THE first year to which the Revenue Act of 1936 has applied is now passed. It is appropriate to try to give some calm thought to the plan of Federal income taxation as now imposed and what it will mean to the business and industry of the country if this plan of taxation is continued unchanged. Whether or not we like to pay these taxes is beside the point. Taxes are high and may be expected to be high for many years. The important question is whether the taxes to be imposed will destroy or injure business enterprise and development, and, in so doing, lower the standards of employment, living, comfort, and welfare of our people. The power to tax is the power to destroy. That destruction may come suddenly as a cyclone, or slowly as dry rot. What, if any, features are there in the present plan of Federal income taxation that have these destructive tendencies? A few of the points follow that seem to call for consideration.

I HAVE chosen for my subject a mining district which in an article published four years ago I referred to in the following words: "One of the un- usual anomalies of mining development and history is that a district having added thirty or more millions of wealth to a principal mining state, situated within four to six miles of two transcontinental railways and two auto highways, and within 150 miles of the most widely advertised part of the United States, should have been so completely lost sight of that probably not one mining man in ten can tell offhand where it is situated." But this district never was a dead one: it was only slumbering. During the past four months, day by day, it has been emerging from that state of slumber.

William Metcalf, Pittsburg, Pa. (communication to the Secretary*): I am greatly pleased that some one has at last reached what I have long regarded as the only rational explanation yet given of the reasons why steel hardens. Mr. Field claims originality; and doubtless he is entitled to it, but not to priority, mhich must be granted to Prof. John W. Langley.' The difference between them is that Langley says " Tension, probably molecular," and Field says " Tension, probably atomic "; in either case the vital thing after solution is tension. Mr. Field's argument carries with it the idea of increase of density with hardness; if he mill study the facts farther he will observe that the case is just the reverse; that is, the greater the hardness the less the specific gravity; it was just this fact that led Langley to his conclusion, in mhich I have always concurred. Field agrees with Langley that the first requisite for perfect hardening is complete solution of the carbon, not combination; and all of the facts agree with this conclusion. The fact that increase of hardness causes reduction of density was first brought to my notice some 40 years ago, when Major William Wade was testing Jones & Laughlin's cold-rolled iron, and I mas his assistant. We found the well-known increase of tenacity, compressive strength, torsional resistance, and hardness. Specific-gravity tests showed that the cold-rolled iron was less dense than the hot-rolled bars. Major Wade was so surprised at this result that he gave me a lot of samples to weigh, saying that he was not satisfied with

FREE competition, long the controlling ideal of domestic trade within the United States, has had the fundamental geographical advantage of functioning in the world's largest area of unrestricted commerce. Goods moved back and forth across state lines, unimpeded by customs, and industrial operations have developed rapidly to meet the expanding needs of a pioneer country richly endowed with natural resources. Fifty years ago, antitrust laws were adopted to protect the competitive private enterprise principle. It became illegal for one person to combine with another to restrain trade or commerce among the several states or with foreign nations. The original legislative measures defining this philosophy were the Sherman Act of 1890 and the Clay- ton Act passed in 1914. The development of Europe and other parts of the world was influenced by different conditions which led to a different theory of trade. Here were many small nations, with limited natural resources and a thin market, and they attempted to protect their national economy by tariff walls. International business arrangements for the purpose of diminishing the ups and downs of the more competitive system --crux of the modern cartel operations-seemed a logical device to stabilize production and guard the interests of both workers and consumers. European governments as well as European industrial interests became convinced that if com- petition could be held in bounds the danger of business depressions and un- employment could be reduced.

THIS paper gives the results of an investigation of the behavior of the argentiferous cobalt-nickel arsenides of Temiskaming, Ontario, in roasting, made in the metallurgical laboratories of the School of Mines, of Columbia University in the City of New York. The ore was kindly given by the owners of the La Rose and Trethewey properties at Cobalt, Ontario, and Mr. E. J. Hall, Tutor in Assaying in Columbia University, has helped us much. I. OBJECT OF THE INVESTIGATION. The object of the investigation was to learn:- 1. The temperature at which the arsenic is most rapidly expelled; 2. The thoroughness with which it is expelled by prolonged roasting at this temperature; 3. The effect of adding charcoal (a) near the end of the roast and (b) at the beginning of the roast. II. NATURE OF THE ORE. The important ores mined in the Temiskaming deposits are native silver-with small amounts of dyscrasite (Ag6 Sb), argentite (Ag2S), pyrargyrite (Ag3SbS3)-smaltite (CoAs2), chloanthite (NiAs2) and niccolite (NiAs). Mispickel (FeAsS) and cobaltite (CoAsS) also occur in smaller quantities. The average composition of the ore shipped from this district for the first six months of 1905 -was: silver, from 4.1 to 4.8 per cent.; cobalt, from 6.9 to 8.2 per cent ; nickel, from 3 to 4.7 per cent ; and arsenic, from 30.9 to 34.6 per cent. When conditions are right, diatoms propagate by subdivision in huge numbers. Alkalinity, temperature, and the presence of high concentrations of silica in the water largely control diatom life. When the diatoms die the skeletons drop to the bottom of their habitat to form oozes of varying thicknesses. Diatomites Diatomite, or diatomaceous earth, is composed essentially of the siliceous remains of the diatoms, although other organic skeletons are also present, especially in sea-water deposits where radiolaria, sponges and silico-flagellates are common. Impurities are generally carbonaceous material, fine-grained silt, volcanic ash and dust, and occasional coarse grains of sand. Diatomites are marine, brackish, or fresh-water, depending upon types of diatoms and their method of deposition. Diatoms More than 8000 species of diatoms have been named and classified. Some are definitely classified as to their habitat; some are so well recognized as to their living conditions that they can be stated to be diagnostic types, and when encountered in a deposit determine the origin of the deposit. THE literature of the last decade is rich with information relating to the cause and means of control of grain growth in pure metals, but is deficient concerning the role diffusion plays in grain growth, although during this period many new products that depend on diffusion for their properties and success have been developed. Among these are cementation products, produced by calorizing, chromizing, and carbonizing, or by mixing, pressing, and sintering powdered metals such as Syke's iron-molybdenum die material, Genelite, and Elcon Metal (copper, tungsten) etc. This is a fertile field for new developments, but before it can be util-ized to the fullest extent there must be a thorough investigation of the processes by which diffusion and grain growth take place. Grain growth plays no small part in the process and certainly the physical properties of these products depend largely on the grain size and state of equilibrium produced. The field of investigation does not end here, but may be extended to the effect of diffusion on impurities, segregations and dendrites in the broad field of ferrous and non-ferrous metallurgy. A number of years ago the author investigated several of these cases and noted, with striking regularity, the pronounced effect of diffusion in promoting recrystallization and grain growth. An example of this phenomenon is given in his paper on chromizing1 which contained photomicrographs of large radial or columnar crystals produced by diffusion of chromium in the solid state. Another manifestation of this effect was discussed by Austen,2 who showed the part hydrogen plays in the decarburization of steel and the effect of diffusion upon the grain structure.

Magnesium has long been known as the lightest of our engineering metals. This metal, silvery white in color, has a specific gravity of only 1.74. Aluminum, the next lightest structural metal, is 1 ½ times heavier; zinc is 4 times heavier; iron and steel are 4 ½ times heavier; and copper and nickel are 5 times heavier. Magnesium does not occur in the free state but is very abundant in nature, constituting 2.5 pct of the earth's crust in the form of various ores. It is the third most abundant structural metal, being exceeded only by iron and aluminum. Magnesium is unique, however, in that in the form of magnesium chloride it also exists in the oceans. Sea water is the source most widely used for production in the United States but magnesium is also commercially produced from magnesite, dolomite, and other ores as well as from certain inland brines. The vast quantity of magnesium existing in the waters of the oceans can be visualized when it is realized that the removal of one hundred million tons per year (the approximate annual steel production in the United States) for a million years would reduce the magnesium content of sea water only from 0.13 to 0.12 pct, providing no more magnesium had washed into the sea in the meantime. Not only is magnesium potentially very abundant but it is in addition a very versatile metal and can be shaped and worked by practically all methods known to the art of metal working. Discussion of the paper of H. R. Barnhurst, presented at the New York Meeting, October, 1913, and printed in Bulletin No. 82, October, 1913, pp. 2523 to 2532. H. R. BARNHURST :-I would say that in that experimental furnace we were trying to adopt the proper form for burning low-volatile coal. I was enabled on one occasion to burn coke having 15 per cent. ash. Tailings, or washings from the preparation of coal for by-product coke ovens, which came to me 52 per cent. ash, were burned without any trouble. So that ash really might be regarded as not burning, but simply diluting the fuel that was there, without doing any particular harm except that we had to put in more of the material to get the same quantity of heat. With anthracite, I burned coal right along with from 24 to 27 per cent. ash, but it took a furnace of peculiar form in which the products of combustion had to be diverted to the point of entrance of the fuel. With an ordinary furnace the fuel is deflagrated by its surroundings as soon as it enters the furnace. In a cement furnace this action is secured by the hot clinker passing clown, and the walls of the kiln are heated upon contact with it, revolving as they do', so that deflagration occurs very quickly in a cement kiln. Deflagration would occur very quickly in an open-hearth furnace also. There is no trouble in burning anthracite coal under those conditions for three or four days successively. It should be very well dried and thoroughly pulverized. Aside from that, there is no trouble. WILLIAM A. During the latter part of the year 1931, the Republic mine of the Republic Steel Corporation, at Republic, about 4 miles south of Brownsville, Pa., was mining coal along four rib or fracture lines. One of these lines, the west butt rib line, was retreating towards a concrete-lined air shaft, 320 ft. deep, which had been sunk in 1911 for ventilation purposes. With the normal rate of mining at that time, it was expected that this rib line would pass the shaft in three or four months and the shaft would then be abandoned and allowed to cave. Realizing the opportunity presented for the study of an unusual case of ground movement, the question of conducting the study was presented by the junior author to thechairman of the Institute's committee on Ground Movement and Subsidence, Mr. George S. Rice, who presented the matter to Mr. G. H. Morse, General Manager of the Northern Mines, Republic Steel Corporation, and he agreed to cooperate with the Bureau of Mines in making the study, the results of which arc presented in this paper. Acknowledgments are due to Mr. Morse for his full cooperation in this work and to Mr. G. S. Rice and Mr. J. W. Paul, both of the U. S. Bureau of Mines, for their advice and guidance during the course of the work. The authors are indebted to Mr. B. F. The surface slopes of the hills are gentle and their average gradient is less than 6º. THE object of this paper is to describe briefly the practical results obtained in several problems of civil engineering by resistivity measurements of the underground. It is intended for the mining engineer, as well as for the construction engineer; the stratigraphical problems discussed are general and frequently are encountered in mining exploration. Resistivity measurements have been used in mining and oil exploration for a number of years.1 Their introduction in the field of civil engineering, on the contrary, is rather recent. It was applied for the first time in the spring of 1928 near Littleton, N. H., in the survey of two dam sites for the New England Power Assn .2 Since then, the geophysical firm with which the author is connected has had an opportunity to develop this field of activity, and more than 20 investigations at dam and tunnel sites have been carried out in the United States and Canada. A part of this work has been verified by underground or drilling exploration. This paper deals with but a few of the results, which we are permitted to make public now. The theoretical and technical sides of the processes employed will not be discussed; they have already been described in various technical. .publications. A few general points will be mentioned, to make clear the practical examples given.

A. I. Blank.*-—Mr. Kanter has spoken of failures from causes other than creep itself in metals that are subjected to creep stresses. Would it be possible for the author to enlarge on this very important matter of "cataclysmic types of failures? " J. J. Kanter.—Of course, it is always a delicate matter to discuss specific failures. I would prefer to keep the present discussion on fundamentals and principles. H. L. Burghof.*—Mr. Kanter, I should like to ask what you consider the responsibility of the designer in avoiding stress concentrations that would lead to these types of failures? J. J. Kanter.—lt was my feeling in looking over the papers of this symposium that they were significantly lacking in consideration of what happens to the metals when strained under conditions that lead to rupture. Often creep tests are run that produce only a fractional percentage of the deformation, in several thousand hours. That kind of information gives the designer no assurance whatever that cracks will not result in his structure at points where stress concentrations, and therefore deformation concentrations, exist. I think anyone in this day and age who presents a paper on creep should incorporate with those studies a thorough investigation of creep rupture if it is expected to make an impression upon the design engineer.

The important question of the metallurgical value of the coals of the Rocky Mountains and the Pacific Coast is to be settled, of course, by practical experiment. Meanwhile, as I have had occasion to point out, the proximate analyses of these coals throws little light upon it, and is, indeed, likely to mislead the metallurgist, if he compares it with the results of similar analyses upon bituminous and semi-bituminous coals. With the view of showing how large a proportion of the material usually classed as(" volatile matters " consists of combined water, or oxygen and hydrogen presumably in chemical combination, I have collected a number of ultimate analyses from various sources, in the following tables. IN 1925, Harry Howard Stout, then metallurgist for Phelps Dodge Corporation, while investigating the cleaning of cathode copper by various gases at elevated temper-atures below the melting point of the metal, observed in the laboratory that particles of pure copper heated in a closed tube filled with hydrogen seemingly "stuck together." By further investigation he found that there was actual crystal growth across the boundaries of the particles of pure metal; in other words, there was a complete new crystal realignment and growth throughout the newly formed copper mass. It was coalescence, not adhesion; the several parti-cles had become one unit. From this dis-covery has been developed the coalescence process, whereby copper of cathode purity is squirted out in semifabricated form from an extrusion press, by the appli-cation of about 3000 tons pressure on a 10-in. piston. Stout decided that cathode copper pro-duced by electrolytic deposition was the logical source of the pure copper required for the coalescence process, but as there was no way of reducing the ordinary tough commercial cathodes to the small particles required he was confronted by a serious problem at the outset. SOME old-time views which have recently come into my possession have inspired me to record that part of the early history of Leadville, Color- ado, with which I am familiar, the years 1878 to 1882, in the hope that others will add to what is here mentioned. My first appearance in Leadville was in June, 1878, immediately after graduation from the University of Michigan, and I found a congenial and lively crowd of young men, already there. The old log hotel, at the corner of Pine and State streets, housed some distinguished guests in the summer and fall of 1878. It was my good fortune there to make the acquaintance of James B. Grant, afterwards Governor of Colorado, in July of that year, when we were both glad of the accommodation afforded by cots in the second floor loft of the hostelry presided over by Herman Hibschle. Grant was then building his smelter and our associates were Eddy and James, August R. Meyer, and Berdell and Witherell. The Grand Hotel-Harris and Walsh, pro- prietors-was the first-class hotel of the place; but in a very few months there were many competitors.
