This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a forthcoming publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World." (Information Circular, 1959.) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then brass, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. INDUSTRIAL relations in the United States Smelting Refining and Mining Company's Western operations covers the field of personnel and labor relations, and the principal aims are to render service to the employes of the Company and to its operating departments. Accident prevention Safety is a primary function. A safety engineer is employed at each operation. The wholehearted support of Company officials, staff, and the working force has been most successful in preventing accidents. Constant vigilance has been combined with a policy of building safety into all operating activities whether these are in the construction of a new facility, the developmnt of a mining system, or the direction of the working force. That this policy has produced results is attested to by the fact that the accident frequency rate at the Company's major mining operations in Utah has been reduced approximately 75 per cent in the ten-year period ending Dec. 31. 1946.

SOME time ago the Detroit Copper Mining Co. had to decide the question whether it would pay to re-treat slime-tailings, and several machines were tested in order to ascertain the type of construction which would give the greatest saving. In previous tests on the ore of this company, several tables proved far inferior to the Frue vanner, and for this reason they did not receive any serious consideration. In the late tests, however, one table was found to surpass the vanner in the percentage of saving made. The Frue vanner used in these tests had been adjusted approximately to the slope which the slime-vanuers in the concentrator of the Detroit Copper Co. had at that time, about 2 in. between the inside of the wooden posts, or 0.272 in. per ft. It had not been determined, however, if this slope was the most economical one for treating the slime-feed in the mill, or for re-treating the tailings from the slime-vanners, and I was instructed to ascertain by test-runs, under different conditions, the best adjustments for the work to. be done. In order to determine if a change in the adjustments of the machines would improve the results, it seemed sufficient to continue running the tests between the vanner and the table before mentioned, keeping the feed and all other conditions the same, but. varying the adjustments of the vanner .from run to run. I employed a vanner-man of long experience to operate these machines, who expressed the opinion that a slope between 2 3/8 and 2.5 in. between the posts (0.323 and 0.340 in. per ft.) would give the best results. Some runs made this way gave a considerable improvement. While for a slope of 2 in. (0.272 in. per ft.) the saving had been only 40.5 per cent. of that of the table, it .was 49.2 per cent. for 2.5 in. (0.340 in. per ft.) slope. A decrease of

SILICON and its metallurgical uses have been the subject of speculation since the earliest days of modern civilization. The early philosophers, Theophrastus and Pliny, believed that silica was a special form of ice, an opinion that was not seriously challenged until the seventeenth century. The first comprehensive view of the nature of silica was advanced by Lavoisier in 1787. He assumed silica to be an oxide of an unknown metal. In 1808 Berzelius produced ferrosilicon by heating silica, iron and charcoal. Probably the first produc¬tion of crystallized silicon was in 1854 when H. St. C. Deville accidentally produced the material while electrolyzing a double chloride of aluminum and sodium containing siliceous impurities. It is not strange that the early investigators should have given so much attention to silica and silicon, because of the great natural abundance of the former. Although silicon does not exist in the elemental state in nature, it has been estimated that the lithosphere contains approximately 60 per cent silica; quartz and rock crystal are found in practically every part of the world.

FOR many years the Homestake Mining Co. has devoted serious attention to the elimination of accidents, and ground is steadily being gained in this direction. In accident prevention work it is line-plunging with perfect teamwork and not the spectacular forward pass that brings progress toward the goal. In both surface plants and under- ground workings we regard "good housekeeping" as a first requisite for safety as well as efficiency. Under this term are included all types of safety guards and protective devices as well as cleanliness and orderliness it working places. Perhaps the most important factor in safety work is to arouse and maintain employee interest. The general morale and contentment of employees is of particular importance.

Development and production activity in Oklahoma during the year 1940 was of routine nature. Production, according to the Corporation Commission's figures, averaged 409,100 bbl. daily as compared with 421,000 bbl. for the year 1939. Discoveries were of minor importance except for the Cumberland pool in Marshall and Bryan Counties, in the southern part of the state. Maintenance of a relatively stable producing rate is attributable to the drilling of new wells and the recompletion of many old wells in the previously established producing areas. During the year 1785 new wells were drilled, a decline of approximately 10 per cent as compared with the previous year. Of the wells drilled, 962 were oil wells with a combined initial production of 241,000 bbl. daily, 172 were gas wells having aggregate capacities of 1205 million cu. ft., and 651 were dry holes. Wildcat activity increased 20 per cent over 1939 and 227 such wells were completed during the year; that isl 43 oil wells, 16 gas wells, and 168 dry holes. In addition to the new work completed, 603 wells were recorded as having been drilled deeper or plugged back to test new horizons; included were 334 producing wells with total initial production of 65,000 bbl. daily, 37 gas wells with initial aggregating 305 million cu. ft., and 232 abandonments. Footage drilled amounted to 4,730,000 ft., an average of 2650 ft. per well as com-pared with an average depth of 2600 ft. recorded the previous year. The principal new pools discovered as a result of the exploratory drilling were Cumberland; East Cromwell, in Okfuskee County, and Prague, in Lincoln County. At the end of the year Cumberland had 13 completed wells, which averaged 700 bbl. initial through tubing from the Simpson Bromide formation (Ordovician) at 4750 ft. East Cromwell had 10 wells with average initial of 435 bbl. in the Cromwell sand (Pennsylvanian) at 3460 ft. Prague had II wells with an initial average of 220 bbl. from the Senora sand (Pennsylvanian) at 3260 ft. There were notable extensions to the Dill pool, Okfuskee County, and to the Hewitt pool, Carter County. At the end of the year, 19 producing wells had been drilled in the former, with initials averaging 1000 bbl., and 63 wells averaging 150 bbl. daily in the latter. There were no notable changes in the policy of State conservation authorities with respect to proration. The Bureau of Mines recommendations for the year averaged 413,000 bbl. daily; the State author-ities fixed allowables at an average of 406,000 bbl. daily, while, as noted above, production averaged 409,100 barrels. The most important development in the older areas occurred in the following pools: Billings.—Seven oil wells with an average initial production of 2500 bbl. and two dry holes were completed during the year. DURING the summer of 1931, I spent four months in a study of the Willow Creek district, Alaska. This work was part of a general investigation of the territory contiguous to the route of the Government- owned Alaska Railroad. It was conducted by the U. S. Geological Survey to determine the real and potential merits of the mineral deposits, to stimulate development of them, and thus to increase the traffic on the Alaska Railroad.

For three years The Hudson Coal Co. has used egg anthracite instead of coke in its foundry cupola. It has long passed the stage of being told it cannot be done—the metal would be cold, of poor quality, or the speed of operation would be low. From observation, from use and from test. we know that our metal is about average; the cast iron invokes no adverse comment from the machine shop and the speed suits our foundry requirements. We have there-iore resolved into practice anthracite combustion processes in an industrial furnace formerly using coke, under conditions suitable to our needs. When it comes to translating what we know into use in another cupola, however, where operating conditions may be different, or to explaining why, with seemingly the same conditions in our own cupola, we have attained sometimes a temperature of 2800° in the metal and at another time 2600°, or a speed of 5 tons per hour against 2 35 tons per hour, we cannot do it. We cannot do this because there seems to be an unbridged gap between laboratory ideas on combustion and practical ideas on com-bustiqn, which we have been unable to cross in terms understandable to us as practical consumers. This gap or bridge centers around the problem of how combustion actually takes place; and we believe it is controlled by two factors: (I) the character of the surface of the fuel and (2) the space provided and needed within which the oxygen of the air is allowed to or can act on that surface. It has long been contended on behalf of coke that porosity is an important factor in combustion, although, admittedly, there are two schools of opposing thought on this question, as revealed in technical literature. It has been understood generally that a light, porous coke is the best metallurgical fuel because there are more square inches of carbon exposed to the blast of air, therefore more useful carbon-dioxide reactions can take place in the given space between the entrance of the air and the point where useful work is done. It is now our general idea that the heavier and the harder the coal, the better the metallurgical fuel, provided the surface of that fuel is suitable for fast reaction with the oxygen. Time and Space A cupola is loaded in layers of fuel and iron. The horizontal line where the first charge of iron rests on the coal is the top of the bed coal. With us that is 22 in., usually, above the tuyeres where the air enters. This means 600 lb. of coal. Every subsequent coal layer is 100 to 125 lb. of coal, and that 100 to 125 lb. of coal melts 1000 lb. of iron at around 2700° in the ladle. This quantity of coal represents a 3-in. layer spread across the cupola. The question arises: If this 3 in. of coal will melt 1000 lb. of metal, why was it necessary to use 600 lb., or 22 in., of coal beneath and between the first charge of iron and the air entrance?

IN comparing the living conditions of the worker or peasant of the past with those existing today, his-torians might point out many strange contrasts. From the Doomsday Book we learn that at the time of Wil-liam the Conqueror the 1,375,000 inhabitants of Eng-land and Wales owned less than 1000 horses and 5000 oxen. Even as recently as 1871 when England and Wales had a population of 31,845.000, the total number of horses in the country was estimated at 1,110,000. Compare the necessary drudgery of labor in those days with conditions in Canada today where a population of less than ten million people own 3,500,000 horses. Re-member that there is also a turbine installation in` this country of more than four million horse-power, besides steam boilers and locomotive and automobile engines which reduce the traction and hand labor of the farm and factory. Frequently, poetic license has glossed over the poverty and hardship of the common people in the "good old days," and the imagination has created an idyllic world, far from being justified by the condi-tions which actually prevailed. Simon Patten's de-scription of the Middle Ages as "A Thousand Years Without an Ice Box" came nearer portraying the true situation. No one is likely to forget that the discovery of America was an incident in Europe's attempt to find a short route to the Indies, but the fact is usually for-gotten that the summer diet in Europe in 1400-an ice-less age-was such that spices were more precious than gold. Though the glamor of the Indies may never sur-round the modern refrigerator, certainly the modern housewife is likely 'to feel that the applied art called "cookery? may attain to higher levels with the assist-ance-6f such an adjunct. Those who have spoken slightingly of the uniformity of the modern apartment and have eulogized some of the exceptional hand-made furniture which has been bequeathed by former generations, have failed to com-pare modern house furnishings with those in the typical peasant's hovel. Machine-made furniture, though with-out particularly good lines, contrasts quite favorably with the pile of rags in the corner, and the poorest gas or oil stove is better than an open fire on a dirt floor. The scientist's application of the theories of physics, chemistry, biology and mathematics .to practical prob-lems has brought about a series of kaleidoscopic trans-formations in agriculture, industry and commerce. Large scale production, improved means of communica-tion and the prevailing higher standard of living are terms which imply a very human meaning when in-terpreted as actual changes in individual living. Though the student and the teacher may deprecate the influence of commercialism upon science, humanity as a whole has received great benefits from the close relationship which has developed between science and industry, and industry in turn has done much for science through the building and endowment of laboratories and by supply-ing funds to maintain research workers.

In the experimental work for this comparison of wet and dry grinding, it was found that the size distributions for wet grinding operations are characterized by a constant value of the distribution modulus, (a; whereas, for dry grinding the distribution modulus decreases slightly with increased size reduction. Wet grindability seems independent of the weight of material in the mill while dry grindability depends on weight. Experimental data and eqmtions for each process are presented for noncleavable isotropic material, for cleavable or material in which there is some form of internal stress, and for energy consumption. The equation ED/EW=BK-? (where ED and Ew are, respectively, energy for wet and dry grinding, k is the size modulus, and B and ? are constants) was found to give the ratio of energy. Dry grinding is generally considered to require more energy than wet grinding. Taggart' states that power consumption in wet grinding ranges from 60 to 90 pct of that required for dry grinding. Bond' states that dry grinding requires one third more power than wet grinding. It is interesting that Rose and Sullivan' note this same difference in power required for wet and dry grinding, but they state that on purely mechanical grounds it is difficult to see any great difference in fundamental principles between wet and dry milling, since dry milling may be regarded as wet milling with a fluid of low viscosity (i.e., air vs water). Yet it must be the viscosity of the fluid that is responsible for the differences between wet and dry grinding. Probably the most comprehensive investigation comparing wet and dry grinding has been that made by Coghill and Devaney. They compared the grind-ability of both chert and dolomite in a 19x36-in. batch ball mill under both wet and dry conditions. In these tests the weight of ore in the mill was varied from 35 to 200 lb and each grinding test was carried out for such period of time that the amount of -200-mesh material in the product was essentially the same for each test with a given material. Cog-hill and DeVaney's data for the grindability of dolomite, which are reproduced in Fig. 1, show that a comparison between wet and dry grinding is com- plex. The comminution of a material by a wet grinding method is characterized by a constant grindability over a wide range of mill loadings. Since grindability is the weight of material comminuted per unit of energy expended, it is equivalent to (w)/ (p)(t), where W is the weight of material being ground, P is the power, and t is the grinding time. In the case of wet grinding, the grindability of dolomite in the Coghill and DeVaney experiments was 0.546 * 0.009 ton per hp-hr when the load of dolomite in the mill ranged from 50 to 200 lb. On the other hand, for dry grinding no such simple relationship was found to exist between power, time, and weight of material in the mill. ELECTRIC power requirements for Climax are similar to those of most metal mines, except that large blocks of power are used underground and there are a number of other unusual applications. Power is furnished to the Company by the Public Service Co. of Colorado over two 100,000-volt lines to a bank of three 3333-kva. transformers 100/13.8 kv. These transformers are designed so that with the addition of forced cooling their capacity may be increased a third at 12,000-ft. altitude. On the secondary side of this bank is a 15-kv., 1200-amp. oil circuit breaker provided with automatic reclosing relays allowing three successive short circuits before lockout. From this breaker 13.8-kv. power is transmitted to a central switching station where all circuits radiate to the different operations of the property. Each circuit is protected by a 23-kv., 600-amp. oil circuit breaker with by-pass and isolating disconnecting switches. An educated man is distinguished neither by his clothes nor by his knowledge; he is replarkable not for the things he says, but for the way he says them. You cannot even stand with him under an archway in the rain without finding him out. He may talk only of the weather. His words and his phrases alike may be simple. -at distinguishes him is the arrange- ment of his words; however desultory his talk, it will be method- ical; he has habituated himself to foreseeing the part to be played by each word he uses and the place to be taken by each sentence he utters. On the other hand, the uneducated man, though shrewd and well-informed, will relate facts and events as they recur to him, generally in disorder; in his effort to recollect and in his attempt to rectify forgetfulness he will pause irregularly, filling the intervals with meaningless phrases, such as "and then ", "and: so ", or 'said he to me", "said I to him"; and even the contipuous parts of his story will be told confusedly-because he has not learned the proper use of words.* My own experience as an editor of technical manuscripts has taught me that the misuse of 'that' and 'which' is a fruitful cause of obscurity and confusion. The relative pronouns have distinct functions, and no writer can express himself clearly until he has learned to discriminate between these I functions. For example:

I. INTRODUCTION. IN the summer of 1908, R. B. Cochran, Superintendent of the Compania Metalurgica Mexicana at Sierra Mojada, Mexico, presented to the Department of Geology and Mineralogy at Case School of Applied Science an interesting series of silver-, copper-, and lead-ores from the Veta Rica mine. These ores contained several interesting minerals which were associated in a somewhat peculiar manner, so that I was impelled to make a closer study of their occurrence. The investigation has brought out several new facts concerning the geology of the district and the geological occurrence of the ores, and therefore has seemed worthy of record. Two papers have been published previously about the region, one by Chism1 in 1887, and the other by Malcolmson2 in 1902. These articles, however, treat of the district more from the stand-point of the metallurgist and mining engineer, and not much attention is devoted to its mineralogy and economic geology. II. GEOGRAPHICAL LOCATION OF THE DISTRICT. The Sierra Mojada is situated in the extreme western part of the State of Coahuila, near the Chihuahua boundary. It is reached best via the Mexican Central railroad from El Paso, Tex., to Escalon, Chihuahua, a distance of 494 miles. From this point, a branch line, the Mexican Northern railroad, runs 78 miles in a NE. direction to the mines, which are its northern terminus. DEFENSE Materials Procurement Agency has been moving rapidly to encourage copper industry expansion programs. Although copper production is at a high level, a shortage exists on a world-wide basis as well as on the domestic scene. Projected expansion programs will not ease this current demand for most of them are 2 to 5 years off. Refining facilities are adequate but there is a shortage of ore and scrap, and it is for this reason that the expansion programs are directed at developing more sources of supply. The domestic expansion programmed thus far and understood to have been arranged with price escalation should the domestic price go to 271/20, were summarized by American Metal Markets as follows (dates of announcement are given in parenthesis: .1-Copper Cities Mining Co.'s, $15,000,000 expansion near Miami, Ariz., to be operating about 1954. DMPA will buy 22,500 tons of copper a year up to a given amount on an agreed price of 23¢ per pound, with some exceptions and depending upon salability at a higher price to other purchasers in the U. S. (September 25th). 2-An RFC loan of $60,000 to North Butte Mining Co. to be paid off on the basis of deliveries at a purchase price of 241/20 per pound (September 25th). 3-A $25,000,000 expansion program by Phelps Dodge to provide 38,000 tons per year by late 1954. DMPA would purchase it at a price of 22¢ per pound up to 112,500 tons providing other purchasers in the U. S. will not pay a higher price (September 26th). 4-Anaconda Copper Mining Co. $40,000,000 expansion in Nevada to provide more than 30,000 (might be increased to 45,000) tons per year. DMPA would purchase the copper at 250 per pound for a limited period of time if it is not salable to industrial users at above this price. Production would start around 1953 (November 14th).

The influence of precipitation from solid solution on the subsequent deformation resistance of alloys is well known. However, the influence of precipitation or aging that occurs simultaneously with deformation may be entirely different and of considerable importance. It is thought1 that the presence or absence of a yield point jog in impure iron at room temperature and the presence or absence of discontinuous flow at higher temperatures may be directly related to aging phenomena, particularly since the yield point jog is absent when the carbon and nitrogen are sufficiently removed.2 As a preliminary attack on the problem of simultaneous aging and deformation, three kinds of tests—constant strain rate tensile tests, constant load creep tests, and variable strain rate tensile tests—were carried out on an age hardenahle aluminum alloy. Constant Strain Rate Tensile Tests Stress-strain curves at a strain rale of about 0.001 min-1 were obtained for specimens of 61S that had been quenched into liquid nitrogen after a one-hour solution treatment at 521°C, then aged at room temperature 10 min., 20 min., 4 hr, and 26.5 hr before testing. Strain-time curves were obtained on the same chart with the stress-strain curve by means of an auxiliary pen, driven parallel to the axis of the chart drum at constant speed by a synchronous motor and gear chain. The angle of rotation of the chart drum was proportional to strain. The strain rates reported are the measured slopes of the strain time curves. Constant strain rate was approximated (within a factor of 2) by manual adjustment of the oil inlet valve of the hydraulic testing machine in such a way that the course of the recorder pen was parallel to pre-drawn strain-time lines of the desired slope. The market at present supplied by shipments from the phosphate districts of Quebec, Ontario, and New York State requires high-grade ore, carrying from 75 per cent. to 90 per cent. of phosphate of lime. In sorting out such material by hand, much valuable phosphate is necessarily left in the "culls" or refuse, besides which, much phosphate-rock of low-grade is not now mined at all, because it cannot be made available by the crude method of cobbing and hand-sorting. The utilization of such material, which would, of course, greatly benefit this industry, requires either a mechanical separation or a chemical process which would concentrate the phosphate in a form suitable for agriculture. Considering the rich phosphate now shipped as the first class, we may arrange the lower grades in three classes, as follows: Second Class.—Cull-ore from the first class, and the mass of deposits having, as gangue, pyroxene or hornblende. The following table gives the hardness and specific gravity of the minerals concerned: Hardness Spec. gravity. Apatite,....... . 5 3.1 to 3.25 Crystalline limestone (pink calcite),. 3 to 4 2.5 to 2.9 Pyroxene,..5 to 6 3.23 to 3.5 Hornblende,.5 to 6 2.9 to 3.4 Feldspar (orthoclase),. .. . 6 to 6.5 2.5 to 2.6 It is evident that when pyroxene and hornblende are present in large proportions, this ore cannot be successfully concentrated by crushing and jigging. It may be reduced to fine powder by successive treatment in a rock-breaker and a Sturtevant or Frisbee-Lucop mill, or other suitable apparatus, and in this condition it could be largely used by applying it freely upon exhausted clay soils, such as occur in Quebec and Ontario.
