Arbitration is a legally recognized alternate litigation for the resolution of civil disputes. The parties agree, either before or after a dispute arises, to submit that dispute to an independent third party for resolution. The decision of that third party is binding on the parties. A decision of an arbitral tribunal, typically referred to as an "award," cannot be reviewed by a court except on very limited grounds, such as fraud. See, e.g., Va. Code 8.01-581.010. Indeed, an arbitral award is typically less subject to judicial review than the decision of a trial court, whose decisions are almost always subject to appellate review as a matter of right. Arbitration is typically the result of a contractual agreement between the parties to submit disputes to arbitration. On occasion, arbitration can be required by statute. For example, the California Department of Transportation requires the arbitration of all disputes arising under its contracts. Public Contract Code, Article 7.1 (§§10240-10240.13). There may be a question whether statutorily required arbitration is truly arbitration or an administrative law disputes resolution procedure. The significance of the difference is that the decisions of administrative law bodies are typically reviewable by a court of law as a matter of right while, as set forth above, arbitral awards are almost never reviewable.

Recently discovered Carboniferous bentonites are variable in charadeI and thickness, but being altered aeolian, ash-fall tuffs, they are probably extensive. Most are the Ca-montmorillonite type without the natural swelling characteristics of the Wyoming deposits, but their situation, thickness, and response to beneficiation through cation exchange may give them some potential as sources of future economic deposits.INTRODUCTIONLoughnan and See (1959) gave an account of bentonites and fuller's earth deposits of New South Wales. The most likely potential industrial sources were those occurring in the uppermost formations of the Newcastle and Singleton Coal Measures (Permian) in the Hunter Valley and deposited during epochs not marked by strong contemporary vulcanicity.One feature of the record of known occurrences at that time was the absence of bentonites from the thick volcanic sequences of the Carboniferous, but since this paper appeared, many bentonite beds have been discovered by the writer in the Carboniferous facies formerly known as the "Kuttung Series".The purpose of this contribution is to report briefly on the occurrence, genesis, mineralogy, and economic potential of these deposits which augment possible sources of bentonite near major industrial centres on the eastern seaboard.The potential world demand for bentonite would increase markedly with the trend to pelletization in the steel industry, if its use in this field became more general. The study comprised of the investigation into the sensitization characteristics of AISI 409 titanium stabilized ferritic stainless steel during low heat input welding. AISI 409 is a fully ferritic stainless steel used in catalytic converters and tubing for automotive exhaust systems due to the supposition that sensitization does not occur during low heat input welding. Two plates of 2 and 4 mm were tested for sensitization during low heat input welding. The study confirmed that chromium carbide (M23C6) precipitation occurs on the grain boundaries in the heat-affected zone with consequent depletion of Cr adjacent to the grain boundaries during welding. In the 2 mm plate sensitization occurred in the heat input range of 0.1 kJ/mm to above 0.25 kJ/mm and in the 4 mm plate sensitization occurred in the heat input range of 0.2 to 0.9 kJ/mm. Ti stabilization is ineffective at the heat inputs used in this investigation due to the rapid cooling rate through the temperature region where TiC precipitates. The presence of N was found to be detrimental since it consumes Ti on cooling, forming TiN, effectively lowering the amount of Ti available for TiC formation during rapid cooling after welding. Annealing for 5 minutes at 725°C does not improve the sensitization characteristics of the welded plate. There is a linear increase in grain size as heat input increases. The resistance to pitting corrosion decreases in the sensitized, welded plate in theheat-affected zone adjacent to the fusion line of welding. Introduction The issue of coal mining safety plays an important role in the United States' growing dependence on coal to supply its future needs. This article will address the federal government's role, principally the US Bureau of Mines, in meeting this challenging growth and demand while reducing the social and economic costs attributed to injuries and fatalities in underground mining. Some interesting facts and projections with respect to the nation's energy picture will be discussed. This includes the distribution of its reserves and the projected role of coal in the energy and economics of the nation's future. Underground mining will continue to be an important means of providing this coal. The author will discuss how the Bureau of Mines' research program addresses the problems of health and safety that grow out of the demand for more coal. Future projections First, a synopsis of salient facts and projections concerning the US's situation with respect to energy and the economy. Figure 1 depicts the relative quantities of recoverable energy reserves in the United States by their type. Most people are aware of the nation's use of oil. We hear a lot about natural gas. And we are aware of the controversy over the use of nuclear energy. But, while looking at Fig. 1, the question becomes, "Where will our fuel to meet the demand for energy in the future most certainly have to come from?" With 82% of the nation's recoverable fuel reserves being coal, the answer is irrefutable. Coal will be that source. Figure 2 is the present market for coal. It shows that 77% of the coal mined goes to supply electric utilities. Therefore, the coal industry as a whole is most sensitive to the trends and demands for electricity. It is less affected by what happens in other markets, such as export and direct industrial use. In fact, the coal industry is three times more sensitive to the electric utility market than to all other markets combined. Therefore, the trend in the demand for electricity must be examined. Electricity demand is expected to increase steadily over the next 15 years. It is projected to grow from its present 2.3 trillion kWh per year to 3.5 trillion kWh per year by the year 2000. The fuel to supply this increase in demand must come from somewhere. The question is "How much of this extra fuel will be coal?" Although the demand for electricity is predicted to increase, the demand for coal does not necessarily follow. Coal must maintain its fraction of the energy sources used for electricity generation if its demand is to increase at the same or greater rate as electricity. Except for a near-term dip in demand due to a slight increase in nuclear capacity, the domestic electric generation accruing to coal will go from 56% in 1985 to more than 60% in 2005. Thus, the predicted trend is for coal to become a larger part of the fuel mix for electric power generation. Similarly, looking at the most recent forecast for total coal consumption trends, it can be seen that for electric power generation alone, the coal industry must be able to supply an additional 316 Mt/a (348.5 million stpy) by the year 2000 (Fig. 3). It must be stressed here, though, that without significant improvements in mining safety, it can also be easily predicted that injuries and fatalities will increase in proportion to the increase in coal production. Will society consider that acceptable? This author does not believe so. Figure 4 examines the effect of coal prices on the price of electricity. The projections show that the already high proportion of fuel cost will become a greater fraction of the consumer price for electricity. Specifically in 1985, 36% of the price of electricity was the cost of the fuel. In 1995, 46% of the price of electricity will be the fuel cost. That implies that the price of coal will have an increasing influence on the consumer price for electricity. Thus, as coal is used more to generate electricity and as fuel becomes a greater

When considering all the aspects of a viable mine plan, it is important to estimate the accurate cost of mine ventilation, which varies as a function of airway dimensions, fan selection and ventilation network. Optimization of the overall elements of ventilation design can lead to very significant cost savings when capital and operating cost savings are considered in combination. This paper will describe a methodology, whereby ventilation costs can be minimized by optimizing the ventilation aspects of mine design and fan selection, by providing a brief description on ventilation theory and the factors which affect ventilation operating and capital costs.

Keywords: Co3O4, Cobalt Compounds, Morphology, Urea, Homogeneous Precipitation Depending on experimental condition, precipitation from cobalt nitrate and chloride solution in the presence of urea yield dispersed cobalt compounds with different chemical compositions and morphologies. The effects of concentration of cobalt solution and urea, agitation, on precipitation morphology were investigated experimentally. Generally in closed systems the particles are identified as cobalt (II) basic carbonate with needle type shape. In open system, spherical and plate-like precipitations of cobalt (II) basic cyanate are formed. The chemical formula of cobalt compounds was confirmed. They are CoII,III(OH)0.83(CO3)0.49 Ay?0.14 H2O (in tightly-capped reactor: A stands for NO3?, Cl?; y[A]molecular weight < 12.9) and CoII,III(OH)0.83(NCO)XAy?0.14 H2O. (in open reactor A stands for: NO3?, Cl?; 42 x + y[A]molecular weight < 44.82). The main reason was that the primary particles had different chemical compositions for the effects of the different kinds of anions and stoichio-chemical compositions of the primary particles. The effect degree of the anions depended on the co-existing anion radius in the reaction solution. According DTA-TG analysis of the cobalt compounds, the latter particles transform to Co3O4 powders on calcining. The shape of the Co3O4 particle with porous character has inheritance with precipitation. In this paper, it concludes that the particle formed by the principle of nucleation-aggregation in aqueous solution. The process of aggregation has played an important role in formation of particles. During calcination, the aggregation would be destroyed partly.

Researchers from the National Institute for Occupational Safety and Health1 (NIOSH), together with employees from The Doe Run Company, are monitoring and evaluating the stability of a pillar retreat section at the Fletcher Mine, a lead/zinc, room-and-pillar mine near Bunker, MO. Cemented rockfill is being used to provide roof support as high-grade, remnant ore pillars are mined. Earth pressure cells and deformation meters placed in backfill panel pillars monitor stress change and vertical deformation, respectively, as nearby ore-bearing pillars are extracted. Similarly, biaxial stressmeters and borehole extensometers are used to monitor mining-induced stress change and deformation, respectively, in long-term support pillars. Data from these instruments indicate that when ore-bearing pillars were mined, stress was redistributed from support pillars to a backfill panel pillar. The data also indicate that the backfill and support pillars have remained stable for two years after pillar extraction was completed in the area. This research demonstrates the importance of using reliable instruments to document the geomechanical behavior of pillars and backfill. Gaining a better understanding of roof support and stress redistribution mechanisms is a fundamental part of NIOSH&apos;s goal to reduce and/or predict rockfalls, which are still among the leading causes of injuries in metal/nonmetal underground mines.

Ausmelt Technology has a unique capability of removing the impurities, phosphorus and sulphur, from the feed materials to the process. Sulphur is removed to the gas phase almost completely because of the interactions of ore and coal in the reaction region at the top surface of the slag bath. Phosphorus is removed to the slag phase, with both basic and higher, controlled iron oxide levels in slag being achieved in the process. The significance of these features of the process relate to the production of pig iron with very low levels of these impurities for the further processing to steel, and to the treatment of high phosphorus and high sulphur raw materials. The marketability of pig iron and the raw materials are discussed in relation to this feature of Auslron.

Unrelieved residual strains can influence the states of stress in rock masses. If cheap, stable structures are to be constructed in Tock in which large pressures are exterted by unrelieved residual strains, the pressures must be either utilized or neutralized. A photoelastic technique has been used to show that the release of residual strains in rocks is influenced by the mechanical properties of anisotropic rock fabrics. The relationships between directions of residual strain release and the attitudes of minor geological structures have been determined. For engineering design purposes it is possible to estimate the principal stress directions in rock containing unrelieved residual strains if the attitudes of such minor geological structures as foliation planes, lineations, and joints are known.INTRODUCTIONQuarry workers have long been aware that near-surface rocks may be highly stressed. In many cases the stresses are too large to be the result of gravitational loads. Dale (1923, pp. 34-35) gives many instances of deformation produced by the violent release of residual strains in quarry rocks. Coates (1963) has described powerful rock bursts and cases of rock deformation underground implying the existence of much larger stresses than are likely to result from present-day gravitational loads. The only explanation is that pressures of up to several thousands of pounds per square inch may be caused by unrelieved residual strains in rock.Instruments have been developed for measuring states of stress in rock masses. Various seam conditions had been examined during longwall production at RAG German hard coal mines. Based on the field data a prediction method was developed considering separation planes as influencing factors for roof falls at the face. The characteristics, orientation, and density of separation are important factors on the occurrence of roof falls. In addition to geological influences, the performance parameters and geometry of support must be considered and optimized for the prediction and prevention of roof falls in a longwall face. Based on detailed macro- and microscopic investigations of e coal seams considering various ranks of carbonization, the origin and characteristics of separation planes are determined and a strata-specific influence on roof fall is interpreted. It was assessed that the coal face fracturing and displacement caused by the stress depend on the floor and roof strata conditions due to activation of the existing separation planes. Field studies are shown giving an idea of influences by advance rates of the longwall face, support delay and hydraulic pressure to the roof control in longwall faces in depth of more than 3000 ft. The analysis includes the application of specific software developed for longwall roof fall prediction as a result of a European research project. The software allows a laminar graphic display of roof fall probability, which is used for recognition of risk areas and risk management.

The WEMCO Heavy Media Drum Separator was first introduced by WEMCO in California in the 1940`s, initially from their base in San Francisco and later when the company moved to Sacramento. The WEMCO Company became a part of EIMCO Process Equipment in 1985, and in 2002 EIMCO became a part of the GL&V Group when Dorr-Oliver EIMCO was created. Throughout this period of time the WEMCO Drum has been installed on a variety of different applications and is now operating at the heart of many of the world?s largest Minerals and Coal Processing Plants, as well as being used by many smaller producers and metal re-cycling operations. This paper looks at the practical aspects of using WEMCO Drums in a representative range of processing applications.

Electronic and Electric Equipment contains a range of components made of a wide variation of metals, plastics and other substances. Up to 60 elements can be found in complex electronic equipment: base metals, precious metals and special metals in circuit boards and batteries. Because of its amount WEEE represents a considerable metal resource with a higher special and precious metal content than found in ores. The Umicore integrated smelter and refinery recovers and supplies back to the market 17 different metals from EEE. Pre-treated materials enter state of the art, material and energy efficient metallurgical processes for environmentally sound recovery of metals and treatment of off gasses and hazardous substances. The organics in the feed function as reducing agent and alternative energy source during smelting for precious metal recovery. Lithium-ion batteries are treated using a dedicated process. As a result the environmental footprint of metals produced from EEE is much smaller than primary production.

"Twenty-five years ago, there were about thirty-two gold mines operating in Canada; nine of these have been in continuous operation since then and are still operating. Three of these are part of the Dome Group. Operations of these three and of the newer mines in the Group are referred to in discussing process development over the last twenty-five years.Of the Dome Mines Group, Dome Mines Limited, Sigma Mines (Quebec) Limited, Campbell Red Lake Mines Limited, Detour Lake Mine and Kiena Gold Mines Limited, three have been in continuous operation for the last twenty-five years. Dome has operated for seventy-seven years; Sigma about to complete fifty years, and Campbell approaching forty. Overall, milling processes are virtually the same as they were twenty-five years ago. Tota1 go1d production from the three mines has hardly changed; 1960 production, 416,700 ozs. versus 411,300 in 1985. Milling costs have risen by a factor of six or seven and gold price from $35/oz. in 1960 to $322 in 1985.Basic flowsheets are relatively unchanged. Sigma is an all cyanidation mill grinding in cyanide solution; Dome operates gravity concentration and cyanidation; Campbell gravity concentration, flotation, roasting and cyanidation. All three use Merrill-Crowe zinc precipitation.Detour and Kiena are two examples of the major change in gold processing in the last twenty-five years - carbon-in-pulp. This process has brought along with it other changes, such as, carbon stripping and reactivation, electrowinning, and induction furnace melting. Modern mill design with its use of outside thickeners and agitators, bulk handling of reagents, instrumentation, etc., has made a radical change in operating conditions and appearance of the new plants."

Wind erosion can be a major cause of the loss and dispersion of tailings material from a tailings dam into its surrounding environment. Such dust dispersion can be a serious nuisance, as well as a health hazard to inhabitants in nearby settlements, and can also damage the health of animals, degrade crops, making them less marketable, and cause soil and water pollution. The problem of wind erosion can affect tailings dams in all types of climate, but becomes worse as climatic aridity increases. Because clouds of dust are often observed billowing across the top surfaces of tailings dams in dry windy weather, there is a common misconception that the dust arises from wind erosion of the top surface. As a result, much effort and money is vainly spent on treating the tops of tailings dams to prevent dust generation, whereas the slopes of the dams are the true major dust source. This paper briefly reviews what is known of erosion of tailings dams and then proceeds to describe the mechanics of wind erosion in general, and how it affects tailings dams in particular. Finally, recommendations are made for mitigating wind erosion of tailings dams and the resulting blowing dust.

This Tunnel Connection project will include construction of two short tunnels to connect the existing subway tunnels (Red and Blue lines) in the northern loop area of downtown Chicago through a new station. The Southeast Tunnel will connect the Red Line to the new station below the intersection of State and Washington Streets and the Northwest Tunnel will connect the Blue Line to the new station below the intersection of Dearborn and Randolph Streets. The connection tunnels are located in a very dense urban area of downtown Chicago and under several important historical buildings. Both tunnels are curved at the intersections and located at a depth of about 7.5 m below ground surface in saturated soft clay with an average undrained shear strength of approximately 25 kPa. The design calls for minimizing surface disruption and ground displacement while maintaining normal operation of the existing subways during the construction of the connections tunnels. This paper presents mining and cut and cover tunneling alternatives for the project.

Sulfur removal from high sulfur coal has several objectives including: a) reduction of the atmospheric load that contributes to the problem of acid precipitation; b) reduction of ash, which contributes to decreased energy transfer in boilers, as well as ash disposal; and c) alleviation of the social and economic dislocations reluted to uneven geographical distribution of sulfur in coal reserves. Cost in relation to the value of refined coal will govern the development of an emerging coal refining industry. Estimation of the premium paid by power companies for coal with a low sulfur content is a good estimate of the value that will be added as the result of refining. Estimates of premiums paid in 1984 are $28.65/t ($26 per st) for reduction of total sulfur from 3’% to 1% S and greater than $28.65/t ($26 per st) for removal below 1% sulfur.
