The oil and gas lease is the basic contract of the oil and gas industry; it is the foundation stone upon which the producing industry, particularly, is based. As the industry is precarious and highly speculative, the foundation contract should be of the utmost integrity and certainty. But right there an anomaly exists; the oil and gas lease is the most obscure, most uncertain, doubtful contract in the realm of law today. That is a condition that must be considered when taking oil and gas leases, and when buying, selling, and holding them. It may fairly be asked why should this industry rest upon so insecure a foundation. Why should not the oil industry rest upon the contract that is the basis of all industry, the warranty deed? There are many contributing reasons, but the principal one is business expediency. The Anglo-Saxon idea of ownership of land is that every land owner owns from the center of the earth to the sky—all that is above and all that is below—consequently the oil and gas are owned by the person who owns the surface. That idea is not exactly true with reference to oil and gas, for many states have adopted the doctrine that oil and gas are like wild animals; they are fugacious and migratory and belong to the man that traps them. But, except for that doctrine, we believe that oil and gas are owned by the owner of the surface, wherein we differ from the Latin-American countries where the mineral rights are owned by the government. The United States was settled largely by homesteading. The owners of land were, in the main, farmers, who did not have the means or the faith to drill for oil or gas. The operators or speculators did not want to buy the land on the mere possibility of finding oil; hence a compromise resulted by which the land owner gave the speculator or the operator what he called an oil and gas lease, or a right to go upon his land and drill for oil and gas. What is supposed to be the first oil lease placed on record reads as follows: Agreed this 4th day of July, a.d. 1853, with J. D. Angier of Cherrytree township in the county of Venango Pennsylvania that he shall repair up and keep in order the old oil springs on land in said Cherrytree township, or dig and make new springs, and the expense to be deducted out of the proceeds of the oil, and the balance, if any, to be

MANY trends were evident in the coal industry during 1951. Some were favorable for the industry; others were not. Probably those having the most far-reaching consequences are those affecting coal's markets. The rapid dieselization of many railroads and the continued trend toward oil and natural gas for home heating has caused serious dislocations in various mining districts. Mines have been forced to close down or to work on a reduced time basis. Conversely the increased activity in the metallurgical industries has increased the demand for coking and special purpose coals, and the growing production of electric energy has increased the demand in certain areas for steam coals. The increased demand for metallurgical coal and for steam raising by the large utilities is more than equal tonnage-wise to the loss of coal to railroad dieselization and conversions to oil and gas in the domestic market. Since much of the expansion is at captive mines of large corporations, many commercial operators supplying railroad and domestic users have had their markets curtailed without any compensating demand from other sources. Feverish activity was in evidence in many areas by commercial operators attempting to find new markets. The Norfolk and Western Railway is the, only major American railroad committed to the burning of coal. It has an exceptionally good cost record. During 1951, fifteen additional modern coal-burning steam switching locomotives were authorized for construction in the company's Roanoke shops at a cost of about $1,450,000. When the new order is completed the road will own a total of sixty locomotives of the modern-switcher type, including thirty acquired by purchase last year. The Norfolk and Western today is the only American railroad building its own motive power. All of these locomotives burn coal. Production Coal production in the year 1951 will approximate 570 million tons of anthracite, bituminous coal, and lignite. Of this, approximately 7 pet is anthracite. Total production is approximately 30 million tons more than in 1950 and reflects the increase in general industrial activity. Exports are expected to be close to 50 million tons. The industrial stockpile is close to 75 million tons, the highest it has been since 1943. With the exception of the usual local stoppages the year 1951 was unmarked by labor disputes. It was a year of good labor-management relations with a negotiated wage increase unmarred by a work stoppage. This may be the beginning. of an era of sensible negotiations to find agreeable settlements of disputes without the usual protracted bickering and industry-wide strike. The United Mine Workers of America has condemned wildcat strikes, stating that in nearly every, instance proper grievance procedures have not been instituted. Government defense organizations, perhaps profiting by their experiences during World War II, are pursuing a more enlightened program with regard to the fuel requirements of the nation. Many prominent officials have stated that wherever possible coal should be considered the primary source of fuel in all defense expansion. With the increased consumption of steel by defense projects, approval of transportation facilities for liquid and gaseous fuels have been refused where these fuels would enter a coal producing area. Liquid and gaseous fuel producers also have failed to provide satisfactory evidence that they have sufficient reserves and are capable of supplying their product in adequate amounts for the periods of time required. Realization has at last become prevalent that the hydro-electric power installations in several areas are insufficient to handle increased demands.' Steam generating plants are being constructed in these areas and equipped to burn coal. Most notable of these, is the TWA area whose supplemental steam power plants are expected to consume 10 million tons of coal per year when completed. The Pacific Northwest is another area which is expected to follow the same pattern. Nearly all new steam-power generating plants are being equipped to burn coal either as a primary fuel or as an emergency measure. Metallurgical Coal The steel and other metallurgical industries are expanding rapidly to meet increased industrial demands and defense orders. Since these industries are dependent on coke, coke has had a year of high production and can be expected to break all existing records when steel-plant expansions are completed. Most notable of the expansion projects is that of the Delaware River area where the iron ore will be received by ship from Canada and South America. U. S. Steel is only one of several steel corporations that are planning on putting integrated steel producing units in this area. The Defense Solids Fuels Administration announced in December that through. Lead-zinc production in Canada accounted for 19% of the total value of metals and minerals produced in 1976, says Keith C. Hendrick, president of Noranda Sides Corp. Mine production of recoverable zinc w as 1. 158 million toils of 27.4% of free world production in 1976. Slab zinc pro¬duction was placed at 472,000 tons that year. Canadian mine production of recoverable lead was 247,000 tons or 10.6% of the free world production. Refined lead that year was at 177,000 tons.

EVE have studied the gold-aluminum system by X-ray diffraction and by the microscope over the entire range of composition for temperatures between 300° and 500° C. Results obtained are shown in Fig. 1, com-bined with the work of Heycock and Neville1 at higher temperatures. The diagram differs in important details from that given by Hansen2 in his critical compilation of the literature of binary alloy systems. This work was, undertaken both because of the intrinsic value of a knowledge of the phase diagram of this system and because of the need of theoretical metallurgy for precise and accurate data, particularly X-ray diffraction data. Systematic studies of equilibrium diagrams, particularly by Hume-Rothery,3 have shown regularities that yield a certain insight into the nature of alloying forces. It has been shown, for example, that solid solubility depends on the concentration of free electrons in the alloy, on the relative radii of solvent and solute atones, on the forces of attraction between atoms, and on the relative stability of intermediate phases. The well-known Hume-Rothery rule states that the crystal structures and compositions of many intermediate phases depend on the electron-to-atom ratio. This has been confirmed and extended by wave mechanical calculations.4 A knowledge of the forces between atoms in alloys, even an imperfectly developed empirical one, should be a valuable guide in the preparation of technological alloys of desirable properties. Furthermore, such informa-tion is basic in such problems as rate of diffusion, age-hardening, phase transformations, and others. (Washington Meeting, May, 1905.) SEVERAL years ago, Mr. Robert A. Cook described and illustrated in our Transactions 1 a mechanical coke-drawer, patented in 1891 by Mr. Thomas Smith of the Thorncliff Iron Works, Sheffield, England, and first introduced in the United States in, 1896, at the coking-plant of the Latrobe Coal Co., Latrobe, Pa. This machine has not received any very extended application in this country, although it was successfully used in two places for a number of years. The present. paper describes a new and simpler machine, containing few wearing-parts capable of withstanding continued rough usage. Anything which tends to prolong the general use of bee-hive ovens will be welcome to those who are interested in cheapen¬ing the cost of producing coke in such ovens, especially if it provides satisfactory mechanical means, replacing the hard labor involved in drawing coke by hand with the old-fashioned ?duck bill.? The difficulty of finding efficient coke-drawers, especially during the summer season, and in the South, is notorious. Yet, notwithstanding the great improvements that have been made in retort coke-ovens, new bee-hive ovens are continually constructed; and a machine which will successfully compete with hand-drawing, and, at the same time, add to the efficiency of the bee-hive oven, seems to deserve notice. The machine here described was put in operation at the Frick Coal and Coke Co.'s plant, known as Continental No. 1, at Uniontown, Pa., in October, 1904, and is reported to have met successfully all the tests to which it has been subjected. Publication of the article "The Flotation Behavior of Digested Asphalt Ridge Tar Sands" by R.J. Smith and J.D. Miller has confirmed and again spotlighted a most significant and important development in the field of tar sand and heavy oil mining. This is the ability to recover 95% of the bitumen in dry tar sands by a hot water process. The initial investigation by Miller and Sepulveda in early 1978. "Separation of Bitumen from Dry Tar Sands," was the first blockbuster. It is disappointing that there has been so little scientific and industry ackowledgement that the authors laid to rest the long entrenched belief that the sand grains had to be "water wetted" for a hot water process to be applicable. Dr. Miller and his researchers at the University of Utah used slightly different mineral dressing terminology in describing their process but it is essentially the old, established technique of high &lids attrition scrubbing at elevated temperatures with a conditioner or modifier, followed by dilution and froth flotation. Similar techniques were described in detail for other nonmetallic minerals in the mid-1940s by Stuart Falconer of American Cyanamid Co. The authors used a 15-minute "scrub" period (or in their terminology "digester step") at 73% solids and 95OC (203°F) in a 0.3 m solution of sodium carbonate-about 4 kg/t (8 lb per st) of tar sand. Flotation was at 10% solids. Obviously, the scrub is an expensive step with respect to energy input but the high recovery of bitumen appears to justify it. Two basic questions then arise: What are the effects of shorter scrubbing time, lower temperature, and less sodium carbonate? Would a two-stage approach be advantageous? That is, could you get the major proportion of the bitumen with a mild scrub and apply the high power and temperature only to the refractory portion? These variables should be evaluated. Apparently, all results were only for rougher flotation. What would the grade and recovery of bitumen be if multiple cleaner flotation steps were employed? We must concede that a 60.62% grade of bitumen leaves considerable room for upgrading. Finally, it should be noted by all executives who approve funds for heavy oil recovery schemes, most of which are variations of in-situ methods, that mining can yield a 95% recovery of bitumen. That is correct, 95%. Imagine what that does to the total barrels recovered from a heavy oil resource compared with the scrawny 30-35% maximum recovery we are getting now. The conclusion-let's mine heavy oil and tar sands.

THE primary objective in laying track in panel sections is to reduce the number of track laborers required. This is possible because the work is mechanized. Moreover, because the work is mechanized and each of the operations needs only a few men, and each is self-contained, the work can be carried on at night as well as in daylight; therefore, the method provides a means of preparing tracks on more than one shift. The laying of tracks in open pits and quarries in panel sections is not new but new methods have been made possible by the introduction of new types of equipment. The purpose of this paper is to describe the methods that are followed in' the Morenci open pit. GENERAL MINING OPERATIONS Full-scale ore production at Morenci is about 50,000 tons daily. The normal yearly output of ore and waste is 32,000,000 tons, of which 30,000,000 tons is handled by rail haulage. This requires the building of approximately 47 miles of loading and other temporary tracks during a 12 months' period (Fig I). Broken ore and waste, is loaded., into 90-ton capacity dump cars with 5-cu-yd full-revolving electric shovels. Shovel banks are uniformly 50 ft high:. They are blasted- with churn drill holes, and the broken material from a blast is loaded out with two shovel cuts, the first one being called (locally) the "splatter" cut and the second one the "clean-up" or "face-up" cut. When a shovel is making its clean-up cut, the loading track is about 70 ft from the toe of the bank and, under normal conditions, a bank is blasted against it without removing the track. It is thus evident that each track is used for two shovel cuts before relocation is necessary, inasmuch as a single position serves for both the clean-up cut prior to blasting and for the splatter cut following the blast. The normal advance of a solid bench by a single blast is 40 ft (Fig 2). PREPARATION OF PANEL GRADE In preparation of panel grades bulldozers and rooters are used for the bulk of the work and an auto-patrol road grader for the final stage. At Morenci, bulldozers have always been used for track-grade preparation, but before the introduction of the other two types of equipment grades were uneven and irregular at best, and always necessitated a big gang of track laborers to hand-block under the ties with rocks after a track was laid into place. High blocking also made poor track because of instability and caused frequent derailments. Under these conditions derailments were generally bad as re-railing became difficult. Much track was torn up and many ties broken in the process. The inadequacy of the hand-blocked track, together with the inefficiency of hand blocking, constantly pointed to the desirability of reducing the amount of labor required, so various means were tried to improve conditions, such as wood

Equipment was constructed which permitted the hot compression of 99.8 pct Armco iron and 2.8 pct Si steel at constant true strain rates of 0.05 to 1 per sec over the temperature range 600" to 1000°C. A maximum true strain of 1.9 could be attained, followed by immediate quenching or by isothermal annealing. True stress-true strain curves were obtained, and the steady-state flout stress, a, strain rate, i, and temperature, T, were found to fit the following expression: The constants A, a, n', and AH were determined for the two ,materials. The activation energies obtained for Arrnco iron and silicon steel are 66 and 80 kcal per mole, respectively, and approximate those for seu- diffusion and for creep. This indicates that hot compression is a diffusion-controlled thermally activated process. THE hot compression of iron and steel is usually carried out in the austenite temperature range,1"7 as this is the one of greatest interest with respect to industrial hot working. However, a disadvantage of testing in the austenite range is that the hot-worked structure is destroyed by the phase transformations taking place during cooling. The present study was therefore carried out in the ferritic temperature range, and the hot-worked substructures were preserved by rapid quenching after deformation. The substructural results will be described in a separate paper, and the present communication is restricted to the strain rate/stress/temperature relationship observed during hot working. The results of hot-compression testing are usually given in the form of true stress/true strain curves, with a different curve for each temperature/strain rate ~ornbination.',~,~ Sometimes simple algebraic equations are fitted to the curves, so that certain extrapolations or interpolations can be performed.1'2'5 These equations are, however, devoid of mechanistic interpretations. The present study was undertaken to show that hot compression can be described by an equation of the type used in creep studies. That is, it will be shown that the temperature dependence of the strain rate in hot working is well-represented by an Arrhenius term, with an activation energy similar to that for creep. Also it will be seen that the stress dependence of the strain rate is similar to that for creep EXPERIMENTAL METHOD AND MATERIALS The investigation was carried out with the following three ferrous materials: 1) Armco iron; 2) Armco iron with 0.26 pct Mn; 3) 2.8 pct Si steel. The first two materials were utilized for investigations performed in the temperature range 600" to 800°C; the last one was used for tests at temperatures from 600" to 1000°C. The materials were of commercial purity,* as shown in Table I. Cylinders of five different sizes were prepared by strain annealing. The resulting mean grain diameter was 3 mm in the 1-in. Armco iron and 2 mm in the other sizes and grades. Different ratios of diameter/height were used to enable the determination of the coefficient of friction. The specimen faces were provided with concentric grooves, which acted as lubricant holders during compression, as recommended by English and ~ackofen' and others.2'9 Powdered glass lubricants were applied to the samples before hot compression to decrease friction and barreling, following the practice of previous investigator~.~~~~~~~~ Different mixtures of glass powder were used for each temperature, after the determination of suitable compositions by experiment.'' Equipment for Hot Compression. Hot-compression tests were carried out on an adapted 150-ton vertical hydraulic extrusion press and also on a modified high-temperature creep machine. The modified extrusion press was used for temperatures up to 800°C. The following items were added to the press: a) a high-temperature furnace with built-in upper and lower platens; and b) a transmission assembly, which permitted the attainment of logarithmically decreasing crosshead speeds. These accessories are described in detail in Ref. 11.

STATE geological surveys have had an interesting development in this country. They first appeared more than a hundred years ago. The fact that they have persisted and are now an important part of most state governments indicates the basic need for state departments con-cerned with mineral problems. The number of state surveys in 1941 (43) is at an all-time high, as is the aggre¬gate appropriation for their support for the fiscal year 1940-'41 ($1,600,708). The first surveys, those of North and South Carolina (see Fig. 1), made their appearance in 1820-'30, but neither survived that period. During the next two decades surveys were created in twenty states, but only three survived. In fact, it was not until the decade 1900-'10, when eighteen surveys were created and only five abolished, that these agencies became firmly established.

J. H. HEGINBOTHAM, a, metallurgist of the General Engineering Co., talked on "Current Milling Practice at Kirkland Lake," at the December meeting of the Utah Section. The ore is enough alike through the whole district so that some generalizations and comparisons may be made. The question as to whether or not the flotation process should be used in the flowsheet for extracting gold by cyanide solutions is still being vigorously debated, and it will seemingly need some years for a definite answer to be given. Most of the gold is either free, though much of it is finely dispersed in quartz, or occurs with pyrite. At times there may be 2 per cent of telluride compounds in the ore, but the amount of gold telluride present is small and has not been definitely established. It has been shown by Dr. Haultain and others that though gold tellurides may be so finely disseminated that it is necessary to grind the ore exceedingly fine, the compounds themselves are not difficultly soluble. (An increase in temperature helps to dissolve tellurides, and also to settle pulps.) It is likely that if the ore were ground through 400 mesh, practically all of the gold would be soluble. As it is, with 96 to 98 per cent of the ore ground to minus 200 mesh, and some 70 per cent minus 325, the cost of

ACCORDING to the records, Phelps Dodge made its original entry into the production of copper in the oldest copper mines of Arizona at Morenci in 1881. The ore body now being mined as the Morenci open-pit, as outlined by churn-drill holes, diamond-drill holes, and underground workings, is estimated to yield 230,000,000 tons of ore averaging 1.06 per cent copper. This development will add 2,500,000 tons of copper to the 900,000 tons already produced in the district. Some five years ago preliminary development of the ore body began, with big-scale production planned including the erection of a new treatment plant to be built near the mine. Inasmuch as the Morenci open-pit was an entirely new project this required the grading of roads, establishment of mining benches, construction of railroad grades, building of railroad tracks, erection of shops, as well as the purchase of the necessary equipment to satisfactorily and economically maintain the schedules of production forecast. Along with the preparation of the main ore body it was also desirable to mine and deliver to an experimental mill a relatively small daily tonnage of typical ore.

THE present ruling principle in shop and factory, induced by conditions of. keen competition, is to do the greatest amount of work in the shortest time, or in other words, to secure the greatest output at least cost, a condition which generally necessitated the substitution of machinery for manual labor. The chemical laboratory in our industrial establishments has remained a factor of minor importance, and, for this, reason, not only has progress been permitted to lag, but the methods of analytical work have been carried on along individual traditional lines. Some works-laboratories are equipped with such conveniences as Gooch filters, suction-pumps, compressed air, shaking-machines, centrifugal machines, crushers, etc., yet there is much room for improvement, particularly in laboratories of metal smelting and refining plants, in which long series of filtrations and stirrings are performed singly by hand in a slow and laborious manner. There are also many other instances in which collective handling appears rational. As a rule the chemist wastes much time by such manual labor, which, in a modern establishment and under up-to-date management, could be more advantageously applied to useful chemical work; and such higher chemical work is gradually and surely becoming recognized as an essential extension of old-time methods of assaying. While it maybe said that in some laboratories, boys and not chemists do the manual labor, it should be borne in mind that all chemical work requires care and accuracy and in these respects boys are naturally a source of concern to the responsible chemist. Moreover, the cheapness of child-labor is largely offset by the increase in the expense-account of laboratory materials, caused chiefly by breakages resulting from care¬lessness. (New Haven Meeting, February, 1909.) THE Hammond Mining and Metallurgical Laboratory is the gift of Prof. John Hays Hammond to the Sheffield Scientific School of Yale University. Professor Hammond was graduated from this school in the class of 1876, and has always shown great interest in its welfare and progress. In 1903, he offered to build and equip for it a mining and metallurgical laboratory. This offer was gratefully accepted by the trustees; and in October of the same year the architect, W. Gedney Beatty, and the writer were employed to draw up plans for the building, which is the largest of its kind in this country. The Treasurer's report shows the total gift of Professor Hammond, including land, building, and equipment, to have been $128,741.53. This does not include $5,000 given by Professor Hammond to defray incidental expenses. MECHANIZATION of coal mine, is radically changing the requirements for under-ground transportation. It has increased materially the need for reliability and belt conveyors are the most dependable means of moving coal away from the place where it is mined. Their record of freedom from delays is almost 100 per cent. Why then are- not belt conveyors in more general use. Part of the answer lies in the pour records made at some of the earlier installations, and in the fact that belts have so long been identified as a type of equipment suitable, in the main, only to thin seams. Another reason is lack of knowledge of the full potentialities of belt transportation.

THE Star shaft is near the north boundary of the group of mining claims belonging to the Ground Hog Unit of the American Smelting and Refining Co., near Vanadium, N. Mex. The shaft bins and surface plant are served by a siding from the Atchison, Topeka and Santa Fe railroad, and this factor of railroad transportation influenced the choice of site. This paper describes the shaft sinking only, and does not cover the surface plant or other parts of the mine or its equipment. A. J. The shaft has four compartments, as shown in fig. 1. Equipment: Riddell Mucker: The mucking was done by a clamshell bucket and a Riddell mucker, which, as in other shafts sunk with this machine, consisted of a carriage mounted on axles with double flanged wheels that traveled back and forth on a swinging track, parallel to the long axis of the shaft (fig. 2 to 6). Three air motors were mounted on the carriage; one hoisted the clam, one operated the bucket opening and closing device, and the third moved the carriage along the track. The carriage was designed with guide shoes and could be hoisted to the surface in either skip compartment without trouble (fig. 4). During blasting operations the clam was tied on the rails and the carriage was hoisted up a few sets to protect it from flying rock. No attempt was made to hoist the carriage and clam together lest the clam catch in the timbers. The track on which the carriage operated was built of extra heavy 6 in. pipe with 1x2 in. strap welded on top for rails. A Yzx4 in. angle was welded on the bottom of the 6 in. pipe with a 1 in. round rod welded in the angle for a filler and additional strength. The end or cross pieces of the track which kept the track to gauge, were also made of reinforced, heavy 6 in. pipe and were bolted to the long members on which the carriage traveled (fig. 2 and 3). This section of track was used, instead of heavy railroad rails, for two reasons: (1) this section would bend before it snapped and was much safer for the men in the bottom; and (2) it was a better blasting shield, and protected the timbers better, in fact, only five wall plates were broken by blasting in 1926 ft of shaft, although 150 to 225 lb of 40 pct powder was loaded per round, depending on the ground conditions. The swinging track was supported by four % in. hoisting cables anchored to the end plates. There were also four safety cables fastened two to three sets above the carriage, which would catch the carriage if one of the supporting cables should fail for any reason (fig. 7). Clamshell Buckets: Two clams were used, each of % yard capacity, both manufactured by Blaw-Knox, Nos. 662 and 663. The No. 663 clam was 4 in. wider and 5 in. shorter than the No. 662, but seemed to dig and load more satisfactorily. It was easier to hoist and lower when it came up for repair. NUMEROUS requests for the suspension of publicity make difficult the preparation of the annual review of copper metallurgy for 1934. In the United States, sales allocations indirectly have set restrictions on the scope of activities of producers and refiners, and necessitated closer cooperation between secondary and primary producers. However, the feeling exists that preparations for a return of intense competition should not he neglected, and careful investigations are being conducted for ways and means of improving industrial positions and production methods. In all probability, efficiency in technique and equipment will prove of far greater importance in the near future than production capacity, and many important developments in copper metallurgy later will be found to have been born during the current year.
