Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement

We all deplore the high accident rate of our coal mines, but when brought to task we immediately attempt to appease our conscience by calling attention to the high tonnage rate per fatality in American coal mines as compared to European mines, losing sight of the fact that the accident rate per hours of exposure has shown no improvement during the past twenty years. Measuring our accidents in terms of hours of exposure, not in terms of production, is the only correct method. Certainly it can be of only scant satisfaction to the miner to know that his chances of getting killed this year are as great, or perhaps greater, than last year, but the tonnage rate per fatality will have gone up. We cannot help asking ourselves why it is the other major industries, almost without exception, have made wonderful strides toward reducing accidents, while coal mining stands alone as the one major industry in which no improvement has been made. It certainly cannot be charged entirely to the increased use of machinery and the increased productivity per man employed, as the other industries likewise, or to an even greater extent, have increased the use of machinery and the production per man.

Freedom from whatever exposes one to danger or from liability to cause, danger, or harm; safeness: hence, the quality of making safe or secure, or of giving confidence, justifying trust, insuring against harm or loss. (From Webster.) The meaning of the word "Safety" by Webster is very explicit, clear, and plain. It is not obscure or imperceptible. What man, woman or child is not familiar with this word? A mere word by itself, but indifference to its significance means the difference between life, death, permanent or partial disability, or injury. There is no question about a safety program being expensive. It is-it produces no commodity-but when properly organized and with a definite goal in view it will pay 'a dividend by increasing the efficiency of the human worker.

The two most talked of questions in the mining industry today are rock dusting and mechanical loading. The one as a matter of safety, and the other as a matter of economy, and both are of vital interest to the mining fraternity. Rock dusting and other safety methods will be dealt with by others at this meeting, so I will confine my few remarks to the matter of mechanical loading. I will not attempt to tell you what mechanical loaders are doing in the different mining fields throughout the country, or what they should do, but will endeavor to give you an outline of the work being done with mechanical loaders in No. 4 Mine of the Union Pacific Coal Company, at Hanna, Wye. In order that you may better understand and be in a position to follow me it will be necessary to cite the conditions under which we are working. and the type of loaders in use. The seam pitches from 14 to 17 degrees, and is normally 32 feet in thickness, and is overlaid with a soft sandstone roof. The panel system of working is used, planes being driven on the pitch, and rooms driven on the strike. Owing to faults being encountered planes are driven between the faults, and the. rooms on either side are in some instances 800 to 1,000 feet in depth. Rooms are advanced eight feet in height, and 32 feet in width, by hand loaders and .Toy mechanical loaders, and when driven to the boundary,, 18 feet of the remaining 24 is loaded out with Thew electric shovels, and six feet left to protect the roof. In January, 1916 the company installed a Type 1 Thew shovel, equipped with a 1 1/4-yard dipper, and in July, 1917, they installed a Type 0 Thew electric shovel, equipped with a 1-yard dipper, and in the year 1918 two additional Type 0 Thew shovels, equipped with a 1-yard dipper, were installed, making a total of four Thew shovels for this mine. The introduction of these shovels caused the employees much concern, and like all departures from the old methods of mining, met with indifference by some and open antagonism by others, so that for some time they results obtained were not satisfactory. However, by constant supervision and changes in the method of haulage the results obtained at present, while not entirely satisfactory, are much better and the production and costs are reasonably good. The Thew shovels in use are mounted on traction wheels with swivel axle and move. in all directions by their own power, and while the weight of each is approxi¬mately 20 tons, they are not as cumbersome as. one would think and are easily operated. The system used in working these shovels is to shoot the coal clown ahead of the shovels and maintain two tracks, two cars being used on each track so that shovel is loading on one track while driver is, changing cars on the other. When place is finished the shovel is run back to the first cross-cut by its own power and lowered to the next room with block and tackle, the roof coal in cross-cut being shot down to a height of 16 feet to allow passage of the boom. With better results from the Thew shovels we soon realized that it was necessary to find some method of developing rooms faster than was being done with hand loaders in order to keep the Thew shovels in working places, and in November, 1923, the company purchased from the Joy Machine Company two Type 4 B U Joy loaders, and the installation of same met with the same indifference and antagonism from the employees as did the Thew

it may be clearly seen that one of the most rapidly increasing items in mining operations is the cost of the timber alone, to say nothing of the cost of installation. Consequently, any practical means that may be used to lengthen the life of mine timber will greatly tend to decrease mining costs and result in important economies in operation. The four principal agents by which mine timbers are destroyed are, decay, insect attack, fire and mechanical abrasion. Decay and insect attack are credited with more than 50 per cent of the total amount of timber destroyed in the mines. Numerous methods may be used to conserve mine timbers, such as better selection, preparation, storage and segregation. It frequently happens that good timber goes into places where poor timber would do as well, and timber of inferior quality is sent into places where only the best grade should be used. However, the most effective method of conservation is by treatment with some standard preservative to prevent decay. Some of. the benefits to be noted from the use of preserved timbers are; the reduction in operating costs by decrease in timber purchases; cuts down interference with mining operations due to timber failures on main haulageways; prevents excessive falling of roof in entries by maintaining timber in sound condition; conserves timber supplies and makes possible the utilization of inferior woods; reduces the danger of mine accidents; improves mine ventilation; lessens fire hazard. Our experience thus far with preservatives, while not of a sufficient period of time to establish just what length of life we may obtain from timber so treated, results obtained during the past four years indicate that the intelligent use of preservatives will effect sufficient economies in mine timber costs to justify the expenditures made for this purpose. MR. BAKER (Concluding): Now, if there are any questions you gentlemen would like to ask about our particular operations, I will attempt to answer them. J. H. EMRICK (Sullivan Machinery Company, Denver, Colo.) ; I was wondering how much penetration you get. MR. BAKER: We get between one-sixteenth and one-eighth of an inch; it is a dipping process. With pressure treatment you get-a greater absorption; that is, better than one-sixteenth of an inch. As long as there is no mechanical abrasion, it seems to serve the purpose. MR. EMRICK: Does that apply to the condition of the timber before it is treated? If it is perfectly dry, will it absorb more treatment than if it is partly green? MR. BAKER: Certainly; one of the things we do is to have it thoroughly seasoned before it is put into the preservative. We put some green timber into the mine once, and the fungus went after it right away. MR. EMRICK: What was the difference in the depth reached by the preservative? MR. BAKER: It hardly penetrated at all when it was green. It has to be sound and well seasoned. MR. EMRICK: How long was the timber dipped or treated? MR. BAKER: According to the seasoning. If it was well seasoned, it was left in the hot bath for an hour; if not so well seasoned, it was left for about a couple of hours. C. M. BILLINGTON (General Superintendent, Rocky Mountain Fuel Company, Lafayette, Colo.): Have you found it necessary to treat timber that has been charred? MR. BAKER: No. However, I suppose it has the sane effect; in lots of places they char timber for the purpose of treatment. MR. BILLINGTON: Have you ever tried lime and salt? MR. BAKER: No, this is the only thing we have tried, the creosote and the Aczol; the Aczol is a foreign product. WM. LITTLEJOHN: Which I is preferable, the Aczol or the creosote? MR. BAKER: I couldn't say as to that. MR. LITTLEJOHN: Have you had any tests as to the value of either? MR. BAKER: We have had some of the Aczol timbers in service for a little over four years; we have had some creosote timbers in service

Profiled below are the eight RMCMI 1999 Scholarship Award winners. Seven of the eight attended the 95th Regular Meeting and convention at Crested Butte, Colorado in late June. Each spoke during the Scholarship Awards Monday luncheon and shared their goals with attendees. In addition to receiving a $1,500 tuition credit, thanks to the Patrons of the Institute annual funding of scholarships, each received recognition at the luncheon with a brass plaque signifying this honor. The winners are guests of the Institute Sunday through Tuesday and have an incredible opportunity to meet many in the coal industry who could be potential employers. The state vice presidents host the winners and pay for their travel and hotel expenses. This is a continuing scholarship and may be renewed for tuition credit again in the senior year if they remain a full time student and if recommended by the dean of their college or university. A resident from each of the eight member RMCMI states is selected by the Scholarship committee from Board approved institutions. Criteria for these annual awards is that the recipient (1) is a full time sophomore student who will use the tuition credit the junior year. (2) Be both a U. S. citizen and a legal resident of the member stare. (3) Maintain good academic standing, be pursuing a degree in a mining related field and have an expressed interest in western coal as a possible career path. Contributions to this worthwhile project are tax deductible to each individual RMCMI member or his company. Through donations of $100 or more to the Patrons of the Institute, each Patron receives a plaque and a year bar for each additional year contributions are made. He resides with his wife, Karen, and children Morgan, Nicole and Scott. Spending twelve years as a mechanic and semi-truck driver, Alan decided to return to school to pursue an engineering degree. Having maintained a 4.0 G.P.A. at Arapahoe Community College, he was accepted at CSM where he continues to excel. He firmly believes that the future of our country will be enhanced by our ability to utilize our natural resources. Alan enjoys time with his family, fishing, water skiing, bowling and reading Tom Clancy or John Grisham novels.

A symposium concerning "The Image of the Coal Industry" was presented at 2:00 p.m. in the Conference center and chaired by Charles W. Margolf, RMCMl Program Chairman and Vice President, Western Coal Development, W. R. Grace & Co. MR. McKEEVER: I'd like to do one thing and that's to introduce our Program Chairman, Charlie Margolf, who will be handling this portion of the program. Charlie and I have been acquainted since late 1973. He has worked together with me on several projects at W. R. Grace here in the west; a dear friend and one that I just want to say thanks to again. I think I have a little token of that appreciation here for Charlie. Here you are Charlie. (present given) I turn the command over to you. Mr. Margolf, a native of State College, Pennsylvania, received a Bachelor of Science Degree in Industrial Engineering from Pennsylvania State University in 1950 and a Juris Doctor Degree from University of Pittsburgh School of Law in 1953. His professional experience has beem as an attorney in the Law Department of Reynolds Metals Company, Richmond, Virginia, where he served as legal counsel to the Geological Department the mining subsidiaries of the parent company both foreign and domestic, the Power Department and the Oil and Gas Division. He was closely associated with Reynolds Mining Corporation's project at Lake DeSmet, Wyoming, from its inception in 1954 and became Manager of the Wyoming Division of Reynolds Mining Corporation when it was established in 1966, holding that position until September 1972 when he joined Cameron Engineers, Inc. of Denver, Colorado as Vice President in charge of its coal, water and environmental activities. Mr. Margolf joined W. R. Grace & Co. in January 1974 as Director of Western Coal Operations. Memberships are held in the Virginia Bar Association, the Wyoming Bar Association, the American Bar Association and its Section of Natural Resources Law, the Wyoming Engineering Society, the Colorado Mining Association, the Rocky Mountain Coal Mining Institute which he has served as vice president for Wyoming, the Society of Mining Engineers of the American Institute of Mining, Metallurgical and Petroleum Engineers, the Minerals Information Committee of the Denver Chapter of AIME and the Denver Coal Club which he has served as Chairman of its Board of Directors. He has also been a member of the Montana Coal Council and served as a director, the Wyoming Water Development Association which he has served as a director for industry and as first vice president and the Wyoming Mining Association. He has been reappointed by Governor Lamm to the Governor's Scientific Advisory Council. He was appointed by the Federal Power Commission, Gas Policy Advisory Council, to its Supply- Technical Advisory Task Force - Synthesized Gaseous Hydrocarbon Fuels and served as Vice Chairman of that Task Force. He has been reappointed by the Secretary of the Interior to the Solid Fuels Unit, Department of the Interior, National Defense Executive Reserve. He also serves on the Advisory Council to the Industrial Ecology Institute of the Colorado School of Mines and was recently elected a member of the Board of Directors of ROMCOE (Center for Environmental Problem Solving). Chairman Doc, distinguished guests, and fellow members of the Rocky Mountain Coal Mining Institute: It's a genuine pleasure to meet with you again at the 54th regular meeting. I might add that it is always pleasant to be at the top of the batting order. The field is wide open since there is no danger of repeating something already said. At the same time, I am aware that the lead-off speaker has a responsibility to avoid stepping on the toes of subsequent speakers. I promise to confine my remarks to areas other than those to be covered by the well qualified speakers that follow. During our meetings at this convention, many fine papers will be presented. Our thanks are due Bob Williams and his hard working program committee for the superior selling that brought so many eminent speakers to our meeting. And, of course, our special thanks go to Doc Schloss, general chairman of this meeting. Doc and his able colleague, Stan Shubart, have been the spark plugs that fired up all of the arrangements we are enjoying here in Glenwood Springs. I'm sure all of us are appreciative of the many hours Doc has devoted to seeing that our meetings will be pleasant and profitable. When we mention arrangements, we always think of that master arranger, Fred Whiteside, who, as a charter member and secretary-treasurer of the Rocky Mountain Coal Mining Institute, has had more to do with more matters around these parts than just about anyone I can think of.

Bureau of Mines Technical Paper 172, by S. H. Katz and H. C. Porter, entitled "Effects of Moisture on the Spontaneous Heating of Stored Coal", says at the outset, "Spontaneous fires in storage piles of bituminous coal' have been the source of trouble and loss since the industrial utilization of coal began. In Europe the idea arose that spontaneous combustion is more liable to happen during wet weather than during dry. Statements favoring or opposing this idea have crept into the literature. Conflicting conclusions, based on experiment as well as opinions based on observations of various degrees of reliability, are given in most of the recorded discussions of the subject. "Because of the uncertainty of the effect of moisture and its seeming importance among the conditions that affect spontaneous combustion in stored coal, the work described in this paper was undertaken by the Bureau of Mines. The experiments showed that a coal from Illinois oxidized faster when dry, whereas a sample of Pittsburgh coal oxidized faster when moist. These discordant results and similarly inconsistent results from the observations of different investigators may be coupled with the fact that under actual conditions of, storing, both coal and air always contain a considerable amount of moisture." The foregoing report of the investigations of the Bureau demonstrates that the mystery of spontaneous combustion has not yet been solved. This fact adds to the fascination of the subject. I became interested in the matter about ten years ago in observing what was probably one of the best exhibitions of this phenomenon. The old dump at Castle Gate No. 1 Mine contained boney coal and track cleanings generally. In winter when snow fell upon this old dump, the snow was soon melted by the heat of the dump which was comparatively warm at all times. Within 48 hours afterward little blue flames were in evidence on the surface of the pile. Few of the gas feeders were sufficiently constant to maintain a steady flame at any given point, but shifting emissions of gas were ignited one by another, resulting in a continuous popping and apparent running about of the flames. Another interesting exhibition of spontaneous heating was to be seen a few years ago in the storage coal piles of the local sugar factories. This coal was piled in concrete lined pits and the latter were filled with water. However, or this occasion the coal extended above the surface of the water. At every plant where this condition existed the coal was affected heating, and in each case the affected area was in a plane horizontal to and from 8 to 1.4 inches above the water level. The height of the hot area above the surface of the water appeared to be affected by the fineness of the coal. It is well known that oily rags have a tendency to heat when allowed to accumulate in some location protected from free air circulation. For some reason, as yet unknown, this does not apply to petroleum or its derivatives. Now, the most common explanation of spontaneous combustion is that the combustible material oxidizes by being brought into contact with air in the presence of moisture, the theory being that the moisture acts as a catalytic agent. My theory is that spontaneous combustion is due to oxidation of combustible matter by free oxygen carried in solution by a liquid, the oxidation taking place only as, when, and at the place where this oxygen is released from solution by the evaporation of the liquid. Also, this oxidation takes place to some degree regardless of the condition of the combustible-whether it be lump coal, coal dust, straw, wheat flour, coke, or any other combustible but, as the speed of oxidation is directly influenced by temperature, it follows that spontaneous combustion only becomes noticeable or serious in cases where the resulting heat' cannot escape as fast as it is generated.
