The Annual Business Meeting of the members of The Rocky Mountain Coal Mining Institute held during he 84th Regular Meeting of the Institute was called to order by the president, H. Dean Jacot at 11:30 a.m Tuesday, June 28. 1988 in Peak Room 5 of Beaver Run Resort at Breckenridge, Colorado. Twenty three were present and a quorum was established. The president stated the purpose of the annual meeting is to inform members of the status of the affairs and activities of the corporation during the year. It was moved by Loren Linville, seconded and carried to approve the minutes of the previous meeting as published in the 1987 Proceedings. The chair called for reports of the various com¬mittees and these reports will he placed on file in the RMCMI office. Bylaws and Resolutions. Chairman Loren V. Linville reported there were no bylaws revisions. He further reported that the Board had adopted two resolutions: (I) Noting the passing of members since the last convention-Richard T. Brownrigg. Don A Dewey, John T. Maulshy. Hugh D. Nyquist and Mike Zakotnik. (2) Recognizing the superior skills of J. Brett Harvey. RMCMI Vice President of Utah. For recruiting 26 new members from the State of Utah and named him as #1 Recruiter in the Institute?s 1988 membership drive. Linville further commended the Executive Secretary officers, chairmen and committees loran excellent job in planning the 84th Regular Meeting and convention. Membership. In the absence of chairman Ed Sullivan. the secretary reported there are currently 718 active or dues paying members, 51 Life Members and 250 delinquent in dues payment. In the 1988 membership drive. 132 new members have been recruited and 74 of them attended this convention making up 27V, of the total attendance. Patrons of the Institute. This report was given by the secretary for chairman Ira McKeever. A total of 124 plaques has been prepared during the low year life of the program. It has been culled to 119 possible donors as some firms have gone out of business or consolidated. Of this number 46 renewed their annual $100 donation and three new Patrons have joined prior to the convention for a total of 49. During the convention. four new Patrons donated $100 each. tour former Patrons pledged $100 each and seven would be-new Patrons pledged $100 each for a total of 15. This would bring the grand total to 64 if all pledges are received prior to the close of this fiscal year as opposed to 59 renewals in 1987. Program. Co-Chairman Pete Nielsen announced the convention program theme "Broadening OUR Horizons" was well received despite the loss of three speakers during the final days prior to convention. Because the remarks of the Monday luncheon keynote speaker ran over the first time-to-be-tried Monday afternoon Poster Session was delayed almost an hour in beginning. This well thought out feature will he run again next year but in a different time frame. Nielsen thanked his co-chairmen, Bill Balaz and the Poster Session chairman Marcie Greenberg. Publicity. Chairman Tom Egan reported three newsletters including the convention newspaper were sent members during the year. He and Bob Jacob of Bob Jacob Public Relations were at registration daily to secure business card ads and to solicit advertising for the Proceedings. Scholarship. Chairman Keith McGinnis reported that six of the seven scholarship recipients were present at the convention. The University of Arizona at Tucson was added this year and it was the only university visited this year by the chairman. Each scholarship recipient was introduced to the membership at the Monday morning Welcome Session, presented a plaque and responded. The input Iron each winner was most favorable to the program. Each was appreciative of the many contacts made and the educational seminars and programs. McGinnis noted that the mining engineering department at the University of Wyoming may be dropped during the coming year. Joe Dunlap suggested that every member rally support of this department. For the past quarter century, it is fair to say that the political agenda of Western industrialized societies has been driven by those opposed to forms of economic growth providing sustenance to a growing population. They regard growth as the major threat to their social philosophy which champions a wholly "new ethic of biocentric equality" or "living as if Nature mattered." This ethic demands that "a violent, plundering humankind" must abandon its alleged rape of Planet Earth and derive its ethical norms from pre-existing harmonies and fragile, precarious balance present in Nature. A Green political agenda appeals strongly to deep longings shared among many people whose temperament seeks tranquillity in a world of wild natural beauty uncluttered by dependency on tools and experts and specialists. According to proponents of the Green philosophy, our world is pregnant with enormous problems. Armed with expanded political powers, regulatory guardians at state and local levels have mustered their forces with shotguns cocked, poised to prod an ignorant and lazy citizenry to the altar for an exchange of vows with Environmental Ethics. Social engineers have skillfully discredited the traditional role of professionals in scientific engineering who are summarily dismissed as the failed architects of an industrial system pillaging the earth. They stand accused of producing unmanageable offspring - from mining minerals and energy resources to disposing of toxic wastes - whose disputed parentage and expectant crimes against humanity must be prevented by removing them from normal custody. Green critics claim that markets cannot be given custody of industrial offspring - pollutants, wastes, land-use abuses. Markets appear to have failed to provide equity to present and future generations. The only custodian with sufficient coercive power seems to be the regulatory bureaucracy. The upshot is a stark Hobson's choice - Shotgun Wedding vs. Custody Dispute. It derives its fateful predestination from an uncritical acceptance of several preconceptions which currently undergird the altar of Sustainability characterized by its acolytes as "a new and exciting doctrine." It is significant that Limits to Growth slogans of the 1970s have been displaced in the 1990s by the more palatable language of Sustainability. As a policy recommended to forestall an impending doom, Sustainability derives its credibility from dire predictions of global warming, ozone depletion, acid rain and the like. The Rio Declaration announced to the world in June 1992 that, although energy is essential to human well-being, its production and consumption in wealthy industrialized nations is unsustainable. It called for a complete overhaul of energy systems with nothing short of a total replacement of fossil fuels, uranium fission reactors, and large hydroelectric projects by means of so-called renewable energy sources, augmented by coercive regulations to force conservation and limit consumption demands. MR. TESCHER (Disaster at Dawson) : I move that you appoint a committee of nine members of this Institute to draft a set of resolutions that we can send out to all members of this Institute, to the mine officials in all four states, that might go towards preventing these disasters; that we reach all men, all mining men, mine officials of all kinds. I think we have enough brains to carry out a few suggestions of that kind. I think you are fully familiar or know men who are fully qualified to act on this committee. The only qualification that I have is to ask that Mr. Harrington be appointed a member of this committee. PRESIDENT WHITESIDE: You have heard the motion, and I believe it was seconded. Is there any discussion? That is a subject that really needs a great deal of thought. MR. LAMB: Things like that can't be handled in a minute. What Mr. Tescher suggested is all right, but to my mind, going into a great many of these different properties, seeing the conditions, such things hit pretty close to home. I would suggest that you put this off; lay it over until such time as the people who had the disaster have some time to think these things over. It is too soon to offer even a suggestion. Suggestions are all right, but there are no nine living men in the United States who can stand up or sit down and talk it over and give you any reasonable answer, in one hour or six months. First, you would naturally have to go down there and converse with the men who were at the camp at the time. You are all operators; all you operators would -like to talk it over today. You realize that anything that is good for the camp is always acceptable in disasters of this kind. I say, do it gracefully and not by publication. MR. TESCHER: I feel that the men present know these suggestions by heart and they don't have to discuss them. They know them instinctively and they know they will apply to any mine. It must be understood that if these suggestions are not carried out, they ought to be; and there is a motion before the house. PRESIDENT WHITESIDE: Mr. Murphy, you started to rise to your feet a moment ago. Have you anything to say on the subject? MR. MURPHY: I have just returned from a visit to Mr. Brennan. Mr. Brennan and I have worked together for twenty years. The manager of our company asked me to go down there and express his sympathy. Those things come to all men if they live long enough, in the coal business, and he wanted me to express to Mr. Brennan personally his sympathy and deep regret. What I had in mind when I started to rise, was to suggest that the Institute as a whole express its sympathy to Mr. Brennan. I don't think there is a man in Utah, Wyoming, Colorado or New Mexico who has done more in safety' lines than Mr. Brennan, and it just seems bad luck that he had this disaster, and I am in hearty sympathy with the gentleman who spoke about not appointing this committee. I believe a resolution to Mr. Brennan would be very much better. JAMES DALRYMPLE: I am in sympathy with this gentleman here. I think it is going to hurt the feelings of those connected with the mines in which this disaster occurred. If you will give me the privilege for a few minutes, I will gladly express myself and the action that has been taken in the past by this Institute, and my opinion combined with a great many other opinions. And what I am going to say is going to be said by the-well, I am going to say it as I see it. I am going to say it not in an unfriendly spirit, but from a spirit of not undue criticism. I happen to be one of the original members who organized this Institute. I did what I could to obtain memberships. I remember very well when we had our first meeting that we had a very large membership. I think I have a photograph of the members which was taken on the steps of the Capitol building at that time. Our membership at that time was composed largely of underground officials. I mean by "underground" officials, the superintendents to some extent, the mine foremen, their assistants,

The Bituminous Coal Industry has for the past year been faced with a most serious problem. I am sure that you have had your own individual and local problems, as do we all. In my thirty years of practical experience with coal mining, I have never found an operating man nor a coal mine without problems. The very nature of mining, with so many unknown factors involved, precludes the absence of problems. But they are not insurmountable, and one should not dwell on them interminably. They should be recognized as a challenge to our ability and ingenuity to solve them, and once the proper solution is found, it should be applied and the problem dismissed. However, we find ourselves at the moment in the midst of a serious challenge to our very existence. In the early thirties, many in the industry welcomed the re-establishment of Unionism as a balance wheel, in the belief that the stabilization of wage scales would also stabilize prices and eliminate disastrous price cutting practices. The ultimate effects of having twenty-six years of benevolent paternalism in the administrative branches of Federal and State Governments with their labor courting policies, could hardly have been anticipated. And so with wages spiralling under government sponsorship, we have finally reached the point where competitive fuels, such as natural gas and oil are more attractive to the consumer, from the economic angle of cents per BTU cost, than coal.

9:00 a.m., June 28, 1983 MR. MORTENSEN: Good morning ladies and gentlemen. Again, it gives me great pleasure to welcome you to another session of the 79th meeting of the Rocky Mountain Coal Mining Institute. The thing again that has always been impressive are the activities that we've had so far. The success in the meetings has been delightfully encouraging to all of our committee people. Please welcome the chairman of the session, Charlie Margolf. MR. MARGOLF: Thank you, Vernal. Good morning, ladies and gentlemen. It would be my privilege to serve as the session chairman this morning. To allow the maximum time for our speakers, I'll turn the microphone over to Bernie Bernstrom who will introduce our first speaker. MR. BERNSTROM: Thank you. As Vernal mentioned, Dan Jackson will be our first speaker. He is the Western Editor of Coal Age Magazine. Dan really doesn't need an introduction to this group. He's belonged to the Rocky Mountain Coal Mining Institute about 25 years. Dan is a native of West Virginia and he's an ex-coal miner. He graduated form West Virginia University as an electrical engineer and worked for Amherst and West Bending Coal prior to employment by Coal Age Magazine. Back in 1972 Coal Age moved him to Denver from New York City. MR. JACKSON: When Vernal Mortensen asked me speak to the members of the Rocky Mountain Coal Mining Institute earlier this year I found it impossible to say no to the guy because of what he has contributed to western coal. Little did 1 know that the subject he had in mind would be entitled, "An Outsider's View of Western Coal." At first I asked myself-I've been associated with the coal industry for some 38 years, 12 years in national operations and 26 years reporting on it. You might say that I've been married to two industries, coal and the business press for 26 years, but today I'll put on my business press hat and try to make an impression of what an outsider might think of western coal. But at the outset, let's get one thing straight: When you say press, whether it's business press, the media or whatever, and you heard some comments yesterday as far as what the media has done .to this industry and there's been some definitions bandied around as to just what an editor is. One of the most recent ones has defined an editor as a person who can talk on any subject with an open mouth. Now that's not my case. Secondly, I don't give long talks. Several years ago I was giving a rather lengthy talk to a group similar to this and it was halfway through the talk when I noticed one guy on my right looking at his watch quite frequently. I didn't mind that too much because all of us do that once in a while, but when he looked at his watch, took it off and shook it, I thought, "My God, better cut short." But for more than a decade western coal has enjoyed substantial annual increases in production from some 30,000,000 tons in 1970 to some 264,000,000 tons in 1981, but 1982 was a different story. We lost about 6,000,000 tons of production in that year. In 1983 it's expected to be a little worse than '82. Coal historically doesn't rebound from a recession as quickly as other industries. It takes about eight to 10 months longer for us to really get moving again and I'm afraid that you'll still have to don your fighting helmets and flack jackets when you go out into the market to sell your product. Western coal, as you know, has problems and al l of them are not going away when the recession ends and they won't go away overnight. I'm sure most of you are aware of what those problems are. Carl Bagge and Jim Harris, along with other speakers, at this meeting have educated us well on those problems and I'm sure you'll hear more from Jim Watt at today's luncheon. If everyone in this room were asked to list three orfourof the most serious problems facing western coal, I'd make book that the total of the answers wouldn't vary by more than 3 to 5%, if that much. But coal is not the only mining segment in the U.S. with problems. Metal and non-metal mining has its share, too. I'd like to step back into the past for a few minutes, if I may, to a time when our problems were just beginning. Since 1979 a third of the nation's mines, including coal, metal and nonmetal have been shut down. The total volume of all mining in the U.S. in that year totaled some $24 billion. Today that figure has dropped some 21 %. The after tax rate on return for mining companies has fallen from 6'/% in 1980 to minus 3% in 1983. But that's really not where our problems began. They began 20 years ago when a profound change began taking place in the U.S. economy. Our economy had been growing at about 2'/-3% annually without exception except for the great depression. Our inflation rate was about I'/%, interest rates were running about 6%, and the federal budget was $77 billion, really great figures compared to today. From 1960 to 1980 the federal budget increased almost 1.000% and taxed paid by individual families increased by 700% during that same period. Despite the huge increases in taxes, the federal deficit kept getting larger and larger year after year and within this 20 year period the national debt climbed to a trillion dollars. Economic progress of this type can't continue indefinitely without some serious consequences. The result of that economy, well, you know what happened and there is a direct relationship of that

In the current issue of Link-Belt News is this quotation: "Advancing waves of other people's progress sweep over the unchanging man and wash him out." As we look over the industrial world today we are struck by the many waves which are sweeping over backward industries. Mergers are being consummated in all lines of endeavor. General Motors are making radios and the Bendix Brake Company are making airplanes. Railroads which twenty years ago were called to account by the Federal Government for their efforts to form combinations are today being ordered to combine. But what is of immediate concern to the coal industry is the fact that there is now in existence or in project a total of 3,641 miles of pipe lines to carry natural gas to most of the country's industrial centers. This is the wave of progress which is sweeping toward you and me. If we are to grasp the significance of these many changes, we must widen our vision so that we may learn some- thing from 'the other fellow's experience. The first lesson is that cost of production alone is not a measure of profit. It is an interesting fact that the production of an article represents a definite loss until that article has been sold for a price in excess of its total cost, and the money is in the hands of the producer. If this is true, then the selling price is more important than the production cost.

I read a book the other day called Opportunity 2000. The book, Opportunity 2000, talks about what's going to happen in the next nine or ten years as we propel ourselves through the 1990s into the 219 century. The book, Opportunity 2000, is a futuristic book, somewhat like Megatrends. It said that by the year 2000, baby boomers will be old people, and when you got here before the baby boomers, how does that make you feel? It said that there will be more women in the American work place by the year 2000 than men. The book, Opportunity 2000, discusses diversity. The big challenge for the 1990s is ?diversity?. We'll have the D-word in the 1990s. We had the G-word in the 1980s ? ?global.? Diversity in terms of more immigrants, more minorities, more females into the American work place, but also value systems diversity. We'll have to deal and adapt to four different generational clusters in dealing and interacting with employees and management in the 1990s-value systems diversity. PRESIDENT LITTLEJOHN: Before we open the discussion on the Utah mining laws, I want to bring out what I consider a slight misunderstanding on some of the things that I said this forenoon relative to our comparison of accidents. I did not mean to infer that we, as mine officials, are satisfied we have done the best we can to eliminate the accidents, when I was talking about a four-to- one comparison. I do not want any- one to get the idea in their heads that I do not think we are doing all we can. There is not any of us who can state that, even if we better these figures. It is the general understanding that these figures are based upon ratios per thousand man shifts and not upon the tonnage basis that we use. If it were based upon a tonnage basis, I think the figures would be pretty nearly reversed, for we are producing from two to four tons more per man than they do in Great Britain. The discussion will now be continued as I said this morning. There is a gentleman in the audience here that is as guilty of making these laws as I was, and I am quite sure when speaking he will confine himself to the subject of Utah Mining Laws and the prospective results. Before Mr. Monay starts with his paper, I want it understood that this discussion must be finished by 2:30 for the reason that we have still quite a lot of business before us this afternoon.

The 66th Regular Meeting of the Rocky Mountain Coal Mining Institute convened in the Opticon Theatre, Snowmass-at-Aspen, Colorado, and was in session at 10:00 a.m. The meeting was called to order by Past President, Stanley C. Shubart, Secretary-Treasurer, Schloss & Shubart, Inc., Denver, Colorado. Mr. Shubart welcomed the guests and was pleased at the large attendance, in view of the fact, that the site for the convention had to be changed at the last minute from the Stanley Hotel in Estes Park to Snowmass-at-Aspen. He stated that Joe Ward, our General Chairman, could not be present due to the serious illness of his wife, Thelma. He called on Bob Wilson, Chairman of the Registration and Hotel Committee, to give his report on applicants for membership since the last meeting. Mr. Wilson stated that there were 89 applicants and 242 registrations, an all-time record. A list of new members follows.

We all deplore the high accident rate of our coal mines, but when brought to task we immediately attempt to appease our conscience by calling attention to the high tonnage rate per fatality in American coal mines as compared to European mines, losing sight of the fact that the accident rate per hours of exposure has shown no improvement during the past twenty years. Measuring our accidents in terms of hours of exposure, not in terms of production, is the only correct method. Certainly it can be of only scant satisfaction to the miner to know that his chances of getting killed this year are as great, or perhaps greater, than last year, but the tonnage rate per fatality will have gone up. We cannot help asking ourselves why it is the other major industries, almost without exception, have made wonderful strides toward reducing accidents, while coal mining stands alone as the one major industry in which no improvement has been made. It certainly cannot be charged entirely to the increased use of machinery and the increased productivity per man employed, as the other industries likewise, or to an even greater extent, have increased the use of machinery and the production per man.

CHAIR: I see a great many safety men in the audience and I hope you will all take part in using up the time that we have left. The point brought up by all was the necessity of education. It is very hard to know just how this is going to be done. We get very little encouragement to do this. At a recent meeting at Rock Springs, 100 in attendance, and most of them mine officials. Another condition which contributes to accidents is the labor turnover in many of our States. With many companies I am told from actual statistics the labor turnover is 125 per cent. Each field has different mining conditions so that men coming from one field are not always familiar with the mine conditions in the field they come to. These are conditions which have to be overcome. WM. LITTLEJOHN: Mr. Harrington brought up the subject of sprinkling. I will try to tell what we are doing at the Utah Fuel Company camps. Our dust at Castle Gate is the most inflammable gas that has yet been tested at the Pittsburgh station of the Bureau of Mines, so it is up to us to use every precaution to keep it down. I will try to tell what we are doing regarding sprinkling from tanks. We now have in operation two tanks in our locomotive roads, one in Castle Gate, one in Sunnyside. These tanks are something like 500-gallon tanks with pump on one end of truck which gets its power from the power wire and has a half circle perforated pipe on the other end of tank. This is simply hooked on to the locomotive. When the pump is started up it throws a fine spray of water all around which wets the roof, the sides and floor. We found this very successful from an economical as well as a working standpoint. A roadway that we probably would have had to pay a man at least two shifts for, covering the full distance, with the ordinary hose and spray, we can do in half a day and do it more thoroughly. We are also figuring on at the present time using the same system on rope haulage ways, which of course will have to be run by a reel from the feed lines, handling say four hundred feet each way before reconnecting. We haven't got it finished, but are working on it at the present time. MR. COLBURN: I would like to say a few words -about this question of education. Education was mentioned by all three sections of the Safety Committee. Education regarding safety might be divided into two branches. One branch is for the official at the mine to keep him acquainted with the latest developments in safety equipment and safety methods. The other part of education is for the workmen. The United States Bureau of Mines is co-operating in both directions. Safety Clubs are organized around the Bureau of Mines First Aid Training, but it is the idea to expand those clubs and teach the miner the advantage of such-things as the closed safety lamp, and also the regulations that have been made for his safety. In Illinois we can't operate with the closed lamp, because the miners in that section of the country are not educated to the advantages of the safety lamp. Another form of education has been taken up by the National Safety Council, consisting of voluntary organizations similar to the Institute, to which all mining men are invited to attend. Such conferences nave been held in the Lake Superior district, in Butte, and in Globe, Arizona, this year. These are to be extended throughout the coal mining regions. CHAIRMAN PRYDE: The Union Pacific Coal Company has also built two tank cars of 600 gallons capacity each. The tanks are connected with hose, so that water can flow from one tank to the other. A centrifugal pump is mounted on a truck, and connected to the front tank. This pump takes its power from the trolley wire. The discharge from the pump is perforated, so that it sprays the floor and sides of the entries. We expect to use this water train on main haulage ways where we have no sprinkling line.
