This paper discusses the potential role of underground space and tunnelling in urban planning in Australia. The paper gives examples of the infrastructure and commercial applications of underground space which have been effectively used overseas but have been slow to be considered as a part of urban planning in Australia. In particular, the paper looks at underground quarrying and underground commercial development and their potential use in the urban environment. Existing sites and potential sites for quarrying and/or commercial use have been classified using a system developed by the author. Underground quarrying may provide some solutions for planning problems involving sand and aggregate supplies, waste disposal and other uses. Commercial development involving underground excavation may be accepted if the cost of underground commercial development can be shown to be equivalent to the cost of above ground development. The paper concludes that one role of the underground construction industry is to promote tunnelling and underground space amongst architects, town planners and planning decision-makers. The Australian Underground Construction and Tunnelling Association (AUCTA) and the Australian Society for Trenchless Technology (ASTT) should be instrumental in actively promoting the use of underground space in society.

Ore reserve estimation is a procedure involving data collection, data storage and judgement and assumptions about geology mining and metallurgy. Calculations are based on these assumptions and an economic analysis on projected cash flows is carried out. Ore reserve estimation must therefore be subjective and will always depend on the extent to which the assumptions used in arriving at the estimate are correct. This paper is an attempt to summarise the many aspects that can contribute to ore reserve problems and to offer some suggestions on how to minimise these problems. For further details on specific concepts readers are referred to the detailed descriptions in the referenced papers.

The use of computational simulation to predict the performance of existing equipment or for the design of improved mineral processing equipment will be referred to as Computational Mineral Processing (CMP) in this paper. The emphasis will be on solving the governing equations for liquid solid flows in complex geometric domains to obtain, typically, the three-dimensional distributions of velocity and pressure for the liquid phase and the velocity and concentration for the solid phase. The underlying technology, computational fluid dynamics (CFD), is very well-developed in other industries (aircraft, car and chemical) and forms a vital part of product design and analysis. The subsequent design of improved mineral processing equipment may also involve finite element structural analysis (FESA). Computational fluid dynamics (CFD) and finite element structural analysis (FESA) are part of the generic discipline of Computational Engineering and Science (CES). Ciment and Scherlis (1993) define CES as `The systematic application of computing systems and computational solution techniques to mathematical models formulated to describe and simulate phenomena of scientific and engineering interest'. Increasing computer power (Kaufmann and Smarr, 1993), is a dominant factor determining the rapid growth of industrial utilisation of CES. This increase is happening at both the supercomputer and the workstation level. Indeed, today's typical workstation, a Hewlett-Packard 735, is as powerful as a CDC 7600, the leading supercomputer in 1970. Future computer architectures are expected to become increasingly parallel (Gartner Group, 1990) allowing a sustained performance of a teraflop (a million megaflops) to be achieved well before the Sydney Olympics in the year 2000. It is recognised that the modem development of most disciplines in the physical sciences rests on the three complementary strategies of experimentation, analysis and computational simulation. As the 21st century is approached the volume of computational simulation, both fundamental and applied, is growing dramatically and the role of experimentation is diminishing. In the area of equipment design, CES provides the following advantages over experimental testing and measurement: 1. lead time in design and development is significantly reduced; 2. CES can simulate conditions not reproducible in experimental tests; 3. CES provides detailed and comprehensive information; and 4. CES is more cost-effective and time-efficient. The ultimate benefit for industry is greater productivity and hence greater profitability. The broader issues in relation to CFD are discussed by Fletcher (1993b). In the five- to ten-year time frame, growth in computer power will make it practical to combine CFD and FESA with optimisation procedures to produce a design process that is almost fully computerised. This paper will examine the prospects for Queensland's non-fuel mineral industries as we approach the 21st century. The opportunity for growth is unprecedented. Exploitation of recent discoveries, proposals and developments in downstream processing are predicted to contribute to a doubling of the State's mineral exports to around $10 billion by the year 2000. In 1995 - 96 the value of Queensland's mineral production was $6 billion, comprising $1892 million metallic minerals, $127 million non-metallic minerals and $4 025 million total fuel minerals. For many years Queensland has been among the world's major producers of copper, silver, lead, zinc, bauxite and mineral sands. Recently Queensland has become an important producer of magnesia. Queensland's ability to compete results from its location close to rapidly developing Asian markets, the diversity of its major minerals and an increasing ability to add value to the resources base using competitively priced energy. Northwest Queensland is one of the richest base metal provinces on earth following the recent discovery of five world-class orebodies. Of these deposits, Osborne (copper-gold) has commenced production and Cannington (silver-lead-zinc) and Ernest Henry (copper-gold) are scheduled to be developed by 1997. Century Zinc Limited and the Queensland Government are negotiating with native title claimants on the development of Century (zinc-lead-silver). Expansion is in progress at the Mount Isa copper mine (renamed the Enterprise) and copper smelter and a high analysis fertiliser project may be developed based on Phosphate Hill. Korea Zinc Company Limited has reached agreement to construct and operate a 350 000 Mtpa zinc smelter/refinery near Townsville. There are future expansion prospects for the vertically integrated major industrial mineral operations based on Weipa bauxite and Kunwarara magnesite. Upgrading of the Boyne Island aluminium smelter will require a doubling of alumina consumption. Downstream processing options for Kunwarara magnesite are being investigated and are expected to lead to increases in production and the manufacture of a range of value-added products. At the Yabulu refinery near Townsville, nickel and cobalt production using imported ore is to be increased and a commercial cobalt plant is to be built. Additional opportunities for further processing and manufacturing are associated with proposed new mines at Ely (bauxite), Skardon River (kaolin) and Goondicum (ilmenite). Recently discovered resources of zeolite and perlite also offer exciting development possibilities. Other manufacturing opportunities such as glass and ceramics based on local and plentiful clay and silica sand could replace imports. Silica sand at Cape Flattery is currently exported and production is expected to double.

Ashton Mining Ltd (Ashton) and Lynas Corporation Ltd (Lynas) have established a joint venture partnership to develop and process rare earth oxides (REOÆs) from the Mt Weld deposit in Western Australia. The deposit is located in a deeply weathered volcanic carbonatite structure that contains approximately two million tonnes of rare earth oxides at an average grade of 20 per cent REO. As part of the 1999/2000 feasibility study currently being undertaken by Ashton and Lynas, an extensive laboratory beneficiation test program was undertaken by CSIRO Minerals on diamond drill core samples from the Mt Weld orebody. The aim was to develop a flowsheet, based primarily on flotation that could be confirmed at pilot plant scale. The target concentrate grade was 52 per cent REO with a REO recovery of at least 35 per cent. Two main ore types, nominated as CZ (limonitic siltstone) and LI (nodular limonitic ironstone) were identified for separate laboratory evaluation. The lower grade LI-type ore overlies the higher grade and more extensive CZ-type ore. The majority of the work was conducted on the CZ ore; only limited testing of the LI ore was undertaken. The latter contains a clay component that will present difficulties in processing due to its poor filtering and settling characteristics. Two processing options for treatment of CZ ore were presented for pilot plant consideration. One (Option 1) includes gravity concentration prior to flotation while the other (Option 2) includes finer grinding and four stages of open circuit cleaning. The benefits of each scheme are discussed in detail. Neither has been fully optimised and the definitive flowsheet is most likely to be a hybrid of the two schemes, incorporating the best features of each. Typical metallurgical results from each scheme were final concentrate grades of 49 per cent REO, 10-16 per cent Fe2O3 and 3.2-4.8 per cent CaO. REO recoveries were above 35 per cent in both cases. Features of the processes developed by CSIRO were the inclusion of a gravity concentration stage prior to flotation, a modified flotation reagent scheme, a change in the method of feed preparation, and incorporation of magnetic separation to upgrade final flotation concentrates. Metallurgical results obtained from flotation tests on LI ore were much poorer than those obtained for CZ ore. The best rougher/scavenger result, with the limited amount of testing so far completed, was an REO grade of 32 per cent with a recovery of 28 per cent. Further work is needed to develop a viable processing route for this ore type.

The decrepitation technique is a rapid means of measuring abundances, temperatures and to some extent the fluid compositions, of fluid inclusions in transparent and opaque minerals. The method has been used to investigate the hydrothermal fluid systems associated with gold mineralisation in the Tennant Creek, Pine Creek and Halls Creek Goldfields. At the Enterprise Mine, Pine Creek, several different stages of quartz veining are distinguished and within these, gradational changes in fluid temperatures and compositions help to define the centre and nature of the thermal system responsible for the mineralisation. In the surrounding Pine Creek region and at Tennant Creek and Halls Creek, the results were applied on a regional scale to characterize outcrops and aid in the discrimination between potentially mineral- ized and barren outcrops. The decrepitation method involves the heating of a small (lgm) sample of crushed and sized grains up to as high as 800 degrees celsius. During the heating the fluid inclu- sions within the grains develop sufficient internal pressure to physically burst, the temperature of such bursting being dependent on the type of fluid and the prevailing tem- perature at the time the inclusion was originally trapped. The resulting tabulation of the number of inclusion bursts per 10 degree temperature interval is plotted as a histogram of decrepitations versus tempera- ture and called a decrepigram. The decrepi- grams frequently show several distinct peaks at different temperatures which are caused by different populations of inclusions in the sample. The areas of the peaks indicate the abundances of inclusions in each population while the shape and mean temperature of the peak provides a guide to the type of fluids involved. Of particular importance in this study is the presence of decrepitation peaks at fairly low temperatures (around 2000 C. These are characteristic of C02 rich fluids which build up internal pressure very quickly when heated. The Enterprise Gold Mine at Pine Creek comprises a number of overlapping quartz vein systems hosted by Burrell Creek Formation sediments. The geology of this mine has been described at this conference by Dann and Delaney, who have defined several distinct stages of quartz veining based on structural, mineralogical and physical features of the veins. For this decrepitation study, 19 quartz samples from the mine and environs, including some from each stage of veining were collected. These results suggest that there are 4 major vein types, within 3 of which additional small variations can be discerned which are due to gradational changes in the temperatures and fluid compositions in the mine area.

In 1944 some ten or so pieces of legislation impacted on the mining industry. Today in excess of 80 in one way or another apply to the Northern Territory miner. This paper will look at the nature of the legislation that has been introduced and the reasons for its introduction. During the Second World War the mining of resources such as iron, tin etc for the war effort set the platform for the subsequent expansion of the industry in the post-war years. Thereafter, the change in attitudes over the years that have resulted from a more conscious public and more responsible governments and developers associated with the recognition of the legal rights of others and the threat of litigation, will be traced. With a major review of the Northern Territory Mining Act currently in progress, this paper will view ANZMEC's foreshadowed preference for a National Code and the NT's intent of drawing some commonalities with other states of Australia to achieve this aim. Finally, the questions of over-regulation and whether existing legislation is complete will be addressed. From this it is foreshadowed how legislation may develop during the lead into the 21st century.

Zinifex Rosebery Mine is a lead-zinc underground mining operation located at the base of Mount Black, on the West Coast of Tasmania. Mining activities at the Rosebery Mine have been undertaken for over 100 years, and it has been operating in its current form for over 60 years. A large surface and underground exploration drilling program over the last 18 months has increased the mineÆs expected mine life from five to 12 years, with expectations that over the next 18 months as the program continues this will swell to 20 plus years. Zinifex Ltd secured Rosebery Mine in April 2004 and commissioned a detailed life-of-mine (LOM) study on all aspects of the operation. One of the most detailed sections of this report was on the state of the current ventilation system. It was identified in this report that for mining at the current depth of approximately 1100 m to continue a minimum 30 per cent increase in ventilation quantity was essential, as well as a likely requirement for a refrigerant cooling plant for each of the two deepest panels, the K and P lenses. It was identified that Zinifex did not have personnel with the expertise in underground refrigeration to manage and implement a project of this nature. A second report was commissioned with Bluhm Burton Engineering (BBE), a South African firm specialising in both surface and underground large-scale refrigeration plants. BBE concluded that two refrigeration plants were required to provide the necessary cooling power in the lower sections of the mine. In 2005, with BBE as technical consultants, Zinifex Rosebery Mine embarked on a project to commission two underground refrigeration units capable of lowering the wet bulb temperature at the decline face by four degrees centigrade. This paper is intended to give the reader an overview of: Rosebery Mine operations,Rosebery underground refrigeration project,technical difficulties associated with implementing an underground refrigeration system, andkey learnings to date.

IN the ordinary course of treatment of pyritic ores or concentrates, whether for the recovery of copper, tin, gold, or any other contents, the removal of some or all of the sulphur contents is almost invariably the first step. The practice is to roast the ore in a current of air so that the sulphur is oxidized to sulphur dioxide and the metal constituents are changed from sulphides to oxides. If it is feasible to produce sulphuric acid in conjunction with the treatment process, the sulphur can be usefully employed; but if this is not possible, then the sulphur contents not only become a dead loss, but tend to be a nuisance as well in the surrounding neighbourhood.The problem of avoiding this disadvantage and making economic use of the sulphur has had attention from the early days of scientific metallurgy, and in the past few years very special efforts have been made both to drive part of the sulphur as such from pyrites and recover it, and to replace the sulphur in the S02 by carbon, with the production of carbon dioxide and precipitation of the sulphur. So far economic success does not appear to have crowned these efforts. In the case of pyrites, of the two atoms of sulphur which go to make the FeS2, the first is very lightly held. Dissociation is effected by heat alone at a temperature which is given by Peters as 5160 C.Now, sulphur and hydrogen will unite or burn together, with the production of sulphuretted hydrogen. It occurred to the writer that, if hydrogen was passed over pyrites heated to the above temperature, this first atom would be snatched away by the hydrogen, and could possibly be economically recovered.The first step consisted of some simple laboratory experiments. From these it was found that this first atom was readily removed, and that the extraction was practically complete. Further, the reaction took place at a low temperature, a dull red heat being sufficient.

The Hunter Valley Coal Chain Coordinator (HVCCC) Limited is the primary planning organisation responsible for the export of coal through the Port of Newcastle, Australia. HVCCC stakeholders include producers (mining companies), rail track owners, above rail operators, and terminal operators. The HVCCC is tasked with coordinating the activities of all the corresponding parts of the coal export supply chain so as to maximise the system efficiency. The HVCCC also has a forward looking planning role: with demand for coal expected to double in the next decade, strategic capacity planning is a core activity for the HVCCC. Optimisation and simulation models are key aids in such activity. They are used to suggest and evaluate infrastructure expansions and operating policy changes. These models require input data in the form of shipping stems, which are arrival streams of ships at the port, together with their cargo types and composition, and date and time of arrival.Although everyone is familiar with the expression ægarbage in equals garbage outÆ, relatively little research is dedicated to the issues surrounding input data generation. In this research we seek to redress this, and have developed a method for generating high quality shipping data. Shipping stems used as input should be realistic, reflecting key characteristics of historical patterns. They should accurately represent future demand scenarios. Yet they should also have controllable parameters that can be used to test what-if scenarios, such as are required by the HVCCC to answer questions about future infrastructure or operational plans.Here we review our process for achieving this, and give a case study analysing the effects of different shipping stems on the performance of the coal chain, as measured by a capacity assessment tool. The latter is an optimisation model that takes shipping stem and infrastructure data as input, and calculates key supply chain performance metrics. The potential benefits of alternative demand management strategies are analysed by measuring the performance of the coal chain given different shipping stems obtained via the stem generatorÆs controllable parameters.

The Golden Blocks Goldfield is located in the Slaty Creek area,North West Nelson, about 20 km west of Collingwood. Alluvial gold was discovered in Slaty Creek in 1861. Gold was mined from quartz veins up to 1.5 m thick at nine mines from the 1890s until the closure of the Aorangi Mine in 1911. Total production from the Golden Blocks Goldfield is estimated at 46 000 ounces of gold. The Aorangi Mine was the largest mine, with a recorded production of 27 978 ounces of gold at an average grade of 36 g/t. Quartz veins containing gold and sparse sulphide mineralisation occur in a slightly metamorphosed, complexly deformed over-turned sequence of Lower Ordovician sandstones and shales. Primary gold mineralisation is associated with intensely deformed zones that occur near or at carbonaceous shale and sandstone contacts. Some eighty-five percent of all gold production (39 000 ounces) came from four mines confined to the stratigraphically lowest, most widespread shale unit. The quartz veins exhibit textures consistent with a hydraulic fracturing mode of vein formation with fissure infill vein types predominating over replacement textures. Stylolites of carbonaceous material and recrystallization features within the veins suggest multiple phases of deformation. The lack of wall rock alteration, and low primary fluid inclusion temperatures of 200¦ - 265¦ indicate that the ore fluids were associated with a low temperature epithermal system. A model consistent with similar mineralisation styles observed in Ordovician sediments from Pacific Rim occurrences is presented. The high grades (up to 100 g/t) mined from the upper levels of several mines suggests supergene enrichment processes associated with the Upper Cretaceous weathering surface. The Golden Blocks Goldfield has had no modern exploration. The most recent exploration was undertaken in the early 1980s. There are known acid intrusives in the area, with potential for the application of new models of intrusive-related gold mineralisation.

A metallurgical balance drawn around a mineral processing plant or smelter must involve all process streams crossing the plant boundary. Modern sampling theory, as formulated by Gy, and sound statistical method can be used to determine the uncertainties in the observed assays for the set of balance analytes and in the mass flow rates of the process streams for the balance period. These uncertainties can then be used together with the material balance equations to arrive at adjusted component mass flows that satisfy the material balances exactly. To determine whether or not the data is consistent with the level of uncertainty in the data and with the material balance equations, a goodness of fit test is applied. This goodness of fit criterion is the principal tool to quantify the quality of the material balances. The mathematical structure of the statistical material balance problem poses a number of challenges. For example, while the variances of the adjusted component mass flows do not vanish, the variances of the sums of the adjusted component mass flows about each balance node do vanish, simply because the balancing computation demands that the balances close exactly. Even though it can be shown that the variances of the adjusted component mass flows are always lower than the estimates for the corresponding unadjusted component flows, it is still not possible to construct a confidence interval on the component mass flow into (and out of) a balance node using the adjusted component flows. On the face of it, such a confidence interval is exactly what is most desired from the balance calculations. The problem arises because the balance problem is a data adjustment rather than a parameter estimation problem. It is possible, however, to calculate the recovery of a component to a product stream and determine a confidence interval for the recovery value. It is also possible to calculate an uncertainty in the mass flow of any balance species in any process stream, before and after balancing.

Over the last 20 years the mining industry has played a key role in the further development of many Central Queensland and New South Wales communities. The number of people who are employed by the coal mining industry, the number of transient residents, shift work and the town facilities have all contributed to how the community views the coal mining industry. As the coal mining boom continues and the mining communities continue to grow more emphasis is needed to address the community concerns, specifically the socio-economic and environmental impacts that the coal mining companies may have on these communities. Central Queensland coal mining operations are situated in the Bowen Basin. Many of the towns in the region have been developed specifically for the coal mining industry with 13 - 50 per cent (Australian Bureau of Statistics, 2006) of people living in the communities being directly employed by the mines. The introduction of shift work, differing rosters and the mining boom have resulted in considerable changes to these communities with more transient contractors and permanent employees taking up residence outside of these communities. This change, however, has not been as noticeable in the Hunter Valley region. The Hunter Valley, situated in the Sydney Basin has two main mining towns, Singleton and Muswellbrook. Of the 37 173 (Australian Bureau of Statistics, 2006) people that reside in the communities 13.8 to 16.5 per cent (Australian Bureau of Statistics, 2006) are employed directly by the mines. The Hunter Valley is a large tourist destination due to its many vineyards; this results in a diverse community where mining is not the sole means of employment. Similar to Central Queensland the mining boom has brought more people to the Hunter Valley region, although greater percentages have taken up residence in the communities. The views vary between the two regions on the coal mining industry, specifically on the socio-economic and environmental impacts that the industry may have on the surrounding communities.

Solid Energy New Zealand (SENZ) uses a 20+ year period for integrated planning of all its business activities. It has an ongoing program of coal resource assessment to optimise future mines within this 20 year period, using a six step resource and mine planning process. Desktop review and conceptual study at preliminary Levels 1 and 2 are based on general coal resource information. Further coal resource investigations are carried out for the more detailed evaluations in secondary assessment, prefeasibility study, feasibility study and detailed engineering from Levels 3 to 6. At Levels 1 and 2, completing conceptual planning, including preliminary resource evaluation and economic appraisal to the target cost uncertainty level of ¦33 per cent, is challenging in New ZealandÆs highly variable geological and geographical conditions. Where coal deposit geometries are relatively simple, approximate methods for determining pit limits using overburden strip ratios, seam thickness, physical boundaries, and quality cut-offs may be sufficient. Many New Zealand coalfields are however complicated structurally, with multiple seams and extensive folding and faulting. Coal seams are characterised by variable dip, thickness, and quality over relatively short distances. In the North IslandÆs Waikato coalfields, coal is typically overlain by weak sediments and clay rich strata that necessitate very flat cut and fill slope angles. The proximity of these deposits to major infrastructure (including towns, highways and rail lines), significant environmental features such as the Waikato river and lakes, and valuable dairy farmland, add further complexity. Traditional preliminary mine planning techniques applied in these conditions are insufficient. Pit optimisation software, widely used in the metalliferous mining industry since the 1980s, offers the ability to analyse many more specific factors affecting pit limits, mine layouts, and economics, with more rigour and for a much larger number of scenarios, than traditional methods allow. SENZ therefore decided to adapt and use æWhittleÆ pit optimisation software for Level 2 analysis of several Waikato opencast prospects. This paper describes this work.

That represents certainly the most influential gathering of the mining and investment community in Sydney for a very long time, and on behalf of the Institute I bid you all a very great welcome. Due to the pilots' strike some of you have arrived by very unusual methods and others have travelled long distances. So for those of you that have made a special effort, thank you very much. Inevitably some people have not been able to get to Sydney and this has led to some minor programme changes. I'd like to thank our sponsors. This paper reviews some of the factors thought to control the formation of supergene gold in the Pacific and its Rim. Discussion of these should lead to reassessment of the economic potential of many areas. In several parts of the world many gold-bearing veins display rich gold values only in the oxidized zone, whereas beneath the present (or ancient) watertable the unaltered vein commonly holds only sub-economic refractory low grade sulphides or arsenides. In the Eastern Highlands of Australia some of the most spectacular concentrations of - gold have been found at shallow depths. For example, Harper (1918) describes the Canton mine in New South Wales which was stoped over a length of 180 metres from the 45 metre level to the surface. The reef yielded gold at 300 g/t in the upper levels, but became gradually poorer at depth. Present geologists of N.S.W. Geol. Survey, G.R. Mcllveen and B.P.J. Stevens, believe that many similar Australian enrichments were formed between the surface and its ancient water table level during the extended period of weathering in the Eocene or pre-Eocene. They concede, however, that further supergene movement of gold may have occurred since the early Tertiary. Large quantities of Mesozoic supergene gold of extreme fineness (Au 99.7%, Cu +òFe 0.3%; Leibius 1885) was found at Mt. Morgan near the Tropic of Capricorn in Queensland. Lower Jurassic sediments cover part of the gossan in a small depression caused by oxidation and collapse of the Main Pipe, thus showing that the supergene gold is pre-Lower Jurassic (Cornelius, 1968). Because the Lower Jurassic landscape around Mt. Morgan was mature with a surface slope of less than 10 (Playford and Cornelius, 1967), erosion would have been very slow. The conventional ammonium nitrate fuel oil (ANFO) loader utilises a pneumatic system to control the flow of ANFO (via rotary actuator/ball valve) and air (via an auxiliary air valve). This system, though relatively simple and reliable, has several drawbacks with respect to ease of control and level of automation. In this paper, a radio frequency (RF) remote control for explosives charging is discussed. The system design incorporates electric solenoid valves to control the rotary actuator and the auxiliary air valve. All operations associated with explosives charging are selectable at the remote and are completed according to a modifiable time sequence. This allows the following charging sequence to be reduced to a single momentary application of the remote:removal of water from the hole prior to charging with ANFO; charging of the hole for a preset but adjustable period of time; and removal of the remaining ANFO from the ANFO hose. A specially developed remote switch allows the operator to maintain two-handed control of the ANFO hose whilst achieving full control of the charge-up process. Failsafe electronic architecture is incorporated into the systemÆs design to increase safety to the highest level. Should the RF remote control fail, a wired remote is included in the system to allow for the charging process to continue, albeit at a reduced level of control. The application of the RF remote control system in an underground explosives charging operation minimises and/or eliminates many problems associated with the use of the conventional charging system. These include: the wet-hole problem, trip and entanglement hazards, air embolism and the two-man loader control requirement. The developed remote control unit proved to be effective at removing water from wet holes leading to increased face advance per drilling operation. It proved to be economically feasible, allowed for an increase in systemÆs dependability and safety factor and for a truly one-man operation which resulted in reduced manpower.

Environmental legislation is changing rapidly throughout Australia at the present time, and with that change comes additional responsibilities for the mining and petroleum industries. Among the many changes that are being made are increased penalties for both criminal and accidental environmental impairment. The defences for criminal offences are limited and for other offences the laws may impose strict liability - in effect the offender is guilty until proven innocent. Mines may be included under contaminated land legislation, creating additional liabilities for clean-up, rehabilitation and long-term management. It is not unknown in Australia for the value of a mortgaged property to be less than the amount of the environmental liability acquired by a mortgagor in possession due to contamination of the site. An essential part of the management program for resource projects is now the regular conduct of an environmental audit, the results of which assist in the management of the legal and financial liabilities facing company directors and managers. The audit can also assist with negotiations with government agencies, staff, unions, insurers, Aboriginal and other community groups. An environmental audit may also help to ensure that companies are claiming the maximum allowable deductions for environmental works under the tax laws, and provide evidence in support of such claims. Environmental legislation affecting resource industries Environmental legislation in Australia is changing rapidly and can impose massive constraints, substantial administrative costs, and considerable liability on directors, managers and the corporation. Pollution control legislation Every State and Territory of Australia has a range of pollution control legislation contained in either individual acts relating to air, water, noise and land, or embodied in a single environment protection act. Pollution control legislation provides a critical management baseline for resource industries throughout Australia, often requiring the full-time attention of an environmental manager or an environmental department. In general, it is an offence to discharge effluents into water, or emit gases into the atmosphere above prescribed limits, cause noise above a regulated level, or contaminate land without a licence. A licence determines how much of a substance can be discharged, the location, the receiving environment, the quality, and the time at which discharges can be made or noise can be caused. Planning legislation Planning legislation controls where a project is located, how it will be constructed and operated, how large it is allowed to be, and what will happen once the project is completed. Development consents or approvals will generally contain a range of conditions controlling the preparation of the site, the construction of the facility and the way it is operated throughout its expected life time. Resource projects may be regarded under legislation as scheduled or designated developments requiring special treatment during the decision-making process. Under planning legislation, it is usual for resource projects to be subject to an environmental impact assessment process. Resource legislation Resource legislation specifically covering mining and petroleum in Australia, also contains requirements regarding protection of the environment during exploration for and extraction of minerals and oil. A mining or petroleum production lease usually contains numerous conditions regarding protection of the environment and rehabilitation of the site during and after the life of the extractive process.

Every mine is situated within a water catchment – a catchment with potentially many other land uses. A mine may take up a relatively small area in that catchment, but its operations have the potential to affect the whole catchment and long after that mine has ceased to operate. Therefore, the residents of any given catchment have the right to feel secure in the knowledge that their catchment, and indeed the wider environment, will not be degraded by mining activities. Much conflict can arise when this confidence does not exist.But, imagine if a community not only felt confident that their catchment would not be degraded by mining activities, but was also confident that their catchment would be left in a better and continuously improving condition – with improving water quality, biodiversity and soil - and a strengthening, more resilient economy. An Environmental Impact Statement (EIS) for a major mining development typically has to address various aspects of surface water management, including some which generally tend to be the more contentious: the diversion of rivers and creeks from areas disturbed by mining, and their rehabilitation; the effective management of disturbed area run-off via the collection, containment and treatment of contaminated water on site in sedimentation dams; the collection, containment and treatment of mine pit water; the decommissioning of surface water storages; final void water quality; and water discharge criteria. Environmental Impact Assessment processes for proposed mining developments in Australia at the state and commonwealth level usually involve a form of Initial Advice Statement (or Notice of Intent), Terms of Reference, an EIS, and a Supplementary Report (or similar) which responds to agency and public comment on the EIS. The EIS is used by approval agencies to decide the acceptability of the Project, and to set the conditions of approval. The conditions are often in the form of a state-issued æOperational LicenceÆ or similar. With mining, the initial approval at the EIS stage is often just a pre-cursor to various other planning related approvals, including obtaining a mining lease. Afterwards, mine plans and plans of operations must be submitted to government at various stages of the mineÆs life, ostensibly to provide the detailed mine planning over periods of one û five years. Despite all this additional planning and documentation beyond the submission of the EIS, government approval agencies are increasingly not satisfied with conceptual water management designs and commitments to an outcome (such as meeting a specified water quality standard) in the EIS. Agencies are also requiring sufficient water management design information to be convinced that the outcomes are achievable. To assist proponents of major mining developments, the Queensland Government has published Technical Guidelines for water management, and Environment Australia has published a æBest Practice Environmental Management in MiningÆ booklet on water management. In addition, the Australian and New Zealand Environment and Conservation Council (ANZECC. 2000) has published Water Quality Guidelines which provide an approach to water management, and provide receiving water investigation trigger criteria. So, what are the water management issues that are likely to be the subject of comment, debate and negotiation prior to the EIS being approved? and what commitments may a mining proponent have to make in order to convince the approval agencies that sufficient investigation and design has been provided? This paper provides some answers to this question, by reference to recent major mining proposals which the author has managed through state and commonwealth Environmental Impact Assessment processes.
