The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. (Articles of Incorporation and Bylaws as adopted are printed following these minutes.) Additional resolutions were read by Linville as follows: Item 1: WE RESOLVE herein that in the year since the last convention of the RMCMI, the Institute and the coal industry have suffered the loss, through death, and the services of: Lloyd W. Taylor Charles T. Holland THEREFORE, BE IT RESOLVED, that we record in the minutes of the RMCMI, recognition of the passing of these members who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere sympathy and deep regard of the members of the Institute. Item 2: RESOLVED, that in recognition of their long and faithful service to the coal industry that the status of Life Member be conferred upon: Bernard Bernstrom Roy Coulson Shirl C. McArthur Item 3: RESOLVED, that we commend and express our gratitude to our Executive Secretary, officers, chairmen and committees for an outstanding job in presenting. the 80th RMCMI meeting. Item 4: RESOLVED, that the RMCMI express its gratitude to K&P, INC. of Golden, Colorado for their generous donation of office facilities and furniture for the RMCMI office and to K&P SALES ENGINEERS, INC. also of Golden, Colorado for their assistance in telephone answering, other office procedures and the use of certain office equipment. Item 5: RESOLVED, that six scholarships be awarded annually to advance the education program of the Institute to worthy students pursuing career paths in mining or other related industry in the six states in which the Institute generally operates and has members and in accordance with the criteria set forth by the Scholarship Committee. ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. (b) An individual who has devoted long and dedicated service to the corporation and to its goals and purposes may become a life member of the corporation upon being elected to that status by the Board of Directors, and such individual shall retain such status for life. (c) An individual who has been at any time an active member of the corporation and who has reached 70 years of age may become a senior member upon payment of such annual dues as the Board of

9:00 a.m., June 28, 1983 MR. MORTENSEN: Good morning ladies and gentlemen. Again, it gives me great pleasure to welcome you to another session of the 79th meeting of the Rocky Mountain Coal Mining Institute. The thing again that has always been impressive are the activities that we've had so far. The success in the meetings has been delightfully encouraging to all of our committee people. Please welcome the chairman of the session, Charlie Margolf. MR. MARGOLF: Thank you, Vernal. Good morning, ladies and gentlemen. It would be my privilege to serve as the session chairman this morning. To allow the maximum time for our speakers, I'll turn the microphone over to Bernie Bernstrom who will introduce our first speaker. MR. BERNSTROM: Thank you. As Vernal mentioned, Dan Jackson will be our first speaker. He is the Western Editor of Coal Age Magazine. Dan really doesn't need an introduction to this group. He's belonged to the Rocky Mountain Coal Mining Institute about 25 years. Dan is a native of West Virginia and he's an ex-coal miner. He graduated form West Virginia University as an electrical engineer and worked for Amherst and West Bending Coal prior to employment by Coal Age Magazine. Back in 1972 Coal Age moved him to Denver from New York City. MR. JACKSON: When Vernal Mortensen asked me speak to the members of the Rocky Mountain Coal Mining Institute earlier this year I found it impossible to say no to the guy because of what he has contributed to western coal. Little did 1 know that the subject he had in mind would be entitled, "An Outsider's View of Western Coal." At first I asked myself-I've been associated with the coal industry for some 38 years, 12 years in national operations and 26 years reporting on it. You might say that I've been married to two industries, coal and the business press for 26 years, but today I'll put on my business press hat and try to make an impression of what an outsider might think of western coal. But at the outset, let's get one thing straight: When you say press, whether it's business press, the media or whatever, and you heard some comments yesterday as far as what the media has done .to this industry and there's been some definitions bandied around as to just what an editor is. One of the most recent ones has defined an editor as a person who can talk on any subject with an open mouth. Now that's not my case. Secondly, I don't give long talks. Several years ago I was giving a rather lengthy talk to a group similar to this and it was halfway through the talk when I noticed one guy on my right looking at his watch quite frequently. I didn't mind that too much because all of us do that once in a while, but when he looked at his watch, took it off and shook it, I thought, "My God, better cut short." But for more than a decade western coal has enjoyed substantial annual increases in production from some 30,000,000 tons in 1970 to some 264,000,000 tons in 1981, but 1982 was a different story. We lost about 6,000,000 tons of production in that year. In 1983 it's expected to be a little worse than '82. Coal historically doesn't rebound from a recession as quickly as other industries. It takes about eight to 10 months longer for us to really get moving again and I'm afraid that you'll still have to don your fighting helmets and flack jackets when you go out into the market to sell your product. Western coal, as you know, has problems and al l of them are not going away when the recession ends and they won't go away overnight. I'm sure most of you are aware of what those problems are. Carl Bagge and Jim Harris, along with other speakers, at this meeting have educated us well on those problems and I'm sure you'll hear more from Jim Watt at today's luncheon. If everyone in this room were asked to list three orfourof the most serious problems facing western coal, I'd make book that the total of the answers wouldn't vary by more than 3 to 5%, if that much. But coal is not the only mining segment in the U.S. with problems. Metal and non-metal mining has its share, too. I'd like to step back into the past for a few minutes, if I may, to a time when our problems were just beginning. Since 1979 a third of the nation's mines, including coal, metal and nonmetal have been shut down. The total volume of all mining in the U.S. in that year totaled some $24 billion. Today that figure has dropped some 21 %. The after tax rate on return for mining companies has fallen from 6'/% in 1980 to minus 3% in 1983. But that's really not where our problems began. They began 20 years ago when a profound change began taking place in the U.S. economy. Our economy had been growing at about 2'/-3% annually without exception except for the great depression. Our inflation rate was about I'/%, interest rates were running about 6%, and the federal budget was $77 billion, really great figures compared to today. From 1960 to 1980 the federal budget increased almost 1.000% and taxed paid by individual families increased by 700% during that same period. Despite the huge increases in taxes, the federal deficit kept getting larger and larger year after year and within this 20 year period the national debt climbed to a trillion dollars. Economic progress of this type can't continue indefinitely without some serious consequences. The result of that economy, well, you know what happened and there is a direct relationship of that

CONCLUSIONS: Our experience, where we attempt to remove a continuous face with a seam more than six and one-half feet in thickness, has been rather disastrous. We have been able to open up faces and retreat for a distance of 75 to 100 feet in this particular character of coal, but after the supporting timbers have been removed for the second or third time we have found that the roof has a tendency to ride over the props and break off at the face of the coal support. However, where our coal is below six and one-half feet in thickness we have had very good success in handling the roof and breaking it off systematically with our break line of props, which are usually from 12 to 15 feet from the face of the coal. Our practice in to set props at about two-foot intervals in each direction and remove two sets of props, at the same time two additional sets are placed along the coal face. At all times we are very insistent that all props be removed from the gob and that entire coal be taken out so that it is possible for the roof to break freely and all come down, not having any supporting pillars in the gob. The conclusion of our experiments to date is that if all the supports beyond the breaking line of props are taken out as the long face retreats and the closer the breaking line of props is kept to the face the better the results will be. We have never felt it safe to have less than four rows of props to protect the machinery and men working along the coal face. We feel that the time element as to the rapidity with which these faces are advanced or retreated, is of vast importance, but to date have not had an opportunity or experience enough to reach any conclusion as to what time element is proper here with us. We feel that the crushing strength of the overlying strata will govern this to a large extent, and as ours varies considerably, it is going to he very difficult for us to reach a definite conclusion. My opinion is, that conditions may be such that rather than have a short face and retreat rapidly, it will be found that a longer facewith a slower retreat will work out better. Such a condition might give the overlying strata time to settle. The caving of roof or of control of this caving, with us, is quite closely associated with the ventilation. We find that the places where the strata overlying the coal are composed of shale, that the effect of the air on this is of very great importance. It is our endeavor, at all times, not only to remove obnoxious gases, but to keep a current of fresh air moving along the face and, of course, a portion of this travels over the gob and comes in contact with the roof and overlying strata. This, we find, helps materially in keeping the roof on the move. As it is our practice to keep water for sprinkling purposes at all places, we also use this water to keep the roof wet back in the gob. The effect of water on the shale is to cause it to disintegrate quite rapidly. MR. HOLMAN (Concluding): If there are any questions about this, I will be glad to answer them. I have some prints and also some pictures of the scraper loader and the shaking conveyors (distributes.) PRESIDENT MOSES: We wish to thank you, Mr. Holman, and also wish that you would thank Mr. Dupont for his paper. Are there any discussions? Do you wish to ask Mr. Holman any questions? (No response.) PRESIDENT MOSES: Mr. Holman, I would like to ask you how you take the photographs; were they taken by flashlight, or were globes used, or how were they taken, in a gaseous mine? MR. HOLMAN: Our mines being gaseous, we do not use the ordinary flashlight for taking underground photographs, but we have had considerable success, I think, with underground pictures by means of electric lights. We use 250 watt globes. We have six of these rigged up with tin reflectors, 18 inches in diameter, on standards, and we carry two or three hundred feet of wire connected with these six lights, and they can be turned on in the room where we take the photograph, by means of this extra wire. It's my pleasure to welcome the Rocky Mountain Coal Institute to Montana. Now that you've ended a 74 year history of meeting outside our borders, I hope you'll be back more often. Even if I can't convince you to come back before 2060, when another 74 years will be up, I'm confident the Kalispell and Flathead Lake area will do the persuading for me. In recent weeks, I've made a number of speeches around the state pointing out just how wrong the revenue projections in Montana's state government made in April of '85 were when we came to April of '86. Since the middle of this month, Montana's legislators have been in Helena struggling to balance a state budget that, by the end of fiscal year '87, threatened to be some $88 million in the red. Other western states reliant on natural resource and agricultural economies have found themselves caught in the same deflationary spiral. The "window of opportunity" I proposed and the 1985 Montana Legislature passed, couldn't have been opened at a more difficult time. What was envisioned as an incentive to expand Montana's coal production, and our tax base, ran aground on low oil prices and excess hydroelectric power. De- spite the one-third severance tax rebate offered on new coal production, year-to-date figures published in the June 2nd Coal Week show that production in Montana is down almost 10 per- cent from last year. Again, we're not alone. Production in Wyoming is down 8 percent and in North Dakota, it has dropped 13 percent. An over- all 3 percent production decline in western states looks even worse when contrasted against a 12 percent increase for your eastern competitors. Montana's "window of opportunity" had the potential to be a significant signal to your industry. That potential was quickly tempered by the inability of Arab nations to stabilize world energy prices. If any of us had forgotten, the last twelve months have reminded western states that the well-being of our natural resource economies has a tremendous impact on the ability of all levels of government to provide services. The past year has also driven home that in the world of business and in the business of the world, risk-taking is still the name of the game. The Western Governors recognize the problems facing this industry - and our states - and we're prepared to fight for the future of western coal. In the past two decades, legitimate environmental concerns have created a vast body of new legislation affecting coal producers. The industry has been required to meet new reclamation standards - tough regulations relating to ground water, air quality and wildlife habitat. To the industry's credit, coal companies have hired professionals with the technical know-how to do it right. Rather than considering reclamation laws to be an unreasonable burden, today's coal company is more likely to view its reclamation efforts as a source of corporate pride. In a sense, the industry and the agencies which regulate it have matured together . . . although at times OSM is reluctant to admit that either of us capable of or willing to play by the rules. Certainly some abuses exist and OSM's oversight has been helpful in ensuring parity between those states willing to comply and those that would rather defy federal law. Nonetheless, penalizing the more modem and responsible western coal industry for abuses that occur elsewhere is both unfair and counterproductive. Federal penalties range from "cruel and unusual" reporting requirements to the proposed electricity tax that would effectively force utilities and ratepayers who have already met the sulphur emission standards to subsidize those who have dodged their cleanup responsibilities. Profiled on these pages are the eight RMCMI 1994-95 Scholarship Award Winners. Six of the eight winners were present as guests of the Institute at the June convention in Crested Butte, Colorado. Each received recognition at the Institute Awards Luncheon Monday. June 26, 1995. Each state vice president served as the host for the collegiate winner. The first and last winners - Arizona and Wyoming - were absent. Besides receiving a plaque from the Scholarship Chairman, Alan Czarnowsky, each winner receives $750 tuition credit for the coming academic year, as well as transportation, hotel lodging and meals at convention as guests of the Institute. This latter portion is paid by each state vice president. Because this is a continuing award, the winners from the previous year also receive a second $750 for tuition credit in their senior year. A resident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards to be made in the spring annually is that the recipient (1) Is a full time sophomore student who will use the tuition credit during the junior year. (2) Be both a U.S. citizen and a resident of the member state. (3) Maintain good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than in the mining departments, but in engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholarship program. A listing of current donors is found elsewhere in this book. [ ] ARIZONA WINNER Brad Carroll University of Arizona - Tucson, Arizona Brad Carroll's hometown is Tucson, Arizona but his summer work is in Oriskany Falls, New York where he is a quality control technician, truck driver and equipment operator for the Eastern Rock Products. Brad served as vice president and treasurer for the SMWAIME student chapter at the University of Arizona for the past three years He was assistant and mine foreman at the San Xavier Mining Laboratory near Tucson. Upon graduation Brad plans to find a job in a southwest mine. He is a totally self supporting student. [ ] COLORADO WINNER Zane Znamenacek Colorado School of Mines - Golden, Colorado Zane Znamenacek hails from a small town in Colorado - Alamosa - where he 4 was a 4.3 GPA in high school. As a student at Colorado School of Mines, he has many hobbies to ease the tension of education. Foremost among these is skiing, mountain biking, billiards and spring rugby. He hopes to further mining technologies and contribute to the industry by working in it full time. In 1997 he will pursue whatever opportunities are available to graduating mining engineers

Gentlemen and guests of the Rocky Mountain Coal Mining Institute: This is the thirty-second regular meeting of our Institute, and rather than try to make some extemporaneous remarks, I thought it best to write them out, so I could in that way give them to you, and probably give you a new thought for the future conduct of our Institute. The thirty-first regular meeting of the Rocky Mountain Coal Mining Institute was held in Salt Lake City, June 22, 23, and 24, 1932, and due to rapidly changing conditions in the coal industry, subsequent meetings have been postponed from time to time, as many of our members and our Secretary have been tied up with code and labor matters. Since our last meeting, at which was discussed problems of vital interest to all of us, especially the production and marketing of coal safely and economically, and the stabilization of our industry, which has already suffered two years of deplorable conditions, almost two more years have been added to the record, but during the past six months miracles have happened, and an industry which formerly was unable to govern itself, has now, through the aid of our Government, at least learned how to make a proper start in that direction. Whether we like it or not, and whether or not the things being done are in agreement with our various political beliefs, without doubt, we are in a much better position today than prior to this transformation. However, it is a pleasure to all of us to note that safety has not been lost sight of in the interim, and without doubt, as later papers and statistics will substantiate, the period since our last regular meeting has probably shown the most remarkable safety achievement of any period in recent history.

Mr. Chairman and Gentlemen: Some of you men may know who are familiar with what we have been doing in the C. F. & I. the last three years, that we have revamped our entire method of cost accounting from the pit bosses' report through to the final report of the president. The basic ideas involved in our cost system are not ours. They were given us by one of the best management and industrial engineering concerns in the country-at least they have that reputation. All I can do now is to try to pass on to you some of the ideas we have from various sources and the methods we have used in teaching those ideas to our coal men on cost accounting. This will not be a technical paper. I tried to put it in language we could all understand, and I hope I will be talking the same language that you gentlemen talk when you think about the cost of your coal in your own mines. Accounting of all kinds is classed as overhead expense, and as overhead expense we must justify its cost by the service it gives the rest of the organization. That brings us up to the problem of making the cost department pay its own way, just the same as the power plant has to pay its own way, and we have gotten away from the old idea of cost accounting in that it is sufficient within itself. The cost sheets are only so good as they enable the operating man to reduce his costs. The cost sheets are only just so much work for the cost department, and if they do not help the operating man to control his costs, we figure that is so much work wasted. The cost department works for the operating department.

Discussion was prepared by A. L. Jones and Frank A. Rank, of the General Electric Company, read by Mr. Jones; by C. B. Officer, of the Sullivan Machinery Company, read by Mr. J. H. Emrick; by Mr. D. C. McKeehan, Chief Electrician of the Union Pacific Coal Company; and by Mr. L. C. Ilsley, of the United States Bureau of Mines, read by Mr. K. P. Marshall. Their prepared answers are inserted in the body of Mr. Harrington's paper, as answers to his questions. Introductory Remarks PRESIDENT MARKS: We have made special assignments for the discussion of this paper, and I believe these discussions are to be answered in sections, and as the different sections are read applying to this paper, we will just have a brief discussion on that particular point and proceed to the next and try and expedite this discussion as much as possible, be- cause I realize a good many of you have something to say. The first discussion is by Mr. Frank A. Rank, of the General Electric Company, Salt Lake City. MR. F. A. RANK (General Electric Company, Salt Lake City, Utah) : Mr. Chairman, while my name has been put on the program as being the one to discuss this paper, I believe Mr. Jones of our company has prepared a discussion on it, and therefore will let him talk in my place. MR. A. L. JONES: I think that it is passing the buck. However, Mr. Rank sent me a copy of the paper, and I read it over with a good deal of interest. There is one thing I want to say: Mr. Shubart, in his breezy letters, stated this paper was to be written by Mr. Harrington, assisted by a number of manufacturing and operating companies, among them the General Electric Company. We did not function. The paper was completed, and we were not consulted, and I believe that is true of the others. After reading the paper over, I dictated a few notes which I want to read, to give you the view-point that we have on the subject We do not want to minimize electrical dangers, or in any way slow down high-grade construction maintenance, but there is such a thing as overstating the case. The 66th Regular Meeting of the Rocky Mountain Coal Mining Institute convened in the Opticon Theatre, Snowmass-at-Aspen, Colorado, and was in session at 10:00 a.m. The meeting was called to order by Past President, Stanley C. Shubart, Secretary-Treasurer, Schloss & Shubart, Inc., Denver, Colorado. Mr. Shubart welcomed the guests and was pleased at the large attendance, in view of the fact, that the site for the convention had to be changed at the last minute from the Stanley Hotel in Estes Park to Snowmass-at-Aspen. He stated that Joe Ward, our General Chairman, could not be present due to the serious illness of his wife, Thelma. He called on Bob Wilson, Chairman of the Registration and Hotel Committee, to give his report on applicants for membership since the last meeting. Mr. Wilson stated that there were 89 applicants and 242 registrations, an all-time record. A list of new members follows.

The 74th Regular Meeting of the Rocky Mountain Coal Mining Institute convened at The Mark Conference Center, Lionshead Village, Vail, Colorado, and was in session at 10:00 a.m. Past President, Ralph Moore, Vice President, Operations, Westmoreland Resources, Hardin, Montana, called the meeting to order. The membership was asked to stand and pledge allegiance to the flag. He welcomed members and guests and thanked Park Lamborn, the Program Chairman, for the excellent speakers and program he engineered. He mentioned the cancellation of our golf tournament due to the conflicting dates with the Annual Jerry Ford Invitational Golf Tournament. He thanked all of the committees with a special "thank you" to Loren Linville and Gussie Whiteside. He introduced President, Shirl C. McArthur. President and General Manager, American Coal Company, Huntington, Utah. A biographical sketch follows: Mr. McArthur, a native of Huntington, Utah, began his coal mining career shortly after graduating from North Emery High School and worked his way up through the ranks, having worked at every job available underground. For example, he dug coal with a "banjo" at the Independent Coal and Coke Company in Kenilworth. In the summer of 1941, he worked at Straight Canyon Mine as a timberman and advanced to section foreman in four years. He was face boss for part of the time. In October 1946, he received a call from the LDS Church General Welfare Board (presided over then by Marion G. Romney) and took over as superintendent of the Church Mine. He operated in that capacity until the mine became privately owned in 1971. In 1961, Mr. McArthur formed Castle Valley Mining company, and in 1970, he organized American Coal Company, which he presently owns and operates.
