At the East Sullivan site, wood wastes covering the abandoned mine tailings impoundment prevent sulfide oxidation by creating an anoxic environment. The addition of coarse ligneous wastes and their high permeability favour infiltration, resulting in a water table rise that maintains most tailings under water saturation and thus provides an additional protection against sulfide oxidation. Moreover, high infiltration allows a more rapid flushing of acid prone groundwater generated prior to the cover placement, which could cause acid mine drainage over a long period of time. Finally, the pore-waters under the cover are characterised by a strong reducing potential, high alkalinity, and near neutral pHs. These conditions favour sulfate reduction and base metal precipitation as sulfides and as carbonates. Pore-water composition monitored from 1992 to 1998 showed a significant Fe2+ decrease, following cover placement. Thereafter, the restoration strategy capitalised on the alkaline and reductive properties of the waters underlying the wood-waste cover. An original treatment of acid effluents, based on the recirculation of water discharging around the impoundment through the organic cover, was implemented. In 2002, the recirculated water from May to October had a mean pumping rate of 240 m3/h, for a total volume of 800 000 m3. Data gathered near the dispersal zone from 2000 to 2002 show that despite the recirculation of acid water (pH ÿ3), the pH decreases by only one unit from 7 to 6, during the recirculation period, ie from May to November. However, alkalinity decreases from 800 to 100 mg/L-CaCO3. Despite this decrease, the alkalinity is back up to 800 mg/L-CaCO3 the following May, thanks to sulfate reduction. From 2000 to 2002, Fe2+ concentration in the pore waters near the dispersal zone is maintained below 2 mg/L. Evolution of surface water quality suggests that the contaminated groundwater flush is completed in the north and north-west area of the impoundment; the east sector is under recovery, while the south sector remains the most problematic. A wood-waste cover, besides limiting sulfide oxidation, can fill the role of alkaline reducing barrier for the treatment of these acidogenic waters, until a balance between acidity and alkalinity in the effluent is reached.

The production of crushed stone in the United States has exceeded 1.0 Gtpy since 1987. Eighty percent of the crushed stone produced is used in the aggregate industry, accounting for over half of the quantity of natural aggregate consumed in the United States. Approximately 718 of the crushed stone produced in 1989 was limestone and dolomite followed by granite, traprock, sandstone and quartzite, miscellaneous stone, marble, shell, calcareous marl, volcanic cinder and scoria, and slate in order of descending volume (Table 1). Of the remaining 20% crushed stone produced in the United States and not used as aggregate, 12% is used in the manufacture of cement which is an important construction material. Only 8% of crushed stone is used in specialty products not associated with the construction industry. Therefore, this chapter will concentrate on crushed stone as used in aggregates, with occasional reference to other uses or to chapters which discuss specific nonconstruction uses of crushed stone. Construction aggregates are hard, essentially inert materials suitable for being formed into a stable mass by the addition of cementing or binding materials that produce a concrete by compaction, or by natural weight to produce a road or foundation fill. Aggregates are usually from 80 to 100% of the material volume of the construction masses in which they are used. Conditions necessary for a rock deposit to be developed for construction crushed stone include: Quality-should pass rigid specifications for strength and durability; Quantity-adequate volume of rock is needed to have a production life of at least 10 years, preferably 20 or more years; Market-must have adequate market to support a new crushed stone operation; Transportation-transportation cost must be competitive for the intended market; Environmental-the impacts of mining, processing and transportation of crushed stone on the environment at or surrounding the mine site must be within acceptable limits; Permitability-mining, processing and transportation of crushed stone must usually be permitted by governing agency. The following discussion will touch upon all facets of crushed stone operations from the mineral deposit and its geology to technology, uses, economic factors and end with governmental regulations of mining crushed stone. The sections are not designed to answer all questions, but rather to be an introduction to the crushed stone industry. Where more information is required, The Aggregate Handbook by Barksdale (1991) is recommended as the best general source.

INTRODUCTION The Scope of the Chapter This chapter discusses environmental regulation and closely-related public policies associated with mineral development in the United States. This chapter outlines the nature, extent, and amelioration of secondary effects of mineral development. It sketches the policy foundations of regulation; discusses the implementation of environmental law; describes land use conflicts and land management regimes; and surveys the costs and benefits of environmental regulation. Since regulations are subject to frequent change, the chapter emphasizes basic factual and conceptual material, rather than specific regulations. The goal is to familiarize the reader with the general nature of environmental impacts and mitigation which arise in the minerals industry, and with the issues surrounding the regulation debate. The chapter is organized as a series of sub- chapters. The first of these is a discussion of the conceptual foundations of regulatory policy. The second section summarizes the principal federal environmental statutes, and the implementation of such regulation. Following that, the third section summarizes the current state of knowledge regarding the types of environmental impacts associated with mineral development. This discussion, organized in a format similar to that used in environmental impact statements, can be thought of as a guide to reading and understanding such statements. Next, the fourth section surveys studies of the costs and benefits of environmental regulation. 'These empirical studies are evaluated in terms of the framework developed in the first section of the chapter. In the fifth section, the discussion turns to federal, state, and local approaches to land use control and siting, and the economic analysis of such conflicts. Included are discussions of the two principal forms of public lands mineral entry, the 1872 location patent system and the 1920 leasing approach. CONCEPTUAL FOUNDATIONS OF REGULATORY POLICY David A. Environmental and related regulation occurs because the public believes the free market does not properly value environ- mental quality. In this section, concepts are advanced to aid the reader in understanding the government's role in this respect.

The results described in this article are based On field work conducted during the periods April-May, I939, and May-July, 1940. The United States Potash Co. is mining potash on Government land under a permit from the Department Of the Interior and the geophysical investigation was completed under a cooperative arrangemerit made between that company and the Conservation Branch Of the Geological Survey. The writer, a member Of the SeCtion of Chemistry and Physics of the Geologic Branch, was assigned to this investigation. Four definite objectives were in mind for the geophysical work in the studies over the salt deposits. The first was to determine the measure Of success that could be attained in this type of work with the resistivity methods that were to be employed. These methods had been introduced into the work of the Conservation Branch by Benjamin E. Jones for the investigation of dam sites, and have been used under his direction by the author for such work. If the method proved to be be an effort was to be made to contour the top of the salt beds and also the other formation boundaries known to be present in this area. Salt-water aquifers were to be studied in an effort to determine their boundaries, and an attempt was to be made to delineate the potash-bearing beds. Earlier Studies Others have made, and reported, restivity studies over saliferous deposits in different areas. Friedell and Messrs. Schlumberger2 reported geophysical work performed in the discovery of the salt domes of Alsace; Carrette and Kelly? described the geology of the same area. Leonardon and Kelly' published a resistivity curve obtained over the Hettenschlag dome, and a further discussion of this same area was given by the Messrs. Schlumberger6 in a communication. Messrs. Alty6 described studies on salt deposits in which the single-probe method was used. sinerez7 mentions that electrical methods were tried over salt deposits in Spain. Geoffrey and Charrin8 show a resistivity curve obtained over marl, gypsiferous marl and salt which is similar to that obtained over the New Mexico salt deposits. Kelly9 reported resistivity work performed with the ground Comparaor of Zuschlag over the salt deposits near Syracuse, N. Y., where the Salina formation is at a depth of 700 to 800 ft. It must be stressed that the following comments are offered only to assist mineral industry professionals in understanding the issues involved in personal liability. The information and views expressed herein are not intended to be a comprehensive guide or definitive statement of the law and they should not be regarded as a substitute for specific advice for individual situations. Readers should consult their own legal and other professional advisers before applying the content of this paper to their own particular circumstances. It is hardly news that work in the mining industry is governed by a complex regulatory and legal system which is constantly changing, but few realise just how directly they can be affected and become personally liable for any breaches. These may result in civil or criminal proceedings and personal assets are at risk. Owners, company directors, managers and now employees are at risk, together with consultants, contractors and suppliers of equipment or consumables, as well as government inspectors. They are liable for their personal decisions to act (or failure to act) in managing operations or carrying out directions, as well as for the actions of others under their control. This paper identifies the areas where such individuals in the open pit mining industry in Australia face the risk of personal liability and measures which can be used to minimise the risk or which can be used to make out a defence to legal action which could arise. There have always been a myriad of Commonwealth, State and Local Government laws and regulations with which to comply, and now international protocols are being used as a basis to impose greater obligations on all people. Once, the `corporate veil' gave some protection to the individual, but today there is negligible protection from the full force of the law. Not only are there various types of law enforcement officers, but public interest groups, shareholders, customers, suppliers, creditors etc may litigate. This paper is not intended to be an exhaustive discussion of the provisions of all the legislation or case law where individuals can be held) personally liable. These areas would include environmental, pollution and heritage law (including Aboriginal sacred sites); occupational health and safety (including workers' compensation) law; trade practices and fair trading law; contract law; corporations law (including the requirements of the Australian Stock Exchange [ASX] and Australian Securities Commission [ASC]); industrial relations law; anti-discrimination and sexual harassment law; taxation (including superannuation trustee) law; and the Common Law. The focus is on the following areas of regulation, which are outside the usual experience of those in the open pit mining industry (the Mining Acts and Regulations are specifically not dealt with here): ò Environment Law; ò Trade Practices Law; ò Occupational Health and Safety Law; and ò Corporations Law.

"A novel selenium removal process called Recycled Green rust/Ferrite Process is developed by MMC. In this process, a mixed Fe2+-Fe3+ hydroxide compound, green rust (GR), reduces selenate to elemental selenium, while GR is consequently oxidized to magnetite Fe3O4. Sequencing batch-mode experiment showed that the residual selenium concentration gradually decreased with the number of batch test increased. Stable selenium removal was achieved when the number of batch test exceed 15 times. Optimum selenium removal ratio reached 99.95% where initial Se concentration 2.1mg/L decreased to 0.001mg/L. Furthermore, the continuous feeding test carried out through a pilot-scale plant with a feeding capacity 600 L/hr. Approximately 860-hour-feeding test was carried out for the selenium-contaminated groundwater which had an averaged selenium concentration of 0.88 mg/L. Selenium concentration in the effluent from thickener maintained less than 0.01 mg/L (selenium removal rate of 99%) until a net operating time reached 800 hours.IntroductionJapan is one of the largest producers of selenium, and thus there are potential environmental impacts of selenium on soil and aquatic environments. The Mitsubishi Material Corporation (MMC) owns some real estate properties whose soil and groundwater was polluted by selenium and other heavy metals. These sites include former industrial plants: a smelter for nonferrous metal and a fabricating semiconductors and pigments. Selenium in aquatic environment commonly exists in four oxidation states, namely, VI, IV, 0 and -II. Selenate ion (SeO4 2-), the most oxidized form of selenium, and selenite ion (SeO3 2-) are highly soluble and mobile. Elemental selenium (Se0) is insoluble in water and therefore has much lower toxicity. Because selenium is carcinogenic and teratogenic at high concentration, the national effluent standard in Japan is fixed at 0.1 mg/L and the environmental standard at 0.01 mg/L. Although there are several selenium removal techniques, the most conventional process is coprecipitation with a ferric hydroxide because of its simplicity and low cost. It is known that selenite is adsorbed strongly on the surface of ferric hydroxide, but selenate is not. The low affinity of selenate on oxide mineral surfaces was demonstrated by the fact that selenate could be easily displaced by adding competing anions, particularly sulfate ion. Selenate removal from polluted water is one of the most difficult techniques, and more effective methods are desired. MMC developed a novel selenium removal process [1]. In this process, the concentrated slurry that contains Fe(II)-Fe(III) hydroxyl-salts known as Green Rusts (GRs) contributes to selenate removal. The main components of the iron precipitate in the reactor are GRs and their oxidation product, magnetite (Fe3O4)."

Brand se Baai, on the North-Western Cape Coastline of Southern Africa, is the site of the Namakwa Sands Limited Heavy Mineral Sands Mining Operation. The mine is a 14 000 000 tonnes per annum open-cast strip-style mining operation using truck and excavators to mine the sand. The orebody consists of relatively unconsolidated sands reworked by fluvial, marine and aeolian mechanisms. The total orebody includes three primary ore types, namely the Red Aeolian Sands, the Dorbank (a hardcap layer) and the Orange Feldspathic Sands, which forms the bulk of the resource. Mine planning and scheduling is done using a 50 m + 50 m variable bench height system with three primary bench heights. The Aeolian and Dorbank each have a bench that varies with their thickness of up to a maximum eight metres and the Orange feldspathic sand, a standard bench height of eight metres. For a number of years Namakwa Sands used a complex 2D, Datamine Based, macro system to perform the resource evaluation and mine design. As the mining operations expanded it became clear that a complete system redesign was required to cope with the increasing operational pressures coming to bear on the old system. The biggest challenges facing any replacement system are the sheer scale of the mining operation (16 km long and 7 km wide resulting in a minimum of 30 000 individual 50 m + 50 m mining blocks), the size of the geological data files (up to one gigabyte) and representing the benching system accurately (as the benches follow the topography and are not horizontal). In addition to these large-scale issues, the ability to run multiple mine design scenarios was required, an aspect which the old system was unable to perform adequately. Based upon these primary difficulties, a new business process was developed which required a complete rethink of the mine design methodology as well as the creation of a new system to deplete the resource model, produce monthly reconciliation evaluations and create a ultimate pit limit based on the operations mining cost model. Using a system based on the Earthworks Mine2-4D Mine Design and Scheduling System (with its mine design and scheduling specific tools), as well as a small, customised program, massive time-savings have been made. It is now possible to run several life of mine scenarios in the same timeframe that a single life of mine run took under the old system. This paper will present the methodology and business decisions behind the new Namakwa Sands system, and detail the restructuring and development used to deal with the large data set sizes and long processing times inherent in the old system. Future enhancements to the system that will make it more generically applicable to open-cast mining scenarios will also be dealt with.

The lead-zinc mill of Phelps Dodge Corporation, Copper Queen Branch, Mines Division, Bisbee, Arizona, is about 3 miles from the main hoisting shafts of the Junction and Campbell mines at Lowell. All the ore treated in the mill is obtained from these two mines. The mill was designed for an all-flotation treatment of 450 tons of lead-zinc ore per day, and has been operated at that capacity since the start of milling operations on Nov. 17, 1945. An expansion program is underway whereby the mill capacity will be doubled, but this article describes only the original program and presents results of the 450-ton operation. General Description The milling plant consists of an ore-receiving bin and three steel-constructed buildings housing, respectively, the primary crushing equipment, the secondary crushing equipment, and the ore-storage bins, grinding, flotation, and filtering equipment. The mill site is the one that was used for a previous copper-concentrating plant, which was operated over a period of years and then dismantled. There remained from this operation some milling equipment, a reservoir for mill-water supply, railroad tracks, tailings-disposal ponds, and a steel-constructed building, all of which were incorporated in the design of the present lead-zinc mill. The location plan of the plant layout is shown in Fig I. The flowsheet of the mill is based on the conventional scheme for lead-zinc treatment, however, several innovations were made necessary in order to utilize the existing building. Placing of equipment also was governed by the design of the building; thus making the mill unique in many respects. The following brief description of the mill building as adapted to the flowsheet points out the compactness of the installation and some of its unusual features. The first floor (Fig 2) houses the grinding equipment, with connecting conveyors for ore feeding, also an air compressor, two vacuum pumps, bins for lead and zinc concentrate storage with individual conveying systems for loading the two kinds of concentrates. Filtering of concentrates is done on the second floor, the concentrates discharging directly into the concentrate-storage bins. On this floor are the lead and zinc filters, two diaphragm pumps, sample-filtering equipment, sample-preparation room and a change room for the mill employees. The flotation machines are on the third floor, at elevations allowing a gravity flow of the lead and zinc concentrates to the thickeners. The annex to the building contains a freight elevator and provides space for all reagent mixing and feeding, also storage of reagents and grinding balls. IT is only in recent years that substantial progress has been made in developing a physico-chemical picture of the solid state. The molecular concept, so useful in dealing with gases, was naturally carried over to the field of crystalline solids; it has resulted in the firm implanting of erroneous concepts that only now are being eradicated successfully. Two simply written and effective books on the subject are Crystal Chemistry by Stillwell1 and An Introduction to Crystal Chemistry by Evans.' A more complete treatment of the subject is available in a book by Wells.' The monograph by Hückel4 also touches on a subject most easily perceived by reference to the brief introduction by Bragg,5 that master of the field. These texts make it clear that while some solids are built of molecules, many are built of ions, others of atoms connected in the form of giant molecules, and still others of cations and electrons. The various lattices in which these entities are systematically arranged, the joint use of several of these entities, and the transitional character of some of the bonds make for the great variety of crystalline solids. The purpose of this paper is to point out a most important corollary of present views on the structure of solids. In this connection the classification of solids in Table I is helpful. Atomic crystals are those formed by the noble gases, e.g., helium and argon. They are soft, sublime at very low temperature, of very low specific gravities, and not encountered in ores. Molecular crystals are uncommon among inorganic materials, common among organic materials. Typical examples from both inorganic and organic fields are sulphur, iodine, naphthalene, benzene, and carbon tetrachloride. These crystals are soft and have low specific gravities; where the molecules are small, the sublimation temperature is low. Filament and sheet crystals are rare. They are typified by elemental selenium and elemental arsenic, respectively. Graphite and molybdenite come near being sheet crystals. These crystals are soft in some directions, tough in others, sublime at various temperatures. Diamantine crystals, typified by diamond, are very few in number, stable at high temperatures, and extremely hard. Ionic crystals are common. Most salts, acids, and alkalies belong in the two classes of ionic crystals; examples are rock salt, fluorite, calcite, and angle-site. The salts, acids, and alkalies that do not belong in these classes are more properly regarded as transitional between ionic crystals, framework crystals, and diamantine crystals, e.g., ice and quartz. Fiber crystals are relatively uncommon mineral-ogically speaking, but common in the fields of living processes. Examples are asbestos, silk, cellulose, and wool. Maintenance and inventory are usually the last items considered in mine development. They need to be addressed properly and early. The micro-computer brings sophistication within the reach of even the smallest mines. Maintenance and inventory programs, if properly installed, will reduce costs 15 to 25% and allow management time to address the mining and metallurgical problems at start up. Shops and warehouses are rarely designed properly. Large engineering firms spend 5 to 20 times more than is necessary for first class facilities. There is an optimum design, size, and layout. Take the time necessary to assure you get the right people, programs, and facilities in that order. Maintenance, inventory, and inventory control must be addressed early if a small mine is to have a chance at optimizing costs during the first two years of operation. This is hard work and is usually put on the back burner until the mine is in some degree of trouble. Hiring an experienced maintenance superintendent is important but it is not the complete solution. Maintenance systems, design of facilities, and use of computers are not skills that maintenance people usually have. In addition, the work of ordering spare parts and working with erection people is a full time job and any maintenance people on site during construction are quickly recruited. The end result is that few mines start up with an adequate Maintenance or Inventory System in place. The months, and in some cases years, that the mine attempts to operate without a system are both painful and expensive. Designs of successful integrated maintenance and inventory programs are virtually 100% supported with some outside assistance. Our system is the approach that we are most familiar with and this paper will isolate how Rushton International would go about setting up systems and designing support facilities. Micro-computers are the only way for a small mine to go. ~ini-computers cost more originally and operating costs are many times higher than even the most sophisticated micro system. Micro- computer software is developed further and recent advances in hardware makes medium priced units equal to most mini's in RAW COMPUTER POWER. Mines in general, and especially small mines, have no need for main frame power. MAINTENANCE A good maintenance program has: 1. Equipment Master List a. Equipment Detail Reports 2. Work Order and Backlog Control Program 3. Component Control Program 4. Tire Program 5. Wear Materials Program 6. PM Control Program 7. Maintenance History Program 8. Performance Program We also track miscellaneous items such as MSHA training and inspections, timekeeping, etc. Rather than going through the program step-by-step, it makes more sense to go through a typical Maintenance Day and show how the programs are used. The first floor (Fig 2) houses the grinding equipment, with connecting conveyors for ore feeding, also an air compressor, two vacuum pumps, bins for lead and zinc concentrate storage with individual conveying systems for loading the two kinds of concentrates. Filtering of concentrates is done on the second floor, the concentrates discharging directly into the concentrate-storage bins. On this floor are the lead and zinc filters, two diaphragm pumps, sample-filtering equipment, sample-preparation room and a change room for the mill employees. The flotation machines are on the third floor, at elevations allowing a gravity flow of the lead and zinc concentrates to the thickeners. It is recognised by the current JORC (1999) code that resource classification involves the interaction of numerous qualitative and quantitative criteria such as data quality, geological continuity and grade continuity. No prescribed criteria and rules will work for all situations or even between different ore types within the same deposit. Also these criteria and rules are sometimes applied without a clear understanding of their appropriateness, accuracy or correct implementation. For these reasons case studies are useful to evaluate and compare criteria commonly used to assist in resource classification. In this paper blasthole data from a selected area of Joffre Member hosted ore of the Brockman Iron Formation at the Mt Whaleback orebody are used as the basis of a case study for the above-mentioned purposes. Iron grade, in per cent, is interpolated from a blasthole dataset into a block model using ordinary kriging. Samples are then removed from this blasthole dataset to produce a random sample grid, a semi-random sample grid and a regular sample grid. Using nearest neighbour, inverse distance squared, ordinary kriging and sequential gaussian simulation, block iron grades are estimated using these three blasthole data subsets as inputs. This provides four groups of estimates with the ordinary kriging estimate based on the complete blasthole dataset being considered to represent the true estimate of iron grades. Also generated during this process are estimates of the error for each block. These error estimates range from the simple, such as drill spacing, through to more advanced methodologies such as kriging efficiency and simulation. These estimates of grade and grade estimation error are then compared to the true estimate using graphs and statistics. In order of increasing accuracy the block grade estimation and simulation methods were nearest neighbour, inverse distance weighting, ordinary kriging and finally conditional simulation. The simulation in some instances doubled the accuracy of individual block grade estimates when compared to nearest neighbour and inverse distance weighting estimates. It was found that many methodologies for estimating the error of individual blocks performed equally well with only methods such as average drill hole spacing and classification by search ellipse pass number performing poorly. An approach on how to convert the abovementioned error estimates of individual blocks into a meaningful JORC classification is also discussed. Although advanced non-linear resource estimates are applicable, most iron ore mines are still using relatively straightforward methods. The use of blasthole data and some simple linear interpolation methods and simple linear based error estimates makes this study repeatable for most iron ore sites and their resource geologists. This style of investigation is recommended as a useful approach for the Competent Person to apply to their deposit and thus better select, implement and understand the criteria used for resource classification and provide more consistency and confidence in the resource classification process.

As a public servant geotechnical engineer, I observed how costly and valuable geotechnical field explorations are to the success of every project. Often however, the field exploration is a long and complex process that is made less efficient by the difficulty of retrieving and utilizing nearby internal or external historic geotechnical datasets. As an employee of a public agency, we would often start our investigations for every project from scratch, given the difficulty of locating and utilizing historic geotechnical data. This is an ethical and technical failing of our profession. When we start subsurface explorations from scratch, not only do we often duplicate investigations, we are also likely defaulting to reapplying tradi- tional test methods that yield con- servative geotechnical parameters, resulting in overly conservative and potentially costly construction. To address this issue while working as a public servant, I started a research program with Yunfeng Zhang, Ph.D., of the University of Maryland, to build a tool that could compile internal historic geotechnical data and extract additional value from it, using machine learning. This tool was able to provide, upon request, nearby historic geotechnical data, estimated soil parameters and recommendations for geotechnical test methods best suited for a given project site. This prevented common field ex- ploration problems such as, requesting duplicate data, requesting test methods that were not applicable for the project geology, not realizing presence of karsts, missing permits for wetlands, private property and others. This tool allowed for more efficient field investigations with regards to time and money saved. There was one problem with this tool: it could only be used by internal employees of a single state's depart- ment of transportation (DOT) for which this data was compiled. I realized at that point that it would be of tremendous value to make this concept universally accessible to the geotechnical engi- neering profession. I left public service to devote time to building a platform that would host historic geotechnical data from publicly funded sources throughout the country. The tool I helped build as a public servant was the foundation of Geosetta, a nonprofit company dedicated to serving the geotechnical profession. The nonprofit structure was adopted to prevent acquisition by a for-profit company and to ensure that Geosetta remains an independent steward of our profession's valuable data. Geosetta provides a GIS (geographic information system) platform that enables users to view historic geo- technical data and extract value from it with machine learning-based predictions and visualization tools. This data is provided in an open and interchangeable format called DIGGS, which stands for Data Interchange for Geotechnical and Geoenvironmental Specialists, making it easy for users to integrate it into their workflows. Geosetta is collaborating with the American Society of Civil Engineers' Geo-Institute and other sponsors to extract public data at no cost to the agency and provide the profession with free access to the existing data and access to advanced tools through a subscription to support the nonprofit mission.

Not since 1917 has a foreign company developed a standalone, grass roots gold mine in Russia. With Russia's political changes of the late 1980s, development of mineral prospects once again beckons foreign investors. Cyprus Amax's interest in Russia began before the mid-1991 breakup of the former Soviet Union. In 1990, Cyprus Amax began searching for such an opportunity. Early this year, production will begin at the Kubaka gold project located in the Russian Far East, near the Arctic Circle. The Kubaka project is a 1.75-kt/d (1,930-stpd) open-pit operation that will produce more than 9.3 t/a (300,000 oz/year) of gold. Identifying Russian mining opportunities In late 1990, the first Cyprus Amax people travelled to Russia. The trip was to determine the potential for western firms to develop profitable mines. This encouraging visit suggested that Cyprus Amax focus on the Russian Far East with its mineral riches and its easier access to the United States. The company's initial efforts thus focused on working with the Soviet Union's Northeast Geologic Expedition, the then government agency for exploration and geology in Russia's Far East. After the breakup of the Soviet Union, Cyprus Amax continued working with the same people, but they now represented new independent, nongovernmental entities. For three years, Cyprus Amax investigated numerous deposits. This resulted in the identification of two properties of significant interest, one of which was Kubaka. Location Kubaka is located in the Northern Evensk District of the Magadan Oblast in the Russian Far East. This is an area east of Siberia. The project is situated in a mountainous area of the Kolyma Range, about 300 km (985 miles) south of the Arctic Circle. It is 285 km (180 miles) north of the fishing village of Evensk and 380 km (235 miles) northeast of the silver-mining town Omsukchan. The site is 950 km (590 miles) northeast of the regional capital city of Magadan. Magadan, the political and economic center of the Oblast, has a population of about 150,000 people. A study of the fracture behavior of unidirectwn-ally solidified Cu-Cr eutectic alloy was performed. Fractured whiskers, grain boundaries, and the interface between proeutectic Cr dendrites and the Cu matrix were the predominant failure initiation sites where grain size was larger. Strain induced void formation was restricted at lower solidification rates. This was attributed to a lack of adequate plastic constraint and a probable preferred orientation. A modification of the Crussard et al. model is presented to explain the appearance of "elongated dimples" on the shear fracture surface. A Cu-Cr alloy containing about 1.8 at. pct Cr solidifies by a eutectic reaction forming filamentary crystals of chromium within a continuous copper solid solution matrix.' Webb and Forgeng2 have shown by bend tests that the extracted chromium filaments, which are ordinarily curved and branched (due to random solidification), have the high strengths associated with whiskers. If an ingot of the eutectic alloy is unidirectionally solidified and appropriate control exercised over the thermal gradient, growth rate, and impurity level, the chromium fibers can be forced to solidify as fibers which are substantially parallel to the growth direction, Fig. 1. Uniaxial tensile tests on these straight chromium fibers extracted from controlled ingots3 have confirmed the earlier bend test results on curved fibers. Combining the facts that the strength and modulus of the chromium filaments are higher than the more ductile copper matrix and assuming that a "good bond" exists between the two phases, the Cu-Cr controlled eutectic system fulfills the requirements for effective fiber reinforcement of ductile matrices as established by studies on fiber glass reinforced plastics and other two-phase systems.4 Therefore, it was decided to study the fracture characteristics of morphologically simple specimens of chromium fiber reinforced copper (i.e., specimens of the controlled eutectic with substantially parallel reinforcing fibers) with the objective of establishing the dominant aspects of fracture. PREVIOUS WORK Comparatively little work has been done to understand the manner in which ductile alloys fail be- cause of the limited demand for this kind of information. Nearshore construction projects often require installation of steel piles and specific methodologies of installing piles may adversely affect nearby species of concern. Water is an uncompressible medium which allows for easy transmission of energy through the water column. Energy transmission through water depends on the following factors for pile driving: 1) direct contact of the pile and the water; 2) the depth of the water column; 3) the size of the pile; 4) type of hammer; and 5) the energy of the hammer. Seasonal restrictions are usually the best practicable alternative for reducing habitat impacts when pile driving activities may adversely affect the species of concern. When seasonal restrictions are not practical other options need to be evaluated, including mitigation and noise attenuation devices. The broad array of mitigation options will not be discussed as part of this presentation but instead will focus on noise attenuation technologies. Dewatered cofferdams can be effective noise attenuators as they eliminate direct contact of the pile with water while driving. Also, introduction of a compressible medium, like air, near the energy source can provide sound energy attenuation. An unconfined bubble curtain is relatively inexpensive but is not effective in tidal marine projects or rivers and may have unacceptable secondary effects. Secondary effects must be evaluated as these can increase exponentially for larger projects. Secondary effects to the environment include air quality degradation from air compressor use, transportation costs for fuel and equipment, and the potential for injecting oily compressed air into the water column. The confined bubble curtain works well in nearly all environments. It usually is more expensive initially, relative to an unconfined air curtain, but there is less potential for harmful secondary effects. Generally, seasonal restrictions will be adequate to protect species of concern. However, there are conditions in which mitigation or one of the sound attenuation options should be utilized. Site specific factors, including the amount of energy being imparted into the environment, sensitivity of the species of concern, current, accessibility, length of time needed to complete the project, and the cost of the sound attenuation, should be factored into the permit evaluation.

Among the rich mineral deposits of the great Appalachian field, the Pittsburgh coal bed stands pre-eminent. Other coal beds may cover a wider area, or extend with greater persistence, but none surpasses the Pittsburgh seam in economic importance and value. It was well named by Rogers, and his able assistants of the First Geological Survey of Pennsylvania, in honor of the city to whose industrial growth and supremacy it has contributed so much. Whether or not the prophetic eye of that able geologist ever comprehended fully the part which this coal bed was to play in the future history of the city that gave it a name we do not know; but certain it is that the 7 ft. of fossil fuel, which, in Rogers' time, circled in a long black band around the hills and, overlooking the site of Pittsburgh from an elevation of 400 ft. above the water of the Allegheny and Monongahela, extended up the latter stream in an unbroken sheet for a distance of 200 miles, has been the most potent factor in that wonderful modern growth that has made the Pittsburgh district the manufacturing center of America, and that bids fair to continue until it shall surpass every other district in the world, even if it does not now hold such primacy.' The Pittsburgh coal bed stands today as probably the largest contributor of wealth of any single mineral deposit in the world. If it is not, what other deposit is? It has contributed to Pennsylvania alone more than 2,500,000,000 tons of high-grade coal worth nearly $4,000,000,000; since 1910, it has added more than $2,500,000,000 to the value of Pennsylvania's mineral output. I. INTRODUCTION Lawyers are a cautious breed; and it might be expected that a paper concerning a broad and complex area of legal regulation, prepared by lawyers for presentation to a predominantly non-legal audience, would commence with several caveats. Ours are the following: First, we have written a broad (and, in some instances, simplified) overview of the regulatory system and of some of the more important requirements generally applicable to uranium mine and mill wastes in the United States. Our paper is not a legal opinion setting forth all of the governmental requirements that would have to be met by any particular mine or mill. Similarly, we do not imply that the requirements we mention are necessarily applicable to each and every mine and mill in the country; depending on the facts, some of the requirements may be inapplicable or avoidable through exemption or variance proceedings. Compliance decisions and strategies for particular facilities must be considered on a site-specific basis. Second, we have undertaken merely to describe the regulatory framework and some of the generally "applicable" requirements which have been promulgated and proposed by administrative agencies. We express no opinion on whether, under the U.S. Constitution and statutes, the existing and proposed agency regulations are valid in general or as applied to any particular mining or milling operation. There are, of course, procedures for judicial review of agency action; and newly promulgated environmental regulations have frequently been challenged, with varying degrees of success, before the courts. For us even to begin to consider such issues would expand an already forbiddingly long paper to totally unmanageable proportions. Third, in light of the subject of this Conference we have limited our paper to the legal framework and requirements applicable to uranium mine and mill "wastes" -- primarily mine overburden and waste rock and mill tailings (including waste tailings solution). We treat operating discharges (e.g., emissions from yellowcake drying) only peripherally. Fourth and finally, it is important to note that this paper, at least in so far as it concerns the specific requirements of particular regulations, will likely soon be out of date in some important respects. Mine planning typically involves designing an operation to uncover coal with the minimum initial costs with reclamation planning and earthworks being done as an "add on" task. The landform is too steep to remain stable, has no drainage and frequently has areas of excessive acidity or alkalinity. Extensive earthworks are required to reduce grades to an acceptable level and create a drainage system. The flexibility available to the mining engineer to alter the post mining landscape clearly depends on the mining methods. Straight dragline stripping provides virtually no flexibility. However most mining operations over the term of current ten year plans have a substantial pre-strip component. It is this pre-strip material which has the potential to reduce the final reshaping earthworks. The reshaping operation itself is subject to some flexibility with various options being available to re-grade and provide drainage. The full utilisation of this flexibility to minimise earthworks cost should be the aim of reclamation design. ACIRL's current thrust in reclamation is aimed at the integration of mine planning and reclamation earthworks. This involves gathering all environment and agricultural criteria and designing the earth works necessary to produce an acceptable final landform. A key component of our work is the use of computer aided design (CADD) for the design of spoil piles, pre-strip dumps and spoil re-shaping. This approach has been applied to a number of mine sites with earthworks operations covering hundreds of hectares and hundreds of millions of cubic metres volume. We are continuing to provide that consultancy service and at the same time are involved in the development of more sophisticated software tools to apply to reclamation design.
