It has long been understood that extended occupational exposures to respirable mine dusts can lead to chronic lung disease. In underground coal mines, coal workers pneumoconiosis (CWP) and silicosis are major concerns. While there have been many studies aimed at understanding total dust concentrations and silica content associated with different mining conditions (e.g., locations/occupations within a mine, cutting methods, geologic strata), little research has been completed to more comprehensively characterize respirable dust (i.e., by distributions of particle composition, size or shape). For such analysis, scanning electron microscopy with energy dispersive X-ray (SEM-EDX) may represent a powerful tool. This article is a preliminary investigation of SEM-EDX to characterize respirable dust from an underground coal mine in Central Appalachia. Samples were collected from various locations in the study mine, and individual dust particles were identified and classified by mineral type. A continuous personal dust monitor was also used to estimate respirable dust concentrations during sampling. This data was compared to particle densities observed under the SEM. Dust is generally defined as small, solid particles with an effective diameter between 1 and 100 µm. In underground coal mines, dust is produced by a variety of activities such as coal and rock cutting, materials handling, haulage and from a variety of materials. While the coal itself is primarily made up of organic carbon, it is estimated that as much as 60 percent of coal mine dust consists of mineral matter, including clays, metal oxides and sulfides, carbonates, quartz, phosphates and heavy minerals (WHO, 1997). Mineral matter may be ingrained in the coal seam or associated with adjacent or interlying strata, and may also be contributed by specific activities such as rock dusting. When dust is generated or made airborne, suspended particles tend to settle slowly with gravitational forces, but can remain airborne for extended periods of time depending on environmental conditions such as air velocity (Courtney et al., 1986) and particle properties such as size (ISO, 1995; WHO, 1999). Thus, miners working underground are routinely subject to occupational dust exposures ? with highly variable characteristics between and even within mines.

The recent discovery of large amounts of helium-3, a valuable thermonuclear fuel, on the surface of the Moon has prompted engineers and scientists to examine the commercial attractiveness, thetechnological feasibility, and the environmental features of this important resource. The main feature of this fuel cycle is the low (˜ 1%) fraction of energy released in neutrons. Such low neutron fluxes result in important reductions in the amount of radioactivity, afterheat, and radiation damage in a fusion power plant. On the other hand, the high fraction of energy in charged particles and synchrotron radiation can be directly converted to electricity, resulting in very high efficiencies of electricity production (˜60.70%). It has been shown that there is 10 times more energy in He3 on the Moon than there ever was in fossil fuels (i.e., coal, oil, and gas) on the Earth. The techniques and equipment needed to extract the helium-3 have been examined and internationally acceptable mechanisms for the industrial development of this resource have been outlined. This paper expands on the financial, environmental, and technical aspects of the recovery of helium-3 for use in the 21st century.

INTRODUCTION Early in the morning of July 16, 1979, there was a breach in the earthen retaining dam of a tailings pond at the United Nuclear Corporation's (UNC's) Church Rock uranium mill. The acidified liquid and tailings slurry spilled through the damaged portion of the retaining wall into an arroyo that is a tributary to the Rio Puerco river system. The Rio Puerco runs through Gallup, New Mexico, and eventually crosses the New Mexico-Arizona border (Fig. 1). On its way to Gallup, the Rio Puerco and its tributaries pass through land with a checkerboard pattern of ownership, with portions owned or leased by the Navajos, individuals, the Bureau of Land Management, and the State. In terms of tailings liquid volume (3.6 x 108L; 94 million gal), the UNC spill ranks as one of the largest. The mass of solids released in the slurry (10.0 x 105 kg; 1 100 tons) appears to be close to the median for accidents of this kind, however [U.S. Nuclear Regulatory Commission (NRC), 1979]. The UNC first opened its Church Rock uranium mill in 1977 on land adjacent to acreage belonging to the Navajo tribe. The mill, which is next to the UNC Church Rock mine, is located approximately 16 km (10 miles) northeast of Gallup, New Mexico (Fig. 1). Gallup, a town of 18 000 people, is the closest population center. The region surrounding the plant site is sparsely populated by Navajos, at a density of approximately 5.8 persons/km2 (15 persons/sq mile). The UNC mill and mines employ approximately 650 persons, and the adjacent Kerr-McGee uranium mine employs about 300. The UNC mill normally processes 3.2 x 106kg/day (3 500 tons/day) of uranium ore, depositing the acidified tailings slurry in a series of three earthen holding ponds. The tailings ponds are located east of the pipeline arroyo that feeds into the Rio Puerco approximately 2.4 km (1.5 miles) from the southernmost tailings dam. The liquid portion of the tailings slurry evaporates in the ponds; hence, under normal conditions, there is no surface flow from the holding ponds to the arroyo. Both runoff from the plant site after heavy rains and possible seepage from the tailings ponds may deliver radionuclides to the arroyo-river system, however. The dam across the southernmost tailings pond was considered to be in keeping with the state of the art. However, the New Mexico Environmental Improvement Division (NMEID) had warned UNC about dangers of locating the pond over a heterogeneous geological formation. The state Engineer's Office approved of the site only after UNC agreed to strict design criteria. Others have pointed to dangers of constructing earthen dams for impoundment of uranium mill tailings (Carter, 1978). Causes of the dam break were multiple: the UNC mill filled the tailings pond to a level that exceeded permit criteria; the tailings pond was lined improperly; the dam was constructed using clay that was compacted excessively, resulting in cracking and subsequent seepage; and the unstable substrate beneath the dam permitted differential settling. The UNC Church Rock mine has continuously released dewatering effluent into the pipeline arroyo at a rate of 88.3 L/sec (1 400 gal/min) since 1968. Before 1975 this effluent was not treated; after 1975 it received precipitation treatment for removal of Ra-226. Radionuclides are also released into the river system through the dewatering of the Kerr-McGee uranium mine 1.6 km (1.0 mile) north of the UNC mill. During usual mining operations, approximately 227 L/sec (3 600 gal/min) are released into the pipeline arroyo and subsequently into the Rio Puerco. The Kerr-McGee mine began continuous release of dewatering effluent in January 1972. In 1974 Kerr-McGee began Ra-226 precipitation treatment of its dewatering releases, but NMEID data indicate that treatment has often been incomplete. The effluent from both mines has been responsible for transforming the downstream portion of the Rio Puerco from a sporadically dry riverbed into a continuously flowing stream and has contributed to the current levels of background radiation along the river system (Table 1). This paper will summarize the postspill monitoring efforts and relate the assessment of this spill to the general question of evaluating the health effects of nuclear fuel-cycle wastes. The data pertaining to the measurement of radionuclides in the Church Rock environment and the radionuclide concentrations in animals will appear in forthcoming reports. CHURCH ROCK HEALTH EFFECTS ASSESSMENT APPROACH The initial health effects evaluation involved identifying the radionuclides that were released into the river system from the tailings pond. Table 1 lists the State of New Mexico maximum permissible radionuclide concentrations for liquids released to unrestricted areas, the typical tailings liquid concentrations, and postspill river water concentrations. The tailings liquid contained comparatively high levels of Th-230, Ra-226, Pb-210, and Po-210--all of which, according to postspill river water samples, had exceeded the state maximum permissible concentrations (MPC) at one time or another. After the radionuclides in the tailings were identified, pathways through which humans could be exposed were clarified. Caterpillar unveiled a new dozer, the new Cat D10T2 dozer, that builds on the success the company has had with its D10T model. The newest version of the dozer includes refinements to its power train, automated controls and structures. The result, the company said, is high productivity with superior fuel efficiency, reliable operation with long-lived structures, as well as enhanced access for service technicians and operators. The D10T2 uses the latest load-sensing hydraulics technology combined with Cat advanced engine controls to maximize the amount of material moved for every drop of fuel burned. Improved filtration protects the fuel system, hydraulic system and power train oil system to help ensure high reliability and minimal machine downtime. Refined large structures, such as redesigned track roller frames, deliver longer service before rebuilds. Improved access and egress features enhance safety and productivity of technicians and operators, and optional powered access systems and platforms enable configuring the D10T2 for the site. Caterpillar offers the D10T2 with two variations of the Cat C27 engine with ACERT Technology. One version is U.S. Environmental Protection Agency (EPA) Tier 4 Final certified, and the other is capable of achieving emission levels equivalent to EPA Tier 2 standards. Both engine configurations produce net power of 447 kW (600 hp) in forward gears and 538 kW (722 hp) in reverse gears. The engine controller automatically adjusts power output based on the direction of travel. With the new system, the D10T2 has about 20 percent more power in reverse compared to its predecessor model. The result is faster cycle times and greater productivity in certain applications. The D10T2 is suited for a variety of applications including mining, heavy construction and bulk materials handling.

The very high cost of exploration and development for new mines requires that a carefully planned, complete, and technically competent geotechnical evaluation be applied to the ore body and the surrounding rock. The ground conditions must be predetermined sufficiently so that, during the development and exploitation stages, unexpected conditions will be of minor consequence. Ground conditions are a major factor affecting the cost of excavated items such as shafts and inclines. For example, shafts cost less to sink in tight dry ground than in highly pervious ground below the water table, with all other factors being equal. The proper mining methods also is dependent upon the ground conditions. Bad ground for room-and-pillar mining may be ideal for caving methods; whereas, ideal ground for room-and-pillar mining would be extremely difficult for a caving operation. To do a proper engineering design, the parameters of strength, deformability, and permeability must be determined, in addition to the loads that will be applied as a result of the mining activity. The required degree of accuracy for each parameter depends upon the individual case. For example, the strength of massive rock in which openings of small cross-sectional area are to be driven at shallow depths needs to be resolved only within several thousand kilopascals (pounds per square inch). Under such conditions, the rock strength is not likely to be of great economic importance unless the rock is very weak. Large openings at great depths require a much more accurate appraisal of rock strength and deformation characteristics. Ground water conditions are important at any depth. Today, a number of techniques exist for evaluating conditions before opening up the ground for development. These techniques and their applications are described in more detail later in this text. The evaluation of ore body ground conditions should start at an early stage, as soon as the deposit has been proven viable for a mine. Economic geology investigations mainly serve to define the value and limits of the ore deposit. To do this properly, the geology of the site is determined in at least as much detail as is necessary to define the "controls" for the ore body. The ground-condition evaluation must determine the engineering properties of the ore body and the surrounding material. This includes the structural geology as it relates to rock strength; i.e., the frequency, extent, and orientation of discontinuities such as faults, joints, bedding, etc. Ground water conditions also must be determined. It is important that the detailed geology of the site be determined at an early date. Reasonable geotechnical parameters must be established during this time period, so they can be used in mining model studies that include both physical and mathematical models. The ultimate goal bf-the geotechnical evaluation is to predict the ground behavior as the excavations are made and how the ground behavior will affect the safety and economic well-being of the mine. The formulation of a ground-condition evaluation program should be planned carefully to determine the particular geotechnical parameters only in as great a detail as will have a bearing on the mine design. For instance, it is not necessary to make numerous triaxial tests in strong rock when the mining will be conducted within a few meters (feet) of the surface in a regime of gravity loading and an absence of tectonic stresses. Similarly, it is not necessary to invest large amounts of time and effort in the determination of joint strengths if the orientations of the joints are such that the failure could not occur along them. Generally, the determination of ore body ground conditions can be divided into four main steps: 1) The general and structural geology of the site must be determined; this is determined primarily during the economic evaluation. 2) The material behavior characteristics of the deposit and the vicinity must be determined. 3) The ground water hydrology of the deposit and the vicinity must be determined. 4) Miscellaneous ground support considerations must be established. Gross features are defined first, followed by a series of increasingly detailed investigations. Specifically, the geology study should start by utilizing techniques such as remote sensing, topographic map interpretation, geologic mapping, etc. After the gross features, such as major faults, have been delineated, the studies are directed toward defining the more detailed elements of jointing, rock strength, ground water hydrology, and other characteristics. This information is used to formulate an assessment of the strength of the ore body and the surrounding rock. Finally, all of the gathered information is integrated to make an assessment of the rock behavior in relation to the types of openings, the excavation methods, the support requirements, etc., that should be used for the rock conditions that are present. The mine design and the geotechnical assessment should be an iterative process. General conclusions about the rock conditions will dictate a type of mine plan. The specific mine plan then should be modified by specific geotechnical considerations. For example, an initial assessment may conclude that the ore body is strong and that a strong rock unit is present over the ore body. Thus, one definite possibility is to mine the deposit by room-and-pillar methods. However, subsequent investigations may reveal faults through the deposit, requiring relocation of the mine openings so that pillars and other structures are in sound rock. In other words, the final mine plan should be compatible with the geotechnical aspects of the ore body.

The Yankee Gulch sodium minerals project (YGP) is a solution mining project operated by American Soda. The mine operates on a federal lease administered by the U.S. Bureau of Land Management (BLM). Commercial operations began in November2000. In 1964, Irv Nielsen discovered nahcolite mineralization where the YGP pilot plant is now located near the Piceance Creek in Rio Blanco County, Colorado (Nielsen, 1969).Development of the project accelerated after Williams Corp., of Tulsa, OK, joined with American Alkali in1996 to form American Soda. Pilot testing by American Soda led to commercial permitting, plant design, construction and startup. Figure 1 shows the location of the Yankee Gulch leases and the location of the upper and lower plant sites.

Fleet management systems (FMSs) as the pivotal part of any surface mining operation find it essential to evolve from conventional into intelligent systems because of both Mining 4.0 requirements and some shortcomings inherent in conventional methods. However, this novel transformation needs to be investigated technically and strategically. To this end, the previously published research works on intelligent FMSs are explored to track the latest status of these third generation frameworks within the surface mining context. Following that, their underlying models are compared in terms of five categories of allocation and dispatching features to pinpoint the technical gaps ignored. Having drawn the future lines of research, the present article then leverages the popular SWOT analysis method to outline the strengths, weaknesses, opportunities, and threats associated with the advent of these intelligent FMSs in mines of future. By and large, the analysis indicates that advantages outweigh disadvantages. Solutions are offered to address the existing weaknesses and threats.

Anomalies of sulfur dioxide and other gases have been defined, by direct measurement, around various sulfide bodies. These readings were made (1) in soil gas and (2) in the atmosphere, from both ground vehicles and, to a limited extent, from helicopters. Test areas included porphyry copper and molybdenum deposits, sulfide bearing vein systems, pyrite zones associated with sandstone uranium accumulations, and pyrite-bearing mine dumps. Some of the deposits are covered by as much as several hundred feet of overburden or barren rock, while others outcrop, or have been exposed by mining operations. Depending on local conditions, background values of sulfur dioxide in soil gas and the atmosphere range from 1 to 15 parts per billion. Using present techniques, anomalous readings are recognized at approximately two times background. Apparent "depth penetration? on known deposits has ranged to several hundred feet. Readings have been made over known deposits from a helicopter and ground vehicle moving at up to 40 mph. The rate at which the survey may be carried out depends largely on the size and extent of the anomaly. The existence and magnitude of sulfur dioxide anomalies around sulfide-bearing deposits is a function of geology, target size, soil moisture, and climatic conditions such as temperature and temperature changes, barometric pressure, wind velocity, and precipitation. Industrial S02 pollution can effectively mask the presence of the anomalies sought.

The Arkansas Novaculite of Devonian and Mississippian age is the most distinctive formation in the central Ouachita Mountains of Arkansas from the standpoint of both topography and lithology. The formation typically forms precipitous, narrow ridges (hogbacks) which reflect the steepness of dip and the resistance and thickness of the rock units. The Arkansas Novaculite varies from less than 200 feet thick in the north to locally over 800 feet thick in the south and outcrops over an east-west distance of 360 km (200 miles) in the Ouachita Mountains of Arkansas and Oklahoma. Most of the rocks of the formation are highly siliceous with novaculite predominating, and lesser quantities of chert, siliceous shale, conglomerate and rarely sandstone. Novaculite is commonly defined as a homogeneous mostly white rock, translucent on thin edges with a dull to waxy luster and composed almost entirely of microcrystalline quartz. The word novaculite comes from the Latin word novacula, meaning razor hone. This term was first used by Richard Kirwan in his mineralogy text of 1784. The origin of novaculite remains controversial but we believe it was a primary silica derived mostly from the alteration of submarine volcanic-rich materials, with numerous fine biogenic components and some minor clastics (derived mostly from foreland facies via turbidity currents) and deposited as an amorphous siliceous ooze in the deep Ouachita trough. It was subsequently converted to microcrystalline quartz during diagenesis by the compaction of the overlying rocks and the intense Late Paleozoic Ouachita Mountain tectonism. In the central and southern portions of the region three divisions of the formation have been defined: a Lower Division predominantly of light-colored novaculite; a Middle Division of interbedded dark chert and shale; and an Upper Division of massive often calcareous novaculite. In the northern exposures the formation is thinner and contains more black chert and shale, chert-shale conglom¬erate, sandstone and less novaculite. The massive novaculite of the Upper and Lower Divisions is a source of high purity silica (99+%). Indians were the first to use novaculite. They made their various tools and hunting implements from the weathered broken rock until they learned the quarrying techniques. The first white men in the area recognized the use of novaculite for sharpening their tools and knives: previously whetstones were obtained in small quantities from Europe. To this day whetstone is quarried mostly in areas which the Indians and possibly the Spanish previously worked. Some of the current mining practices have changed very little from those of the early quarryman. In areas where the novaculite of the Upper Division is poorly cemented, this friable tripolitic material has found applications in such uses as an abrasive, as a filler or extender in paints, plastics and other purposes. Some of the dense novaculite is suitable as a filler in fire bricks and also in plastics. Because some of it has the tendency to decrepitate when heated not all novaculite can be used for these applications. Several quarry operators are crushing novaculite for road, concrete, and other aggregate. This use was formerly rather limited due to the abrasiveness of the novaculite on crushing and screening equipment. Further potential uses of novaculite are speculative but include application of high purity silica in the production of silicon metal for solar cells, seed or "growing", and fusing quartz for electronics.

The mined geologic burial of high-level nuclear waste is how the favored option for disposal. The underground repositories must keep the waste away from the biosphere for very long times - several thousands to tens of thousands of years. Also, access must be maintained to the vaults for several tens of years, so that the waste can be retrieved, if necessary. Both the excavation of the underground chambers, and the radiogenic heating will disturb the rock mass. The overall rock mechanics problem is to understand and predict the processes associated with these perturbations, and their impact oh the isolation and containment of the waste (3)**. The specific rock. mechanics issues which have been identified for the three candidate hard rocks (basalt, granite, and tuff), are summarized in Table 1. The table also indicates the level of adequacy of our knowledge in the areas of the various issues. Such an evaluation is consistent with the general consensus of the rock mechanics profession, as explained in several key reports and publications (1 to 11). The main shortcomings of today's rock mechanics for waste repositories can be summarized as: ? lack of resolution for remote mapping of fractures in rock masses ? great difficulty in testing large volumes of rocks to determine their mechanical properties.

Several attempts have been made in the past sixty or so years to commerciliaze the vast oil shale deposits of the United States of America. However, the industry has yet to become viable and economic. To date, it has not been possible to produce oil from the oil shales at a competitive price when compared to the oil produced from oilfields by conventional methods. However, the development work has been quite fruitful in furthering the art of thick bed mining and technology of in situ retorting. The in situ method has the potential of recovering oil from thick beds and the resource recovery potential is much greater than that from underground mining and surface retorting. In situ methods require that the shales/ marlstones be fragmented ' in place to induce adequate porosity and permeability to allow in situ' heating of the fragmented shales. This can be accomplished by using explosives. However, it has been found that the existing blasting systems, though very efficient, are somewhat lacking. The explosive become insensitive when shot in multiple vertical decks. They can also become insensitive when spaced horizontally at close proximity to other charges. Also, since the blasting is done in a very limited free face, this limits the delay time that can be allowed between charges. Consequently it is not always possible to predict the performance of the blasting system on a routine basis. Furthermore, since it is not possible to undertake secodary blasting, it is imperative that the blast design function properly. Recent, successful retorting by Occidental Petroleum Company of retorts seven and eight suggests that some of these problems may have been overcome. This paper addresses some aspects of in situ retorting and problems those have impeded the development of a viable oil shale industry in the U.S.A.

A multi-layer gangue roof of a steeply dipping coal seam with a large mining height face area was analyzed using physical simulation, numerical simulation, theoretical analysis, and field measurement methods to evaluate the roof deformation and the mechanisms associated with the instability of the hard gangue and soft coal interlayer. The results indicated that the first weighting step of the multi-gangue roof was larger than that of a non-gangue roof, but periodic weighting steps were similar. The overburden collapse height was lower in the multi-gangue roof than in the non-gangue roof due to the buffering and supporting function of the collapsed gangue. Moreover, the failure of the coal interlayer was the key factor in the collapse of the multi-layer gangue. A mechanical model was established for the hard gangue and soft coal interlayer based on a revised Prandtl squeezing theory. The limited load of the interlayer and maximum resistance of the shield support was thusmodeled. The maximum resistance of the support increased with the dip angle of the seam and burial depth. It also increased with the interlayer thickness at thicknesses below 2.75 m. It reached a peak when the interlayer thickness was between 2.75 and 3 m and exhibited a decreasing trend when the thickness was greater than 3 m. The results were confirmed using physical simulation and a field test. Certain measures were proposed to control the stability of the gangue roof, including zoning control of the mining height and resistance and advancing the support while maintaining roof contact, thus ensuring the integrity of the support and surrounding rock system.

Powered haulage and haul truck-related fatal accidents are among the most frequent at surface mines. Industry organizations developed guidance on accident scenarios to address haul truck and mobile equipment collision-related accidents. However, there is a need to investigate accident data to prioritize these scenarios and identify factors relevant to developing validation methods for collision warning/avoidance technologies and determining their capabilities and limitations. Standards and effective validation methods are necessary for improving system efficacy within mining operations and promoting industry adoption. To address these needs, researchers from the National Institute for Occupational Safety and Health (NIOSH) investigated available powered-haulage and machinery-related fatal accident reports documented by the Mine Safety and Health Administration (MSHA). Their objective was to gain a perspective for informing the development of test protocols and validation methods through determining the most prevalent accident scenarios and related factors. Our findings afford insight for addressing the most prevalent haul truck scenarios and relevant factors within U.S. surface mining environments.

Despite being crucial for meeting the world’s energy demands, coal mining operations present considerable health risks, especially when it comes to exposure to coal dust. Longwall coal mining, an advanced technique, has considerably enhanced production but made dust control more difficult. Due to its explosive nature, coal dust continues to be a serious and dangerous concern in the industry despite developments in safety technology. This study aims to comprehensively assess the risk of coal dust explosions by integrating fuzzy risk matrix and Pareto analysis methodologies, offering precise risk ratings for various root causes. A fuzzy risk matrix was developed to assign exact risk ratings to identified root causes. Additionally, a Pareto chart was used to identify the main reasons and suggest particular preventive measures. 17 significant causes were determined for underground coal mines based on the study’s methodology, and some preventive measures were suggested. In accordance with fuzzy risk rating values, root causes were divided into six categories. The root hazard with the highest risk rating was identified as ‘accumulation of inflammable gas/gases’. The proposed approach was used to examine incidents caused by coal dust explosions in Turkish coal mines in order to demonstrate the effectiveness of combining the fuzzy risk matrix and Pareto analysis for assessing coal dust explosions. This study gives not only a solid framework for risk assessment but also critical information for classifying the risks associated with coal mine dust explosions. The results highlight the critical necessity for proactive and preventive actions to reduce the hazards of coal dust explosions and protect the safety of mining workers.

INTRODUCTION For any identified mineral resource to qualify as a minable reserve, it must contain legally and economically extractable mineral at the time of determination. As competition for land has increased, the legal complexities have more than kept pace, frequently becoming the most important determinant in mineral exploration and development projects. Rarely will developers of a project avoid having to obtain numerous federal, state, and/or local permits while acquiring the necessary legal permission to begin mining. Each site must be selected carefully, not only for economic feasibility, but also for legal feasibility. Although it is impossible to present site-specific solutions for all potential underground developments, certain generalizations may be applied to specific land categories, particularly federally owned land. Such federally owned land includes more than 33% of the land area of the United States and many of the areas potentially attractive for future development. State and local restrictions affect a large portion of the nonfederal land, and those restrictions are equally important even though their diversity and current status require more regional study than can be provided herein (the list of references include sources of additional information). Each potential mining site requires a title search of the land status to determine the land ownership and the conditions affecting development. In addition, appropriate data concerning the mineralogic and economic potentials of an area must be collected. As listed in Table 1, many sources of public information are avail- able to aid potential developers. Fig. 1 illustrates a typical federal master title plat. HISTORICAL PERSPECTIVE The settlement of the United States reflects a fascinating history of public-land laws and subsequent mineral-disposal laws. Most of the statutes of the eighteenth and nineteenth centuries sought to dispose of land for the purpose of generating revenue to the federal government. The underlying need for general revenue contributed directly to numerous and often conflicting land policies. More recently, diverse federal programs such as environmental legislation have transcended the need for revenue in forming the framework that determines who has power over mineral developments and where those developments can take place. In 1812, the General Land Office was established under the Treasury Dept. At that time, English common law prevailed, entitling the owner of the surface to whatever was contained within the surface boundaries from the surface to the center of the earth. Unless a distinct title separated the mineral estate, it was included in the surface-land ownership. However, gold and silver were the property of the crown and were controlled by sovereign prerogative. Early state legislation on the subject of mines and minerals may be classified as legislation providing for the sale of state lands with a reservation of the minerals and legislation recognizing or asserting the sovereign prerogative for precious metals. In 1781, a Pennsylvania statute reserved 20% of all gold and silver ore for the use of the commonwealth. Thomas Jefferson suggested that a portion of all gold and silver be retained by the federal government. These early rules affecting land in the eastern states, now privately held, have been re- pealed, declared obsolete, or largely ignored. Federal legislation prior to 1848 and affecting mining may be classified as legislation reserving the minerals to the United States and legislation authorizing the disposition of reserved minerals by sale, lease, or grant. With many modifications, these basic policies remain in effect at the present time. A 1796 act provided for the sale of the Northwest Territory and for the establishment of the present system of rectangular survey for public lands. The Lake Superior copper region was the scene of "wild and baseless excitement in 1837" when the attorney general concluded that the president had the power to lease lands in Wisconsin; this opinion soon was overturned by another attorney general. By 1846, Congress had passed legislation authorizing the president to sell reserved lead mines "as soon as practicable" since the system of granting Leases had proved to be unprofitable to both the government and the lessees, many of whom refused to pay the rent. The general practice of early federal Legislation was to make a distinction between mineral lands and other lands, deal with them separately, and generally withhold mineral lands from disposal except through special legislation dealing with particular land. In 1848, following the treaty of Guadalupe Hidalgo, a vast land area was ceded to the United States by Mexico. This area included the present states of California, Nevada, and Utah, as well as portions of Arizona. Colorado, New Mexico, and Wyoming. This abolished the Mexican laws and customs relating to mining and preceded the adoption of the miners' own rules and customs. The adoption of those rules and customs followed a hard-fought battle between western congressmen and the eastern establishment. The western congressmen advocated adopting local customs through a location patent system, while the eastern establishment, particularly in Ohio and Indiana, favored an all- leasing system to pay off Civil War debts. The first mining law was passed in 1869 as an amendment to an act granting right-of-way to ditch land owners, and it was followed by the 1872 Mining Law. Precedent was established for the first categories of protected lands in the opening words of this act, which included the phrase "all unreserved" lands. Reserved lands subsequently defined included military and Indian reservations and were excluded from location since they were determined to be reserved lands. Estimating ground-water inflows in rock deep tunnels is critical to the safety of personnel constructing the tunnel and the cost of construction. This paper presents two case studies, including the Chattahoochee and Nancy Creek tunnels, for estimating steady-state ground-water inflows into deep rock tunnels. Statistical methods were applied to packer test data obtained from exploratory borings during geotechnical site investigations, and a semiempirical procedure was used to estimate ground-water inflows. The Chattahoochee and Nancy Creek tunnels are deep rock tunnels that exhibit radial flow conditions. For the radial flow condition, a statistical analysis presented in this paper indicates that the semiempirical procedure works well; however, variations in the procedure and/or an insufficient amount of testing could lead to underestimations of the inflow quantities. Modeling using Monte Carlo simulations was observed to be an effective tool for removing data distribution irregularities and incorporating high-end permeability data to derive reasonable ground-water inflow estimates.

Mining has been the mainstay of the Woods Creek Valley for more than a century. The head of the valley is at the Continental Divide, about 50 miles west of Denver, Colorado. First, it was the quest for gold and silver that drew people to the valley. Then, when molybdenum was classified as a strategic metal by the U. S. Government during World War I, it was the valley's molybdenum mineralization which attracted the most attention. Molybdenum is used primarily as an alloying material in superior grades of steel. Circumstances responsible for providing the label "Urad" are unknown, but Urad is variously reported to be an acronym for "Uranium Research and Development" or "Uranium Research of America Division". The search for uranium was fruitless as no ore grade uranium exists in this area. The moly orebody was first developed and mined by the Primos Exploration Company from 1914 to 1919. During World War II, the mine was purchased by the government and turned over to the Molybdenum Corporation of America to operate. In 1963 AMAX Inc. purchased the property for $2 million. After spending nearly $30 million for exploration and development, AMAX put the mine into production again in 1967.

The TRJV Mine is located approximately 43 miles northeast of Winnemucca, along the east flank of the Osgood Mountains in the Potosi Mining District, Humboldt County, Northwest Nevada (see Figure 1). The Turquoise Ridge Mine is an underground mine, and is a 25% joint venture partner with Newmont Mining. The TRJV mine utilizes the underhand cut-and-fill mining method due to the relatively low rock quality in the ore zones and the relatively shallow dipping 25-45 degree ore body geometries. This paper defines a rehabilitation risk rating system (RRRS) for prioritizing rehabilitation of drifts damaged in the mining processes including long term development drifts providing access to the mining areas. The ultimate use is as a mine planning tool for the organized scheduling of rehab in a timely manner. A few case studies of the most needy rehab areas identified by the RRRS mapping system is presented, and the type of rehab completed design for these areas. Suggestions on improving the rehab risk mapping system include the use of support history and rock mass strength rating factors.
