Eminent domain overview Eminent domain is the power of the Government or a municipality to take property for public use without the consent or acceptance of the owner. Typically, the agency taking the prop¬erty will make an offer, hoping the owner will immediately accept and allow work to begin. If a mutual resolution regard¬ing its value cannot be reached, how¬ever, the municipality will institute a condemnation action in court seeking possion of the property. This is when the problems begin. The power of the Government to take the subject property is limited by Federal and state constitu¬tional requirements to pay "just com¬pensation" for the property. The exact nature of an owner's prop¬erty has been the subject of much debate and discussion. It is generally under¬stood, though, that property is consid¬ered to be "every kind of right or inter¬est, capable of being enjoyed and recog¬nized as such, upon which it is practi¬cable to place a money value" (US vs. 53 114 Acres of Land). A taking, for condemnation purposes, is considered to occur whenever there is a substantial interference with the free use and enjoyment of the property. Rarely is the necessity for the taking ever challenged and more rarely is the taking ever successfully challenged. When a taking occurs, it is not only the fee owner who is entitled to compen¬sation. Every person holding an interest in the subject property will be recog¬nized. Thus, all persons who at the time of taking have a compensable interest in the property will be made parties to the case (Swanson vs. US). Minerals, like all other interests in land, are recognized as property rights, giving the owner the power to dispose of them as he or she sees fit. Thus, the only remaining considera¬tion is only "just compensation." Ex¬actly what "just compensation" is has been difficult to define. Generally, it is that amount of money that will "put the person in as good a position as the per¬son would have been in had the taking not occurred." The owner must not be forced to sacrifice or suffer by receiving less than full and fair value for the prop¬erty. Every element that effects the value of the land and that would influence a purchaser must be evaluated. Courts have employed a variety of techniques to determine just compensa¬tion but have generally relied on market value as the standard for measuring compensation to the owner. The deter¬mination of market value is based on sales, income, costs, and use. These factors have been employed in various ways but can be summed up as: -The highest estimated monetary price the property will bring if exposed for sale in the open market with a reason¬able amount of time allowed to find a purchaser who is buying with knowl¬edge of all the uses and purposes to which it is adapted and for which it is capable of being used. • The amount the property would bring if it were offered for sale by one who desired, but was not obliged, to sell, and was bought by one who was willing, but not obliged to buy. • What the property would bring in the hands of a prudent seller, at liberty to fix the time and conditions of sale. • What the property would sell for in negotiations resulting in sale between an owner willing, but not obliged to sell, and a buyer willing, but not obliged to buy. • What the property would be rea¬sonably worth on the market for a cash price, allowing a reasonable time to affect a sale. (Michigan Standard Jury Instructions). Special consideration regarding mar¬ket value is given when the taking is only partial, rather than complete. An example of this partial taking is when a state highway cuts across the northern half of a parcel of property, leaving the rest behind for the owner. A variety of problems can be immediately seen. In a partial taking, the owner is permitted to recover not only for the property taken, but also for any loss in the value of the remaining property. The measure of compensation for partial taking purposes is generally the difference between the market value of the entire parcel before the taking, and the market value of what is left of the parcel after the taking (Michigan Stan¬dard Jury Instructions). Determining the partial taking value for mineral bear¬ing lands is the difficult issue.

The subject of rapid excavation tunneling is one that is extremely important to the people in the Metropolitan area of Chicago. My personal observation is that it is also extremely important to the urban communities around the U.S., to many local and state governments, and to the public officials who are deeply concerned about state affairs and taxes. The Metropolitan Chicago area is in fact, (as are 40 other major urban areas in the U.S.) confronted at the present time with a very serious combined sewer overflow, drainage and pollution problem which accounts for an estimated 40% of the pollutional load on its waterway system. In response to this the District has to date spent some seven millions of dollars in an attempt to find the most economical solution available for the elimination of this problem. This study included extensive investigations of the geological strata, the quantity and quality of storm runoff to be dealt with, and the various methods of storage and treatment available. It has considered solving the overflow problem by a concept involving a series of tunnels, rock tunnels, shafts and storage areas which will collect, retain and subsequently treat that portion of the combined sewer overflow which can be handled in the most cost-effective and economical way, consistent with following the federal and state standards - with which we at the present time agree in principle.

With both unit costs per meter and average depth of drilling constantly increasing, there is a strong incentive to maximize the information acquired from drill holes, and then to make this information accessible to the geological staff. The larger the drilling project, the more advantageous computerization of data is over manual methods. The conversion to computer-readable form and the verification of large amounts of drill-hole data can be a substantial data processing task, but once accomplished, the benefits in increased accuracy and speed of interpretation will compensate for the time and effort spent in the work. For an exploration project progressing towards a preliminary feasibility study, about half of both the time and costs for all computer work of the entire feasibility study are devoted to drill-hole data base organization, and maintenance. Once drill-hole results are quantified and verified to be correct, they are immediately accessible and are not subject to further transcription or reinterpretation of errors. To obtain maximum benefits from computer utilization in this area, the drill-hole data base should be set up along with availability of the first data. For some companies, this may initially comprise a large number of purely speculative drill holes on a spacing of perhaps 1 or 2 km. Although few of these drill holes may encounter economic material, thought should be given, at this time, to the variables which will be logged when such material is found. In this way, it should be possible to set up a consistent format into which all future drill-hole information will readily be accommodated. This format may even be carried over into the data base requirements for an operating property.

Concrete is one of the decisive construction materials, also for the AlpTransit Gotthard Tunnel. The client has many requirements, and many are the solution possibilities that concrete systems can offer. Cement producers and concrete admixture manufacturers have been challenged to design and test jointly concrete systems for cast and sprayed concrete. The testing operation followed the scenario laid out by the Gotthard AlpTransit Project management?s instructions ?Testing system for concrete mixes.? Various supplier teams have applied for the concrete systems for sections Amsteg/Erstfeld, section Sedrun and/or sections Bodio/Faido and have also followed through with the tests. As was to be expected, the rate of failed mixes matched the level of the requirements. Thanks to this system, it was nevertheless possible to test complete concrete systems for all sections and to get them approved. The joint ventures tendering for the contracts were allowed to include only approved mix designs in their bids. Workability and durability are of paramount importance for cast and sprayed concrete mixes. Durability is influenced by the chosen mix design where binder concept and well-defined water content, i.e., impermeability, are determinant. Aggregates for AlpTransit are to be considered as given. The concrete mix design also determines workability. Because ambient conditions and also requirements with respect to workability are subjected to change, it is necessary that the mix designs include control measures. The choice and number of components for the concrete systems (cement, additives and admixtures) allow adaptation to changing conditions. For AlpTransit such adaptive measures must meet very strict requirements.

Defining the Risks The bad news is peak commodities, energy and economic crisis and stock markets collapsing are the issues that are already hitting everyone?s bottom line and draining the treasuries of every mining company around the world. Higher energy costs are affecting the bottom line more than ever before, which is creating more risk for companies. Mining companies have major land positions around the world and they have major energy needs. Uncontrollable increases in energy costs, increased regulations for diesel fuel emissions and energy intermittencies are costing mining companies more time, money, and man-power, which are cutting into profits and hitting the balance sheet. The good news is, there are practical energy solutions which are off the grid, tried and true methods which can be implemented in a cost-effective manner and will increase profitability and save shareholder values as well as energy security for these companies and their projects. To date, most of the mining resource industry has not yet considered or used other forms of power like clean, sustainable, or alternative energy for their own energy needs. The reasons have primarily been pushback from the mining industry due to beliefs of older technologies in alternative energy, a lack of understanding of the cost advantages long term, and perceptions of environmental relativity.

The theme of the 2012 North American Tunneling conference (NAT) was ?Tunneling: Driving Value.? This theme best reflects where the tunneling and underground construction industry is to-day. Major advances that have been made in technologies have provided tremendous improvements in productivity, which, in turn, have allowed the industry to deliver more cost-effective and less disruptive solutions to the nation?s infrastructure needs. Despite a weak economy, domestically and globally, cities and states continue to spend billions on infrastructure improvements. For the underground construction industry, that means more transportation and water, wastewater, storm water projects and other underground structures. And, for each project completed, underground construction and tunneling technology grows. The NAT conference, put on by the Underground Construction Association (UCA) of SME, provides an outlet for technology transfers among professionals. This year?s conference, held in Indianapolis, IN June 24-27, attracted 918 attendees, up from 803 at the last NAT in 2010. The accompanying exhibit also featured 116 exhibitors occupying 140 booths. That was up from 108 booths in 2010. So, the meeting continues to grow as underground construction professionals throughout the world seek to learn from their peers.

Historically, mica usage has been low because of limited availability; as a by-product of many small processors, who have lacked motivation for extensive R & D. The discovery of a 30 million ton deposit of 85-90% pure phlogopite, when existing markets are only 300,000 tonnes annually, forced the search for large volume new markets. Increasing costs of energy, petrochemicals, plastics and glass fibers, and environmental constraints on asbestos usage, have led to new opportunities for mica as a reinforcing filler. Extensive research and developments; in beneficiating, processing and treating mica, has been necessary to satisfy these new markets.

Since the mid-1970s, samples of airborne and waterborne fibrous particulates have been collected in the area of the Northshore Taconite Ore Processing Facility by the Minnesota Department of Health (MDH), the Minnesota Pollution Control Agency (PCA), and the University of Minnesota. Indirect sample preparation has consistently been used although other aspects of the sampling methods and sites have varied and analytical procedures were altered over time as more accurate and precise microscopy methods were developed (i.e., phase contrast optical microscopy, transmission electron microscopy, transmission electron microscopy with energy dispersive spectroscopy). In the mid-1970s, levels of airborne fibrous particulate in the Silver Bay area averaged from 0.00030 to 0.03 f/ml. This level was significantly greater than levels of similar particulates in the St. Paul, MN area, although two of the Silver Bay sampling sites, considered individually, did not indicate levels of fibrous particulate markedly different than that seen in St. Paul. More recent sampling data (i.e., 1990?2001) indicate mean concentration of airborne fibrous particulates (amphibole-like fibrous particulates) of 0.0020 f/ml with a range of values from 0.0001 to 0.0140 f/ml. Such levels are not significantly different from those seen in other non-urban environments in the US and Europe. Concentrations of fibrous particulates in water samples were higher in the mid-1970 when iron ore tailings were being deposited in Lake Superior, but since the tailings have been deposited on land waterborne levels of fibrous particulate in the Beaver River have remained relatively constant averaging in the range of 7.5 MFL. This level is only slightly in excess of the current EPA drinking water standard for fibrous particulates. Review and consideration of this data is important in determining the potential health risks associated with airborne and waterborne fibrous particulates in the areas of the Northshore Taconite Ore Processing Facility. © 2007 Elsevier Inc. A comprehensive, harmonic and sustainable development has always been a real concern of state policy makers. To reach such development, regional planning is an approach which is widely applied. This paper deals with policies adopted by a given country with rich mineral deposits, in order to accomplish a mining growth as well as economic development in relatively poor regions. In this regards, first, some worldwide experiences belonging to China, with large scale mining operations and Nigeria with a small scale mining industry, are studied. The mining industry in Iran is then considered as a case study. The study continues by categorizing and prioritizing Iranian regions based on their mining potential and the degree of development, using statistical analysis and Taxonomy and AHP techniques. Results obtained serve to provide recommendations as to where capital investments in the mining industry would produce highest returns. The approach used, together with the practical policies suggested in this paper, can be used to adapt appropriate strategies for mining development in a way that contributes to regional development and a more effective income distribution.

Equipment-washing facilities at Freeport-McMo-Ran?s Sierrita Mine in Arizona produce a mixture of oil and water that was difficult to dispose of easily or cheaply. However, after some changes in the facility, waste oil is now used as part of the mining process. Freeport-McMoRan Copper & Gold Inc., head-quartered in Phoenix, AZ, operates copper, gold and molybdenum mines. It is the world?s largest producer of molybdenum. Heavy equipment used at the mine is hosed off periodically in the wash bay. The dirty water and oil mixture drains into the sump next to the bay. Oil was manually collected for disposal. This was a tedious and dirty process Mine managers sought a more efficient method of removing the oil. Instead of spending the time and effort skimming the tank with vacuums or sorbents, they enlisted the help of Abanaki Corp., manufacturer of the Model 4 Oil Grabber. Engineers designed the sump to utilize prevailing winds to blow the oil to one corner. This was the ideal place for the Abanaki skimmer. The skimmer removes the oil and discharges it into a plastic storage container. ?This reduces the time needed to keep the area clean, and the staff can focus on cleaning the equipment rather than worrying about the oil,? according to Jay Salerno, construction manager at the Sierrita Mine. Salerno is considering adding an optional oil concentrator to the skimmer to make the process even more efficient. The concentrator would remove any water picked up by the belt and return it to the sump, leaving nearly pure oil for disposal. Because the mine is located in the Sonoran desert, most of the water evaporates in the hot, dry air and is not reused.

It is no need to say that exploitation of industrial minerals has a close relation to development of the industries related. In the first stage, a small scale manufactures were initiated in areas producing some main raw material minerals. China and cement manufactures, for example, were established depending on the local occurrence of raw materials such as kaolin and limestone without exception. That is, the industrial development is greatly influenced by the local production of the raw materials in the stage. With the development of industrial technology, various kinds of raw material minerals are explored to meet the demands of industries in the second stage. New materials become indispensable, and low-grade raw material minerals, which were left as useless, are developed as useful materials. In the stage, the development of raw material minerals is accelerated by that of industrial technology related. However, industries mainly rely on domestic production of the min raw material minerals.

The Peñasquito deposit in Mexico is one of the largest grassroots precious metal discoveries to be developed in recent years. Goldcorp Inc. acquired the gold-silver-lead-zinc property with the acquisition of Glamis in 2006. The company has since committed US$1.5 billion to construct the mine, mill and associated facilities. The first of two 50-kt/d (55,000-stpd) mill and flotation lines is currently being commissioned while engineering and construction continues on the second line. A high-pressure grinding roll (HPGR) will ultimately take total throughput to 130 kt/d (142,000 stpd). The Peñasquito property is located in the northeast corner of Zacatecas state, Mexico. The elevation of the property averages 1,900 m (6,200 ft) above sea level and it is situated in a wide east-west valley. Except for one small outcrop (Peñasquito), the area is covered by up to 30 m (98 ft) of alluvium.

The National Institute for Occupational Safety and Health (NIOSH) identified hearing loss as the most common job-related disease in the United States in its 1996 National Occupational Research Agenda. Previous studies by NIOSH have shown operators of surface drill rigs without cabs are commonly exposed to A-weighted sound levels exceeding 90 dB. During hammer-drilling, A-weighted sound levels exceeding 100 dB were recorded at the operator station. NIOSH collaborated with a local drilling company to design and install a partial cab between the operator and the drill steel in an effort to reduce the sound level at the operator station. Sound level measurements in the field show the partial cab reduces the A-weighted sound level by 5-9 dB at the operator’s left ear and 2-5 dB at the operator’s right ear while hammer-drilling. This paper will briefly discuss the preliminary design of a cab and the testing of materials for construction of the prototype. Explanation of the ideas behind the prototype design and fabrication will be covered. Finally, the field test method and results will be discussed in detail.

Ask someone what they can tell you about the Royal Canadian Mint and most likely the first thing that they will mention, is coinage. The Royal Canadian Mint manufactures Canada's one-cent coins, nickels, dimes and quarters - over 1 billion per year. Most of these coins use copper and nickel as base material, and all of this metal is mined, refined and processed in Canada prior to being shipped to the mint for coin production. In 1985 alone, 1270 metric tons of Canadian nickel and 2160 metric tons of Canadian copper were absorbed in circulating coinage. July 1987 will have marked the introduction of Canada's new one dollar coin, an important new addition to Canada's monetary system. The first phase of this program will consume about 2,235 metric tons of Canadian nickel in the initial production run. Annual requirements in subsequent years are estimated at 225 metric tons. The Royal Canadian Mint is also a major producer of circulating coinage for foreign countries. Since the state-of-the-art Winnipeg plant swung into full production in 1976 the Mint has struck more than 5.2 billion coins for some 35 nations around the world. 1985 sales have increased almost 6 fold over 1984. 1987 already shows commitments for a further significant increase in volume in this business. The use of Canadian metals in export to foreign nations as coinage adds still more to the Royal Canadian Mint's key role as a major market maker for Canada's mining industry. The success of the Mint in this realm can be directly traced to it's 75 years as one of the world's most important refiners of gold. Libby, Montana is the site of a large vermiculite deposit that was mined between 1920 and 1990 to extract vermiculite for commercial applications such as insulation, gardening products, and construction materials. The Libby vermiculite deposit also contains amphibole minerals including tremolite, actinolite, richterite, and winchite. Historically, Libby mine workers experienced high exposures to amphibole structures, and, as a group, have experienced the health consequences of those occupational exposures. It has been suggested that Libby residents also have been and continue to be exposed to amphibole structures released during the vermiculite mining operations and therefore are at increased risk for disease. The Agency for Toxic Substance and Disease Registry (ATSDR) conducted two epidemiological-type studies of residents living in Libby and the surrounding areas to assess these risks. The Environmental Protection Agency (EPA) collected and analyzed exposure data in Libby and used those data to project risks of asbestos-associated disease for Libby residents. The EPA has placed the Libby Asbestos Site, which includes the mine and the town of Libby, on its National Priority List of hazardous waste sites in need of clean up. This article presents a review of the exposure studies conducted in Libby and an analysis of health risks based on the data collected in those studies. Libby mine workers have experienced elevated levels of asbestos-associated disease as a consequence of their occupational exposures to amphibole structures. Libby residents? exposures typically are substantially lower than mine workers? historical exposures, and the health risk projections for residents are, accordingly, substantially lower. © 2007 Published by Elsevier Inc. This paper describes the preliminary design of the fourth bore of the Caldecott Tunnels along State Route 24 in Oakland, California. The paper focus is on two major aspects of the project: initial support system design and seismic design. The initial support system was designed based on the New Austrian Tunneling Method (NATM).NATM provides the required flexibility to accommodate the variable ground conditions in the weak, folded, and faulted rock along the alignment. The seismic design provides a final lining system that meets serviceability requirements for a 1,500 year seismic event with an estimated peak ground acceleration of 1.2g.

The upgrading project for two hydropower plants in Slovenia, Europe, requires two new pressure tunnels: Plave II (5.9 km Flysch) and Doblar II (3.6 km Limestone). It is the worldwide largest application of the Double-Shield TBM technology combined with an extremely thin-walled monoshell honeycomb lining system. The first drive has been completed by end of June 2000 achieving best performances of 50m/d and almost 1,100m/mth. In September 2000 the TBM started the second tunnel without any required adjustments due to geological or other reasons. Another 52m/d have been bored already within one production day of two 8 h shifts achieving a maximum penetration rate of more than 6m/h. The completion of the Doblar drive can be expected by February 2001.

In order to address the difficulty of accurate segmentation of froth images of different sizes, a method of froth image segmentation based on highlight correction and parameter adaptation is proposed. First, a machine vision system on a single-cell flotation machine is built to collect froth images. Homomorphic filtering is used to improve the uneven brightness and shadow of the images. Fuzzy c-means (FCM) clustering is then utilized to classify similar highlights that belong to the same froth. After Otsu threshold segmentation, a parameter-adaptive morphological operation is used to extract the marker points and edge bands and correct the froth edges in the original image. Finally, the modified image is filtered by morphological reconstruction, and the highlight mark is used as the local minimum point for watershed segmentation. Three sizes of froth images are segmented in comparative experiments. The results show that the proposed method is suitable for the segmentation of froth images of different sizes. The position of the extracted segmentation line is close to reality, with average over-segmentation and under-segmentation rates for froth images of 2.6% and 6.8%, respectively. The froth image segmentation performance is stronger than that of the other methods examined.

Asbestos crystallizes within rock formations undergoing intense deformation characterized by folding, faulting, shearing, and dilation. Some of these conditions have prevailed during formation of the taconite iron ore deposits in the eastern Mesabi Iron Range of Minnesota. This range includes the Peter Mitchell Taconite Mine at Babbitt, Minnesota. The mine pit is over 8 miles long, up to 1 mile wide. Fifty three samples were collected from 30 sites within areas of the pit where faulting, shearing and folding occur and where fibrous minerals might occur. Eight samples from seven collecting sites contain significant amounts of ferroactinolite amphibole that is partially to completely altered to fibrous ferroactinolite. Two samples from two other sites contain ferroactinolite degraded to ropy masses of fibers consisting mostly of ferrian sepiolite as defined by X-ray diffraction and TEM and SEM X-ray spectral analysis. Samples from five other sites contain unaltered amphiboles, however some of these samples also contain a very small number of fiber bundles composed of mixtures of grunerite, ferroactinolite, and ferrian sepiolite. It is proposed that the alteration of the amphiboles was caused by reaction with water-rich acidic fluids that moved through the mine faults and shear zones. The fibrous amphiboles and ferrian sepiolite collected at the Peter Mitchell Mine composes a tiny fraction of one percent of the total rock mass of this taconite deposit; an even a smaller amount of these mineral fragments enter the ambient air during mining and milling. These fibrous minerals thus do not present a significant health hazard to the miners nor to those non-occupationally exposed. No asbestos of any type was found in the mine pit. © 2007 Elsevier Inc. The Liaoning Dahuofang Reservoir Water Transfer Project is an important development for the Department of Water Resources of Liaoning Province in northeastern China. The 85.3 km water conduit will transport water from the Hun River downstream of the Huanren Reservoir to the outlet on the Suzi River leading to the Dahuofang Reservoir. The additional water is required to sustain the growing cities of Fushun, Shen-yang, Liaoyang, Anshan, Panjin and Yingkou. The project is divided into seven contracts. Three TBM contracts comprise almost 75% of the work and the others are drill and shoot. The focus of this paper is about the creditable TBM performances achieved and some of the problems encountered by Chinese contractors; notably two having had no previous TBM experience.
