Eminent domain overview Eminent domain is the power of the Government or a municipality to take property for public use without the consent or acceptance of the owner. Typically, the agency taking the prop¬erty will make an offer, hoping the owner will immediately accept and allow work to begin. If a mutual resolution regard¬ing its value cannot be reached, how¬ever, the municipality will institute a condemnation action in court seeking possion of the property. This is when the problems begin. The power of the Government to take the subject property is limited by Federal and state constitu¬tional requirements to pay "just com¬pensation" for the property. The exact nature of an owner's prop¬erty has been the subject of much debate and discussion. It is generally under¬stood, though, that property is consid¬ered to be "every kind of right or inter¬est, capable of being enjoyed and recog¬nized as such, upon which it is practi¬cable to place a money value" (US vs. 53 114 Acres of Land). A taking, for condemnation purposes, is considered to occur whenever there is a substantial interference with the free use and enjoyment of the property. Rarely is the necessity for the taking ever challenged and more rarely is the taking ever successfully challenged. When a taking occurs, it is not only the fee owner who is entitled to compen¬sation. Every person holding an interest in the subject property will be recog¬nized. Thus, all persons who at the time of taking have a compensable interest in the property will be made parties to the case (Swanson vs. US). Minerals, like all other interests in land, are recognized as property rights, giving the owner the power to dispose of them as he or she sees fit. Thus, the only remaining considera¬tion is only "just compensation." Ex¬actly what "just compensation" is has been difficult to define. Generally, it is that amount of money that will "put the person in as good a position as the per¬son would have been in had the taking not occurred." The owner must not be forced to sacrifice or suffer by receiving less than full and fair value for the prop¬erty. Every element that effects the value of the land and that would influence a purchaser must be evaluated. Courts have employed a variety of techniques to determine just compensa¬tion but have generally relied on market value as the standard for measuring compensation to the owner. The deter¬mination of market value is based on sales, income, costs, and use. These factors have been employed in various ways but can be summed up as: -The highest estimated monetary price the property will bring if exposed for sale in the open market with a reason¬able amount of time allowed to find a purchaser who is buying with knowl¬edge of all the uses and purposes to which it is adapted and for which it is capable of being used. • The amount the property would bring if it were offered for sale by one who desired, but was not obliged, to sell, and was bought by one who was willing, but not obliged to buy. • What the property would bring in the hands of a prudent seller, at liberty to fix the time and conditions of sale. • What the property would sell for in negotiations resulting in sale between an owner willing, but not obliged to sell, and a buyer willing, but not obliged to buy. • What the property would be rea¬sonably worth on the market for a cash price, allowing a reasonable time to affect a sale. (Michigan Standard Jury Instructions). Special consideration regarding mar¬ket value is given when the taking is only partial, rather than complete. An example of this partial taking is when a state highway cuts across the northern half of a parcel of property, leaving the rest behind for the owner. A variety of problems can be immediately seen. In a partial taking, the owner is permitted to recover not only for the property taken, but also for any loss in the value of the remaining property. The measure of compensation for partial taking purposes is generally the difference between the market value of the entire parcel before the taking, and the market value of what is left of the parcel after the taking (Michigan Stan¬dard Jury Instructions). Determining the partial taking value for mineral bear¬ing lands is the difficult issue.

"In this study, physical, chemical and microscopic characteristics of high phosphorus oolitic hematite were studied firstly. Based on which, the new methods of high phosphorus hematite used in the æsolid state reduction by rotary hearth furnace - magnetic separationÆ and iron nugget by rotary hearth furnace direct reduction processes were discussed. The results showed that high temperature, low basicity and high carbon content is conducive for the apatite in iron ore to reduce into molten iron, but not conducive to the removal of phosphorus. Through optimisation of process parameters, dephosphorisation rate of high phosphorus hematite is more than 60 per cent by æsolid state reduction roasting-magnetic separationÆ process while that is up to 80 per cent by iron nugget process. THIS REPORT by the Federal Bureau of Mines presents data on water-supply wells used by waterflood operators in North Texas and shows the distribution of permeable source sediments. Averages of well characteristics, including static fluid levels, working fluid levels, net thicknesses, producing rates, and depths, are presented and discussed. Essentially all water used in waterflooding is mineralized water from consolidated sediments. This study is concerned with the geology and distribution of these mineralized source sediments, whereas previous work in this area was predominantly a study of shallow sources of potable water. Tables, isopachous maps, and electric-log cross sections are included to describe the several source aquifers. In general, water-producing capacity increases with depth of the sediments. Wells completed in Cretaceous sediments 82 to 600 feet deep yield 50 to 600 barrels of water daily, whereas those completed in Pennsylvanian sediments 360 to 4,110 feet deep yield 100 to 7,000 barrels daily. Although deeper formations are used where oil and water are produced conjunctively and where large withdrawal rates are required, insufficient well data prevented mapping of deeper formations.

Variations in water percolation rates through saturated cohesionless hydraulic backfill (mill tailings) have been studied in relation to the many physical aspects of the system to determine the most important factors in causing these variations. A multivariable least-squares regression analysis of 135 separate tests shows that a reliable estimate of the water percolation rate through typical hydraulic backfill can be made if the bulk density (unit weight), specific gravity, and grain-size distribution are known or can be estimated. Equations for predicting percolation rate, coefficient of permeability, and seepage velocity are developed both for the range of data analyzed and for extrapolation. The prediction equations for use within the range of data studied are quite accurate, while the ones developed for extrapolation are less accurate but still give reasonable approximations of flow rates. The equations given are valid for cohesionless materials that are free of clays and micas, exemplified by classified mill tailings. The equation developed for predicting percolation rates is as follows: 1nP20 = 11.39147 + 2.853422 1n(VR X D10) + 0.1747436 VR X Cu -178.8039 D10 X D50 + 311.7034 (DSO )3, (1) where P20 = percolation rate, inches per hour at 20° C; correction factors for other temperatures are given in the text, VR = void ratio, dimensionless, D10 = effective size (diameter in millimeters of the 10-percent-finer grain size), Cu = coefficient of uniformity (ratio of the diameter of the 60-percent-finer grain size over D10), D50 = average size (diameter in millimeters of the 50-percent-finer grain size), and In = natural logarithm (log to the base e). The prediction equation for percolation rate is rather complicated, so for practical use a nomograph that simplifies the solution of the prediction equation was developed.

"In mechanized mining, poor equipment efficiency (availability, utilization, productivity, and quality) can endanger the success of the operation. This case study will show how an initiative to improve equipment performance developed into a comprehensive turnaround plan for the mine that placed it in the forefront of performance achievement.As part of a company-wide review process, poor overall equipment effectiveness (OEE) was identified as a major reason for the mine not achieving its targets. A project to improve the OEE identified eight improvement areas (elements) that contributed significantly to the poor performances. Measurement metrics were determined for these elements, followed by determination of baseline and target (improved) key performance indicators (KPIs). Cost savings associated with the improved efficiencies were calculated and tracked throughout the project. The mine team determined the specific actions required to achieve the target KPI in each element. These were individually developed and managed like mini-projectswith allocated responsibilities for delivery. The paper will indicate how this OEE improvement initiative triggered an improvement in almost all sections of the mine. Soon after launch, the initiative gathered momentum as the KPIs starting to improve. A visible tracking system exists at the mine and each employee can see the improvements and feel the success. The original eight elements were extended by five more, and the mini-projects grew as participants saw the success of the initiative.This paper concludes that through management and worker involvement, visible measurement and controls, and carefully chosen improvement elements, the mine was turned around. It is now achieving and exceeding its targets, and employee relations and motivation as well as safety have improved considerably. All of these achievements are reflected in the bottom line."

Ultra fine grinding is becoming increasingly used in the mining industry over recent years. The development of large-scale units for high volume grinding of low value materials and concentrates has opened up new areas of economical metal extraction. The ability of stirred vertical mills to produce very fine particles with high surface areas, is providing mine operators with novel extraction possibilities within gold concentrate regrind for Biox or leach feed, Activox autoclave feed preparation and lime slaking operations. The paper will review design, operational and maintenance aspects of ANI-Metprotech stirred vertical mills, comparing these to tower mills, horizontal bead mills and attrition mills.

This paper will focus on two topics, namely (1) an innovative process for the neutralization and partial sulphate removal of acid streams produced during coal mining and processing and (2)optimization of this integrated neutralization process by adding small amounts of synthetic organic polymers. The integrated lime and limestone process has been developed to neutralize acid mine water and to remove sulphate (to less than1 200 mg/l), magnesium and metals. Limestone and lime treatment is the most cost-effective technology for neutralization and partial sulphate removal of acidic/sulphate-rich water to sulphate levels of less than 1 500 mg/l due to precipitation of magnesium and removal of the associated sulphate fraction (through gypsum crystallization). Neutralized mine water of this quality may be suitable for irrigation. The process consists of the following stages: 1. Limestone (CaCO3) neutralization to raise the pH to 7 and CO2-production. 2. Lime (Ca(OH)2) treatment to pH 12 for Mg(OH)2precipi-tation and gypsum (CaSO4.2H2O) crystallization. 3. pH adjustment with CO2recovered from stage 1 and CaCO3 precipitation. Retention times of 1 hour, 4 hours and 1/2an hour were required by stages 1, 2, and 3 respectively. The sulphate level was reduced to 1 094 mg/l, which is less than the original aim of 1 200mg/l. Chemical costs associated with neutralization, using limestone instead of lime, are reduced by 69% in the integrated limestone/lime process. The overflow water from the clarifier of each of the above stages generally contains a wide variety of colloidal impurities that may cause the water to appear turbid or may impart colour. This results in very slow sludge settling rates that cause overflow water with a high degree of turbidity and colour. There are a number of successive or simultaneous stages involved in the agglomeration of particles. To get optimum neutralisation of the acid water and partial sulphate removal to below the saturation level of gypsum (i.e. 1 500mg/l), maximum sludge recovery is needed. The higher the concentration of seed crystals, the larger the surface area. Therefore, effective removal of suspended and colloidal matter from the overflow of each stage is required and can be achieved by coagulation and flocculation. The polymers PAC6 and 3095 were effectively used as coagulant and flocculant respectively. The addition of these polymers resulted in a clear overflow in each of the above stages with a very low turbidity.

The Jabali zinc deposit, in Yemen, contains at least 9.4 Mt at a grade of 10.7% zinc, 2.2% lead and 77g/t silver. The zinc occurs as smithsonite with minor hydrozincite. The Jabali ore does not produce a zinc concentrate of sufficient grade to be acceptable to conventional smelter/refineries, and it has been necessary to formulate a less conventional development plan. This involves the construction of a mine and concentrator at Jabali and a metal production facility using a new flowsheet designed specifically for the treatment of oxide material, at Yanbu, in Saudi Arabia. In order to give the facility the necessary economies of scale, the Jabali concentrate will be supplemented by feed from other deposits, this may be either oxide or sulphide material. The paper outlines the geology and proposed mining and treatment operations at Jabali, the flowsheet for Yanbu and presents preliminary costs for both operations

The action of water on a number of Queensland shales which are associated with particular coal measures and oil shales has been studied. The results suggest that the disintegration of some of the shales could cause significant problems in mining and preparation operations. The extent of shale breakdown varies widely from deposit to deposit and from seam to seam but a suitable assessment procedure utilises the test described in AS 1661-1979, and an improved method of presenting the results is described in the paper.

This report describes an investigation of the technical feasibility of using a conventional commercial-size (10-ft. i.d.), rotating grate, dry-ash-removal type gas producer to make producer gas from chestnut-size bone anthracite. Test instruments were installed, and some minor changes were made in the equipment to handle the large quantities of materials expected. Extensive tests, lasting about 4 weeks, were planned, using 35 to 50 percent ash chestnut anthracite bone. However, operations were suspended after 8 days when it became apparent that to use this type of fuel satisfactorily substantial changes in equipment and operating procedures would be required. Nevertheless, enough data were obtained to indicate that gas could be produced continuously and routinely from bone coal in this type of producer whenever conditions justified the necessary development work.

The objective of this contract was to conduct characterization, evaluation and/or calibration studies of instrumentation used for measuring the quantity of respirable dust in mining atmospheres. Initially, this work involved the upgrading and detailed evaluation of the aerosol test chamber and the development of impactors with respirable classification characteristics. These were used as standards in the chamber for measuring the quantity of respirable dust based on either the ACGIH or BMRC respirable dust criteria. A program was then conducted to calibrate several photometers. In addition, the mass sensitivity of the GCA RAM-1 photometer to water droplets in the respirable size range was determined. Three additional studies were also made in this program. First, an experimental study was performed to ascertain the effect of crosswind, cyclone orientation and particle size on particle sampling and penetration through the 10 mm Dorr-Oliver cyclone. Second, a theoretical study was conducted to refine the theory used to predict the particle collection characteristics of impactors. Third, filter samples with known quantities of diesel and coal particles were produced and delivered to the B. of Mines for testing a Raman scattering analysis technique to discriminate diesel particles in the presence of coal dust.

NO new ferrous alloys have been produced in the last five or six years that are as outstanding contributions to civilization as were the high-speed steels of the early part of the century or the stainless steels announced at the close of the World War. There have been, however, many developments of major importance having to do either with modifications of existing alloys or with new methods of treatment of older iron or steel alloys. Only a limited number of these new developments can be discussed and their selection does not necessarily imply that these are the most important but merely that they are of general interest rather than perhaps of greater importance in highly specialized fields.

An effective prototype face support system to minimize rockfalls in rockfall-prone mines was developed and patented during a project sponsored by the Mine Health and Safety Council (MHSC). An experimental development model (XDM) roof support unit was developed and evaluated. Mines with rockfall problems in the face areas can use the roof support system to reduce fatalities and injuries in the face area of stopes. The roof support system consists of two similar support units connected to each other via two crank mechanisms. Each unit consists of a headboard supported by a ?wishbone? structure (top and bottom leg). In the first design a threaded bar with struts similar to a scissors jack keeps the legs apart. (In the final version that was field trialed, the threaded bar mechanism was replaced with a hydraulic cylinder). All the components are manufactured from steel. To move the system forward the first support unit is collapsed, the second remaining in the loaded position. The first unit then hangs from the second unit to which it is connected. The first collapsed unit is then manually cranked forward and prestressed. If the required position is still not achieved, the other unit is released and moved forward. The specification for the system was determined and presented at a workshop with industry participants. Different concepts were developed and evaluated against the system specifications. A technology demonstrator was then developed and tested on surface. The technology demonstrator development process included detail design, building and testing of components and subsystems, design reviews and the building and commissioning of the technology demonstrator. The testing of the technology demonstrator was done in a 500-ton hydraulic press, in a mock-up stope and underground. A risk analysis, in which technical, logistical and economic aspects were assessed, was done to determine the critical areas of the system. During the next phase of the project working prototypes were developed for underground tests and evaluation. This process indicated that it was necessary to adjust the system specifications and a redesign was called for. In an iterative process test units were built for purposes of evaluation, specification verification and field trialing. After the successful conclusion of the trials the equipping of a complete production stope started for purposes of integrating the system into the current mining process.

It's my pleasure to welcome the Rocky Mountain Coal Institute to Montana. Now that you've ended a 74 year history of meeting outside our borders, I hope you'll be back more often. Even if I can't convince you to come back before 2060, when another 74 years will be up, I'm confident the Kalispell and Flathead Lake area will do the persuading for me. In recent weeks, I've made a number of speeches around the state pointing out just how wrong the revenue projections in Montana's state government made in April of '85 were when we came to April of '86. Since the middle of this month, Montana's legislators have been in Helena struggling to balance a state budget that, by the end of fiscal year '87, threatened to be some $88 million in the red. Other western states reliant on natural resource and agricultural economies have found themselves caught in the same deflationary spiral. The "window of opportunity" I proposed and the 1985 Montana Legislature passed, couldn't have been opened at a more difficult time. What was envisioned as an incentive to expand Montana's coal production, and our tax base, ran aground on low oil prices and excess hydroelectric power. De- spite the one-third severance tax rebate offered on new coal production, year-to-date figures published in the June 2nd Coal Week show that production in Montana is down almost 10 per- cent from last year. Again, we're not alone. Production in Wyoming is down 8 percent and in North Dakota, it has dropped 13 percent. An over- all 3 percent production decline in western states looks even worse when contrasted against a 12 percent increase for your eastern competitors. Montana's "window of opportunity" had the potential to be a significant signal to your industry. That potential was quickly tempered by the inability of Arab nations to stabilize world energy prices. If any of us had forgotten, the last twelve months have reminded western states that the well-being of our natural resource economies has a tremendous impact on the ability of all levels of government to provide services. The past year has also driven home that in the world of business and in the business of the world, risk-taking is still the name of the game. The Western Governors recognize the problems facing this industry - and our states - and we're prepared to fight for the future of western coal. In the past two decades, legitimate environmental concerns have created a vast body of new legislation affecting coal producers. The industry has been required to meet new reclamation standards - tough regulations relating to ground water, air quality and wildlife habitat. To the industry's credit, coal companies have hired professionals with the technical know-how to do it right. Rather than considering reclamation laws to be an unreasonable burden, today's coal company is more likely to view its reclamation efforts as a source of corporate pride. In a sense, the industry and the agencies which regulate it have matured together . . . although at times OSM is reluctant to admit that either of us capable of or willing to play by the rules. Certainly some abuses exist and OSM's oversight has been helpful in ensuring parity between those states willing to comply and those that would rather defy federal law. Nonetheless, penalizing the more modem and responsible western coal industry for abuses that occur elsewhere is both unfair and counterproductive. Federal penalties range from "cruel and unusual" reporting requirements to the proposed electricity tax that would effectively force utilities and ratepayers who have already met the sulphur emission standards to subsidize those who have dodged their cleanup responsibilities. Several economic factors have caused the surface mining industry to require large-capacity shovels and trucks for efficient, high-production, low-cost operations. Some of those factors include technological advancements in equipment, commodity market depressions, increased labor and maintenance costs, contractural obligations and harsh operating conditions. The difficult operating conditions in surface mines, however, pose challenges to the use of high-capacity equipment. They include space limitations, weak over-burden, and weathered soils and rocks. So mining companies face major challenges in selecting appropriate shovels to meet the technical, operating, safety, environmental and economic requirements of their mines.

Reduced workability and flowability of the concrete through the tremie tubes and drilled shaft reinforcement have been identified as the main causes of tremie-concrete drilled shaft concrete defects. This paper discusses two recent case studies of defective tremie-concrete drilled shafts. The defects (soft inclusions, aggregate segregation, and low concrete strength) were primarily caused by the combined effects of the tremie placing sequence, rapid concrete slump loss, and poor passing and blocking characteristics of the approved concrete mix design. The level of detail contained in the drilled shaft specifications varied between projects. However, even when the specifications incorporated several of the more recent recommendations for tremie-concrete placement, the case studies showed that typical provisions for concrete mix proportioning and placement can be further improved to minimize construction defects such as those described in this paper. Based on the findings of the case studies presented, recommendations for the development of more effective specifications are provided. The recommendations include requirements for mock-up testing of proposed concrete mix designs and evaluation of the tremie-concrete placement sequence. Performance of such testing and evaluation would greatly reduce the potential for drilled shaft defects and consequent time and financial burdens associated with them.

The paper describes the search for mineral deposits in an area of 4,500 sq. miles of south-west Tasmania. The area is one of difficult access and the problem of speedy movement and maintenance of field parties was solved by the use of helicopters. The programme has followed a systematic pattern of the aerial photography of the exploration area with the preparation of photQmosaics and topographical base sheets from these mosaics. Geological maps were initially prepared by photogeological interpretation and making use where possible of pre-existing information. The maps produced were later checked by ground traverses. Geophysical maps were obtained by the use of airborne magnetic, electromagnetic and radiometric methods. Geophysical and geological anomalies were checked on the ground by a campaign using ground geophysical equipment in the former case and geological and geochemical work in both instances. Audio Frequency Magnetic and Induced Polarization techniques were used in an area which was covered by several hundred feet of Tertiary sediments.The campaign has reached the stage of the drilling of specific targets.INTRODUCTIONThis paper describes the activities of Lyell-E.Z. Explorations (L.E.E.), an organization which was formed in 1956 by the Mt. Lyell Mining and Railway Co. Ltd. and the Electrolytic Zinc Co. of Australasia Ltd. to explore for mineral deposits in an area of approximately 4,500 sq. miles in southwest and southern Tasmania. To provide the necessary personnel and equipment for this project the exploration resources of both Companies were pooled and augmented and a headquarters was established in Queenstown. The work was directed by a Committee of four made up of officials from both Companies; a review of this structure has recently been presented by Hall (1959).

Physical testing of rock support for rockbursting conditions has been carried out for over 40 years. A review of this testing shows that it has been mostly component?based, rather than actually testing support systems. Further, it is concluded that none of the testing is truly representative of rockburst loading in a similitude sense. Similitude conditions are not achievable, mainly because the real conditions in a rockburst event, such as seismic source location and magnitude, wave frequencies, amplitudes, and interactions, are not all known. Because such information is not available, and because the results of all testing carried out to date have not been able to define, for support design purposes, the capacity of support systems, ongoing physical testing of rockburst support systems is essential. It is essential that the test should simulate, or actually take place in, a supported rock excavation. A rock support system is a combination of individual support components that work together to retain and contain the rock. In doing this, the components are subjected to loading by the rock and to interactive loading between one component and another. It is necessary to prove the capacity of such rockburst support systems by subjecting them to severe loading, as in direct blasting. The direct blasting approach, pioneered more than 40 years ago, probably still provides the greatest validity as a significant test of rockburst support capabilities, even though it does not simulate a rockburst.
