumatic coal-cleaning machines have been developed and introduced to the American coal-mining industry: 1. Peale Davis: "Pneumo-Gravity" machine, 1924. 2. Arms "Concentrator," oscillating table, 1924. 3. Heyl and Patterson oscillating table, 199.7. 4. "Stump Air-Flow," pulsating air jig, 19391. Out of these five developments only the Sutton, Steele and Steele, or American Oscillating, and the Stump Air-Flow Jig remain on the market. They are the predominating pneumatic coal-cleaning machines in use in the United States. HISTORY OF AMERICAN TYPE SEPARATOR The first successful American machine, the CJ table (Fig. 1) was developed by the Sutton, Steele and Steele Co. The SJ table was the first standard model designed specifically for the cleaning of coal. It was installed in the original Crane Creek plant, owned and operated by the American Coal Co. at McComas, West Virginia. This plant was designed by The Roberts and Schaefer Co., Chicago, Ill., working in cooperation with the American Coal Cleaning Corpora¬tion, which had taken over the patent rights and sale of the pneumatic separators.
