PRESIDENT WETZEL: Gentlemen, the fortieth regular meeting of the Rocky Mountain Coal Mining Institute will now come to order. It is my pleasure to present Mr. William Fealey, who will introduce the first speaker. WILLIAM A. FEALEY (Bethlehem Steel Company, Salt Lake City, Utah): Mr. Wetzel and Gentlemen of-the Rocky Mountain Coal Mining Institute: The Governor of the State of Utah was sup- posed to be here this morning, but he heard Bracken Lee was in town and he took a runout powder. So without any further ado, I am just going to present the Mayor of Price, Utah, who is perhaps better known to all of you than anybody else. Mayor Bracken Lee.

MORTENSEN: On behalf of the Rocky Mountain Coal Mining Institute, I take great plea¬sure in saying good morning to you at Vail. With a few clouds in the sky, at least we won't get sunburned. We won't have to worry about our kids in the swimming pool, perhaps. It is delightful for me to have been able to have represented the Rocky Mountain Coal Mining Institute for the year 1982-1983. This has been our 71st year and this is our 79th meeting. In recognizing the attendance here, that dinner we had last night, and some of our entertainment must have gotten to some of us, or it is a little early. But I'm sure as the day goes on, and with the speakers outlined, it will be very beneficial for those who do attend. We do appreciate your attendance. I'd first like to make an introduction of our head table. Doris Finnie, she is our executive secretary. As most of you are aware, Gussie Whiteside retired as secretary. This will be the first time since the Institute started that there has not been a Whiteside present at one of our conventions. I'm sure Gussie would appreciate any calls or letters that any of you would care to make to her. Doris, I might add, has been a great help to me and all of the people who have been working on the program for the Institute this past year. There's been lots of reorganization and we are very pleased with Doris's ability to take hold from Gussie without any waves. Much credit must be given to you Doris for this and we do appreciate the help you have given us and believe me she has kept us out of trouble. Next, we have Art Neill. He is our vice president of the Institute from Montana and he also works with Western Energy Company. We appreciate the help that all of these session leaders and chairmen give to us. We have other names on the head table, but they will fill in as the morning goes on, so we won't bother you with any of those at this time. To set the stage for business, first I would like to call on Doris for a motion to approve the minutes of last year. MS. FINNIE: Thank you, Vernal. Mr. President, I suggest that the reading of the minutes be dispensed with and that the members refer to pages 9 through 80 of the Proceedings for the 78th regular meeting of RMCMI, as published MR. MORTENSEN: Thank you, Doris. Do we have a motion to so approve? MR. LINVILLE: I so move. MR. MORTENSEN: Loren Linville so approved. Do we have a second? MR. GARR: Second. MR. MORTENSEN: All in favor say aye. (Audience responded affirmatively.) MR. MORTENSEN: Those opposed? Hearing none, the motion is carried. I'm sure glad we didn't have to read those 80 pages. Is Doug Hammer in the audience? He was going to give us a list of new members of the Coal Institute and ask for your approval. But because of his absence, the names will be listed so that you can read them at a later date, I will entertain a motion that we approve the new members who have joined the Institute. Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement

Our program is rather long this morning, and I am not going to take up any of your time, as we got started a little late. I will ask Mr. Marchant to make a few announcements. (Announcements.) SECRETARY MARCHANT: I just noticed in this morning's paper a rather serious accident at Hobbs, New Mexico, in which George Kaseman, a former President of the Institute, and a loyal member ever since its organization, was killed. I think that this meeting should go on record and prepare a resolution of condolence, etc., and with your per- mission we will have the Committee on Resolutions do that.
