Introduction The impact of the Comprehensive Environmental Response, Compensation, and Liability Act, or Superfund, as well as the Resource Conservation and Recovery Act (RCRA) and their state counterparts underscore the intention of the nation's lawmakers to reduce the risk from hazardous substance to American society. The promises and requirements embodied in these laws, together with their prospects for liability, will continue to have a very substantial impact on decision making in the mining industry. These laws present the prospects for staggering liabilities, often of an unquantifiable nature in terms of time and amount. It is therefore necessary to keep them in clear focus. This is particularly true in light of President Reagan's signing into law the Superfund amendments on Oct. 17, 1986, and in light of the Environmental Protection Agency's (EPA) major policy pronouncement of July 3, 1986, regarding solid wastes from extraction of ores and minerals. This article examines the general trends as well as the specific provisions of these laws in an effort to assess the prospects of liability for the mining industry of releases of hazardous substances into the environment. Hazardous substances vs. hazardous wastes The distinction between the terms "hazardous substances" and "hazardous wastes" is important to appreciate for the purposes of assessing the potential for liability for a mining operation. Hazardous substance is a term that appears in and is defined in the Superfund Act. In Superfund, it is defined by reference to other substances that have been declared to be hazardous under other federal environmental statutes, such as RCRA, the Clean Air Act, and the Clean Water Act. Hazardous waste is a term that is less all-encompassing than hazardous substance, as that term is defined by RCRA. Hazardous substances do not need to be wastes to be considered hazardous for the purpose of Superfund liability. A "release" of a hazardous substance into the environment can bring about potential liability under Superfund. Many mining wastes, even though they are not considered hazardous wastes by EPA under RCRA, have been determined by that agency to be capable of bringing about liability under Superfund if they contain chemical substances, such as the heavy metals copper, lead, mercury, zinc, silver, and others. Therefore, it is not sufficient for the mining industry to be able to answer whether one has hazardous waste at a mining site. That question only goes partway in addressing the potential for liability. The next question is, do one's solid or liquid mining wastes contain hazardous substances that could bring about liability under Superfund? Superfund 1980 law: A review Some provisions of Superfund as it existed before its recent amendments must be considered. The law provides that the owners and operators of mining sites, together with those who transport hazardous substances to such sites, can be held jointly and severally liable for the cost of cleaning up the site. The concept of joint and several liability means that one party, as among many, can be held totally responsible for the costs of cleanup. "INTRODUCTIONTeck-Corona Operating Corporation's David Bell Mine is located 35 Km east of Marathon, Ontario. In conjunction with its 1000 tonne per day gold concentrator, the company operates an effluent treatment plant for the treatment of mill, mine and site effluents prior to environmental discharge. This paper provides a brief overview of treatment strategies and methods, employed to detoxify final effluent.WATER MANAGEMENTThe tailings impoundment basin, located 3 Km south of the plant site, provides storage capacity for all process effluents and site run-off. Basin supernatant (reclaim water) is recirculated to the plant for reuse as process water, in order to minimize fresh water consumption. As site run-off and limited fresh water intake exceed natural losses due to evaporation, reclaim water in excess of process requirements is passed through the effluent treatment (ET) facility to control tailings basin level by providing regulated discharge of environmentally acceptable effluent. (Figure 1)PASSIVE TREATMENTTo reduce treatment costs and burden on the ET facility, reclaim water is fed to the plant to take maximum advantage of natural destruction processes occurring in the tailings basin.These include: volatilizationphotodecompositionbiological oxidation and precipitationstorm water dilutionConcentrator recovery techniques (Figure 2) are directed toward maximizing gold recovery while limiting the addition and extraction of contaminants requiring disposal and eventual treatment.Currently ore ground to 90% -200 mesh is pre-aerated at pH 9.0 with lime for 18 hours prior to 30 hours cyanidation at pH 9.5 with low cyanide ion excess (70 ppm).Pre-aeration passivates cyanicides prior to cyanide contact. This reduces cyanide consumption and the formation of cyanide complexes. In conjunction with recovery requirements low pH is maintained to retard the dissolution of stibnite into its antimony and sulfide components."

The quarrying and related industries of the United States improved their safety record in 1938 by reducing their accident-frequency rate to a lower acid more favorable position than it has occupied at any time except 1935 since comparable accident statistics became available in 1916. The rates for 1935 and 1938 were identical. The number of men employed in 1938, although smaller than in 1936 and 1937, was larger than in any other year since 1930. Volume of employment, as measured by the number of man-hours worked in the industry as a; whole, likewise was larger than in any year since 1930 except 1936 and 1937. Reports from operating companies to the Bureau of Mines, United States Department of the Interior, showed that 77,497 men were employed in 1938, a decrease of 6,597 compared with 1937. This figure represents the average number of employees for the period during which the quarries and plants were active during the year, which in 1938 averaged 223 workdays per employee compared with 241 in 1937. A total of 17.3 million man-days or 133.8 million man-hours of work was shown for the industry as a whole, which indicated a weighted average of 7.75 hours per man-shift. Reports for 1937 showed a total of 158.3 million man-hours for the entire industry and an average workday of 7.81 hours. Accidents resulted in the death of 82 employees, 5 more than in 1937, and in 5,027 nonfatal injuries involving disability for more than the remainder of the day on which the injuries were received. The number of nonfatal injuries was 1,321 less than in 1937. As the number of deaths and injuries was reduced more, proportionately, than man-hours of employment, the accident-frequency rate per million man-hours of work declined, the rate for 1938 being 38.19 compared with 40.59 for 1937. In other words, accident occurrence to the average employee was 6 percent more favorable in 1938 than in 1937 on the basis of actual number of accidents and actual number of man-hours worked during the 2 years.

The Narragansett Bay Commission (NBC) is a regional sewer authority that serves ten communities in the Providence, Rhode Island metropolitan area. From 1992 to 1999, the NBC developed a comprehensive facilities plan to abate Combined Sewer Overflow (CSO) pollution in the Upper Narragansett Bay. The plan underwent many major evolutions during this period, most notably the addition of a stakeholder?s process by which NBC demonstrated a site-specific plan to control the pollutants and meet water quality standards. The favored solution consisted of deep tunnel storage with treatment at existing wastewater facilities that had been recently upgraded. In 1999, a final plan was accepted which included two tunnels, five CSO interceptors, twelve sewer separation projects, a wetland facility, and a wastewater treatment facility upgrade. The program is to be constructed over 20 years in three sequential phases (Figure 1). Phase I of the program includes a 4,963 m (16,284 ft) long, 7.9 m (26 ft) diameter, 70.1 m (230 ft) deep storage tunnel; seven drop shafts with connecting adits; ancillary facilities; and a pump station. Construction of Phase I began in 2001 and is expected to be operational by October 2008. This paper focuses on design and construction of the Fields Point Tunnel Pump Station (FPTPS)located at the south end of the main spine tunnel. A189 Ml/day (50 MGD) pump station is required to lift CSO flows from the tunnel to the Fields Point Wastewater Treatment Facility (FPWWTF). The pumps are to be housed in a 35.6 m × 18.6 m ×20.7 m (117 ft × 61 ft × 68 ft), 91.4 m (300 ft) deep cavern excavated in a complex meta-sedimentary rock of the Rhode Island Formation, and connected to the surface by 9.7 m (32 ft) and 3.4 m (11 ft) diameter shafts. Factors which influenced selection of the size, configuration and location of facilities included the preferred arrangement of pumps, critical aspects of site geology, and estimated cost. Technical and value engineering reviews also affected the final design. Following Notice to Proceed (NTP), concerns were raised by the contractor regarding constructability and design. Additional geotechnical investigation and independent engineering review were employed to validate the design assumptions. The cavern was successfully excavated and sup-ported in rock, completed on schedule and within budget in 2005. In 1992 the NBC retained Louis Berger Group (LBG) as Program Manager (PM) for the CSO Abatement Program. LBG thereafter formed a design team including: Jacobs Engineering Group(JEG) as the designer for underground structures and near surface collection facilities; Black and Veatch(B&V) to design the pumping system and associated facilities; Haley and Aldrich (H&A) to oversee the geotechnical program; and Malcolm Pirnie to design the system-wide instrumentation and control system. Construction management, resident engineering, and inspection services were provided by the joint venture Gilbane/Jacobs Associates (G/J).

The Al-Zn-Mg alloys (e.g. 7004, 7020) are employed for land transport and architectural applications whereas the Al-Zn-Mg-Cu alloys (e.g. 7075, 7050) provide the high strength aircraft alloys. The Cu gives rise to suitably sized and distributed precipitation but causes high quench sensitivity. Their hot work processing also has marked differences; the Cu-free alloys have good extrudability whereas the Cu-bearing alloys have low extrudability and are difficult in rolling as well. The behaviors of the two classes are described in terms of flow stresses and ductility over 300 - 500°C, along with constitutive contrasts. The ductility of the alloys with Cu is much reduced above 400°C by precipitation of a phase at the grain boundaries that can be avoided by suitable heating schedules. The high strength alloys are subject to de-lamination corrosion of sheared edges due to severely pancaked grains; this can be alleviated by holding between passes, in mid-rolling schedule. In torsion tests at 10-1 to 10 s-1/ 250 - 500°C, the stresses (ductilities) at 300°C/ 1s-1 and activation energy Q for 7004 were 118 MPa (2) and 262 kJ/mol. The 7075 was tested after several pretreatments: completely over-aged (softened): 107 MPa (5), Q=150 kJ/mol; whereas, solution and quick cooling to testing caused extraordinarily high peaks related to dynamic precipitation resulting in 160 MPa (1.2), Q=300 kJ/mol.

An incremental analysis based stope design optimization method was developed at Exodus, an underground project located 30 miles north of Carlin, Nevada. Traditional underground stope design methods, by manually drawing stope shapes, are typically very time-consuming and lacking of consistency and accuracy. For quick reserve calculation and economic analysis, a new method named '3D Incremental Analysis based Stope Optimization' was created for mine wide stope designs at Exodus. With this unique but practical method, multiple options of mine designs were completed within a short period time, which allowed us to select the optimal cutoff grade and best stope design option for the project.

The Monotube is a uniformly tapered high-strength steel shell pile manufactured for friction pile applications. The Monotube pile was developed in the early 1920's in Canton, Ohio. Its first commercial installation was an Ohio railroad trestle in 1926. The Monotube has been manufactured in the same Canton plant since its inception. The Monotube is produced in four diameters, 12, 14, 16 and 18 inches, with U. S. Standard Gage wall thicknesses of 9, 7, 5 and 3. The uniformly tapered Monotube section can be manufactured in one of three rates of taper.

A series of controlled experiments was conducted at four surface coal mines to study the effects of certain blast parameters upon the ground and air vibration. Preliminary scale-model blasts were conducted at a quarry to provide basic data. It was found that the amplitudes of the ground and air vibration were controlled by the maximum explosive weight per delay. Either cube root or square root scaling could be used for the seismic amplitudes, and cube root scaling could be used for the overpressure amplitudes. Both amplitudes were not significantly affected by the total charge weight per blast, the attitude of the boreholes, or the charge length or diameter. The overpressure amplitudes were affected by the charge depth, the use of cover over surface detonating cord, and the use of adequate stemming. The length of the delay intervals and the spacing of holes were important in determining' the potential fur reinforcement of the amplitudes in certain directions from the blasts. In downwind directions from the blast, the attenuation of the overpressure with distance decreases. Surface terrain did not significantly affect the overpressure amplitudes within the range investigated. The type of overburden affects the generation of both amplitudes and the propagation of the seismic amplitudes. Spectral analysis of the ground and air vibration is reported. A bibliography of pertinent literature is included as an appendix. A scaled distance of 300 ft/lb1/3 should produce a peak particle velocity of less than 1 ips and an overpressure of less than 128 dB linear peak. For square root scaling, a scaled distance of 75 ft/lbl/2 should limit the ground vibration to less than 1 ips.

Cable reel systems for shuttle cars were investigated to determine whether an improved system could be identified. Interviews and mine visits were conducted to better define limitations and problems with present systems. Although simple and relatively inexpensive, present cable reel systems are not fully satisfactory. Several concepts for a different technical configuration were formulated and evaluated. An all ectric system using electronic control and external sensors was recommended for further development.

During and immediately following World War II, the heavy demands for steel required the mining of unusually large quantities of coal for the manufacture of metallurgical coke. The largest demand for metallurgical coke is in the Appalachian region, which comprises central and western Pennsylvania, Maryland, West Virginia, Virginia, eastern Kentucky, Tennessee, and Alabama. This demand is satisfied by coke made from coals within the region; consequently, the reserves of coking coal in this region are being depleted more rapidly than reserves in other coal-producing regions. The supply A' high-quality coking coal during the war was inadequate, and some coke were forced to use inferior coals. The coke produced from these inferior coals adversely affected the rate of production. Another national emergency probably would produce a similar condition, and in the interest of -national security, the Munitions Board of the National Military Establishment requested the Bureau of Mines to evaluate the reserves of coals suitable for the manufacture of metallurgical coke. All bituminous coals in the Appalachian region are coking, and as the coal that produces the better metallurgical coke become depleted, other coal previously considered inferior will be used. The general trend is toward the use of lower-quality coals for metallurgical purposes.

"Deposits of gray hematite occur in two districts in Talladega County, Ala., the Emauhee-Tallasochatchee and Weewoka, both in the vicinity of Winterboro, 50 miles east of Birmingham.The deposits were investigated by the Bureau of Mines in 1943 and 1944. Approximately 13,000 feet of diamond drilling was done and 6,000 linear feet of trenches excavated and sampled.A total of 13,000,000 tons of ore averaging 36 percent iron was indicated in all areas.A detailed discussion of each property investigated, drill logs, and sampling results are given in this report.In the work done in the Talladega County iron investigation, special acknowledgement is due to Paul M. Tyler, formerly regional engineer, Eastern Region, and Richard W. Smith, formerly district engineer, for aid and direction of the project; also to J. B. Clemmor, metallurgist, for diligent research work in the Southern Experiment station laboratory. All were members of the Bureau of Mines Staff.The project was conducted in cooperation with the Federal Geological Survey, whose field work was in charge of T.G. Andrews assisted by Brewster Baldwin. The able and valuable assistance of Andrews and Baldwin aided greatly in accomplishing the project.The areas investigated by the Bureau of Mines were in two districts: The Emauhee-Tallaseehatchee district, between Sylacauga and Sycamoer (marked B on fig. 1) and the Weeworka district, between Winterboro and Sycamore (marked A on fig. 1)."

The National Institute for Occupational Safety and Health (NIOSH) Pittsburgh Research Laboratory (PRL), RAG Pennsylvania and Strata Control Technologies of Australia collaborated in an intensive study of ground behavior, reinforcement performance, and stress redistribution at the Emerald Mine in Southwestern Pennsylvania. The study site was a longwall tailgate subjected to a severe horizontal stress concentration. Field measurements indicated that the stresses applied to the study site nearly doubled during longwall mining, resulting in roof deformations extending to a height of 4.8m (16 ft) above the entry. A computer simulation of the field site was conducted using FLAC-2D, incorporating a broad range of rock behaviors and failure mechanisms. Comparison between the measurements and the simulation showed that the model was able to capture the most significant aspects of the roof and support system behavior, particularly, the extensive slip along bedding that created a partially destressed "softened" zone in the immediate roof. The model also showed that supplementing the normal roof bolt support pattern with cable bolts would allow the entry to survive a further 20-25% increase in the applied horizontal stress. Such information could have very practical application to the design of roof support systems for coal mines.

If a conductor traversed by an electric current is broken, a conduction forms in the air between the two broken ends of the wire. This conduction manifests itself in an initial phase by an electric spark and, in a second phase, by an arc if the the circuit continues to supply sufficient power. This arc goes out when the distance between the two ends of the conductor becomes sufficiently large. If the break occurs in an explosive atmosphere, the energy contributed by the arc can cause an explosion. To avoid such accidents, electric circuits that may be utilized in hazardous atmospheres can be made "intrinsically safe". The investigation which we conducted is part of a research project on the intrinsic safety of arcs of high intensity but short duration, in the case of resistive circuits. We developed an electronic system which makes it possible to limit the duration of an arc at the level of the break of a conductor traversed by a current with a possible maximum intensity of 80 amperes. This experimental device for monitoring and measuring the parameters of the arc has shown that arcs of high intensity but with a duration limited to a few microseconds do not ignite an explosive methane-air mixture.

The U.S. Bureau of Mines and Cyprus Shoshone Coal Corp. conducted a study of deformation mechanisms in strata around a longwall gate road system at two sites in an underground coal mine near Ham, WY. Of particular interest was timedependent (on the order of several months) roof deformation. Strata above and below the coal seam are very weak, carbonaceous mudstones that have cohesionless planes of weakness oriented along bedding, which dips approximately 8° to 16° at N 49° E. An extensive array of instrumented roof bolts, roof extensometers, and biaxial stressmeters were installed during development mining at these two sites under variable depth of cover [I83 to 335 m (600 to 1,100 ft)], seam dip (10° to 16°), and top coal thickness [estimated to be 0.30 to 0.61 m (1 to 2 ft) on the downdip side of the entry]. Bolt load and roof deformation histories during the entry development periods were compared. Bolt loads at site 2 were less than those at site 1, which is consistent with the amount of overburden. Deformation magnitudes at site 2 were similar to those at site 1, but deformation rates were approximately 44% greater and nearly constant over time, whereas the deformation rates at site 1 decreased exponentially over time. Also, most deformation occurred above the bolt horizon at site two, but extensometer measurements at site 1 showed that a significant amount of deformation occurred within the bolt horizon. The most significant factor that influenced bolt tension and timedependent strata deformation was strength and Young's modulus of the strata. Finite-difference models support this conclusion.

A study of the various components contributing to energy costs and their relationships to generally trended operating data, such as tonnage, operating costs, etc., over progressively shorter time periods provides information for an energy audit. A study of annual data gives some insight into the importance of various energy components. As the time frame of the study progresses through monthly, daily and, finally, into quarter hourly data, the variations become more evident and, most important, strategies develop to minimize energy costs. The results of an audit conducted during the summer of 1978 at Wesfrob Mines Limited are reported to illustrate this important phase, prerequisite to a meaningful energy cost avoidance program. The balance of the paper deals with the energy conservation program at Falconbridge Nickel Mines Limited's Sudbury operations, the metering and control equipment, the commitment, the new energy accounting practices and, lastly, the policies. Examples of successful energy conservation endeavours include automatic peak electrical load control, waste heat recovery from mine air and compressor cooling water, energy reductions resulting from lower building temperatures and curtailment of idling loads. The use of pulse meters to measure the flow of gas, steam, compressed air and electrical energy, with their signals interfaced to process computers, allows monthly, daily and, if necessary, immediate reporting of energy and energy per unit of production information The program so reported at Falconbridge's Sudbury Operations is credited with an annual cost avoidance of .9 million dollars in a 14.0-million-dollar annual energy account

The plant and processing site at Porgera has been built on a levelled mudstone ridge about lkm E of the mine. Excavation of 7xl06m3 of soil and rock was necessary to achieve the required area. The exposed mudstone belongs to the Chico Formation and is weak, sheared and readily breaks down by slaking upon exposure. Tectonic uplift and subsequent erosion have produced the present landscape of narrow bedrock ridges, with deep colluvium in the incised valleys. The deep excavation to a maximum of 60m, has rapidly unloaded the mudstone, and subsequent stress relief has caused rebound and dilation of the material. The processes of pore pressure equilibration, softening, progressive failure and loosening, combine to deteriorate the newly exposed rock mass. In fact, sulphur is so important that there has been an increasing tendency in recent years to measure industrial growth in terms of sulphur consumption.The uncertainty of obtaining adequate supplies •of elemental sulphur from the Frasch-mined domes. of Texas and Louisiana in the United States led all countries in 1950 to seek alternative sources of supply of this necessary element.Canadian industry has been supplied, for many years, with most of its sulphur requirements by United States Frasch-mined sulphur. World demand for this sulphur has necessitated the imposition of controls on its distribution, as production has not kept pace with demand. Until the third quarter of 1950, Canadian manufacturers of pulp and paper, heavy chemicals, explosives, and textiles •experienced little difficulty in obtaining their needs of elemental sulphur from the United States. However, at that time, low producers' stocks and declining reserves threatened to reduce shipments from producers, with the prospect of a continuing shortage for some time. These conditions, together with higher prices, stimulated the search for alternative sources of supply in Canada."

The 500-kt/a (550,000-stpy) refinery in Burnside, LA, owned by Almatis Inc. produced specialty alumina used in the abrasives, ceramics, chemical and refractory industries. The 1.2-Mt/a (1.32 million-stpy) refinery in Gramercy, LA, owned by Noranda Alumina LLC produced alumina mostly for use in aluminum smelters but also produced specialty alumina. An upgrade project at the Gramercy refinery to convert 200 kt/a (220,000 stpy) of capacity to produce more profitable specialty alumina was completed in the first half of 2018, and another project to increase capacity was started but a completion schedule was not available. The amount of new capacity was not disclosed, but it would be used to produce nonmetallurgical grade alumina. The 2.3-Mt/a (2.5 million-stpy) refinery in Point Comfort, TX, which was temporarily shut down in March 2016, remained closed throughout the year."

Magnetic separation is routinely used in the processing of titaniumminerals, and the efficiency of these operations can be determined bymeasuring the magnetic properties of the process streams. The valuable components in the feed to a titanium minerals plant have specific magnetic susceptibilities ranging from -10-9 m3 kg-1 (zircon) to 10-6 m3 kg-1 (ilmenite). However, in an industrial environment, in which the mineral temperature may range from 20 to 120¦C, it is difficult to measure susceptibilities lower than about 10-7 m3 kg-1. Hence laboratory testing of spot samples from magnetic separators is currently required to obtain accurate performance data. This is an inherently slow process and where feed grades are variable, optimum performance of magnetic separators is generally not achieved.This paper describes the development of an inductance-basedinstrument for measuring very low levels of magnetic susceptibilityon-line. The signal from the instrument can be used for process control purposes to maintain optimum magnetic separator performance.A prototype instrument has been installed in the zircon scavengercircuit in an Australian titanium minerals plant. The circuit consists of a roll magnetic separator treating a feed consisting mainly of monazite and stained zircon. The monazite-rich magnetic fraction is returned to the mine site for disposal, while the non-magnetic fraction is recycled to the zircon wet circuit. Splitter positions in the separator are adjusted when the final zircon product fails to meet specification, or the magnetic fraction contains more than 30 per cent zircon. Weekly composite grain counts show that sub-optimal operation of the magnetic separator results in significant zircon losses into the magnetics fraction.Using the instrument, the zircon content of this stream can now beaccurately determined from the measured magnetic susceptibility,provided a correction for the effect of mineral temperature is applied using the Curie - Weiss relationship.

This summary of State laws or explosives was compiled primarily to ascertain what subjects relating to their control have been acted upon by each State legislature and, in general, how they have been treated. It does not include any legislation passed after 1942, or any proclamations, regulations, or administrative orders. It does not purport or attempt to be authoritative. If any problem arises involving interpretation of the statutes of any particular State, the original source must be consulted for the exact words used by the legislature. This summary, however, will be useful In determining whether relevant statutes exist, and In locating them quickly,-with a minimum of effort. It will be of value also in comparing statutes in one State with similar statutes in other States to determine what construction has been placed upon them by the courts of those jurisdictions or to contrast the varying provisions of many States upon a similar subject. To make these comparisons easier, the statutory provisions for each State have been grouped under several major topics in outline form. Although this sometimes has resulted in disruption of the continuity of individual acts, the increased general clarity and availability of comparable sections have more than justified the procedure followed.
