Our next speaker this afternoon is a good friend of mine of some years. I must introduce him by way of a little story. Now Harris Sherman, many of you know because he was really in charge of everything to do with the mining industry in the State of Colorado for a good many years. Some of you may know that before he became part of Governor, Lamm's first cabinet as Director of Department of Natural Resources, he was an attorney for the Environmental Defense Fund and that caused me considerable panic as I think it might have caused some of you. I have observed Hams from the time he stepped into that office until he retired from that office to go into private practice as the senior partner of Arnold & Porter's Denver office, one of the , nation's most prestigious law firms. Hams is a Colorado native. He's lived here all of his life. He's a graduate of Columbia Law School for his law degree and a graduate of Colorado College down at the Springs for his BA. He has served in state government, but I thought it might be appropriate, since he is no longer in state government, if we used Harris, today, to tell us from a former state official's perspective what the image is of the coal industry from the seat he held in Governor Lamm's cabinet for a good many years. Gentlemen : It is a pleasure to come to Glen- wood Springs to participate in this meeting of the Rocky Mountain Coal Mining Institute an organization created to handle chiefly the economic questions dealing with the coal industry of the Rocky Mountain District. I am not unmindful of the many and varied problems confronting the mining industry of this country which is so general at the present time throughout the United States. By reason of the difficulties experienced in marketing the product of your mines, there is all the more reason for greater economy and efficiency in production. No industry can be efficiently operated without giving due consideration to the safety of the employees. Safety and efficiency are inseparable for the success of any industrial enterprise. While the Bituminous coal companies of the United States are doing splendid work in the promotion of safety, yet our fatality rate is exceedingly higher compared with that of foreign countries, and with greater cooperative organized effort on the part of mine owners, mine officials, mine workers, and state and federal governmental agencies having jurisdiction, much more substantial progress can be made in the future and a greater economic saving .to the industry effected, not taking into consideration the greatest and most important phase of safety, which is the conservation of life and health of all those who are engaged in the occupation of mining. You are concerned with freight rates, marketing of coal and similar operating problems. PRESIDENT MOSES: I think this will conclude our program for this afternoon, unless you have some- thing else. Mr. Holman, will you tell us what you are doing in the way of your local chapter, around Dawson? W. C. HOLMAN: (Chief Engineer, Phelps-Dodge Corporation, Dawson, New Mexico.) We have organized a local chapter of the Rocky Mountain Coal Mining Institute, and we invite all foremen, fire bosses, shot firers or anybody interested, either on the surface or in the mine. I think at the last meeting we had sixty to seventy men present. We hold meetings once a month; usually on a certain set Tuesday or second Friday of the month, or so on. We have a President, a Vice-President and a Secretary-Treasurer. There are no dues connected with it. We aim to take up the' papers that are presented at the various meetings of the Rocky Mountain Coal Mining Institute, and also any other subject that would be of interest, connected with our own mining operation. We usually ask two or three men to pre- sent papers, rather than one man. We find it difficult in getting one man to work up any subject, but two or three men work up very interesting papers. While we have just recently organized, we aim to have luncheons in connection with it, and possibly once a year a banquet or .some similar activity that we think would interest the men. We feel it is going to be a great help in carrying on the work of the present organization in presenting the activities around the mines. PRESIDENT MOSES: I thank you, Mr. Holman. Has any one any- thing to bring up at this time? MR. LITTLEJOHN: I would like to ask Mr. Holman if the Institute or the Chapter there is confined to Dawson alone, or open to other camps in New Mexico? MR. HOLMAN: At the present, Mr. Littlejohn, it is just confined to our own camp, although we intend to invite the members and the officials of the other camps later on, perhaps. Especially, if we gave a banquet, no doubt we would invite the others. MR. LITTLEJOHN: Is there any other Chapter in New Mexico besides yours in Dawson, Mr. Holman? MR. HOLMAN: None that I know of, right now.

The thought and practices in the field of accounting in the past two or three years are undergoing far-reaching changes, but more important than this is the changing viewpoint of business managers toward accounting reports and statistics. Accounting is no longer considered a necessary burden of business, for progressive managers and operating officials everywhere look upon it as a service. A service of supplying operating men and executives with information on their affairs which enables closer and more effective supervision, to the end that business may be conducted more satisfactorily and more profitably. This service is the real function of accounting in business management. Of the many treatises on accounting published in recent years, the great majority deal with principles and procedures, and were written purely from the accountant's point of view, thus they appeal, and are of interest, chiefly to accountants. Recently, however, the interest displayed by the operating man, be he president, general manager, superintendent, mine foreman or potential mine executive, calls upon the accounting department to serve him in furnishing him with figures showing the financial position and economic progress daily. In order to effectively render this service the necessary co-operation between management, operating and accounting -forces must exist. Satisfactory services may be developed only on a basis of close contact and pulling together between these departments. It is not a one-man job, the responsibilities necessarily rest on all. This co-operation contemplates:

The Colorado Fuel and Iron Company has divided their coal mines into groups or divisions: Las Animas, Huerfano, Fremont and Gunnison counties. Each division is represented by a safety committee composed of three men appointed by the management and three men selected by the employes? representatives. The three men appointed by the management are usually from a group engaged in routine work that is primarily of a safety nature. Mr. Robert McAllister, chief mine inspector; Mr. George B. Parker, superintendent of first aid and mine rescue training; Mr. F. C. Miller, chief chemist, fuel department; and Mr. 0. C. Irwin, assistant chief electrician. The three men appointed by the management act in each of the four divisions. It is the duty of the safety commit- tee to visit each mine three times per year and make a thorough investigation of conditions underground and on top. Their report is in the form of recommendations to the management for their consideration. They are also called to investigate all fatal accidents and learn, if possible, the cause leading up to the accident and recommend precautionary measures that will prevent the recurrence. This committee inspects the haulage roads, air courses, manways, electrical equipment, ventilation, timbering, working places and humidity. In addition, each mine has a local safety committee with the superintendent acting as chairman. It is the duty of this committee to keep in daily touch with conditions underground and on top. They hold weekly meetings and discuss problems related to safety. These men work on local conditions that govern their affairs. As an example: One of the mines has a checking out board at the man-trip parting in addition to the regular checking in and out system as required by law, and this board is checked before the man-trip leaves for the outside, giving the officials a chance to take prompt action in looking up a man who may have become ill or injured. Should a man walk out and forget to check off, there is a penalty imposed. The ventilation of a coal mine is most important and the method of conducting the air to the working face is one of the greatest precautionary measures linked with safety. A quantity of air must be maintained at every working face to insure rapid diffusion of explosive or noxious gases and in a manner without interruption. With this intent in, view, the Colorado Fuel and Iron Company is installing fan equipments with capacities of 200,000 cubic feet per minute with dual drives, twin fans in some instances, for insured circulation. I'm the Vice President of the Rocky Mountain Coal Mining Insitute from the state of New Mexico. I'm manager for the Navajo Mine down in Farmington, New Mexico and also project manager for a new mine that we're starling out called the LaPlata Mine in the same area. I'd like to introduce our first speaker, Tom Lien, who is the Director of Engineering, Western Division of AMAX Coal Company. He is responsible for mine engineering, environmental engineering, permitting, reclamation, planning, design and construction plant engineering, geology exploration, quality control and real estate for the western division. He joined AMAX Coal in 1980 as manager of preparation and quality control and was promoted to the present position in August of 1980. He has a BS in geological engineering from the University of Mines. He previously worked for Kennecott Copper Corporation in Hayden, Arizona from 1965 to 1970. He worked as a mine geologist, mill metallurgist, mine production and quality control engineer. Then he also worked for Kaiser Steel Corporation, Eagle Mountain Iron Ore Mine in California, 1970 to 1977. Worked as a process engineer and plant superintendent at that place. Then he was employed by Mountain States Research and Development, Tucson, Arizona, 1977 to 1980. Worked as a senior process engineer and operation superintendent. So without further ado, I'd like to introduce Tom Lien who will talk to us about in-pit coal crushing. MR. LIEN: Thank you. The official title of my paper is actually: "The Potential for In-pit Crushing and Conveying in the Powder River Basin." The Powder River Basin is one of the world's greatest coal fields and will be an important source of energy for centuries to come. About one-eighth of the total coal producing in the United States comes from the Powder River Basin, and 80% of that production came out of Campbell County, Wyoming last year. The growth potential for this region is projected to be enormous. New technology as well as existing technology will make this region competitive in the decades ahead. Understanding the current status of the Powder River Basin, both the mines and the possible methods for changing the means of material movements within the mines is the subject of this paper. Each mine is unique and must be addressed specifically with respect to the application of new and innovative technology. There have been many articles written in the recent mining journals on in-pit crushing and conveying applications, including costs which are very interesting, enlightening and I recommend it to any company considering such installations. To give a general setting, coal production in the United States for 1982 was about 800,000.000 tons. This production came principally from six regions, the Applachian fields of the eastern states where bituminous and anthracite coals have been mined for almost three centuries, the Midwest located in the upper Mississippi Valley are often typified by huge dragline operations of which AMAX Coal has three right now, the Gulf Coast lignites. feeding mine-mouth power plants, the vast bituminous and sub-bituminous departments of the four-comer states of Arizona, New Mexico, Colorado, and Utah and finally the Northern Great Plains lignite fields currently being developed and the sub-bituminous fields of Wyoming and Montana including the Powder River Basin. The Powder River Basin is located in northeastern Wyoming and southeastern Montana. It is the darker brown right in the center of the photograph. It covers about 18,000 square miles. It's about 200 miles north to south and 90 miles east to west. The shallowest coal beds are on the east, north and northwest edges of the basin with deeper coal beds toward the center in the same kind of relationship. There are about one trillion tons of coal in the Powder River Basin, that's the one with 12 zeros after it. A little bit there. It's distributed in many, many seams at varying depths to the current topography. In 1982 about 100,000,000 tons of coal were mined from this basin and 81,000,000 tons came out of Campbell County, Wyoming. The mines that are shown in this picture are basically the mines around the basin edge. The principal area that I'll be talking about is the eastern edge down where it shows Gillette and Campbell County. Geologically the Powder River Basin is the Fort Union formation. The most productive seam is called the Wyodak or Smith-Roland or the Anderson-Canyon, depending upon where you're located. There is about 75 billion tons of coal in the Wyodak of which about 23 billion are considered surface minable today. the coal is Paleocene in age, about 40,000,000 years old. It was once an old Delta region very much like the Mississippi River delta is today. During the 100,000 years that this deposit was formed peat accumulated to a thickness of about 365 feet. It was later buried and turned into sub-bituminous coal. All of the coal mined in the basin is for the electric utility industry. This coal has a typical BTU content of about 8,300 plus or minus about 4,500 BTUs. Sulfur coal is generally less than'/ %, thereby making this coal compliance coal in terms of sulfur dioxide emissions, 1.2 pounds of sulfur dioxide per million

PRESIDENT MOSES: I thank you, Mr. Emrick. Mr. Shubart would like to supplement your paper with another article. SECRETARY SHUBART: My paper really should not supplement Mr. Emrick's paper, because I secured some data from him, I knew Mr. Emrick had had a great deal of experience in shearing and I thought he could give you some useful data. (Here Mr. Shubart read the following:) "For the past two years, there has been considerable discussion among coal mining men concerning the advantages of a shearing cut in addition to the undercut, in mine work. We have had a number of requests for information on sheared coal. We were asked questions like these: What percentage increase in lump can be obtained from sheared coal? What has been the experience of mine men who have employed the shearing cut? Is the shearing cut a means of increasing the lump content? If so, is it increased to such an extent as to warrant the installation of shearing machines? Upon investigation it was found that no one could give us any definite information on the subject as no one had weighed separately the grades of coal produced from' the shearing cut. With a view of getting this information first-hand, the Goodman Manufacturing Company built up a shearing machine to be used in experimental work only. The officials of the Troy Coal Company were eager to share in the expense of obtaining this information, so that in May of this year we shipped to their mines our first type 319 shearing machine. The Troy Coal Company operates a mine at Troy, Illinois, in the No. 6 seam and produces about 275 tons daily. The coal seam averages five and one-half feet in thickness. Previous to the arrival of the shearing machine the coal was undercut six feet deep by a' Goodman Shortwall Machine. To break down the coal required two shots in the entries and three in the rooms. The percentage of lump measured over two-inch screens, averaged 58.2 per cent. The conditions of the mine were very favorable for obtaining accurate weights on the amount of lump and slack coal run over the shaker screens. The shearing machine easily cut the entire tonnage of the mine so that all coal dumped into the railroad cars had been produced from a shearing cut, in addition to an undercut. Accurate records were kept of the railroad weights and front this data the percentages of lump and slack were computed. During the month of June the percentage of lump produced over two-inch shaker screens was 69.9 per cent. This result demonstrated that the introduction of the shearing cut had increased the percentage of lump twenty per cent. The entries were driven ten feet wide and the rooms thirty feet wide The shearing cut was made near the center of the face in all places. A hole was drilled in each rib and the coal shot down with one-half the powder required when the places had been undercut only. The coal was broken down to the back of the cut so that very little pick work was necessary to load it out. The benefits derived from the shearing cut were as follows: 1. Increased percentage of lump, thus increasing the average price of coal per ton. 2. Preservation of a tender top due to the decreased amount of explosive used. 3. Facilitated handling of coal by the miner thus increasing the tonnage per man. 4. Eliminated coal yardage in entries and crosscuts of ten feet or less in width for the reason that the shearing cut provides a loose end from which to shoot the coal. This applies to the union fields only, as the non-union mines do not pay for coal yardage. Based on a price of $2.50 for lump coal and $1.25 for slack coal, the average price per ton was increased

?Twowinters ago, what had been a mediocre safety record at West Virginia?s Sago Mine grew dramatically worse. Over 23 months beginning in February 2004, two dozen miners were hurt in a string of accidents, some of them caused by rock chunks falling from the mine ceiling. Federal safety inspectors slapped the mine with citations 273 times, or an average of once every 2 ½ days. Despite this record, the price paid by Sago?s operators was light. Government regulators never publicly discussed shutting down themine and never sought criminal sanctions. The biggest single fine was $440, about 0.0004 percent of the $110 million net profit reported last year by the mine?s current owner.? -Washington Post, January 8, 2006

C. Williams Frank Cameron J. E. Pettit D. W. Brown C. H. Gibbs E. H. Weitzel acted as chairman of the meeting. This committee drew up a form of Constitution and By-Laws, to be recommended to the general meeting to be held on the following day; and, with the exception of two alterations, this Constitution and By-Laws, formulated by the Organization Committee, were accepted as a whole by the general meeting. With the exception of a general discussion of affairs that might be brought out by means of such an institute, no further business was done at this meeting of the Organization Committee, and it was adjourned.

At the Annual Meeting of the RMCMI Board of Directors held June 29, 1985, the following amendments to the corporation bylaws Article III were made: Section 2. Advisory Board. There shall be an Advisory Board of Directors which shall be com- posed of all former presidents of the corporation and of the unincorporated association, also known as The Rocky Mountain Coal Mining Institute, of which the corporation is the successor. The Advisory Board shall periodically review the philosophy and policies of the corporation and make recommendations concerning the same to the Board of Directors. The Advisory Board shall hold an annual meeting at the same place as and immediately pre- ceding the annual meeting of the members in each year and written notice stating the place, day, and hour of the meeting shall be given or mailed to each member of the Advisory Board at least thirty days prior to the date fixed for such annual meeting. The annual meeting of the Advisory Board shall be for the purpose of electing a chairman from among its members and the person so elected chairman shall also serve as a member of the Board of Directors of the corporation. The Advisory Board shall meet at such other times and conduct its affairs in such a manner as it shall determine from time to time by resolution. Section 4. Regular Meetings. A regular meeting of the Board of Directors shall be held immediately following the annual meeting of the members, at the site of the annual meeting of the members, the day and time to be fixed by the Board of Directors at its annual meeting immediately pre- ceding the annual meeting of the members in each year, without the necessity of any other or advance notice. Such regular meeting of the Board of Directors shall be for the purpose of considering committee appointments, and for the transaction of such other business as may come before the meeting. A regular meeting of the Board of Directors shall also be held in the Fall of each year following the annual meeting of the members and written notice stating the place day and hour of the meeting shall be given or mailed each member of the Board of Directors at least thirty days prior to the date fixed for such regular meeting. Such Fall regular meeting of the Board of Directors shall be for the purpose of receiving the treasurer's annual financial report of the previous fiscal year as reviewed and approved by the auditor, to take action on the budget, and for the transaction of such other business as may come before the meeting. Section 8. Standing Committees. The Board of Directors may create by resolution adopted by a majority of the entire Board of Directors, a Bylaws and Resolutions Committee, a Nominating Committee, a Finance Committee, and one or more other committees each of which shall consist of two or more directors and which shall have and may exercise such authority in the management of the corporation as shall be provided in such resolution or in these bylaws. Section 9. Ad Hoc committees. The Board of Directors from time to time may by resolution create a Membership Committee, a Scholarship Committee, an Education Committee, various convention committees, and one or more other committees each of which shall consist of members of the corporation and which shall have and may exercise such authority, other than in connection with the management of the corporation, as the Board of Directors may determine. Margolf at 1:35 p.m. Tuesday, July 2, 1985 in the Windom Peak Room of the Tamarron Resort near Durango, Colorado. Thirty members were present and a quorum was established. It was moved by Bill Balaz, seconded and car¬ried to dispense with the reading of the minutes as these were published on pages 67 thru 77 of the 1984 issue of the Proceedings. The chair called for reports of the various com¬mittees and these reports will be placed on file in the RMCMI Office. Bylaws and Resolutions. Chairman Loren V. Linville reported that the Board of Directors had adopted changes to Article III, Sections 2, 4, 8 and 9 calling for clarification of Ad Hoc and Standing Committees as well as setting forth a purpose for the Advisory Board meetings and stating a time for an annual meeting.
