While most of these issues relate to the author’s specialty of mineral appraisal some are more general in nature and could be of interest to those who may be involved in current or future court testimony. Several important areas to be reviewed and agreed upon with the client and their legal counsel are discussed. General observations on litigation, the discovery process, testimony and some repercussion’s are also given.

Coal mining companies in Australia are managing the high-consequence risks across their operations more effectively by using an interactive online risk management system known as Riskgate Developed by the Minerals Industry Safety and Health Centre (MISHC) at the University of Queensland, Australia, Riskgate contains detailed information about 11 high-consequence risk areas (called topics in the system) for opencut and underground coal mines (Table 1). The existing topics are: fires; strata control for underground mining; ground control for opencut mining; tires; isolation; collisions; explosions and explosives; manual tasks; and trips, slips and falls. Every Riskgate topic is focused on coal industry activities (mining, processing, transport and storage). The scope includes mine sites, lease areas and mine infrastructure (mobile, fixed plant, field equipment, buildings, road and rail transport), and all aspects of the mine life cycle from design through to decommissioning. The topics uniformly recognize that a loss of control can result in injury or fatality, equipment damage, production loss, reputation loss and environmental damage. However, the priority focus for Riskgate is the safety of mine personnel.

Few departments of mining, metallurgical or petroleum engineering in the United States have critical mass. Cost per student credit hour (SCH) in departments across the country are usually the highest among engineering departments, which are the highest on campus. Almost all departments are operating at fixed costs and enrollments could easily double without incurring much additional cost. However, the cost per SCH would remain unacceptably high and the probability of doubling enrollment is nil. Declining enrollment is a more likely future. The pressure to reduce SCH from university administration is unrelenting. And it has the potential for doing serious damage to program quality when standards and requirements are lowered in attempts to maintain enrollments and increase retention.

Aquatic organisms are sensitive to free cyanide (HCN) though the presence of certain metals that can form stable complexes and thereby reducing both the amount of bioavailable cyanide. Recent work has suggested that consideration of HCN rather than total cyanide can provide the basis for water quality criteria. Cyanide is often present in complex effluents that affect speciation and bioavailability. We have developed a model to predict the speciation of cyanide in complex effluents and have shown that this model can predict the toxicity of metal-cyanide complexes in terms of HCN. This study evaluated available cyanide toxicity exposures with this model to assess the role of water chemistry (e.g., metal-cyanide interactions) on the observed. Toxicity endpoints based on total cyanide ranged over several orders of magnitude for a variety of metal-cyanide mixtures. However, predicted HCN concentrations among these same tests described the observed toxicity data to within a factor of 2. Aquatic toxicity can be well described using HCN though in certain metal-cyanide mixtures toxicity was jointly described by HCN and elevated levels of bioavailable metals. This work was performed in support of an industry-sponsored reassessment (Gensemer et al 2006) of the U.S. EPA water quality criteria for cyanide (EPA 1985) using free cyanide as the basis for the re-calculation. The work presented in this manuscript presents technical support for using free cyanide as the preferred basis for this recalculation.

Australia’s mineral valuation code continues to evolve, while mineral valuation standards are also being written for Canada and Southern Africa. The author is leading a task force for writing the extractive industries addition to the International Valuation Standards. Meanwhile, the International Accounting Standards Board is continuing the development of an extractive industries addition to its International Financial Reporting Standards, with an emphasis on valuation reporting. This paper analyzes the need, content and ownership for a U.S. minerals appraisal standard in the context of both these developing international standards and also existing U.S. regulations and appraisal standards. The author provides many questions for research and debate.

Four companies mined ball clay in four States during2004. They were H.C. Spinks Clay (owned by Franklin Minerals) Kentucky-Tennessee Clay (owned by Imerys),Old Hickory Clay and Unimin. Production was estimated to be 1.46 Mt (1.61 million st) valued at about $56.9 million, based on a preliminary survey of the ball clay industry. In 2003, production was 1.31 Mt (1.44 million st) valued at $56.2 million. Tennessee was the leading producer state with 61 percent of production. It was followed by Texas, Kentucky and Mississippi.

One of the present trends in the mining industry is the increased use of mining contractors. In the past, many project owners have utilized mining contractors for topsoil stripping or overburden removal, usually on a short-term or periodic basis. In recent years, mining contractors have not only removed the overburden, but mined the product as well. Why is this change occurring? A prevalent trend in the mining industry appears to be the outsourcing of non-core and non-strategic functions, allowing producers to focus more on areas of technical expertise where higher incremental value is added—that is the processing, refining, and marketing of the product. As capital allocation becomes more critical, this trend is likely to continue.

Tracer gases have been utilized successfully in a variety of industries, each with specific releasing and sampling methods. The various attributes of tracer gases are dependent on the industry the tracers are utilized in. Tracers must be chemically and thermally stable, safe, odorless, detectable at low concentrations, have a low background concentration, and should not be naturally occurring in the environment if they are utilized in underground mining applications (Thimons et al., 1974). In addition, the tracer gas should be inexpensive, non-corrosive, non-toxic, easily transportable, readily attainable, and non-radioactive (Kennedy et al., 1987). Sulfur hexafluoride (SF6) met many of these above requirements and therefore was introduced as an ideal tracer gas to use in mining industry in the early 1970?s (Thimons et al., 1974). Due to the nature of underground mining including complicated geometry, irregular flows, turbulent flows, obstructed airways, and leakages it is difficult to use conventional anemometer and smoke tube techniques to accurately measure the effectiveness of ventilation controls (Thimons et al., 1974; Klinowski and Kennedy, 1991). There have been several applications of SF6 as a tracer gas in underground metal/non-metal and coal mines. Thimons et al. conducted early testing of SF6 in an underground limestone mine and determined that it is an effective technique for evaluating auxiliary fans, estimating volumetric flow rates in large areas, and measuring low flow velocities. A rapid face ventilation measurement method (FVM) utilizing SF6 was developed by the Bureau of Mines to make face measurements in underground coal mines (Timko and Thimons, 1982). When measuring the effectiveness of jet fans in dead headings SF6 was proven more effective than smoke tubes (Timko and Thimons, 1982). Experiments related to determining methane liberation in the gob were also conducted by injecting SF6 into a borehole (Timko and Thimons, 1982). Also, in an emergency situation where the gob had to be sealed due to a fire, SF6 was released to determine the effectiveness of the seals (Timko and Thimons, 1982).

One of the first things we tell a potential new client is that they have only one chance to make a first impression with an Aboriginal community; all future communications and engagement will be predicated on that first impression. The key components of this most critical meeting are not your power point, your maps, or your draft plan for development ? they are instead a genuine, evident and clear demonstration of a sincere desire to develop a positive relationship that is based upon respect, and consideration and understanding of local communities and their interests, needs and desires. Relationship building is the foundation of proactive and positive consultation and accommodation with Aboriginal communities and the tone is set with the first meeting. C3 has refused more clients than we have accepted due most often to the fact that relationships between the company and the Aboriginal community have already devolved into a tense and toxic scenario. Land access and tenure certainty for exploration and mine development is critical to the foundation of a healthy, sustainable and environmentally and economically sound mineral exploration and mining sector. Without certainty confidence to invest in mineral exploration will be severely eroded. We all understand that substantive investments in exploration are required to increase the possibility of discovering, defining and developing new mines. The development of positive relationships based on a shared commitment of understanding, mutual respect and trust by Aboriginal Peoples and the mineral sector can provide the required business certainty and deliver social and economic benefits for local Aboriginal communities.

After several years of laboratory and field evaluations, it has been established that each frother has its own unique relationship among bubble size reduction, gas hold-up increase, froth stabilization and frother concentration. It has been shown that a frother?s hydrodynamic properties can be characterized using the relationship between the froth zone property froth height and the pulp zone property gas hold-up. The relationship is established in a bubble column run at a given air rate over a range of frother concentration. The use of relationships in frother selection and plant diagnostics is illustrated in a series of plant case studies.

The Melbourne City Link Tunnels have been constructed through a BOOT process, the largest undertaking in Australia to date. Tolling commenced on the 1.6 kilometer Domain tunnel in April 2000, and the 3.4 kilometer Burnley tunnel December 2000. The project was delivered by design construct contracting and under ISO 9000. There were a number of major challenges in completing the tunnels, including much higher than expected groundwater infiltration, hydrostatic pressures greater than 6 bar, and unique design and construction applications required to prepare the tunnels for service. This paper covers the end play and final delivery of the tunnels.

The attapulgite industry saw a year of solid growth after a weaker 2003. Demand was up between 5 percent and 6 percent driven by almost all of the key markets. Construction continued to show record new housing demand, assisted by continued low interest rates. That drove strong growth in construction related markets like coatings, tape joint compounds and other construction materials applications. The agricultural markets rebounded modestly to increase sales for suspension fertilizers, animal feeds and pesticide carriers. Oil drilling also showed strong growth due to high oil and gas prices. Sales to molecular sieve applications grew due to petrochemical and construction demand. The export markets were assisted by further depreciation of the dollar. The only weak area was in nonagricultural granular sorbents, where other sorbent materials continued to dominate.

Mining is likely to be targeted by The United States Environmental Protection Agency (“EPA”) as one of its key enforcement targets for fiscal year 2002-2003. Identifying the mining industry as an enforcement target, coupled with an increase in enforcement activity in recent years, places each mining operation at increased risk of receiving enforcement attention. A properly developed and implemented Environmental Management System (“EMS”) tailored for your operation is invaluable in reducing the risk of incurring liability for non-compliance. At the heart of an effective EMS is an audit program that checks the company’s compliance with environmental requirements. In addition, audit privilege (in select states), voluntary self-disclosure, and the attorney-client privilege serve as very effective tools for managing those liabilities that may arise during auditing a well-developed program. Of course, these latter tools are effective only if the auditing program is properly structured and properly managed. EPA and some states also provide varying degrees of immunity for environmental violations that are voluntarily disclosed in writing by the company. However, self-disclosure laws and policies typically prescribe stringent requirements for parties seeking to take advantage of them. For example: U.S. EPA has recently extended the time period in which to provide full written self-disclosure to 21 days. However, U.S. EPA’s revised Self-Disclosure guidance also addresses when a company obtains knowledge of a violation for purposes of triggering the 21-day clock and specifically extends the knowledge requirement to include the company’s agents and consultants. This expansion increases the difficulty companies may have in clearly defining and managing when they obtained knowledge. Currently, there are several techniques and technologies available which are used by mining industry in its attempts to remotely monitor the ground movements both at surface and underground mines. The currently available remote distance meters and distance change monitors mainly use phase change and time-of-flight techniques. The described monitor uses triangulation technique to track position of an optical spot projection and then image processing to measure mine wall movements. The system can be easily automated and poses no obstruction to mine traffic. The position of an off-normal laser spot will shift as the target wall moves. The described ground movement monitoring system has potential for superior accuracy and target monitoring can be made through air (gaseous) or other transparent media. The theoretical accuracy and range of this system depends solely on the resolution and focal length of the camera being used. The remote capabilities of the system make it uniquely suited to applications where monitoring is required in high-traffic, inaccessible, or unstable and dangerous areas of a mine.

The authors previously had developed a methodology that combines injury and citation measures into an overall mine safety performance evaluation tool, called the Safe Performance Index (SPI). It can be easily adopted by mine operators to monitor trends in their injury and citation experiences as a risk assessment method. In this paper, six normalized safety measures and the SPI are used to evaluate the risk that existed at mines in the two years preceding the occurrence of a fatality. The percentage of mines is given for which the risk was high or where trends of some of the safety measures indicated moderate risk. In 50% of the mines, this mine safety performance tracking method could have been helpful to the companies, state agency, or MSHA in recognizing and addressing emerging problems with actions that may have been able to prevent high-risk conditions, the fatality, and/or other serious injuries. The approach would have given scrutiny to the risk for mines that encompassed 74% of the fatalities during 2007-2010.

An exchange of coal mine specialists was made with the USSR under an "Agreement on Exchanges and Cooperation in Scientific, Technical, Cultural, and other Fields for 1972-73," which was signed by President Nixon and Chairman Breshnev on April 11, 1972.* This exchange, in the field of coal mine safety and scientific research in hazard control technologies, was one of 16 technical exchanges covered under the above agreement. A six-man USA delegation visited the Soviet Union from September 9 to September 21, 1973. The delegation visited four deep mines, three in the Donets Basin and one in the Moscow Basin, a State Safety Research Institute, a Mine Research Station and associated Research and Design Institute, two Research and Design mining equipment institutes, and a Trade Union-sponsored health sanitarium. In Moscow, the delegation received a briefing on the Soviet coal industry from First Deputy Minister Vladimir Fedanov. A similar briefing was given to us on the Donets coal basin by the Deputy Minister S. Saratikyanz of the Ukrainian Coal Ministry. Lengthy technical discussions were held with the mines staff and research personnel at the institutes we visited. In addition, we had detailed discussions with key staff members of two combinats "Donetskugol" and "Tulaugol." In all these meetings, principal topics were matters of safety related to hazards associated with face mechanization, coal transport, methane gas control measures, gas outbursts, coal and rock outbursts, fire fighting add control, explosion suppression and control measures and other related hazard factors. There was also much discussion on miner training, miner's attitudes toward safety and accident prevention practices, and preparation and enforcement of safety rules and regulations. The delegation was very warmly received and constant attention was given to our needs. Our numerous questions were answered with candor although quite often in not as much detail as we would have liked.

Operation and maintenance of California?s water tunnels is an important factor and vital link in California?s infrastructure. These tunnels are owned and operated by a variety of large and small private and public water and power utility companies, municipal agencies, and irrigation districts. Visionary pioneers such as Michael O?Shaughnessy (San Francisco Hetch Hetchy Water Supply System), William Mulholland (Los Angeles Department of Water and Power and Metropolitan Water District of Southern California?s Colorado River Aqueduct), and John Eastwood (Southern California Edison Big Creek Hydroelectric Project) built large and small water supply, irrigation and hydroelectric tunnels, which have supplied environmentally friendly-water supply, renewable electricity, and uninterrupted service to a burgeoning population and economy. This paper introduces these pioneers and describes several case histories and lessons learned during condition assessment and rehabilitation of tunnels providing enlightenment of California?s vital water projects.

Auxiliary Equipment pumping systems to support primary, secondary and regrind grinding circuits will be the primary focus of this paper. Every grinding system is unique and requires special design considerations for proper application of pumps to transport mill discharge. To satisfy the majority of applications, a new series of pumps has been developed by Svedala, known as World Class Pumps. Selection of these newly developed pumps for each type of grinding circuit will be presented. Specific components of selection are materials of construction, piping system, classification method, material characteristics and slurry characteristics. Both horizontal and vertical pump applications will be reviewed with emphasis on rules of pump piping and sump design.

Technical innovation in electrical and electronic equipment with new functions and design, stimulate consumer?s purchasing desire towards the latest equipments and this leads the rapid increase in the production of increased amount of waste materials Treason et al (2006) have reviewed the data on electronic waste generation in different parts of the world. Studies by Bertram et al (2002) have also affirmed that waste electrical and electronic components are the fastest growing waste category; this emphasizes the need for efficient recycling strategies. Recycling of electronic waste is an important subject not only from the point of waste treatment but also from the recovery aspect of valuable materials. However, recycling of electronic scrap is still quite limited due to the heterogeneity of the materials present in the products (Veit et al. 2005). A bioleaching based process offers a number of advantages compared to the conventional pyro or hydrometallurgical methods (Lee et al. 2007; Lee and Pandey, 2012). The advantages include simple, inexpensive (in some cases) and eco-friendly approach besides, generation of less active leach residue then other metallurgical processes. Though, biohydrometallurgical process has been successfully applied for the leaching of metals from ores (Olson et al. 2003; Rawling 2000), data pertaining to its application for the extraction of electronic scrap is still scanty. Recently, a few studies have been undertaken for extraction of metals from electronic scrap/printed circuit boards (Brandl et al. 2001; Faramarzi et al. 2004; Choi et al. 2004, Ilyas et al. 2007; Ilyas et al. 2010). These studies were conducted with mesophilic chemolithotrophic (Acidithiobacillus ferooxidans and Acidithiobacillus thiooxidans) or cyanogenic bacteria (Chromobacterium violaceum) or moderate thermophilic bacteria (Sulfobacillus thermosulfidooxidans). However, compared to bacterial leaching, fungal leaching has the following advantages: (i) ability to grow under higher pH, and thus is more suitable in bioleaching of alkaline solid waste (ii) a generally faster leaching process with shorter lag phase (iii) Chelation of excreted metabolites (e.g. organic acids) with metal ion, thus reduce its toxicity to the biomass (Burgstaller et al. 1993; Aung and Ting 2005). Adverse geological condition is a major factor which makes construction difficulty in tunneling. But if it is predicted and tunnel support is made efficiently in time, the above difficulty can be reduced. It is necessary to develop one or several effective and economical geological methods for prediction of tunnel geology while expensive and time-consuming instruments are used. This paper reviews and proposes several geological methods for prediction of fault, seam, contact zone, and groundwater inrush. These methods have been proved to be effective and economical in tunneling practice in China.
