"REVIEW OF ISA's DRAFT EXPLOITATION REGULATIONS – HAVE KEY STAKEHOLDERS' CONCERNS BEEN ADDRESSED ADEQUATELY?In early August 2017, the ISA published a revised draft of the exploitation regulations. My presentation will focus on the extent to which key State and Contractor issues raised in formal submissions in November 2016 have been addressed in the revised draft and any additional key issues in the revised draft which are likely to cause significant concern for Contractors.ABSTRACTFollowing the ISA's call for submissions in response to draft zero of the exploitation regulations in July 2016, 43 responses from stakeholders were received by the ISA in November 2016. My presentation will start by briefly looking at how the ISA has continued to engage with stakeholders following the publication of draft zero of the exploitation regulations, including at payment regime workshops in London (November 2016) and Singapore (April 2017) and at the environmental workshop held in Berlin in March 2017. It will also touch on the publication in February 2017 of what was in effect a very preliminary draft of the environmental regulations before moving on to consider in detail the extent to which key State and Contractor issues have been addressed in the ISA revised draft exploitation regulations which were published in August 2017. My review of the formal submissions will include, amongst other things, commentary on:(i) the level of Stakeholder response (State Parties to UNCLOS, Sponsoring States, Privately owned Contractors, State Owned Contractors and NGOs);(ii) the quality of the submissions (particularly by States and Contractors); (iii) the key concerns raised by State and Contractor stakeholders and how those issues have been addressed in the revised draft exploitation regulations; and(iv) how all stakeholders need to further engage with the ISA to ensure that the exploitation code adequately addresses the legitimate and reasonable concerns of each Stakeholder group (e.g. Contractors, Sponsoring States, Developing States and NGOs)."

Ocean observatory technologies permit uninterrupted, real-time observation of dynamic seafloor environments such as gas hydrate deposits and hydrothermal vent fields that are of both scientific and economic interest. Such observations enable new discoveries of linkages between physical, chemical and biological processes and could permit continuous monitoring of environmental variables during mining operations. Ocean Networks Canada operates the NEPTUNE and VENUS cabled observatories in the Northeast Pacific Ocean. The offshore NEPTUNE observatory supports instruments at two gas hydrate sites on the continental margin off Vancouver Island, and in the hydrothermal vent fields of the Endeavour segment of the Juan de Fuca Ridge. The primary focus of the gas hydrate field observations is to understand the dynamics of the growth and stability of outcropping and sub-seafloor hydrate deposits. Outcropping hydrates at 840 m depth in Barkley Canyon have been monitored for the past 3 years with a mobile instrument platform known as Wally, which is operated over the Internet by a research group in Germany. This tracked vehicle carries standard oceanographic sensors, acoustic current metres, cameras and methane sensors. Data indicate a relationship between degassing of hydrates and tidal currents. In 2012-2013 two high-resolution sonar towers were added to the hydrate field to provide precision tracking of Wally and to monitor volume changes in the outcropping hydrate mounds. A large subsurface hydrate deposit occurs at the Clayoquot Slope site, where bottom depth is 1260 metres. Monitoring instrumentation is currently being established at this location. In September 2005 Williamson & Associates, Inc. delivered the BMS2 remotely operated seafloor coring system to the Japan Oil, Gas & Minerals National Corporation (JOGMEC). During acceptance trials aboard the JOGMEC research vessel R/V Hakurei Maru No. 2 the BMS2 successfully recovered 7.44 m of rock core in 3377 m water at a site near the crest of a seamount about 500 nm SE of Japan. Hydrogenous ferromanganese oxide crust, basaltic lava, sandstone and volcanic sediments were sampled with near 100% core recovery. The BMS uses rotary rod coring tools to collect samples to a maximum depth of 30 m in water depths up to 6000 m. Depending on bottom type to be sampled, the BMS tool magazine can be loaded with various drilling tools including core barrels with different bit types, drill rod and bore hole casing. The drill has 9 video cameras, a suite of sensors and 60 hydraulic functions powering thrusters, telescoping legs, seawater pumps and all of the standard drilling controls. The BMS provides deep water investigations with the functionality of conventional diamond bit rod drilling currently the mainstay of exploration programs in land mining.

In the last two years, C-CORE has developed a new seabed sampler directed specifically at obtaining samples from hard or compacted bottoms such as are typical of marine placer deposits. Samples are required for appraisal of concentrations of saleable commodities, and for determination of levels of biological indicators in the deposits. Recently C-CORE and the University of Victoria have been comparing the performance of the Scott/C-CORE sampler with that of the Van Veen sampler often used for biological sampling. Initial trials of the Scott/C-CORE sampler in 1992 at the WestGold mining site, Nome, Alaska, were described by Jewitt et al. at the 1993 UMI. Since that time the sampler has been modified to prevent overfilling, and to limit turbulent flow of water across the top of the sampler buckets when the sampler is recovered with partly-open buckets. The modifications included shoes to prevent sampler overfill, and flexible rubber shielding over top and sides of the sampler to prevent water circulation. Samples have been taken with both samplers in two field areas, one at Pine Cove, Baie Verte, Newfoundland, and the other near Long Pond in Conception Bay on the Avalon Peninsula, Newfoundland. In each area multiple samples were taken with both sampler types, and the samples processed immediately to establish the types and quantities of marine organisms that were present. Species identification is expected to be complete by late August.

A regional assessment of the aggregate potential of the Scotian Shelf is presently being funded through a Canada-Nova Scotia Cooperation Agreement on Mineral Development. This assessment includes testing of seabed materials for their suitability in a variety of concrete, asphalt and other specialized applications. The glacial and postglacial Holocene history of the Scotian Shelf has been favourable for the formation of large deposits of sand and gravel that have potential for use as marine aggregate resources. Large banks and inner shelf areas of the seabed consist of basal transgressive sand and gravel of the Sable Island Sand and Gravel Formation. These sediments accumulated during the late Wisconsinan postglacial transgression, through sorting of glacial materials that were originally deposited beneath marine terminating glaciers. Some sandy deposits occur as low-stand deltas on the inner shelf at 70 m water depth and were formed during the maxi- mum low sea level stand, in early postglacial time, at approximately 12 000 yBP. Modern sediment transport processes have contributed to the formation of areas of large sand bedforms, such as the Cape Split sand wave field and other isolated sand waves of the inner Bay of Fundy, and Eastern Shoal on Banquereau. Sandy sediments, found in many transverse channels in the nearshore, offer a potential for placer gold where proximal to adjacent onshore epithermal gold deposits. Lithothamnion covered gravel occurs as a thin lag overlying glacial sediments in much of the nearshore. Relict gravel beach ridges have been eroded and redistributed through sub-littoral processes after passage of the transgressing beach front. Multibeam bathymetry, sidescan sonograms and high-resolution seismic reflection profiles are the main survey tools. Ground truth consists of large volume seabed samples, vibrocores and photographs. A preliminary assessment of the aggregate potential indicates that very large volumes of suitable aggregate lie in the offshore of southeast Canada.

Active development of the exploration and further exploitation of deep-sea minerals requires special emphasis on the protection of the marine environment. The complexity of this subject lies in the fact that potential impact and effects of future mining activity are not completely known. One of the main sources of potential impact near the seafloor, as it expected, would be a generation of sediment plumes, their dispersion and redeposition of sediment. Meanwhile, their dimensions, rates of dispersion and redeposition are a big issue. Other plumes are expected in the surface layer as a result of discharges of processing waters and particles after sorting on board of mining vessel, and their features are also not clear. At the same time, understanding of these aspects would be crucial for definition of environment impact area, delineation and designation of different types of protected areas (Areas of Particular Environmental Interest, Impact and Preservation Reference Zones) and future assessment of environmental impacts. Attempts to address these issues demonstrated wide variations between the data of field experiments on the one hand and the results of analytical and numerical models on the other. According to in situ measurements, plumes were detected at a distance vary from one to less than 20 km [e.g., Burns et al., 1980; Sharma et al., 2001; Nautilus Minerals, 2008 etc.], whilst some models show results up to 100 km [Rolinski S. et al., 2001] and more. It seemed that results of in-situ experiments are preferable, but they were not many indeed. However, these data were used in different investigations rather widely, but their focus, as far as we know, was not on the matters related directly with plumes.

Clark volcano is a large volcanic center on the active arc front of the intraoceanic Kermadec arc. It is one of the two southern-most Kermadec arc volcanoes (the other being Whakatane volcano) that sits on oceanic crust before the transition to continental New Zealand, and is underlain by the 17-km-thick Hikurangi Plateau, which is presently subducting beneath the southern section of the Kermadec arc. Unusual K-rich basaltic lavas have been recovered from Clark (1.5 to 2.25 wt.% K2O), together with more typical basaltic-andesite, andesite and dacite rocks. The total volume of the Clark volcanic center is ~90 km3, calculated from the summit of the volcano down to the 2,500 m contour (which marks the inflection point of the volcano flanks with the surrounding seafloor) and comprises two separate edifices similar in size; the northern one having a volume of ~4.57 km3 and the southern one 4.43 km3. The volcano has a maximum relief of ~1,645 m from the 2,500 m contour to the summit of the shallower northern edifice shoaling to 855 m below sea level. The northern edifice is comprised of twin peaks each consisting of a constructional cone, with evidence of sector collapse having occurred between the cones. A more recent, smaller cone again has grown on the eastern flank between these summit cones. Massive, blocky lavas and coarse talus dominate the summits of the cones, with finer-grained volcaniclastic material and sediments a feature of the volcano flanks. The southern edifice is noticeably more dissected than the northern one, having a pronounced horst in the centre of the volcano bounded by 5-6 km-long faults. There is no obvious constructional cone atop the southern volcanic edifice.

Introduction Technology development for sustainable, safe, reliable and efficient mining of polymetallic nodules in the deep seas requires careful design, thorough understanding and integrated testing of all equipment, physical processes and (sub) systems involved (Dasselaar et al [1]). Proceeding from Vertical Transport System (VTS) experiments at IHC laboratory scale by Van Wijk [2], with typical system dimensions of several meters, to prototype or pilot scale testing with typical dimensions of several kilometers, is a giant leap. Naturally, intermediate steps are required in order to mitigate the possible risks in the full-scale system’s (physical) processes. Within the EU program Blue Mining (2014-2018), possibilities emerged for performing experiments at intermediate scale: the so-called medium-scale vertical slurry experiments. Near Freiberg, Germany, the village Halsbrücke possesses a 140 meter deep empty vertical mine shaft, perfectly suited for housing the test setup. For this purpose, a 318 meter long 145 mm pipeline circuit was constructed, including both a 130 meter high vertical riser and fall pipe section. A purpose-built sediment injection and separation system was deployed, including a 55 kW centrifugal pump. The riser section has been equipped with sensors capturing pressure, temperature, flow velocity, volumetric concentration and flow visualization. The planning, modification and construction of the test facility site itself is described by Müller et al [3]. The present paper describes the objectives, experimental program, equipment, and the preliminary results. Publications on in-depth results are foreseen in the (near) future.

Deep-sea rare-earth element-rich mud (REE Mud) distributes in pelagic clayey sediment column on ocean seafloor at 4,000-6,000 m deep. The thickness ranges 5-80 m and the burial depth 0-100 m. The REE content ranges 600-2,250 ppm in Pacific and one of the richest, maximum 6,500ppm, has been found in Marcus Is. exclusive economic zone. By applying a conventional hydraulic excavation and lifting methods, the economy of REE Mud mining around Marcus Is. is preliminary examined. Because the waste content in REE Mud is high and the disposal cost in Japan is very expensive, the mining is recognized far away from economy.

There are a number of likely impacts from mining operations, but a key issue is uncertainty about the environmental effects of sediment plumes created by disturbance to the seafloor and discharge of processed waters. The New Zealand National Institute of Water and Atmospheric Research (NIWA) is undertaking a research project to improve understanding of such impacts (relevant to both mining and trawl fisheries), by examining the extent and persistence of sediment plumes, the immediate impact and subsequent recovery of seafloor exposed to these plumes, and the effect on functioning of ecologically significant species. The project will use a combination of field survey experimentation with in situ observations and controlled laboratory-based experiments. The field work begins in May 2018 when an area of up to 1km2 at depths of 400-500 m on the Chatham Rise, 450 km east the New Zealand South Island will be subjected to disturbance by an upgraded former NOAA Benthic Disturber. The suspended sediment load created by the disturbance will be tracked and monitored, with the effects on seafloor animals examined by pre-and post-disturbance sampling. A wide range of seafloor sampling, benthic landers, towed cameras, oceanographic moorings and water column monitoring will be carried out over a three week period. Monitoring surveys will be repeated in 2019 and 2020 to determine the longer-term resilience and recovery of disturbed communities. The laboratory-based side of the programme, also starting in 2018, involves holding live deep-sea corals and sponges in tanks at NIWA, and exposing them to various levels and duration of particle loads in the water in order to reveal lethal thresholds as well as sub- lethal effects of settled and suspended sediment.

Deep-sea mining is rapidly approaching the test-mining phase to prepare for commercial mining in multiple oceans, both in areas within and beyond national jurisdiction. The first test-mining operations are likely to focus on seafloor massive sulfides found at active and inactive hydrothermal vents within national jurisdictions – possibly in the coming months. Beyond national jurisdictions, the International Seabed Authority (ISA) is developing the regulations to oversee exploitation of polymetallic nodules, massive sulfides and cobalt crusts. The Deep Ocean Stewardship Initiative (DOSI) minerals working group has, over the last 3 years, made formal submissions on the regulatory framework, on the draft exploitation regulations, on the article 154 review of ISA and on the initial environmental regulations. In advance of both test and commercial mining, we urgently need to identify and develop comprehensive, ecosystem-based management practices for deep-ocean environments subject to mineral extraction. Transparent criteria for deep-sea institutional and corporate social responsibility also need to be established. Proactive development of management practices, frameworks and policy prior to the onset of mining will facilitate some degree of protection and preservation of the marine environment, whilst enabling the use of seabed mineral resources. The DOSI minerals working group constitutes a broad spectrum of scientific, industry, legal and policy expertise. We provide expert opinion, both in collated and individual response forms, on deep-sea mining related concerns to ISA and national bodies. Our publications and workshops on key concepts raise awareness and provide scientific updates on ecosystems targeted for mining. The Kuroko-type seafloor massive sulfides (SMS) in the western Pacific have received much attention as sources for economic recovery of gold (Au), silver (Ag), copper (Cu), zinc (Zn), and lead (Pb). Since the end of the 1980s, the Kuroko-type SMS have been found in the back-arc basins and on oceanic island-arc areas. In Okinawa Trough (Halbach et al., 1989) and on the Izu-Ogasawara Arc (Iizasa et al., 1999) are the typical representatives in the Japan’s EEZ. They yield a higher concentration in Au and Ag than the SMS found in ocean ridge areas (Rona, 1985). Similar formation processes with the Kuroko ore deposits on-land in Japan have been expected and outlined by many researchers (Sillitoe, 1982; Scott, 1985). The higher Au and Ag contents have increased the chances for profitable mining operation, which is under consideration by a private company (Malnic, 2001). Information about the resource potential of the targeted Kuroko-type SMS deposit, such as the amount of SMS ore body, the inside structure, the mean metal yields, and the geographical details are necessary for a technical and economic validation analysis for the development. The Sunrise Deposit of Myojin Knoll on Izu-Ogasawara Arc in the Japan’s EEZ is selected as a target for the technical and economic validation analysis. The relatively higher amount of information on its resource potential is the reason why the deposit is selected.

The topic area for this paper covers the United States portion of the northern Gulf of Mexico, extending from the Rio Grande delta east to the Florida peninsula. Declaration of an Exclusive Economic Zone in 1983 expanded Federal economic jurisdiction on the continental margins from 12 to 200 nautical miles seaward from the coast. The nation-wide area of the EEZ totals 3 million square nautical miles, with approximately 186 thousand square nautical miles in the Gulf of Mexico. In the Gulf, the continental shelf has an area of 81 thousand square nautical miles, extending to a depth of 600 ft. and having widths of 6 to 120 nautical miles. Specific areas on the shelf offer the greatest potential for containing aggregate and other hard mineral resources. The primary geomorphic features along the Gulf coast include: barrier islands, chenier plains, tidal inlets, bays and lagoons, estuaries, and deltaic headlands. These features are composed of terrigenous siliclastic sediments, except for the west Florida coast, south of 29°N latitude, which is dominated by carbonate sediments. On the shelf, the primary features are linear sand shoals and associated sand sheets, relict delta lobes and channels, and banks related to salt diapirs and coral reefs. The composition and distribution of sediments in these coastal and shelf features are determined by numerous geologic factors including: seabed topography; riverine sediment discharge; sediment dispersal patterns due to currents, waves, storms and tides; tectonics and subsidence; and repeated fluctuations in sea level.

Paleooceanic structures of the Urals fold belt contain different volcanic-hosted massive sulfide deposits of the Urals, Kuroko and Cyprus types [Prokin, Buslaev, 1999]. Small Cobearing massive sulfide deposits, as Ishkinino, Ivanovka and Dergamysh, associated with ultramafites of the Main Urals fault, are less known. Interest to them had arisen after discoveries of the modern “black smokers” associated with ultramafic rocks of the Middle-Atlantic Ridge (MAR). Ores of the Urals deposits are enriched in Co (0.3 %) and Ni (0.6 %) that are concentrated in Co-Ni-Fe-sulfides, sulfarsenides, and arsenides. Ores also contain the increased gold contents – 3–6 ppm and up to 16 ppm in those saturated with As-bearing minerals. The aim of the paper is a comparison of precious metal mineralization in ores from the Paleozoic and modern ultramafic-hosted massive sulfides.

Field observations and sampling of land-based and submarine hydrothermal and geothermal sites show a definite link between the geological setting, fluid geochemistry and specialized assemblages of microorganisms found at these settings. Three initial sites have been chosen as a basis for these studies. The first site is located on hydrothermal vents in pit craters on the submarine volcano Lo?ihi (Hawai?i) at a water depth of 1,300 meters. The second site is within the geothermally active vents, ponds and lakes of the Taupo Volcanic Zone of New Zealand. The third site extends along the chain of volcanically and hydrothermally active volcanoes of the Kermadec-Tonga arc and back-arc system. To focus our work in New Zealand, a geomicrobiology field and experimental center has been established in Wairakei, New Zealand, with the relevant genomics, proteomic and bioinformatics work being conducted at the University of Hawaii. As part of a partnership between the University of Hawai?i, the Institute of Geological & Nuclear Sciences (GNS) and Victoria University of Wellington, a new interdisciplinary graduate course in geomicrobiology will be taught at Victoria University beginning next year. Since mineral-microbial interactions have been occurring for the past few billion years and these interactions have led to where one generates the other, a metal-bacteria research program has been initiated at GNS using arsenic-gold and other metal-bacterial interaction processes as a research objective. In this research program, we have completed the full genome of a new species of marine bacterium Idiomarina loihiensis from the Lo?ihi hydrothermal vents and identified specialized microorganisms living in pH 0.3 geothermal vent waters of White Island, New Zealand. The multidisciplinary approach to study the process of accumulation of metals in the hydrothermal systems clearly shows the path of how bacterial-mineral interaction can precipitate metal deposits. These studies will lead to new avenues for biomining, bioremediation and the understanding of the origins of life.

The Chatham Rise is a submarine topographic feature lying off the east coast of New Zealand between the South Island and the Chatham Islands and within New Zealand?s jurisdiction. The Chatham Rise hosts economically significant deposits of rock phosphate and other potentially valuable minerals. The deposits comprise nodules lying on, or just below the surface of the seabed in shallow waters. Rock phosphate is an essential ingredient of fertilizer and can be applied directly to pasture. There is a realistic opportunity the phosphate deposits could supply New Zealand?s agricultural requirements for an estimated 30-year period at current rates of consumption.

Volcanogenic massive sulfide deposits are generally considered to have been formed by hydrothermal fluids that leach ore metals out of footwall rocks. However, the necessity for a metal-rich magmatic component in the ore-forming fluid of "giant" ore deposits has been debated over the decades. The solution to this issue is important not only for metallogenic models but also for the mineral exploration. In the hydrothermal leaching model, massive sulfides at mid-ocean ridges are deposited from hydrothermal fluids containing 80 ppm Fe, 6 ppm Zn, 2 ppm Cu, 350oC, and 0.7 g/cm3 density (average data for 21oN East Pacific Rise). A simple calculation demonstrates that such a dilute fluid is unlikely to have been responsible for the formation of the largest ancient massive sulfide ores of greater than 100x106 tonnes, such as Kidd Creek, Brunswick No. 12, Neves Corvo, and Rio Tinto. For such a deposit consisting primarily of pyrite, sphalerite, galena and chalcopyrite (other minerals, including gangue, might account for an additional 10-20%) and even assuming 100% precipitation and retention of the sulfides, more than 790 km3 of vent fluid would be required. For typical water-rock reaction ratios of about 2, this fluid would have to have reacted with about 395 km3 of rock to acquire its metals by conventional leaching processes. This estimate, however, conflicts with the observation that even a giant massive sulfide ore body is usually underlain only by a few cube kilometers of obviously altered rocks. Moreover, this model is not consistent with the observation of hanging wall alteration in many large massive sulfide deposits. The close spatial association between massive sulfides and volcanic rocks, in both ancient and modern sea floors, suggests that direct magmatic contribution should be taken into account in the genetic model. Magmatic fluids, capable of carrying abundant ore metals and volatiles and escaping from magma by depressurization, are well known from modern active volcanoes on land. High concentrations of metals occur in CO2-rich magmatic fluid trapped in felsic volcanic rocks nearby large presently-forming VMS deposits in the eastern Manus Basin (Pacmanus, Suzette) and also in the footwall rocks of Ordovician giant Brunswick #12 deposit in the Bathurst district, New Brunswick. Only 1% of such metal-rich magmatic fluid mixed with heated sea water, that has leached its metals from rocks, would contribute 85% of the total metals to form an orebody. Such magmatic fluids are most likely to be formed from volatile-rich felsic magmas that are prevalent in back arcs, and, if added to the normal circulation system, the fluids could be responsible for the formation of "giant" ore deposits. If this is true, then the study of magmatic fluids in the seafloor volcanic rocks may provide criteria for the exploration of large ore deposits.

The marine diamond industry off south-western Africa is maturing rapidly. Some of the larger explorers have reached an advanced stage in their resource development and new mining operations have been started in the last year. Most of the major exploration, mining and marine engineering companies have offices in Cape Town. As a result of the increased activity and experiences to date, new approaches to marine diamond exploration and mining are now evolving. Primary factors contributing the new approaches are namely 1) the concentration of expertise in a localised area 2) the significant increase in the base of available exploration and production results and 3) parallel advances in the marine engineering design and geophysical survey equipment. The sea floor geology and setting of the marine diamond exploration areas is now better understood. Consequently the strategy for exploration and the selection of appropriate survey equipment is improved. Due to new equipment developments, different exploration alternatives now exist, depending on the programme objectives. Significant advances have also been made in the data processing and modelling undertaken to assist in the identification and targeting of potentially diamondiferous prospecting features. Similarly, the design of appropriate prospecting tools and programmes has also been improved. Following exposure to the requirements of the marine diamond industry, the design engineering and operating companies have responded with innovative designs for new prospecting tools. In recent years the availability of relevant information on marine diamond prospecting and production has increased. As a result, there is now sufficient basis for the construction of meaningful financial valuation models that can be effectively used to control and guide the exploration projects, to the benefit of both the explorer and the investor.
