Gentlemen and guests of the Rocky Mountain Coal Mining Institute: This is the thirty-second regular meeting of our Institute, and rather than try to make some extemporaneous remarks, I thought it best to write them out, so I could in that way give them to you, and probably give you a new thought for the future conduct of our Institute. The thirty-first regular meeting of the Rocky Mountain Coal Mining Institute was held in Salt Lake City, June 22, 23, and 24, 1932, and due to rapidly changing conditions in the coal industry, subsequent meetings have been postponed from time to time, as many of our members and our Secretary have been tied up with code and labor matters. Since our last meeting, at which was discussed problems of vital interest to all of us, especially the production and marketing of coal safely and economically, and the stabilization of our industry, which has already suffered two years of deplorable conditions, almost two more years have been added to the record, but during the past six months miracles have happened, and an industry which formerly was unable to govern itself, has now, through the aid of our Government, at least learned how to make a proper start in that direction. Whether we like it or not, and whether or not the things being done are in agreement with our various political beliefs, without doubt, we are in a much better position today than prior to this transformation. However, it is a pleasure to all of us to note that safety has not been lost sight of in the interim, and without doubt, as later papers and statistics will substantiate, the period since our last regular meeting has probably shown the most remarkable safety achievement of any period in recent history.

Man's capacity far fretting is endless, and no matter what difficulties we surmount, how many ideals we realize, there is a stealthy pleasure in rejecting mankind or the universe as unworthy of our approval. - Will Durant Until recently, reasons for favoring one or another energy alternative were advanced on the basis of technical considerations and economic realities. However, it is an indication of the cultural climate of our society and growing realization of why energy is our master resource that many citizens have begun to express concern about the social and ethical implications of our energy deci¬sion-making. A vivid indication of this shift toward ethical concerns is reflected in the attention being focused on conservation - even to the point of regarding it as a virtual panacea equivalent to a "free energy resource." Among others, the authors of a publication by Resources for the Future cautions us about the difficulties of defining conservation. They also point out that unrealistic expectations for achieving the high levels of conservation claimed by true believers may boomerang if, at the same time, we are morally required to maintain economic growth and robust productivity for the basic well-being of more people. In its economic meaning, conservation signifies the most economic or cost-effective applications of energy, together with other resources, in a given process or activity. To achieve conservation that is cost-effective, saving energy alone is not sufficient; the cost involved in saving the energy must be no greater than the cost of the energy that is saved. Using its thermodynamic meaning, conservation and efficiency are viewed as constrained by physical laws and measured against ideal limits set by these laws and processes. Since achieving higher levels of technical performance is not without costs, the economic meaning of conservation must be factored into technical possibilities. It is the ethical, equity and environmental meaning of conservation that concerns us here. In its third meaning, conservation consists in moderation as a value which appears inherently worthwhile both in itself and in relation to social choices dedicated to achieving distributive justice. The value of moderation seems predicated on the assumption that natural resources and the environment have fixed, finite, exhaustible capacities for satisfying human needs. Hence norms for moderating human behavior appear to require prescriptions by some authority. Such norms presuppose some agreement on "essential" uses of energy. However, the difficulties of setting behavioral norms loom large, because "... it is as difficult to determine essential energy consumption as to determine what is essential in any other phase of consumption, whether it involves food, clothing, shelter, or recreation." The ethical meaning of conversation is further complicated by a centuries-old argument over the proper exercise of stewardship - i.e., how best to develop natural resources. On the one hand, the preservationist position insists on an inviolate, "hands-off" policy and stands opposed to ongoing development of wilderness areas and mineral resources. On the other hand, the "scientific conservationist" who preaches the "gospel of efficiency" insists on development of resources based on principles of sustained-yield, multiple use and - in the case of competing claims - reserving resources or land for their "higher use." Current confusion reigns among opinion leaders in the environmental movement because they appear to have lost the genius of the original Conservation ethic, developed in the 19th century. They seem to think that conservation is preservation. The question I wish to explore is whether a single-minded, exclusive pursuit of "conservation" in its economic, thermodynamic and preservationist meanings may actually do more harm than good in serving the ethical goals of conservation. Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement

PRESIDENT SHOTT: Gentlemen, the meeting will now come to order, please. Members of the Institute: It is with great pleasure and honor that we welcome you to the thirty-ninth regular meeting of the Rocky Mountain Coal Mining Institute. I assure you that Mr. Krippner, the General Chairman, and his associates have an outstanding program in store for you, and trust it will be of much interest to the industry. I note by the program they have me slated for an opening address, but I am going to defer that, proceed with the remainder of the program, and endeavor to go on schedule and keep matters on schedule as outlined on our program. The first item on the program is the reading of the minutes of the thirty-eighth regular meeting by the Secretary. I might say that it has been customary in the past that we omit the reading of the minutes. If that is not agreeable, we will read them; otherwise, I would like for someone to make a motion that we dispense with the reading of the minutes, inasmuch as they are published in our annual report each year. Loading mechanically has of late become the most widely discussed subject in connection with coal mining and has even equalled. the discussion of safety measures as a topic of interest. The subject has been discussed in the various mining journals and by well. informed persons at the Mining Institutes, so it would appear; that all has been said that can be said until further experiments bring out new lines of discussion. It is, therefore, not the intention to present this article as a technical discussion of the subject of mechanical loading as a whole, but rather as a plain talk on machines with which the writer has had personal contact. In 1919, during the first period of post-war depression, a Pennsylvania coal company employing union labor became interested in the possibilities of mechanical loading with the hope of reducing their mining costs, which were and are yet too high to meet competition from the non-union fields of Somerset and Westmoreland counties. Of several loaders presented for their consideration the model of the Joy loader shown by Mr. Joseph F. Joy, seemed to hold the greatest possibilities, and after extended study, the management decided to invest in a machine of this type. A machine was built, which as far as the writer knows was the only one of its type ever put on the market. This machine arrived at one of the mines early in 1920 and was put to work immediately. It was a forerunner of the present 4-BU and 5-BU types, but differed from them very radically as to design. In general the machine consisted of the familiar Joy gathering arms and a short conveyor which discharged into a steel tank which held about four and one-half tons of coal. This tank was emptied by a second conveyor which placed the coal in the mine car. The object of this conveyor tank was to provide storage room while changing cars and to allow the machine to load on the entry while the room was short. This plan was very efficient and from our experience was worth retaining, but has been abandoned by the Joy Company on account of its making the machine unwieldy. The whole machine was mounted on caterpillar tractors which were driven by two 10-H.P. Westinghouse series wound motors, each having its own controller, the controllers being arranged in tandem so as to be operated by the same handle. This very ingenious scheme which is shown in Figure 4, was supposed to make it possible to steer the loader by the controllers. By swinging the handle one way both motors moved forward, by swinging the handle the other way both motors moved backwards and by twisting the handle as shown by arrows, one motor moved ahead and the other back, thus causing the machine to turn. This scheme proved a failure as the loader was too temperamental and erratic in its operation. After Mr. Joy, himself, narrowly escaped serious injury, this device was taken off and the controllers manipulated separately. This system never proved satisfactory and was abandoned' for

E. H. DENNY (United States Bureau of Mines, Denver, Colorado) In the absence of Mr. Harrington it is my privilege to read his paper, which is in his usual, forcible and sincere style, and it is within the province of this Institute, certainly, to go into it as it concerns safety and efficiency in mining. He brings out some points in his paper that, I think, are well worth the consideration of the Institute. The figures he uses were compiled by Mr. Adams, of the Bureau, and cover a five-year period. However, examination of similar Bureau figures for a ten-year period, or any other long period on other bases brings out similar results. The figures in this paper have been based on the million hours of exposure of accidents, and the figures based on three hundred working-man-day basis, or on tonnage, brings out similar results. This paper is entitled "Accident Record in Western Mines," and it is, in a way, an amplification of Mr. Harrington's letter which was read at the Glenwood Springs Meeting.

Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,
