Thank you very much for that introduction. I spent part of my early career in the coal industry here in Colorado, and I am always happy to return. In such a beautiful setting, it seems out of place to talk about "Improving the Climate". But in our work-a-day worlds, we know the climate for the coal industry is something less than picture perfect. But unlike Mother Nature's climate, there are some things we can do about the climate for coal. Today, I want to talk to you about sonic of the activities that we are engaged in... and that you can support... to improve that climate. A number of challenges and opportunities face our industry. I will try to set the stage for this conference by briefly describing the current climate for coal - which is indeed very challenging. I will then outline some of the steps we are taking to broaden our base to include our allies in the rail and electricity industries and the public at large.

Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,

Monday, August 29, 1927, in the County Court House at Trinidad, Colorado, the Vice-President, F. L. Peart, presiding. After a few words from John F. Carmody, Editor of Goal Age, J. Q. McNatt, Division Engineer of the Colorado Fuel & Iron Company, read a paper on "Coal Geology." In the afternoon, Prof. C. B. Carpenter, of the Colorado School of Mines talked on the work in Fuel Engineering being developed at the Colorado School of Mines. W. C. Holman, of the Phelps Dodge Corporation, then read his paper on "Developing a Pit Car Design." L. M. Kuhns, Safety Engineer of the Gallup American Coal Company, read his paper on "Safety Methods at Gallup American No. 5 Mine." After discussion the meeting adjourned for the day.

A facetious title was purposely given this talk, so that a formal paper would not be expected. TWO or three days ago, while discussing with Mr. Dickinson some of the details of the dust explosion demonstrations we are planning for this coming Saturday, I remarked that we would like to have as many people as possible see some samples of 20 and 200 mesh dust, so they would more fully understand just what was causing the explosions. Mr. Dickinson requested that I bring samples and screens and in this informal manner, give you all a ".close-up" of coal dust which is considered in Explosion Hazard reports. While sampling mines, for road, rib, and roof dust, in connection with safety service and hazard reports which the Bureau of Mines Engineers make at the request of coal operators, I have often been assisted by under- ground mine officials or other men of many years experience and on almost every occasion, while we were carefully brushing the very fine dust from timbers or coal surfaces, they would make some remark such as: "never had noticed this kind of dust, didn't know it was here", or "well, that's the first time I really understood what all 'this dust talk was about." Such experience makes me believe that the much published terms, 20 mesh and 200 mesh are just numbers to the great majority of both miners and operators. We are now going to have lesson one in the primer of coal dust explosions and I want to say, in all sincerity that a complete course in the hazards of mining is deserving of a place in the curriculum of the best mining schools of this country. Sample No. 1 is fine coal and dust and is a fair sample of what can be found every where in rooms and entries of a mine, as it is too small to be gathered up with a shovel and is left in the ordinary mining at the faces and is spilled along the entries in haulage. In this you will see some quarter inch coal, much eighth and sixteenth inch coal, in fact those are the sizes I find many people have in mind when they are asked about the dust made in mining. Although the sizes mentioned are the ones which seem to almost entirely make up this sample, such is not the case, for from 10 to 20% of such a sample will usually pass this 20 mesh screen and in Sample No. 2 we have 20 mesh dust. Result of many tests, supports .the statement of the coal mining division of the Bureau, that it is quite probable that coal over 20 mesh does not take part in any but the most violent of explosions and that all dust under 20 mesh may take part in any explosion. The largest particles in this sample will not be over .03 inches in their largest dimension and a pound of dust to a foot of average heading is very easily found in most every mine I have visited and usually a great deal more can be readily gathered up. It was .found early that the finer the dust the more dangerous it was for a given coal. So for the early explosion tests conducted by the Bureau a commercial pulverizer was used and it turned out a 20 mesh dust of which about 75% would pass 200 mesh. Some men question whether the ordinary mining methods made such a dust and so doubted the explosibility of the dust in their own mines. The question was well taken, and hundreds of dust samples were taken by the field men of the Bureau to determine the kind of dust being made in all methods of mining and all classes of coal. The result of such sampling showed some coals. resisted breakage more than others and that actual mine road dust, through 20 mesh, would show from 10 to 20% through 200 mesh, and for actual rib and roof dust through 20 mesh, they would get from 20 to 40% of 200 mesh dust. The Wednesday morning session was opened by President Joe Ward at 9:30 a.m. He complimented Walter Mueller, Program Chairman, for the excellent job he did as head of that very important committee. He also thanked all those on the various committees, speakers, and all who participated in making the 1972 meeting a success. He called on William S. The morning session opened at 9:00 a.m. and was presided over by Mr. Don Ross, Manager of Mines, Kaiser Steel Corporation,- Sunnyside, Utah. The first speaker was Mr. S. W. Zanolli, Partner in Law Firm of Webster and Kilcullen, Washington, D.C. Mr. Zanolli was born and raised in a coal mining community of Fredericktown, Washington County, Pennsylvania. He was educated at Washington and Jefferson College and graduate schools of the University of Pittsburgh. He served as an infantry officer in the European Theatre of operations during World War 11. He worked as' a handloader at Vesta No. 5 Mine of Jones & Laughlin during summers while attending Washington and Jefferson College. He worked at a variety of production jobs at No. 7 Mine. of Island Creek Coal Co. of Holden, West Virginia. Assigned to a variety of industrial relations assignments at Island Creek Coal' Company during 1949-51, attaining position of Supervisor of Personnel and Labor Relations. Served in many industrial relations assignments at U.S. Steel Corp. headquarters during 1953.-1967, attaining a position of Personnel Director-Heavy Products Operations. In January, 1968" he became a member of the Bituminous Coal Operators Association-as Executive Vice President. This past year he went back to practicing law and is a member of the Law Firm of Webster and Kilcullen, Washington, D.C. He is married and has five children.

Members of the Institute: It is with great pleasure and honor that we welcome you to the thirty-ninth regular meeting of the Rocky Mountain Coal Mining Institute. I assure you that Mr. Krippner, the General Chairman, and his associates have an outstanding program in store for you, and trust it will be of much interest to the industry. I note by the program they have me slated for an opening address, but I am going to defer that, proceed with the remainder of the program, and endeavor to go on schedule and keep matters on schedule as outlined on our program. The first item on the program is the reading of the minutes of the thirty-eighth regular meeting by the Secretary. I might say that it has been customary in the past that we omit the reading of the minutes. If that is not agreeable, we will read them; otherwise, I would like for someone to make a motion that we dispense with the reading of the minutes, inasmuch as they are published in our annual report each year. What are your wishes?

The Wednesday morning session was opened by President Max Robb at 9:30 a.m. He thanked the various committees, speakers and all participants in making the 67th meeting a success. He called on David M. Lane, Chairman of the Auditing Committee, to give his report. He read the report and asked for a motion to approve it. Motion was made, seconded and approved. At the meetings of this Institute held two years ago, there was presented a very comprehensive paper on the subject of shearing coal. It was well prepared and contained data based upon actual test and experiment. The conclusions reached showed that where the shearing cuts and tests were made and conducted [ ] there was no advantage but a disadvantage from having sheared the coal. In presenting my ideas on the subject of this paper to you, I do not mean to take issue with the author who addressed you two years ago but only to report the advantages which have recently been secured from shearing coal. All of this goes to prove again the well known fact that what one mine's conditions will permit another's will not. A number of years ago, when most of the coal produced was shot from the solid and when the "good, old" pick miner?s pay was based on the amount of lump coal he loaded out of his room, he was frequently seen putting in a vertical cut in the face as deep as he could do so with his pick. This man was the best ac- [ ] quainted with the peculiarities of the coal and, no doubt, saw that his pocketbook would be fattened more if he put forth the extra effort to make this vertical cut. Fortunately he was well repaid, and his employer loo, on account of the greater percentage of lump produced. We all deplore the high accident rate of our coal mines, but when brought to task we immediately attempt to appease our conscience by calling attention to the high tonnage rate per fatality in American coal mines as compared to European mines, losing sight of the fact that the accident rate per hours of exposure has shown no improvement during the past twenty years. Measuring our accidents in terms of hours of exposure, not in terms of production, is the only correct method. Certainly it can be of only scant satisfaction to the miner to know that his chances of getting killed this year are as great, or perhaps greater, than last year, but the tonnage rate per fatality will have gone up. We cannot help asking ourselves why it is the other major industries, almost without exception, have made wonderful strides toward reducing accidents, while coal mining stands alone as the one major industry in which no improvement has been made. It certainly cannot be charged entirely to the increased use of machinery and the increased productivity per man employed, as the other industries likewise, or to an even greater extent, have increased the use of machinery and the production per man.

The session adjourned at 11 :50 a. m., in order to attend the organ recital at the Tabeknacle at:'12 o'clock. JUNE 11-AFTERNOON SESSION The meeting. Gas called -to order at 2 o'clock, with President E. H. Weitzel in- the .chair. The minutes of, the organization meeting and that of the Executive Board, the 1atier:of which was held April 15, 1913, in Denver, were read and both' approved. A letter from A. 3. Reef, of Denver, containing proposed amendments to the Constitution and By.-Laws, was read, and, upon motion,, was referred to the Executive Board, with .instructions to report upon the matter at the next, regular meeting. The proposed amendments follow: Article I1 (regarding who may become members and how) to be amended to read as follows: "Membership in this Institute shall be of three classes-corporate, individual, and honorary. Any company, firm, or individual operator actually engaged in the mining of coal within the territory of this Institute may become a corporate member on application, and by consent of a majority of the members present at any stated meeting. Any person, who is directly engaged or interested: in some branch of coal-mining may become an individual member upon application, and by consent of a majority of the members present at any stated meeting. Honorary members may be elected at the discretion of the Institute."

The Morning Session of the Forty-Eighth Meeting of the Rocky Mountain Coal Mining Institute convened in the Little Theater of the Broadmoor Hotel, Colorado Springs, Colorado, at 10:00.a. m.; June 2, 1952, Howard B. Crandell, President, presiding. PRESIDENT CRANDELL: Gentlemen, the meeting will come to order. I presume most: of you have heard the decision of the Supreme Court in the steel case. The decision was six to three that the President had no legal authority to seize the steel industry, and it is reported that the strike is already under way. Gentlemen, it is both a pleasure and an honor to talk to you who come to the meeting of the Coal Mining Institute, many of you, from long distances. Our program committee has suggested that the president give a 30-minute talk, but you may be at case because I assure you I won't take anywhere near that long, when we will pass to more instructive and enlightening subjects. Another reason for the short talk that I am going to make is that many men in this audience know more about coal mining, specialized subjects, than I do.
